INTRODUCTION I, the Chairman of the Committee on Papers Laid on the Table, Rajya Sabha having been authorized by the Committee to presentthe report on its behalf, do present this 88th Report to the Rajya Sabha. 2. The Committee took up for consideration the various papers, particularly the Notifications/Orders and the Annual Reports andAudited Accounts of Government Companies/Organisations laid by the various Ministries on the Table of the House during the 197th Session of Rajya Sabha and examined the factors leading to the delay in the laying of the papers. 3. The Committee considered and adopted the report in its meeting held on 21st April, 2003.

The Committee on Papers Laid on the Table, Rajya Sabha took up for consideration and scrutiny the Notifications/Orders and theAnnual Reports and Audited Accounts of Government Companies/Organisations laid by the various Ministries on the Table of the Houseduring the 197th Session of the Parliament. Lists of such Notifications/Orders and Annual Reports and Audited Accounts of GovernmentCompanies/Organisations laid by the Ministries/Departments and examined by the Committee are placed at Annexure I and II, respectively.

2. The Ministry-wise analysis of the delay in the laying of the papers is as under:-

OBSERVATIONS AND RECOMMENDATIONS

3. As can be seen from the above tables, a total of 253 Notifications/Orders were laid by the different Ministries during the 197th

Session of the Rajya Sabha. Out of these, 195 Notifications/Orders were laid within the stipulated period. However, 58 GovernmentNotifications/Orders were laid beyond the stipulated period with delay ranging from 3 ½ months to 1 year, 3 ½ months. In addition, theMinistries also laid 688 Annual Reports and Audited Accounts of different Government Companies/Organisations on the Table of theHouse. 574 of these reports were laid within the stipulated time period. In case of 29 reports, there was an excessive delay of more than 2years. 14 reports were delayed by period ranging from 1 to 2 years while the remaining 71 reports had delay of less than a year. 4. A perusal of the laying of these Government Notifications/Orders which is under the purview of the Committee shows that theMinistry of Road Transport and Highways delayed the laying of 41 Government Notifications/Orders. While one Government Notificationwas delayed by more than 6 ½ months, 40 Government Notifications were delayed by about 3 ½ months. The Ministry of Finance andCompany Affairs also belatedly laid 12 Government Notifications/Orders. One of these was excessively delayed for laying by 1 year, 3 ½months and another by 6 ½ months. 10 Notifications were delayed by about 3 ½ months. The Ministry of Environment & Forest and theMinistry of Social Justice & Empowerment also delayed laying of 2 Government Notifications/Orders each. One Notification of theMinistry of Mines was delayed by 3 ½ months. The Committee also notes that except for the delayed Government Notifications/Orders laidby the Ministry of Social Justice & Empowerment, no other Ministry had laid delay statements along with such delayed GovernmentNotifications/Orders. The Committee, therefore, reiterates that in case of delay in the laying of Government Notifications/Orders, acomprehensive delay statement explaining the reasons in detail for the delay in laying of the papers on the Table of the House from the datesof publication of the Notification/Order in the Gazette to the actual date of laying on the Table of the House, mentioning the time frame, ifany, allowed in the statute should invariably be laid. The non-laying of the delay statement along with the delayed GovernmentNotifications/Orders does not enable Parliament to know the reasons which had contributed to such a delay. 5. The Committee also notes that out of the 688 Annual Reports and Audited Accounts of the Government Companies/Organisationslaid on the Table of the House during the 197th Session, 114 reports were laid after the expiration of the stipulated time period. While 71reports were laid after delay ranging from 10 ½ months to less than a year, 43 reports were delayed by periods of more than a year. TheMinistry of Human Resource Development delayed 42 of their Annual Reports and Audited Accounts for laying on the Table of the House. The Ministry of Youth Affairs and Sports & the Ministry of Agriculture laid 14 and 12 of their Annual Reports and Audited Accountsrespectively after the expiry of the stipulated time period. While the Ministry of Tourism and Culture & the Ministry of Health and FamilyWelfare delayed laying of 7 Annual Reports and Audited Accounts each, the Ministry of Social Justice & Empowerment had delayed 8Annual Reports and Audited Accounts. TheMinistry of Agriculture considerably delayed the laying of the Annual Reports and Audited Accounts of the Orissa Agro IndustriesCorporation Limited for the year 1992-93 by about 8 years, 11months. The Annual Reports and Audited Accounts of the Indian Institute ofManagement, Indore for the years 1997-98 to 2000-01 were laid by the Ministry of Human Resource Development after delays ranging from

