EXPLANATORY MEMORANDUM

1. By Decision of 25 February 1982, the Council authorised the Commission

to open negotiations with Hong Kong with a view to the conclusion of

an agreement on trade in textile products.

2. In accordance with that Council Decision, and in consultation with the

Article 113 Committee, the Commission conducted negotiations with Hong

Kong from 1 June to 30 November 1982.

Following the negotiations, a draft Agreement was drawn up.

The draft Agreement:

(i) covers all MF A products of wool, cotton and man-made fibres

originating in Hong Kong,

(ii) calls for voluntary restraint, at agreed levels, on exports to

the Community of certain categories of products covered by the

Agreement,

(iii) provides for a consultation procedure whereby voluntary re­

straint measures may be introduced for categories of products

not initially subject to limitation, where certain thresholds

are exceeded,

(iv) establishes a double checking system for categories of products

subject to limitation, and an origin control system for all

categories covered by the Agreement,

(v) includes a flexibility clause allowing the transfer of a certain

percentage of the quotas from category to category, or from one

year to another,

(vi) includes an "anti-surge" clause allowing in certain circum­

stances the suspension of flexibility or the introduction of

temporary limits within quotas,

(vii) includes an "anti-fraud" clause allowing in certain circum­

stances the debiting against the quota of the true country of

origin of quantities shipped fraudulently,

(viii) in exchange for limitation, contains an undertaking by the

Community not to introduce further quantitative restrictions

under Article XIX of the GATT or Article 3 of the MFA, or to

measures having an effect equivalent to quantitative restric­

tions .

The Heads of the Delegation initialled the text of the draft Agreement

on 30 November 1982, having noted that it correctly represented the

results of the negotiations.

3. In order to ensure that the successful implementation of the Agreement

should not be put at risk and to prevent a flood of exports preceding

its entry into force, the Community, following the conclusion of the

negotiations, proposed to the third countries that until such time as

the Agreement entered into force both parties should apply its

provisions on an autonomous basis as from 1 January 1983. These

provisions were put into effect by Council Regulation (EEC) N° 3589/82

of 23 December 1982 making the importation into the Community of

textile products originating in certain third countries subject to

authorisation and quantitative limitation, as amended by Council

Regulation (EEC) N° 3762/83 of 19 December 1983 1 (2).

4. The Commission considers that the draft Agreement embodies an

arrangement which is acceptable to the Community. It therefore recom­

mends that the Council:

(i) approve the Agreement by adopting the regulation, the draft of

which is annexed hereto,

(ii) pending approval of the Agreement, take the necessary

decisions in connection with the signing thereof.

in textile products

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

and in particular Article 113 thereof,

Having regard to the Recommendation from the Commission,

Whereas the Agreement on trade in textile products negotiated between the

European Economic Community and Hong Kong should be approved,

HAS ADOPTED THIS REGULATION:

Article 1

The Agreement between the European Economic Community and Hong Kong on

trade in textile products is hereby approved on behalf of the Community.

The text of the Agreement is attached to this Regulation.

Article 2

The President of the Council shall give the notification provided for in

Article 17 of the Agreement

Article 3

This Regulation shall enter into force on the third day following its

publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable

in all Member States.

RECOGNIZING the importance of trade in textile products between the

European Economic Community (hereinafter referred to a. the "Community")

and Hong Kong,

HAVING REGARD to the Arrangement regarding International Trade in Textiles

and in particular Article thereof; arid to the Protocol extending the said

Arrangemer.t togetner with the Conclusions adopted on 7.2 December 1931 by

the Textiles Committee, which Arrangement, Protocol and Conclusions are

hereinafter referred to as the "Geneva Arrangement",

HAVE iF.CIDED to conclude this Agreement arid to this end have designated

as t h e i r P l e n i p o t e n t i a r i e s ,

WHO H W E AGREED AS FOLLOWS :

Section I : Trade Arrangements

Article 1

1. The parties recoqnize and confirm that, subject to the provisions

of this Agreement and without p r e judice to their rights and obligations

under the General Aareement on Tariffs and Trade, the conduct of their

mutual trade in textile products shall be gove r n e d by the p rovisions of

the Geneva Arrangement.

