The mine site slopes, terraces and reclaimed channels were inspected after the pre-bid meeting which was held on 6/10/2014 from 9 to 11 a.m. The mine site is stable. Whiskey Creek has flow of about 0.5 gpm in the reclaimed area. Two springs are mere wet spots on the banks. The slopes are green with perennial grasses, forbs and shrubs, particularly in the biosolids treated locations.

The loadout was inspected on 6/12/2014.

The "eyebrow" above the large sinkhole is stable. Vegetation has taken hold on its berm and in the ditch.

Pocks/gouges are stable and functioning. A few pocks are holding water. Most are dry.

There is evidence of elk, deer, cougar passing through the area.

The slurry pond #1 and #5 are both inactive. It is likely these slurry ponds will not be active until next spring. Slurry Pond is or near or ready for reclamation. Majority for the coal has been mined this year. There is a small area that still has coal slurry but the ash content may or may not be high.

The slurry pond #1 is near or now ready for reclamation. It depends on the quality of slurry still within the pile to determine if pond can be reclaimed. It the material is to high in ash then is pile can be reclaimed.

Since, the last inspection the permittee mined approximately 3,000 tons from slurry pond #5.

The identification signs are next to the roads to the mine site. The identification sign meets the minimum requirements of the R645 Coal Rules.

2. Signs and Markers

The permittee has been working in Middle Fork Canyon clean culverts and diversion. The diversions and culvert are not design to handle the runoff from the mountain since the forest fire. The mud from last year’s rainstorm was as high as the top of a road grader tire. That is about 5 feet of mud laid down from the storm event.

4.a Hydrologic Balance: Diversions

The sediment pond was cleaned out last year in middle fork canyon. The permittee is now clean this pond again due the last year’s rainstorm. The sediment pond was filled with 10 feet on mud from one rainstorm. The permittee is in the process of cleaning this pond again.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

Inspected the refuse piles and did not see any hazardous conditions. The permittee mined approximately 3,000 tons from slurry pond #1 since, the last inspection.

7. Coal Mine Waste, Refuse Piles, Impoundments

The site is generally clear of non-coal waste materials.

8. Noncoal Waste

The rainstorm of last year caused a massive mud flow in the Middle Fork Canyon. This is cause by the forest fire of the year before.

10. Slides and Other Damage

The permittee is continuing cleaning the main road in Middle Fork Canyon.

All road drainages in Middle Fork Canyon are open and functioning as design.

The permittee is in the process of grading for new spur line (new train track) for oil trans-loading. The Westside of the property is used for trans-loading of crude oil.

The permittee installed new identifications from roads leading to public access. The information contains within the signs meet the R645 Coal Rules. They have also installed new MSHA signs.

The topsoil piles were inspected with no signs of wind or water erosion. The topsoil piles were stable.

The diversions and culverts were recently clean throughout the property. No water was flowing within these diversions and culverts at the time of the inspections. The diversions would function as design during a storm event.

Most of the sediment ponds were dry. No hazardous conditions were noticed. The embankments were stable. The sediment ponds are not likely to discharge in the near future.

I inspected the refuse piles and slurry ponds. No hazardous conditions were noticed during the inspection. The slurry ponds had test pits for coal quality. Some of the material will be used for a test burn.

The current DOGM permit remains valid through May 6, 2016. The current UPDES permit (UTG040024) is valid through August 31, 2018.

The Permittee had the proper identification signs in place. The ID signs were located at the point of access and included the name, address, telephone number, permit number and MSHA ID number. Disturbed area boundary, perimeter markers, and topsoil storage areas signs were correctly placed.

2. Signs and Markers

Topsoil storage areas signs were correctly placed. No wind or water erosion was observed. No additional topsoil was placed and there was no topsoil reclamation taking place. No resources were leaving the topsoil area. Vegetative cover is protecting the topsoil stockpile as well as can be expected. The designed sediment control berm for the topsoil stockpile (identified in the MRP) is in place and functioning properly.

3. Topsoil

All diversions, ditches, and culverts are properly designed with certified drawings. Ditches and culverts were in need of general maintenance. The issues will need to be addressed before the next DOGM inspection or technical visit.

