Editorial

Welcome to this combined issue of the fortnightly TEXPROCIL E-Newsletter! As you are aware, we had covered a roundup of the various activities upto end of the month of May in our previous issue. In the interim, apart from the other activities, the Council was involved in organising the coveted TEXPROCIL Export Awards F.Y. 2019-2020 which due to the “second wave of pandemic” and the attendant travel and assembly restrictions could not be organised as an ‘in-person’ event including in a ‘hybrid’ format. However, considering the popularity of the event, the Council organised the Export Award function online, for the first time ever, offering the grandeur of a physical event to all our patrons.

We bring to you a Special Issue on the ‘Export Award Function’ offering a comprehensive coverage of this much awaited annual event of the Council.

TEXPROCIL Export Awards 2019-2020 was held on 18th June, 2021 at 4:00 pm on an online platform along with a live streaming of the event on YouTube and Facebook social media channels of the Council. The gracious presence of Smt. Smriti Zubin Irani, Hon’ble Union Minister of Textiles and Women & Child Development as the Chief Guest along with Shri Upendra Prasad Singh, Secretary, Ministry of Textiles and Smt. Roop Rashi, Textile Commissioner, Ministry of Textiles inspired us all. From the Council’s side, Shri Manoj Patodia, Chairman, along with Shri Sunil Patwari, Vice Chairman and myself coordinated the proceedings online.

The ‘Chairman’s Page’ in this edition highlights the salient features the speech delivered by Shri Manoj Patodia, Chairman, TEXPROCIL at the Export Award function.

The ‘Cover Story’ of this issue titled ‘Rewarding Excellence in Export Awards’ presents the chronology of important events that were a part of the online awards program. The article also provides historic details of ’TEXPROCIL Awards’ from the first event held in 1975-76 to the present Scheme followed in selection of Awardees. The Awards are popular amongst the exporters and have been well received on account of the modifications made to the Scheme of Awards to align with the changing needs.

The Awards have acquired a prestigious status due to the inventiveness seen in the present scheme to encourage large as well as small exporters within the overall scheme. The categories, such as Highest Global Awards, Special Achievement Awards and the Awards for Highest Employment Generation (employment overall, for MSMEs, and for Women) continue to reward achievements in quantum growth, innovation and job creation in the textile sector. The coveted Awards popular as the “TEXPROCIL Awards”, have helped inculcate a spirit of healthy competition between the exporters who keenly vie with each other to bag these Awards.

In this edition, we have focused on the excellence in exports achieved by our member exporters despite the various challenges brought in by the uncertain times.

The ‘Awardees Speak’ column in this edition brings to you the reactions and remarks of the awardees on winning the trophies and plaques respectively.

TEXPROCIL congratulates all the winners for their meritorious performances.

Friends, it is our endeavor in this Newsletter to balance feature articles and news roundups with informative content on policy updates, trade notifications and circulars which serve as important resources for members to navigate their businesses.

The popular, ‘Policy Talks’ section of the Newsletter regularly features updates on recent changes in policy and procedures announced by the Government. This section explains various provisions of the Foreign Trade Policy, incentive schemes and issues of taxation. The column in the present issue explains the various features of EPCG (Export Promotion Capital Goods) Scheme.

We do hope that you find reading this edition of the E-Newsletter worthwhile. We welcome your valuable feedback on the present edition and also invite contributions in the form of short articles on matters relevant to trade and industry.

Dear Friends,

It was indeed a matter of great pleasure for me to welcome all our guests to the prestigious Texprocil Awards function for 2019-20 on June 18, 2021, held on a digital platform for the first time in the history of the Council. Hon’ble Minister of Textiles & Women and Child Development, Smt. Smriti Zubin Irani graced the occasion as the Chief Guest. Shri Upendra Prasad Singh, Secretary Textiles presided over the function and Smt Roop Rashi, Textile Commissioner was the Guest of Honour.

I take this opportunity to congratulate all the Award Winners who have emerged leaders in their respective line of businesses during a very challenging year. Despite many challenges affecting global supply chains as well as the subsequent demand, it is noteworthy that our Award winners did not deter from marching ahead and sustained their businesses through that tough period.

Friends, in the welcome speech delivered by me at the award function, I briefly touched upon the prevailing global conditions especially affecting the exports of textiles & clothing during the F.Y. 2019-20. We highlighted some of the recent global developments including trade conflict between the US and China; the EU’s negotiation on a peaceful Brexit, and rapid strides made by countries like Bangladesh and Vietnam.

