The Directive

Council Directive 2001/113/EC on fruit jams, jellies, marmalades and sweetened chestnut purée

Lays down a marketing standard:- Product definition (Annex I) - Labelling requirements (Article 2)- Authorised ingredients/Composition(Annex II)

At EU level :Directive Transposition in National legislation (by 2013/2014)

At Codex level :« Draft » Codex standard for jams, jellies and marmalades at Step 8(this standard will supersede individual standards for citrus marmalade CODEX STAN 80-1981 and jams (fruit preserves) and jellies CODEX STAN 68-1981).

The Directive shall apply to the products listed in Annex I:

- Jam- Extra Jam- Jelly- Extra Jelly- Marmalade- Jelly marmalade- Sweetened chestnut purée

in Some cases the directive does not applyExemptions: - products intended for fine bakery wares, pastries or biscuits + products in respect of which sugars have been wholly or partially replaced by sweeteners (eg diet products……

The Scope

- The product names listed in Annex I (jam etc..) shall apply only to the products referred to therein = « reserved terms »

- These names may, however, be used in addition to the name and in accordance with practices used to designate other products which cannot be confused with those defined in Annex I. >> labelling must be clear, show ingredients, no consumer confusion

- The product names shall be supplemented by an indication of the fruit or fruits used, in descending order of weight of the raw materials used. Over three fruits ‘mixed fruit’ label may be used

- The labelling shall indicate the fruit content by including the words ‘prepared with … g of fruit per 100 g’ of the finished product.

- The labelling shall indicate the total sugar content by the words ‘total sugar content … g per 100 g’ of the finished product.

For the products defined in Annex I, Member States shall not adopt national provisions not provided for by this

Directive.

Only the ingredients listed in Annex II and raw materials which comply with Annex III may be used in the manufacture of the products defined in this Directive.

Products defined in Annex I must have a soluble dry matter content of 60 % or more.

Exemptions: Member States may, however, in order to take account of certain particular cases, authorise the reserved names for products defined in Annex I which have a soluble dry matter content of less than 60 %.
