PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION The recommendations are necessary in order to comply with the provisions of the Political Reform Act of 1974. In accordance with the Act, the Board of Supervisors must approve a Conflict of Interest and Disclosure Code for each local government agency for which the Board of Supervisors is the code reviewing body. Pursuant to Government Code Section 87300, every agency must adopt and promulgate a Conflict of Interest and Disclosure Code that, as the code reviewing body for Los Angeles County, the Board of Supervisors must approve before the code can then take effect. In addition, pursuant to Government Code Section 87306, agencies are required to amend their Conflict of Interest Codes when such amendments are necessitated by changed circumstances.

Approve the Conflict of Interest and Disclosure Codes listed on Attachment I, to be effective the day following your Board’s approval.

PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION The recommendations are necessary in order to comply with the provisions of the Political Reform Act of 1974. In accordance with the Act, the Board of Supervisors must approve a Conflict of Interest and Disclosure Code for each local government agency for which the Board of Supervisors is the code reviewing body. Pursuant to Government Code Section 87300, every agency must adopt and promulgate a Conflict of Interest and Disclosure Code that, as the code reviewing body for Los Angeles County, the Board of Supervisors must approve before the code can then take effect. In addition, pursuant to Government Code Section 87306, agencies are required to amend their Conflict of Interest Codes when such amendments are necessitated by changed circumstances.

The proposed amendments to these Conflict of Interest and Disclosure Codes have been thoroughly reviewed and approved by the code review staff in accordance with the procedures established by your Board. FISCAL IMPACT/FINANCING Local governmental agencies must have a Conflict of Interest and Disclosure Code in which designated employees are required to disclose financial interests at a level appropriate to their decision-making authority. These employees make or participate in the making of decisions that may have a foreseeable material effect on a financial interest. Adoption of a Conflict of Interest and Disclosure Code deters potential conflicts of interest, thereby averting misuse of public funds. The recommended action has no effect on budget revenues and expenditures. FACTS AND PROVISIONS/LEGAL REQUIREMENTS The code review staff recommends that your Board approve the newly adopted Conflict of Interest and Disclosure Codes for the department/agencies listed below, pursuant to Government Code Section 87300. Acton-Agua Dulce Unified School District

• Expands the disclosure of the School Board Members.

• Deletes an obsolete disclosure category from the code. Agoura Hills/Calabasas Community Center

• This new agency adopted 2 Cal. Code of Regulations, Section 18730 as its Conflict of Interest and Disclosure Code.

• Deletes an obsolete disclosure category from the code. California Cities for Self Reliance Joint Powers Authority

• This is a newly formed joint powers authority. The authority has incorporated by reference Regulation 18730 and it constitutes their conflict of interest code.

• The authority has designated the following positions as code filers: Members of the Board of Directors; Alternate Members Board of Directors; Executive Director and General Counsel.

Department of the Board of Supervisors

• Adds the positions of Administrative Services Manager I; Senior Secretary V; and Departmental Personnel Technician (Temporary Services Contracts) to the code.

• Deletes Senior Board Specialist (Temporary Services Contracts) from the code.

CONFLICT OF INTEREST AND DISCLOSURE CODE

SECTION 100. The Action-Agua Dulce Unified School District of the County of Los Angeles hereby adopts this Conflict of Interest and Disclosure Code. The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this code shall be interpreted in a manner consistent therewith. SECTION 200. Designated Positions. The positions listed on Exhibit "B" are designated positions. Persons holding those positions are deemed to participate in the making of decisions which may foreseeably have a material effect on a financial interest. SECTION 300. Economic Disclosure Statements. Designated positions are assigned to one or more of the disclosure categories set forth on Exhibit "A". Each person holding a designated position shall file a statement disclosing his/her interest in investments, business positions, real property, and income, designated as reportable under the category to which his/her position is assigned on Exhibit "B". SECTION 400. Place and Time of Filing. A Persons holding designated positions in an agency which is adopting a code for the

first time shall file an initial statement within 30 days after the effective date of the code. Persons holding designated positions which are added to the agency's code shall file an initial statement within 30 days after the effective date of the code.

B Persons appointed, promoted, or transferred to designated positions shall file an

assuming office statement with the agency within 30 days after assuming the position. C Annual statements shall be filed with the agency by April 1st by all persons holding

designated positions. Such statements shall cover the period of the preceding calendar year or from the date of the last statement filed.

