Dodge County Broadband Assessment Study

RFP #LRP 21-03 1) Overview of Project

Dodge County, Wisconsin is seeking proposals from qualified firms to conduct a county wide Broadband Assessment Study. The Broadband Assessment Study will provide an inventory and analysis of the current conditions of broadband infrastructure and services in Dodge County, examine current and future broadband uses and needs and identify strategies available to Dodge County to improve Broadband service. The Assessment Study will provide Dodge County with the information needed to analyze, select, and implement the best solutions to improve broadband across the entire County. Dodge County is not interested in creating a utility or becoming a service provider.

2) General Community and Project Information

Dodge County is located in southcentral Wisconsin in a triangle between Green Bay, Madison, and Milwaukee. Home to the 32,000 acre Horicon Marsh and known for its lakes, streams and small towns, Dodge County, Wisconsin is an expansive rural county located within an hour’s drive of Milwaukee, Madison and Fox Valley metropolitan areas. Covering 892 square miles, Dodge County has an estimated 2020 population of 90,005. A majority of commercial activities and roughly half of the population resides in the 9 cities of the County, with Beaver Dam (16,890), Mayville (5,069) and Horicon (3,768) being the largest cities wholly within Dodge County. The cities of Watertown (23,150), Waupun (10,600), Hartford (14,000) and Columbus (5000) straddle county borders. The county seat is Juneau (2,634). Much of Dodge County is underserved or unserved in terms of sufficient access to broadband. The County is served with a combination of cable internet, DSL, fiber, fixed wireless service and satellite-based internet services.

While protecting the best interest of the County and its residents, the long-term County goal is to determine the best options available that advance a viable means to bring the highest quality broadband services to a County with limited resources and large geographic area. The County acknowledges that broadband is a critical service for quality of life, as is the case with roads, water, sewer, and electricity. Every home, business, non-profit organization, government entity, and place of education should have the opportunity to connect affordably, easily, and securely. Dodge County should have broadband services that are shaped by the values of the citizens and businesses that take deep pride in our community.

Additionally, large areas of the County have poor cellular coverage. The Broadband Assessment Study may identify these areas and provide options for efficiently locating cellular infrastructure, potentially in conjunction with broadband infrastructure.

3) Scope of Services The project area for the Broadband Assessment Study is the entirety of Dodge County. County Land Resources and Parks staff will be administering the project and serve as the local point of contact. Consultant attendance will be necessary at select committee meetings and the County Board as related to key work effort presentations and to engage as necessary. Scope of services to be provided by Consultant shall include, but not be limited to, the elements defined in this RFP. This is a guide to prospective Consultants. Consultant creativity and ideas on approaches for strengthening the planning process are encouraged. The County expects a Broadband Assessment Study tailored to meet the specific needs and unique characteristics of Dodge County.

Anticipated Project Tasks a. Research and evaluate the current usage, needs and supply of broadband communications assets,

products and services in the County and identify unserved, under-served and served areas through a range of efforts and methodologies identified by the successful firm. Develop a communication and outreach strategy to survey and engage stakeholders, disseminate information, and provide opportunities for inclusion in the process.

b. Evaluate the current and future demand and market for broadband products and services in Dodge County by gathering input from:

▪ Public stakeholders (e.g. local and regional government agencies, educational institutions, federal agencies, etc.)

▪ Private stakeholders (e.g. local businesses, business organizations, healthcare providers, digital divide advocates, other interested consumers, residents, and interest groups)

▪ Broadband providers regarding the demand for, and adoption of, their products c. Provide strategic guidance in the planning of a broadband connectivity project that can be

implemented as cost-effectively and quickly as possible for the purpose of enabling economic development and citizen connectivity.

d. A completed Engineering and Assessment report that provides multiple potential recommendations relative to mechanisms for high-speed internet service delivery (e.g. FTTP, wireless, fiber/wireless hybrid, etc.) including suggested infrastructure and backhaul routes for each recommendation.

e. Assessment of potential construction and operational relationships with public, private, and membership owned companies in the service area and with publicly and privately funded networks as suitable for interconnection.

f. Provide an assessment of the telecommunications environment detailing the location of facilities, types of services, pricing, availability and limitations. Identify potential areas for partnership between the County and incumbent providers and, if possible, provide assistance to the County in creating a dialogue with these providers.

