Agenda: The agenda for this meeting was filed with the Office of the Lieutenant Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

Minutes: It was moved by Mr. Konishi, seconded by Mr. Leong, and unanimously

carried to approve the Applications Committee meeting and Executive Session meeting minutes of January 11, 2016, and the Board Meeting and Executive Session meeting minutes of November 20, 2015 as circulated.

Amendments to Agenda: It was moved by Mr. Suehiro, seconded by Mr. Kagawa, and unanimously

carried to approve the following amendments to the agenda: Delete from Appearances: e. Jean-Paul Jette, RME

Chapter 91, HRS, Adjudicatory Matters: Chairperson Akasaki called for a recess from the Board’s meeting at

8:39 a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors’ Licenses of Wide Open

Construction, Inc., and Michael A. Young; CLB 2015-271-L Respondent Wide Open Construction Inc. (“Respondent Wide Open”) and Respondent Michael A. Young (“Respondent Young”) are licensed in the “B” General building classification. RICO alleges five citations as part of Investigation Number 316273366 were issued to Respondent Wide Open by the Hawaii Department of Labor and Industrial Relations’ Occupational Safety and Health Division. The violations alleged were categorized as serious, relating to equipment, machinery, and forklift certification. Information indicates fines were paid in full. If proven at an administrative hearing, the allegations would constitute violations of the following laws:

HRS section 444-17(6) (violation of applicable safety or labor law); and

HRS section 436B-16 (failure to provide written notice of order within thirty days).

Respondents do not admit to violating any law or rule, but agree to pay, jointly and severally, an administrative fine of $500.00.

After discussion, it was moved by Mr. Kamai, seconded by Mr. Leong, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. b. In the Matter of the Contractors’ Licenses of Oahu

Plumbing & Sheet Metal, Ltd., and Norman Koji Tada; CLB 2015-197-L

Respondent Oahu Plumbing & Sheet Metal, Ltd. (“Oahu”) is licensed in the “B” General building classification and specialty classifications; Respondent Norman Koji Tada is licensed in the C-37 and C-52 classifications. In paragraph 2 on page 2 of the Settlement Agreement, it states that Mr. Tada’s license was issued on May 28, 1988. The Board notes that Mr. Tada’s license was issued on May 23, 1988. OAHU entered into a settlement agreement with the State of Hawaii Department of Labor and Industrial Relations on or about August 30, 2013 to resolve two citations relating to safety laws issued to OAHU. Respondent notified the Board of the settlement agreement on or about March 20, 2015. If proven at an administrative hearing, the allegations would constitute violations of the following law:

HRS section 436B-16 (failure to provide written notice of determination within thirty days).

Respondents do not admit to violating any law or rule, but agree to pay an administrative fine, jointly and severally, in the amount of $200.00. After discussion, it was moved by Mr. Konishi, seconded by Mr. Polischeck (with Mr. Kagawa recusing), and carried by the majority to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

c. In the Matter of the Contractors’ License of Halliburton Energy Services, Inc.; CLB 2015-266-L

Halliburton Energy Services Inc. (“Respondent”) was licensed as a General engineering contractor on or about December 6, 1989, and is due to expire or forfeit on September 30, 2016. Respondent disclosed information relating to a September 20, 2013 guilty plea in a United State District Court case, United States of America v. Halliburton Energy Services, Inc. (Case No. 13-165 “H”) to one count of intentionally causing damage to a protected computer by knowingly causing the transmission of a program, information, code or command. If proven at an administrative hearing, the allegations would constitute violations of the following laws:

HRS section 436B-16 (failure to provide judgment, disciplinary sanction, or order within thirty days); and

HRS section 436B-19(14) (criminal conviction, whether by nolo contendere or otherwise, of a penal crime directly related to the qualifications, functions, or duties of the licensed profession or vocation).

Respondent does not admit to violating any law or rule and agrees to pay an administrative fine in the amount of $4,000.00. After discussion, it was moved by Mr. Mochida, seconded by Mr. Suehiro, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders None.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Akasaki announced that the Board was reconvening to its open meeting at 8:43 a.m.

Executive Session: At 8:44 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa, and

Executive Session: At 9:31 a.m., it was moved by Mr. Mochida, seconded by Mr. Kamai, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:38 a.m., it was moved by Mr. Suehiro, seconded by Mr. Konishi, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Mr. Acasio retracted his request to withdraw his application in the C-20

classification, and requested that the Board consider his application in the C-20 classification.