D Leaving office statements shall be filed with the agency within 30 days of leaving a

designated position. Such statements shall cover the period from the closing date of the last statement filed to the date of leaving the position.

E An individual who resigns a designated position within 12 months following initial

appointment or within 30 days of the date of a notice mailed by the filing officer of the

individual's filing obligation, whichever is earlier, is not deemed to assume or leave

office, provided that during the period between appointment and resignation, the individual does not make, participate in making, or use the position to influence any decision of the agency, or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position. Within 30 days of the date of a notice mailed by the filing officer, the individual shall do both of the following:

(1) File a written resignation with the appointing power. (2) File a written statement with the filing officer on a form prescribed by the Board

of Supervisors and signed under the penalty of perjury stating that the individual, during the period between appointment and resignation, did not make, participate in the making, or use the position to influence any decision of the agency or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position.

SECTION 500. Contents of Economic Disclosure Statements. Statements shall be made on forms supplied by the Agency, and shall contain the following information. A When an investment, or an interest in real property, is required to be reported, the

statement shall contain: (1) A statement of the nature of the investment or interest; (2) The name of the business entity in which each investment is held, and a

general description of the business activity in which the business is engaged;

(3) The address or other precise location and the use of the real property;

(4) A statement whether the fair market value of the investment or interest in real property equals or exceeds one thousand dollars ($1,000) but does not exceed ten thousand dollars ($10,000), whether it exceeds ten thousand dollars ($10,000) but does not exceed one hundred thousand dollars ($100,000), or whether it exceeds one hundred thousand dollars ($100,000);

(5) If any otherwise reportable investment or interest in real property was partially

or wholly acquired or disposed of during the period covered by the statement, the date of acquisition or disposal shall be reported.

B When income is required to be reported, the statement shall contain: (1) The name and address of each source of income aggregating two hundred fifty

dollars ($250) or more in value, of fifty dollars ($50) or more in value if the income was a gift, and a general description of the business activity, if any, of each source;

(2) A statement whether the aggregate value of income from each source, or in the

case of a loan, the highest amount owed to each source, was at least two hundred fifty dollars ($250) but did not exceed one thousand dollars ($1,000), whether it was in excess of one thousand dollars ($1,000) but not greater than ten thousand dollars ($10,000), or whether it was greater than ten thousand dollars ($10,000);

(3) A description of the consideration, if any, for which the income was received; (4) In the case of a gift, the amount or value and the date on which the gift was

received and the name, address, and business activity, if any, of the intermediary or agent and the actual donor;

(5) In case of a loan, the annual interest rate and the security, if any, given for the

loan; (6) The first report filed by a person holding a designated position shall disclose

any reportable investments, interests in real property, business positions, and income received during the previous 12 months.

C When the filer's pro rata share of income to a business entity, including income to a

sole proprietorship, is required to be reported, the statement shall contain: (1) The name, address, and a general description of the business activity of the

business entity; (2) The name of every person from whom the business entity received payments if

the filer's pro rata share of gross receipts from such persons was equal to or greater than ten thousand dollars ($10,000) during a calendar year.

D When business positions are required to be reported, the statement shall contain: (1) The name, address, and a general description of the business entity; (2) The filer's job title or position;

(3) A statement whether the position was held throughout the entire reporting period and the dates the position was commenced or terminated, if not held during the entire reporting period.

SECTION 600. Disqualification. Persons holding designated positions shall disqualify themselves from making or participating in the making or in any way attempting to use their official position to influence a governmental decision when it is reasonably foreseeable that the decision will have a material financial effect, distinguishable from its effect on the public generally, on: A Any reportable investment or interest in real property; B Any reportable source of income, other than loans by a commercial lending institution

in the regular course of business, aggregating two hundred fifty dollars ($250) or more in value received within twelve months prior to the time the decision is made;

C Any business entity in which the person holding a designated position is a director,

officer, partner, trustee, employee, or holds any position of management. SECTION 700. Adoption by Incorporation. Adoption by incorporation by reference of the terms of this code along with the designation of employees and the formulation of disclosure categories in the Exhibits referred to above constitute the adoption and promulgation of a Conflict of Interest and Disclosure Code.

