ThePrinceEdwardIslandBuildingCodesActwaspassedinspring2017.TheBuildingCodesActanditsRegulationsadopttheNationalCodeofCanada;outlinetherequirementsandproceduresforissuingandacquiringbuildingpermits;andlisttherequirementsforthequalificationsrequiredofbuildingofficials.TheintentoftheBuildingCodesActRegulationsistodetailtheminimumbuildingstandardsacceptabletomaintainthesafetyofbuildings,withregardtothe
i. design,construction,erection,placement,useandoccupancyofnewbuildings;ii. alteration,demolition,removalandrelocationandchangestotheuseandoccupancyof
existingbuildings;andiii. worknecessarytocorrectunsafeconditionsinexistingbuildings.
PART1-INTERPRETATIONANDAPPLICATION
Part1givesthedefinitionsanddescribeshowthecodeswillbeapplied.TheNationalBuildingCodeofCanada,2015,andtheNationalEnergyCodeofCanadaforBuildings,2017havebeenadopted,includingallrevisions,amendmentsandcorrectionsmadebytheCanadianCommissiononBuildingandFireCodes,andtheNationalResearchCouncilofCanada.
Division1-DefinitionsAct-meanstheBuildingCodesActR.S.P.E.I.1988,Cap.B-5.1;Building-meansanystructureusedorintendedforsupportingorshelteringanyuseoroccupancy;BuildingArea-meansthegreatesthorizontalareaofabuildingabovegradewithintheoutsidesurfaceoftheexteriorwallsorwithintheoutsidesurfaceofexteriorwallsandthecentrelineoffirewalls;BuildingCode-meanstheNationalBuildingCodeofCanadaadoptedundersection2;
Constructor(fromAct)-meansapersonwhocontractswithanownertoundertakeordirectaprojectonbehalfoftheowner,andincludesanownerwhocontractswithmorethanonepersonfortheworkonaprojectorpersonallyundertakesordirectstheworkonaprojectorpartofaproject;

overseeingandcoordinatingtheworkofalldesignprofessionalsorconsultantsinvolvedinaprojecttoensuretheoverallplansandspecificationsmeettherequirementsoftheActandtheseregulations;
Subcontractor-meansapersonwhoundertakestheworkonabuildingconstructionprojectoranypartofsuchaprojectunderthedirectionoftheconstructor;
Professional(fromAct)-meansaprofessionalengineerorarchitect;
Work-meansanyconstruction,dutyorfunctionofaconstructor,subcontractorortradespersonregulatedbytheseregulationsorthecodes,andiscarriedoutonoraboutaconstructionsite,buildingorpartofabuilding;
Fieldreviewofconstruction-meanstheinspectionofconstructionworkatappropriateintervalsataprojectsiteandatanyplacewherebuildingcomponentsaremadeforuseattheprojectsite.Thefieldreviewofconstructionistoensureworkcomplieswiththedesigndrawingsmadebytheprofessionalengineerorarchitectandtheauthorityhavingjurisdiction.Thefieldreviewofconstructiondoesnotinvolvecoordinatinganyconstructionworkandisnotconsideredaguaranteeofthequalityorperformanceoftheconstruction.