After discussion, it was moved by Mr. Suehiro, seconded by Mr. Polischeck, and unanimously carried to defer Mr. Acasio’s application for licensure in the C-13 and C-20 classifications pending the submittal of separate project lists for each classification verifying four years of broad-based supervisory experience of the means and methods in each classification.

c. Aaron W. Cooledge, RME Jamile’s Plumbing LLC C-37 Plumbing Executive Session: At 9:40 a.m., it was moved by Mr. Kamai, seconded by Mr. Polischeck,

and unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:50 a.m., it was moved by Mr. Matsuzaki, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Kagawa, seconded by

Mr. Matsuzaki, and unanimously carried to defer Mr. Cooledge’s application for licensure in the C-37 classification pending the submittal of additional projects verifying broad-based C-37 experience, including new installations.

d. Geoffrey S. Lewis (Individual)

“B” General Building

Executive Session: At 9:51 a.m., it was moved by Mr. Kagawa, seconded by Mr. Suehiro, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:00 a.m., it was moved by Mr. Polischeck, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Polischeck, seconded by Mr. Leong, and unanimously carried to defer Mr. Lewis’ application for licensure in the “B” classification pending verification of three years of on-site supervisory experience where he directed the labor in the performance of the means and methods required to construct a building. The Board will credit Mr. Lewis with one year of experience for his architecture degree. Mr. Lewis related that he teaches materials and methods at the University of Hawaii and inquired if the Board would consider this in lieu of experience. Mr. Mochida related that the Board is looking for hands-on supervisory experience directing the means and methods from the “ground-up”.

f. James A. Tsuji (Individual) C-31 Masonry C-51 Tile Executive Session: At 10:03 a.m., it was moved by Mr. Polischeck, seconded by Mr. Kagawa,

and unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:10 a.m., it was moved by Mr. Matsuzaki, seconded by Mr. Mochida,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Mr. Tsuji withdrew his application for licensure in the C-31 classification. After discussion, it was moved by Mr. Matsuzaki, seconded by Mr. Kamai,

and unanimously carried to approve Mr. Tsuji’s application for licensure in the C-51 classification and accept the withdrawal of his application in the C-31 classification.

g. W G Construction LLC (Additional classification)

and unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:24 a.m., it was moved by Mr. Suehiro, seconded by Mr. Mochida,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Mr. Guieb withdrew his application for licensure in the C-42 classification. After discussion, it was moved by Mr. Suehiro, seconded by Mr. Kamai,

and unanimously carried to approve Mr. Guieb’s application for licensure in the C-17, C-31, and C-33b classifications pending submittal of

h. Jonathan D. Perry, RME Oahu Tree Works LLC C-27b Tree trimming & removal Executive Session: At 10:26 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kamai, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:49 a.m., it was moved by Mr. Suehiro, seconded by Mr. Konishi,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Polischeck, seconded by

Mr. Mochida, and unanimously carried to waive the $37,000.00 bond requirement based upon the updated financial statements submitted by Mr. Perry today.

Recess: Chairperson Akasaki called for a short recess at 11:14 a.m. The Board meeting reconvened at 11:24 a.m. Executive Session: At 11:25 a.m., it was moved by Mr. Suehiro, seconded by Mr. Mochida,

and unanimously carried to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 12:29 p.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Committee Reports: 1. Examination Committee: Aldon Mochida, Chairperson

The Contractors Examination Summary for December 2015 was distributed to the Board for their information.

2. Recovery/Education Fund Committee:

The Recovery Fund Litigation Report for November 21, 2015 to January 22, 2016 prepared by Ronald Michioka, Esq., the Board’s Recovery Fund Attorney, was distributed to the Board for their information. 3. Legislation Committee: Peter H. M. Lee, Chairperson Mr. Leong presented the Legislation Committee Report. A summary of last year’s legislation, copies of bills, committee reports and prior Board testimony were distributed to the Board for their review and comment. 2015 LEGISLATIVE SESSION MEASURES

H.B. No. 54 – This bill provides that general contractors shall not be issued any specialty classifications unless they take examinations and pay additional fees for each specialty classification applied for. This bill is similar to H.B. No. 78 (2014) and S.B. No. 347 (2013), which the Board opposed because all general contractors automatically hold certain specialty contractors which allow them to perform the broad scope of their work. This bill has a triple committee referral, but no hearings were scheduled in 2015.

H.B. No. 103, H.B. No. 103 H.D. 1 – H.B. 103 raises the “handyman exemption” threshold from $1,000.00 to $5,000.00. This bill is similar to S.B. No. 2707 (2013), which raised the threshold from $1,000.00 to $2,500.00. The Board opposed S.B. No. 2707 (2013) because it will increase the likelihood of consumer harm and contribute to the problem of unlicensed activity.

On February 10, 2015, the House Committee on Economic Development and Business (“EDB”) held a hearing on H.B. No. 103. The Board submitted testimony in opposition based upon its position on similar bills in the past. EDB passed the bill with amendments to reduce the increase in the exemption threshold from $5,000.00 to $2,000.00 and changing the effective date to February 19, 2025. This bill was referred to the House Committee on Consumer Protection and Commerce (“CPC”) on February 18, 2015. CPC did not schedule a hearing for H.B. No. 103 H.D. 1.