▪ Identification of potential wired network routes and interconnected points as well as potential tower site recommendations to support and maximize coverage.

g. Determine what economic and community impact broadband issues are having on Dodge County. This should include an evaluation of key issues limiting broadband expansion and a phased, prioritized approach to broadband expansion.

h. Identify potential funding sources and provide strong justification for funding to serve as the bases for a grant/loan application to support project implementation.

i. Evaluate and map current levels of cellular coverage within the County. Identify and prioritize ways to increase cellular coverage and quality throughout Dodge County.

Items provided by County The County will assist consultant in conduct of services outlined above by providing the following:

1. The County’s ESRI ArcGIS shape files and geodatabase of current known Towers/Tower Facilities (~115 in database). Data to be verified as part of project by selected firm. 2. County wide digital ortho photo files (2020) and elevation data. Other GIS data layers as available.

4) Deliverables Using the results of the anticipated project tasks, develop a comprehensive written report that presents alternative methodologies for deploying broadband services throughout Dodge County and addresses the engineering and business parameters of each alternative. The analysis must consider a wide continuum of business models and engineering options. It shall also highlight associated costs, alternative financing methods including other funding sources, as well as risk, timing and service quality considerations. The report must conclude the analysis by identifying a recommended strategy and associated action plan for its implementation.

The final written report shall at least include:

▪ Executive Summary ▪ County demographics ▪ Results from surveys and other public participation efforts ▪ Incumbent providers, their location(s) and details on current service and technologies ▪ Industry findings ▪ Similar projects ▪ Potential project partners ▪ Legal and regulatory issues ▪ Preliminary design modeling to achieve connectivity and redundancy affordability ▪ Business and financial modeling in support of network build to include Fiber to the

Premises (FTTP), Fixed Wireless Broadband, or a Hybrid System ▪ Estimation of project cost and construction timeline ▪ Provide ESRI ArcGIS shape files or geodatabase created or utilized for the Project in the

Dodge County Coordinate System, including updated Towers/Tower Facilities. ▪ Final list of recommendations and suggested implementation measures to be employed

by Dodge County and its municipalities, together with a summary of data collected and relied upon for recommendation

▪ Analysis of Cellular coverage within Dodge County, including a phased plan to improve coverage Countywide

Additional Technical Requirements

Successful consultant will be required to attend a kickoff meeting anticipated to be held in August

with key county personnel to explain the goals and purpose of the project, identify issues and

activities of the project, gather financial, demographic and related documents and data, and develop a detailed timeline based on schedules of applicable personnel.

Successful consultant is expected to be actively engaged during the entire project and routinely

report the progress to County staff.

Successful consultant is expected to meet with the Project Team as often as needed and as

requested by the Project Team in order to timely achieve the required project scope within the required project timeline.

Successful consultant is expected to present the draft Assessment in-person at a meeting of the

oversight Committee. The draft assessment will be provided to the County electronically in

Microsoft Word format at least two weeks prior to the in-person presentation to the Committee.

Successful consultant is expected to present the final Assessment in-person to the County Board of Supervisors at its regular or a special County Board meeting at project completion.

The final Assessment document will be provided to the County at least two weeks prior to County Board meeting during which the Assessment will be presented. Successful consultant shall prepare

and provide 40 copies of an Executive Summary, ten (10) printed and bound copies of the final

Assessment document and provide the final Assessment document electronically in PDF format. Any accessory documents and files associated with the Assessment should be included.