11 ½ months to 3 years and 11 ½ months. While the Ministry of Youth Affairs and Sports laid the Annual Reports and Audited Accounts ofthe Rajiv Gandhi National Institute of Youth Development for the years 1993-94 to 2000-01 with delays ranging from 11 ½ months to 7years and 11 months; the Ministry of Social Justice and Empowerment delayed laying of Annual Reports of the National Commission forMinorities for the years 1993-94 to 1995-96 by more than 5 years, 11 ½ months. The Committee, therefore, took up for close scrutiny of thereasons that led to the delayed laying of the Annual Reports and Audited Accounts of the aforesaid organizations in the succeeding paras. 6. Orissa Agro Industries Corporation Limited, Bhubaneswar (Ministry of Agriculture) 6.1The laying position of the Annual Reports and Audited Accounts of the Orissa Agro Industries Corporation Limited for the years1992-93 onwards is as follows:-

6.2The delay statement laid by the Ministry along with the Annual Report and Audited Accounts of the Orissa Agro IndustriesCorporation Limited for the year 1992-93 stated, inter alia as follows:- “….The Annual Report and Accounts of the Corporation for the year 1992-93 were compiled by 31.12.1996. The delay was due toshortage of accounts staff for collection of relevant records from fifty field offices spread throughout Orissa and thereafter its scrutiny by theStatutory Auditor. The Company Law Board appointed the Statutory Auditors for the year 1992-93 on 29.05.2001. The Accounts werehanded over to them for audit on 20.06.2001 and after completion of audit the accounts were sent to CAG for supplementary audit on 17.09.2001 whosecomments thereon were received on 21.12.2001. The English and Hindi version of the Report were received in this Ministry on 17.04.2002and 06.06.2002 respectively. Hence, there has been a delay in laying the Report on the Table of the House.”

6.3 The Committee regrets to note that there was considerable delay in the appointment of the statutory auditors for the year 1992-93 bythe Company Law Board due to which the entire auditing process was delayed. The Committee is astonished to note that the Corporationtook more than 3 ½ years to compile its accounts which should have been compiled within 2 months of the closure of accounts. TheCommittee feels that the Ministry and the Corporation did not take timely steps to get the statutory auditors appointed. The Committeedirects the Corporation and the Ministry of Agriculture to immediately approach the Company Law Board for early appointment of statutoryauditors for the subsequent years. The Ministry should also ensure that once the papers of the Corporation are received by them, they shouldactively process them for early laying on the Table of the House. The Corporation and the Ministry should take necessary steps toimmediately give effect to the recommendations of the Committee contained in its 82nd Report to clear the huge arrears in the laying of thepapers. 7. Indian Institute of Management, Indore (Ministry of Human Resource Development) 7.1The laying position of the Annual Reports and Audited Accounts of the Indian Institute of Management, Indore for the years 1997-98onwards is as follows:-

*Request to C&AG to take up audit of IIM, Indore was issued by Ministry of Finance vide their letter No. 1(15)-B®/2000 dated 20.09.2000. 7.3The Committee fails to understand the reasons as to why the Ministry of Finance requested the C&AG to take up audit of the Indian Institute of Management, Indore after more than two years of the finalisation of accounts in 1998 vide their letter dated 20.09.2000. Had the request for entrustment of audit of Indian Institute of Management been made earlier by the Ministry of Human ResourceDevelopment, delay could have been easily avoided or reduced. The Committee directs the Ministry of Human Resource Development toexamine the matter in coordination with the Ministry of Finance so that such delays could be avoided in future. Further, the Institutesubmitted the accounts for the year 1997-98 to 2000-01 to the AG after more than a year, i.e., on 22.10.2001. It is again observed that theInstitute took more than 8 months to forward the printed copies of the Annual Reports and Audited Accounts to the Ministry after havingreceived the audited accounts from the CAG on 07.03.2002. The Committee directs the Ministry to take necessary steps to streamline theentire process of preparation and laying of the Annual Reports and Audited Accounts of the Institute.