4.a Hydrologic Balance: Diversions

Impoundments have been properly inspected (most recent inspection was complete 9-16-13). No hazards or signs of instability were identified at either Pond 1 or Pond 2 during the inspection. Both ponds contained water. All inlets and outlets were functional. The elevations at pond 1 and 2 are 5834 and 5835, respectively.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

Silt fences needing maintenance were identified. Maintenance for sediment control measures and diversions needs to be completed by the next inspection. Jay Marshall provided updated photos of the portal ASCA areas. The ASCA's appear to be functioning properly and are controlling sediment as planned and designed.

4.c Hydrologic Balance: Other Sediment Control Measures

No UPDES parameters have been exceeded. Water monitoring has been conducted according to schedule.

Both of the UPDES outfalls were reported as "no flow" on 5-31-14. The timeliness of each reporting period was in accordance with the permitted reporting criteria.

No permitting action is currently being processed with the Division for Soldier Creek Mine. The permit will expire on Feb. 03, 2017. The SPCC plan was last updated on October 11, 2011. The UPDES permit will expire on August 31, 2016. The UPDES permit number is UT0023680. The Air Quality permit is DAQE-334-94.

The identification sign was on the side of the main road overlooking the sediment pond. The information addressed the requirements of the R645 Coal Rules.

The diversions were open and would function during a rain storm event.

4.a Hydrologic Balance: Diversions

I inspected the sediment pond. The permittee did some prevention of otter slope failure by installing post and wooden planks on the outslopes of the sediment pond. The stream is adjacent to the outslope of the sediment pond. The outslope is nearly vertical drop to the stream. The sediment pond is incised and was completely dry. There were no hazardous conditions and no signs of slope failure. This work is to reduce the possibility of future problem.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

The water monitoring information is submitted to the Division in Salt Lake City.

There was no discharge from the sediment pond for the first quarter of 2014.

The site was clear of non-coal waste materials. Some old equipment could be considered as non-coal mine waste since the equipment was vandalized last year.

The mine identification sign was in place on the metal archway at the entrance into the mine permit area. The identification sign contained the information that is required in the Utah R645 Coal Rules. The mine identification sign is compliant with the coal rules.

Diversions and culverts were inspected. The culvert inlet at the road entrance to the main office is partially filled with sediment, but still functional. The culvert outlet across from the fuel station is partially filled with sediment, but still functional. The undisturbed culvert inlet by the oil storage building is partially filled with leaves and sediment, but is still functional. Arrangements to schedule the maintenance of these structures was scheduled prior to the close of the inspection.

The Second Quarter 2014 sediment pond inspections were done on June 6, 2014.

The trans- loading oil is taking place at Savage Coal terminal. There is a possibility that this could be expanded in the near future. The road expansion for loading crude oil is completed and is use.

The coal storage facilities was receiving trucks for loading or unloading of coal during the inspection.

The shipping and loading of coal on to unit trains should increase slightly.

The wash plant was idle.

Identification sign was at gate to permit area. The information meets the minimum requirements of the R645 Coal Rules.

2. Signs and Markers

The topsoil pile by the coal stock piles was inspected. The topsoil pile was stable with no signs of water or wind erosion. Some vegetation is growing on the pile. The topsoil pile silt fences needs maintenance. The silt fence is sagging and is rip in some places.

3. Topsoil

The diversions were inspected and some minor cleaning of diversions will be needed in the near future. Coal fines have started to build-up within the diversions. The diversions at this time are still functioning as design. Permittee has stated that the diversions will be clean out.

4.a Hydrologic Balance: Diversions

The sediment ponds were inspected with no hazardous conditions noticed during the inspection. No sediment pond was discharging. The sediment ponds were dry except for the lower sediment closes to the pump house. This sediment pond is used for wetting down the haul roads. The sediment ponds are incised.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

The refuse pile is totally eliminated for the time being. No refuse pile inspection is needed as long as there is no refuse.

The mine identification sign is posted at the entrance into the mining permit area on a power pole. The sign contains all of the required information set forth as requirements in the Utah R645 Coal Rules.

