The nineteenth edition of this spectacular chapter event was one certainly to
remember. The historic ocean liner was alive as it must have been when passen-
gers sailed across the Atlantic in years gone by, with the sounds and sight of
costumed carolers, a pianist playing familiar holiday songs, and an overall
ambience fitting of a Currier & Ives Christmas portraiture.

President’s Corner My first article in large part will be the
words I spoke after being elected to
serve as your Chapter President on
December 11th aboard the Queen
Mary. I have freshened it up a bit but
am still just as excited and honored to
serve all of you, our valued members.
Good evening everyone! I wish to
thank the membership and the Board
of Directors for your vote of confi-
dence. Most importantly I want to
thank Terry Osburn for the fantastic
job he did as serving the Chapter so
well as its president during the past
four years. His accomplishments were
many and maybe the most important of
his accomplishments, is that he created
a positive outlook for the chapter and
our industry.
Special thanks to Don Vulich, our lead
negotiator in working with our labor
partner Grant Mitchell and the rest of
his team at District Council 36, in
crafting a new labor agreement that is
reasonable in these trying and difficult
times. Special thanks are also in order
for our valued Associate Members
who help plan many of our successful
events and meetings throughout the
year. I would also like to thank Greg
Quinn for his outstanding job as the
association's Executive Director and to
his wife Kim for their hard work and
dedication to this chapter.
I have seen many of you at various
meetings. But some of you may not
know each other. That is why it is im-
portant that we gather at social events
such as this, so we can exchange ideas,
discuss business issues, and build rap-
port with each other to work together
to improve the industry as a whole. I
hope you noticed that we have a new
member on the Board and that is
Robert Stewart! In the past two years,
Robert has been a regular at our luncheon
meetings, attended our social events, state
PDCA conferences, and has shown an
increasing interest in this association and
our industry. With Robert's years of experi-
ence in our industry, I know all of us on
the Board of Directors will value his input
and together we will work on issues impor-
tant to our industry now and into the fu-
ture.
As most of you know, our association is
comprised of various industry leaders who
are involved in the Residential, Commer-
cial, and Industrial sides of the industry.
We have always welcomed any profes-
sional signatory painting contractor into
our association and have never restricted
membership to the "big boys". We have
over 60 contractor companies , ranging
from the small 2-3 person shop to the lar-
ger contractor and represent all of them
equally on issues and events that face our
ever changing and challenging industry at
the local, state and national level.
I realize that there are other associations
out there, but you really have to admit, the
Los Angeles Painting & Finishing Contrac-
tors Association has provided all of our
members the best information on issues
concerning our industry. This information
is provided to you in many ways: Chapter
Newsletter, Luncheon Meetings, website,
fax, mail, e mail updates. We also offer our
members a number of free services, includ-
ing employee safety books, estimating
guides, construction law books, green
training classes, and PDCA Contractor
College courses. I can tell you that other
similar associations have not and do not go
this far in detail to keep you informed on
industry issues or events that affect our
businesses. So the question I ask myself, is
why in the world would anyone leave this
association?
After the first of the year, you will have the

opportunity to rate your chapter.
That's right you will be receiving a
report card in which you can tell
your Board how you feel the chapter
is doing and what you would like to
see us focus on, or any suggestions
you may have. I promise you that the
report card will be simple to fill out
and once you do so, just place it in
the return envelope and mail it to
your chapter office. We are even
providing the postage.
Has anyone had the opportunity to
visit our website? You should, as
under Terry Osburn's tenure, our
website has gone through a major
transformation. With the help of our
marketing professional John Teno-
rio, we now have a website that
showcases who we are and why our
contractor and associate member
companies are a 'step ahead" of the
competition. With just one click you
can view our marketing DVD, a list
of all our members, past newsletters
and a number of other areas promot-
ing our chapter and industry. For
2011, it is my goal to add a Forum
page on our website so members can
post questions concerning industry/
association issues. The area will be
available to everyone and will be a
great place to stay informed and
voice your concerns.
My wife Pat and I hope that you and
your family had a very Merry Christ-
mas and that 2011 will be bring you
health and prosperity!