EXHIBIT "A" CATEGORY 1 Persons in this category shall disclose all interest in real property within the jurisdiction. Real property shall be deemed to be within the jurisdiction if the property or any part of it is located within or not more than two miles outside the boundaries of the jurisdiction or within two miles of any land owned or used by the agency. Persons are not required to disclose property used primarily as their residence or for personal recreational purposes. CATEGORY 2 Persons in this category shall disclose all investments and business positions. The Political Reform Act defines investment as follows:

"Investment" means any financial interest in or security issued by a business entity, including but not limited to common stock, preferred stock, rights warrants options, debt instruments and any partnership or other ownership interest, if the business entity or any parent, subsidiary or otherwise related business within the jurisdiction at any time during the two years prior to the time any statement or other action is required under this title. No asset shall be deemed an investment unless its fair market value equals or exceeds one thousands dollars ($1,000). The term "investment" does not include a time or demand deposit in a financial institution, shares in a credit union, any insurance policy, interest in a diversified mutual fund registered with the Securities and Exchange Commission under the Investment Company Act of 1940 or a common trust fund which is created pursuant to Section 1564 of the Financial Code, or any bond other debt instrument issued by any government or government agency. Investments of an individual include pro rata share of investments of any business entity mutual fund or trust in which the individual or spouse owns directly, indirectly or beneficially, a 10 percent interest or greater.

According to the Political Reform Act, a business position is a position of director, officer, partner, trustee, employee, or any position of management in any organization or enterprise operated for profit, including but not limited to a proprietorship, partnership, firm, business trust, joint venture, syndicate, corporation or association.

CATEGORY 3 Person in this category shall disclose all income and business positions. The Political Reform Act defines income as follows:

"Income" means a payment received, including but not limited to any salary, wage, advance, dividend, interest, rent, proceeds from any sale, gift, including any gift of food or beverage, loan forgiveness or payment of indebtedness received by filer, reimbursement for expenses, per diem, or contribution to an insurance or pension program paid by any person other than an employer, and including any community property interest in the income of a spouse. Income also includes any outstanding loans. Incomes of an individual also includes a pro rata share of any business entity or trust in which the individual or spouse owns, directly, indirectly or beneficially, a 10 percent interest or greater.

CATEGORY 4 Person in this category shall disclose all business positions, investments in, or income (including gifts and loans) received from business entities that manufacture, provide or sell service and/or supplies of a type utilized by the agency and associated with the job assignment of designated positions assigned this disclose category. CATEGORY 6 Individuals who perform under contact the duties of any designated position shall be required to file Statements of Economic Interests disclosing reportable interest in the categories assigned to that designated position. In addition, individual who, under contract, participate in decisions which affect financial interests by proving information advice, recommendation or counsel to the agency which could affect financial interest shall be required to file Statements of Economic Interests, unless they fall within the Political Reform Act's exceptions to the definition of consultant. The level of disclosure shall be as determined by the executive officer (or head) of the agency.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE AGOURA HILLS/CALABASAS COMMUNITY

CENTER JOINT POWERS AUTHORITY ADOPTING A CONFLICT OF INTEREST CODE WHICH

INCORPORATES BY REFERENCE THE STANDARD CONFLICT OF INTEREST CODE PREPARED BY THE

FAIR POLITICAL PRACTICES COMMISSION THE BOARD OF DIRECTORS OF THE AGOURA HILLS/CALABASAS COMMUNITY CENTER JOINT POWERS AUTHORITY HEREBY RESOLVES AS FOLLOWS: WHEREAS, the Political Reform Act, Government Code Section 81000, et seq., requires the Authority to adopt a conflict of interest code for the Authority. WHEREAS, the Fair Political Practices Commission has adopted a Model Conflict of Interest Code (“the Model Code”). The Model Code, codified at 2 Cal. Code of Regulations section 18730, can be incorporated by reference by the Authority as its conflict of interest code. That Model Code will be amended by the Fair Political Practices Commission from time to time to conform to amendments to the Political Reform Act. NOW, THEREFORE, BE IT RESOLVED THAT the standard Conflict of Interest Code adopted by the Fair Political Practices Commission, attached hereto as “Exhibit A,” and “Appendices A and B” thereto, which set forth the designated positions and the disclosure categories for each Authority officer or employee, are herein incorporated by reference and shall constitute the Conflict of Interest Code for the Authority. Incorporation of FPPC Regulation 18730 (2 California Code of

Regulations, Section 18730) by Reference The Political Reform Act (Government Code Section 81000, et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes. The Fair Political Practices Commission has adopted a regulation (2 Cal. Code of Regs. 18730), which contains the terms of a standard conflict of interest code. After public notice and hearing, it may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act. Therefore, the terms of 2 California Code of Regulations Section 18730, and any amendments to it duly adopted by the Fair Political Practices Commission, are hereby incorporated into the conflict of interest code of this agency by reference. This regulation and the attached Appendices (or Exhibits) designating officials and employees and establishing economic disclosure categories shall constitute the conflict of interest code of this agency.