4.a Hydrologic Balance: Diversions

The sediment ponds were inspected for the First Quarter of 2014 on March 27, 2014. A report was compiled and P.E. certified. Existing sediment levels for all of the sediment ponds was found below the 60% sediment elevation level, which requires that a pond be cleaned.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

The discharge monitoring reports for Janaury, February, March, April and May 2014 were reviewed as part of the complete inspection. The reports showed that no discharge occurred in any of the months listed from any of the sediment pond outfalls for the mine site. The reports were submitted to the State of Utah Department of Environment Quality.

4.e Hydrologic Balance: Effluent Limitations

The excess spoil piles #1 and #2 were inspected on March 27, 2014 for first quarter 2014. A report was compiled and P.E. certified. The reports did not show any problem with either excess spoil pile. Excess spoil pile #2, phase #2 is the pile that is being actively utilized.

The first quarter 2014 refuse pile inspection was done on March 27, 2014 and has been P.E certified.

The permittee had a survey conducted on the shaft area in November 2013. The shafts settled near one inches. This could be in the error of the survey accuracy. The shafts appear to be stable and no change since the last inspection.

The permittee has completed the reconstructing of three diversions. A 200 plus year rainstorm this summer had moved rip rap, cause erosion within the stream channel. The repair was completed in November16, 2013.

No violations were issued.

The DOGM Permit will expire on April 26, 2016. The permittee will seek bond release in 2015 for all properties except lower Crandall Canyon shaft area. The shaft area is about 1 acre.

I inspected identification signs at the gate to Crandall Canyon, the topsoil barrow area along highway US 50-6, and next to the road along Indian Canyon. The signs meet the minimum requirements of the R645 Coal Rules.

All available topsoil was used in reclamation. I did not see any signs of erosion to the topsoil. The soil appeared to be stable.

The reconstructed diversions were functioning as design. No water was flowing within the diversions.

The mine was active and mining coal. The mine is still running one miner section. There may be an increase in production in the near future. There is also talk about reinstalling a longwall.

No coal was being shipped during the inspection. Coal is ship durning the late afternoon.

There are plans to continue reclaiming the De-gas pads. The permittee is short handed to oversite the reclamation of the DE-gas pads and roads.

I reviewed the identification signs at the mine, the information on the sign meeting the minimum requirements of the R645 Coal Rules. It is next to the gate entering the mine site. There are also identification signs at the refuse pile and topsoil pile. The information is the same on all signs.

2. Signs and Markers

I inspected the topsoil piles at the refuse pile and at the main road to Soldier Creek Mine. The topsoil piles were stable with no signs of wind or water erosion.

3. Topsoil

Several diversions need to be clean out. The diversion along the road to the water tanks need to be clean out and regarding to the diversion around the refuse pile in some areas need grading. Sediment has started to build-up in these diversions. These diversions will function as design.

4.a Hydrologic Balance: Diversions

I inspected the mine site sediment pond and it contained water but was not discharging during the inspection. The refuse sediment pond was completely dry. I did not see any hazardous conditions. The embankments were stable. The permittee inspected the sediment ponds on April 16, 2014. No hazardous conditions were reported.

Water monitoring information is submitted to the Division. The information is reviewed and a report is written.

There was no discharge for the first quarter of 2014.

The refuse pile was inspected by the permittee on April 16, 2014. No hazardous conditions were reported. I inspected the refuse pile and the permittee will need to do minor maintenance to the diversion at the toe of the refuse pile. Sediment has started to fill the diversion. The diversion will function as design but maintenance will be needed.

-Mining permit C/007/042 issued November 14, 2008 and expires November 14, 2013.-UPDES permit #UTG040025 effective September 1, 2013 and expires @ midnight August 31, 2018.-Air Quality Permit DAQE-239-02 issued April 1, 2002, remains in effect.-SPCC plan is not required.-Certificate of Insurance effective 08/01/2013 and terminates 08/01/2014.-Reclamation agreement is dated October 14, 2003 and signed by both parties.

1. Permits, Change, Transfer, Renewal, Sale

The mine identification sign is posted at the entrance into the permit area.

