Preface The importance of broadband Internet is a topic that is receiving much attention. The availability of broadband in rural areas has been low; the overcoming of this gap be-tween population-sparse and population-dense areas has been a key issue on the in-formation society agenda. Decision-makers – at municipal and national levels – are facing increasing pressure to overcome these discrepancies.
This book seeks to provide insights for immediate action on two levels. Firstly, the management perspective addresses the economic relevance of broadband and feasible business models. The second part of the book takes a legal perspective, providing mu-nicipal decision-makers with guidelines for the swift implementation and the legal fea-sibility of rural broadband rollout solutions. This dual approach combines the legal perspective with the field of business administration as well as economic restrictions with the field of law. Interdisciplinarity is crucial within this context. Allowances must be made for the form and format of both parts of the book. The authors have chosen to retain the legal and economic specifics in order to ensure usability in both areas. This book predominantly addresses people working with business models, broadband re-searchers as well as decision-makers and politicians evaluating the legal feasibility of broadband rollout projects at a municipal level.
Therefore, the first part of the book focuses on the economical feasibility of rural broadband rollout strategies – including an international comparative analysis – as well as the sustainability of broadband technologies. Part two presents directly appli-cable answers in terms of legal questions that arise with the construction of rural broadband rollout models. Our approach – a FAQ-based legal inventory – provides decision-makers with support in terms of the German and European legal frameworks. English and German are therefore used.
The economic issues of broadband rollout projects do not differ significantly between countries. However, matters of law and legal feasibility must be dealt with at national levels in detail. This is where sophisticated language skills and legal capabilities ena-ble the understanding and interpretation of national laws so as to be able to give ap-propriate advice to decision-makers. As a result, the first part of the book is written in English, and the second in German. Part two seeks to provide guidelines and answer the legal questions faced daily by municipal politicians and decision-makers in the European Union and the Federal Republic of Germany in detail.

This book is a result of productive cooperation between the Institute for Information, Organization and Management at the University of Munich (led by Arnold Picot) and the Institute for Information, Telecommunication and Media Law at the University of Münster (led by Bernd Holznagel). Both authors have significant experience with broadband issues. Furthermore, as board members of the scientific working committee of the German regulatory authority (the Bundesnetzagentur), rural broadband provi-sion has become part of their personal engagement.

Vorwort Die gesellschaftliche Bedeutung eines breitbandigen Internetzugangs ist zu Recht in aller Munde. Mittlerweile dürfte auch die Erkenntnis Allgemeingut geworden sein, dass der ländliche Raum beim Anschluss an die Informationsgesellschaft den Städten nicht hinterherhinken darf. Entscheidungsträger – ganz gleich, ob auf kommunaler oder übergeordneter Ebene – sehen sich mit einem wachsenden Handlungsdruck kon-frontiert.
Das Buch soll auf zwei unterschiedlichen Ebenen Aufklärung über Handlungsoptionen schaffen. Auf der wirtschaftlich-organisatorischen Ebene wird im ersten Teil des Bu-ches das Problemfeld im strategischen Zusammenhang aufbereitet. Kommunalen Ent-scheidungsträgern wird auf der verwaltungspolitischen Ebene im zweiten Teil ihr kon-kreter, rechtlicher Handlungsspielraum zur sofortigen Implementierung von Breitband-lösungen dargestellt. Der Vorteil dieses bewusst gewählten dualen Vorgehens besteht in der jeweiligen Integration einer juristischen Perspektive in die Betriebswirtschaft sowie der ökonomischen Betrachtung rechtlicher Handlungsspielräume. Dabei ist Interdisziplinarität stets nicht nur ein wohlklingender Begriff, sondern bedingt auch Abstriche in der Einheitlichkeit wissenschaftlicher Formalia der beiden Teile des Bu-ches. Die Autoren haben bewusst auf eine künstliche Glättung zu Lasten der jeweili-gen Verwendbarkeit im eigenen Fachbereich verzichtet.
Angesprochen sollen sich vor allem zwei Zielgruppen fühlen. Zunächst richtet sich der erste Teil an das (nicht nur) ökonomisch interessierte internationale Fachpublikum der Breitbandszene. Neben der Analyse optimaler Implementierungsstrategien im Hinblick auf den kommunalen Breitbandausbau im internationalen Vergleich werden Fragen der Nachhaltigkeit unterschiedlicher Breitbandtechnologien sowie der erforderlichen Breitbandkapazität untersucht. Für deutsche kommunale Breitbandverantwortliche ist der zweite Teil des Buches ein in der Praxis direkt verwertbarer, rechtlicher Aus-gangspunkt. Diesem Publikum wird bisher einmalig zugleich ein fundierter Überblick über den deutschen Rechtsrahmen für Kommunen in FAQ-Form verschafft. Demnach ist auch der Wechsel der Sprachwelten zwischen Englisch und Deutsch bewusst ge-wählt.
Während die ökonomischen Belange des Breitbandausbaus in der internationalen Fachdiskussion keiner starken Fluktuation unterliegen, so ist dies im Hinblick auf rechtliche Fragestellungen bei der nationalen kommunalpolitischen Umsetzung umso mehr der Fall. Genau hier kommt es auf die Besonderheiten und Feinheiten nationaler

Gesetzgebung und damit auch auf das erforderliche sprachliche Feingefühl an. Dem-zufolge ist der erste Teil des Buches in englischer Sprache verfasst und der zweite in deutscher Sprache. So kann am Beispiel der Bundesrepublik Deutschland den juristi-schen Herausforderungen des kommunalen Breitbandausbaus in dem erforderlichen Maße entsprochen werden.
Das vorliegende Buch ist das Ergebnis der guten Zusammenarbeit des Instituts für In-formation, Organisation und Management von Prof. Dr. Dres. h.c. Arnold Picot an der Ludwig-Maximilians-Universität München und dem Institut für Informations-, Tele-kommunikations- und Medienrecht von Prof. Dr. Bernd Holznagel, LL.M., an der Westfälischen Wilhelms-Universität Münster. Beiden Institutsdirektoren ist die Breit-bandversorgung des ländlichen Raums auch aufgrund ihres Hintergrunds als Mitglie-der des Wissenschaftlichen Arbeitskreises für Regulierungsfragen bei der Bundesnetz-agentur und ihrer jahrelangen Beschäftigung mit der Anwendung und Verbreitung von neuen Informations-, Kommunikations- und Medientechnologien in ihrer Bedeutung nicht nur wohl vertraut sondern auch ans Herz gewachsen.