Place of Filing of Statements of Economic Interests All officials and employees required to submit a statement of economic interests shall file their statements with the agency head, or his or her designee. The agency shall make and retain a copy of all statements filed by its Board Members, Governing Board Members, Alternate Board Members, as appropriate, and its agency head (Agency/Department Head, Executive Officer or Chief Executive Officer, Superintendent, or Director), and forward the originals of such statement to the Executive Office of the Board of Supervisors of Los Angeles County. The agency shall retain the originals of statements for all other Designated Positions named in the agency’s conflict of interest code. Exhibit “A” Disclosure Categories

1. All reportable investments and business positions. An asset is deemed to be

“investments”: only if its fair market value equals or exceeds $1,000. The term “investment” does not include bank accounts, interests in mutual funds, money market funds, or insurance policies, or governments bonds or securities. A reportable business position is the position of director, officer, partner, trustee, employee or any position of management in any organization or enterprise operated for profit, including, but not limited to, a proprietorship, partnership, firm, business trust, joint venture, syndicate corporation or association.

2. All reportable income and sources of income including, without limitation, loans,

gifts and travel gifts. The term “income” generally includes earned income such as salary or wages; gifts; reimbursements of expenses; proceeds from sales, regardless of whether a profit was made; certain loans or forgiveness of loans or indebtedness; contributions to a pension or insurance program by someone other than an employer; the filer’s community property interest in his or her spouse’s income; a pro rata share of any business entity or trust in which the filer or spouse owns, directly or indirectly or beneficially a 10 percent interest or greater.

3. All reportable interests in real property within the jurisdiction. Real property is

CONFLICT OF INTEREST AND DISCLOSURE CODE SECTION 100. The Bellflower Unified School District of the County of Los Angeles hereby adopts this Conflict of Interest and Disclosure Code. The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this code shall be interpreted in a manner consistent therewith. SECTION 200. Designated Positions. The positions listed on Exhibit "B" are designated positions. Persons holding those positions are deemed to participate in the making of decisions which may foreseeably have a material effect on a financial interest. SECTION 300. Economic Disclosure Statements. Designated positions are assigned to one or more of the disclosure categories set forth on Exhibit "A". SECTION 500. Contents of Economic Disclosure Statements. Statements shall be made on forms supplied by the Agency, and shall contain the following information. A When an investment, or an interest in real property, is required to be reported, the statement

(2) The name of the business entity in which each investment is held, and a general description of the business activity in which the business is engaged;

C When the filer's pro rata share of income to a business entity, including income to a sole

proprietorship, is required to be reported, the statement shall contain:

(1) The name, address, and a general description of the business activity of the business entity;

(2) The name of every person from whom the business entity received payments if the

filer's pro rata share of gross receipts from such persons was equal to or greater than ten thousand dollars ($10,000) during a calendar year.

D When business positions are required to be reported, the statement shall contain:

(1) The name, address, and a general description of the business entity;

(2) The filer's job title or position;

(3) A statement whether the position was held throughout the entire reporting period and the dates the position was commenced or terminated, if not held during the entire reporting period.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CALIFORNIA CITIES FOR SELF RELIANCE JOINT POWERS AUTHORITY

ADOPTING A CONFLICT OF INTEREST CODE.

