2. STATEMENT OF INTENTThis official development plan is intended to establish standards forthe development of a 25.386-acre site within the Conifer 285Corridor Master Plan located in Jefferson County, State of Colorado.These standards are intended to create a high quality, residentialdevelopment.
3. PERMITTED USES3.1. USE AREA 1: Residential 10.069 Acres
3.1.1 Maximum density of 101 residential dwelling units.3.1.2 Dwelling units are limited to Single-family Attached
Units (as townhomes). 3.1.3 Accessory Uses: Home Occupation
3.2 USE AREA 2: Open Space 15.317 Acres3.2.1 Uses permitted Use Area 2 include, but are not limited
to: soft surface trails, bicycle trails, pedestrian trails, green spaces areas (maintained areas that may containbenches, play areas, or similar, located on slopes of <20%), native landscaped areas, planted landscape areas, pedestrian amenities, and retaining walls.
3.2.2 No structures, with the exception of a structure, whichis necessary for the purposes of housing irrigation, electrical, wellhead or similar, are permitted in Use Area 2. No landscaping or retaining walls shall occur inareas with slopes of 30% or greater, unless it is absolutely necessary for erosion control measures, safety, or similar.
3.2.3 Ownership and maintenance of open space or green space areas, will be the responsibility of the Association of Conifer Heights Property Owners, or equivalent entity.
3.2.4 Retaining walls and roads are permitted in Use Area 2 (see also note 3.2.2).
4. LOT AND BUILDING STANDARDS4.1 Single-family attached (townhome) Lot; 1,500 s.f. minimum
for each unit.4.2 Building setbacks forth is official development plan shall be:
4.2.1 Primary Structure/Garage Facing Street: Twenty (20) ft.4.2.2 Primary Structure/No Garage Facing Street: Fifteen (15)
ft.4.2.3 Side: Five (5) ft.4.2.4 Rear: Ten (10) ft.4.2.5 Internal property line: zero (0) ft.
4.3 All setbacks to be measured from the foundation or wall; however, eaves, roof overhangs, window wells, and fireplaces may protrude 24” into setbacks.
4.4 Primary residential structures are limited to 35' measured inaccordance to the Jefferson County Land Development Code.Further, building roofs should not break ridgeline nor exceedthe height of the surrounding trees wherever practicable,unless buildings are situated where existing topographicfeatures provide a backdrop for the building. Buildings areencouraged to be stepped up or down following thetopography, in order to minimize visual impacts.
5. PARKING STANDARDS5.1 All parking areas within this official development plan shall
conform to the requirements of Section 13 "Off--street Parking and Loading” of the Jefferson County Zoning Resolution, except as supplemented or modified below.
5.2 All parking spaces shall be located outside of the Open SpaceUse Area 2; however, one (1) parking space may be permittedin the lower green space area only, if access is available through residence driveways or a parking area. Parking must be formalized, monitored and signed accordingly by the HOA.The intention is to prevent parking on streets, and/or to prevent people from making unsightly informal spots that may be subject to erosion.
6. FENCES AND RETAINING WALLS6.1 Fencing throughout the development shall be designed to
allow for the free movement of wildlife. Fencing shall be openstyle, no more than forty-two (42) inches in height unless used for screening purposes around ground-mounted mechanical equipment, or similar. In such instances fencing shall be limited to the area surrounding the item to be screened, no more than six (6) feet in height.6.1.1 Materials used for screening shall compliment or
match the materials used on the residential structures(e.g., stone veneer and wood). Materials used in the
construction of walls or fences should be mountain appropriate.
6.2 Continuous fencing around the perimeter of the planned development boundary shall not be permitted.
6.3 No barbed wire or chain link fencing is permitted.6.4 Screen fencing, coupled with landscape amenities, is required
to screen visually objectionable items such as mechanical equipment.
6.5 Retaining walls developed with this property shall be faced with wood timbers, native rock, introduced rock or masonry units of earth tone colors such as dark tan, dark brown or gray. Lighter tones should be avoided (creme and/or lighter beige tones). Retaining walls shall be complimentary to the architectural character of the development.
