5. GENERAL CONDITIONS

5.1 Any change in personnel, equipment or working conditions as mentioned in the consentsform/order should immediately be intimated to this Board.

5.2 The waste generator shall be totally responsible for (i.e. Collection, storage,transportation and ultimate disposal) _of the wastes generated.

5.3 Records of waste generation, its management and annual return shall be submitted toGujarat Pollution Control Board in Form - 4 by 31st January ot every year.

5.4 In case of any accident, details of the same shall be submitted in Form - 5 to GujaratPollution Control Board.

5.5 Applicant shall comply relevant provision of "Public Liability Insurance Act-91"

5.6 Unit shall take all concrete measures to show tangible results in waste generationreduction, voidance, reuse and recycle. Action taken in this .regards shall be submittedwithin 03 months and also along with Form 4.

5.7 Industry shall have to display on-line data outside the main factory gate with regard toquantity and nature of hazardous chemicals being handled in the plant, includingwastewater and air emlssioils and solid hazardous waste generated within the factorypremises.

5.8 Adequate plantation shall be carried out all along the periphery of the industrial premisesin such a way that the density of plantation is at least 1000 trees per acre of land and agreen belt of 10 meters width shall be developed.

5.9 The applicant shall have to submit the returns in prescribed form regarding waterconsumption and shall have to make payment of water cess to the Board under theWater (Prevention and Control of Pollution) Cess Act- 1977.

Subject: Environmental and CRZ Clearance for development of LNG Terminal at Mundra Port, Kutchch, Gujarat by M/s. GSPC LNG Ltd - Reg.

This has reference to letter No: GNR/LNG/D-001/201 dated 20.05.2013 and subsequent letters dated 03.06.2013, 07.09.2013, 01.10.2013, 04.12.2013 and 10.01.2014 seeking prior Environmental and CRZ Clearance for the above project under the Environment Impact Assessment (EIA) Notification - 2006 and Coastal Regulation Zone (CRZ) Notification, 2011. The proposal has been appraised as per prescribed procedure in the light of provisions under the EIA Notification - 2006 and Coastal Regulation Zone Notification, 2011 on the basis of the mandatory documents enclosed with the application viz., the Questionnaire, recommendation of State Coastal Zone Management Authority, EIA, EMP and the additional clarifications furnished in response to the observations of the Expert Appraisal Committee constituted by the competent authority in its meetings held on 28th - 30th October, 2013, 26th - 28th December, 2013 and 22nd - 24th January, 2014.

2. It is interalia, noted that the proposal involves setting up a terminal for import, storage and regasification of liquefied natural gas (`LNG") of a capacity of five (5) MMTPA, expandable up to ten (10) MMTPA at Mundra, State o f Gujarat, ("GSPC LNG Terminal"). The facilities include LNG carrier berthing and unloading facilities; two (2) LNG storage tanks having net capacity of 160,000 cubic meters each in Phase I third LNG storage tank in Phase II; LNG regasification system; Feral metering and connection to the natural gas grid; and all cLiailities -find control systems. The LIG Terminalis proposed be eveloped in three (3) phases and is proposed to have the following facilities ii-Pon completion of each phase.

• Upon completion of Phase 1: unloading facilities for LNG tankers, two (2) LNG storage tanks and regasified LNG send out capacity of five (5) MMTPA (peak capacity six point two five (6.25) MMTPA).

• Phase II: unloading facilities for LNG tankers, two (2) jetties, three (3) LNG storage tanks and regasified LNG send out capacity of ten (10) MMTPA (peak capacity twelve point five (12.5) MMTPA).

• Final Phase: unloading facilities, two (2) jetties, six (6) LNG storage tanks and regasified LNG send out capacity of twenty (20) MMTPA.

3. Currently Phase-1 of the development of the GSPC LNG Terminal (as detailed above) is planned to be implemented while keeping provision for next phase of development. A plot of twenty eight (28) hectare (800 m by 350 m) has been earmarked for Phase I of the LNG terminal. Expansion of the Project using the adjacent plot of twenty (20) hectare is available for the final phase. The LNG terminal (including the waterfront) is located within the SEZ area at Mundra, of which Adani Ports and Special Economic Zone Limited ("APSEZ") is the developer. The LNG receiving, Storage and Regassification facilities will be established in the terminal. The proposed LNG jetty will be located to the south of the shore line and west of the proposed new container terminal at sea bed level of about -15 m CD, which would be sufficient to berth LNG ships up to 2,50,000 Cum capacities.

4. Clearance was issued to Water Front Developments of and Mundra Port SEZ Ltd (MPSEZ) after following due procedure under EIA Notification, 2006 including conduct of Public Hearing. The LNG Terminal has also one of the component. M/s GSPC has made concession agreement with APSEZ for setting up of LNG Terminal. Accordingly, M/s GSPC LNG made application for transfer of Clearance with respect to LNG Terminal from M/s. Adani Port SEZ Ltd. to M/s. GSPC LNG Ltd.

5. The EAC finalised ToR in its meetings held in January, 2009 and August, 2009. The project proponent requested for the exemption of Public hearing stating that it was conducted by the M/s. Mundra Port and SEZ Ltd., for which Environmental Clearance was issued by the Ministry and the above project is part of the total project of M/s. Mundra Port and SEZ Ltd. The Committee after a detailed discussion, recommended to exempt the Public Hearing as it was already conducted earlier for whole of the project. The Gujarat Coastal Zone Management Authority has recommended the project vide letter dated ENV-10-2010-98-E dated 06.06.2010.

6. EAC in its meeting held in October, 2013 decided to defer the proposal till a report on the issue relating to the Ms Sunita Narain Committee was received by the EAC from the Ministry. GSPC has stated that the report of Sunita Narain Committee acknowledges presence of LNG project and there is no adverse remark against the proposed LNG terminal project. The GSPC LNG project is about 2.6 km away from the disputed area and creeks. The evacuation pipeline for regasifed LNG shall be routed away from the Baradi Mata creek and mangrove zone. The road connectivity to the LNG terminal shall be from the existing road of South Port and away from the creek/ mangrove areas. The Project Proponent further stated that GLL has completed all other pre-project activities and was ready to award the lump sum EPC contract for the project facilities. All information and studies required from time to time by the MoEF/Expert Appraisal Committee of MoEF have been submitted. The Mundra LNG terminal project shall bring additional 5 MMTPA of LNG (Approx 19 MMSCMD of natural gas to consumers) which shall mitigate the growing demand supply gap of natural gas in the country. The

Project Proponent also stated that he shall abide by the stipulations and conditions of EIA studies as well as conditions considered pertinent by MoEF to implement Lhe project in a environmentally safe and harmonious manner.

7. The matter has been examined by the Ministry and referred the proposal to EAC subject to the submission of action plan to maintain the present mouth of the Baradi Mata creek by the Project Proponent/ APSEZ Ltd.

8. The EAC in December, 2013 suggested to the Project Proponent to carryout the hydrodynamic model study to measure the flow at the mouth of ' Baradi Mata Creek and come with the plan to ensure sufficient flow between creek and the Gulf and also to protect the mouth 'of Baradi Mata creek.

9. The details submitted and presented by the Project Proponent were examined by the EAC in January, 2014. According to Project Proponent, pre-development of Port, there was wider flow at the mouth during high tide and 82 m wide flow during low tide. Post development, the flow is 290 m wide at. low tide. The hydrodynamic model study recommended annual bathymetry survey in Baradi Mata creek and the near shore areas in front of the mouth/ west of breakwaters and maintenance dredging to ensure that the creek mouth remains open. The EAC examined the proposal of Project Proponent for ensuring flow into Baradi Mata creek. Considering different alternatives, it was thought prudent not to construct any civil structure at this juncture.

10. The Expert Appraisal Committee, after due consideration of the relevant documents submitted by the project proponent and additional clarifications furnished in response to its observations, have recommended for the grant of Environmental and CRZ Clearance for the project. Accordingly, the Ministry hereby accords necessary Environmental and CRZ Clearance for the above project as per the provisions of Environmental Impact Assessment Notification - 2006 and Coastal Regulation Zone Notification, 2011, subject to strict compliance of the terms and conditions as follows:

11. SPECIFIC CONDITIONS:

(i) "Consent for Establishment" shall be obtained from State Pollution Control Board under Air and Water Act and a copy shall be submitted to the Ministry before start of any construction work at the site.

(ii) Project Proponent shall carry out annual bathymetry survey in Baradi Mata creek and the near shore areas in front of the mouth/west of breakwaters as per the area of extent proposed in the hydrodynamic study.

(iii) Project Proponent shall carry out periodical maintenance dredging to ensure that the creek mouth remains open in all the seasons for tidal exchange of water.