WHEREAS, the California Cities for Self Reliance Joint Powers Authority (hereafter called “Authority”) was formed on July 11, 2001 and the Authority filed a “Notice of a Joint Powers Agreement” pursuant to Government Code Section 6503.5 with the Secretary of State within 30 days of its formation;

WHEREAS, the Authority is governed by a Board of Directors that has appointed an Executive Director, a Treasurer and a General Counsel;

WHEREAS, the Board of Directors of the Authority is required to adopt and

promulgate a conflict of interest code by Government Code Section 87300, which code shall have the force of law and any violation thereof by a designated employee shall be deemed a violation of Chapter 7 of Title 9 of the Government Code;

WHEREAS, no Conflict of Interest Code shall be effective until it has been

approved by the code reviewing body, which is the Los Angeles County Board of Supervisors;

WHEREAS, the Fair Political Practices Commission has adopted Section 18730

(2 Cal. Code of Regs.) that contains terms of a standard conflict of interest code and that can be incorporated by reference by public entities;

WHEREAS, the Board of Directors of the Authority and the employees of the Authority have received and considered the provisions of the conflicts of interest code;

NOW, THEREFORE, the Board of Directors of the California Cities for Self Reliance Joint Powers Authority hereby establishes the following regulations:

The Board of Directors may adopt a resolution amending the disclosure categories set forth herein as may become necessary from time to time. 1.14.4. Filing of Statements of Economic Interest. All officials and employees required to submit a statement of economic interests shall file their statements with the agency’s General Counsel who is hereby designated as the filing officer. Incorporation of FPPC Regulation 18730 (2 California Code of

Regulations, Section 18730) by Reference The Political Reform Act (Government Code Section 81000, et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes. The Fair Political Practices Commission has adopted a regulation (2 Cal. Code of Regs. 18730), which contains the terms of a standard conflict of interest code. After public notice and hearing, it may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act. Incorporation of FPPC Regulation 18730 (2 California Code of

Regulations, Section 18730) by Reference The Political Reform Act (Government Code Section 81000, et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes. The Fair Political Practices Commission has adopted a regulation (2 Cal. Code of Regs. 18730), which contains the terms of a standard conflict of interest code. After public notice and hearing, it may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act. Therefore, the terms of 2 California Code of Regulations Section 18730, and any amendments to it duly adopted by the Fair Political Practices Commission, are hereby incorporated into the conflict of interest code of this agency by reference. This regulation and the attached Appendices (or Exhibits) designating officials and employees and establishing economic disclosure categories shall constitute the conflict of interest code of this agency.

Place of Filing of Statements of Economic Interests All officials and employees required to submit a statement of economic interests shall file their statements with the agency head, or his or her designee. CONFLICT OF INTEREST AND DISCLOSURE CODE SECTION 100. The Gorman School District of the County of Los Angeles hereby adopts this Conflict of Interest and Disclosure Code. The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this code shall be interpreted in a manner consistent therewith. SECTION 200. Designated Positions. The positions listed on Exhibit "B" are designated positions. Persons holding those positions are deemed to participate in the making of decisions which may foreseeably have a material effect on a financial interest. SECTION 300. Economic Disclosure Statements. Designated positions are assigned to one or more of the disclosure categories set forth on Exhibit "A". Each person holding a designated position shall file a statement disclosing his/her interest in investments, business positions, real property, and income, designated as reportable under the category to which his/her position is assigned on Exhibit "B". SECTION 400. Place and Time of Filing. A Persons holding designated positions in an agency which is adopting a code for the first

time shall file an initial statement within 30 days after the effective date of the code. Persons holding designated positions which are added to the agency's code shall file an initial statement within 30 days after the effective date of the code.

B Persons appointed, promoted, or transferred to designated positions shall file an assuming

office statement with the agency within 30 days after assuming the position. C Annual statements shall be filed with the agency by April 1st by all persons holding

designated positions. Such statements shall cover the period of the preceding calendar year or from the date of the last statement filed.

D Leaving office statements shall be filed with the agency within 30 days of leaving a

designated position. Such statements shall cover the period from the closing date of the last statement filed to the date of leaving the position.

CONFLICT OF INTEREST AND DISCLOSURE CODE E An individual who resigns a designated position within 12 months following initial

appointment or within 30 days of the date of a notice mailed by the filing officer of the individual's filing obligation, whichever is earlier, is not deemed to assume or leave office, provided that during the period between appointment and resignation, the individual does not make, participate in making, or use the position to influence any decision of the agency, or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position. Within 30 days of the date of a notice mailed by the filing officer, the individual shall do both of the following:

(1) File a written resignation with the appointing power. (2) File a written statement with the filing officer on a form prescribed by the Board

of Supervisors and signed under the penalty of perjury stating that the individual, during the period between appointment and resignation, did not make, participate in the making, or use the position to influence any decision of the agency or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position.