6.6 The materials that will be utilized for retaining wall structuresare exposed rock cuts with vegetated soil pockets, heavy wood timbers, hand laid small rock or boulder retaining walls,mechanically placed large boulder retaining wall, or, as color specified above, dark earth-tone, highly-rock textured concrete masonry retaining wall units.
6.7 The horizontal distance between retaining walls shall meet ata minimum the requirements of the Jefferson County Zoning Resolution, providing planting area between multiple, terraced retaining walls, and landscaped with a minimum of six (6) shrubs and one (1) tree per thirty (30) feet of the length(on average) of the series of terraced retaining walls. The intent is to provide for shrubs and trees of sufficient height toaid in the visual relief of large expanses of walls.
6.8 All retaining walls shall have a curvilinear design and avoid right angles in their design.
6.9 All retaining walls shall be subject to applicable Jefferson County regulations and supplements in design with the restrictions noted above.
7. LIGHTING7.1 All lighting within this planned development shall conform to
the lighting section of the Jefferson County Zoning Resolution(specifically, the “Mountainous Areas” requirements within that section), except as supplemented or modified below.
7.2 Pole lights, if utilized, shall be downcast, full cut-off and/or shielded type fixtures, not to exceed twelve (12) feet in height. These pole lights may be utilized in pedestrian walkway areas, private/public roadways and parking areas where necessary for security/safety purposes.
7.3 All lamps shall be fully shielded by baffles extending at least two (2) inches below the bulb or protective lens. Shielding shall be required for lamps with accent entry ways, pathway lighting, bollards, or, other pedestrian or trail circulation.
7.4 Maximum illumination levels resulting from on-site lightingshall not exceed the following as measured on the propertyline: Residential, Active Recreational, Agricultural adjacent tosimilar uses and ROW = maximum illumination level(foot-candles) 0.2; Passive Recreational adjacent to all otheruses and ROW = maximum illumination level (foot-candles)0.1.
7.5 Illuminated signage or illuminated outdoor advertisingdevices are prohibited with the exception of intermittentpedestrian-activated lit crosswalk signage or stop signs.
7.6 Obtrusive canopy lighting and/or up-lighting of trees isprohibited.
7.7 No illuminated flags and/or up-lighting of flags permitted.
8. SIGNS8.1 Signs within this planned development shall be in accordance
with the Jefferson County Zoning Resolution, except as or modified below.8.1.1 No commercial signs, illuminated signs of any material
(see exception 7.5 above), or signs advertising a homeoccupation, are permitted within Conifer Heights. Seealso Prohibited Signs as found in Section 11: Signs inthe Jefferson County Zoning Resolution.
8.2 Signs shall be integrated into the overall design and be of a constant graphic theme consistent with the development. Signs shall utilize earth-tone colors and shall be kept clean and legible at all times.
8.3 Addresses shall be required for each unit and shall be placedon the residence in a location that can be seen from theright-of-way, day or night, preferably in a location that isincidentally lit from downcast exterior lighting of residence.Additional/ancillary ground-level/decorative solar addresssigns are permitted; however, may not replace addressrequired on home.
9. LANDSCAPING/OPEN SPACE REQUIREMENTS9.1 Landscaping within this planned development shall be in
accordance with the Jefferson County Zoning Resolution, except as supplemented or modified below.9.1.1 Any new landscaping must use plants suited for low
water use, which may include plants or grasses thatgo dormant during dry weather. To responsibly usewater, household irrigation systems may besupplemented via harvesting rainwater (rain barrels).
9.1.2 A maximum of two rain barrels with a combinedstorage of 110 gallons or less are allowed for eachhousehold, pursuant to Colorado Law. Rain barrels canonly be installed at multi-family households with four(4) or fewer units. A maximum of two (2) rain barrelscan be used at each household and the combinedstorage of the 2 rain barrels cannot exceed 110 gallons.Rain barrels can only be used to capture rainwaterfrom rooftop downspouts and the captured rainwatermust be used on the same property from which therainwater was captured, for outdoor purposes only.
