Major Monetary and Fiscal Measures and Policies in 2001

Monetary Measures

In order to maintain economic andfinancial stability and betteraccommodate economic develop-ments, the authority implementedcertain changes to its monetarypolicies in 2001. The adjustmentsincluded correcting the misalign-ments in short-term interest rates,abolishing the bank rate, improvingand developing various financialmarket regulations and encouraginglendings to SMEs. In addition,measures to deter baht speculationwere also relaxed and new measuresto resolve financial institutions'problems were introduced, includ-ing supervision and developmentissues. Moreover, the MonetaryPolicy Committee's assessment ofcurrent economic conditions andoutlook were periodically releasedto the public, all of which aresummarized below.

A. Interest rates

(8 June) Corrections of mi-salignments in short-terminterest rates

In order to correct misalign-ments in short-term interestrates whereby the interbankrate was lower than depositrate, the BOT announced earlyin June an increase in the 14-dayrepurchase rate, its policyinterest rate, from 1.5 per centper annum to 2.5 per cent perannum.

(25 September) Abolition of theBank Rate

The BOT announced theabolition of the bank rate in orderto increase the effectiveness ofits policy interest rate (the 14-

day repurchase rate) as a signal.Consequently, any related regu-lation, notification, circular,contract, agreement, rule, con-dition imposed by any public orprivate sector organizationsshould now use the rate chargedby the end-of-day liquiditywindow facility, as defined inthe Bank of Thailand's regula-tion on Repo transactions 2001,whenever a reference to the bankrate needed to be made. Thiswas effective from 1 October2001.

B. Implementation of monetarypolicies

(12 July) Monetary PolicyCommittee's Decision

The BOT announced thedecision of the Monetary PolicyCommittee (MPC) regardingthe appropriate stance ofmonetary policy. The MPCagreed to adopt the previousframework of monetary policy.Core inflation would be keptbelow the 3.5 per cent ceiling,and the 14-day repurchase ratewould remain the policy interestrate. With respect to monetarypolicy implementation, the MPCand the BOT would monitorexternal stability more closely,especially the declining currentaccount surplus. Furthermore,external stability would also bestrengthened through betterexchange rates managementaimed at reducing short-termfluctuations.

After consideration of the futuretrend for inflation, the pro-

bability of inflation being abovethe target level was deemed tobe low. Moreover, the move toincrease short-term interestrates on 8 June 2001 was ade-quate to correct the misalignmentin the short-term interest ratestructure. The MPC therefore,decided to maintain the 14-dayrepurchase rate at 2.5 per centper annum.

(25 December) Monetary PolicyCommittee's Decision

The BOT announced thedecision of the MPC regardingthe appropriate stance ofmonetary policy. The MPCviewed that Thailand's currentfinancial situation on theexternal front had become morestable. The Baht was stable andofficial reserves were strong.However, growth was expectedto slowdown during the nextperiod.

The last data pointed to con-tinued uncertainties and possiblefurther slowdown in worldeconomy, especially in theUnited States, Japan, and otherThailand's major trading part-ners. This had important reper-cussions on Thai exports andeconomic situation. Further-more, the declining trend ininflation had resulted in higherreal interest rates which mighthave weakened growth. At thesame time, core inflation in 2002was projected to remain low andwell within the range of 1.5-2.5per cent per annum, whileexternal stability improvedcreating room for an easing of

monetary policy. Thus, in orderto promote economic recovery,the MPC announced a cut in the14-day repurchase rate by 0.25per cent, from 2.5 per cent perannum to 2.25 per cent perannum.

C. Measures for money marketdevelopment

(17 August) Bilateral Repo ofthe financial institutions

In line with the BOT's policy toencourage financial institutionsin the securities repurchaseagreements, the following rules,procedures and conditions wereset for commercial banks tofacilitate borrowings in theprivate repurchase market:

1. The definition of privaterepurchase is given as thetrading of securities with anagreement to resell or re-purchase, so as to facilitatelending/borrowing betweenfinancial institutions, usingsecurities as collateral.

