The Committee discussed the use of Coldstream tennis courts for pickleball and the potential impacts from the noise on nearby residents. Challenges to noise mitigation were considered, including the cost and effectiveness of barriers, as well as enforcement. It was suggested that signage be posted at local parks to identify and encourage respectful conduct.

Safety Concerns at the Coldstream Market The Committee discussed safety issues at the Coldstream Market when the fuel tanks are filled. A resident has expressed concern with traffic safety as the truck has to back out onto Kalamalka Road, creating conflict with vehicular and pedestrian traffic. It was advised that the fuel transport and operation falls under the jurisdiction of the Motor Vehicle Act and is outside the scope of the District, but that the Chief Administrative Officer would liaise with the complainant and the RCMP to attempt to mitigate the issue.

1. Purpose:
The report reviews and makes recommendations on five Planning and Development Policy documents.
2. Recommendation: THAT the Committee of the Whole recommends that Council rescind Policy No. PLD 014 – Zoning of Subdivision Applications;
AND THAT the Committee recommends that Council rescind Policy No. PLD 017 – Exemptions to Development Variance Permits; AND THAT the Committee recommends that Council rescind Policy No. PLD 022 – Preliminary Layout Subdivision Reviews; AND THAT the Committee recommends that Council rescind Policy No. PLD 026 – Middleton Mountain Outline Plan; AND FURTHER THAT the Committee recommends that Council rescind Policy No. PLD 031 – Submissions of Applications to the Provincial Agricultural Land Commission.
3. Alternatives & Implications Option #1: Council could opt to proceed based on Administration recommendation, rescinding the mentioned policies. Option #2: Council may opt to only rescind some of the policies, and to either keep or recommend alterations to them. That is not recommended with any of the policies recommended for deletion; all the recommended deletions involve policies which actively contradict municipal bylaws or provincial legislation.

Option #3: Council could opt to rescind one, two or all of policies PLD 020, 024 or 028 Staff are not recommending that these policies be rescinded. They are valuable policies that reflect modern legislation and help guide staff in day to day activities.
4. Discussion/Analysis PLD 014 – Zoning of Subdivision Applications This policy “requests” that the Approving Officer refuse subdivision applications for a property that isn’t appropriately zoned. This policy, despite being couched as “request”, appears to feter the Approving Officer, which is not something which Councils not advised to do. In the event that the AO rejects a subdivision, the applicant might point to this policy and suggest that it created undue influence on the part of Council. In the newest version of the Zoning Bylaw, Council has established minimum lot sizes for subdivision. This is the appropriate way to guide an Approving Officer because it is through a bylaw. With those restrictions in the bylaw, this policy is no longer required, and may do more harm that good in the event of a challenge. The bylaw in place accomplishes the same thing as this policy, but in a safe way. PLD 017 – Exemptions to Development Variance Permits This policy directs Administration to process variance permit requests requiring a variance to the 15m creek setback as DVPs, but that they only be issued in conjunction with the Development Permit. Both the District’s Official Community Plan and the Provincial Riparian Areas Regulation supersede this policy. The District also no longer has a blanket 15 m setback, but instead follows provincial methodology. It is no longer current, it is no longer relevant, and cannot be followed without contravening the provincial regulations which supersede it. It should be rescinded. PLD 020 - Naming of Roads This policy requires that roads in major developments be named according to themes, rather than individual names. This policy is not problematic, though Council may wish at a future date to provide additional details or examples, or to develop a list of appropriate themes. PLD 022 – Preliminary Layout Subdivision Reviews This is another policy that appears to fetter the independence of the Approving Officer. The Preliminary Layout Review process is technically an unofficial process, and by codifying it through Policy, Council runs the risk of being seen as interfering with the Approving Officer. It also makes the PLR process mandatory, and most subdivisions processed by Coldstream are lot adjustments that do not require PLRs. It also puts the approval of extensions to a Preliminary Layout Review in the hands of Council. This is an unfair position to put Council into, as unless Council says yes, it is immediately putting itself at risk of challenge for fettering the AO. The policy puts Council in a position where it has to engage in