8. National Commission for Minorities (Ministry of Social Justice and Empowerment) 8.1The laying position of the Annual Reports and Audited Accounts of the National Commission for Minorities for the years 1993-94onwards is as follows:-

8.2The delay statement laid by the Ministry along with the Annual Report and Audited Accounts of the National Commission forMinorities for the period 01.04.1993 to 31.03.1994, 01.04.1994 to 31.03.1995 and 01.04.1995 to 31.03.1996 respectively stated, inter alia,as follows: “The National Commission for Minorities submitted its First Annual Report for the period 1.4.1993 to 31.3.1994 and the

Annual Report for the period 1.4.1994 to 31.3.1995 on 14th June, 1996. The 3rd Annual Report for the period 1.4.1995 to 31.3.1996 wassubmitted on 5th June, 1997. Printed copies of these Annual Reports were received in this Ministry on 27th April, 1998. Based on thecomments received from the concerned Ministries/Departments, an Action Taken Memorandum on the recommendations contained in Firstand Second Annual Reports of the Commission was prepared and forwarded to the Cabinet Secretariat on 19th March, 1999 for seekingapproval of the Cabinet Committee on Scheduled Castes, Scheduled Tribes and Minorities for placing it in the Parliament. The Cabinet note was, however, returned by the Cabinet Secretariat stating that as the 12th Lok Sabha stood dissolved and the RajyaSabha was not in session, these proposals may be brought up after constitution of 13th Lok Sabha. Subsequently, the Action TakenMemorandum on First and Second Reports was updated and Action Taken Memorandum on Third Report of the Commission was preparedbased on the comments received from the concerned Ministries/Departments. The Cabinet Committee on Scheduled Castes, ScheduledTribes and Minorities in its meeting held on 25th June, 2002, approved placing of the First, Second and Third Annual Reports of NationalCommission for Minorities together with the Action Taken Memorandum in both Houses of Parliament.” 8.3The Committee expresses its displeasure at the inordinate delay in the laying of the Annual Reports of the National Commission forMinorities. There was much delay in the receipt of the printed copies of the Annual Reports by the Ministry. The Ministry could haveexpedited the preparation of the Action Taken Memoranda on the recommendations made by the Commission and their subsequent approvalby the Cabinet Committee on Scheduled Castes, Scheduled Tribes and Minorities. A comprehensive delay statement showing thechronological order of the dates of the completion of each of the stages involved in the preparation of the Annual Reports and AuditedAccounts of the Commission should invariably be laid on the Table of the House along with the papers of the Commission. 9. Rajiv Gandhi National Institute of Youth Development, Sriperumbudur (Tamil Nadu) (Ministry of Youth Affairs & Sports) 9.1The laying position of the Annual Reports and Audited Accounts of the Rajiv Gandhi National Institute of Youth Development forthe years 1993-94 onwards is as follows:-