5) Requirements of Proposal

A submitted proposal should include the following: a. INTRODUCTION: Cover letter and executive summary providing the highlights and basic

information included in the proposal and overview of firm’s interest in the project. b. ORGANIZATION CAPACITY: Description of organization including general information about

the firm and a description of the firm’s capabilities and experience with projects equal or greater in scope to the project outline in this RFP.

c. PROJECT APPROACH: Describe firm’s approach to the project, identifying concepts, techniques or tools that may be used to accomplish the tasks set forth in this RFP, as well as any potentially beneficial services beyond those required in this document. Include a detailed work program designed to innovatively and efficiently meet the Scope of Services. Include descriptions of quality control procedures used and any sub-consultants or associations with other firms that will be used and their respective responsibilities.

d. TIMELINE: Detailed project time schedule with date initiating work, a detailed estimate of hourly work by project task, including who will be performing which tasks and a project completion date.

e. FIRM & STAFF QUALIFICATIONS: A description of the firm’s experience on similar projects including samples of comparable work and resumes of all staff that would be assigned to complete the tasks related to this RFP. If you intend to utilize any subcontractors or sub-consultants, provide their experience, samples and staff resumes.

* References: Include a list of organizations, including points of contact (name, address, and phone number), which can be used as references for work performed in the area of service required. References of other Counties or local governments in Wisconsin are preferred. Selected organizations may be contacted to determine the quality of work performed and personnel assigned to the project.

f. FEE PROPOSAL: On Company Letterhead, provide an itemized flat fee cost summary to undertake each task outlined in the Deliverables. The cost estimate should include labor costs, overhead, profit and other direct expenses such as transportation, housing and printing. A breakdown of labor costs, including position, hours, hourly rates of pay, and cost should also be provided. * Must be provided in separate sealed envelope.

Proposal should use 12-Point Font & 1 inch Margins.

One (1) original and Ten (10) copies with 1 electronic copy on USB Flash Drive and separate sealed envelope with Fee Proposal.

All submittals must be packaged, sealed, and clearly labeled with Firm’s name and address and identified as “Broadband Assessment Study Proposal” on the outside of the package in lower left corner and addressed to: Dodge County Land Resources and Parks Department

All submittals must be received no later than 4:00 p.m. (CST) on 6/4/2021.

Any proposals not submitted in proper format, not meeting the specified requirements or received after the above date and time may be rejected.

In the event it becomes necessary to provide additional clarifying data or information, or to revise any part of this RFP, revisions/amendments and/or supplements will be posted on the Dodge County website at https://www.co.dodge.wi.gov/community/business/request-for-proposals-bids. 9) Evaluation Criteria Proposals received will be scored on the following criteria:

1. Organization capabilities: Ability to perform scope of RFP requirements and success of past projects, preferably projects completed with Counties or local governments in Wisconsin.

2. Staff qualifications and references: Ability and qualifications of consultant’s staff to complete the project. References of similar units of governments in Wisconsin.

3. Timeline: Ability of consultant to complete the project in the proposed timeline. 4. Project Approach: Ability of consultant to satisfactorily achieve the results contained in the RFP

based on approach described by consultant. 5. Completeness of proposal: Consultant’s proposal was submitted including all of the proposal

requirements listed by Dodge County. 6. Price/Cost/Fees: Competitiveness of consultant’s fees for the development of the Assessment

including any value-added services offered.

Proposal Review – The Dodge County Broadband Assessment Study selection committee will review and score firms’ technical proposals first and then will review and score fee proposals. The top firms may be invited in for an interview. Top rated firms may be selected for contract negotiations. The County reserves the right to request any additional information that it deems necessary during the evaluation process.

General RFP Information

1. Dodge County requires a high level of service from any firm seeking to do business with the County.

Quality, service and price are all critical factors that Dodge County considers when doing business and in

continuing business with firms. This is especially important when it comes to the requirements of this

request. Dissatisfaction due to product or performance may result in Dodge County discontinuing service

with a firm.

2. Dodge County is a tax-exempt municipality under Section 77.54(9a)(b), Wis. Stats.

3. Successful Firm(s) shall provide a certificate of insurance, including naming Dodge County, its officers, elected officials and employees as Additional Insureds, upon proposal award.

4. All proposals shall be binding for ninety (90) calendar days following the proposal opening date unless the firm(s), upon the request of the County, agrees to an extension.

5. Payment for services will be made to successful firm(s) contingent upon County’s acceptance and approval of all work done and/or products provided or services rendered. Acceptance as herein means acceptance by the County of all work performed or products provided and services rendered, after the department’s authorized agent has found it to be in compliance with the specification requirement. Fuel surcharges or surcharges of any kind will not be allowed.

