WELCOME

Patterson Homes welcomes you to our team of contractors.

You are joining a team of professional tradespeople committed to providing our client with afinished product set to the highest possible standard using industry best practices.

Patterson Homes works hard to ensure that all our building projects are completed within scheduleand to a level of finish that exceeds our clients’ expectations.

We encourage you to spend some time reading through this information so that you canfamiliarise yourself with our company, who we are and what we are trying to achieve. Wealso want to establish good practices from the start so that our business relationship can beto our mutual benefit.

Our target market is mid to high-end owner occupiers and developers. Expectation levelsare usually high and we are committed to ensuring our clients are not left disappointed. Itmatters to us that our clients are happy and it matters to us that your workmanship is to astandard that meets with our expectations.

You should contact our office for any further information or clarification of any matter containedherein.

Our work takes us to all metro areas. If you would like to visit a current site or a completed siteto see the types of constructions being undertaken or the level finish we expect then pleasecontact the office and we can provide you with details of sites available to visit.

OUR EXPECTATIONS

Our expectations are that our contractors will be ‘team players’, well aware of their ownand each other trades’ place and importance within the building chain.

Building is a collaborative effort of its various parts and each trade must take responsibility forensuring they provide the best possible outcome for the entire team of contractors whoparticipate on the project.

A job well done will be rewarded through our clients’ satisfaction on completion andhandover and also through further opportunities being given to you to continue to workon our projects.

We expect that you will maintain good communication at all times with the ProjectSupervisor appointed by us to manage the job and with the Office as may benecessary from time to time.

Warranting your work / Defects

As you are aware, after the project is handed over to the client Patterson Homesmust continue to warrant the job against defects for a further 61/2 years from the dateof the Certificate of Occupancy. Maintenance items (and defects) arising during the first3 months after handover must also be attended to. These are statutory requirementswhich must be adhered to.

We expect that you will also warrant your work concurrently for the duration of thosetwo periods and attend to any repair or rectification works expeditiously if requested todo so.

It is extremely important to Patterson Homes that maintenance and defect issues areaddressed quickly and efficiently. The way in which these issues are dealt with andresolved often leave a lasting impression with clients and we wish to ensure that the“maintenance” experience does not cause undue delay or stress to our clients.

Our aim, and yours, should always be that return attendances will not be requiredand that your work on site will be completed to an exemplary standard without anyneed for follow-up repair or rectification.

Our Project Supervisor will spend significant time on site over the course of aproject managing the site and viewing the progress of all work. In particular the ProjectSupervisor will be checking the standard or your work and timely completion to ensurethat overruns or delays to our building schedule are avoided.

The Supervisor’s role is to ensure that our high standards are maintained at all times by alltrades. You may be asked from time to time to ensure that your work meets with ourexpectations and standards and we will expect your co-operation to ensure that futureproblems do not arise (which becomes an inconvenience to all of us).

ADMINISTRATION / ACCOUNTS

Patterson Homes engages work by way of written Purchase Order which will be faxed,emailed or posted to you. The Purchase Order will contain all necessary information for youto commence and complete your works.

You should read each Purchase Order carefully as they may differ from job to job and youshould not assume that all instructions/requests will be identical. You should contact usimmediately if there is any matter that you do not understand or the scope of works cannotbe met for any reason.

At the start of a project we establish a thorough and realistic building schedule and thetiming of work is carefully managed to avoid delays and clashes between trades’attendance on site. We believe that the timing for your works will be reasonable andrealistic. You should ensure that you communicate with us in relation to any issue that willaffect your ability to complete the works in a timely manner.

Getting Paid

To enable efficient management of our accounting and office systems your invoice mustmeet the following criteria to facilitate prompt payment:-

Inclusion of our Purchase Order number. The amount of your invoice must correspond with the amount of our Purchase

Order including progress payments). Variations/Extras must be authorised and approved in writing by the Project Supervisor

and an additional Purchase Order issued.

Payments requested outside agreed payment terms will only be made in exceptionalcircumstances.

TERMS OF ENGAGEMENT

Your Purchase Order will contain a set of “Trade Notes” and “Terms and Conditions” whichform the basis of the terms of engagement which underlie the contractual terms with us.