(iv) Project Proponent shall carry out continuous monitoring of tide levels in the upstream sections of the creek as proposed in the study and its comparison with open ocean tide at Mundra Port to serve as an indicator of flows in to the creek.

(v) Project Proponent shall conduct flow measurement at Baradi Mata creek at the location derived from hydrodynamic study atleast once a year for 7 days during spring and neap tides to establish a trend and monitor any adverse changes in reduction of flow into the creek.

(vi) Findings and action taken on the above studies shall be submitted along with six monthly report to Regional Office, MoEF.

(vii) Any direction issued by the MoEF with respect to the report submitted by Ms Sunita Narain Committee as applicable shall be complied with by the Proponent.

The evacuation pipeline for regassifed LNG shall be routed away from the Baradi Mata creek and mangrove zone, as committed.

The road connectivity to the LNG terminal shall be from the existing road of South Port and away from the creek/mangrove areas, as committed.

(x) Project Proponent shall earmark at least one percentage of total project cost towards Environmental Fund as committed vide letter dated 05.10.2013.

All the recommendation of the EMP, Risk Assessment and Disaster Management Plan shall he complied within letter and spirit. All the mitigation measures submitted in the EMP/DMP report shall be prepared in a matrix format and the compliance for each mitigation plan shall be submitted to MoEF along with half yearly compliance report to MoEF-RO.

(xii) A separate Environment Monitoring Cell shall be set up especially for this plant and details shall be submitted to the Ministry prior to the commencement of operation

(xiii) Construction activity shall be carried out strictly as per the provisions of CRZ Notification, 2011. No construction work other than those permitted in Coastal Regulation Zone Notification shall be carried out in Coastal Regulation Zone area.

(xiv) The funds earmarked for environment management plan shall be included in the budget and this shall not be diverted for any other purposes.

12. GENERAL CONDITIONS:

Appropriate measures must be taken while undertaking digging activities to avoid any likely degradation of water quality.

Full support shall be extended to the officers of this Ministry/Regional Office at Bhopal by the project proponent during inspection of the project for monitoring purposes by furnishing full details and action plan including action taken reports in respect of mitigation measures and other environmental protection activities.

(iii) A six-Monthly monitoring report shall need to be submitted by tht project proponents to the Regional Office of this Ministry at Bhopal regarding the implementation of the stipulated conditions.

v) Ministry of Environment 85 Forests or any other competent authority may stipulate any additional conditions or modify the existing ones, if necessary in the interest of environment and the same shall be complied with.

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulated are not complied with the satisfaction of the Ministry.

In the event of a change in project profile or `change in the implementation agency), a fresh reference shall be made to the Ministry of Environment and Forests.

The project proponents shall inform the Regional Office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work.

A copy of the clearance letter shall be marked to concerned Panchayat/lotal NGO, if any, from whom any suggestion/ representation has been made received while processing the proposal.

State Pollution Control Board shall display a copy of the clearance letter at the Regional Office, District Industries Center and Collector's Office/Tehsildar's office for 30 days.

13. These stipulations would be enforced among others under the provisions of Water (Prevention and Control of Pollution) Act 1974, the Air (Prevention and Control of Pollution) Act 1981, the Environment (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification 1994, including the amendments and rules made thereafter.

14. All other statutory clearances such as the approvals for storage of diesel . from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

15. The project proponent shall advertise in at least two local Newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded Environmental and CRZ Clearance and copies of clearance letters are available with the State Pollution Control Board and may also be seen on the website of the Ministry of Environment and Forests at httn://www.envfor.nic.in. The advertisement should be made within 10 days from the date of receipt of the Clearance letter and a copy of the same should be forwarded to the Regional office of this Ministry at Bhopal.

16. This Clearance is subject to final order of the Honble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.460 of 2004 as may be applicable to this project.

17. Any appeal against this clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, 2010.

18. Status of compliance to the various stipulated environmental conditions and environmental safeguards will be uploaded by the project proponent in its website.

19. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the company by the proponent.

20. The proponent shall upload the status of compliance of the stipulated Clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.

21. The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of Clearance conditions and shall also be sent to the respective Regional Offices of MoEF by e-mail.

Sub: CRZ clearance for propose LNG Terminal of MIS GSPC LNG Ltd, at Mundra, Dist: Kuchchh.

Dear Sir,

M/s GSPC LNG Limited (GLL) vide their letter dated 11-01-2010 has approached this

Department seeking the recommendation for obtaining CRZ clearance from Ministry of

Environment and Forests, GOI for proposed LNG terminal at Mundra, in Taluka:

Mundra , Dist: Kuchchh,.

M/S Gujarat State Petroleum Corporation Limited, Gandhinagar has submitted that

considering the need of Natural Gas in the country GSPC has launched a special purpose

vehicle, "GSPC LNG Limited(GLL)" to develop and construct Receiving, Storage and

Regasification Terminal for Liquefied Natural Gas(LNG) at Mundra in Kuchchh District

of State of Gujarat. The key facilities of the LNG Terminal shall consist of:

1. Jetty for unloading the LNG from the designated ships( 30M*50M).

2. Unloading arms : 4 Nos

3. Tanks for storage purpose( 2 Nos Full Containment Type having capacity of

1,60,000 M3 each)

4. Open Rack Vaporizer(ORV) for Regasification purpose: 5 Nos.

The GLL has vide its letter dated 14/10/2008, submitted Form-1 to MoEF, GOI along

with proposed TOR. The GLL has made a presentation during 7314 Expert Appraisal

Committee(EAC) meeting held on 30th January,2009 at MoEF, GOI, New Delhi. After

detailed deliberations, the TOR were issued by the MoEF vide its letter no: F.No. 10-

2/2009-IA-III dated 26-05-2009. On a request letter from the GLL and presentation

made by the GLL, the EAC recommended to exempt the project from the Public

Hearing, vide its letter dated 28-10-2009 as it was already conducted earlier for Water

Front Development Plan of MPSEZ, which included LNG Terminal as a part of overall

development plan.

M/s GLL has submitted the following documents:

1. Rapid Environmental Impact Assessment and Environmental Management Plan

prepared by M/S SECON Pvt. Ltd.

2. Risk Assessment Study and Disaster Management Plan prepared by NEERI„ Nagpur.

3. Rapid Marine Environment Impact Assessment prepared by Department of

Environmental Science, KSKV Kuchchh University.

4. Demarcation of HTL, LTL and CRZ boundary along with CRZ map prepared by

National Institute of Oceanography(N1O), Goa.

5. Ship Navigation Study by HR Wallingford, UK.

6. Various undertakings as per the guidelines of this Department.

The SECON Pvt Ltd(SPL), in their rapid EIA report has included the Base

Environmental Data (chapter 3), Anticipated Environmental Impacts (chapter 4),

Environment Impact Statement (chapter 5), Environmental Management Plan (chapter

6), along with the Conclusions.

The SPL has mentioned in its REIA that construction of the LNG Terminal involves civil

, electrical and mechanical work involving various types of machines and its capital

intensive work. Environmental impacts related to construction works are mostly of

temporary nature, and shall last during the construction period only. It is mentioned in

the report that the ambient air quality monitoring results show the SPM and•RSPM

concentration, at most of the locations within the core zone of the proposed project site,

are close to the norms prescribed for the residential areas. Monitored values of SO2 and

NOx in the ambient quality were within limits indicating the low pollution level as per.

the CPCB criteria.

The vehicular movement generates pollutants such as NOx, CO and HC. But the

vehicular pollution is not expected to lead to any major impacts. The soil in the project

area is sandy in texture, and is likely to generate substantial quantities of dust. Since,

there is no habitation or ecologically sensitive areas in the vicinity of the site, the impacts

on air environment during the construction phase is not expected to be significant. The

combustion of diesel in various construction equipment could also be one of the sources

of air pollution during the construction phase.

It is mentioned in the REIA that during the construction, there is potential for excessive

particulate generation on-site and on the approach roads. Vigilant attention to standard

dust control particles , industrial hygiene and traffic control can minimize these effects on

air quality. During construction, the site preparation work and intensive use of heavy

vehicles at the plant site will result in the emission of Particulate Matter. As the site is

sufficiently isolated by distance from the residents of the area, the particulate emission

will not result in significant impacts off the plant site. Thus , the impacts are temporary

and shall last during the construction phase only. This will have some impacts on human

life in terms of health problem especially on construction workers who remain exposed

to dust and air pollution for long duration, however, such impacts are reversible and can

be mitigated by incorporating suitable air pollution control measures in the

Environmental Management Plan followed by its implementation and monitoring.

It is mentioned in the REIA prepared by the SPL that during the normal operation, the

plant will have a few soirees of emission and will have no significant impacts. In

emergency situation, the diesel back-up equipment will cause increased noise but not

significant impacts.