Division2– CodesadoptedTheBuildingCodeandtheEnergyCodeareformallyadoptedintotheRegulations.CertainmodificationstotheBuildingCodearespecifiedinSchedulesAandBtotheregulations.Division3-ApplicationandexemptionsTherationaleforexemptingbuildingsthatlawfullyexistedpriortothecomingintoforceoftheregulationsareexplained.Aboveallelsesuchbuildingsmustbedeterminedtobesafe.Whereapermithasalreadybeenissuedforthealterationtoabuildingthenewregulationswillonlyapplytothepartsofthebuildingthatarebeingaltered,repaired,relocated,ordemolished.The“AlternativeComplianceRequirementsforExistingBuildings(ScheduleB)maybeusedforrenovationstoabuilding,includingaheritagebuilding,thatexistedpriortothecomingintoforceoftheseregulations,exceptwhereachangeofoccupancyclassificationresultsinanoccupancywithanincreasedfirehazardrisk.OtherexemptionsAseriesofexemptionsarealsoprovidedthatrelateto
i. sewage,water,electrical,telephone,railorsimilarsystems;ii. publicutilitytowersandpoles,televisionandradioorothercommunicationaerialsandtowers,
exceptthoselocatedonorattachedtobuildings;iii. floodcontrol,damsforpublicwatersupply,andhydroelectricdams;iv. above-groundorbelow-groundbulkstoragetanksnotregulatedunderPart6oftheBuilding
CodeortheNationalFarmBuildingCodeofCanada,1995,issuedbytheCanadianCommissiononBuildingandFireCodes,NationalResearchCouncilofCanada;
v. abuildingthatiswithinthescopeoftheNationalFarmBuildingCodeofCanada,1995,issuedbytheCanadianCommissiononBuildingandFireCodes,NationalResearchCouncilofCanada;
vi. free-standingsigns;vii. fences;viii. retainingwallsorexteriorstepsnotattachedto,andformingpartof,abuilding'sconstruction;

ix. interiorandexteriornon-structuralmaterialalterationsandmaterialrepairstoabuildingwithin
thescopeofDivisionBofPart9oftheBuildingCode(refertoRegulationsforfulldetails);x. abuildingusedforaresourcewheretheoccupantloadisexpectedtobenotmorethanone
personforeach40squaremetresoffloorareaduringnormaluse;xi. accessorybuildingsnotgreaterthan20squaremetres(215.2squarefeet)inareaxii. single-storeyexteriorwoodendeckforresidentialusethatislessthan600millimetersabove
groundlevelandlessthan55squaremetersinareaanddoesnotsupportaroof;xiii. tentserectedforatemporarypurpose(refertoRegulationsforfulldetails);xiv. ForbuildingsthatfallunderthescopeofPart3oftheBuildingCode,interiorandexteriornon-
structuralmaterialrepairsormaintenancewithamonetaryvalueof$10,000orless.Home-basedbusinessesPermitsarerequiredfortheconstructionorrenovationofadwellingunitforthepurposeofrunningahome-basedbusiness,orforachangeofuseforahome-basedbusiness.Plans,drawingsandotherinformationmustbesuppliedtothebuildingofficialassessingtheproposedhome-basedbusiness.Informationwillbeneededtodeterminethe
i. typeofbusinessuseofthedwellingunitandtheconfirmationofitsresidentialstatus;ii. thetotalfloorareaofthedwellingunitandthepercentofthefloorareatobeusedasthe
home-basedbusiness.
Apermitwillbeissuedifthebuildingofficialissatisfiedthattheapplicant’sproposedhome-basedbusinesswillmeetallofthecriteriaspecified.Thispermitwillnotbetransferable.PART2–PERMITSPart2providesinformationontheprocessforgrantingpermits,makingfeepayments,providingnoticeofwork,andownerandcontractorresponsibilitiesandexemptions.Division1-GeneralPermitsPermitsarerequiredforallbuildingworkregulatedbythecodes,includingachangeofoccupancyorachangeofbuildinguse.Apermitfeebasedonthecostingstandardoftheauthorityhavingjurisdictionwillbecharged.TheacceptedcostingstandardfortheprovincialgovernmentisthatsetoutinScheduleC.Wheretheauthorityhavingjurisdictionisthecouncilofamunicipality,thefeeisestablishedbythecouncilforthatmunicipality.BuildingpermitscanbewithhelduntiladevelopmentpermithasbeengrantedwithrespecttoSubdivisionandDevelopmentRegulations(EC693/00)underthePlanningActorabylaw.Whereamobileormodularhomehasfallenintodisrepair,orbeenmodifiedinsuchawaythatitnolongermeetstherequirementsoftheCSAstandardtowhichitwasoriginallybuilt,abuildingauthoritymaystillissueabuildingpermitafterthefact,providedthemobileormodularhomeissafeforoccupancy.Ifthepropertyisconsideredunsafeabuildingpermitmaybeissuedtoremedyanyunsafecondition.Anoccupancypermitisrequired
i. toallowtheinitialoccupancyofabuildingorpartofabuilding;ii. whentheoccupancyclassificationofabuildingorpartofabuildingischanged;or

iii. toallowpartialdemolitionoralterationofabuildingwhilethebuildingisstilloccupied.