Our Trade Notes and Terms and Conditions are set out below for your reference:-

Trade NotesThe following administrative matters must be noted to ensure prompt processing and payment ofinvoices upon completion of the works:-

• You must include this Purchase Order number on all invoices presented for payment. Pleasesubmit a separate invoice for each Purchase Order or clearly itemise progress claims.

• Your invoice as submitted will not be processed or paid unless the amount corresponds exactly tothe amount noted on this Purchase Order (or as confirmed by you on our request). Any changes oramendments must be requested and authorised in writing – you must contact us to request anamendment or additional Purchase Order number for use.

• You must notify us immediately if you are unable to start/finish the works on the specified dates.

• You must contact us immediately if you are in any doubt regarding your obligations or the scopeof the works required or for any issues relating to the construction site.

• You must keep the site clean of rubbish at all times. Costs will be deducted from payments due inthe event that we are required to remove your rubbish/debris that is not placed in the bin provided.

• You must be prepared to attend to maintenance of your work as may be requested by us resultingfrom the statutory 3 months maintenance period after handover of the dwelling to the Owner. Youmust attend to maintenance items in a timely manner following any request from us.

• A Health & Safety Coordination Plan has been prepared for this site and can be inspected at ouroffices during normal business hours or sent to you upon your request. The plan is subject to reviewand revision as necessary from time to time. You should contact us if you require any site specificinduction training.

Terms and Conditions:-1) Acceptance of this Purchase Order constitutes a binding contract and indicates acceptance ofall written terms and conditions herein and acceptance of the price for the scope of works to beprovided by you.

2) All work is to be performed in accordance with the standard required by the Building Code ofAustralia 2008, Building Act (Vic) 1993, Building Regulations (Vic) 2006, Domestic Building ContractsAct 1995 (Vic) and the Building Commission (Vic) Guide to Standards & Tolerances 2007. (These canbe provided to you in electronic format upon your request).

3) All work is to be carried out in accordance with industry requirements. Patterson Homes’expectation is that work will be of the highest standards of quality and workmanship. A “BuildersInstruction” will be sent to you in the event that your work, in our absolute discretion, falls below ourexpected standards. You will be required to make good, repair and/or rectify the work to astandard/quality deemed acceptable by us. In the event of any dispute by you regarding our

determination of the quality of the work then we will engage an independent inspection of the work.In the event that the report determines that the work is of poor standard or quality then you will berequired bear the full costs of the report.

4) In the event that you fail and/or refuse to attend to repair and/or rectify your works (whether ornot a Builders Instruction has been issued) we reserve our rights to engage another contractor toattend to the repair and/or rectification works and recover the costs from you.

5) In the event that your works result in direct, indirect or consequential damage to the site wereserve our rights to make claim upon you for the repair, reinstatement and rectification of anydamage sustained together with reimbursement for all foreseeable costs in dealing with you andany other consequential trades as a result of your works and including (but not limited to)administration and office costs, legal costs, inspection costs and consequential sub-contractorcosts).

6) Payment will be made for completion of each specified component of the complete scope ofworks as may be detailed on the Purchaser Order sent to you for the works.

7) You are required to supply all necessary plant and equipment to perform the works, unlessagreement is made with us to supply and plant and equipment required by you.

8) You warrant that you have public liability insurance in place and a current Workcover policy.

9) All electrical leads and equipment are to be tagged if used on site.

10) You must have completed an induction course in O.H & S and have an induction card, which willbe provided to us if requested.

11) Site fencing must be closed and locked when leaving the site and must NOT be left open underany circumstances. Please contact the office if you require a construction key for access.

12) You must keep site clean and clear of rubbish at all times and all debris and rubbish must beplaced in the bin provided on site. Care must be taken to avoid soiling of all internal surfaces.

13) No tools are to be placed on the vanities or benchtops.

14) You must accept full responsibility and liability for the work performed by you.

15) Damage, displacement or interruption caused by you to any underground service (includingpipe work and conduit) then such damage will need to repaired or reinstated by you at your ownexpense or a claim for payment will be made by us. “Dial-Before-You-Dig” plans are available andshould be requested if appropriate to the type of work carried out by you. Please contact ouroffice prior to commencing work to request further information if necessary.