H.B. No. 129 / S.B. No. 838 – These bills allow the Board to accept equivalent knowledge, training, or experience, including self-employment and unlicensed experience, in lieu of a specific experience requirement for licensure, if the Board investigates and makes a detailed written finding available for public inspection. This bill is similar to H.B. No. 339 (2013) which the Board opposed because the Board already has the authority to amending our statute to accept equivalent knowledge, training, and experience; and requiring disclosure of detailed information regarding an applicant’s qualifications may violate HRS chapter 92F. In addition, the Board already does take unlicensed activity into account when considering experience for applicants.

S.B. No. 838 – Hearing was not scheduled in 2015. H.B. No. 129 is scheduled for a 10:00 a.m. hearing today with the House Committee on Labor & Public Employment (“LAB”). The Board submitted testimony in opposition of H.B. No. 129. H.B. No. 130 / S.B. No. 839 – These bills prohibit the “A” and “B” general contractors from doing any work it is not licensed in and defines “incidental and supplemental”. These bills are similar to H.B. No. 671 (2013) which the Board strongly opposed because all general contractors automatically hold certain specialty contractors which allow them to perform the broad scope of their work and the Board’s Final Order Upon Remand in the DC 50 case already defines “incidental and supplemental” work.

S.B. No. 839 – Hearing was not scheduled in 2015. H.B. No. 130 is scheduled for a 10:00 a.m. hearing today with the LAB. The Board submitted testimony in opposition of H.B. No. 130.

H.B. No. 131 / S.B. No. 840 – These bills clarify that records that show a licensee’s relevant experience, trade examination results, and adequate bonding are subject to disclosure. On February 4, 2015, the CPC held a hearing on H.B. No. 131. The Board did not submit testimony on this bill, but the Professional and Vocational Licensing Division did submit testimony in opposition. The CPC deferred this bill.

S.B. No. 840 – Hearing was not scheduled.

H.B. No. 307 / H.B. No. 307, H.D. 1 – H.B. No. 307 amends the membership and composition of the Board (four general engineering contractors, two general building contractors, seven specialty contractors, and no public members) and declares that the protection of the public is of the highest priority for the Board. The Board currently has five general contractors, five specialty contractors, and three public members. On February 6, 2015, the LAB held a hearing on H.B. No. 307. The Board submitted testimony in opposition because the proposed amendments would create an imbalance on the board and it repeals all non-contractor/public member positions which is contrary to serving the public’s interest. The LAB amended this measure by:

(1) Removing the proposed character, residency, and domiciliary

qualifications for board members; (2) Clarifying that of the ten contractors in the Board, three shall be

general engineering contractors and two shall be building contractors; (3) Specifying that the non-contractor members shall not:

(a) Hold a valid or expired license to operate as a contractor; (b) Have a close family member who is a licensee; or (c) Hold any financial interest in the business or any licensee of the

Board; and (4) Changing the effective date to July 1, 2115, to encourage further

discussion.

This bill was referred to CPC and no hearing was scheduled. H.B. No. 713, H.D. 1 / S.B. No. 168 – H.B. No. 713 and S.B. No. 168 authorizes the Board to use volunteer investigators. Under the bill, the Board is required to train and deputize volunteers to act as investigators. It increases the fines for violating HRS chapter 444 and also amends HRS section 444-9.5 to require half of all individuals performing electrical or plumbing work to be licensed electricians and plumbers, and the other half to be electrician or plumber apprentices or trainees.

On February 3, 2015, the LAB held a hearing on H.B. No. 713. The Board submitted testimony in opposition because the bill does not clearly state what the volunteers will be investigating; the Board has adjudicatory functions and it is not appropriate for the Board to investigate a case in

which it will be the final decision maker; apprentice or trainee electricians are not licensed or registered with PVLD and would be difficult for RICO to track and enforce; and the mandate that the Board further investigate every applicant places a burden on the Board. The LAB amended this measure by: (1) Authorizing the DLIR, and not the Board, to train and deputize

volunteer investigators for public works projects; (2) Requiring the DLIR to submit status reports to the Legislature; and (3) Appropriating funds from the general fund instead of the Compliance

Resolution Fund and changing the expending agency to the DLIR.

On February 11, 2015, the CPC held a hearing on H.B. No. 713, H.D. 1. The Board did not submit testimony. The CPC amended this measure by mandating DLIR to make rules for specialized investigators (H.B. No. 713, H.D. 2).

S.B. No. 168 - hearing was not scheduled.