2. In respect of the products covered by this Agreement, the Community

undertakes not to introduce q u a n t i t a t i v e restrictions under Article XIX

of the General Agreement on Tariffs and Trade or Article 3 of the Geneva

Arrangement.

3. Measures having equivalent effect to quantitative restrictions on the

importation into the1 Community of the products covered by this Agreement

shall be prohibited.

Arti c L i 2

1. This Agreement -'hall apply to trade in textile products of cotton,

wool and man-made fibres which o r i ginate in Hong Kong and are listed

in Annex I.

2. The classifiration of the pro ducts covered by this Agreement is based

on the n o menclature of the Common Customs Tariff and on the Nomenclature

of Goods for the External Trade Statistics of the Community and the

Statistics of Trade between Member States (NIMEXE).

3. The origin of the products covered by this Agreement shall be determined

in accordance with the rules in for e in the Community and the procedures

for control of the origin of the products set out in Protocol A.

Article 3

H o n g Ko ng agrees to r e s t r a i n its exports to the Community o f the

prod u c t s described in Annex II to the limits set out therein for

each Agreement year.

Exports of textile products set out in Annex II shall be subject to

a d o uble-checking system specified in Protocol A.

Hong Kong and the Ccnnuni iy recognize the special and differential

character of re-imports of textile products into the Community after pro-

censing in Hong Kong,

Such re-imports may be provided for outside the quantitative limits

e3';ablisned under this Agreement provided that they are effe'cted in accor­

dance with the regulations on economic outward processing in force in the

Community,

Art i c le 5

1. Exports to the Community of textile products covered by this

A g r eement shall not be subject to the quanti t a t i v e limits established

in Annex II, prov i d e d that the export licence certifies that the

prod u c t s concerned are for re-export outside the Community in the same

state or after processing.

2. Where the competent authorities in the Community have evidence

that products expo r t e d from Hong Kon g and set off by Hong Kong against

a q u a ntitative limit est a b l i s h e d in Annex II have been subsequently

r e - e xported outside the Community, the authorities concerned shall

noti f y Hong Kong of the q u antities involved. Upon receipt of such

n otification, Hong Kong may authorize exports for the current or the

f o l lowing Agreement year of icentical quant i t i e s of :roducts, within

the same category, which shall not be set off against the q u antitative

limits established 1 r. Anr.ex II.

ARTICLE 6

In any one Agreement year advance use of a portion of the quantitative limit established for the following Agreement year may be agreed following consultations in accordance with the procedures referred to in Article 15,

paragraph 1 for each category of products between 1% and 5^ of the

quantitative limit for the current Agreement year. Amounts delivered in

advance shall be deducted .Tom the corresponding quantitative limits

established for the following Agreement year.

Carryover to the corresponding quantitative limit for the

following Agreement year of amounts not used during any one Agreement

year cay be agreed following consultations in accordance with the

procedures referred to in Article 15 , paragraph 1 for each category of product

between 1% and 356 of the quantitative limit for the current Agreement

year.

Transfers in respect of categories in Group I shall not be made fro® any categories except a3 follows s

Transfers into any category in Groups II and III may be made

from any category or categories in Groups I, H and Ilf for any Agreement

year up to of the quantitative limit for the category to which the transfer

The table of equivalence applicable to such transfers is given

4# The increase in any category of products resulting from the

cumulative application of the provisions in paragraphs 1, 2 and 3 above

during an Agreement year shall not exceed the following limits“:

- for categories of products in Group I 10$

- for categories of products in Groups II end III 11$

5· Prior notification shall be given by the authorities of Hong Kong

in the event of recourse to the provisions of Paragraphs 1, 2 and 3 above,

6* Hong Kong shall provide the Community with export data showing

the amounts of carryover available in any Agreement year. If substantial

statistical differences exist between the export data from which the

amount to be carried over is calculated and the Community's data the

Community may, within the first 120 days of the following Agreement year,

reguest consultations in accordance with the procedures referred to in

Article 15 paragraph 1 on the amounts involved, Xr\y such request shall be

accompanied by full particulars of the alleged statistical differences.