It is mentioned in the REIA that emissions from the mobile sources, such as ships and

vehicular traffic along with flaring and fugitive emissions are most likely contaminants to

be found during operation of an LNG plant. The LNG Terminal and re-gasification unit

will have the facilities like LNG storage tank, Boil off gas compressor, Absorber, HP

Pump, Heat exchanger, Pipelines, Metering devices, Flare Stack and D.G. sets etc. The

LNG storage and re-gasification does not involve combustion of any anthropogenic fuel.

Thus, the ambient air quality is not likely to be affected due to proposed project. In case

of emergency, cold vapour would be flared. A low pressure cryogenic collection and flare

system shall be provided. The flare shall not be sized for the full sendout rate, which will

be prevented by a High Pressure Protection System(HPPS). The system shall include a

liquid knock-out drum elevated flare and pilot burner. The flare design shall consider the

maximum heat radiation to surrounding personnel and equipment. Emissions during LNG

flaring are not expected to be significant. CO2 and NOx in small quantities will be

released to atmosphere during the flaring, however, their GLCs will be insignificant.

It is mentioned in the REIA that the impact of noise generated by the activities of

operations on the near-by population is expected to be significant as the proposed

location is offshore. During the construction phase, noise will be generated through

vehicular movement , construction activities, DG Sets etc. It is further mentioned in the

REIA that on the basis of expected noise levels, it can be concluded that the noise levels

in the region would be within the standard limits. The increase will only be temporary and

marginal compared to the existing noise levels.

It is mentioned in the REIA that the soil in the area is sandy in nature and has high

permeability. This leads to quick migration of contaminants in to water flow leading to

sea water. Hence, the proper effluent treatment will prevent the contamination of water

bodies. For this purpose there will be an effluent treatment plant with which the

discharge of liquid waste will be connected for treatment and disposal.

It is mentioned in the REIA report that the proposed LNG Terminal requires an area of

48 hector , which will involve two phases. Phase-I requires an area of 28 hectors and

Phase-II requires an area of 20 hectors. The construction operation in the area will

involve loosing of topsoil in certain area and partial removal of vegetation. No source of

impact on the chemical, biological quality of soil exists, as part of these operations.

Hence, no residual impacts are envisaged on the land environment due to loosening of

soil and removal of vegetation. It is further mentioned that solid waste generated is

estimated to be 2 kg/day. Solid wastes generated during the construction operations will

be incinerated and the residue will be sent to Authorized Disposal Facility.

It is mentioned in the REIA that the floristic components of the study area does not

include any rare-or-endangered species. No rare or endangered species of the fauna are

reported to exist in the area. There will not be any impacts on flora as the proposed

project will be on reclaimed land. The proposed project area has little vegetation or

habitats for terrestrial organisms. The land on which the project will be established is yet

to be reclaimed. Thus, it can be concluded that the proposed project is unlikely to cause

any adverse impacts on terrestrial ecology. Thus, any significant negative impacts on the

flora or fauna are ruled out.

The GLL. has also submitted a Rapid Marine Environmental Impact Assessment Study

for the proposed LNG Terminal prepared in July, 2009 by the Department of Earth and

Environment Science, KSKV Kachchh University.

The KSKVKU in its report has mentioned that construction and subsequent operation of

the proposed LNG Terminal is likely to pose certain impacts on the Marine biological

environment. Activities like landward dredging for piling and other terminal related

construction and subsequent disposal of dredged spoil during construction phase will

result in disturbance to marine environment. During Phase-I of the project, an estimated

2.7 Million M3 earth work is envisaged in the landward margin adjacent to intertidal

belt. This will eliminate intertidal fauna in the site of activity due to habitat alteration.

However, this will be localized and is not expected to extend beyond 100m linearly along

the intertidal belt since the pier configuration will require only limited preparation in the

intertidal belt. So, intertidal habitat destruction will be negligible given the vast intertidal

expenses in and around the project site.

It is mentioned in the META prepared by the KSKVKU that in the subtidal realm, habitat

and mortality of subtidal organisms will be highly localized to a radius of around 100 m

during construction phase. Pile installation requires localized drilling of the seabed, side

casting and leveling. The impact will be irreversible in and around the pile structure

though recovery will set in the immediate vicinity of the pile structure. Recovery of the

disturbed area generally depends on the nature of the sediment at the dredged site, sources

and types of the recolonizing benthos. Certain benthic organisms , which are more

sensitive to dredging than others will be eliminated permanently from the sea area.

However, it is likely that most of the disturbed benthos in small stretch will recolonize

quickly since disturnbance will be totally absent subsequent to seabed preparation for

piling.

It is mentioned in the MEIA that bottom sediments at the site were mostly muddy , which

will favour only slow recovery. However, total dredging area is proportionally going to

be small given the vastness of the subtidal extent. Loss of subtidal macrobenthos density

in this site is around 265/ m2 population. This loss, however, will be negligible compared

to the total benthic community in the study area. It is Further mentioned in the MEIA

report that construction activities like pile driving, preparing the approach way and

movement of vessels will churn up the bottom sediments and disperse fine particulate

matter in the water column, which in turn could result in increase in turbidity. Besides

this direct effect, indirect effects like changes in circulation pattern and littoral sediment

transport is likely to be caused. This will reduce light penetration and consequently

photosynthetic efficiency and primary productivity in the water column. However, this

will be highly localized and no major changes in the overall productivity of the water

column is expected since the back ground suspended load in the water column is already

high with low to moderate primary productivity.

It is mentioned in the MEIA report that there is no evidence of metal enrichment from

churned-up bottom sediment due to capital and maintenance dredging being carried out

for MPSEZ jetty. Hence the suspension of sediment in the water column is unlikely to

deplete Dissolved Oxygen and expose biota to undesirable levels of pollutants that might

be trapped in the sediments in this dynamic environment. Other crucial water quality

parameters like Ph, Salinity and BOD is most unlikely to be affected during construction

phase. With the exception of direct mortality at the intertidal and subtidal habitat, other

potential effect in the environment would be reversible with time and no long term effect

is bound to occur. In general, the magnitude of the potential environmental impact is

considered to be low and the geographic extent would be limited.

It is further mentioned in the report that @ 200 labours are likely to be engaged in

different construction activities out of which around 50 labours will stay permanently at

the site itself. Given the prevailing currents and circulation pattern in the Gulf system,

impact arising out of the disposal, which will be mostly non-point in nature, will be

negligible. Similarly, impact in terms of habitat fragmentation due to terminal

construction will also be negligible as the proposed terminal will altogether occupy an

area of 28 ha, which include both terrestrial and intertidal belt. This, area , comparing the

whole intertidal stretch of Mundra, will be negligible.

It is mentioned in the MEIA report that there is no evidence of changes in shoreline

configuration due to already existing MPSEZ jetty. The proposed jetty will be supported

on piles allowing adequate flow of water without significant obstruction of the tidal flow

and littoral currents. Hence, the jetty is unlikely to influence the prevailing local

circulation pattern and littoral sediment transport to adversely influence the shoreline due

to the proposed project activity.

It is mentioned in the report that during the construction phase, impacts on mangroves,

especially in the Navinal and Bocha strands will be low to moderate, which are close to

the proposed project site. These impacts are mostly associated with vessel traffic and

continued human activity in and around the terminal. It is most unlikely that vessel traffic

will increase sedimentation rate in the intertidal belts of mangrove lined creeks.

Mangrove ecosystem generally requires sedimentation rate of around 1 mm/year in order

to ward off sea level rise. In many instances, it is the capital and subsequent maintenance

dredging that will enhance sedimentation rate in mangrove ecosystem. Since, the

proponents do not envisage to undertake any form of the dredging activity, it is unlikely

that other terminal related activities will have a serious impact on the mangrove in the

vicinity. It is also to be noted that capital; and maintenance dredging carried out by the

existing MPSEZ Ltd; whose jetty is located in between Bocha and Navinal creek has not

shown any sign of impact so far.

A

It is mentioned in the META report that during commissioning and operation of Phase-I,

the LNG Terminal plans to intake 26000m3/hr. of sea water for various operations like

vaporizers, fire water pumps and electro chlorination. Seawater used in different

processes will be released in to the open sea at about 15-20 m CD. The intake and outfall

point will be spaced at a distance of 500m in order to prevent re-circulation of the outfall

and intake water. The released seawater will have reduced temperature not greater than 5°

C. Since the water column is well mixed with an average temperature range of 27-30°C,

release of seawater with this low temperature will not cause a widespread impact and it

will be highly localized. The proposed site experiences strong tides and currents,

allowing good mixing with the receiving water body. The contaminant levels are

expected to be down to background levels beyond 200 in from the point of discharge.