9.1.3 Rain Barrels are required to be equipped with asealable lid to prevent mosquitos.
9.1.4 Rain barrels are to be completely emptied every month(or less). If you plan to be away from the home formore than 10 days, rain barrels must be disconnectedfrom the downspout.
9.1.5 The Conifer Heights HOA cannot ban the use of rainbarrels by its members; however, it can impose“reasonable” aesthetic requirements about thelocation and/or appearance of rain barrels.
9.2 A minimum of forty two (42) percent of the entire planned development shall be landscaped or preserved in its natural state.
9.3 A minimum of sixty-five (65) percent of trees on the site shallbe evergreen trees and shrubs, in keeping with the mountainenvironment.
9.4 Plant materials shall be selected for their proven hardiness, drought tolerance and ability to withstand snow loading. Useof xeriscape landscaping techniques, including but not limitedto: the use of water conserving plant material, such as nativeand drought tolerant trees and shrubs; rocks and stones for ground cover is required.
9.5 A minimum thirty (30) foot wide landscape buffer shall be installed along the east property line adjacent to US Highway285. Landscaping shall be installed at a density of one (1) treeper sixty (60) linear feet and five (5) shrubs per 2,000 square feet.
9.6 All native landscaping areas shall be designed, installed and maintained to imitate the natural topography and landscaping. The establishment of landscaping will be achieved by a water delivery system to facilitate initial and drought-period irrigation of new landscaping materials (see note 9.1.1).
9.7 The tree preservation standards of the zoning resolution shallbe met in Use Areas 1 and 2. Within use area 2, tree removal shall be allowed only for road construction, utility crossings, drainage improvements, trail construction, or forest management.
9.8 All areas of land of disturbance in the completion of this development shall be restored in compliance with Section 15Land Disturbance of the Jefferson County Zoning Resolution.
9.9 Properties shall be maintained in a safe and neat condition free of trash, weeds, blown sand and debris. Native grass areas shall be periodically addressed to mitigate infestations of noxious weeds. Roads and pavement shall be kept in goodrepair; drainage ditches shall be kept clean and free of noxious weeds, sediment and any obstacles.
9.10 All areas of land of disturbance in the completion of thisdevelopment shall be restored in compliance with Section 15Land Disturbance of the Jefferson County Zoning Resolution.

9.12 HOA shall be responsible for the development andmaintenance of trails throughout the development, includingthe Open Space parcel. Trails should be improved, usingnatural materials only- no paving or concrete unless fordrainage or erosion control purposes. Trails should considerusing pre-existing wildlife trails, topography and any historicpathways instead of clearing new vegetation; disturbanceshould be limited in open space area to the greatest extentpracticable. Trails may be signed; however, no illumination ofsignage is permitted. Trails may be incorporated or connectinto Conifer trail system.
10. ARCHITECTURAL STANDARDS10.1 Architectural standards within this planned development shall
be in accordance with the Jefferson County Zoning Resolution,except as supplemented or modified below.
10.2 No portion of a building facade can exceed thirty--six (36) vertical or horizontal feet without a change surface material and surface plane. The change in the horizontal building facade shall be a minimum of two (2) feet.
10.3 All roofs shall be pitched.10.3.1 Roofing materials are limited to the following
materials: concrete shingle (to mimic wood shake shingle) of a dark earth-toned color, standing seam metal of a dark green, brown or other
mountain-appropriate dark earth tone color, imitationslate of a dark earth tone color, or any recommended FireWise materials similar to the above-mentioned products- provided they are dark earth-toned in color.