Where such a requeet is made, the portions carried over shall not he

ur.ed until the parties have completed consultations. If no such requeot is

male within a 120-day period, the portion carried over shall be presumed

to have been calculated correctly.

exceeded the level resulting from the application of paragraphs 8 and 9

and gave rise to the request for consultations; or

e) the level of export a u t h o r i e a t i o n s a l ready issued at the time of suspension.

6 . The annual growth rate for the q u a n t i t a t i v e limits introduced under

his Article shall be d e t e r m i n e d duri n g the course of the c onsultations

referred to in paragraph 3 above.

7, The provisions of this Article may be invoked by the Community at a

regional level.

8 , The Community u ndertakes not to invoke the p r ovisions of paragraph 3 of

this Article before the level of export a u t h orisations for textile products

me n t i o n e d in paragraph 2 in any cate g o r y exceeds/ in relation to the

p r e ceding year'-s total· imports into the Community q f prod u c t s in that category/

the following rates :

- for categories of products in Group I 0.2%

- for categories of products in Group II 1.0%

- for categories of prod u c t s in G r o u p III 3.0%\

9. The Community further under t a k e s rot to invoke the p rovisions of this

Article on a regional basis before the level of export authori s a t i o n s for

textile products m e n tioned in p a r agraph 2 in any category e x ceeds the

following regional per c e n t a g e s of the levels referred to in paragraph 8 :

Germany 23.5%

Benelux 10.5%

France 18.5%

Italy 15.0%

Denmark 3.0%

United Kingdom 23.5%

Greece 2.0%

10. Up to the date of communication of the statistics referred to in

Article 9, paragraph 6 the provisions of paragraph 2 as qualified by

paragraphs 7 and 8 of this Article shall apply on the basis of the annual

statistics previously communicated by the Community.

11. in order to facilitate forecasts of Hong Kong's future export trends,

Hong Kong undertakes to supply the Community with half-monthly statistical

returns showing the quantities covered by the export authorisations mentioned

in paragraph 1 which are issued under the System to Hong Kong exporters.

Such data on export a u t h orisations shall be provided by the Hong Kong authorities

promptly in such detail and as frequ ently as the Community may reasonably request.

12. In the implementation of the provi s i o n s of this Article Hong Kong shall

notify the Community immediately upon receipt of any application for an export

authorisation in an e x c e p t i o n a l l y large amount.

13. The Hong Kong authorities undertake to notify the Community of any changes

to the Export Auth o r i s a t i o n System having a direct effect on the implementation

of this Agreement, where necessary, consultations may be requested under

jaragraph 1 of Article 15 of this Agreement.

14. The provisions of this Agreement which concern exports of products subject

to the quantitative limits est a b l i s h e d in Annex II shall also apply to products

for which quantitative limits are intro d u c e d under this Article.

Article 9

1. Hong Kong undertakes to supply the C o m munity with precise statistical

information on all export licences issued by the Hong Kong authorities

for all categories of textile p roducts subject to the quantitative limits

e s t a blished under this Agreement.

Hong Kong shall set out in its p eriodical statistical reports the m a x i m u m

export levels for each category subject to a quanti t a t i v e limit and the

rate of utilization of these levels.

Z. The Community shall likewise supply to the Hong Kong authorities

p r ecise statistical information on import documents issued by the

Community authorities in respect of export licences issued by Hong Kong.

3. The information referred to in p a r a g r a p h s 1 and Z shall, for all

c ategories of products, be tra n s m i t t e d before the eno of the second month

f o l lowing the quarter to which the statistics reLated.