SECTION 500. Contents of Economic Disclosure Statements. Statements shall be made on forms supplied by the Agency, and shall contain the following information. A When an investment, or an interest in real property, is required to be reported, the statement

shall contain: (1) A statement of the nature of the investment or interest; (2) The name of the business entity in which each investment is held, and a

general description of the business activity in which the business is engaged; (3) The address or other precise location and the use of the real property; (4) A statement whether the fair market value of the investment or interest in real

property equals or exceeds one thousand dollars ($1,000) but does not exceed ten thousand dollars ($10,000), whether it exceeds ten thousand dollars ($10,000) but does not exceed one hundred thousand dollars ($100,000), or whether it exceeds one hundred thousand dollars ($100,000);

(5) If any otherwise reportable investment or interest in real property was partially

or wholly acquired or disposed of during the period covered by the statement, the date of acquisition or disposal shall be reported.

dollars ($250) or more in value, of fifty dollars ($50) or more in value if the income was a gift, and a general description of the business activity, if any, of each source;

(2) A statement whether the aggregate value of income from each source, or in the

case of a loan, the highest amount owed to each source, was at least two hundred fifty dollars ($250) but did not exceed one thousand dollars ($1,000), whether it was in excess of one thousand dollars ($1,000) but not greater than ten thousand dollars ($10,000), or whether it was greater than ten thousand dollars ($10,000);

(3) A description of the consideration, if any, for which the income was received; (4) In the case of a gift, the amount or value and the date on which the gift was

received and the name, address, and business activity, if any, of the intermediary or agent and the actual donor;

(5) In case of a loan, the annual interest rate and the security, if any, given for the

loan; (6) The first report filed by a person holding a designated position shall disclose

any reportable investments, interests in real property, business positions, and income received during the previous 12 months.

C When the filer's pro rata share of income to a business entity, including income to a sole

proprietorship, is required to be reported, the statement shall contain: (1) The name, address, and a general description of the business activity of the

business entity; (2) The name of every person from whom the business entity received payments if

the filer's pro rata share of gross receipts from such persons was equal to or greater than ten thousand dollars ($10,000) during a calendar year.

SECTION 600. Disqualification. Persons holding designated positions shall disqualify themselves from making or participating in the making or in any way attempting to use their official position to influence a governmental decision when it is reasonably foreseeable that the decision will have a material financial effect, distinguishable from its effect on the public generally, on: A Any reportable investment or interest in real property; B Any reportable source of income, other than loans by a commercial lending institution in the

regular course of business, aggregating two hundred fifty dollars ($250) or more in value received within twelve months prior to the time the decision is made;

C Any business entity in which the person holding a designated position is a director, officer,

partner, trustee, employee, or holds any position of management. SECTION 700. Adoption by Incorporation. CONFLICT OF INTEREST AND DISCLOSURE CODE SECTION 100. The Southeast Area Social Services Funding Authority (SASSFA) of the County of Los Angeles hereby adopts this Conflict of Interest and Disclosure Code. The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this code shall be interpreted in a manner consistent therewith. SECTION 200. Designated Positions. The positions listed on Exhibit "B" are designated positions. Persons holding those positions are deemed to participate in the making of decisions which may foreseeably have a material effect on a financial interest. SECTION 300. Economic Disclosure Statements. Designated positions are assigned to one or more of the disclosure categories set forth on Exhibit "A". Each person holding a designated position shall file a statement disclosing his/her interest in investments, business positions, real property, and income, designated as reportable under the category to which his/her position is assigned on Exhibit "B". SECTION 400. Place and Time of Filing. A Persons holding designated positions in an agency which is adopting a code for the first

time shall file an initial statement within 30 days after the effective date of the code. Persons holding designated positions which are added to the agency's code shall file an initial statement within 30 days after the effective date of the code.

Within 30 days of the date of a notice mailed by the filing officer, the individual shall do both of the following:

(1) File a written resignation with the appointing power. (2) File a written statement with the filing officer on a form prescribed by the Board

of Supervisors and signed under the penalty of perjury stating that the individual, during the period between appointment and resignation, did not make, participate in the making, or use the position to influence any decision of the agency or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position.

business entity; (2) The name of every person from whom the business entity received payments if

the filer's pro rata share of gross receipts from such persons was equal to or greater than ten thousand dollars ($10,000) during a calendar year.