a sort of consideration theatre, but the outcome is predetermined unless Council wants to risk a legal challenge it would likely lose. This policy should be rescinded to protect Council and the District from challenge, and instead, the AO should simply refer to the LGMA’s Guide for Approving Officers and legal advice where required. PLD 024 – Matters to be referred to the Advisory Planning Commission This Policy sets up which files are referred to the Advisory Planning Commission. This is a very useful policy, as it determines what is forwarded to APC. Because Policies are not widely known or publicized, at some point, Council may wish to consider shifting this language from a Policy to the Development Procedures Bylaw for better visibility, but staff don’t see this as a priority at this time. PLD 026 – Middleton Mountain Outline Plan This policy outlines the Middle Mountain development plan. Under no circumstances should land use documents ever be adopted by policy. This policy is inappropriate and has no force. It contradicts what Council has adopted in subsequent OCPs, and does not match the development that actually occurred. It also states that it will provide a guide for future Zoning Amendments, which cannot be lawfully done through policy. It references the defunct Municipal Act, rather than the current Local Government Act. It should be rescinded. PLD 028 – Strata Conversion Policy Strata Conversions of previously occupied buildings are at the discretion of this Council. This Policy complies with the most recent Strata Property Act. It is a valuable policy in guiding what applicants need to present to Council, and is helpful for staff in putting together supporting reports. There is no reason to rescind or amend this policy, and staff believe that it serves a valuable purpose. PLD 031 – Submissions of Applications to the Provincial Agricultural Land Commission This policy indicates that when an ALR application is endorsed by Council, all information will be submitted to the ALC for consideration except the staff report. There is an exception if the ALC requests the staff report. By default the ALC always requests a staff report, and will not accept submissions without an attached staff report. This policy appears to have been rendered meaningless, as the ALC automatically requires staff reports, triggering the policy exemption. This policy serves no purpose and if staff were to hold to it, would prevent any applications for non-farm use or other ALC applications from being considered in Coldstream.
5. Strategic Objectives Good governance has been identified as a Council priority. Cleaning out outdated policies is a sound practice.
6. Legislative Authority Policies are enacted by local governments as a tool to guide staff in operational matters. Unlike bylaws, they are not regulatory tools, but instead can be seen more as tools of internal guidance.

When a policy conflicts with a Bylaw, it puts staff in the difficult position of having to gauge between two appositional directives from Council.
7. Financial Implications
There are no financial implications associated with any of the policy recommendations in this report.

POLICY STATEMENT This policy is subject to any specific provision of the Municipal Act, or other relevant legislation or Union Agreement.
In addition to following the requirements of the Land Title Act with respect to the review, approval or refusal of applications for approval of subdivisions, the Approving Officer shall, where a subdivision may be approved pursuant to all applicable legislation and bylaws, issue to the applicants for subdivision approval a synopsis of requirements to be satisfied prior to subdivision approval. Said synopsis shall be issued as a courtesy and shall hereafter be known as a Preliminary Layout Review (PLR). Applicants may have a period of one year to meet the PLR requirements for all subdivisions of less than fifteen lots and may have a period of one and onehalf years to meet the PLR requirements for all subdivisions of fifteen lots or more.
Notwithstanding this proviso the Approving Officer may, if having received a written request by the owner, prior to the expiration of the time periods discussed above, extend the preliminary layout review period for one more year. Extensions shall not be granted, however, where a preliminary layout review, or extension thereto, has expired unless the Approving Officer is authorized to issue said extension by Council after considering any special circumstances presented to them by the applicant."

POLICY STATEMENT This policy is subject to any specific provision of the Local Government Act and the Community Charter, or other relevant legislation or Union Agreement.
Pursuant to Section 898, the Local Government Act provides that Council may by bylaw establish an Advisory Planning Commission to advise Council on all matters respecting land use, community planning or proposed bylaws and permits under Divisions 2, 7, 9, and 11, of Part 26 of the Local Government Act;
Whereas Council has established an Advisory Planning Commission:
1. The following matters shall be referred to the Advisory Planning Commission for advice to Council:
a. Official Community Plan Review
b. Official Community Plan Amendments
c. Zoning Bylaw Review
d. Zoning Bylaw Amendments, which involve more than one property
e. Form and Character Development Permits (e.g. Industrial, Multiple Family, Seniors Housing, Commercial)
2. When directed by Council, the following matters shall be referred to the Advisory Planning Commission for advice to Council:
a. Agricultural Land Reserve Exclusions, Subdivisions, and Non-Farm Use
b. Heritage Revitalization Agreements
c. Amendments to, or preparation of, Neighbourhood or Area Plans
d. Amendments to, or preparation of, Strategic Plans
e. Amendments to, or preparation of, other land use-related bylaws and policies
f. Any other planning related matter.

