Recommendation: That the Pilbara JDAP resolves to: 1. Approve DAP Application reference DP 11/02543 and accompanying plans

submitted under this application being Figures 1, 2, 3, 4 and 4a to 4g, 5, 6, 7 and 7a, 8, 8a to 8c, 9, 9a to 9i, 10, 11 and 11a, 12, 13 and 13a and 14 in accordance with Clause 8.1 of the Shire of East Pilbara Town Planning Scheme No. 4, subject to the following conditions:

a) All development shall be in accordance with the submitted plans; b) Prior to the construction of all hard stand and parking areas, a Car Parking

plan shall be submitted to the Shire of East Pilbara indicating the following minimum number of car parking Spaces:

i. 8 spaces to the Security Gatehouse; ii. 11 spaces to the Early Mining Operations Office; iii. 50 spaces to the Administration Complex; iv. 27 spaces to the Mobile Equipment Maintenance Workshop and

Warehouse; v. 9 spaces to the Fixed Plant Workshop; and vi. 4 spaces to the Sample Preparation Shed;

c) All car parking to be constructed in accordance with the requirements of the Shire of East Pilbara Local Planning Policy No. 4 – Vehicle Parking Standards;

d) All waste water from the proposed light and heavy vehicle wash-downs shall be contained on site and appropriately treated for reuse and/or removed from site in an appropriate manner for the disposal and treatment at an alternate location;

e) A stormwater and drainage management plan being prepared and implemented for use on site to the satisfaction of the Shire of East Pilbara;

Advice Notes: a) If the development the subject of this approval is not substantially

commenced within a period of 2 years, or such other period as specified in the approval after the date of the determination, the approval shall lapse and be of no further effect;

b) Where an approval has so lapsed, no development shall be carried out without the further approval of the Council having first been sought and obtained;

c) All building works are to comply with the legislative requirements; d) Prior to the commencement of any work on site, the applicant must obtain a

Building Licence from the Shire and Structural Engineers Certification in accordance with the Requirements of the Building Code of Australia;

e) Consultation will be required with the Shire of East Pilbara and Department of health with regards to the on-site treatment of effluent, waste waters and the construction and implementation of effluent and waste water treatment plants

The proposal is for the development of infrastructure and mining specific services to facilitate the mining of Ore Body 24 deposits to contribute to BHP Billiton’s proposed annual export of up to 500 million tons per annum. The Mineral Lease the subject of this application incorporates other Ore Body’s including Mt Whaleback Mine, Ore Body 25 and so on. There have been multiple previous applications determined by the Shire of East Pilbara and include, but are not limited to:

Power Station; Accommodation Village; Administration and associated offices; Bus loop; Car park; and Warehouse and Storage facilities.

Details: outline of development application The purpose of the subject application is to develop facilities in order to mine the deposits of Ore Body 24 and to do so; the applicant requires to develop the following:

Primary Crushing facility: o Primary crusher;

o Primary crushing electrical substation; o Loadout Conveyor; o Train loadout area; and o 11 KV Train Loadout Electrical Substation

Heavy Vehicle Tyre Change facility: o Tyre maintenance shed and office; o Amenities building including toilets and store room; o Tyre maintenance slab; and o Tyre storage area