Whereanownerrequiresoccupancytooccurbeforeallworkiscompleted,theownershalli. applyfortheoccupancypermitandpaytheapplicablefeesetoutinScheduleC;andii. ensurethatnounsafeconditionexistsorwillexistbecauseoftheworkbeingundertakenor
notcompleted.GettingapermitBeforeapermitcanbegiventoanapplicanttheymustprovide:
i. detailoftheworkandoccupancytobecoveredbythepermitforwhichapplicationismade;ii. buildinglotidentificationusingpropertymapping,auniqueparcelidentifier,aPIDforthe
lot,oradescriptionofthepermitslocation;iii. allplansandspecificationsrequiredbysections2.2and2.3ofDivisionCoftheBuilding
Code,includingasiteplan,afoundationplan,afloorplan,aframingplanincludingfloorandrooftrusslayout,buildingelevations,adeckframingplanandcross-sections,asapplicable;
iv. avaluationoftheproposedworkandtheproposedstartdate;v. contactinformationoftheowner,architect,professionalengineerorotherdesigner,the
constructor,andanyagencyengagedtomonitortheworkorpartofthework;vi. adescriptionofbuildingsystems,materialsandappliancestobeusedinthework;vii. anyinformationrequestedtheauthorityhavingjurisdiction;andviii. thefeerequiredbytheauthorityhavingjurisdiction.
RequirementswhenprofessionaldesignisrequiredWhereabuildingorpartofabuildingistobedesignedbyaprofessional,theownermustalsoprovide
i. professionallydesignedandstampeddrawingsorplans;ii. aBuildingCodedesignreviewpreparedbytheprofessional;iii. aletterofundertakingbytheownerintheapprovedformat;andiv. theapplicabledeclarationsinwritingfromtheprofessionalresponsibleforthedesignand
itssubsequentimplementation.
Changestothebuildingthatdepartfromrequirementsofthecodes,regulations,ortheconditionsofapermit,arenotallowedwithoutfirstobtainingpermissioninwritingfromtheauthorityhavingjurisdiction.Note:Theprofessional(architectand/orprofessionalengineer)mustbelicensedtopracticeinPrinceEdwardIsland.LandsurveyorlocationcertificateAnownerwillsubmit,ontherequestofabuildingofficial,anup-to-dateplanofalotsurveyorsurveyor’slocationcertificate,preparedbyalandsurveyorwhoisamemberoftheAssociationofPrinceEdwardIslandLandSurveyorsto
i. establishbeforeworkbeginsthattherequirementsofanyActorregulationrelatedtothesiteandthelocationofthebuildingwillbecompliedwith;and
ii. verify,oncompletionofthework,compliancewiththerelevantActsorregulations.
ResponsibilityTheowner,owner’sagentorconstructorshallensurethatallprofessionalsinvolvedintheworkwill

providethebuildingauthorityhavingjurisdictionalltheinformationrequiredbytheregulations.Furthermore,theowner,owner’sagent,constructor,primeconsultantandotherprofessionalsinvolvedintheworkwillbearalltheresponsibilityforcarryingouttheworkorhavingitcarriedoutinaccordancewiththeseregulations,thepermit,andthecodes.SitegradingThebuildingofficialmayrequireanownertogradetheirpropertytoconformtoanystormwatermanagementordrainageplaninforce.PermissiontoproceedPermissiontoproceedwithexcavationorconstructionwillonlybegrantedaftertheplansfortheentirebuildingsitehavingbeensubmittedandapproved.Anyspecialpermissiontoproceedwithapartialexcavationorconstructionofabuildingisnotanassurancethatapermitforanyotherworkontheprojectwillbegranted,orthattheprojectasawholewillbeapproved.Whenworkhasbeencompletedtheownermustnotifytheauthorityhavingjurisdictionandmustnotproceedwithanyfurtherworkuntilanewpermithasbeenissued.OccupancypermitAnoccupancypermitmaybegivenbeforecompletionofbuildingworkiftheauthorityhavingjurisdictionissatisfiedthatthebuildingissafetoinhabit.Anoccupancypermitisrequired
i. toallowtheinitialoccupancyofabuildingorpartofabuilding;ii. whentheoccupancyclassificationofabuildingorpartofabuildinghaschanged;oriii. toallowpartialdemolitionoralterationofabuildingwhilethebuildingisstillbeing
occupied.