4 . The Community shall transmit to the Hong Kon g authorities import

statistics for all products covered by Article 7, and for prod u c t s c o vered

by Article 5, p a r agraph 1.

5. The information referred to in pa r a g r a p h 4 shall, for all categories

of products, be transmitted before the end of the third month following the

quarter to which the statistics relate.

6 . For the purpose of applying the p r o v i s i o n s of Article J and

Article 8 the Community u nder takes to provide Hong Kong authorities

before 15 April of each year with the p r e ceding year's statistics on imports

of all textile products covered by this Agreement, broken down by the

supplying country and C o m munity Memb e r States.

?. Should it be found on analysis of the information e x c hanged above that

there are significant d i s c r e p a n c i e s be t w e e n the returns for exports and those

for imports^ consultations may be i n i t i a t e d ip accordance with the procedure

sp e c i f i e d in Article 15 of this Agreement.

Any s u c h consultations shall be resolved on the basis of the agreed

descriptions of the products contained in Annex I.

8 . Hong Kong also undertakes to supply the Community with statistical

Information on all textile exports by country of destination. This

Information shall be transmitted before the end of the third month

following the quarter to w hich the statistics refer.

ARTICLE 10

1, The authorities of Hong Kong shall, be informed of any amendment

to the Common Customs Tariff or NIMEXE or any decision, made in accordance

with the procedures in force in the Community, relating to the class­

ification of products c o vered by this Agreement.

Any amendment to the Common Customs Tariff or Nio e x e or any deci s i o n w h i c h

résulta in a m o d i f i c a t i o n of the o l a e a i f i c a t i o n of products c o vered by this

Agreement shall not have the effect of reducing Hong Kong's ability to

use the quantitative limits e s t a b l i s h e d in Annex II.

The procedures fqr the app l i c a t i o n of this pa r a g r a p h are set out in

Protocol A.

2. In case of divergent opini o n s b e t w e e n Hong Kong and the competent

Community authorities at the ppint of e ntry into the Community on the

classification of products covered by the present Agreement, consultations

in accordance w i t h A r t i c l e 15 paragraph 1 shall ba held w i t h a view to reaching

agreement on the app r o p r i a t e cl a s s i f i c a t i o n of the products concerned and

to resolving any d i f f i c u l t i e s arising therefrom.

for this purpose, the a u t h o r i t i e s of Hong Kong shall be informed by the

competent authorities of the Community as soon as a case of divergent

opinions on the c l a s s i f i c a t i o n of p r o d u c t s arises.

Pending agreement on the app r o p r i a t e c l a s s i f i c a t i o n and in order to avoid

d i s r u p t i o n to trade, the p r o d u c t s in ques t i o n shall be imported on the basis

of the classi f i c a t i o n indicated by the competent Community aut h o r i t i e s at

the point of entry, in c onformity with the provi s i o n s of this A g r e e m e n t .

ARTIOI.S 11

1. Hong Kong and the Co:r uunity agree to cooperate fully in preventing the

circumvention of tho present Agreement by transshipment, rerouting or

whatever other means*

corresponding quantitative limits established under the Agreement·

satisfactory solution within tho period specified in Artiole 15 para 1 of

the Agreement, the Community shall have the right, where clear evidence of

circumvention has boon provided, to deduo't from tho quantitative limits

established under thin Agreement amounts equivalent to tho products of

Kong Kong origin.

Article 12

1, Hing Kong shall endeavour to ensure that exports of t e xtile products

subject to q u a n t i t a t i v e limits are spaced out as evenly as possible over

an Ag>*eef"ent year, due account being taken, in particular, of seasonal

façtors.