2. The portion of the value ofthe securities used as colla-teral by a commercial bankthat exceeds the borrowedamount must be added to thevalue of credits, investmentor obligation to the counter-party financial institution. Ifthis amount exceeds thesingle lending limit, then thecommercial bank will not beable to enter into the privaterepurchase transaction. Inthe case where the commer-cial bank was in compliancewith this condition at thetime it entered into the tran-saction, but later exceededthe single lending limit, forwhatever reason, then it canno longer enter into futureprivate repurchase transac-tions. However, the previoustransaction approved wouldstill be binding according tothe agreement.

Under this facility, theBOT will enter into bondpurchasing transactions withfinancial institutions andspecialized financial institutions(the Government Savings Bank,the Government Housing Bank,the Bank for Agriculture andAgricultural Cooperatives, theExport-Import Bank of Thailand,the Industrial Finance Cor-poration of Thailand, the SmallIndustrial Finance Corporation,the Secondary MortgageCorporation, and the Thai AssetManagement Corporation) at 90per cent of the face value at aninterest rate equal to the policyinterest rate plus 1.5 per cent perannum. A financial institutionwishing to use this facility mustnotify the intention to sell to theBOT between 17:00 - 17:30 hrs.,send confirmation by 10:30 hrs.and repurchase the bond by12:00 hrs. the next business day.This has been effective since 1October 2001.

(9 November) Approval forcommercial banks to borrow ina form of private repurchasefrom institutional investors

The BOT gave approval forcommercial banks (excludingBIBF) to borrow in the form ofprivate repurchase from insti-tutional investors, including:

1. Mutual Funds, ProvidentFunds and Private Fundsunder supervision of theOffice of the Securities andExchange Commission(SEC)

2. The Government PensionFund

3. The Social Security Office

4. Specialized financial insti-tutions established by law,such as the Asset Mana-gement Corporation and the

3. In the calculation of the ratein 2., in the case where thesecurities used as collateraldepreciates in value, if theborrowing commercial bankis called for a cash margin,then the borrowed amount isto be reduced by the increasein margin. However, if thebank is called for a securitymargin, then the collateralvalue should be increased bythe amount of the increase inmargin.

In the case where thesecurities used as collateralappreciates in value, if theborrowing commercial bankreceives a cash marginreturn, then the borrowedamount is to be increased bythe amount of margin return.However, if the bank recei-ves a security margin return,then the collateral valueshould be decreased by theamount of the margin return.

4. The market price is to beused in securities valuation.

This was effective from 21August 2001.

(25 September) Measuresconcerning the bond repur-chase market to improve end-of-day liquidity

The BOT acts as a lender of lastresort for financial institutionswith short-term liquidityproblems. Previously, there were3 liquidity windows available tofinancial institutions for thispurpose, namely the loanwindow, the late hour repurchasewindow and the intradayliquidity facility. However, therates charged by these facilitieswere uncorrelated and incon-sistent with the policy interestrate, resulting in ineffectivemonetary policy signalling.Therefore, the BOT decided toreplace these facilities with a

Secondary Mortgage Cor-poration, etc.

5. Life and non-life insurancecompanies

The BOT's supervisory andregulatory policies on the privaterepurchase undertaking of thefinancial institutions will con-tinue to be applied as well asother regulations and super-visory measures to be announcedin the future.

D. Foreign exchange measures

(27 December) Baht lending tonon-residents (measures todeter baht speculation)

The BOT relaxed regulationsagainst baht speculation byallowing financial institutions togive direct loans to non-residentsin neighbouring countries ofUnion of Myanmar, the People'sDemocratic Republic of Laos,Cambodia, Vietnam and thesouthern part of the People'sRepublic China, with the follow-ing conditions:

1. Financial institutions wish-ing to provide direct loans inbaht to non-residents in theneighbouring countries mustseek permission from theBOT on a case by case basis.

2. After the credit has beenextended, the financialinstitution must deposit thebaht into no more than oneSpecial Non-resident Ac-count (SNA) that the non-resident opened with afinancial institution. Thefinancial institution mustreport the name and accountnumber of the SNA and allchanges to the account statusto the BOT.

3. The financial institutionwhere the SNA is held atmust oversee that with-drawals from the account are

for the purpose prescribedby the BOT. Such purpose isfor the purchase of domesticgoods and services or repay-ment of liabilities to a Thairesident, and not for thepurchase of foreign curren-cies. Borrowing of baht topurchase foreign currenciesis normally prohibited bythe BOT, but a non-residentmay undertake such trans-action only if the intention isreported the first time therequest to borrow was filed.