16) Care must be taken to avoid damage or soiling of any internal or external surface. Any damageor soiling will need to be rectified at your expense.

17) If signs are posted that give specific directions concerning access or conduct on the site thensuch directions must be complied with at all times without exception, including the removal of shoesto carry out work inside the dwelling. Soiling or damage caused as a result of non-compliance willneed to be rectified at your expense.

18) If in doubt about anything - please contact the Site Supervisor to discuss the issue further.

Important Note: If there is any element in the above that you are not prepared toadhere to you should contact us immediately. Your acceptance of our PurchaseOrder will be deemed acceptance of all the notes, terms and conditions notedabove.

Damage caused whilst on site

Damage sustained to the building site results in cost and inconvenience to all of us. Youwill appreciate the construction sector is highly competitive in the current market andfinancial climate, with margins and overheads carefully controlled.

It is extremely important for you to be aware that we cannot absorb the cost ofdamage sustained to the site, external footpaths and crossovers, or forfines/penalties imposed by Council as a result of your attendance on site.Unfortunately, in the event of damage or other loss we will be forced to pass this costto you for payment. It is imperative that you take care whilst on site.

We do understand that accidents sometimes happen and it is left to you to make anyinsurance arrangements that you deem necessary.

SAFE WORKING PRACTICES

Important Note: Any information given here does not remove the obligation of all PattersonHomes’ employees or individual contractors and their employees from observing therequirements of the Occupational Health and Safety Act 2004, its regulations andcodes of practice or complying with any safe work procedure as may be required onbuilding construction sites. Further information can be obtained from the WorkSafeVictoria Advisory Service by phone on (03) 9641 1444 or Toll free 1800 136 089.

Patterson Homes promotes safe working practices to ensure a safe and healthy workplacefor all employees, contractors and visitors to the site.

General Expectations for Safety, Risks & Hazards

A building site is the workplace of many people and must be kept safe at all timeswith all risk eliminated and where this is not possible, managed and reduced asfar as practicable.

We expect that you will be committed to health and safety issues on our building sitesand be proactive in notifying us of any issue of hazard or risk which may affect the safetyof the workplace.

We expect you to respect the workplace (and the work carried out by others) whileyou are on site.

We expect that you will continue to respect the workplace for those who will arrive on siteafter you leave.

You are responsible for your own site “housekeeping” and we expect that you willkeep the workplace in a clean and tidy condition. This responsibility falls on contractorsusing the site from time to time and we expect that you will not leave your rubbish on siteand will use the rubbish bin provided if necessary. Any of your materials left on site mustbe stored safely and in an area not likely to adversely affect other trades, neighbours orthe public.

Legal requirements (as published by WorkSafe Victoria)

The Occupational Health and Safety Regulations came into effect from July 2007 andsets out minimum safety standards specific to the construction industry.

The Occupational Health and Safety Act 2004 is based upon the following key health andsafety principles: All people – employees and the general public – should have the highest level of

protection against risks to health and safety. Those who manage or control things that create health and safety risks in the

workplaceare responsible for eliminating or reducing the risks, so far as is reasonablypracticable.

Employers should be proactive in promoting health and safety in the workplace.

Information and ideas about risks and how to control them should be sharedbetween employers and employees.

Employees are entitled – and should be encouraged – to be represented inrelation to health and safety issues.

Note: the legislation provides that “employees” may include – sub-contractors, employees or thatsub-contractor and any person working in a workplace over which you havemanagement and control.

Legal duties of contractors (as published by WorkSafe Victoria)

You have a general duty to take reasonable care for your own health and safety, and that of otherswho may be effected by your work, and to cooperate with efforts to make the workplace safe.

In practice this means that you should cooperate with your employer (Patterson Homes) by followinginstructions, procedures and work practices and attending training sessions if required.

You must not intentionally or recklessly interfere with or misuse anything provided by the employer(Patterson Homes) which could adversely affect health, safety or welfare at the workplace.

Guidance and Compliance (as published by WorkSafe Victoria)

WorkSafe Victoria has a range of guidance for the construction industry on particular issues suchas industry standards, WorkSafe codes of practice, guidance notes, incident reports and checklists. Allof this information can be accessed at WorkSafe Victoria’s website: www.worksafe.vic.gov.au orcan be ordered from the WorkSafe Advisory Service.

