Supreme Court yesterday afternoonrendered decision in tho "appropria-tions' test case," entitled "In lie Ha-

waiian Star Newspaper Association,Ltd.", appeal from a .decision ot thoAuditor declining to issue a warrantfor paying a printing bill Incurred bythe tax bureau, dismissing the appealwithout prejudice. Deputy AttorneyOenerar E. C. Peters tor appellant;Holmes & Stanley for tho Auditor.

The cause shown for the dismissalof the appeal is that the Treasurer tookthe six months' bill of 1903 as a guidetor supplying deficiencies In appropria-tions for the last eighteen months ofthe two-yea- rs period when he shouldhave gone back to the appropriationbill ot 1901.

Chief Justice Frear writes tho ma- -porlty opinion. Justice Galbralth concurs In the dismissal of the appeal butotherwise disagrees with the majorityopinion. Galbralth's separate opinion

"The Legislature failed at Its reg-ular' session In 1903 to provide for thenecessary expenses of the governmentfor the succeeding biennial period. InIts extra session Immediately after. Itpassed complete appropriation bills forthe first six months of the biennialperiod, and bills providing for a por-tion of the necessary expenses of tholast eighteen months, but failed to pro-vide for perhaps a half of the neces-sary expenses for those eighteenmonths on the supposition that thoseexpenses would be borne by countiesunder an act which turned out to hovoid. "That the expenses so unprovided forcould be paid out of the last appropria-tion bills by the Treasurer with thoadvice of the Governor under section54 ot the Organic Act, and

That 'the last appropriation bills,'within the meaning of that sectionwere those ot 1901 and not tho sixmonths bills of 1903."

"It is not disputed that tho expensesnow In question were 'necessary cur-rent expenses' within the meaning otSection 64 of the Organic Act"

"Whether those officers (Treasurerand Governor) could muko paymentsunder tho last appropriation bills Incase tho Legislature should Intentional-ly omit a single appropriation as unnecessary without first specifically andIndependently repealing at Its regularsession the law, if any, for the execu-tion of which a similar appropriation!had been mado by the preceding Legis-lature, It Is unnecessary to say. Itwill be time enough to decide thatquestion when It arises."
