Invitation to Tender for Disposal of Condemned Old/Obsolete/Unserviceable Items

Sealed tenders are invited in two bid from the interested Recyclers/Re-processors for disposal of condemned computer systems, UPS, other computer peripherals, batteries, furniture and other office equipments (herein referred as “items”) as mentioned in the Annexure A on “As-is- Where-is” basis. The Tender Document can be downloaded from the website of North Eastern Space Applications Centre i.e. www.nesac.gov.in . No printed copies will be provided. Important dates of tender related activities are as under:

The Tender should be complete in all respects and in a sealed envelope. Such sealed tender should be addressed to The Sr Administrative Officer, I/C Stores Division, North Eastern Space Applications Centre, Government of India, Department Of Space, Umiam -793103, Meghalaya and be dropped in the Tender Box placed at the Main Gate.

Note: In the event of any of the above mentioned dates being declared as a holiday for this office, the tenders/bids will be received/opened on the next working day at the appointed time.

Tender for Disposal of Condemned Old/Obsolete/Unserviceable Items

North Eastern Space Applications Centre (NESAC), intends to dispose of

old/obsolete/unserviceable items including Bolero, e-wate computer hardware items (Desktops,

UPS, Printers etc.), photocopy machines, control panels, Furniture’s etc. on “AS IS WHERE IS

BASIS” through open tender in TWO BID. The tender document along with terms and

conditions can be downloaded from the website www.nesac,gov.in. No printed copies will be

provided. The list of the items to be disposed are in ANNEXURE A.

1. Eligibility Criteria

Bidders must fulfill following eligibility criteria and submit documents mentioned at

Annexure - I of this tender document in support of the same as under: -

a) For bidding of E-waste item the bidder must be registered as a

Recycler/Reprocessor/Dismantler of e-Waste with Central Pollution Control Board

(CPCB), Ministry of Environment and Forests, Government of India or with the State

Pollution Control Board or State Governments dealing with E-waste etc. Bids received

other than so registered will be summarily rejected.

b) Must not be blacklisted by any Department of the Government of India or of any State/or

by any PSU/Autonomous Organisation of Government. An Undertaking regarding non-

blacklisting of the bidder by any Government Organization must be furnished by the

bidder in the tender document in the format given in Annexure - II. Bids without above

undertaking will not be considered.

c) Should have a valid GST registration with Departments of Government of India/State

Governments.

d) The Bidders should furnish bid security (EMD) as stated in Sl No.3 below along with

their bids failing which their bid will not be considered.

e) Bids should remain valid for acceptance for a period of Ninety days from the date of

opening of the Bids. Bids with lesser validity period will be summarily rejected.

2. Delivery & Inspection of Items

a) The delivery of the item will be as is where is, whatever there is condition. The

quantities indicated in the materials list are approximate and rough estimate. The

Tenderer should lift the available quantity only.

b) The delivery and inspection of the Lots will be at North Eastern Space Applications

Centre, Umiam - 793103, Ri-Bhoi District, Meghalaya and except for Lot No.4.1 where

the delivery and inspection will be at DWR Building, IMD Office, Lower Cherrapunjee,

Meghalaya.

c) The bidder or his authorized representative may inspect the materials during the

inspection schedule mentioned in the tender between 11am to 4 pm (excluding lunch

hours) on any working day with prior permission from the identified focal officer i.e

Shri A. Shukla, Sr Administrative Officer, I/C Stores, NESAC. Queries can be raised to the

concerned Officer at the time of inspection. No further clarification shall be entertained

after the above inspection.

d) Delivery has to be taken within 30 (Thirty) calendar days (called free delivery

period) from the date of the acceptance letter/sale order (excluding the date of issue

of acceptance letter/ sale order). The delivery of material will be given only after

realisation of the demand draft/ pay order. If the purchaser is not able to lift the material

within the free delivery period, ground rent @ 0.5 per cent of the sale value per day will

be levy.

e) No picking, choosing, sorting, welding, cutting or breaking of goods or materials sold

will be permitted. Welding cutting works if any can be arranged only with the prior

permission from NESAC.

f) If any foreign materials are found to be mixed in the lot, other than the items included in

the tender document and acceptance letter/sale order, NESAC reserves the right to

remove them at the time of delivery.

g) The material will be delivered only to the successful bidder or his authorised

representatives against the presentation of the buyer’s identity proof. If the successful

bidder desires to authorise a representative or an agent to accept delivery, the bidder

shall produce a suitable power of attorney or authorisation letter for each lot

separately, duly attested, by a notary public authorising his representative or agent to

lift the material from the seller.

h) The buyer shall not be entitled to re-sell an item, lot or part of a lot while the goods are

still lying within the premises of the seller and any such sale or assignment of the

buyer’s right to the material sold will not be recognised. All documents for releasing

materials will be made out in the name of the buyer only.

i) No delivery of the materials will be given on Saturday, Sunday and closed holiday

observed By NESAC. Materials will be delivered between 8:30AM to 3:30PM on any

working day. The buyer should intimate well in advance as to when vehicle will come for

taking out the materials.