You should inform yourself and provide your own equipment in relation to any risk or other workplacehealth and safety issues you may be exposed to by virtue of the nature of your work or the scope ofworks under which you are engaged. Consideration should be given (but not limited to) thefollowing as you may deem to be necessary or appropriate:-

working at heights scaffolding and working platforms elevated work platforms steelerection pre-cast panel erection individual fall arrest systems ladders falling objectspenetrations (horizontal and vertical) trenches and other excavations electrical safety plantand equipment cranes concrete boom pumps traffic management demolition

asbestos confined spaces hot work personal protective equipment dangerous goods andhazardous substances explosive power tools site housekeeping manual handling emergencymanagement and first aid

Health & Safety Co-ordination plan

A Health & Safety Co-ordination Plan will be prepared for each building site and is available for inspectionat our Office during normal business hours.

The co-ordination plan will be reviewed and changed when necessary. A sample co-ordination plan isattached as “Appendix A”.

GENERAL SITE SAFETY RULES

RIGHT OF ENTRY TO SITE

Work sites are restricted to construction and company staff only. Members of the publicare not permitted on site unless prior arrangement has been made with the ProjectSupervisor.

PUBLIC SAFETY

All sites are to locked up and fenced off at the end of each working day. If you are thelast on site you should ensure that any gates and perimeter fencing is properly secured.

DUST AND NOISE CONTROL

Dust and noise levels must be kept to a minimum to ensure neighbouring properties andthe public are not unduly affected.

VEHICLE PARKING AND ACCESS

You must ensure that your vehicles do not obstruct roads, driveways etc. of neighbouringproperties. Please use access roads where provided or follow other directions for accessas may be given from time to time.

REPORTING ACCIDENTS AND INCIDENTS

All accidents, incidents and near misses are to be reported to the Project Supervisor,recorded and acted upon to prevent any re-occurrence.

Where required they are also to be reported to WorkCover.

DRUG AND ALCOHOL POLICY

The use of, possession or sale of illegal drugs is prohibited at any time while onsite. The consumption, possession or sale of alcohol is prohibited at any timewhile on site.

Any person under the influence of illegal drugs or alcohol should not attend theworkplace or attempt to operate any plant owned, hired or contracted toPatterson Homes. If such a situation occurs then the person will be required toleave the workplace.

PERSONAL PROTECTIVE EQUIPMENT (PPE)

You are responsible for providing your own personal protective equipment such as safetyhelmets, protective clothing and sunscreen and must be used to control any risk.

GENERAL STANDARDS OF BEHAVIOUR

The following behaviour is prohibited and will not be tolerated on our building sites:-

Discrimination or intimidation of any kind. Vandalism or theft of any kind. Language or behaviour likely to effect neighbours or the public. Refusal to act on safety instructions issued by the Project Supervisor. Unauthorised removal of any safety hazard controls.

IN CASES OF FIRE

Warn other persons in the area.

Move all persons to safety.

Close off all doors to contain the fire (if inside).

Ring emergency number 000.

Use a fire extinguisher on the fire (if available) if it is safe to do so – do not use water on anelectrical fire unless the power is isolated.

Report the incident to the Project Supervisor immediately.

EMERGENCY MANAGEMENT – PERSONAL INJURY

Don’t panic. Do the following as quickly as possible:

Send for a qualified first aider. Do not move the injured person unless his/her life is threatened. Ensure airways are clear. Administer cardio pulmonary resuscitation if required and if qualified to do so. Stop serious bleeding by applying pressure to the affected area. Make the person as comfortable as possible.

DIAL 000 FOR HELP IN AN EMERGENCY

When you make an emergency call you should tell the operator the following information:

Where the emergency is What has happened What is being done Who is calling Wait to be told what to do

Emergency and other site contact information will be placed in a prominent andappropriate position around the building site.

EMERGENCY MANAGEMENT – Contact the Project Supervisor for further information or instruction ifrequired.Don’t panic. Do the following as quickly as possible:

Send for a qualified first aider. Do not move the injured person unless his/her life is threatened. Ensure airways are clear. Administer cardio pulmonary resuscitation if required and if qualified to do so. Stop serious bleeding by applying pressure to the affected area. Make the person as comfortable as possible.