It is mentioned in the MEIA report that given the design consideration and proper

compliance with the strict operational requirements of LNG Terminal, likelihood of

substantial LNG spillage or release is extremely low. It is mentioned in the report that

since the LNG floats on the water and evaporates rapidly, impact arising out of a• major

spill will not be long lasting and severe unlike other hazardous materials like petroleum

products. In short, the proposed project during operational phase will not cause any major

impact on the intertidal and subtidal organisms in the event of a major spill and it is quite

manageable given the contingency plan the proponent proposes to install to meet such

exigency.

It is mentioned in the MEIA report that other than LNG, spillage of other liquids

containing high levels of hydrocarbon are possible. This will cause localized loss of

habitat through smothering and species extinction in a radius of 200 m from the spill.

Regular bird species, both migratory and residents will avoid that water body. At lower

scale, these spillage will lead to substantial reduction in species abundance and physical

smothering in an extent proportionate to spillage level. Changes in reproductive

behaviour and feeding in intertidal and subtidal organisms is possible. However, other

effluents like emissions from exhaust gas, compressors and turbines are not expected to

produce significant impact on marine habitat.

It is mentioned in the MEIA report that impact on mangrove arising out of elevated levels

of Petroleum Hydro Carbon(PHC) and heavy metals which are locked in the sediment

and released due to vessel movement and dredging is expected to be low. Levels of PHCs

and heavy metals in the sediment were mostly normal and no abnormal levels of these

elements which could pose serious degradation have been noticed during the present

study. Vessel movement and traffic in the creek system will generate propeller noise that

would chase away fish and other marine mammals However, marine based noise

pollution will be of short duration. Since, the proposed project area already witnesses a

heavy marine traffic, there seems to be no discernable impact due to this noise source and

no impact on the marine life has been recorded due to ongoing MPSEZ activity. In short,

overall effect of the tanker traffic on the marine environment would be similar to the

existing tanker traffic with an increased frequency.

Further, the GLL has made a presentation on 15/03/2010 ,. and superimposed their

proposed activities on the CRZ maps prepared by the National Institute of Oceanography

(an agency authorized by the MoEF, GOD.

The Director of GLL has furnished the following undertakings:

1. The GLL shall impleMent all the suggestions and recommendations given by the

consultant in EIA report and in. Risk Assessment Report.

2. The GLL shall bear the cost of the External agency to be appointed by Forests

and Environment Department for supervision/ monitoring of the proposed

activities.

3. Comprehensive Environment Impact Assessment and Risk Assessment has

already been carried out by MPSEZ for Waterfront Development Plan(WFDP) in

which LNG Terminal is a part of the overall WFDP.

4. The GLL shall not tap the ground water to meet with the water requirements

during construction and operation stages.

5. The GLL shall provide construction labour with adequate amenities including

water supply, sanitation and fuel to ensure that they do not ruin the existing

environment.

6. The GLL shall insure that the camps of the construction labour will be located

outside the CRZ areas and no waste including the construction debris will be

disposed off in the sea/creeck or in to the CRZ areas.

7. Socio economic uplifttment programme will be implemented in consultation with

the District Collector/District Development Officer.

8. Greenbelt development programme will be implemented in consultation with the

Forests Department, if required.

9. The GLL shall support fmancially the National Green Crops Scheme being

implemented by the GEER Foundation in Gujarat in consultation with the F&ED.

The GLL vide its letter dated 05/04/2010 has submitted that two mangrove patches

nearest to the project sites are Navinal creek mangroves which is about .5 km on the

eastern extension of the project location and Baradimatha patch towards landward

side(North) at a distance of 3 and 3.5 km. It is further submitted that a thorough

vegetation characteristics of mangroves in four prominent mangrove stands in the

proximity of the proposed operation has been studied. Collected data shows that

occurrence of highest density of 3675/ha in Baradimatha creek(BMC) stand, which

towards the north of the project site at 3.5 km. Navinal creek mangrove stands on the

eastern side at 5 km recorded a density of 2100/ha. Other two patches namely Abban and

Bocha recorded a density of 2967/ha and 2976/ha respectively. Regeneration and

recruitment potential is also fairly good in these stations. The nearest mangrove patches,

Baradimatha and Navinal creek recorded a regeneration density of 137902/ha and

391964/ha and recruitment density of 40223/ha and 25066/ha, showing the stand is

dynamic. The GLL has submitted details about the impacts on mangroves and fishing

activity , mitigation measures there-of along with Specific Environmental Management

Plan. It is submitted by the GLL that no major commercial scale fishing operation

could be observed in the project vicinity except for minor shore based hand netting

operation. Bombay duck is the annual breeder and benthic feeder. Usually Bombay duck

fishery is confined to offshore waters in Kuchchh at about 6-12 miles from the coast.

Considering the area covered by the project proponents and ongoing MPSEZ activities,

no impact on fishing ground is visualized.

The GLL, has submitted that the capital dredging and maintenance dredging is not

envisaged from the proposed project. It is further submitted that the application for

obtaining NOC of the GPCB is under process. It is further submitted by the GLL that the

size of seawater intake and outfall pipelines is 64" which will not be passing through

CRZ area. The length of the approach way(Cause way) to the terminal is approximately

2,20 km, which fall in CRZ area. Send out gas pipelines and other utilities like water,

sewage lines will be installed over the causeway. The dimensions of the send out

pipelines is yet to be finalized, however, tentatively the size will be 42" (dia) . The

distance between intake and outfall points and the nearest mangrove patches are as

follows.

1. Between intake and Bharadimatha mangroves-235 and 3.03 kms.

2. Between intake and Navinal mangroves-5.36 km.

3. Between outfall and Baradimatha mangroves-3.87 and 3.83 km.

4. Between outfall and Navinal mangrove-3.18 km.

The GLL has requested to recommend for total reclamation of 48 ha area on which LNG

Terminal will be developed. Out of which 28 ha of land will be developed in phase I for

5MMTPA for import, storage process and transport of LNG and balance 20 ha of land

will be developed for additional 20 MMTPA of import, storage, process and transport of

LNG. At present only one jetty shall be developed. For developing activities of Phase-II,

GLL, has committed to again approach MoEF.

The GLL vide its letter dated 18/05/2010(copy enclosed) has submitted that it is

considered to provide a captive power plant of 25 MW capacity in design of proposed

LNG Terminal for power back up. It is further submitted that this project is a part of the

total project of M/s Mundra Port Limited, for which environmental Clearance was already

issued by the MoEF, GOI. The issue was examined by the EAC in its 78th meeting held

on 27th-28th August, 2009 and the Committee after detailed discussion, recommended to

exempt the Public Hearing as it was already conducted earlier for whole project.

Further to this, M/s GLL vide its letter dated 05/06/2010(copy enclosed) has submitted

that the terminal will be constructed on 28 ha. For Phase-I and another 20 ha for Phase-H

on a reclaimed land at +9 m above the sea Chart Datum with shore protection dyke. Two

jetties , one each for phase —I and Phase-H will be constructed on piled foundation. The

terminal will be linked to the land through 2.3 km long causeway. The causeway will be

connected with road of Mundra Port.

As per the superimposition done for the proposed project activities on the CRZ map

prepared by the MO, only cause way of @2.3 km length falls in the CRZ area with very

less area of the LNG terminal coming in the CRZ area.

As per the information furnished by the GLL, superimposition done for the proposed

project activities of the GLL on the map prepared by the NIO, and the Marine EIA

report prepared by KSKVKU , proposed activities fall in the CRZ I(i) and CRZ I (ii)

category . As per the provisions of the CRZ Notification, 1991, as amended from time to

time, the proposed activity for LNG Terminal is permissible in CRZ area as per 2(ii) of

the CRZ Notification, 1991

In view of the above, the State Government hereby recommends to grant the

environmental clearance under the CRZ notification, 1991, for proposed LNG Terminal

related facilities such as the approach way(Cause way) to the terminal is of @ 2.20 km,

send out gas pipelines and other utilities like water, sewage lines over the causeway etc

near Mundra , Dist: Kuchchh , by M/s Gujarat State Petroleum Corporation LNG

Limited , with the strict compliance of the following conditions :

Specific Conditions :

1. The provisions of the CRZ notification of 1991 and subsequent amendments issued

from time to time shall be strictly adhered to by the SPPL. No activity in contradiction

to the, provisions of the CRZ Notification shall be carried out by the GLL. The

proponent shall carry out only permissible activities within the CRZ areas.

2. All necessary permissions from different Government Departments / agencies shall be

obtained by the GLL before commencing the expansion activities.

3. The GLL shall carry out the construction activities either in the CRZ area or into the

sea / estuary only after having the detailed study with respect to chances of erosion /

accretion due to the proposed activities conducted through the NIO or any such

reputed organization and shall implement all necessary suggestions / actions as may

be suggested by this institute for mitigating the potential negative impacts including

the checking of erosion and/or accretion in the region. Further, the company shall,

have to have the construction drawings approved for this purpose through a competent

agency before undertaking any construction and/or enabling activities at the site.

