*Los consejos de diseño plantean ciertos problemas constitucionales. b s abogados bablan de ellos empleando las expresiones "proceso legal establecido" e "igual proteccidn ante la iey". El proceso legd significa un juicio justo y la proteccidn igual, ausencia de discriminaci6n arbitraria Hay dos maneras de conseguir esto:

Son normas dentro de las cuaks puede trabajar un ar- quitecto porque en d i d a d no implica gran dkrecionaüdad, y cualquier persona tiene capacidad suficiente para someterse a ellas. Si el municipio establece esas normas de antemano. el arquitecto no puede decir que se le discrimine en particular, aunque no esté de acuerdo con la norma en si misma.

.Cuando no podemos establecer normas porque los p m blemas no se prestan a ello, se nombra un consejo al. que se le dan poderes discrecionales. E1 consejo debe ser responsable del ejercicio de su discrecionalidad. En el sistema americano de

gobierno contarnos con varios procedimientos para hacer res- ponsables de sus actos a ias personas con poder. Por ejemplo, 10s jueces disfrutan de una gran discrecionalidad pero han & escribir sus opiniones. No pueden tomar partido sin decir por qud. Pueden ser criticadas cuando someten sus opiniones a la critica escribitndolas o dindolas. Esto es una gran proteceidn,

Los tribunales han establecido que h belleza es un bien urbano a buscar mediante Ios poderes politicos, 10s consejos de inspeccibn y otras medidas reglamentarias, pero han omitido mar las normas por las cuales se puede dcfmir la belleza o los procesos mediante los cuales puede juzgarse equitativamente su presencia. Las autoridades locales han reaccionado nombran- do uexpertosr (usualmente arquitectos de la localidad) que m curren a su propia discrecionaIidad para juzgar la beIleza o la falta de bellera en ta obra de 10s dem8s. En tal sistema los lf- mites al capricho, a1 autoritarismo o a la venalidad son los que puedan marcarse cada uno de los miembros individuales de esos consejos de disefio. Es el gobierno par el hombre y no el g* bierno por la ley.

En procedimientos que se basan exclusivamente en el gusto, el arquitecto solicitante queda perplejo y a menudo se pierden miles de dblares en intentos frustrados, por tener que hacer anteproyectos más que proyectos, para anticiparse o ajus- tarse a los dictadas de los expertos* cuyos gustos y filosofías difieren de los del arquitecto o san tan caprichosos que resu!tau incomprensibles.

Estdticamente, tampoco se logra lo que se pretende. Cualquier artista poda haber dicho a los legisiadores que es impasible legislar sobre la belleza y que los intentos de hacerlo recurriendo a expertos no s61o dardn lugar a groseras iujusti- cias sino a una mortecina fealdad del entorno.

En esa btisqueda de ia seguridad se nos escapa la be- lleza y se promueve una mismidad simplista a costa de la vita- lidad diversa que se marchita bajo los edictos de los revoluci* narios de la arquitectura, hoy ya envejecidos, que manejan los consejos de diserio y que al parecer han Ilegado a la certidumbre estdtica.