The Plan will also be used to establish the basic level of servicing that will be required to accommodate new developments within the Plan Area. It is intended that the Plan will form the basis for future approvals of amendments to the District of Coldstream Official Community Plan as well as the basis for future rezoning and subdivision approvals.

3.0 SERVICES
3.1 Major Roads (Present)
It is the policy of the Council of the District of Coldstream:
1. To require that MiddletonVVay be located as shown on the District of Coldstream Official Community Plan and li1jg!jf~~-
2. To require that all future subdivisions within the Plan Area be connected to Middleton Way via a road dedicated and constructed to District of Coldstream Collector Road standards.
3. To require the dedication, construction and servicing of Middleton Way through to Middleton Drive/Sarsons Road when the College Way/Kalamalka Road Major Road connection is completed.
4. To enter into a latecomer agreement with any developer who is required to construct Middleton Way through to Middleton Drive/Sarsons Road in accordance with 3. above.
5. To require a collector road connection from Mt. Thor Drive back to Middleton Way at the closest point to Mt. Thor Drive that will meet District of Coldstream road design standards.
6. To prohibit direct access to any lot from any Major Road that is required to be dedicated within the Plan Area except that some additional direct access may be required in order to facilitate an orderly transition of lot design near the present terminus of Middleton Way .

3.2 Major Roads (Future)
It is the policy of the Council of the District of Coldstream:
1. To establish a new Major Road link from the Kidston Road/Kalamalka Road intersection through to the Husband Road area as shown on l'1i!;IU\'e~-
2. To require that this new Major Road be dedicated 25 m wide and be constructed to District of Coldstream Collector Road standards. If an underpass is required to be constructed as part of this Major Road, it would be constructed to accommodate two lanes of traffic and would be designed to be expanded to a four lane standard at a later date.
3. To require the dedication and construction of this road as a condition preced,ent to any subdivision or rezoning approvals for the lower slope area shown on [Blggt~~,.
4. To prohibit direct access to this Major Road from any future lots subdivided within the Plan Area.
5. To amend the District of Coldstream Official Community Plan to include any revisions to the Major Road Network deemed necessary pursuant to 1. above.
3.3 Collector and Local Roads
It is the policy of the Council of the District of Coldstream:
1. To require the collector road connections shown on fiflll,~~ as a condition precedent to rezoning or subdivision approval.
2. To require that all new development within the Plan Area be provided with a collector road connection directly to Middleton Way or with a connection to the Major Road referenced in Section 3.2., Policy No. 1 above.
3. To require the extension of Apple Drive, through to Middleton Way, in order to satisfy the concerns of the North Okanagan Regional District Fire Prevention Officer/Emergency Services Coordinator as expressed in Section 3.10 of this Plan.
3.4 Community Sewer
It is the policy of the Council of the District of Coldstream:
1. To require an engineering study of the capacity of the sewer line located in Kalamalka Road as a condition precedent to approval of any rezoning applications that are located outside the old "Vernon/Coldstream Sewer Agreement Area" shown on ITciQur~Jll,. The engineering study must be carried out by an engineering firm approved by the District, and the study will be carried out at the applicant's expense.
2. To require that the community sewer connection to Kalamalka Road be assured, as a condition precedent to rezoning or subdivision approval, with particular respect to the requisite rail crossings.
3. To investigate the need for additional development cost charges in the Plan Area to upgrade existing sanitary sewer facilities.

