Requirements throughout the states and D.C. that charities register with authorities--or be exempt--everywhere they solicit

Why Comply With The Laws

• IRS Form 990• Criminal & civil penalties, e.g.:

-- FL: 3rd degree felony; 5 yrs/$5000 & narrow exemptions

-- AZ: Class 1 misdemeanor & scant exemptions-- IL: civil fine; $500 to $1,000-- PA: 1st degree misdemeanor; $10,000; 5 years-- GA: civil fine; $25,000 -- NJ: civil penalty up to $10,000-- DC: civil fines, penalties, fees-- VA: misdemeanor; 1 yr/$1000 fine

- Passive solicitation

- DC, VA, FL, AZ, NY, IL, PA, GA, others

- email, US mail, phone, ads, meetings, etc.

- Active solicitation

- CA, TX, MD, UT, WA, WI, others

• Ask for charitable support by- Email- US Mail- Meetings- Events- Advertisements

• These are a solicitation in nearly every state

Even If You Are Soliciting

• You might be exempt• Exemptions vary drastically across states

-- Mission, with qualifications

-- Gross revenue

-- Gross fundraising revenue

-- Revenue from within the state (kindest)
