ADDENDUM NO. 1

Reference is made to the Open Advertised Bidding (OAB) for the above procurement and the bid document for same. Bidders are requested to take note of the following amendments/clarifications: 1. Invitation for Bids:

Paragraph 3: The closing date has been extended to 26 March 2019 at latest or before 14:00 hours (local time). Bids will be opened on 26 March 2019 at 15:00 hrs (local time).

2. Section 1: Instructions to Bidders (ITB) are amended as follows:

Sub-Clause 1.5 - Priority of Documents

Sub-Clause 18.5 - Insurance for Design

Add the following Sub-Clause 18.5:

“The Contractor or his designers and design Subcontrators shall effect professional indemnity insurance which shall cover the risk of professional negligence in the design of the Works. This insurance shall be for a limit of not less than the amount stated in the Appendix to Bid, with no limit on the number of occurrences. The Contractor shall maintain the professional indemnity insurance in full force and effect until 5 years after the Time for

Completion. The Contractor undertakes to notify the Employer promptly of any difficulty in extending, renewing or reinstating this insurance.”

Clause 20 – Claims, Disputes and Arbitration

Delete sub-clause 20.2 and replace with the following new sub-clause 20.2

“In case a dispute of any kind arises between the Employer and the Contractor in connection with, or arising out of, the contract or the execution of works or after completion of works and whether before or after repudiation or other termination of Contract, including any dispute as to any opinion, instruction, determination, certificate or valuation of the Engineer, the matter in dispute shall, in the first place, be referred in writing to the Engineer, with a copy to the other party.

The Employer and the Contractor shall make every effort to resolve the dispute amicably by direct informal negotiation. If, after twenty-eight (28) days, the parties have failed to resolve their dispute or difference by such mutual consultation, then either the Employer or the Contractor may give notice to the other party of its intention to refer the matter to:

“ the competent courts of Mauritius”

Delete sub-clauses 20.3, 20.4, 20.5 ,20.6, 20.7 & 20.8

4. Section 4: Employer’s Requirements

The Employer’s Requirements are replaced by the Employer’s Requirements (revised) attached herewith (Annex - A).

5. Section 5: Appendix to Bid is amended as follows:

ANNEX - A

Employer’s Requirements (revised)

1. General

The Development Bank of Mauritius Ltd (DBM) intends to set up ten Anti-Insect Net

Covered Structures (Net Houses) complete with Fertigation System on a Design-

Build/Turnkey Basis at Plaine Magnien, for renting to farmers.

The site is easily accessible by road. Water supply and electricity are available on the Royal

Road Plaine Magnien (A10). There is no existing public storm water drain close to the site.

Each net house shall be of surface area approximately 4,000m2 and shall be erected on a plot of

land of the extent of 1 arpent. Further details on the net house are provided in the Scope of

Works below.

The works consist, among others, of the upgrading of existing track road; levelling of the site;

construction of boundary fences for the site and drainage system for evacuation of storm water

from the site; design, supply, construction, installation and commissioning of ten net houses; and

provision for utilities (electricity and water) and solid and liquid farm waste disposal.

The Bidder shall seek and obtain all necessary permit/clearances/approvals from the relevant

authorities for the project.

Please refer to site and location plan, and drawings FAREI/100FHP/PM/001,

FAREI/100FHP/PM/002 and FAREI/100FHP/PM/003. The drawings have been provided for

guidance only. The Works have to be designed and certified by the Contractor’s designers and

design Subcontractors.

2. Scope of Works

A. Anti-Insect Net Covered Structure (Net House)

The works consist, among others, the design, supply, construction, installation and

commissioning of ten anti-insect net covered structures (net houses), of surface area

approximately 4,000m2 each, with the following specifications:

(i) The structure shall be made of hot dip galvanized steel pipes suitable for its location

and intended use, and environmental and climatic conditions to which it will be

exposed, and covered with 50 mesh UV-treated anti-insect nets on roof and on all

sides.

(ii) The structure shall be able to withstand wind loads arising from basic wind speed of

100 km/hr with the roof and side nets in place and basic wind speed of 280 km/hr

with the nets rolled up or removed, in accordance with British Standard Code of

Practice CP3 Chapter 5: Part 2 – 1972, including subsequent amendments to date.

(iii) The side nets will be fixed to the ground in such a way as to prevent insects and

rodents from entering the net houses.