4. No dredging, reclamation or any other project related activities shall be carried out in

the CRZ area categorized as CRZ I (i) and it shall have to be ensured that the

mangrove habitats and other ecologically important and significant areas, if any, in the

region are not affected due to any of the project activities.

5. The GLL shall create baseline data including preparation of GIS and RS based maps

on the present status, extent and composition including important physio-chemical

aspects that determine mangrove healthiness i.e. sedimentation rate, substrate

composition , changes in shoreline configuration etc.

6. The GLL shall carry out regular and periodic monitoring during operation phase to

assess changes, if any, in general mangrove vegetation structure in terms of above

characteristics.

7. The GLL shall identify the most vulnerable mangrove stands in the LNG Terminal

vicinity , which will be subjected to rigorous conservation effect.

8. The GLL shall constitute a special Environment Cell including environmental

experts. The cell shall meet periodically to review the status of the environment in

light of the project activities, Vis-a-vis the conditions of the various

clearances/permissions.

9. No effluent or sewage shall be discharged into the sea / creek or in the CRZ area and

shall be treated to conform to the norms prescribed by the Gujarat Pollution Control

Board and would be reused / recycled within the plant premises to the extract

possible.

10. The project proponent shall commence a comprehensive EIA report through a reputed

institute / organization like NEERI, MO, etc. and shall implement all suggestions /

precautions for the purpose of the environmental protection / management.

11. All the recommendations and suggestions given by .SECON Pvt Ltd in rapid

Environment Impact Assessment report and by KSKVKU in Rapid Marine

Environmental Impact Assessment report for conservation /protection and betterment

of environment shall be implemented strictly by the GLL.

12. The construction and operational activities shall be carried out in such a way that there

is no negative impact on mangroves, if any, and other important coastal / marine

habitats. The construction activities shall be carried out only under the guidance /

supervision of the MO, NEERI or any such reputed institute / organization.

13. The GLL shall strictly ensure that no creeks or rivers are blocked due to any activity

at the site.

14. A detailed Vessel Traffic Management plan shall be prepared as part of the

comprehensive EIA through an institute of repute shall be dovetailed with the

detailed plan for the vessel traffic management prepared and implemented by the

Gujarat Maritime Board and the same shall be strictly followed / adhered to and all

necessary support shall be extended for this purpose by the GLL.

15. The GLL shall participate financially for any common facility that may be established

or any common study that may be carried out for the Gulf of Kuchchh region for

environmental protection and/or management purpose.

16. The construction debris and /or any other type of waste shall not be disposed of into

the sea, creek or in the CRZ areas. The debris shall be removed from the construction

site immediately after the construction is over.

17. The construction camps shall be located outside the CRZ area and the construction

labour shall be provided the necessary amenities, including sanitation, water supply

and fuel and it shall be ensured that the environmental conditions are not deteriorated

by the construction labours.

18. The GLL shall prepare and regularly update their Local Oil Spill Contingency and

Disaster Management Plan in consonance with the National Oil Spill and Disaster

Contingency Plan and shall submit the same to this Department after having it vetted

through the Indian Coast Guard.

19. The GLL shall bear the cost of the external agency that may be appointed by this

Department for supervision / monitoring of proposed activities and the environmental

impacts of the proposed activities.

20. The jetty and most of the approach would be supported on piles allowing adequate

flow of water without significant obstruction.

21. The area falling in CRZ I(i) Le mangrove area shall not be utilized for the purposed

activities. Further, the project Phase-lI shall be implemented after having necessary

approvals /permissions from the competent authorities including the MoEF, GO!.

22. The GLL shall have to take up in-situ biodiversity conservation project for

mangroves at least in .5 ha. of area in addition to plantation of mangrove in 500 ha

1 The groundwater shall not be tapped by the GLL to meet with the water requirements

in any case.

2 The GLLshall take up massive greenbelt development activities in consultation with

the Gujarat Institute, of Desert Ecology I. Forest Department / GEER Foundation /

submitted to the Forests and Environment Department.

3 Mangrove plantation in 500 ha. shall be carried out in consultation with the Gujarat

Ecology Commission/ Forest Department by the GLL, as a part of the Corporate Social Responsibility, plantation in areas of coastal operations to check the ingress of salty water into landside.

4 The GLL shall have to contribute financially for taking up the socio-economic

upliftment activities in this region in consultation with the Forests and Environment

Department and the District Collector / District Development Officer.

5 A. separate budget shall be earmarked for environmental management and socio-

economic activities including the greenbelt / mangrove plantation and details thereof

shall be furnished to this Department as well as the MoEF, GOL The details with

respect to the expenditure from this budget head shall also be furnished alongwith the

compliance report.

6 A separate environmental management cell with qualified personnel shall be created

for environmental monitoring and management during construction and operational

phases of the project.

7 Environmental Audit report indicating the changes, if any, with respect to the baseline

environmental quality in the coastal and marine environment shall be submitted every

year by the GLL to this Department as well as to the MoEF,

Scheme being implemented in Gujarat by the GEER Foundation, Gandhinagar, in

(Copies of Environment and CRZ clearance have been already forwarded to GSPL)

The facilities covered under the said Environment (EC) and CRZ clearance includes Send out

pipelines connecting to GSPL's natural gas grid.

Therefore, GSPC LNG Limited (GLL) has "No Objection" for the transfer of Environment (EC) and

CRZ clearance to Gujarat Sate Petronet Limited (GSPL) for laying send Out Gas pipeline from

GLL's LNG Terminal at Mundra to connect to natural gas grid of GSPL covering approximate

length of 16 Km within APSEZ area.

GSPL shall comply with terms and conditions of Environment (EC) and CRZ clearances as

bifurcated in Responsibility Martix for compliance of MOEF & CRZ conditions, enclosed as

2. The project Is for developing waterfront development which includes, North Port, South' Port, West Port and East at Port. Mundra District Kachchh, Gujarat. The North Port, approach channel will be dredged to a uniform depth of -17.5m CD The proposed expansion of the existing bhannel affecting mangroves has been dropped. Further, two turning circles of diameter about 550m at 17.5m below CD. Five container berths, Ro-Ro terminal (600m wide), railway line, backup area of 350 ha, back up facilities like rail sidings, rail truck loading facility, open faxed areas, associated buildings, utilities, amenities eta and connectivity to rail and road corridor are proposed: With regard,to the East Port channel will be channel dredged to a uniform depth 'of -173m CD. For the project three turning circles .of diameter about 800m dredged and maintained at -17.5m below CD, fUrther two container terminals of total cumulatiVe quay length of 2000m, light and heavy engineering berth-2, liquid berth-I, multipurpose berth-2, back up area 640 ha, backup facilities like rail sidings, rail and truck loading facility, open paved areas and associated buildings, utilities, amenities etc., and connectivity to the rail and road corridor are proposed. Two potential sites have been identified for shipyard development (one on eastern end and other on western end of the wasting port):' Both the shipyards are identical. IVIrirdr-facilities to be developed are, two drydocks with single position: intermediate gate, block assembly area at the head of biith docks for final blocking of shlisections, commissioning and outfitting quay and associated facilities. The West port shipyard area will be 281 ha and East yard shipyard area will be 320 ha. Total dredging involved for the project is 2/0MM3. Pledged spoil is suitable for reclamation. Dredging, reclamation and levet raising activities will be carried out. Seawater intake channel is planned for Power plants, desalination plant and other industrial requirements. Further, Bocha Island (88ha), East of Bocha Island (155ha), Kotdl Mouth (981ha), Mouth of Baradimata (30ha) have been identified for conservation as a potential mangrove area, which is to be maintained by the Horticulture Department of Mundra Port. The project proponent have already undertaken 1000 ha of mangrove afforestation along die coastal areas of Gujarat and have committed a additional afforestation of 200 ha of mangroves in the coastal areas of Gujarat. Creeks will bekept open to maintain the hydrology of the region.

3. The project was considered in the Expert Committee meeting held on 23g & 24th April, 2008, 25"' & 26th November, 2008 and 194 & 20th December, 2008 and recommended the project. Keeping in vlew the above facts, the proposal has been examined in the Ministry of Environment & Forests and environmental clearance from Envirorunerital Impact Assessment Notification, 2006 and Coastal Regulation Zone Notification, 1991 is hereby accorded to this project subjectto.effective implementation of the following conditions:-. .