EXHIBIT "A" CATEGORY 1 Persons in this category shall disclose all interest in real property within the jurisdiction. Real property shall be deemed to be within the jurisdiction if the property or any part of it is located within or not more than two miles outside the boundaries of the jurisdiction or within two miles of any land owned or used by the agency. Persons are not required to disclose property used primarily as their residence or for personal recreational purposes. CATEGORY 2 Persons in this category shall disclose all investments and business positions. The Political Reform Act defines investment as follows:

"Investment" means any financial interest in or security issued by a business entity, including but not limited to common stock, preferred stock, rights, warrants, options, debt instruments, and any partnership or other ownership interest, if the business entity or any parent, subsidiary or otherwise related business within the jurisdiction at any time during the two years prior to the time any statement or other action is required under this title. Bylaws of the Board E (1) 9270(a) Purpose (Section 100) The Temple City Unified School District of the County of Los Angeles hereby adopts the following Conflict of Interest and Disclosure Code. The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this code shall be interpreted in a manner consistent therewith. Designated Positions (Section 200) The positions listed below are designated positions. Persons holding those positions are deemed to participate in the making of decisions, which may foreseeably have a material effect on a financial interest. Category(ies)

Economic Disclosure Statements (Section 300) Designated positions are assigned to one or more of the disclosure categories set forth on Exhibit “A”. Each person holding a designated position shall file a statement disclosing his/her interest in investments, business positions, real property, and income, designated as reportable under the category to which his/her position is assigned. Place and Time of Filing (Section 400) 1. A person holding a designated position shall file the statement with the agency

within 30 days after the effective date of this Code.

CONFLICT OF INTEREST (continued) E (1) 9270(b) 2. Persons appointed, promoted, or transferred to designated positions shall file an

initial statement with the agency within 30 days after assuming the position. 3. Annual statements shall be filed with the agency by April 1st by all persons

holding designated positions. Such statements shall cover the period of the preceding calendar year or from date of the initial statement.

4. Leaving office statements shall be filed with the agency within 30 days of leaving

a designated position. Such statements shall cover the period from the closing date of the last statement filed to the date of leaving the position.

5. Any person who resigns within 12 months of initial appointment, or within 30 days of the date of notice provided by the filing officer to file an assuming office statement, is not deemed to have assumed office or left office, provided he or

she did not make or participate in the making of, or use his or her position to influence any decision and did not receive or become entitled to receive any form

of payment as a result of his or her appointment. Such persons shall not file either an assuming or leaving office statement.

(A) Any person who resigns a position within 30 days of the date of a notice from the filing officer shall do both of the following:

(1) File a written resignation with the appointing power; and (2) File a written statement with the filing officer declaring under penalty of

perjury that during the period between appointment and resignation he or she did not make, participate in the making, or use the position to influence any decision of the agency or receive, or become entitled to receive, any form of payment by virtue of being appointed to the position.

Contents of Economic Disclosure Statements (Section 500) Statements shall be made on forms supplied by the Temple City Unified School District and shall contain the following information: 1. When an investment, or a interest in real property, is required to be reported, the

statement shall contain:

a. A statement of the nature of the investment or interest;

b. The name of the business entity in which each investment is held, and a general description of the business activity in which the business is engaged;

c. The address or other precise location and the use of the real property;

d. A statement whether the fair market value of the investment, or interest in real property, equals or exceeds $1,000 but does not exceed $10,000, whether it exceeds $10,000 but not exceed $100,000 or whether it exceeds $100,000.

e. If any otherwise reportable investment or interest in real property was

partially or wholly acquired or disposed of during the period covered by the statement, the date of acquisition or disposal shall be reported.

2. When income is required to be reported, the statement shall contain:

a. The name and address of each source of income aggregating $250 or more in value, or $50 or more in value if the income was a gift, and a general description of the business activity, if any, of each source;

b. A statement whether the aggregate value of income from each sources or

in the case of a loan, the highest amount owned to each source was at least $250 but did not exceed $1000, whether it was in excess of $1000 but not greater than $10,000 or whether it was greater than $10,000;

c. A description of the consideration, if any, for which the income was

received;

d. In the case of a gift, the amount or value and the date on which the gift was received and the name, address, and business activity, if any, of the intermediary or agent and the actual donor;

e. In case of a loan, the annual interest rate and the security, if any given for

the loan; f. The first report filed by a person appointed to a designated position shall

disclose any reportable investments, interests in real property, business positions, and income received during the previous 12 months.