CILC Legislative Conference on
April 12 in Sacramento
The Construction Industry Legisla-
tive Council (CILC), a consortium of
over 40 subcontractor trade associa-
tions in the state (PDCC and
LAP&FCA are active members) will
be holding their annual "Day At The
Capitol" on Tuesday April 12th in
Sacramento.
The morning session features speak-
ers who will talk on issues that atten-
dees will later take to their respective
legislators in the afternoon at the
State Capitol. To make their visit to
the State Capitol more meaningful,
position papers on key bills will be
given to each attendee.
The cost of registration will be reim-
bursed by PDCC for any LAP&FCA
member who registers for the confer-
ence. Registration includes breakfast,
program and lunch. You will be re-
ceiving registration forms from
CILC soon and if you are interested
in attending or have any questions
please contact your chapter office at
323-258-8136.
SB189 Passes
SB189 (Lowenthal) has passed and
brings to an end the decade long re-
view of the Mechanic's Lien process
by the California Law Revision
Commission. This will renumber and
recast every statute pertaining to Me-
chanic's Liens, Stop Notices, and
Payment Bonds, among other statutes
relating to recovery by contractors.
Those changes do not become effective
until July 1, 2012 and once effective,
all of the references to specific statutes
that pertain to the enforcement of Me-
chanic's Liens, Stop Notices and Pay-
ment Bonds will be obsolete. While
most of the changes in SB190 are not
substantive (they do not change the
substance of most of the statutes) the
law will be contained in different stat-
utes and the current references will not

Project Labor Agreement News
Wilshire Grand Hotel
Officials from Korean Air and real es-
tate developer Thomas Properties
Group announced on December 15 that
the companies have signed a PLA with
the Los Angeles and Orange Counties
Building and Construction Trades
Council for an estimated $1 billion
redevelopment of Los Angeles's Wil-
shire Grand Hotel. It is estimated that
the hotel's renovations would create
about 7,200 direct construction jobs
and 5,000 construction related jobs
over the four years that it will take to
complete the project.
Korean Air and Thomas Properties
Group proposed the redevelopment in
April 2009 wanting to construct two
LEED-certified high rise towers to the
replace the hotel's original building.
The towers will house nearly 560 hotel
rooms and up to 100 condominiums,
along with 275,000 square feet of retail
shops and office space.
LAX Extends PLA
The LA/OC Building Trades Council
and Los Angeles International Airport
have agreed to a 10-year extension of
the PLA that has been in effect for 10
years and was scheduled to expire at
the end of the year, adding a local hire
provision and a list of new projects to
the agreements original language,
Richard Slawson, executive secretary
of the LA/OC trades council said.
Some of the new projects listed in the
agreement include terminal remodel-
ing, a connector between terminals,
new taxi lanes, and a central utilities
plant. The projects in the agreement
total $1.6 billion.
PLA for Hospital Project
The LA County Board of Supervisors
voted on December 14 to go ahead
with negotiations with local trade un-
ions for a PLA to cover a $121 million
project to build an outpatient clinic at
the new Martin Luther King Jr. Medi-
cal Center. The PLA which must still
be worked out with the Los Angeles/
Orange Counties Building and Con-
struction Trades Council, will include
provisions that at least 30% of total
construction labor hours will be per-

"that have been suspended or de-
barred" without providing a compel-
ling, written reason to the contracting
officers. Previously, the prohibition
applied only to first-tier subcontrac-
tors.
1099 Repeal Efforts Fall Short in
the Senate - For Now
On November 29, 2010 the U.S.
Senate failed to approve two amend-
ments that would have repealed the
expansion of IRS Form 1099 report-
ing requirements. 67 votes were
needed in order to suspend the rules
of the Senate and vote on repeal leg-
islation offered as amendments to the
FDA Food Safety Modernization Act
(S. 510). The amendment offered by
Sen. Johanns (R-Neb) which would
have paid for repeal with unspent
federal dollars identified by the Of-
fice of Management and Budget,
failed 61-35. The amendment offered
by Sen. Baucus (D-Mont), which
was not paid for, failed 44-53. Both
Senators expressed a desire to offer
repeal legislation once the new Con-