3.5 Community Water
It is the policy of the Council of the District of Coldstream:
1. To allow subdivisions and to grant rezoning only for those areas of the Plan Area that have fire flow capacity meeting the requirements of the Regional Fire Prevention Officer.
2. To support new North Okanagan Water Authority development cost charges for water supply infrastructure to serve the Plan Area and to coordinate District of Coldstream development cost charges for off-site works that may be required by the District.
3. To require the looping of the Middleton Way transmission main through to Aberdeen Road when Middleton Way is constructed through to Middleton Drive as discussed in Section 3.1 (Policy No. 2) above.
3.6 Storm Water Management/Drainage
It is the policy of the Council of the District of Coldstream:
1. To require the preparation of a stormwater management plan as a condition precedent to rezoning or subdivision approvals within the Plan Area. The stormwater management plan shall: • Demonstrate the means of controlling post-development runoff rates to pre-development
levels for all storm events up to and including the 100-year return period design storm event.
• Identify the route of stormwater runoff from the proposed development to a receiving watercourse with sufficient capacity.
• Identify improvements which will be undertaken to protect downstream property owners from the potential drainage impacts of the proposed development.
• Identify measures to control erosion and sedimentation during and after the construction of the development.
2. To require the acceptance of the stormwater management plan by both the Water Rights Branch and Fish and Wildlife Branch of the Ministry of Environment where stormwater will discharge to a natural watercourse.
3. To require that all stormwater be conveyed to Coldstream Creek, or another suitable receiving watercourse, as a condition precedent to rezoning or subdivision approvals within the Plan Area. In this regard the approval of the Canadian National Railway must be provided with respect to the requisite railway crossings.
3.7 Electric Power, Telephone and Cable TV Wiring Services
It is the policy of the Council of the District of Coldstream:
1. To require that all electric power, telephone and cable TV wiring services be installed underground.
2. To phase subdivisions and to grant rezoning in phases that will facilitate servicing with electric power and telephone wiring services from Middleton Way.
3. To require the looping of all electric power and telephone wiring services through to Aberdeen Road when and if the Middleton Way extension is provided as discussed in 3.1 above.

3.8 Parkland
It is the policy of the Council of the District of Coldstream:
1. To reguire that a neighbourhood park, and other park areas be dedicated, as shown on Eiig_ur~;t5.. The park dedication shall be provided as a condition precedent to subdivision approval.
2. To require that all new multi-family development within the Plan Area be provided with open space and play areas meeting Central Mortgage and Housing Corporation standards.
3.9 Open Space
It is the policy of the Council of the District of Coldstream:
1. To require that covenants be registered to prohibit further subdivision, intensive agricultural use, or other disturbance (soil removal or deposit, etc.) of areas designated as "Open Space" on the District of Coldstream Official Community Plan. The covenants shall be registered as a condition precedent to rezoning property located within the Plan Area.
3.10 Natural Hazards, Emergency Access, Fire Protection
It is the policy of the Council of the District of Coldstream:
1. To not approve any subdivisions or rezoning of the lower slopes of Middleton Mountain to Residential Apartment and Multi-Family Zone (R.3) until an alternate means of access to these areas is available to the area as discussed in 3.2 above. This alternate road connection may be achieved in a number of ways as discussed above.
2. To require that a geotechnical study of the Outline Plan Area be carried out as a condition precedent to subdivision approval and/or rezoning, as the case may be, to determine whether or not the area is, or may be, subject to the hazard of landslip, rockfall, flood by surface or sub-surface water flows, etc ..
3. To require that covenants be registered to prohibit subdivision or other disturbance (soil removal or deposit, etc.) of any hazard areas determined as a result of the above-mentioned geotechnical study. The covenants shall be registered as a condition precedent to rezoning property that is located within the Plan Area.
4. To ensure that new development within the Plan Area will be serviced with a community water system meeting the fire flow requirements of the District of Coldstream with particular respect to multi-family development.

POLICY STATEMENT This policy is subject to any specific provision of the Municipal Act, or other relevant legislation or Union Agreement.
As per the Strata Property Act, or legislation replacing the same, Council is the approving authority for strata conversions of properties. As such, the following is the policy of Council for strata conversions.
a. Certification by a Professional Engineer or Architect certified in the Province of British Columbia, that the building(s) substantially complies with all current municipal bylaws and with the BC Building Code and BC Fire Code.
b. Proof must be submitted showing that existing tenants have been notified by the applicant of their intentions to pursue strata titling the subject property.
c. Provision of separate water and sewer connections and payment of appropriate fees.
d. Consent is obtained from all utility companies that their concerns have been met.
e. Approval for strata conversion is valid for up to 364 days from the date of Council approval.
f. Confirmation by the Approving Officer, on behalf of Council, that all conditions typically required in conventional subdivisions have been fulfilled and that the regulations pertaining to strata conversion in the Strata Property Act or legislation replacing the same, have been complied with.
g. Payment of the application fee, inspection fee, and other applicable fees.