Ifanownerasksforoccupancybeforeallbuildingworkisfinished,theownershalli. applyfortheoccupancypermitandpaytheapplicablefeesetoutinScheduleC;andii. ensurethatnounsafeconditionexistsorwillexistbecauseoftheworkbeingundertakenor
notyetcompleted.TemporarybuildingoroccupancyInspecialcircumstancesabuildingofficialmayissueapermitinselectivecompliancewiththecodesandauthorizespecificexemptionsthatapplyto
i. theerectionandexistenceofatemporarybuilding,orpartofatemporarybuilding;orii. atemporarychangeofoccupancyclassificationforanoccupancywhich,becauseofits
nature,willexistforashorttimeonly.Division2-ResponsibilitiesandObligationsAnownershallensurethatallrequiredpermitsorapprovalsareobtainedpriortocommencingtheworktowhichtheyrelate.NoticebyownerorconstructorTheowneroraconstructormustprovidetheauthorityhavingjurisdictionofanychangetothestartupdateonthebuildingsite.Theymustalsogivenoticeinwritingtotheauthorityhavingjurisdictionof

i. thename,addressandtelephonenumberoftheconstructororotherpersoninchargeof
thework,ii. theprimeconsultantandotherprofessionalswhowillreviewaspectsofthework,andiii. anyinspectionortestingagencyengagedtomonitortheworkorpartofthework;andiv. anychangeinorterminationofemploymentofapersonaboutwhomnoticewasgiven
duringthecourseoftheconstruction,assoonaspracticablebutnotlaterthan3daysfollowingthechangeortermination.
NoticeofchangesInordertoreceiveanoccupancypermittheowneroraconstructormustgivenoticeinwritingtotheauthorityhavingjurisdiction
i. assoonasanychangeinownershiporchangeintheaddressoftheowneroccursbeforeitcanreceiveanoccupancypermit;and
ii. priortooccupyingthebuilding,oranyportionofit,shoulditbeoccupiedinstages.PlansatsiteAnowneroraconstructormustensurethatanyrequiredstampedplans,specificationsandrelateddocumentsonwhichtheissuanceofapermitwasbasedareavailableatthesiteoftheworkforinspectionduringworkinghoursbyabuildingofficialoftheauthorityhavingjurisdiction.Owner’sresponsibilityAnownerwhoundertakestoconstructabuildingorpartofabuildingtowhichPart3orPart4oftheBuildingCodeapplies,orabuildingover300squaremetresingrossareatowhichPart9oftheBuildingCodeapplies,mustconsultanarchitectandprofessionalengineertodeterminewhichprofessionalsareappropriateforthework.Theownerthenmustensurethattheappropriateprofessionalsareappointedtoundertakethedesignofthebuildingorpartofit.DesignrequirementsforstructuralcomponentsWherethedimensionsofastructuralcomponentarenotprovidedinPart9oftheBuildingCodeandthedimensionsaretobedeterminedbycalculation,testingoranothermeansofevaluation,theownermust
i. ensurethataprofessionalengineerishiredtoundertakethedesignofthestructuralcomponent;and
ii. provideanundertakingintheapprovedformatthatthestructuralcomponentwillbedesignedinaccordancewiththeBuildingCode.