2, fxport data shall be p r o v i d e d by the Hong Kp n g authorities promptly in

such detail and as frequently as the Community may reasonably request. If,

on the basis of such export data, the Community has evidence that there is

a sharp and substantial increase in the c o n c e ntration of exports, other

than a concentration a t t ributab le to normal seasonal factors, of p a r t i c u l a r

prod u c t s in any one category subject to quanti t a t i v e Limits e s t a b l i s h e d in

Annex II, the Community m a y request c o n s u ltations in accordance with the

pro c e d u r e specified in Article 15 of this Agreement with a view to

r e m edying this situation.

Article 13

1. For the purpose of the a d m i n i s t r a t i o n of this Agreement, the limits

referred to in Article 3 are broken d o w n into shares for each of the

Comnunityts regions as set out in Annex II,

2. The Community undertakes to e x a m i n e with care and reply within four

weeks to any request by Hong Kong for a port*on of any quantitative limit

est a b l i s h e d in Annex II not used in one region of the Community to be

re-allocated to another region.

Jf, in the course of the a p p l i c a t i o n of the agreement Hong Kong finds that

the break-down of a limit est a b l i s h e d in Ann»’x II causes particular

difficulties, it may request the o p ening of :onsultations in accordance with

the p r o cedure specified in Article 1!· with a view to reaching a mutually

satisf a c t o r y solution.

3. Should it'appear'in any given region of -he Community that additional

supplies are required, the Community may, where measures taken pursuant to

pa r a g r a p h 1 above are inadequate to cover those requirements, authorize

the importation of amounts g reater than those stipulated in Annex II.

Article 14

Hong Kong and the Community u n d ertake to refrain from d i s c r i m i n a t i o n

in the allocation of export licences and imjort d o c uments respectively.

Article 15

1, The special consultation procedures referred to in this Agreement shall

be governed by the following rules :

«. any request for consultations shall be notified in writing to the other

Party/ together with a statement setting out the reasons and circumstances

which/ in the opiniqn of the requesting Party, justify the submission of

such a request;

- the Parties shall enter into consultations within 15 days at the tatest

of notification of the request/ with a view to reaching agreement or a

mutually acceptable conclusion within a further 15 days at the latest.

2. If necessary, at the request of either of the Parties and in conformity

with the provisions of the Geneva Arrangement, consultations shall be held

on any problems arising from the application of this Agreement. Any

consultations held under this Article shall be approached by both Parties in a

spirit of cooperation and with a desire to reconcile the differences tetwoen

them.

Article 16

This Agreement shall apply to the territories within which the Treaty

establishing the European Economic Community is applied and under the

conditions laid down in that Treaty on the one hand, and to the territory

of Hong Kong on the other hand.

A r t i d e 17

1. This Agreement shall enter into force in the first day of the month

following the dafe on which the Contractlnj Parties notify each other

of the completion of the procedures necessary for this purpose. -It

shall be applicable until 31 December 1 9 8 6,

2. This Agreement $hatl apply with effect from 1 January 1983,

3. Either P a r t y m a y at any time propose modifications to this Agreement.

4. Either Party may at any time denounce this Agreement provided that

at least ninety days* notice is given. In that event the Agreement shall

come to an end on the expiry of the period of notice.

T I T L E I

C LA S SIF IC A T IO N

A rtic le 1

1. The competent authorities of the Community undertake to Inform Hong

Kong of any changes in the Common Customs T a r i f f or NIMEXE before

the ir entry Into effect 1n the Community.

2. The competent authorities of the Community undertake to Inform

Hong Kong of any Community decision adopted 1n accordance with the

procedures 1n forcé 1n the Community and re lating to the c lassification

of products subject to the present Agreement within one month of such

decision .being adopted at the la te s t . Such communication shall include:

(a) a description of the products concerned

<b) the relevant category, t a r i f f position or sub-position and the

Nl w e code

(c> the reasons which have led to the deçlsion.

3. Where a Community decision on c lass ifica tion results in a change of classi f lc a t i on practice or a change of catejorisation of any product subject to the present Agreement, the competent authorities of the

Community shall provide 30 days', not ice, from the date of the Community'? communication before the decision comes into e ffe c t .