3. Earnest Money Deposit (EMD)/Bid Security

a) Earnest Money Deposit of `15,000/- (Rupees Fifteen Thousand only) must be

deposited by the biddder through an Account Payee Demand Draft/Banker’s Cheque

in favour of Director, NESAC payable at SBI, Umiam (SBI Branch Code: 2010-

Barapani)EMD is to remain valid for a period of forty-five (45) days beyond the final

bid validity period.

b) EMD of the unsuccessful bidders will be returned at the earliest after expiry of the

final bid validity and latest on or before the 30th day after the award of the contract.

c) Bidder are not permitted to withdraw his/her offer or modify the terms and

conditions thereof. In case the tenderer fails to observe and comply with the

stipulations made herein or backs out after quoting the rates, the aforesaid amount of

earnest money will be forfeited.

d) The tenders without the Earnest Money Deposit will be summarily rejected.

e) No claim shall lie against the Government Department in respect of erosion in the

value or interest on the amount of Earnest Money Deposit.

4. Right To Reject All Bids

NESAC reserves the right to accept/reject and cancel any bid, amend the quantity under any

lot or withdraw any lot at any stage before or after acceptance of bid/issue of acceptance

letter/sale order/delivery order/deposit of the full sale value by the bidder, without

assigning any reason thereof and the value of such material, if paid for, shall be refundable.

NESAC shall not be responsible for damage/loss to bidders on account of such withdrawal at

any stage from the sale.

5. Excise Duty, Taxes and Duties/Income Tax

Any statutory variations in the rate of taxes/duties are to be borne by the bidder.

a) All taxes/duties/levies whether by Central/State/Local government where legally

leviable and intended to be claimed should be distinctly shown separately (in

percentage and words) in the bidding, otherwise price quoted will be treated as

inclusive of all taxes.While quoting the tender, the tenderer should take into account

all the extant statutory deductions under Central/State/Local statutes where legally

leviable and show it separately (in percentage and words) and if not separately

shown it will be treated as inclusive of all statutory deductions applicable as per the

extant statutes.

b) Our’s being a Department of Government of India, we are exempted from payment of

Excise Duty

c) Successful bidder shall have to pay Income Tax as per Section 206C of IT Act 1961. It

will be calculated on the gross Sales Value i.e materials Value plus GST.

In order to avoid the imposition of penalty, the amount deposited by the successful bidder

towards taxes and duties will be immediately deposited with the concerned tax authorities

without waiting for the actual delivery.

6. Financial Bid

a) The financial bid shall be quoted in the Proforma given at Annexure - III of this tender

document.

b) The Financial bid of only those bidders shall be evaluated who fulfil the eligibility

criteria.

c) The bidder shall quote for the whole lot.

d) Any overwriting of/on amount quoted will render the bid to be invalid.

e) GST/VAT or any other tax / duty, if applicable shall be borne by the bidder.

f) The rate quoted shall be final.

g) The successful bidder shall be evaluated on the basis of highest quoted price for the

whole lot.

7. Submission of Bids

a. The Bid shall be legible, preferably typed/printed and be in English only. All the pages

of the Bid should be serially numbered and signed.

b. The Bid prepared by the Bidder shall comprise of

i. Details of Eligibility Criteria and

ii. Financial Bid.

c. Bid may include following documents:

i. Eligibility Criteria (Annexure - I).

ii. Financial Bid (Annexure - III).

iii. Supporting documents

Sealed tenders superscribed “Tender for Disposal of Condemned

Old/Obsolete/Unserviceable Items” addressed to The Sr Administrative Officer, I/C

Stores Division, North Eastern Space Applications Centre, Government of India,

Department of Space, Umiam – 793103, Meghalaya and dropped in the Tender Box placed

in the Main Gate on or before 18.03.2021 (1300HRS). Bids received after the closing date

and time prescribed shall NOT be accepted under any circumstances.

All the envelopes shall also indicate the name, address and phone number of the Bidder

enabling the Bid to be returned, if required.

8. Opening of Bids

a) The Bid shall be opened on 18.03.2021 at 1400HRS by the authorized official in the

presence of the Bidders or their authorized representatives

b) The bidder himself or his authorised representative can attend the tender opening

event. The representative attending the opening of the tender on behalf of the bidder

should bring with him/her a letter of authority from the bidder and a proof of

identification at the time of opening of bid. Only one person/representative from

each bidder would be allowed to attend the bid opening event.