Siteconditions,size,orcomplexityrequiringprofessionaldesignandinspectionWherethesizeorcomplexityofabuildingprojectrequireit,theauthorityhavingjurisdictionmayrequiretheownerto
i. hiretheappropriateprofessionalstodesignthebuilding,partofthebuildingorcomponentinaccordancewiththeBuildingCode;and
ii. ensurethattheappropriateprofessionalswillprovidethedeclarationsrespectingfieldreviewsofconstructionthatthebuildingofficialconsidersnecessary.

NotificationforinspectionTheownerofabuildingconstructedunderPart9oftheBuildingCodemustnotifytheauthorityhavingjurisdictionsotheycancarryoutinspectionsfollowing
i. constructionofthefootingsandthefoundation,beforecommencingbackfillingofthelaterallysupportedfoundation,andbeforeasuperstructureisplacedonthefoundation;
ii. framingandthebuildingenvelope,includinginsulationandvapourbarrier,beforethewallframingiscovered;and
iii. beforethefinalcompletionofthework.TimingofnotificationAnownermustnotifythebuildingauthoritynotlessthanthreedayspriortocompletionofthestageofconstructiontobeinspectedandnotlessthanthreedayspriortothefinalcompletionofthework.ModularandmanufacturedhomesModularandmanufacturedhomesaresubjecttoallinspectionsrequiredbyRegulation,butwillbeexemptfrominspectionsoftheworkcertifiedatthefactoryinaccordancewithCSAZ240MHSeries“ManufacturedHomes”orcertifiedtoaCSAStandardA277“ProceduresfortheFactoryCertificationofBuildings,”asapplicable.InspectionofprofessionallydesignedbuildingTheownerorconstructorofabuildingthatisrequiredtobeprofessionallydesignedmustnotifytheauthorityhavingjurisdictionsothatallrequiredinspectionsmaybemadeduringthework,andwhentheworkhasbeencompletedsothatafinalinspectionmaybemadepriortooccupancy.RepairstopublicpropertyAnownerisresponsibleforthecostofrepairofanydamagetopublicpropertyorpublicworkslocatedonpublicpropertythatisaresultoftheowner’sundertakingworkforwhichapermitwasorwasnotrequired.DiscontinuationofworkAnownerwhoisunabletocontinueorcompleteworkisresponsibletomaketheworksitesafebeforethesiteiscloseddown.DesignAnarchitectorprofessionalengineerwhodesignsabuildingorpartofabuildingmustensurethatthedesignmeetstherequirementsofthecodes.ReviewbyprofessionalAnarchitectorprofessionalengineerwhoundertakesareviewofconstructionmust
i. reviewtheworkatintervalsappropriatetothestageofconstructiontodeterminecompliancewithanapproveddesign;
ii. coordinatewiththeauthorityhavingjurisdictionofanychangestothedesigndocuments,plansorspecifications;and

iii. whensatisfiedthattheworkcomplieswiththedesigndrawings,providewritten
confirmationintheformatapprovedbytheMinister.
