Chairman Tim Hennessey (R-Chester) recognized the retirement of Republican Executive Director Eric Bugaile and extended his appreciation for his service on the committee.

Minority Chairman Mike Carroll (D-Luzerne) extended his best wishes to Bugaile, highlighting their long relationship working together on transportation issues in state government.

Bugaile stated that he appreciated bipartisan efforts of the committee to address transportation issues in the commonwealth.

HB 317 Rothman, Greg - (PN 297) Amends Title 75 (Vehicles), in penalties and disposition of fines, further providing for surcharge; providing for automated license plate reader (ALPR) systems; imposing penalties; and establishing the ALPR Equipment Fund. the fuel usage is documented only by an electronic monitoring device used in conjunction with an electronically controlled engine. Effective in 60 days. - The bill was unanimously reported as amended.

Rep. Ryan Mackenzie (R-Lehigh) explained the necessity for the legislation, indicating the law is misaligned with use of ready-mix concrete trucks by the industry. He said the legislation allows companies utilizing fuel for the concrete to apply for a rebate.

A01192 by Hennessey, caps the tax refund up to 30 percent of the liquid fuels tax imposed, permits companies to request a greater refund if explanation is provided on why one is necessary, and allows for the department’s discretion in refunds. The amendment was unanimously adopted.

Despite concerns from the Department of Transportation and the Department of Revenue, Minority Chairman Carroll provided his support for the amendment and legislation. “Clearly the intent of the fuel tax was on the usage of vehicles of the road, not at a construction site,” he said.

Chairman Hennessey asked which vehicles are subject to this type of tax rebate. Committee staff indicated that the rebates include farm tractors; volunteer fire, rescue and ambulance service vehicles; motorized recreational vehicles; motorboats and watercraft; aircraft; truck refrigeration units; and agricultural power take-off (PTO) vehicles.

HB 1298 Irvin, Rich - (PN 1518) Act designating a bridge over the Juniata River in Mount Union Borough, Huntingdon County as Captain Joseph S. Giacobello Memorial Bridge. Effective in 60 days. - The bill was unanimously reported as committed.

HB 1335 Gabler, Matt - (PN 1571) Act repealing in part the act of June 13, 1836 (P.L.551, No.169), entitled “An act relating to roads, highways and bridges.” Effective in 60 days. - The bill was unanimously reported as committed.

Rep. Matt Gabler (R-Clearfield) said this legislation repeals the Private Road Act due to the law being outdated, but maintains language supported by mortgage lenders.

HB 1387 Metzgar, Carl - (PN 1691) Act designating a bridge on that portion of State Route 2016 over the Casselman River in Rockwood Borough, Somerset County, as the PFC Alton Glenn Sterner Memorial Bridge. Effective in 60 days. - The bill was unanimously reported as committed.

HB 1035 Sappey, Christina (F) - (PN 1207) Amends the Act entitled “An act authorizing political subdivisions, municipality authorities and transportation authorities to enter into contracts for the purchase of goods and the sale of real and personal property where no bids are received,” further providing for title of the act; adding a short title; and providing for contracts for services. The bill creates a short title as the Public Contract Bid Nonreceipt Act and establishes when a political subdivision, municipality authority or transportation authority is required to advertise for bids in order to enter into a contract for services and no bids are received, the political subdivision, municipality authority or transportation authority may proceed by (1) advertising for bids a second time, (2) initiating negotiations for a contract to obtain the services previously advertised, with

HB 24 Lawrence, John - (PN 341) Amends the Capital Facilities Debt Enabling Act, in capital facilities, further providing for bonds, issue of bonds and notes, maturity and interest. Requires the principal for new issuances of state debt to be repaid in equal amounts over the term of the bond. Provides the legislation shall apply to bonds, including funding bonds, issued on or after July 1, 2019. Effective immediately. - The bill was unanimously reported as adopted.

A00721 by Bradford, delays the effective date until July 1, 2021. The amendment was unanimously adopted.

Rep. John Lawrence (R-Chester) offered his support for the amendment, stating that last year similar legislation was vetoed. He said by moving the effective date a couple of years, the legislation may pass.

HB 671 Heffley, Doyle - (PN 684) Amends Title 3 (Agriculture), in food protection, further providing for definitions, for license required and for powers of department. The bill provides for licensure of mobile retail food facilities, which includes a moveable retail food facility, such as a stand, vehicle, cart, basket, box or similar structure, from which food is stored, prepared, processed, distributed or sold. Effective in 60 days. - The bill was unanimously reported as committed.

Republican Committee Executive Director Kerry Golden provided a brief summary of the legislation.

Rep. Pamela DeLissio (D-Philadelphia) asked if it is possible to be in violation in one jurisdiction and not another. Golden explained that currently they would be violation if they don’t have that jurisdiction’s license, but under this legislation, since the standards are uniform across the state, the mobile retail food facility would only need one license because they all need

to meet the same standards. Rep. Doyle Heffley (R-Carbon), the bill’s prime sponsor, commented that the purpose of the bill is to streamline the licensing and bring some uniformity across the commonwealth.

Rep. David Millard (R-Columbia) pointed out the legislation does not in any way negate the high standards of inspection for food safety. He said the legislation removes an obstacle for “basically mom and pop businesses that are invited to a lot of the fairs and street carnivals across the commonwealth.” Rep. Millard commented, “This is a great piece of legislation.”

The bill establishes that combination of vehicles which is hauling milk to or from a milk plant or to or from a dairy farm, or is traveling to a dairy farm to pick up milk, may be permitted by the department and local authorities to move upon highways within their respective jurisdictions 24 hours a day, seven days a week, and in the event of a declared national, state or local emergency unless it is specifically stated in a proclamation or executive order. Requires that decals issued by the Milk Marketing Board to be placed on any milk truck that is exempted. Effective in 60 days. The bill creates a short title as the Public Contract Bid Nonreceipt Act and establishes when a political subdivision, municipality authority or transportation authority is required to advertise for bids in order to enter into a contract for services and no bids are received, the political subdivision, municipality authority or transportation authority may proceed by (1) advertising for bids a second time, (2) initiating negotiations for a contract to obtain the services previously advertised, with any provider not otherwise disqualified by law or an enactment or policy of the governing body, and (3) at a regular or special meeting of its governing body, must publicly announce the identity of the parties, the proposed contract price and a summary of the other terms and conditions relating to any proposed contract. Also establishes penalties for evasion. Effective in 60 days.