9. Payment

The successful bidder will have to pay the entire quoted/offered amount in the form of Bank

Draft/ Pay Order drawn in favour of DIRECTOR, NESAC payable at SBI Umiam (Branch Code

2010-Barapani) within two working days after receipt of letter regarding award of contract,

failing which the contract may be cancelled.

10. Lifting of the Lot/items

a) The successful bidder shall be required to lift the lots and not selectively from the

designated place to their premises on “AS IS WHERE IS BASIS” within five working

days after depositing the full amount.

b) In case, the successful bidder deposits the full amount within a stipulated period but

fails to lift the articles in the scheduled time, this Office shall not take responsibility

for safe custody of the articles.

c) No damage shall be caused to the existing property of NESAC or any other Offices in

the premises while removing the materials from the site. Any loss/ damage to the

property of this Office or any other Offices in the premises or injury or personal

accident suffered by any person due to negligence or action of the successful bidder

or his authorized worker/supervisor will be borne by successful bidder and they will

be indemnified.

d) Goods/material will be removed under the supervision of designated Officer(s) of

NESAC. Materials will have to be removed within the time stipulated in acceptance

letter. No extension of time will be given under ordinary circumstances. However,

extension of time may be granted provided convincing and satisfactory reasons for

such delay is given in writing by the successful bidder. Delay, beyond the stipulated

time, may entail cancellation of the award/order.

e) All the charges i.e. loading, unloading and transportation to be incurred in course of

lifting of items from the designated place shall be borne by the successful bidder.

11. Submission of Undertaking and necessary Certificates

a) The successful bidders shall submit an undertaking as per Annexure - IV that:

i. The e-waste items out of old/obsolete/unserviceable computer hardware etc. will be

stored/process/disposed off as per e-Waste (Management and Handling) Rules, 2016

or as amended from time to time.

ii. The old batteries/lead acid batteries out of old/obsolete/unserviceable item

tendered for disposal will be stored/process/disposed off as per The Batteries

(Management and Handling) Rules, 2001 or as amended from time to time.

iii. The Other hazardous waste items out of old/obsolete/unserviceable item tendered

for disposal will be transport/stored/process/disposed off as per The hazardous and

Other Waste (Management and Transboundary Movement) Rules 2016 or as

amended from time to time.

b) Bidders should also submit a notarized copy of the valid registration certificates issued by

the State (or Union Territory) Pollution Control Board (SPCB) and produce it at the time

of taking delivery of the materials, failing which their bid will be liable for rejection.

c) In case the Bidder is from outside the state of Meghalaya and inter-state movement of

goods is involve, the bidder shall also submit an NOC from concerned State Pollution

Control Board with whom the buyer is registered before taking delivery failing which the

bidder will be responsible for the consequences and NESAC will take decision as may be

deemed fit. An undertaking in this regards as per Annexure V may be furnished

12. Other terms and Conditions

a) In the event of failure of the successful Bidder to lift the items in the stipulated time

frame, legal action may also be initiated. Further, the Bidder will be blacklisted for

further business with this office and the Contract will be awarded to next Highest

Bidder to lift the item(s) at H1 rate(s).

b) The bidder has to submit their rate against each lot separately instead of quoting for

individual items of the particular lot. They are requested to quote their rates Lot-wise

(which is one LOT in the present case). Any conditional offer will be rejected.

c) No bidder will be allowed to withdraw after submission of bids/opening of the

tender. (e) This tender is non transferable.

d) Each page of the tender document should be signed by the bidder(s). Incomplete and

unsigned quotations are liable to be rejected.

e) If a firm violates any of these terms & conditions, the same shall be blacklisted and

other legal action may be initiated.

f) This Office reserves the right to accept or reject any bid without assigning or

communicating any reason thereof and to take any decision relating to the tender

including the cancellation of the tender.

g) Any corrigendum / addendum / errata etc. in respect of above Tender shall be made

available in our official website and Notice Board only. No press publication shall be

made in this regard. Hence applicants are advised to visit our website regularly for

any amendment / corrigendum / addendums in this regard.

h) FOR VEHICLES :The purchaser should ensure that Sales/Customs/MMD/RTO and

all other statutory formalities as required are complied with wherever necessary and

expenses including tax/insurance charges etc. should be borne by purchaser. Please

note that in case of documents of vehicles were surrendered to the Registration

Authority purchaser have to release the same from RTO before taking the delivery

of the vehicles by observing all the formalities

i) The bidder shall be responsible for suring that all Registration Certificate issued by