(A) Specific Conditions:

i) No existing mangroves shall be destroyed during construction/operation of the project.

vi) The recommendations of the risk assessment shall be implemented. Any change in the design the project shall come before the committee for seeking necessary approval.

vii) Mangrove plantation of 200 ha to be done in consultations with the GP:ER/GEC of Forest Department, a detailed plan shall be submitted within six months from the date of receipt of this letter.

viii) It shall be ensured that during construction and post construction of the proposed jetty the movement fishermen vessels of the local communities are not interfered with.

ix)!Relocation of the fishermen coMmunity if any, shall be done strictly in accordance with the norms prescribed by the State Government.

x) Marine ecology monitoring shall be done regularly during construction of Breakwater and dredging/disposal operation.

xi) Regular monitoring of air quality shall-be-done in the-settlement areas around the project site and appropriate safeguard measures shall be taken.

xii) Sewage arising in the port area shall be disposed off after adequate treatment to conform to the standards stipulated 'by Gujarat State Pollution Control Board and shall be utilized/re-cycled for gardening, plantation and irrigation.

sill)' Adequate plantation shall be carried out along the roads of the Port premises and a green belt shall be developed.

xiv)There shall be no withdrawal of ground water in CRZ area, for this project.

20 Specific) 'arrangements for rain water harvesting 'shall be made in .the project design and the rain water so harvested shall be optimally utilised. Details in this regard shall be furnished to this Ministry's Regional Office at Bhopal within 3 months.

xvi)Land reclamation shall be carried out only to the extent that it Is essential for this project.

xvii) No product other than those permissible in the Coastal RegulationZone Notification, 1991 shall be stored in the Coastal Regulation Zone area.

B. General Conditions:

(i) Construction of the proposed structures, if any in the Coastal Regulation Zone area shall be undertaken meticulously conforming to the existing Central/local rules and regulations including Coastal Regulation Zone Notification 1991 & its amendments. All the construction designs / drawings relating to the proposed construction activities must have approvals of the concerned State Government Departments / Agencies.

(ii) Adequate provisions for infrastructure facilities such as water supply, fuel, sanitation etc. shall be ensured for construction workers during the construction phase of the project so as to avoid felling of trees/mangroves and pollution of water and the surroundings. ,

(iii)The project authorities must make necessary arrangements for disposal of solid wastes and for the treatment of • effluents by providing a proper wastewater treatment plant outside the CRZ area. The quality of treated

effluents, solid wastes and noise level_etc_naust_conform to the standards laid down by the competent__ authorities including the Central/State Pollution Control Board and the Union Ministry of Environment arid Forests under the Environment (Protection) Act, 1986, whichever are more stringent.

(iv) The proponent shall obtain the requisite consents for discharge of effluents and emissions under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (prevention and Control of Pollution) Act, 1981 from the Gujarat Pollution Control Board before commissioning of the project and a copy of each of these shall be sent to this Ministry.

(v) The sand dunes, corals and mangroves, if any, on the site shall not be disturbed in any way.

(vi)A copy of the clearance letter will be marked to the concerned Panchayat/local NGO, if any, from whom any suggestion/representation has been received while processing the proposal.

(viii) The funds earmarked for environment protection measures shall be trtintained, in a separate account and there shall be no diversion of these funds for any other purpose. A year-wise expenditure on environmental safeguards shall be reported to this Ministry's Regional Office at Bhopal and the State Pollution Control Board.

(viii) Full support shall be extended to the officers of this Ministry's Regional Office at Bhopal and the officers of the Central and Sate Pollution Control Boards by the project proponents during their inspection for

. monitoring purposes, by furnishing full details and action plans including the action taken reports in respect of - mitigative measures and other environmental protection activities.

(ix) In case of•deviation or alteration in the project including the implementing agency, a fresh reference shall be made to this Ministry for modification in the clearance conditions or imposition of new ones for ensuring environmental protection.

(x) This Ministry reserve the right to revoke this clearance, if any of the conditions stipulated are not complied with to the satisfaction of this Ministry.

(xi) This Ministry or any other competent authority may stipulate any other additional conditions subsequently, if deemed necessary, for environmental protection, which shall be complied with.

(xii) The project proponent shall advertise at least in two local newspapers widely circulated in the region around the project, one of which shall be in the vernacular language of the locality concerned informing that the project has been accorded environmental clearance and copies of clearance letters are available with the Statd Pollution Control Board and may also be seen at Website of the Ministry of Environment & Forests at http;//www.envfomiedn. The advertidement shall be made within 7 days from the date of issue of the clearance letter and a copy of the same shall be forwarded to the Regional Office of this Ministry at Bhopal.

(xiii) The Project proponents shall inform the Regional Office at Bhopal as well as the Ministry the date of financial cloSuroand final approval of the project by the concerned authorities and the date of start of Land Development Mirk.

(xiv) Any appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under Section 11 of the National Environment Appellate Act, 1997.

4. The above mentioned stipulations will be enforced among others under the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981, the Environment (protection) Act, 1986, the Hazardous Chemicals (Manufacture, Storage and Import) Rules, 1989, the Coastal Regulation Zone Notification, 1991 and its subsequent amendments and the Public Liability Insurance Act, 1991 and the Rules

made thereunder from time to time. The project proponents shall also ensure that the proposal complies with the provisions of the approved Coastal Zone Management Plan of Gujarat State and the Supreme Court's order dated 186 Apr11, 1996 in the Writ Petition No.664 of 1993 to the extent the same are applicable to this proposal.

Sub: Coastal Regulation Zone• clearance for proposed waterfront development project at Mundra District Kachchh, Gujarat of M/s Mundra Port and SEZ Limited — Environmental clearance — regarding.

The Ministry had earlier accorded clearance to the above project vide Ministry's letter of even number dated 12.1.2009 under the provisions of Coastal Regulation Zone Notification, 1991 and Environment Impact Assessment Notification, 2006 for undertaking the above activity. Now, vide letter No.Nil, dated 14.1.2009 from M/s Mundra Port and SEZ Limited, the project proponent have requested for inclusion of the description of South Port and West Port /which has not been spell out in the above environmental clearance dated 12.1.2009.

South Port is located to the south of the exiting port. An artificially created basin of approximately 505 ha area, dredged to a uniform depth of -17.5m CD with a turning basin of diameter about 700m dredged and maintained at 17.5M below CD. Two breakwaters, one on the west side and another on east and three container terminals having total length of 2680m approximately, multi purpose terminal having total quay length of 550m, liquid berths, Ro-Ro cum service terminal, port crafts terminal of approximately 350m, two deep water berths of LNG terminal with storage facilities, back up facilities like container yard, rail slidings, rail and truck loading facility, open paved areas and associated buildings, utilities, amenities etc. (approx. 700ha) is proposed. West Port is being design to handle vessel of 275,000 DWT, which requires draft of -23m CD. Six berths with mechanized handling of coal and iron ore, five berths for dry bulk cargo, six berths for liquid cargo, approach channel of 500m width,. western breakwater (4.91km), eastern breakwater (4.4km), backup area (920ha) and back-up infrastructure facilities (920ha) is proposed. The project also involves laying of intake and out-fall system for the thermal power plant, desalination plant and other treated effluents which is located outside the Coastal Regulation Zone area. 'Further, a 300 MLD desalination plant is also proposed to meet the water requiremernt.

All other conditions shall remOn unchanged.

This has reference to your letter dated 24.01.2014 seeking extension of validity of clearance granted vide letter No. 10-47/2008-IA-III dated 12.01.2009 and as amended vide letter dated 19.01.2009. The issue was discussed by the EAC in its 130th meeting held during 22nd — 24th January, 2014. The Committee has recommended the project for grant of extension of validity of the clearance dated 12.01.2009 for a further period of five years with any existing qualification in respect of North Port.

2. The recommendations of EAC and those of Ms. Sunita Narain Committee on cancellation of clearance for North Port, have been examined, and an appropriate order dated 18.09.2015 has been passed by the Ministry in the subject matter. It has been decided that the proposal for extension of validity of clearance for North Port granted under Environment Impact Assessment (EIA) Notification, 2006 and Coastal Regulation Zone (CRZ) Notification, 1991 vide the above mentioned letter dated 12.01.2009 would be considered separately at a later stage.

3. As per the recommendation of EAC, the extension of validity of the clearance granted under EIA Notification, 2006 and CRZ Notification, 1991 vide the above mentioned letter dated 12.01.2009 and addendum dated 19.01.2009, excluding the clearance for all developmental activities at North Port, is hereby extended upto 11.01.2019. The extension of validity of clearance for all developmental activities at North Port will be considered at a later stage.

4. The extension of the validity of the aforesaid clearance is subject to the directions contained in this Ministry's order of even number dated 18.09.2015 (copy enclosed). The Project Proponent shall submit the compliance report, including compliance to the directions contained in this order, to concerned Regional Office of the Ministry at Bhopal and Gujarat State Coastal Zone Management Authority. All other conditions stipulated in the above mentioned letter granting clearance dated 12.01.2009 shall remain unchanged.