2. Signs and Markers

The sediment ponds were inspected during the First Quarter of 2014 on March 27, 2014. A report from this inspection was compiled and then P.E. certified. The reports were checked to make sure that all existing sediment elevations are below the 60% sediment elevation. Once the sediment level reached the 60% sediment level the pond is required to be cleaned.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

The discharge monitoring reports for January, February, March, April, and May 2014 were reviewed as part of the complete inspection. The reports and submittal letter to the State of Utah Division of Environmental Quality shows that no discharge occurred from any of the outfalls during the listed month.

4.e Hydrologic Balance: Effluent Limitations

The first quarter 2014 refuse pile inspection was done on March 27, 2014 and has been P.E certified.

7. Coal Mine Waste, Refuse Piles, Impoundments

The air quality permit DAQE-239-02 was issued on April 1, 2002 and remains in effect.

Abandon Mine Lands (AML) have finish reclaiming an adjacent property next to the Deer Creek Mine. The site is a major improvement to the land. All coal fines are removed and sediment and coal will not go into the creek. The site is seeded. It seems the reclaimed area has done well. There are no signs of erosion. The matting has held up throughout the winter.

The mine was active.

Currently the UMWA union is working under the old contract/agreement. The permittee/operator are in talks for a new union contract.

The mine identification signs are located at all points of public access into the various permit areas. The signs contain the necessary information to meet the R645 Coal Rules.

I inspected the bypass diversion at the refuse pile. The diversion was open and would function as design. The permittee did clean many diversions and catch basins. No water was flowing within the diversions.

I inspected the sediment pond at the mine site. It was filled with water and does discharge often. No hazardous conditions were noticed. The outslopes of the sediment pond was stable.

The mine identification sign was checked. The sign are located at the entrances into the mining permit area from public access. The signs are compliant.

The culvert that directs flow under the mine haul road leading to Pond #2 needs maintenance. The sediment level is nearing the half capacity level.

OSM expressed concerns on portions of the side slope of the diversion leading into pond #3. No measurements were taken. The side slopes should be at a two to one.

4.a Hydrologic Balance: Diversions

Pictures of all the sediment ponds was taken during the inspection. Pond #2 is dry the other ponds 1, 1B, 3 and 4 contained water.

First Quarter 2014 pond inspections were done on 03/26/2014. The reports include the elevation of the existing sediment level. All existing sediment elevations were found below the 60% sediment elevation for each pond.

Work is needed on the East inlet into pond #1.

The purpose of this site visit was to access the portion of Quitchupa creek at the confluence of the springs and discus the mitigation requirements outlined in the approved subsidence mitigation plan. The undersigned along with the notedrepresentatives from the mine accessed the area from the south side of the canyon where the two springs flow into Quitchupa creek.

The monitoring and mitigation plan, (Appendix 3-14), for undermining the south fork of Quitchupah 2R2S Block Aand 3R2S Block B is found in volume 5 of the approved MRP. The steps for mitigating subsidence outlined in the plan were discussed with representatives from the mine. Division staff requested that the narrative describing the mitigation measures along with a map containing the gps coordinates and locations of the repaired area and monitoring points be provided to the Division by Monday, June 9th.

The mine identification sign is placed at the entrance into the mine permit area and contained the required information as set forth in the Utah R645 Coal Rules.

Two undisturbed bypass inlets were checked as part of the partial OSM oversite.

The two sediment ponds that run in series were observed as part of the partial OSM oversite.

Site was found free of noncoal waste items outside of the designated containments.

8. Noncoal Waste

Subsidence cracks and crack repairs were observed. Special attention was given to those that lay in the stream channel. Flow interruption was noted on May 16, 2014. Flow interruption was observed from a canyon rim monitoring location. Flow could still be seen at a lower location. On May 19, 2014 personnel hiked into the canyon bottom and found the cracks that the water was running into. Personnel shoved native material into the cracks and then ordered bentonite. On May 21 and 22, 2014 bentonite was placed into the first three cracks and subsequently two additional cracks another 50 feet downstream. Nineteen 50 pound bags of bentonite was used. Water was observed flowing below monitoring location 006C on the 22nd. On May 23, 2014 flow was observed to be consistent at locations 006A and 006C . Joe Helfrich observed flow at location 006D On May 27, 2014.