SPCB/CPCB/MOEF are kept valid for the entire period of the Contract, if awarded to

them, as well as the period of processing such Hardous waste item by them. NESAC as

it sole discretion may ask the bidder to extend the validity period of their

Registration Certificate for a suitable period as deemed fit by NESAC and in such

event the bidder shall be bound to do so, failing which their Bid. Sale order may be

rejected/cancelled at the sole discretion of NESAC and no complaint in this regards

will be entertained from the bidder.

j) The successful Bidder shall pay full value for the items offered in the Sale Order in

cash or DD/PO/Banker’s Cheque to THE DIRECTOR, NORTH EASTERN SPACE

APPLICATION CENTRE,UMIAM based on the intimation from Sr. Administrative

Officer, I/C Purchase & Stores, I/C Purchase & Stores Division, and obtain cash receipt

before lifting the items from our Office Campus. If the successful tenderer fails to

accept the Sale Order issued in their favour or pay the full amount within the

stipulated period and lift the items, the Sale Order shall stand cancelled and the

Earnest Money Deposit submitted shall be forfeited. The Scrap/asset items offered in

Sale Order shall be lifted by the buyer after payment within the stipulated due date as

per Sale Order terms and conditions.

k) The Successful Bidder shall be responsible to protect the properties of NESAC from

any damage while removing, lifting, loading etc., of the items sold to them. Any

damage caused to the properties of NESAC during the above process shall be made

good by the tenderer, failing which such losses shall be recovered from the Earnest

Money Deposit of the buyer.

l) The tenderer shall be personally binding and remain responsible and liable for any

act of theft or fraud committed by them or their authorized agent/employees during

the course of collection removal etc., of the items sold to them. Any such act of theft

or fraud committed shall be penalized by forfeiture of Earnest Money Deposit of the

buyer, inclusive of payment made towards sale value against the Sale Order issued in

their favour.

m) In case of any accident or injury caused to the tenderer or his agent or workers, from

the time of entry till exit, NESAC will not be held responsible for the accident / injury

or for any sort of compensation.

n) The tender submitted by the tenderer for the purchase of items shall be valid for a

period of 90 days from the date of opening for finalization of sale.

o) NESAC shall be under no obligation to accept the highest or any other tender and

shall have the right to accept or reject any tender in part or full without assigning any

reason thereof. NESAC reserves the right to remove any item/s from the Lot, which

are found suitable for use while loading items.

p) NESAC will not be in any way responsible for failure to-deliver the materials due to

cause beyond their control such as strike, lockout, cessation of work by labourers,

shortened hours, act of GOD or other causes of other contingencies whatsoever. The

buyer shall not be entitled to cancel the Sale order and the period of delivery shall

automatically get extended proportionately.

q) CONDUCT DURING DELIVERY: Buyers shall solely be responsible for movement and

proper behavior of their deputies, agents, and labourers within NESAC premises. If

any damage is caused to the company's property, the buyer is responsible to make

good such damageto the satisfaction of NESAC, and the decision of NESAC in this

regard shall be final and binding.

r) ACCIDENTS: NESAC will not at any point of time be responsible for any injuries

caused due to accident within the factory/premises or at the place of work salvage

yard and the bidder will make proper arrangement for medical attention and

treatment to his labour representative. The buyer will be solely responsible for any

claim arising out of the employment, injuries to labourers in the course of the

employment under any statute. It is the responsibility of the buyer to provide

necessary safety appliance (like hand gloves, tools, helmet, safety goggles, boots etc.)

to the labourer who are engaged for handling of the goods.

s) BLACKLISTING: If it is found that the bidder is not following the terms and conditions

of payment. Delivery or other conditions of the Sale Tender and also indulging in any

malpractices either himself or by his agents, deputies or observer, such bidder are

liable to be blacklisted and appropriate action will be taken as deemed fit by NESAC.

t) In the event of any dispute in connection with this sale, the decision of NESAC shall

be final and binding on the parties to the Sale Order. Further any such dispute,

doubts or differences of opinion arising at the time of payment of Delivery, bidders

shall agree and abide by the decision of NESAC.

u) The Buyer shall bring their own bags and boxes, cases or their receptacles for the

removal of the auctioned items and shall be responsible for loading, weighment of

materials under supervision of authorized official of the buyer.

v) No interest will be paid to the purchaser on the amount paid or deposited by him

and on the amount refundable to him, if any.

w) In the event of any disputes or differences in connection with the contract, the

decision of NESAC shall be final and binding on all parties and will be settled as per

the Indian Law in the Court Jurisdiction of Nongpoh Court only.

x) The terms and conditions are supplementary to the remedy available under the

law.