Subject: EC for proposed Multi- Product SEZ and CRZ clearance for Desalination, sea water intake, outfall facility and pipeline, at Mundra by M/s Adani Port and SEZ Ltd. — Reg.

This has reference to letter No. ENV-10-2010-1601-E dated 27.03.2012 of the Director (Environment) & Additional Secretary, Govt. of Gujarat and your subsequent letters dated 10.05.2012, 14.05.2012, 26.05.2012 and 29.04.2013 seeking prior Environmental and CRZ Clearance for the above project under the EIA Notification, 2006 and Coastal Regulation Zone Notification, 2011. The proposal has been appraised as per prescribed procedure in the light of provisions under the EIA Notification, 2006 and the Coastal Regulation Zone Notification, 2011 on the basis of the mandatory documents enclosed with the application viz., the Questionnaire, EIA, EMP, recommendations of the State Coastal Zone Management Authority and the additional clarifications furnished in response to the observations of the Expert Appraisal Committee constituted by the competent authority in its meetings held on 16th —17th April, 2012, 4th —5th June, 2012 and 9th -10th July, 2012.

2. It is, interalia, noted that the project involves development of multi product SEZ on a plot area of 18,000 ha. of which 6641.2784 ha. is presently notified under Special Economic Zone (SEZ). As per the proponent, the Multi product SEZ at Mundra comprising of various processing zones, non-processing zones, warehousing zones, Road Network (trunk as well as internal), Bridges or culverts over natural drains, Rail Network, IT-Telecommunication network, Electrical Network, Water supply, conservation & drainage Network, Effluent collection network, Desalination Plant with proposed intake & outfall locations, Common Effluent Treatment Plants & Sewage Treatment Plants, Natural Gas line network, Social Infrastructure, Existing Airstrip, Municipal Solid Waste Disposal site, utilities & supporting infrastructure etc. For the first phase of development total water requirement will be 150 MLD. Power requirement will be approx. 360 MW. Desalination plant of 150 MLD output capacity is proposed. 11 MLD water will be sourced through Narmada water pipeline. Two CETP each of capacity 50 MLD and 17 MLD as well as STP of 62 MLD is proposed. This will require 375 MLD of seawater intake and 241 MLD of treated waste water outfall into the sea. For fmal phase of development total water requirement will be 450 MLD and power requirement will be approx. 1000 MW.

3. A suitable seawater intake point has been identified on the eastern end of the approved East Port Basin at Latitude 22°48'30.76"N; Longitude 69°46'34.06"E where a depth of 6 m below CD would be available after the port development. As per modelling study the combined discharge of 241MLD which includes 16MLD from CETP and 225 MLD from desalination plant as RO reject is expected having 57.57ppt of salinity, 14.41 mg / 1 of BOD and 94.39 mg/1 of COD. After careful consideration of many aspects a suitable outfall location is identified on the west of the Eastern basin at Latitude 22°46'44.04"N; Longitude 69°45'5.51"E taking advantage of the expected 7.5m below CD basin depth. The outfall pipe line length is approximately 5.7 km and diffuser designed to attain a minimum dilution of 40-50 times.

4. The Centre for Earth Science Studies demarcated HTL, LTL and CRZ area. As per the CESS report and GCZMA, out of 6641.2784 ha of SEZ area, 1473.39 ha area falls within CRZ area. No SEZ industrial activity is proposed in the CRZ area. Only the Desalination plant pipeline for intake and outfall is proposed in CRZ areas. The Gujarat SCZMA in their 14th meeting held on 27-02-2012 considered the proposal of intake, outfall facilities, Desalination plant and laying pipeline and recommended the same vide their letter no.ENV-10-2010-1601-E dated 27th March 2012. Gujarat Pollution Control Board has granted Consent to Establishment of Marine outfall (NOC) vide letter dated 10.11.2011. The length of the intake will be approximately 5 Kms. As the sea water intake demand is 15000m3/h, drawal by pipe system is suitable by incorporating a wet well structure at the location. The intake point proposed is within the proposed East Port basin with a depth of 6 m below CD. The projected quantity of water can be transported through a single pipe of 1.3 m dia with a flow velocity of 3 m/ s or with a 1.6 m pipe with flow velocity of 2m/s.

5. The Expert Appraisal Committee, after due consideration of the relevant documents submitted by the project proponent and additional clarifications furnished in response to its observations, have recommended for the grant of Environment and CRZ Clearance for the SEZ in an area of 8481.2784 ha. However, SEZ for 1840 ha has been approved in principle by Ministry of Commerce and Industries.

6. Hon'ble High Court of Gujarat in WP No. 21 of 2013 vide order dated 13.01.2014 has directed that the Ministry to take a decision of its own so far as the issue of grant of environmental clearance is concerned considering the position prevailing as on date and also the aspects which have been highlighted by us in this judgment, within a period of thirty days from the date of this judgment without fail. Further, vide order dated 27.01.2014 Hon'ble Supreme Court in SLP No. 1526 of 2014 which was filed against the Order of High Court by the Respondent-1 has passed order that in case, the MOEF is unable to complete the process within the time stipulated by the High Court, it will be open for them to approach this Court for extension of time. Accordingly, Ministry has filed a petition before the Hon'ble Supreme Court seeking extension of two months time.

7. It is noted from the Judgement dated 13.01.2014 of Hon'ble High Court of Gujarat in PIL 21 of 2013 the Hon'ble Court has construed , the grant of lease to units prior to

obtaining EC by M/s APSEZL as violation of EIA, Notification, 2006. Therefore, according to the OMs dated 12.12.2012 and 27.06.2013, PP was addressed for Board Resolution and the State Government was addressed to take credible action against the PP for the violation. Direction under Section 5 of E(P)Act, 1986 was also issued to APSEZ not to take up and allow any further construction activity within SEZ till the grant of clearance.

8. Further, Hon'ble Supreme Court video order dated 02.05.2014 in SLP 1526 of 2013 had ordered for stay of Ministry's letter dated 3.04.2014 addressed to Government of Gujarat to initiate legal action for the violation, also directed that the Ministry to complete the process of EC within eight weeks.

9. M/s APSEZ Ltd. has stated that the Board resolved that since the matter is sub- judice before the Hon'ble Supreme Court of India, will fully abide by the out come of the decision of the Hon'ble Supreme Court.

10. In view of the above and to comply with the orders of Hon'ble Courts, Ministry hereby accords necessary Environment Clearance for proposed Multi- Product SEZ in an area of 6641.2784 ha and CRZ clearance for desalination, seawater intake, outfall facility and pipeline for as per the provisions of Environmental Impact Assessment Notification —2006 and its subsequent amendments and Coastal Regulation Zone Notification, 2011, subject to strict compliance of the terms and conditions as follows:

11. PART A - SPECIFIC CONDITIONS

(i) PP shall abide• by the final order/decision of Hon 'ble Supreme Court in SLP (Civil) no. 1526/2014 and connected matters.

(ii) Properly conserve the creeks, river and the mangroves area in the area.

(iii) Ensure that mouths of all the creeks are kept open to ensure flushing of the creeks.

Bring the creeks to the condition as was seen in the satellite map of 2005 which will be a "reference" satellite map and a copy of which shall be sent to you separately.

(v) Submit once in a year latest satellite map which can be compared with the reference satellite map of 2005 to ensure that no modification in the creeks, rivers, mangroves and mouth of creeks have taken place.

(vi) Any direction issued by the MoEF with respect to the report submitted by Ms Sunita Narain Committee shall be complied with by the Proponent as applicable.

(vii) At its cost get Inspection study done once in a year by the organizations like NEERI or any organization approved by this Ministry to - (i) ensure compliance of all the EC conditions (ii) development of SEZ meeting of the environment norms, and (iii) advise any mid-term correction that can be introduced depending on the recommendation of the independent Third Party.

(viii) "Consent for Establishment" for the SEZ shall be obtained from Gujarat Pollution Control Board under Air and Water Act and a copy shall be submitted to the Ministry before start of any construction work at the site.

(ix) PP shall get detailed bathymetry done for all the creeks and rivers within Port and SEZ areas along with mapping of co-ordinates, running length, HTL, CRZ boundary, mangrove areas including buffer zone through NCSCM/ NIOT. PP shall also get prepared a detailed action plan for conservation and protection of creeks/ mangrove area etc through NCSCM / NIOT and submit the same to GCZMA for their examination and recommendation. GCZMA will submit its recommendations to MoEF for approval.

(x) PP shall demarcate the CRZ area on land with GPS coordinates in consultation with GCZMA/ the agency which has done the HTL/LTL demarcation for the area. There shall be no allotment of plot/s in CRZ area to industries. No industrial activity within CRZ area except the port and harbor & the foreshore facilities shall be allowed as committed

Till the approval of action plan for conservation and protection of creeks/ mangrove area, the CRZ area within SEZ shall be demarcated as "No Development Zone". PP shall not allow/ undertake any development in CRZ area of SEZ.