the PLA will be defined as a qualified
local worker who lives in poverty, has no
High School diploma or GED, possesses
a history of incarceration, has experi-
enced protracted unemployment, is a cur-
rent recipient of social service benefits,
or is a single custodial parent, Supervisor
Mark Ridley-Thomas said.
Voters Approve Ballot Measure Banning
PLA's on San Diego County Projects
Voters in San Diego, by a 75% to 25%
margin, approved a ballot initiative on
November 2 that bans project labor
agreements on publicly funded projects
in San Diego County.
In June, voters in Oceanside and Chula
Vista passed similar bans applying to
municipal projects. Supporters of ban
included Associated Builders and Con-
tractors of San Diego (ABC), Associated
General Contractors of San Diego
(AGC), and the non-union Coalition for
Fair Employment In Construction
(CFEC). The San Diego County Building
and Construction Trades Council did not

Federal White House-GOP Tax Compromise
Advances on Capitol Hill
The U.S. Senate passed the $858 billion
White House-GOP tax compromise
package (H.R. 4853) on December 15 by
a vote of 81-19. The package includes:
Estate Tax reform, which sets the top
estate tax rate at 35% and an exemp-
tion for first $5 million of an individ-
ual's estate, instead of reverting to
the pre-2001 tax rate of 55% with an
exemption of only $1 million.
A one-year extension, and a tempo-
rary increase to 100%, of bonus de-
preciation for investments in new
business equipment.
A one-year extension of the in-
crease in the maximum amount
and phase-out threshold of de-
ductible business investments
under Section 179
A one-year extension of the
100% exclusion of the gain from
the sale of qualifying small busi-
ness stock that is acquired before
January 1, 2012 and held for
more than 5 years.
A two-year extension of the
35% income tax bracket.
A two-year extension of the
capital gains and dividend tax
rates of zero percent for taxpay-
ers below the 25 percent bracket
and 15 percent for those in the
25 percent bracket and above,
rather than 10 and 20 percent,
respectively.

December 13, 2010, contractors on
federal projects "shall not enter into
any subcontract in excess of
$30,000" at any tier with contractors

in 2011 include manufacturing build-
ings (+9%) and health care facilities
(+9%). MHC foresees declines in
highways, bridges and other trans-
portation construction, largely due to
"fading" stimulus spending. Murray
predicts that "while the economy is
still facing headwinds, the stage is
being set for construction to see
modest improvement in 2011 from

McGraw-Hill Construction
Forecasts Gains for
Commercial Construction
in 2011 In its 2010 Construction Outlook re-
port, released on October 29, 2010,
McGraw-Hill Construction estimates
that construction starts nationwide will
show a decline of 2% in 2010, followed
by an increase of 8% in 2011. The 2010
figures would follow declines of 24% in
2009, 13% in 2008 and 7% in 2007. As
in 2009, the primary cause of this year's
decline in commercial construction,
which is expected to pull back by 17%
from 2009 levels - the sharpest decline
of any market sector.
"2010 was another year of double-
digit declines for commercial construc-
tion," said Robert A. Murray, MHC vice
president of economic affairs. "The de-
clines slowed compared to 2009, and
commercial construction looks to be on
the uptick in 2011." The Outlook report
forecasts a 16% increase in commercial
building starts in 2011. The report also
notes that the "diminished 2010 per-
formance for construction has its coun-
terpart in the fragile U.S. economy. The
(construction) economic recovery
seemed to take hold at the end of 2009
and in the early months of 2010, but
then it lost momentum during the
Spring. MHC predicts that if access to
credit remains limited, this could possi-
bly "restrain any upturn for construction
in the near future."
Looking to 2011, the report predicts
that firms will remain slow to hire and
the fiscal condition of the states will
remain weak, with growth mainly
driven by single family housing (+27%)

