Welcome from the ChairChairman Hart welcomed and thanked everyone for attending the meeting.

Introduction of Commissioners/Advisors/Public Commissioners and Advisors introduced themselves. Chairman Hart asked if there were any elected officials in the audience; there were none.

Commissioner/Advisor Reports Each Commissioner shared thoughts and information that they learned and thought was beneficial.

Welcome Presentation from Central Florida Regional Transportation Authority (LYNX) Bill Hearndon, Deputy Director of Mobility Services welcomed everyone to Orlando, and gave an overview of LYNX.

Approval of Minutes – May 17, 2017 Chairman Hart asked if there was a motion to approve the May 17, 2017, minutes.

ACTION TAKEN: Commissioner Stevens moved and Commissioner Forsell seconded the motion to approve the May 17, 2017, minutes. The motion carried unanimously.

Election of Vice Chairman Chairman Hart asked for nominations for Vice-chairman, Commissioner Forsell and Commissioner Willingham nominated Commissioner Stevens as vice-chairman for the Commission for Transportation Disadvantaged.

ACTION TAKEN: Vote was taken, the motion carried unanimously.

2017 -18 Annual Regulatory Plan Review Tom Barnhart, Office of the Attorney General, went over the form that was summited in the previous year, Mr. Barnhart made suggestions to update rules/amendments on the 2017-2018 Annual Regulatory Plan Form Mr. Barnhart requested approval to revise the 2017-2018 Annual Regulatory plan.

ACTION TAKEN: Commissioner Willingham moved and Commissioner Tellez seconded to approve Tom Barnhart to revise 2017-18 Annual Regulatory Plan.

2018 Commission Business Meeting Schedule The 2018 Commission business meeting schedule was presented. Chairman Hart asked if there was a motion to approve the schedule.

ACTION TAKEN: Commissioner Stevens moved and Commissioner Tellez seconded to approve the 2018 Commission business meeting schedule as presented.

Executive Director Report Steve Holmes gave an overview of the commission budget.

• FY 2018-19 Legislative budget Request: Mr. Holmes gave a brief overview of the LBR. More information will be given in the December, when approved LBR will be known.

• FY 2017-18 Appropriations/FY 2018-19 Legislative Budget Comparison • APD Transportation Task Force: Mr. Homes gave an overview of the APD Task Force,

and gave an update on what they were working on.

Public Comments Elizabeth Rockwell, Miami Dade TPO expressed her concerns about T&E Grant Reallocation.

Steve Copeland, Uzurv. Shared about his company history and talked about their fast growing new company and innovative ideas to assist ADA riders.

Michelle Ogilie, Hillsborough MPO shared her concern for more participation from state departments.

Scott Clark, Hillsborough County Sunshine Line shared his concern with the new application process, and the hardships it’s causing customers who are persons with disabilities.

Commissioner/Advisor Comments Chairman Hart announced that the next meeting will be held on December 13, 2017, 2017 Sarasota, FL.

AdjournmentChairman Hart asked if there was a motion to adjourn the meeting.

ACTION TAKEN: Commissioner Stevens moved and Commissioner Forsell seconded the motion to adjourn the meeting. The motion carried unanimously.

2017 Shirly Conroy Rural Area Capital Equipment Assistant Grant Award Recommendations Steve Homes, Executive Director, explained that the Department of Transportation authorizes the transfer of $1.4 Million to the Transportation Trust Fund to provide funding to assist the rural areas with the purchase capital equipment. Mr. Holmes reminded the Commissioners that due to an unexpected delay in finalizing FDOT vehicle contracts, Tri County Community Council was unable to purchase a vehicle awarded through the 2016-2017 Shirley Conroy Grant. Therefore, at the May 17,2017, business meeting, the Commission approved for the funds to be taken out of the 2017-18 Shirley Conroy Rural Area Capital Assistance Program, leaving a balance of $1,297,273.00 to be awarded to new projects. Twenty-five applications were submitted totaling to $3,084,715.85. Mr. Holmes presented the subcommittee’s recommendations for awards as provided in the meeting package .

ACTION TAKEN: Commissioner Tellez moved and Vice-Chairman Stevens seconded to approve the Fiscal Year 2017-18 Shirly Conroy Rural Area Capital Equipment Assistant Grant Award Recommendations. The motion carried unanimously.

Rule 41-2.010(4)(c), F.A.C Amendment Mr. Tom Barnhart, Office of the Attorney General, discussed the letter the Commission received from the Legislative Joint Administrative Procedures Committee regarding Rule Section 41-2.010(4)(c), F.A.C.. He explained that this section of the rule addresses the selection of a Community Transportation Coordinator and identifies criteria to be included when the selection is accomplished by a request for proposals. The language specifically refers to Section 216.349, F.S., which has been repealed from statute and is no longer applicable. Therefore, it is recommended that the reference “in accordance with Section 216.349 F. S” be deleted for the current section of the rule.

ACTION TAKEN: Vice-Chairman Stevens moved and Commissioner Willingham seconded the motion to approve amending Rule 41-2.010(4) (c). The motion carried unanimously.

Mr. Barnhart requested approval of a Statement of Estimated Regulatory Costs (SERC) as part of the rule amendment process. He explained that the proposed rule change did not appear to have an economic impact.

ACTION TAKEN: Vice-Chairman Stevens moved and Commissioner Forsell seconded the motion to approve the completion of the SERC. The motion carried unanimously.

Mr. Barnhart also requested the Commission to vote as to whether or not this rule amendment would suspend, revoke, or otherwise discipline any person or company or impose fines or costs or other remedies for violation. The Commission discussed the opportunity to delegate authority to the Executive Director to execute any documents relating to the rule amendment process.

ACTION TAKEN: Commissioner Willingham moved and Vice-Chairman Stevens seconded the motion to approve the response “No” regarding any disciplinary action as a result of the current approved rule change and granting authority to the Executive Director to execute rule amendment relating documents . The motion carried unanimously.