6. Firms may withdraw their proposal at any time before the proposal due date and time by written request for withdrawal to the Dodge County Clerk and by presenting proper identification upon request. Faxed and emailed proposals will be rejected. Late proposals will not be accepted.

7. Dodge County’s Standard Terms and Conditions available at https://www.co.dodge.wi.gov/home/showpublisheddocument?id=35231 are applicable to this request and are hereby made a part of it.

8. If a firm receives an RFP packet from any source or entity other than Dodge County or its website, the firm is responsible for accessing the County’s website (www.co.dodge.wi.gov/community/business/request-for-proposals-bids), view the RFP document there, and check the website for updates and to retrieve any addenda issued for this request. Firms may also contact Dodge County and request any addenda for this request prior to submitting their proposal. Failure to do so in no way obligates the County to issue addendum or other information concerning this request to the firm.

9. No reimbursement will be made by the County for any cost incurred in preparing responses to this solicitation, or for cost incurred before a formal notice to proceed is issued if a contract is awarded.

10. Dodge County shall be the owners of any and all of the reports, plans, specifications and documents resulting from this RFP and firm shall provide both digital and hard copies of all reports, plans and documents as indicated in this RFP to Owner in a format usable to the County. Awarded firm(s) shall also waive any rights to copyright protection so Owner may reproduce, distribute and use all reports, plans, specifications and documents as it so chooses.

11. Any proposal/response and any and all supporting materials submitted in conjunction with this request will become a public record, subject to public inspection.

12. Firms responding to this request shall include with the proposal a proposed contract covering all the terms, conditions and specifications for the performance of all work for this request.

13. Proposers shall list any consultants or subcontractors that may be used to help complete this project.

14. All questions resulting in further clarification or modification to this (RFP) document will be handled by written addenda. Questions shall be directed to the Dodge County Planning and Economic Development Administrator by email to [email protected]. Questions must be presented to Dodge County by May 18, 2021. Questions received after this time may not be answered. Any changes as a result of issues raised will be made by written addenda and posted on the Dodge County website at https://www.co.dodge.wi.gov/community/business/request-for-proposals-bids. It is the firm’s responsibility to check the website for addenda prior to submitting your proposal. Oral and other interpretations or clarifications will be without legal effect.

15. Dodge County assumes no responsibility or liability for any error or omission in any part of this RFP or resulting design. Prior to the deadline for questions, a firm shall notify Dodge County of any error, omission, inconsistency or other factor which requires clarification that is discovered while reviewing the documents or preparing a proposal. Such notification shall be made in writing to Dodge County Corporation Counsel.

16. Confidentiality and Security – This document or any portion thereof may not be used for any purpose other than the submission of proposals. The successful consultant must agree to maintain confidentiality and security standards consistent with the confidentiality and security policies of Dodge County and any applicable state or federal laws or regulations. These include strict control of access to secure areas, sensitive data and maintaining confidentiality of information gained while carrying out their duties. The successful consultant will be required to ensure that all consultant’s personnel providing services to the County which require access to secure and confidential Dodge County information or facilities, meet the criteria for personal security clearance prescribed by Dodge County. Dodge County reserves the right to deny access to any individual that is not fully compliant with security criteria without disruption to timeline or adjustment to project cost.

17. Dodge County reserves the right to require background checks for any consultant employee or subcontractor employee involved in this project from the awarded firm(s).

18. Unpublished information pertaining to Dodge County or its employees obtained by the firm as a result of participation in this RFP or resulting contract is confidential and must not be disclosed without written authorization from Dodge County Corporation Counsel or pursuant to a court order.

19. INDEMNIFICATION Dodge County requires any contract or agreement to contain an indemnification clause indemnifying and holding Dodge County, its officers, elected officials and employees harmless from and against (a) any and all claims arising from contracts between the firm and third parties made to effectuate the purposes of this RFP.

20. NON-COLLUSIVE STATEMENT Each firm, by submitting a response, certifies that it is not a party to any collusive action with Dodge County personnel and/or Consultants. Each firm also certifies that it is not a party to any collusive action with any other party submitting a proposal in response to this solicitation.