3. When the filer’s pro rata share of income to a business entity, including income to a sole proprietorship, is required to be reported, the statement shall contain:

a. The name, address, and a general description of the business activity of

the business entity; b. The name of every person from whom the business entity received

payments if the filer’s pro rata share of gross receipts from such persons was equal to or greater than $10,000 during a calendar year.

4. When business positions are required to be reported the statement shall contain:

a. The name, address, and a general description of the business activity of the business entity;

b. The filer’s job title or position; c. A statement whether the position was held throughout the entire reporting

period and the dates the position was commenced or terminated, if not held during the entire reporting period.

Disqualification (Section 600) Persons holding designated positions shall disqualify themselves from making or participating in the making or in any way attempting to use their official position to influence a governmental decision when it is reasonably foreseeable that the decision will have a material financial effect, distinguishable from its effect on the public generally, on: 1. Any reportable investment or interest in real property. 2. Any reportable source of income, other than loans by a commercial lending

institution in the regular course of business, aggregating $250 or more in value received within 12 months prior to the time the decision is made;

3. Any business entity in which the person holding a designated position is a

director, officer, partner, trustee, employee, or holds any position of management.

Exhibit “A” Disclosure Categories CATEGORY 1 Persons in this category shall disclose all interest in real property within the jurisdiction. Real property shall be deemed to be within the jurisdiction if the property or any part of it is located within or not more than two miles outside the boundaries of the jurisdiction or within two miles of any land owned or used by the local government agency. Person shall not be required to disclose property used primarily as their residence or for personal recreational purposes. CATEGORY 2 Persons in this category shall disclose all investments and business positions. “Investment” means any financial interest in or security issued by a business entity, including but not limited to common stock, preferred stock, rights, warrants, options, debt instruments and any partnership or other ownership interest, if the business entity or any parent, subsidiary or otherwise related business entity has an interest in real property in the jurisdiction, or does business or plans to do business in the jurisdiction, or has done business within the jurisdiction at any time during the two years prior to the time any statement or other action is required under this title. No asset shall be deemed an investment unless its fair market value equal or exceeds $1000. The term “investment” does not include a time or demand deposit in a financial institution, shares in a credit union, any insurance policy, interest in a diversified mutual fund registered with the Securities and Exchange Commission under the Investment Company Act of 1940 or a common trust fund which is created pursuant to Section 1564 of the Financial Code or any bond or other debt instrument issued by any government or government agency. Investments of an individual include a pro rata share of investments of any business entity mutual fund or trust in which the individual or spouse owns directly, indirectly or beneficially, a 10 percent interest or greater. According to the Political Reform Act, a business position is a position of director, officer, partner, trustee, employee, or any position of management in any organization, or enterprise operated for profit, including but not limited to a proprietorship, partnership, firm, business trust, join venture, syndicate, corporation or association.

CATEGORY 3 Persons in this category shall disclose all income and business positions. “Income” means a payment received, including but not limited to any salary, wage, advance, dividend, interest, rent, proceeds form any sale, gift, including any gift of food or beverage, loan forgiveness or payment of indebtedness received by the filer, reimbursement for expenses, per diem, or contribution to an insurance or pension program paid by any person other than an employer, and including any community property interest in the income of a spouse. Income also includes an outstanding loan. Income of an individual also includes a pro rata share of any income of any business entity or trust in which the individual or spouse owns, directly, indirectly or beneficially, a 10 percent interest or greater. CATEGORY 6 Consultants performing the duties of any designated position shall be required to file Statements of Economic Interest disclosing reportable interests in the categories assigned to that designated position. In addition, consultants who, under contract, participate in decisions which affect financial interests by providing information, advice, recommendation or counsel to the agency and possess decision-making authority which could affect financial interests shall be required to file Statements of Economic Interests disclosing reportable interest as determined by the executive officer (or head) of the agency.

The Los Angeles County Board of Supervisors, as the code reviewing body for the above-named agency, has adopted a standard conflict of interest code for use by the above-named agency. Therefore, the provisions of the standard conflict of interest code and any amendments to it duly adopted by the Los Angeles County Board of Supervisors are hereby incorporated by reference and along with the attached Exhibit A in which members, employee, and consultants are designated, constitute the conflict of interest code of the above-named agency.