(xii) The implementation of action plan approved by the MoEF shall be monitored by the NCSCM/ NIOT. Compliance with action plan shall be submitted to GCZMA and to MoEF, RO. at Bhopal along with six monthly monitoring report.

(xiii) PP shall earmark separate budget for the implementation of the above action plan. The details of the expenditure shall be submitted to GCZMA and to MoEF, RO. at Bhopal along with six monthly monitoring report.

(xiv) All the industry in SEZ shall be connected through impervious drainage lines to the STP/ CETP for the discharge of their sewage or industrial effluent. There shall not be any discharge to creeks / rivers. PP shall be accountable for implementing this condition and necessary clause shall be incorporated in the MoU while allotting the plot to the individual industries

PP shall not carry out any river course modification.

The individual industrial units shall obtain prior EC under EIA Notification, 2006 as applicable.

(xvii) Proponent shall identiAr 200 ha of land for mangrove plantation as per the condition laid by SEAC.

(xviii) 50 meter buffer from the existing mangrove area should be provided for any developmental activity,

(xix) Proponent shell develop the green belt with 3 layers of canopy all along the periphery.

(xx) All the recommendation of the EMP shall be complied with in letter and spirit. All the mitigation measures submitted in the EIA report shall be prepared in a matrix format and the compliance for each mitigation plan shall be submitted to MoEF along with half yearly compliance report to MoEF-RO.

(xxi) There shall be no disturbance to the sand dunes. The pipelines shall be laid using advanced method viz. Horizontal Directional Drilling (HDD) so as to avoid disturbance to the sand dunes/ creeks/ mangroves.

PART — B. GENERAL CONDITIONS

Construction Phase.

Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

(ii) A First Aid Room will be provided in the project both during construction and operation of the project.

(iii) All the topsoil excavated during construction activities should be stored for use in horticulture/landscape development within the project site.

(iv) Disposal of muck during construction phase should not create any adverse effect on the neighbouring communities and be disposed, taking the necessary precautions for general safety and health aspects of people, only in approved sites with the approval of competent authority.

(v) Soil and ground water samples will be tested to ascertain that there is no threat to ground water quality by leaching of heavy metals and other toxic contaminants.

(vi) Construction spoils, including bituminous material and other hazardous materials, must not be allowed to contaminate watercourses and the dump sites for such material must be secured so that they should not leach into the ground water.

(vii) Any hazardous waste generated during construction phase should be disposed off as per applicable rules and norms with necessary approvals of the Gujarat Pollution Control Board.

(viii) The diesel generator sets to be used during construction phase should be low sulphur diesel -type and should conform to Environment (Protection) Rules prescribed for air and noise emission standards.

(ix) The diesel required for operating DG sets shall be stored in underground tanks and if required, clearance from Chief Controller of Explosives shall be taken.

(x) Vehicles hired for bringing construction material to the site should be in good condition and should have a pollution check certificate and should conform to applicable air and noise emission standards and should be operated only during non-peak hours.

Ambient noise levels should conform to residential standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Adequate measures should be made to reduce ambient air and noise level during construction phase, so as to conform to the stipulated standards by CPCB/GPCB.

(xii) Fly ash should be used as building material in the construction as per the provisions of Fly Ash Notification of September, 1999 and amended as on 27th August, 2003. (The above condition is applicable only if the project site is located within 100 Kms of Thermal Power Stations).

(xiii) Ready mixed concrete must be used in building construction.

(xiv) Storm water control and its re-use should be regulated as per CGWB and BIS standards for various applications.

(xv) Water demand during construction should be reduced by use of pre-mixed concrete, curing agents and other referred best practices.

(xvi) Permission to draw ground water shall be obtained from the competent Authority prior to construction/operation of the project.

(xvii) Separation of grey and black water should be done by the use of dual plumbing line for separation of grey and black water.

(xviii) Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

(xix) Use of glass may be reduced by upto 40% to reduce the electricity consumption and load on air-conditioning. If necessary, use high quality double glass with special reflective coating in windows.

Roof should meet prescriptive requirements as per Energy Conservation Building Code by using appropriate thermal insulation material to fulfill requirements.

(xxi) Opaque wall should meet prescriptive requirement as per Energy Conservation Building Code which is proposed to be mandatory for all airconditioned spaces while it is aspirational for non-airconditioned spaces by use of appropriate thermal insulation material to fulfil these requirement.

(xxii) The approval of the competent authority shall be obtained for structural safety of the buildings due to earthquake, adequacy offire fighting equipments, etc. as per National Building Code including protection measures from lightning etc.

(xxiii) Regular supervision of the above and other measures for monitoring should be in place all through the construction phase, so as to avoid disturbance to the surroundings.

(xxiv) Under the provisions of Environment (Protection) Act, 1986, legal action shall be initiated against the project proponent if it is found that construction of the project has been started without obtaining environmental clearance.

Operation Phase

The PP while issuing the allotment letter to individual member units shall specifically mention the allowable maximum quantity of water usage and effluent generated by each member unit.

(ii) The PP shall establish an environmental monitoring cell with all the potential polluting units as members to review the environmental monitoring data and suggest improvements.

(iii) Treated affluent emanating from STP shall be recycled/reused to the maximum extent possible. Treatment of 100% grey water by decentralised treatment should be done. Discharge of unused treated affluent shall conform to the norms and standards of the Pollution Control Board. Necessary measures should be made to mitigate the odour problem from STP.

(iv) The solid waste generated should be properly collected and segregated. Wet garbage should be composted and dry / inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material.

(v) Diesel power generating sets proposed as source of back up power for elevators and common area illumination during operational phase should be of enclosed type and conform to rules made under the Environment (Protection) Act, 1986. The height of stack of DG sets should be equal to the height needed for the combined capacity of all proposed DG sets. Low sulphur diesel should be used. The location of the DG sets may be decided in consultation with the Gujarat Pollution Control Board.

(vi) Noise should be controlled to ensure that it does not exceed the prescribed standards. During night time the noise levels measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations.

(vii) Green belt of adequate width and density preferably with local species along the periphery of the plot shall be raised so as to provide protection against particulates and noise.

(viii) Weep holes in the compound walls shall be provided to ensure natural drainage of rain water in the catchment area during the monsoon period.

(ix) Rain water harvesting for roof run- off and surface run- off, as plan submitted should be implemented

(x) The ground water level and its quality should be monitored regularly in consultation with Central Ground Water Authority.

(xi) Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided Parking should be fully internalized and no public space should be utilized

(xii) A Report on the energy conservation measures conforming to energy conservation norms finalised by Bureau of Energy Efficiency should be prepared incorporating details about building materials & technology, R & D Factors etc and submitted to the Ministry along with six monthly monitoring report.

(xiii) Energy conservation measures like installation of CFLs/TFLs for the lighting the areas outside the building should be an integral part of the project design and should be in place before project commissioning. Used CFLs and TFLs should be properly collected and disposed off/sent for recycling as per the prevailing guidelines/ rules of the regulatory authority to avoid mercury contamination. Solar panels may be used to the extent possible.

(xiv) Adequate measures should be taken to prevent odour problems from solid waste processing plant and STP.

(xv) The buildings should have adequate distance between them to allow movement of fresh air and passage of natural light, air and ventilation.

(xvi) The environmental safeguards contained in the EIA Report should be implemented in letter and spirit.

(xvii) Adequate drinking water facility be provided

(xviii) Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project.

(xix) Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating. A hybrid system or fully solar system for portion of the apartments should be provided.

000 Ozone depleting substance (Regulation & Control) Rules should be followed while designing the air conditioning system of the project.

12. Officials from the Regional Office of MOEF, Bhopal who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the

documents submitted to MoEF should be forwarded to the CCF, Regional office of MOEF, Bhopal

13. In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by this Ministry.

14. The Ministry reserves the right to add additional safeguard measures subsequently, if found necessary, and to take action including revoking of the environment clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguard measures in a time bound and satisfactory manner.

15. All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

16. These stipulations would be enforced among others under the provisions of Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and control of Pollution) act 1981, the Environment (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification, 2006.

17. The project proponent should advertise in at least two local Newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded Clearance and copies of clearance letters are available with the Gujarat Pollution Control Board and may also be seen on the website of the Ministry of Environment and Forests at http://www.envfor.nic.in. The advertisement should be made within 10 days from the date of receipt of the Clearance letter and a copy of the same should be forwarded to the Regional office of this Ministry at Bhopal.

18. Clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.460 of 2004 as may be applicable to this project.

19. "Any appeal against this clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, 2010".

20. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the company by the proponent.

21. The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.

22. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by e-mail) to the respective Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.

23. The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of EC conditions and shall also be sent to the respective Regional Offices of MoEF by e-mail.