WorkonpublicpropertyAconstructorisresponsibleforensuringthatnoexcavationorotherworkisundertakenonpublicproperty,andthatnobuildingiserectedormaterialsstoredinwholeorinpartonpublicproperty,withoutapprovalhavingfirstbeenobtainedinwritingfromtheappropriategovernmentauthority.ResponsibilitiesfortheworkundertakenAconstructorisresponsiblejointlyandseverallywiththeownerforallandanyworkundertaken.DiscontinuancebyconstructorAconstructorwhoisunabletocontinueworkforanyreasonisresponsibleforensuringthatnounsafeconditionremainsatthesitebeforeleavingtheworksite.OwnerdeemedtobeconstructorWheretheworkforwhichapermitisissuedisnotunderthecontrolofaconstructor,theownerisconsideredtobetheconstructorwithrespecttothatwork,andtheresponsibilitiesandobligationsassignedtoaconstructorbytheseregulationsandthecodeswillapplytotheowner.Materials,systemstocomplywithcodesAconstructormustensurethatallmaterials,systemsandequipmentusedintheconstruction,alteration,reconstructionorrenovationofabuildingmeettherequirementsofthecodesfortheworkundertaken.PART3–BUILDINGOFFICIALSPart3specifiesthelevelsofauthorizationfortheappointmentofbuildingofficials;outlinestheirresponsibilitiesundertheregulations;anddetailspermitrequirementsandexemptionsDivision1-QualificationsofBuildingOfficialsThreeclassesofbuildingofficialarerecognized,andtheworktheyarepermittedtoinspectandapproveoutlinedbelow.ResidentiallevelappointmentApplicantsmustholdanAssociateResidentialDiplomaissuedbytheAllianceofCanadianBuildingOfficialsAssociation;orequivalentqualificationissuedbyaprovincialassociationthatisamemberoftheAllianceofCanadianBuildingOfficialsAssociation.Residentiallevelholdersmay:
(i) completeplanreviewsandinspectionsinrespectofbuildingsthataresingle-andtwo-familydwellingsunder600squaremetres,includingbuildingsaccessorytothedwellingsthatarewithinthescopeofPart9oftheBuildingCode,and
(ii) (ii)takeanyactionthatabuildingofficialisauthorizedbytheActtotakeinrespectofthosedwellings;

ApplicantsmustholdanAssociatePart9DiplomaissuedbytheAllianceofCanadianBuildingOfficialsAssociation;orequivalentqualificationissuedbyaprovincialassociationthatisamemberoftheAllianceofCanadianBuildingOfficialsAssociation.LevelIholdersmay:(i)completeplanreviewsandinspectionsinrespectofbuildingsthatarewithinthescopeofPart9oftheBuildingCode,and(ii)takeanyactionthatabuildingofficialisauthorizedbytheActtotakeinrespectofbuildingsthatarewithinthescopeofPart9oftheBuildingCode;LevelIIappointmentApplicantsmustholdanAssociatePart3DiplomaissuedbytheAllianceofCanadianBuildingOfficialsAssociation;or;orequivalentqualificationissuedbyaprovincialassociationthatisamemberoftheAllianceofCanadianBuildingOfficialsAssociation.LevelIIholdersmay:(i) completeplanreviewsandinspectionsinrespectofanybuildingthatiswithinthescopeofthe
BuildingCode,and(ii) (ii)takeanyactionthatabuildingofficialisauthorizedbytheActtotakeinrespectofany
buildingthatiswithinthescopeoftheBuildingCode.AppointmentofapreviouslyappointedbuildingofficialTheMinistermayconfirmtheappointmentofabuildingofficial,andspecifytheappropriatelevelonreceiptof
i. awrittenrequestfromtheauthorityhavingjurisdictionthatmadetheappointment;andii. satisfactoryevidenceoftheperson’sappointment,identityandqualifications.
AppointmentofaprofessionalTheMinistermayappointaprofessionalengineerorarchitect,whoisemployedbyanauthorityhavingjurisdiction,asaLevelIIbuildingofficial.ExpiryofappointmentTheappointmentofabuildingofficialexpiresontheterminationofthebuildingofficial’semploymentwiththeauthorityhavingjurisdictionorthedatethattheappointmentisterminatedinwritingbytheMinister.Division2-AdministrativeProvisionsCopiesofapplications,inspections,andtestsTheauthorityhavingjurisdictionmustkeepcopiesofallapplicationsreceived,permitsandordersissued,inspectionsandtestsmadeandallrecordsanddocumentsconnectedwiththeadministrationoftheseregulations.Notices,ordersandremedialmeasuresTheauthorityhavingjurisdictionmustissue,inwriting,anynoticeorordernecessarytoinformanownerthatacontraventionoftheseregulationshasbeenobserved.Thebuildingofficialwhoissuesanoticeororderorrequireremedialorothermeasurestocorrectacontraventionoftheregulationsmustspecifythetimewithinwhichthemeasuresmustbetaken.ServiceofnoticeororderWheretheauthorityhavingjurisdictionissuesanoticeororder,acopyshallberetainedbythebuildingofficialandacopyshallbesentbyregularmailtotheaddressgivenonthepermitapplicationtothe:

ServiceonconstructorIftheconstructorispresentduringtheinspection,thebuildingofficialmaygivethenoticeorordertotheconstructorpersonally.Wheretheorderisastopworkorder,ornon-compliancenotice,thebuildingofficialshallaffixitinaconspicuousplaceontheworksite.DutyofbuildingofficialAbuildingofficialshallansweranyreasonableandrelevantquestionswithrespecttotheprovisionsoftheseregulationsandthecodeswhenrequestedtodoso,butwillnot:
i. assistinthelayingoutofanywork;orii. actinthecapacityofadesigner.