Products shipped before the date of the entry into effect of the

decision shall remain subject to the e a r l ie r c lassification practice, provided that the goocfe in question are presented for Importation Into

the Community within 60 days of that date.

S wher# a Community decision on c lassification resulting in a change of classification practice or a change of categorisation of any product subject to the present Agreement affects a category subject to .re s tra in t , the Community undertakes to enter into consultations without delay in

accordance with the procedures described in paragraph 1 of Article 15 of th is Agreement with a view to agreeing necessary adjustments to the

appropriate quantitative lim its established in Annex I I and mitigating

any disruptive effects which might arise from such a Community decision.

TITLE I I

ORIGIN

Artlcte 2

1 products originating 1n Hong Kong for export to the Community inaccordance with the arrangements established by this Agreement shall be accompanied by a c e rt i f ic a te of Hong Kong origin conforming to

the model annexed to th is Protocol.

2, The c e rt i f ic a te of Hong Kong orig in shall be Issued b7 the competent govern­mental authorities of Hong Kong i f the productn in question can be considered

products originating 1n that country within the meaning of the relevant

rules In force 1n the Community.

3 . Certificates of Hong Kong orig in shall contain a f u l l and detailed description of the goods. In particu lar, c e rt i f ic a te s of Hong Kong

orig in ehall indicate?- in respect of clothing, shipments where the a rtic les 1n question are

Incomplete or unfinished;

- 1n respect of fabrics, Including knitted or crocheted fabric and products of categories 95 and 96, shipments where the products in

question are dyed, printed, Impregnated or coated?

- and in respect of products of categories 19, 20, 38B, 39, AO and

84, shipments where the artic les in question are embroidered.

A. The c e rt i f ic a te of Hong Koag orig in referred to in paragraph 1 ehall not be

required for import of goods covered by a c e r t i f ic a te of origin Form A completed In accordance with the relevant Community rules In

order to qualify for generalized t a r i f f preferences.

TITLE I I I

DOUBLE CHECKING SYSTEM

fOR CATEGORIES Of PRODUCTS

WITH QUANTITATIVE LIMITS

Section I

Exportation

A rtic le 3

The competent authorities of Hong Kong shall Issue an export licence in

respect of a l l consignments from Hong Kong of te x t i le products referred to

1n Annex I I up to the relevant quantitative lim its as may be modified by

Articles 6 / 8 and 13 of the Agreement and of te x t i le products

Subject to any d e f in it iv * or provisional quantitative limits established

as a result of the application of Articles 7 and 8 of the Agreement.

A rtic le A

1. The export licence shall conform to the model annexed to thisProtocol. I t must cert ify inter a lia that the quantity of the product 1n question has been set off against the quantitative lim it prescribedvfor the category of the product 1n question.

Each export licence shall only cover one of the categories òf products

l isted 1n Annex I I of this Agreement.

Art ic le 5

The competent Community authorities must be notified forthwith of the

withdrawal or a lteration of any export licence already issued.

Article 6

1. Exports shall be set o ff against the quantitative limits established

for the year 1n which shipment of the goods has been effected, even 1f the export ce rt if ica te 1s Issued after such shipment.

2, For the purposes of applying paragraph 1, the date of shipment of the

goods is considered to be the date of the ir loading on to the exporting

a irc ra f t / vehicle or vessel.

Artic le 7

The presentation of an export licence, in application of A rtic le 8 below, shall be effected not la te r than 31 March of the year following that in

which the goods covered by the licence have been shipped.

Section I I

Importation

A rtic le 8

Importation into the Community of te x t i le products subject to quantitative

lim its shall be subject to the presentation of appropriate import oocuments.

Artic le 9

The competent Community authorities shall issue such import documentsv

automatically within f ive working days of the presentation by the

importer of the original of the corresponding oxport licence.

Import documents shall be valid for six months.

The competent Community authorities shall cancel the already Issued

import documents i f the corresponding export licence has been withdrawn.