21. Dodge County reserves the right to reject any or all proposals or parts thereof, to waive any technicality in any proposal and accept any proposal deemed to be the most advantageous to the County. It is possible that multiple awards may be made through this RFP process.

22. This request and possible resulting contract shall be interpreted under the laws of the State of Wisconsin. Any disputes or claims that arise under this contract shall be litigated in the Circuit Court of Dodge County, WI.

General Terms & Conditions for Request for Proposal

Negotiations

This is a negotiated procurement. Negotiation is a procedure that includes the receipt of proposal from

offers, permits bargaining, and usually affords an opportunity to revise offers before award of a contract.

Bargaining, in the sense of discussion, persuasion, alteration of initial assumption and positions may

apply to price, schedule, technical requirements, type of contract or other terms of a proposed contract.

Dodge County may make an award on the basis of the original proposal without negotiations.

Binding Contract

A proposal received in response to a request for proposal (RFP) is an offer that can be accepted by Dodge

County to create a binding contract.

Award

In awarding a contract, price is but one factor to be considered and the award is not required to be made

to the lowest offer. Award shall be made to the responsive, responsible firm(s) whose proposal overall

is the most advantageous to the County.

Rejection of Proposals

Dodge County reserves the right to reject all proposals or parts thereof which are determined not to be

in the best interest of Dodge County. Any such rejection is not subject to appeal.

Funding

If funds are not appropriated for payment of a resulting contract, Dodge County may terminate the

service with thirty (30) day written notice without any early termination penalties, charges, fees or cost

of any kind to Dodge County.

Delivery Terms

Proposals shall include delivery costs to the specified delivery point, all transportation charges prepaid

and borne by the consultant.

EXHIBIT A DODGE COUNTY INSURANCE REQUIREMENTS

FOR ARCHITECT, ENGINEERS, CONSTRUCTION MANAGER & PROFESSIONAL SERVICES

I. Minimum Scope and Limits A. Architects, Engineers, Other professionals- Errors & Omissions (Professional Liability) coverage,

with a minimum limit of $1,000,000 per claim, $2,000,000 annual aggregate. This insurance is to be maintained for at least two years after completion of the project. If the firm changes insurance carriers and this policy is provided on a “claims made” basis, the firm will secure the appropriate coverage extension to provide coverage to the project for a period of at least two years following the completion of the project.

B. Commercial General Liability coverage with limits of no less than the following: 1. General aggregate limit per project $2,000,000

(Other than Products-Completed Operations)

2. Products-Completed Operations Aggregate per project $1,000,000

3. Personal and Advertising Injury Limit $1,000,000

4. Each Occurrence Limit $1,000,000

5. Fire Damage limit – any one Fire $ 50,000

6. Medical Expense limit – any one Person $ 10,000

C. Automobile Liability coverage with minimum limits of $1,000,000 combined single limit per accident for bodily injury and property damage, provided on a Symbol 1-Any Auto basis.

D. Workers’ Compensation and Employers Liability Insurance with sufficient limits to meet underlying Umbrella Liability insurance requirements.

E. Umbrella Liability providing coverage at least as broad as the underlying General Liability, Automobile Liability and Employers Liability coverages, with a minimum limit of

$2,000,000 each occurrence and $2,000,000 annual aggregate, and a maximum self-retention of

$10,000.

II. Other Requirements

A. Acceptability of Insurers. Insurance is to be placed with insurers who have a Best’s Insurance Reports rating of no less than A and a Financial Size Category of no less than Class VI, authorized as an admitted insurance company in the state of Wisconsin.

B. Certificates of Insurance acceptable to Dodge County shall be submitted prior to commencement of the work. Certificates shall contain a provision that coverage afforded under the policies will not be cancelled until at least 30 days’ prior written notice has been given to Dodge County.

C. Dodge County, Dodge County’s elected and appointed officials, and Dodge County employees shall be named as additional insureds on all liability policies for liability arising out of project work. Please provide a copy of this endorsement with your certificate of insurance.