(iv) The 50 mesh anti-insect proof nets for top cover have to be UV resistant materials

with shade percentage of 25-30.

(v) Provision of an open field fertigation system for the following crops: cabbage,

cauliflower, broccoli, beans, snap beans, lima beans, peas, soya beans, lettuce,

asparagus, ladies’ finger and creepers.

(vi) Provision of one entrance door (3 m x 4 m) and one separate hall i.e. sash (1 m x 2

m) door which allows insect-free access for workers. All doors have to be with

overlapping anti-insect net to ensure insect-free zone.

(vii) Provision of pressure compensating irrigation networks together with main/submain,

pump and other controlling devices. The bidder shall include in this bid a proposed

layout clearly mentioning what type of fittings and controlling system will be used.

(viii) Supply, install and commission water tank of minimum 9 m³ capacity for each net

house, each complete with reinforced concrete platform, pump cubicle to house

water pump and controlling devices, screen filters and all associated fittings.

(ix) Provision for evacuation of excess water from the fertigation system.

(x) The Bidder has to propose new innovative technology.

(xi) A safe means of access shall be provided to allow easy installation, removal and

rolling up of the nets by the end users.

(xii) The whole structure shall be sized, fixed and tied properly for strength and stability.

(xiii) The structure(s) shall be designed taking aesthetic appearance; sustainability

principles; and ease and cost of maintenance into account.

(xiv) The anti-insect net covered structure has to be pre-fabricated and assembled on site

by means of bolts, nuts and washer without welding. The structure has to be of hot

dip galvanized steel pipes to a minimum height of 4 metres and has to withstand

wind loads as calculated by British Standard Code of Practice CP3 Chapter 5: Part 2

– 1972 including subsequent amendments to date. The whole structure and the

fertigation system have to be certified by a competent Authority of the country of

origin or by the Contractor’s Consultants. ”Contractor’s Consultants” shall have the

same meaning as “designer” and “design Subcontractor” given in Sub-clause 5.1 of

the Contract.

(xv) The irrigation system shall be water saving type with compensating pressure. All

laterals shall be equipped with stop valves.

(xvi) The design shall make provision for space requirements for separate male and female

toilets and washing areas and wastewater disposal (not to be constructed).

(xvii) The Bidder shall provide a complete set of architectural and civil/structural and

mechanical/electrical engineering drawings including detailed layout of the proposed

structure showing clearly the structure and other amenities, including the fertigation

system, along with the bid (one original and two copies).

B. Fencing Works

The works consist, among others, of the supply of all materials, construction, and

commissioning of galvanized pipes and chain link fencing (50x50 mm mesh size) of 1.8 m

high and 2.5 mm minimum thickness along the periphery of the site and two units two-leaf

gate, with the following specifications among others:

(i) The chain link fencing to be strengthened with at least three rows of galvanized

straining wire and to be attached to each pole with galvanized mild steel wire.

(ii) Three rows of barbed wire to be fixed above and all along the chain link fencing.

(iii) A reinforced concrete kerb 150 mm wide by 300 mm high above finished ground

level to be constructed at the bottom all along the perimeter of the fencing. Top of

kerbs to be rounded in order to prevent accumulation of rain water.

(iv) Provision for evacuation of storm water through the fencing towards the storm water

drain. Openings made through the fencing for drainage or other purpose shall be

rodent proof.

(v) Manufacture and fixing of two units two-leaf gate of width: 5 m and height: 2.2 m

inclusive of 3 rows barbed wire.

(vi) All welded parts to be thoroughly cleaned and treated with cold galvanised paint.

(vii) The fence and all its components shall be able to withstand wind loads arising from

basic wind speed of 280 km/hr in accordance with British Standard Code of Practice

CP3 Chapter 5: Part 2 – 1972, including subsequent amendments to date.

C. Site, Drains and Track Roads

(i) Topographical survey and verification of site boundaries for the whole site,

(ii) Provision for site clearance from shrubs and weeds, (existing and stacked) and

levelling the ground to formation level.

(iii) Provision of a V Earthen drain 1 m deep minimum and 0.5 m wide minimum all

around the site and along the proposed upgrade track road for evacuation of storm

water. Actual size of drains to be designed by the Contractor subject to the minimum

size specified. .

(iv) Provision of reinforced concrete cover drain for utility vehicle (minimum 5 m wide)

to have access to each individual plot of land and at road crossings drains. The R.C

cover shall be able to withstand a minimum axle load of 5 tonnes.