10.4 This development shall incorporate mountain appropriate design elements into the buildings, including, but not limited to, exposed heavy timber beams as accent elements or entryfeatures, walls faced with wood, stone, faux stone or culturedstone. Stucco of a dark color may be utilized in small quantities on building facades, but shall be darker earth-tonein color (e.g., dark beige, dark tan, brown, or gray)
10.5 Building materials for residential exteriors shall include at least two (2) types of materials as part of the building facade including, but not limited to: natural stone, rock, sandstone, slate, stucco, or wood- provided they are dark earth-tone in color
11. WATER11.1 All wastewater from the Conifer Heights development shall be
treated at the conifer metropolitan district ln compliance withall applicable and appropriate federal, state, local, and districtrules, regulations, and policies including, but not limited to, those set forth by the conifer metropolitan district; the Colorado department of public health and environment; the Jefferson County Environmental Health Department; and/or the Environmental Protection Agency, at the sole expense of the developer and/or property owners.11.1.1 Return flows of treated wastewater [from the Conifer
Metropolitan District] will be discharged to thefractured ground water system in the NW ¼ SE ¼ ofSection 14, Township 6 South, Range 17 West of the6th P.M.
11.2 All depletions of water from the conifer heights developmentshall be measured and recorded daily using totalizing flow meters. Totalizing flow meters shall be calibrated for accuracyaccording the manufacturer's instructions. total water depletion from this development shall not exceed 0.8 acre-feet per year including irrigation depletions which shall not exceed 0.2 acre-feet per year
11.3 The water supply for the development will be obtained from up to eight wells.11.3.1 The Conifer Ridge Well Nos. 1-8, and any replacement
wells, shall each be equipped with totalizing flow meters. Prior to subdivision of the property describedin Paragraph No. 4, supra, Conifer Ridge, or its successors and assigns, shall monitor and record the volume of water pumped from the Conifer Ridge Well No. 1. The volume of water pumped shall be submitted to Mountain Mutual Reservoir Company (MMRC) on or before November 1 of each year. Uponsubdivision of the subject property, a property ownersassociation, or similar umbrella organization, shall be created, which all purchasers of lots within the subdivision shall be required to join. The instrument creating the property owners association shall requirethat all property owners use the water rights decreed herein only for the decreed uses, except as such waterrights may be changed pursuant to a subsequent watercourt application. Conifer Ridge, or its successors and assigns, shall convey to the property owners association, its rights and obligations under this Decreeand its shares in MMRC. The property owners association shall be responsible for monitoring and recording the volume of water delivered from the Conifer Ridge Well Nos. 1-8 on a monthly basis and reporting total water usage to MMRC at the end of each month. On or before November 1 of each year, the property owners association shall certify in writingto MMRC that water withdrawn from the subject wellshas only been used for the purposes decreed herein. Depletions shall be calculated by multiplying the volume of water pumped from each well by five percent, after subtracting the amount of water used outside of the building(s) being served.
11.4 All water that is used for irrigation shall be separately metered. Eighty percent of the water used for irrigation shallbe assumed to be consumed. in the event that a flow meter malfunctions, it shall be promptly repaired or replaced, but inno event shall the repair or replacement extend beyond forty-five (45) days from the discovery of the malfunction.
11.5 All other findings of fact, conclusions of law, judgment and decree of the Water Court approving underground water rights, a plan for augmentation and exchange right, as found in Case No.: 07 CW 88, of the District Court, Water Division No. 1 of Colorado, shall be applicable to this subdivision, and any future owner.
11.6 Water from each of the wells is decreed for domestic,commercial, irrigation and fire protection purposes.
12. PEDESTRIAN ACCESS12.1. Per the approval of Jefferson County and CDOT, the
developer of Conifer Heights Subdivision at Final Platting willrestripe the Highway 285 overpass with the understandingthat the total overpass width may only accommodate a 5-ft ±
pedestrian walkway depending on the final safety barrierdesign and width required between the travel lane andwalkway.
13. GENERAL REQUIREMENTS13.1 Any human made change to improved or unimproved real
estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations is not permitted within the 100 year flood plain unless a floodplain development permit pursuant to Section 47 of the Jefferson County Zoning Resolution is first obtained.
13.2 All utility lines shall be placed underground.13.3 Prior to the placement, erection or construction of any new
structures, signs, fences, retaining walls etc. on the property,all required permits must be obtained from Jefferson County.
13.4 The existing individual sewage disposal system serving the existing 3-bedroom home must be properly abandoned per the individual sewage disposal system regulation of JeffersonCounty.