DirectionfortestsAbuildingofficialmaydirectanownertomakeorhavetestsmadeofmaterials,equipment,devices,constructionmethods,structuralassembliesorfoundationconditions,attheowner’sexpense,andtoprovidetheresultstothebuildingofficialinordertoestablishwhetherthematerial,equipment,device,constructionorfoundationconditionmeetstherequirementsoftheseregulationsandthecodes.Anownermustcomplywiththedirectionofthebuildingofficial.ReportsregardingfailureorpotentialfailureWhereanyfailureoccursduringtheworkwhichcausesorhasthepotentialtocauseinjuryorlossoflife,abuildingofficialmayrequiretheownerorconstructortosubmitareportstatingthenatureanddetailsofthefailure.Transitionalmatters-applicationAnapplicationforapermitthatwasbegunbutnotcompletedbeforethecomingintoforceofthesenewregulationsisconsideredtobeanapplicationthatfallswithinthescopeofthenewregulations.However,theauthorityhavingjurisdictionfortheapplicationmayallowthedevelopmenttoproceedusingtheeditionoftheBuildingCodethatwasinforceatthetimetheapplicationwasstarted.
ExceptionsfordevelopmentsalreadyunderwayTheActandtheseregulationswillnotapplytoadevelopmentpermitthroughtheSubdivisionandDevelopmentRegulations(undertothePlanningActR.S.P.E.I.1988,Cap.P-8)orabylaw,whereitwasalreadyissuedandbuildingworkstartedbeforethedateonwhichtheseregulationscomeintoforce.Exceptionsforsingle-familyorsemi-detachedhomesTheActandtheseregulationswillnotapplytoanysingle-familyorsemi-detachedhomes(includingthebuildingofandchangestosheds,decksordetachedgarages)untiloneyearaftertheseregulationscomeintoforce.Duringthisperiodthefollowingwillbeallowednamely,a)thedesign,construction,erection,placement,useandoccupancyofanewbuilding;(b)alteration,demolition,removalandrelocationofanexistingbuilding;(c)changestotheuseandoccupancyofanexistingbuilding;or(d)worknecessarytocorrectunsafeconditionsinanexistingbuilding

SCHEDULECThissectionprovidesalistofpermitfeesforresidentialbuildingconstructiondeterminedbysizeofthebuildingareaincludinggaragesanddeckreview.Thefeeslistedincludethecostofplanreviewandtheinspectionsspecifiedinsection25orlistedonthebuildingpermit.Feesforallotherprojectswillbedeterminedonthebasisofthevalueoftheconstruction.Aninspectionfeeof$160perinspectionwillbechargedwhereadditionalinspectionsarerequiredtodeterminewhetherdeficienciesorderedtobecorrectedbyabuildingofficialhavebeencorrectedinamanneracceptabletothebuildingofficial.IftheValueofConstruction(VOC)ismorethan$200,000,thepermitfeeisequalto$4.50pereach$1000oftheVOC.IftheVOCislessthanorequalto$200,000,minimumfeeswillapply,andalistisprovided.EXPLANATORYNOTESAshortexplanationisprovidedforeachofthesections(Sections1–47)foundintheRegulations.