(v) Provision of soak away at lowest points, or other means of disposal of stormwater,

based on Contractor’s design.

(vi) Provision for upgrading of the existing track roads to 5.5 metres wide to withstand a

minimum axle load of 5 tonnes as shown in the drawing FAREI/100FHP/PM/001.

D. Utilities

(i) Provision of water supply from Central Water Authority (CWA) main network to

each individual plot of land.

(ii) Provision of electrical supply from Central Electrical Board (CEB) main line to each

individual plot of land.

(iii) The Bidder shall seek and obtain any necessary clearance/approval from CWA and

CEB.

3. Design Guide and Technical Specifications

A. General Requirements

(i) All structures and their components shall be able to withstand wind loads arising from

basic wind speed of 280 km/hr, except where mentioned otherwise, in accordance with

British Standard Code of Practice CP3 Chapter 5: Part 2 – 1972, including subsequent

amendments to date.

(ii) The Bidder shall provide a complete set of drawings and technical leaflets to ascertain

compliance with specifications along with the bid (one original and two copies).

(iii) The design shall make provision for space requirements for separate male and female

toilets and washing areas and wastewater disposal (not to be constructed).

(iv) The Bidder shall provide for necessary security hoarding, temporary accesses, warning

signs, protective nets and equipment, etc. as may be required to ensure safety and

security of users during construction.

(v) All debris and waste resulting from the works to be carted away to an authorized

dumping location.

(vi) All design, materials, workmanship and testing for the Works shall be performed in

accordance with the relevant British Standards or equivalent.

B. Design and Supervision

(i) The Contractor shall seek the services of Consultants (Registered Civil/Structural

Engineer and Mechanical/Electrical Engineer, and Architect if required by the concerned

Authorities) for the design and supervision of all components of the Works undertaken by

it.

(ii) The Civil/Structural Engineer shall act as the Lead Consultant for the Contractor and

shall coordinate the design activities, production of drawings and site supervision.

(iii)All design work undertaken by the Contractor and all construction and installation works

have to be certified by the Contractor’s Consultants, as required.

(iv) In addition, the Contractor shall ensure that the works are regularly supervised by his

Consultants and shall submit evidence thereof to the Engineer during construction and

maintenance period.

(v) The Contractor through his Consultants shall be fully responsible for the technical

inspection, supervision and monitoring of the structural and civil works, and

mechanical and electrical works comprised in the Works. The duties of the Consultants

will also comprise the following;

- General inspection of the Works in the form of such periodic visits to the site as the

Consultants consider necessary in order to ensure that the Works are carried out in

accordance with the requirements and intention of the design and instructions given,

- Attendance at site meetings/visits,

- The Consultants shall issue written approvals to the Contractor after each inspection

of works or part of works with which they are satisfied;

- Checking Contractor/nominated sub-contractors/suppliers drawings for permanent

works for conformity with design requirements and including detailed checking of

shop details for erection fit,

- Making arrangements for the inspection and testing of such materials and plant as

are usually inspected or tested and submission of test results along with

comments/approval thereon,

- Give instructions for appropriate repairs to faulty works if any are observed during

construction and until final completion,

- Detailed checking of reinforcement in position on site,

- Constant supervision during concreting operations,

- Detailed checking of structural steelworks in position,

- Inspection on site of special formwork,

- Checking of the setting out of all Works, such as reinforced concrete works, line

and level of formwork, line and level of structural steelwork, holding down bolts,

- Slopes and levels of all Works,

- All other duties usually performed by a Consultant with regard to design and

supervision.

(vi) The Contractor’s Consultants shall certify that all items of the Works for which the

Contractor applies for payment have been carried out as per drawings and

specifications and to their approval. In this respect, the Consultants shall issue a

certificate which the Contractor shall submit along with his applications for payment,

reading as follows: “I hereby certify that all civil/structural works (or mechanical and

electrical works) for which the Contractor has applied for payment in application No.

… (to be inserted by the respective Consultant) have been carried out as per drawings

and specifications and to my approval”. The Certificate shall be signed by the

concerned Consultant.

(vii) Prior to the issue of the Taking-Over Certificate, the Contractor shall submit written

certificates from his Consultants that the Works have been completed in accordance

with the Contract. Similar certificates shall be submitted by the Contractor prior to the

issue of the Final Completion Certificate. The format of the Certificates shall be similar

to the one mentioned in (vi) above, with specific reference to the Taking-Over and

Final Completion.