However, i f the competent Community authorities have not been no tif ied

about the withdrawal or cancellation of the export licence un ti l a fter

the products have been imported into the Community, the quantities involved

shall be set off against the quantitative lim it for the category and the

quota year in question and Hong Kong shall be informed as soon as possible.

Ar t ic le 1Q

1, I f the competent Community authorities find that the total quantities

covered by export certif icates issued by Hong Kong for a particular

Category 1n ary Agreement year exceed the quantitative limit established

in Annex I I for that category, as (nay be modified by Article 6 ,8 and 13 of the Agreement, or any defin itive or provisional limitestablished under A rtic le 7 or 8 or ^he Agreement, the said

authorities may suspend the further issue of import documents. In this event, the competent Community authorities shall Immediately Inform the authorities of Hong Kong and the special consultation procedure set out 1n Article 15, paragraph 1 of the Agreement

shall be in it ia te d forthwith.

2, Exports of Hong Kong origin not covered by export licences issued, by

Hong Kong 1n accordance with the provisions of this Protocol may be

refused the Issue of appropriate import documents by the competent

Community authorities.

However, 1f the import of such products i 3 allowed into the Community by the

competent Community authorities, the quantities Involved shall not be set off

against the appropriate quantitative limits set out 1n Annex I I or established

as a result of the application of Articles >7 or . 8 of the Agreement

without the express agreement of Hong Kong.

TITLE IV

FORM AMO PRODUCTION OF EXPORT CERTIFICATES AND CERTIFICATES OF ORIGIN

A rtic le 11

1, The export licence and the c e rt i f ic a te of Hong Kong origin may comprise

additional copies duly indicated as such. They shall be made out in

English or French. I f they are completed by hand, entries must be in

Ink and in p r in tscr ip t .

These documents shall measure 21Q x 292 mm. The paper used Must be

writing paper weighing not less than 25 g/m .

Only the priginajl, ,c learly marked "orig inal" shall be accepted by the

co-petent authorities in the Community as being valid for the purposes

of export to the Community in accordance with the arrangements established

by this Agreement.

2. Each export licence and c e r t i f ic a te of Hong Kong origin shall bear a serial number, whether or not printed, by which 1t can be id en tif ied .

The number for the export licence shall be standardized and composed

of the following elements!

Art ic le 12

The export licence and c ert if ica te of Hong Kong origin may be issued after

the shipment of the products to which they re la te . In such eases they shall bear either the endorsement "délivrée a posteriori" or the endorsement "Issued retrospectively,"

A rtic le 13

1, In the event o f ' th e f t , loss or destruction of an export licence or a cert if ic a te of Hong Kong orig in , the exporter may apply to the competent governmental authority which issued the document for a duplicate to be

made out on the basis pf the export documents in his possession. The

duplicate of any such certif ica te or licence so issued shall bear the

endorsement "duplicata."

2, The duplicate must bear the date of the original export licence or c e rt i f ic a te of Hong Kong origin.

TITLE V

ADMINISTRATIVE COOPERATION

A rtic le K

The Community and Hong Kong shall cooperate closely to Implement the

provisions of this Agreement. To this end, contacts and exchanges of

views ^including on technical matters) shall be fa c i l i ta te d by both

parties , In particular to establish the authenticity and accuracy of documentation required under the provisions of the Agreement.

Arf iç le 1i

Hong Kong shall send the Commission of the European Communities the names

and addresses of the governmental authorities competent for the issue and

verif ica tion of export licences and c e rt if ic a te s of Hong Kong origin together with

specimens of the stamps used by ^hese authorities. Hong Kong shall also• \ 9

notify the Commission of any change in this information.

A rtic le 16

1, Verification of cert if ica tes of Hong Kong origin or export licences

shall be carried out at random by the Hong Kong authorities.