The proposed application is for the development of infrastructure to facilitate the mining of Ore Body 24 (OB24) which has been a long known deposit for iron ore. Ultimately, OB24 is being geared to replace the Wheelarra Mining project and to simultaneously operate with the existing Whaleback and Ore Body 25 projects in meeting the demands of the iron ore export trade. OB24, which is incorporated into the subject property Mineral Lease 244SA (AML70/244) and granted under the Iron Ore (Mount Newman) Agreement Act 1964, is situated approximately six (6) kilometres north-east of the Newman Townsite and as mentioned, forms part of the immediate areas network of iron ore deposits. This being the case, the predominant land use is currently Mining as defined under the Mining Act 1978 therefore all developments the subject of this application can be classed as being “Ancillary Use(s)”. An Ancillary Use is defined under Schedule 1 of the Shire of East Pilbara Town Planning Scheme (the Scheme) as being: “means a use which is incidental to the predominant use of land and buildings” The Shire of East Pilbara have no development guidelines/standards with regards to the structures of mining developments and other associated developments, therefore, such requirements would be at the discretion of Council, or in this instance, JDAP. There are however requirements under the Scheme and Local Planning Policy No. 4 pertaining to vehicle parking requirements. The following is a list of the requirements for parking to the necessary areas as determined by the Local Planning Policy: Security Gatehouse (8 Parking Spaces - Minimum): This space has two primary functions, one being the operation as a security gatehouse and the other being as an induction/testing area. The total area of the building (excluding toilet facilities) is 156m². Under Local Planning Policy No. 4 – Vehicle Parking Standards (LPP4) an office requires 4 spaces per 100m² of Gross Lettable area (GLA) with a minimum of 4. With regards to the induction/testing area, this is not a suitably defined use under the policy and can therefore be at the discretion of council. Given the circumstances, it would be advisable to calculate such area based on the “office” use which is 4 spaces per 100m² GLA with a minimum of 4, that being said, they would require a minimum of 4 spaces for such area. Early Mining Operations Office (11 Parking Spaces – Minimum): The two areas of this facility that require parking is the small office and the 32 person crib room. The office has an area of 120m² with the requirements being 4 spaces per 100m² GLA resulting in an approximate total of 5 parking spaces. The crib room can be calculated using section 3.9(e)(ii) of LPP 4 which requires 1 space for every 5 seats resulting in the requirements for 6 seats. Administration Complex (50 Parking Spaces – Minimum): The areas requiring parking in this complex are the office, reception, computer training room and a 128 person crib room. The requirements for this area are based on the “Office” requirements of LPP 4 with the exception of the crib room which is based on section 3.9(e)(ii) of LPP 4.

Administration – 386m² resulting in 4 per 100m² = 16 spaces; Reception – 121m² resulting in 4 per 100m² = 5 spaces; Computer Training Room – 63m² resulting in 4 per 100m² = 4 spaces; and

Crib Room – 128 seats with 1 for every 5 seats = 25. The meeting rooms are not required to have allocated parking as it is perceived that the use of such rooms would only be utilised by those currently working in the office complex. Mobile Equipment Maintenance Workshop & Warehouse (27 Parking Spaces - Minimum): As this is a multiple use building, it is suggested that discretion be used when applying LPP 4 for the main reason that the subject OB24 is not used for accommodation, therefore workers would either commute as car pool or be transported by mass transport to and from the site. Furthermore, given the large expansive areas of mining facilities, there is generally ample hard stand area to be used in the event that parking areas would overflow. Under LPP 4, a warehouse would require 2 spaces per 100m², given that the building is a total of approximately 2721m², the requirements would be approximately 55 parking spaces. Given the previous mentioned reasons, it is suggested that discretion be used and enforced to a number not more than 1 space for every 100m² resulting in a total of 27 parking spaces. Fixed Plant Workshop (9 Parking Spaces - Minimum): For the same reasons described for the Mobile Equipment Maintenance above, discretion is advised to be utilised and require only 1 space for every 100m². Fixed Plant Workshop – 570m² resulting in 1 space for every 100m² = 5 spaces; Office – 63m² resulting in 4 spaces for every 100m² = 4 spaces. Sample Preparation Shed (4 Parking Spaces – Minimum): As this is not a defined use under LPP 4, discretion is required and based on the nature of the building, may best be aligned with a Warehouse use which requires 2 spaces per 100m² or 2 spaces per employed or a minimum of 4 spaces per tenancy ; whichever is the greater. Based on the area of the building being approximately 85m², the unknown number of employees, the minimum required would 4 spaces. As previously mentioned, there are no development criteria for the proposed infrastructure/structures. Furthermore, it is not proposed that any conditions be imposed to any such effect as the mining activities do not interfere with or are visible from public places. All proposed infrastructure has been suitable designed and engineered in order to achieve certification. Options/Alternatives No alternatives are perceived. Conclusion: The proposed development(s) are consistent with the Scheme to the point that all proposed development(s) are ancillary to the predominant use of the land. Furthermore, the proposal is consistent with all other legislation indicated previously in this report. No design guidelines are required to be adhered to given the semi-permanent nature of the infrastructure. However, it has been noted that minimum parking provisions are required which include the design and minimum number of parking spaces.