Staff have provided additional comments in the attachment to facilitate the discussion. As well, a recommendation has been provided to either Retain or Delete a particular item. In a couple of cases, where an item is indicated to be retained, further Council discussion is needed to confirm the direction.

SUBJECT: 2021 UBCM - Ministerial Meetings and Council Attendance
1. Purpose:
For Council to determine the Minister meeting requests at UBCM and authorize the members of Council to attend.
2. Recommendation:
THAT the Committee of the Whole recommends to Council that staff request meetings with the necessary Ministries as identified by Council;
AND THAT the Committee of the Whole recommends to Council that all members of Council be authorized to attend UBCM.
3. Alternatives & Implications
There are a couple of options for Council to consider.
Option #1: Identify the Issues for Minister Meeting Requests and Approve Council attendance With this option Council needs to determine which issues it would like to raise with the Ministers so that we can submit our meeting requests. The number of councillors, and names if possible, must be authorized for attendance.
Option #2: Do Not Request Minister Meetings but Approve Council attendance With this option Council would not request any Minister meetings but would approve the number of councillors, and names if possible, for attendance at UBCM.
Option #3: Do Nothing
With this option no Minister Meetings would be requested and no members of Council would attend UBCM. This would prevent staff from requesting any meetings at UBCM and Council from attending UBCM. Should a member of Council wish to attend, a resolution would be needed prior to attendance at the convention .
4. Discussion/ Analysis
The 2021 UBCM Convention is scheduled to take place virtually from September 14-17. All Ministerial meetings will be held via conference call September 7-13, 2021. The District recently

received notification from the Provincial Government on the process to request a meeting with the Premier or a Cabinet Minister (Attachment "A"). The deadline for meeting request is June 30, 2021.
At the 2020 UBCM convention, Council had requested the following ministerial meetings:
Ministry of Public Safety & Solicitor General (Mike Farnsworth)
Integrated Police Detachments are a structure used by the RCMP to improve efficiency of delivering police services. However, there are two major concerns. First, Integrated detachments are not contemplated in the Municipal Policing Unit Agreement (MPUA) and second, there are no governance provisions for how integrated detachments are managed. This is especially concerning where there are multiple MPUA's, who pay the bills and provide the service, in an area where an integrated detachment has been implemented. Aside from appearing to be in contravention of the MPUA, the lack of a proper governance model creates inequities in how police services are developed, managed and delivered.
Ministry of Children & Family Development (Katrine Conroy)
The District of Coldstream has submitted a grant application under the Childcare BC News Spaces Fund for the Coldstream Child Care facility. The lack of child care services in our community has been a concern for several years. A recent child care needs assessment confirmed there is a significant lack of available child care in our community. The needs assessment showed there are 1,385 children under the age of 12 in our community but only 256 spaces available. We hope the Ministry will look favorably on our grant application as we strive to improve the available child care spaces in our community.
We would also like to take this opportunity to thank the Ministry for the child care grant we received for the Lavington Child Care Facility, with funding from the Childcare BC New Spaces Fund.
Prior to the convention the Ministry of Children and Family Development cancelled our meeting.
Council had also requested a meeting with the Minister of Municipal Affairs & Housing but the Minister declined our meeting request. The discussion at this meeting would have considered traffic enforcement initiatives including possible legislative changes.
The purpose of this report is to highlight some of the local issues we have been facing and identify if there are any issues that we need to bring forward to the Provincial Government. Some of the issues locally that we have been dealing with include:
• Speeding - How do we find ways to enforce speed limits outside of RCMP resources?
• Conservation Officers - Enforcement activities on the lake. There is a need for additional CO's.
• ALR/ ALC - Recent changes affecting a variety of issues (Cannabis, Additional housing, Farm worker housing).