Despite the uncertainties that prevailed across world markets, the Indian companies took good advantage and overcame the situation by developing new products like PPE Suits / Coveralls / N-95 masks. The dynamic efforts of the entrepreneurs resulted in the development of a new industry valued at Rs. 7000 Crore (almost One Billion USD). The coordinated efforts on part of the Government and the industry under the inspiring leadership of our Hon’ble Minister Smt. Smriti Zubin Iranji, resulted in India becoming the second largest PPE manufacturer in the world in a short span of 90 days.

On the policy issues, I drew attention to some important pending issues that remain unresolved. I thanked the Hon’ble Minister and the Ministry officials present at the event for doing all things necessary for supporting the industry. As regards the value added segments of garments and madeups, we thanked the Government for implementing the ROSL scheme (covering State Levies) and modifying it later into the ROSCTL scheme (covering both State and Central Levies).

However, in the face of stiff international competition, I also pointed to the huge

uncertainty faced by the exporters in quoting prices to their overseas buyers in the absence of any announcement regarding the rates under the Remission of Duties and Taxes on Export Products (RoDTEP) Scheme. I have urged the Hon’ble Textile Minister to personally intervene in the matter, so that the RoDTEP Rates are notified at the earliest.

I have also requested the Hon’ble Minister to review the total levy including customs duty amounting to 11% on import of raw cotton imposed in the Union Budget for 2021-22. We drew the attention of the Ministry towards the fact that the varieties of Extra Long Staple cotton being imported at present are not being produced in commercial quantities in India. While the efforts to produce these varieties in India are in full swing, it will take some time for it to reach a level of self-sufficiency. Hence we request for removing the levy on cotton totally.

The welcome speech was followed by distribution of the coveted TEXPROCIL Export Awards for the excellence in exports achieved during the year 2019-2020. I must thank all the Award winning companies for complying in a timely manner with the requirements of online events that immensely helped to add a lot of splendour to the on-line celebrations.

I am pleased to share that, for the year 2019-20, the Council presented 58 Awards in 34 different categories and out of the 44 companies receiving the award, 5 companies received the prestigious Award for the first time. Also the Council’s decision to institute Awards for Highest Employment generation, three years ago of women workers, by MSMEs and in overall terms drew an enthusiastic response from our members and a special word of praise from the Hon’ble Textile Minister.

Friends, despite being the first time ever that the event was held online, the Export Award function attracted a large number of online participants and was able to maintain the grandeur that it offered through the in-person ceremonies held in the past. This would have not been possible without the generosity of our Advertisers and Sponsoring companies who stood by the Council in organising the online event. I personally thank each of our advertisement partners and sponsoring companies and would request them to continue supporting the Council’s endeavours in future.

Friends, as we are living in COVID times, with the second wave slowly abating amidst warning of an impending ‘third wave’, the only option for

all of us is to ‘stay safe’ and lead normal lives is to ensure that the entire community gets vaccinated on a war footing.

The Government has also intensified its efforts in this direction and the Hon’ble Minister of Textiles & Women and Child Development, Smt. Smriti Zubin Irani also made a special appeal in her speech at the Council’s Award Function.

Taking the message forward, the Council has commenced a drive – ‘Don’t hesitate – Vaccinate’ and has commenced collecting information from the members in this regard. I appeal to each one of you to join the efforts to ‘Vaccinate All’ and send in the information to the Council (in the prescribed format) for further consolidation and reporting to the Ministry.

Friends, in conclusion, I must share that it has been a great pleasure and a novel experience in organising the online export award function. TEXPROCIL Export Awards appropriately reflect the endless hours that our Member companies have spent negotiating contracts and booking orders in these trying times, thereby bringing glory to the entire nation.

While contributing a major share to India’s total industrial production as well as export earnings, the labour intensive cotton textile industry also significantly contributes towards the national goal of employment generation.

The Cotton Textiles Export Promotion Council (TEXPROCIL) recognizes the role played by the exporting community in developing and diversifying the export of Cotton Textiles, every year, by distributing Awards for Outstanding Export Performance.

The first in the series of such Annual Awards was instituted in the year 1975-76 and since then they have been well received thereby acquiring a status of coveted prestige. Winners of these Awards are looked upon as ‘Achievers’ within the exporting community as they pave the way for success despite national and international challenges.

The coveted Awards, popularly known as the “TEXPROCIL Awards”, have helped inculcate a spirit of healthy competition between the exporters as they keenly compete in various categories to win these prestigious Awards every year.

Texprocil Export Awards 2019-2020

The Texprocil Awards function for 2019-20 was held on June 18, 2021 on a digital platform for the first time in the history of the Council. The Hon’ble Minister of Textiles & Women and Child Development, Smt. Smriti Zubin Irani was the Chief Guest while Shri Upendra Prasad Singh, Secretary Textiles presided over the function. Smt Roop Rashi, Textile Commissioner was the Guest of Honour.

