Whereas the forest land as specified in toe Set ~uule appended hereto is the property of the Government of Goa and the Government has proprietary rights owr it (hereinafter called as the "said forest land").

And whereas the Government proposes to constitute the said forest land as reserved forest under Section 3 of the Indian Forest Act, 1927 (Central Act 6 of 1927) (hereinafter called as the "said Act").

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 4 of the said Act, the Government of Goa hereby declares that it has been decided to constitute the said forest land as reserved forest and further appoints, under clause (c) of sub-section (1) of Section 4 of the said Act, Shri Francisco Teles as the Forest Settlement Officer, to inquire into and determine the existence, nature and extent of any rights alleged to exist in favour of any person in or over any land comprised within such limits, or in or over any forest produce, and to deal with the same as provided in Chapter II of the said Act.

Applications are invited by the Conservator of Forests, Junta House, 3rd Floor, Panaji-Goa for selection of 3 candidates for the post of Range Forest Officer, one post is reserved for O. B. C., one for Ex-Serviceman and one for General Category in the Forest Department, Government of Goa, particulars of which are as foliows:-

1. No. of Post: 3 Posts.

2. Pay Scale : Rs. 4500-125-7000.

3. Age : Age not exceeding 35 years (Relaxable for Government servants upto 5 years in accordance with the orders issued by the Government) not exceeding 38 years for O. B. C. and 45 years for Ex-Serviceman.

4. Educational and other qualifications required for direct recruits:

Essential: 1) Bachelor's Degree in Science with

two or more of the following

Note:- (i) Candidates who qualify in written test will have to undergo medical examination and candidate found medically fit will have to undergo a physical test of 25 kms. walk in 4 hours.

(il) Selected candidates will be sent for in-service training in Rangers Course of two years duration m the recognised Forest Training College/Institute, immediately after selection. Failure in the aforesaid training will debar the candidate to claim retention in service as Range Forest Officer.

(iii) Selected candidates ~hall give Bond for such amount as the Govenunent may from time to timp fix. as well as to serve Government for a period of at least 5 years after completion of training, failing which such amount as may be prescribed in the Bond whlch will include cost of training and other expenditure incurred, if any, by the Government will have to be refunded to the Government.

5. Selected Candidates will have to work anywhere in Goa.

Whereas Shri Vassudev B. Gawas, while functioning as a Line Helper in the Electrical Sub-Division II (U),

Panaji-Goa, under Office of the Executive Engineer,

Elect. Division I, Panaji-Goa remained unauthorisedly

absent from duties w.e.f. 3-4-1993 to 21-2-1994 (325

days), 15-3-1994 to 6-7-1994 (114 days), 20-7-1994 to

22-7-1994 (3 days), 30-8-1994 (1 day), 7-9-1994 to

11-9-1994 and 13-9-1994 (6 days), 23-9-1994 to 25-9-1994

(3 days) and from 2-11-1994 till date.

Whereas Shri Vassudev B. Gawas, Line Helper by his

above act. has exhibited lack of devotion to duty and acted in a manner unbecoming of Government servant thereby violating Rule 3 (1) (ii) (iii) of C. C. S. (Conduct)

Rules, 1964.

Whereas Charge-Sheet inoorporating the above

charge vide Memorandum No. CEE/ESTT-5771/CONF/

/LH-76/20 dated 21-4-1999 was sent to Shri Vassudev

B. Gawas, Line HeJt>er'by Registered Post A. D. and the

same was TeceiVed by him.

Whereas Shri G. H. Kenaudekar. Assistant Director,

Directorate of Industries and Mines, Government of Goa, Panaji-Goa was appointed as Inquiring

Authority to inquire into the charge framed against

'Shri Vassudev B. Gawas, Line Helper vide Order

No. CEE/ESTT-5771/CONF/LH-76/11 dated 11-4-2000.

Whereas Shri Vassudev B. Gawas, Line Helper

remained present for the preliminary hearing held on

25-8-2000 and accepted his guilt and pleaded guilty.

25TH JANUARY, 2001

The Inquiring Authority after going through the

evidence on record has submitted his report holding

that the Article of charge against the charged officer

has been pro,:ed.

Whereas vide Memorandum No. CEE/ESTT-5771/

/CONF/LH-76/380 dated 5-10-2000, Shri Vassudev B.

Gawas, Line Helper was given., an opportunity of

making represent(~.tion or submission, if any, against

the inquiry report. Shri Vassudev B. Gawas, Line Helper

has received this Memorandum but did not submit

any representation.

And whereas on a careful consideration of the

Inquiry Report and evidence on record, the

undersigned has come to the conclusion that Shri

Vassudev B. Gawas, Line Helper has failed to maintain

absolute integrity and shown lack of devotion to his

duties and responsibilities to the post of Line Helper

held by him and thus acted in a manner unbecoming

of a Government servant and that the .gravity of the

charge is such as to warrant the imposition of major penalty.

Now. therefore, in exercise of powers conferred by Rule 11 (ix) of C. C. S. (C.C.A.) Rules, 1965, the

undersigned imposes the penalty of dismissal on Shri

Vassudev B. Gawas, Line Helper of this Department

with irmndiate effect.

Read:- 1) Letter No. 16/19/85/RB/582 dated 12-12-2000 of Mamlatdar of Ponda.

2) Directions of Collector of North Goa District, Panaji vide proceedings of meeting held on 9-8-2000.

Whereas the Mamlatdar of Ponda in his letter dated 12-12-2000 has requested to issue order to transfer the proceedings in Tenancy cases mentioned in the annexure below pending with him from his Court to the Courts of Joint Mamlatdars of Ponda .

And whereas the subject matter of transfer of Tenancy cases was discussed in the meeting of Mamlatdar/Joint Mamlatdars and Dy. Collectors held on 9-8-2000 before the Collector of North Goa at Panaji

and the Honourable Collector was pleased to direct

the Deputy Collectors to issue orders to transfer the

tenancy cases from Mamlatdars to Joint Mamlatdars.

And whereas prior notice to each of the parties in

said Tenancy cases cannot be possible due to nature of urgency in the matter and by issuing the notices and

hearing the parties, the very purpose of transferring the

tenancy cases for speedy disposal by Joint Mamlatdars would be defeated.

And whereas I am satisfied for the reasons that the

Mamlatdar of Ponda is always busy throughout the

year with multiferous duties such as election, census

and various meetings, etc. to attend and therefore he

cannot give sufficient time for disposing of tenancy

cases which are in large numbers and as the Courts of Joint Mamlatdars I, II & III of Ponda are having less

number of tenancy cases as compared to Mamlatdar of Ponda.

I, therefore, the Deputy Collector· & S, D.O., Ponda in exercise of -the powers vested in me under sub-section (1) of Section 47 of the Goa, Daman and Diu Agricultural Tenancy Act, 1964 hereby transfer the

proceedings in. Tenancy cases mentioned in the Annexure below from the Court of Mamlatdar of Ponda

to the Court of Joint Mamlatdars mentioned against each case with immediate effect.