9.2The delay statement laid by the Ministry along with the Annual Report and Audited Accounts of the Rajiv Gandhi National Instituteof Youth Development for the years 1993-94 to 1997-98 stated, inter alia, as follows:- “The Annual Reports and Audited Accounts, in English and Hindi, for the years 1993-94 to 1997-98 in respect of the Rajiv GandhiNational Institute of Youth Development, Bheemanthangal, Sriperumbudur, Tamil Nadu could not be laid on the Table of both the Housesof the Parliament within a period of 9 months after the close of the financial years 1993-94 to 1997-98 due to operational difficulties. TheInstitute was established during the year 1993 with no staff sanctioned. A skeleton staff consisting of one Director, one Faculty Head, oneTraining Officer, one Library Assistant and some clerical staff was sanctioned only in June, 1994. The post of Director could not befilled up by a regular appointment till July, 2000. The full time regular Director could be appointed in August, 2000. No post ofAdministrative Officer has been sanctioned to the Institute to attend to the administrative work. As the post of Faculty Heads have also notbeen filled up, the actual work for which the Institute was established i.e. all out development of youth, could not be accomplished. Moreover, no Accounts Officer who could look after the work related to the audit of accounts was appointed during this period.” 9.3The Committee observes that the delay statement laid by the Ministry is not comprehensive as it does not indicate in chronologicalorder the various dates on which the accounts for the relevant years were prepared, auditors were appointed, the accounts were forwarded tothe auditors, date of completion of audit, submission to C&AG, date of issue of certificate by the C&AG, date of adoption of report by theAnnual General Meeting, date of completion of translation and printing and forwarding of the papers to the Ministry. In the absence of thisinformation, the Committee is not is a position to comment on the stages which primarily led to the delay. The fact that the Ministry havelaid Annual Reports and Audited Accounts of the Institute for the last eight years during the 197th Session only indicates that the Ministrydid not show enough concern in so far as the laying of papers is concerned. The Committee recommends that suitable staff strength beimmediately put in place so that the proper functioning of the Institute is ensured and the requirement of timely laying of papers on the Tableof the House is achieved. The Ministry should also lay a comprehensive review statement along with the papers of the Institute covering thebroad performance of the organization and a brief description of the critical areas during the year under review. 10.The Committee hopes that the concerned Administrative Ministries will adhere to the recommendations of the Committee and ensurethat Government Notifications/Orders and Annual Reports and Audited Accounts of Government Companies/Organisations are laid on theTable of Rajya Sabha within the stipulated time period.

SUMMARY OF RECOMMENDATIONS

4. …….The Committee, therefore, reiterates that in case of delay in the laying of Government Notifications/Orders, a comprehensivedelay statement explaining the reasons in detail for the delay in laying of the papers on the Table of the House from the dates of publicationof the Notification/Order in the Gazette to the actual date of laying on the Table of the House, mentioning the time frame, if any, allowed inthe statute should invariably be laid. The non-laying of the delay statement along with the delayed Government Notifications/Orders doesnot enable Parliament to know the reasons which had contributed to such a delay. National Commission for Minorities (Ministry of Social Justice and Empowerment) 8.3The Committee expresses its displeasure at the inordinate delay in the laying of the Annual Reports of the National Commission forMinorities. There was much delay in the receipt of the printed copies of the Annual Reports by the Ministry. The Ministry could haveexpedited the preparation of the Action Taken Memoranda on the recommendations made by the Commissioner and their subsequentapproval by the Cabinet Committee on Scheduled Castes, Scheduled Tribes and Minorities. A comprehensive delay statement showing thechronological order of the dates of the completion of each of the stages involved in the preparation of the Annual Reports and AuditedAccounts of the Commission should invariably be laid on the Table of the House along with the papers of the Commission. 9.3The Committee observes that the delay statement laid by the Ministry is not comprehensive as it does not indicate in chronologicalorder the various dates on which the accounts for the relevant years were prepared, auditors were appointed, the accounts were forwarded tothe auditors, date of completion of audit, submission to C&AG, date of issue of certificate by the C&AG, date of adoption of report by theAnnual General Meeting, date of completion of translation and printing and forwarding of the papers to the Ministry. In the absence of thisinformation, the Committee is not is a position to comment on the stages which primarily led to the delay. The fact that the Ministry havelaid Annual Reports and Audited Accounts of the Institute for the last eight years during the 197th Session only indicates that the Ministrydid not show enough concern in so far as the laying of papers is concerned. The Committee recommends that suitable staff strength beimmediately ;put in place so that the proper functioning of the Institute is ensured and the requirement of timely laying of papers on theTable of the House is achieved. The Ministry should also lay a comprehensive review statement along with the papers of the Institutecovering the broad performance of the organization and a brief description of the critical areas during the year under review.