The challenges in organizing the Awards in virtual mode were easily overcome despite stringent deadlines mainly due to the efforts of the organising team. This was also well supplemented by the timely & quick response from Award winners in complying with the online procedures. These well-coordinated efforts helped in organising a seamless event which managed to hold its past splendour as witnessed in a physical format Show.

Welcome Address

Welcoming all the guests to the online event, Shri Manoj Patodia, Chairman, TEXPROCIL briefly spoke on the prevailing global conditions and the stiff international competition affecting the exports of textiles & clothing due to the Corona pandemic. He also mentioned some of the global developments including trade conflict between the US and China; the EU’s negotiation on a peaceful Brexit, and the rapid strides made by countries like Bangladesh and Vietnam in exports of textile and clothing.

Shri Patodia highlighted that policies play an important and crucial

role in the growth of the industry and he thanked the government for announcing timely reforms which were supportive of the trade and industry at large. Bringing up the issue of the Remission of Duties and Taxes on Export Products (RoDTEP) Scheme rates, he said that exporters face huge uncertainty in quoting prices to their overseas buyers in the absence of the RoDTEP rates. Chairman sought the personal intervention of the Hon’ble Textile Minister, in getting the RoDTEP Rates notified at the earliest.

Over the years, the scheme of the Export Awards has undergone changes to realign with the varying needs of the industry. The present scheme of TEXPROCIL Awards was instituted with a view to encourage large as well as small exporters while recognizing excellence in exports of specific product groups within the overall category of Yarns, Fabrics and Madeups.

For the year 2019-20, the Council presented 58 Awards in 34 different categories and out of the 44 companies receiving the award, 5 companies received the prestigious Award for the first time. Presiding Address

Shri Upendra Prasad Singh, Secretary, Ministry of Textiles presided over the function briefly highlighting the various support initiatives made available to the exporting community by the government to help them tide over the challenges brought by the pandemic situation.

Shri Singh expressed his satisfaction that despite facing such hurdles the textile exporters have still managed to survive and revive their businesses. On behalf of the government, he backed the exporting community of the textile sector by assuring all possible assistance and support.

achieving excellence in exports despite a fall in demand due to the disruption in global supply chains. The Hon’ble Minister congratulated the Award Winners for emerging as leaders in their respective line of businesses during a challenging year.

The Hon’ble Minister took note of the Special Texprocil Awards instituted towards the cause of employment generation in categories such as overall highest employment in the sector, highest employment in the MSME units and highest employment for women.

The Textiles Minister also praised the efforts being undertaken by TEXPROCIL in promoting innovation, new products and market access in non-traditional markets by announcing the Special Achievement Awards instituted for product categories of Yarns, Fabrics and Madeups under the Council’s purview.

The Minister added that the Ministry has always stood in support of the textile community and the pending demands put forward by the industry are being continuously reviewed with the other Ministries including the Commerce, Finance and Revenue departments.

In the present times, saving lives and ensuring safety for all has become a national priority. On its part, the Government has also intensified its efforts to undertake Vaccination Drive on a war footing as it is seen as the only means available to overcome the pandemic situation. The Hon’ble Minister of Textiles & Women and Child Development, Smt. Smriti Zubin Irani also made a special appeal to join the efforts to ‘Vaccinate All’ towards the end of her speech.

Vote of Thanks

Shri Sunil Patwari, Vice Chairman, TEXPROCIL proposed the Vote of Thanks stating that despite the uncertainties prevailing across world markets, the Indian companies turned available opportunities amid global volatility to their advantage.

On behalf of the Council and Members of the Committee of Administration of TEXPROCIL Shri Patwari thanked Hon’ble Minister of Textiles & Women and Child Development, Smt. Smriti Zubin Irani for consenting to be the Chief Guest. He also thanked Shri Upendra Prasad Singh, Secretary Textiles for presiding over the function and Smt Roop Rashi, Textile Commissioner for being the Guest of Honour.

The Vice Chairman further expressed immense gratitude to all those concerned with the organization of the online export awards function, including the Advertisers and Sponsors without whose generosity it would have not been possible to organise such a splendid event. He also thanked the Award winning companies for complying with the procedural requirements of an online export awards function in a timely manner. Shri Patwari also thanked the Press and the Media for supporting the Council’s

initiatives and disseminating critical and crucial information through their respective publications.

Conclusion

The entire country is privy to the fact that the coordinated efforts on part of the Government and the industry had helped India become the second largest PPE manufacturer in the world in a short span of 90 days. The vigorous efforts undertaken by the industry – their entrepreneurial vision in developing new products like PPE Suits / Coveralls / N-95 masks has resulted in the development of a new industry valued at Rs. 7000 Crore (almost One Billion USD).