(viii) The Contractor’s bid shall include all fees for design and supervision by his

Consultants.

4. Documents Comprising the Bid

With reference to sub-clause 14.1 of the Instructions to Bidders - Documents

comprising the Bid - the following shall form part of the Bid. All drawings are to be

prepared in metric scale, in black and white and drawn on appropriately sized paper

(A0/A1).

Site and Location Plan – Scale 1:250 showing net houses, fencing, proposed

finished levels, slopes, drainage, external ground levels, access roads, sewerage

disposal system, rain water disposal system, water supply reticulation, electricity

and lighting network, setbacks, and other appropriate information;

Net house (1:50);

- Floor plans;

- Sections (minimum 2) and Elevations (4);

Fencing (1:50).

- Elevations

- Details

The Bid shall also include the following:

- A schedule of finishes;

- Technical literature and details for net house and fertigation system;

- Structural and Civil Engineering drawings showing the general design

proposal layout plans, sections, site drainage and boundary walls with fencing;

- Mechanical and Electrical Engineering drawings showing the general design

proposal;

- A concise report of not more that 20 (A-4) pages explaining the general

concept as regards the methodology of the construction; architectural,

structural & civil engineering, and mechanical and electrical engineering

design proposals;

- Detailed schedule of areas and the specifications proposed by the bidder to

meet the Employer’s Requirements;

- Any other typical details, which the bidder may consider as an important

feature of his proposal to an appropriate scale;

- Contract Sum Analysis as per format enclosed but to be modified and

elaborated, as necessary, based on the design; and

- Proposed time programme/programme of works, sequence and methods to be

applied for the execution of the works.

5. Contractor’s Documents

With reference to sub-clause 5.2 of the Conditions of Contract - Contractor’s

Documents - the Contractor’s Documents shall also include detailed construction

drawings, as follows:-

The successful bidder shall submit to the Engineer for his approval as to the

suitability and adequacy of the permanent works designed by the Contractor three (3)

hard copies and one soft copy of the below mentioned documents:

- Full design of the Works with calculations certified by the Contractor’s

Consultants designing the Works on behalf of the Contractor;

- Complete Architectural; Civil and Structural Engineering; and Mechanical

and Electrical Engineering drawings with layout, sections, reinforcement

drawings, steel work drawings including connection details;

- Specifications of methods;

- Specifications of architectural and engineering materials, and workmanship;

and

- List of tests to be performed on site and in the laboratory and their frequency.

The Contractor shall submit the Contractor’s Documents which shall be complete in

all respects and in sufficient details to enable the Employer and his representatives to

fully understand and evaluate the Contractor’s Design.

If in the opinion of the Engineer, the Contractor’s submission does not meet the

requirements of the contract or that of the statutory body, the Engineer will notify the

Contractor who shall make appropriate amendments and shall submit to the Engineer

within seven (7) days three (3) copies of amended calculations, drawings and

specifications. The procedure described above shall apply to all re-submissions.

Construction works shall not start until the Engineer has approved the relevant

drawings and once approval has been given, no alterations shall be made to the

drawings without further approval of the Engineer. However, even after the

Engineer’s approval, the responsibility and liability of all design and subsequent

drawings wholly rests on the Contractor, his design Consultants and Suppliers.

During construction stage, additions and modifications to the design may need to be

carried out at no additional cost to the Employer, to be in line with Employer’s

requirements, bid proposals, good building practice, regulations and international

norms.

6. Facilities for the Employer’s Personnel

With reference to Sub-clause 6.6 of the Conditions of Contract - Facilities for Staff

and Labour - the Contractor shall provide an office adequately furnished for use by

the Employer’s personnel and the Engineer and for meetings on site for the whole

duration of the Works. The same shall be removed at the completion of the Works.

7. Performance Tests and Site Commissioning

(i) The Contractor shall carry out all laboratory and on site tests and commissioning of

all items of plant, equipment and materials supplied and installed under the Contract.

(ii) The Contractor shall prepare all laboratory and on site test results and certificates for

all items as required by the relevant Standards. These test results shall be provided

to the Engineer in accordance with the Contract and copies shall be included in the

O&M manuals.

(iii) All tests shall be performed in accordance with the relevant British Standards or

equivalent.