Three Percent Withholding Tax
Repeal
National FCA continues to work
with our coalition partners to repeal
a sweeping new requirement man-
dating that federal, state, and local
governments withhold three percent
from payments for goods and ser-
vices. This unprecedented withhold-
ing mandate will affect all govern-
ment contracts as well as Medicare
payments, farm payments and some
grants. The effective date was ini-
tially set for January 1, 2011, but
was delayed one year to January 1,
2012 by the American Recovery
and Reinvestment Act that was
signed into law on February 17,

One of the many highlights of the eve-
ning was when Don Vulich presented
the 2011 LAP&FCA Outstanding
Member Award to Terry Osburn. The
award is given every two years and
only when there is a member worthy of
its criteria. The award read, "In appre-
ciation for your many years of unsel-
fish dedication and service to the Paint-
ing and Decorating Industry and to the

LAP&FCA". Terry holds the dis-
tinction of being the only President
of the Chapter during its long and
storied history who was elected to
serve two consecutive terms, 2007-
2008 and 2009-2010.

Currently 384 Paint Apprentices in the Program (317 Commercial and
67 Industrial).
School will be hosting the Paint and Drywall Graduation at Luminaria's
Restaurant in Monterey Park on Friday evening January 7, 2011.
38 Paint (commercial) and 8 Industrial Paint along with 33 drywall
Apprentices will also be graduating.
School currently has two instructors who are accredited by SSPC to
train C-7 (John Chambers and Jeffrey Dollarhide). Another instructor
(Robert Thacker) is in the process of becoming a C-7 (Abrasive Blast-
ing) Instructor.
School hosted training for the California State Building Trades Council
at the Apprenticeship Training Center.
David McLean (Summit Painting - LAP&FCA Vice President) was
appointed to the Apprenticeship Committee. He will join fellow
LAP&FCA members on the committee, Steve Edgar (National Coating
&Lining Co. Chapter President) and Greg Quinn (Chapter Executive
Director).

NEWS FROM APPRENTICESHIP SCHOOL by Jesus Fernandez, Director
Lead Paint RRP Enforcement goes into Effect on January 1, 2011 The U.S. Environmental Protection Agency (EPA) RRP (Renovation, Repair
and Painting) Rule requires Federal "lead painting safety certification" for
remodeling or demolition in homes, schools, and childcare facilities con-
structed in and before 1978. Contractors, or at least one person employed by
a contractor's firm should have either completed the necessary training or be
enrolled in the training by December 31, 2010. Penalties for not complying
with the new law are severe and can be as high as $37,500 per day!
Your Apprenticeship School has offered regularly scheduled RRP training
during the Fall. Please call the school immediately if you have not received
this training as of yet (323-727-2811).
California Council to Amend
Apprenticeship Regulations The California Apprenticeship Council
(CAC)will hold hearings in January
2011 on proposals to amend California
Code of Regulations Title Eight
(8CCR) to clarify the requirements for
apprentice dispatch requests on public
work projects and distinguish between
types of apprentice complaints.
The CAC, which is a branch of the
California Department of Industrial
Relations, has proposed amending sec-
tions in Chapter Two of 8 CCR that
outline investigation and hearing pro-
cedures regarding apprentice com-
plaints. The current regulations do not
distinguish complaints about appren-
ticeship programs from disciplinary
complaints, which makes the "process
of reviewing apprenticeship program
actions cumbersome and time consum-
ing than is beneficial." The CAC also
seeks to provide clarity, consistency
and fairness in the dispatch of appren-
tices to public works contractors, by
clarifying the dispatch request
requirements. Meetings on the propos-
als will be held on January 5th in San
Francisco and January 6th in Los
Angeles.
Gallup Poll Finds 52% of
Americans Approve of Unions Just over half of Americans said they ap-
prove of labor unions, according to a
Gallup poll conducted in August 2010, a
slight increase from last year's figure but
still the second-lowest share in the 74-year
history of the survey.
Last year's figure was the lowest union
approval rate in the history of the poll
question, which Gallup has asked each
year since 1936. At that time, 72% of re-
spondents said they approved of unions,
and peaked at 75% during the 1950's be-
fore declining in the late 1970's and early
1980's. In the years prior to 2009, the fig-
ure hovered around 60% before dropping
below 50% for the first time, Gallup said.