There is a need to celebrate the Indian success stories, their entrepreneurial spirit and relentless efforts in achieving success at the highest level. Towards this end at TEXPROCIL – ‘Rewarding Excellence in Exports’ – has become an annual rendezvous that will continue to present itself in the form of the prestigious ‘TEXPROCIL Awards’.

EPCG Scheme – An Instrument to reduce cost of Capital GoodsBy Mr. A Ravikumar, Joint Director, TEXPROCIL

EPCG Scheme – An Overview The EPCG (Export Promotion Capital Goods) Scheme aims to enhance India’s manufacturing competitiveness by facilitating

import of capital goods for the manufacture of quality goods & services. Benefit under the EPCG scheme The EPCG Scheme allows import of capital goods at zero customs duty. Import of capital goods are also exempt from the payment of IGST and Compensation Cess. This exemption has been extended till March 31, 2022 vide CBIC Notification No. 23/2021-Customs dated 31.0.3.2021. There is also an option available to the importer to pay IGST and Compensation Cess in cash in which case the incidence of IGST and Compensation Cess would not be taken for computation of net duty saved subject to the condition that Input Tax Credit is not availed. Clearances of Capital goods under the scheme Duty free clearance of Capital goods imported under the scheme are allowed by the Customs against EPCG Authorizations issued by the Regional office of DGFT (RA) based on applications filed online by the applicant on the DGFT website . Export Obligation under the EPCG scheme The resultant products manufactured out of the capital goods imported duty free under the scheme must be exported. (i) Specific Export Obligation The export obligation under the EPCG scheme is equivalent

to 6 times of the duties, taxes and cess saved on capital goods. This obligation, called as Specific Export Obligation, is required to be completed in 6 years from date of issue of the EPCG Authorisation.

(ii) Average Export Performance ( AEP ) The Specific EO under the scheme shall be, over and above,

the average level of exports achieved by the exporter in the preceding three licensing years for the same and similar products (called as Average Export Performance).

(iii) Mandated Block Period 50% of the Export Obligation must be completed within the

first 4 years from the date of issue of the authorization and the balance 50% can be completed in the last 2 years of the Export Obligation period.

Validity of EPCG Authorizations for import The validity of EPCG Authorisations for import is 18 months from the date of issue of the Authorisation. There is no provision for Revalidation of EPCG Authorisations. Eligibility Manufacturer exporters and Merchant exporters with supporting manufacturer(s) can operate under the EPCG scheme. In the case of merchant exporters, the name of the supporting manufacturer(s) should be endorsed on the EPCG Authorisation.

Actual User Condition Imported capital goods shall be subject to Actual User condition till export obligation is completed and EODC (Export Obligation Discharge Certificate) is granted.Conditions for fulfilment of Export Obligation (EO) (i) Export Obligation should be completed by exporting the

goods manufactured out of the capital goods imported under the scheme.

(ii) Export Obligation can be fulfilled by the EPCG authorisation holder by direct exports or through third party exports.

(iii) In the case of merchant exporters, the name of the supporting manufacturer should be mentioned on the export documents.

(iv) If 75% or more of specific export obligation and 100% of Average Export Obligation till date are completed in half or less than half of the original export obligation period then the remaining export obligation shall be waived off.

(v) Shipments under Advance Authorisation, DFIA, Drawback scheme or reward schemes under Chapter 3 of the FTP would also be counted towards the fulfilment of EO.

(vi) Export obligation can be fulfilled by certain categories of Deemed Exports in addition physical exports.

Indigenous sourcing of capital goods against EPCG Authorizations EPCG authorisation holders are allowed to source capital goods from the domestic manufacturer instead of importing. In case of domestic sourcing, EO shall be calculated with reference to notional Customs duties saved on FOR value. The domestic manufacturer shall be eligible for deemed export benefits. Further, in case of indigenous sourcing of Capital Goods, specific EO shall be 75% of the stipulated EO. Extension in Export Obligation Period There is a provision for two extensions of one year each in export obligation period on payment of the prescribed composition fee. Redemption A Bond is to be executed with the RA and the Customs before clearance of the first consignment. After completion of the export obligation, the Authorisation holder shall apply for redemption of bond the RA. If satisfied, the RA shall issue an EODC ( Export Obligation Discharge Certificate ).Regularization of shortfall in the fulfilment of EO In case of shortfall in the fulfilment of EO, the EPCG authorisation holder shall pay Customs Duty along with applicable interest as prescribed by Customs Authority. Continuation of the EPCG scheme EPCG scheme is widely used by the industry and exporters are hoping that the scheme will be continued in the new Foreign Trade Policy:: TEXPROCIL ::