2 , The competent Community authorities may request subsequent verif ica tio n

of certif icates of Hong Kong orig in or export licences at random or whenever they have reasonable doubt as to the authenticity of such

certif ica tes or licences or as to the accuracy of the information

regarding the products in question. ,

In such cases the competent authorities in the Community shall return

the C ertif icate of Hong Kong Origin or export licence, or a copy thereof to the Hong Kong authorities, g iving, where appropriate, the reasons for

an enquiry. I f the Invoice has been submitted, such invoice shall be

attached to the c e rt i f ic a te or Licence or i ts copy. The authorities

shall also forward any information that has been obtained suggesting

that the particulars given on the said c e rt i f ic a te or licence are

inaccurate.

3. Should the results of the random verification referred to inparagraph 1 above reveal serious contravention of the provisions

of this Agreement the Hong Kong authorities shall notify the

competent Community authorities of the result?.

Where the competent Community authorities have requested verification under paragraph 2 above, the results of such verification shall be

communicated to the competent Community authorities within three

months at the la test. The information communicated shall indicate

whether the disputed c e rt if ic a te or licence applies to the goods

actually exported and whether these goods are e lig ib le for export

in accordance with the arrangements established by this Agreement.Where the competent Community authorities so request, the Information

communicated shall also include copies of such other available

documentation as may fa c i l i ta te the fu l l determination of the facts

and, in particu lar, the true orig in of the goods.

$· For the purpose of subsequent verif ica tion of certificates of HongKong origin and export licences, copies of these together with relevant supporting documentation required to be lodged with the Hong Kong

authorities for the issue of such certificates or licences shall be

kept for a period of at least two years by the Hong Kong authorities.

A rtic le 17

1, Where the verif ica tion procedure referred to in Article 16 or where

information available to the Community or to Hong Kong indicates or apciears to indicate that the provisions of this Agreement are being

contravened, both parties shall cooperate closely and with the

appropriate urgency to prevent such contravention.

2. To this end, Hong Kong shall, on i ts own in i t ia t iv e or at the request of

the Community, carry out appropriate enquiries or arrange for such

enquiries to be carried out concerning operations which are or appear

to be in contravention of this Agreement. Hong Kong shall communicate

the results of these enquiries to the Cor.munity together with such

ether available Information as may fa c i l i ta te the determination of

the true origin of the goods.

3 , In pursuance of the cooperation referred to 1n paragraph 1, Hong Kong and

the Community shall exchange any available information considered byeither partner to be of use in preventing the contravention of the provisions

of th is Agreement.

4 , Where 1t is established to the satisfaction of both parties that the

provisions of this Agreement have been contravened, Hong Kong and the

Community agree to take a l l reasonable measures to prevent a recurrence

of such contravention.

growth rate shall be fixed by agreement between the Parties 1n accordance

applied to corresponding products under b i la te ra l agreements concluded

under the Geneva Arrangement between the Community and other third

countries having a level of trade equal to or comparable with that of

The Community declares that, i f any amendment 1s made to the rules

of origin referred to In Article 2, paragraph 3 of the Agreement, the

measures to avoid any possible consequent reduction of Hong Kong’ s a b i l i ty to use the quantitative limits established 1n Annex I I of the present Agreem i t .

The Community further declares that ony amendment made to the above- mentioned rules shall continue to be based on c r ite r ia not requiring,

1n order to confer originating status, more extensive operations than

those constituting a single complete process.

During the course of the negotiations between Hong Kong and the

Community on an Agreement covering trade in t e x t i l e products

between Hong Kong and the Community, the two parties had regard

to the le t t e r s dated 21 December I98I exchanged between us in

Geneva«

I can confirm that, in respect of Categories 2 and 3, Hong Kong w ill

suspend, for the duration of the Agreement, the provisions of

Artiole 6 of the Agreement in i t ia l l e d on 30 November 1982 in

Brussels between the two parties , Tou indioated that this suspension

and tho provisions of the in i t ia l l e d Agreoment discharge any

commitment which Hong Kong has under the le t t e r s dated 21 Docember

I98I exchanged between us in Geneva, Your le t t e r confirming th is