H.B. No. 714 / S.B. No. 164 – These bills define “incidental and supplemental” as the lesser of one percent of the total contract or $100,000.00 and prohibits general contractors from performing “incidental and supplemental” work. General contractors are required to engage appropriate specialty contractors to perform “incidental and supplemental” work. This bill is also similar to H.B. No. 671 (2013) which the Board opposed for the reasons given above (see, H.B. No. 130).

On February 11, 2015, the CPC held a hearing on H.B. No. 714. The Board submitted testimony in opposition. The CPC deferred this measure.

S.B. No. 164 - hearing was not scheduled.

H.B. No. 1232 – This bill requires a contractor to pay a subcontractor within ten days after receipt of an invoice by the subcontractor that includes any supporting documents pursuant to the subcontract terms.

On February 11, 2015, the CPC held a hearing on this bill, and the Board submitted testimony that it did not have an opportunity to discuss this bill. The CPC deferred this measure. The Board opposes this bill because the current language in HRS section 444-25 is in line with the regulations for payment to subcontractors on public works projects.

S.B. No. 466 – This bill increases the number of members from 13 to 15 (3 general engineering, 2 general building, 7 specialties, 3 public) and membership requirements (contractor members must be licensed for ten years), and restrictions for the Board (public members cannot be related to or have interest in board members’ businesses).

A hearing was not scheduled. The Board opposes this bill because the composition is unbalanced with more specialty than general contractor members. The requirements for the public members appear to be to avoid conflicts of interest and this is already addressed by The Ethics Commission and HRS chapter 84.

S.B. No. 548 – This bill requires a general building contractor on construction projects involving more than four, rather than two, unrelated building trades or crafts. Allows a specialty contractor to take and execute a construction contract involving two or more crafts or trades without requiring the performance of the work to be incidental and supplemental. The Board voted to oppose this bill last year. A General building contractor license is required for construction requiring three or more unrelated trades.

A hearing was not scheduled.

S.B. No. 1055 – This bill regulates ironworkers in the State by: establishing a board of ironworkers; requiring licensure for master ironworkers and journeyman ironworkers in Hawaii; and setting minimum qualification and continued competency requirements for licensure of ironworkers.

The Ironworkers requested the Legislature introduce a resolution for a sunrise study on a structural steel board.

A hearing was not scheduled. The Board is opposed to this bill because it is unclear and appears to create a structural licensing board that would be similar to the Board of Electricians and Plumbers, however it would also issue contractors’ licenses for C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding classifications. The Board already has jurisdiction over these classifications and it will confusing to have two boards issuing contractor licenses. H.R. No. 54 / S.C.R. No. 166 – Requesting the Auditor to conduct a feasibility study for the creation of a structural licensing board.

At the Board’s March 20, 2015 meeting, Arnold Wong of the Ironworkers Stabilization Fund Local Union 625 stated that they are asking for a study on the licensure of trade people and clarified that the licensure was meant for the individual trade people, not the licensing of contractors.

As written, it appears that the structural licensing board would be similar to the Board of Electricians and Plumbers; however, it would also issue contractors’ licenses for C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding classifications.

The Board believes that the resolutions contain inaccurate statements (e.g., the Contractors License Board is not set up to specifically address the specialized licensing needs and concerns that involve structural steel, and the Board members are not well versed in the requirements to install and erect structural steel). The Board believes that it has the expertise to evaluate the experience of applicants in the structural steel classification and has been licensing contractors in the C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding classifications for decades.

The resolution asks the auditor to suggest amendments to the practice of issuing C-38 Post tensioning, C-41 Reinforcing steel, C-48 Structural steel, and C-56 Welding license classifications. The Board opposes creating different licensing requirements for contractor licenses. All contractor license requirements should be the same. The Board already has jurisdiction over these classifications and the does not want them transferred to a structural board because it will be confusing to have two boards issuing contractors’ licenses.

2016 LEGISLATIVE SESSION MEASURES H.B. No. 1589 - This bill requires builders of one and two family residential dwellings to provide buyers with information on the benefits and costs associated with the installation and maintenance of a residential fire sprinkler system. The Board opposes this bill because it places the responsibility for providing details of the costs associated with the installation and maintenance of a sprinkler system on the contractor. Contractors install the sprinkler systems and engineers design sprinkler systems. Since this requirement pertains to all new dwellings for which permits are required, the Board suggests that the City and County Department of Planning and Permitting provide buyers with the information on the benefits of a residential fire sprinkler systems. If the buyer decides to install a sprinkler system, it should be included in the plans for the residential dwelling. It was moved by Mr. Kamai, seconded by Mr. Suehiro, and unanimously carried to oppose all of the above bills for the reasons stated above. Mr. Wong related that the LAB held a hearing on H.B. No. 129 and H.B. No. 130 today at 10:00 a.m. The LAB passed H.B. No. 129 with amendments and deferred H.B. No. 130. 4. Rules Committee: Tyrus Kagawa, Chairperson