4. The BOT does not allow fortransfers between SNAs orbetween an SNA and otherbaht account of a non-resident.

This was effective from 27December 2001.

E. Credit measures

(10 August) Interest rate limiton loans

The BOT abolished the previousrequirement on the calculationof the Minimum Retail Rate(MRR) that commercial banksquote to ordinary customersusing the posted MLR plus aspread not exceeding 4 per centper annum. Instead, commercialbanks were required to calculateloan interest rates according tothe guidelines set in theannouncement of the BOT onguidelines for commercial bankson interest rates and discounts,dated 20 October 1993, and itsrevision. Furthermore, com-mercial banks were required torepor on their average cost offund from deposit to the BOT ona quarterly basis.

F. Measures to resolve financialinstitution problems

(6 February) Extension of theholding period for immovableproperties

The BOT issued a circular toBIBF, along the line of the 24December 1999's circular sentto commercial banks, concer-ning the extension of the holdingperiod for immovable properties.In essence, BIBF may holdimmovable properties transfer-red between 1 January 1997 and31 December 2001, for longerthan the prescribed period.Furthermore, BIBF must sellthese properties within 10 yearsfrom the date of transfer.

(8 March) Permission forcommercial banks to offer anEscrow Account

The BOT extended the scope ofcommercial bank businesses toincluded accepting deposits inthe form of escrow accountwhere depositors have enteredinto a purchase agreement withthe sellers. Commercial bankshave to oversee the withdrawalsfrom the account after bothparties have fulfilled allcontractual obligations. Further-more, commercial banks maycharge a fee for the opening ofthe account, the service and otherexpenses from the customer, asclearly agreed at time of thecontract. Moreover, commercialbanks must maintain a record ofthe name and address of thecustomer, details of the asset inquestion, guidelines, proceduresand conditions of the opening ofthe account, all deposits andwithdrawals, the closing of theaccount, and other expenses andfees incurred from the openinguntil the closing of the escrowaccount.

Commercial banks whoseescrow account services are notconsistent with the abovementioned guideline must seekprior permission from the BOTor risk having their licencerevoked.

(7 August) Modification of theregulations on the purchase orholding of shares in limitedcompanies above the legal limit

In an attempt to strengthen thedebt restructuring frameworkand support investment offinancial institutions, the BOTmodified regulations on thepurchase or holding of shares inlimited companies above thelegal limit as follows :

1. Financial institutions(commercial banks, foreigncommercial bank branchesand BIBF, finance com-panies, finance and securi-ties companies, and creditfoncier companies) areallowed to hold ordinary andpreferred shares in debtorcompanies (as well as deben-tures in credit foncier com-panies) above the legal limitas a result of debt restruc-turing according to BOT'sregulations. The holding ofsuch shares shall includeshares of companies whichthe debtor sold to the finan-cial institutions in paymentof its debts, shares of thecompany of debtor's guaran-tors, as well as shares incompanies created to holdor restructure the debtorcompany.

2. Financial institutions whichhold shares in limited com-panies resulting from debtrestructuring according toBOT's regulations above thelegal limit are required toreduce such holdings and anyother holdings of shares inlimited companies to meetthe legal limit as soon aspossible, but no later than 31December 2004, unlessotherwise specified by theBOT.

3. The reduction of shares heldin limited companies, resul-ting from debt restructuringaccording to the BOT'sregulations must not incurloss to financial institutions,with the exception of thefollowing cases :

3.1 The sale of shares ofcompanies registeredunder the Sock Exchangeof Thailand (SET) at aprice no less than theirbook value or close priceone business day prior tothe date on which thefinancial institution sellsthose securities.

3.2 The sale of shares oflimited companies notregistered under the SETat a price judged to befair by the financialinstitution's auditor, if theauditor is unable toguarantee that the priceis a fair price, the auditorcan appoint a specialistto guarantee that the priceis a fair price on theauditor's behalf.

3.3 Other cases allowed bythe BOT.

The calculation of whether thesale of securities will or will notlead to a loss to the financialinstitution shall be done by acomparison of the sale price tothe book value of the securitieson the day purchased.

(14 September) Trading of debtrestructuring promissory notesin the repurchase market

Following the Ministry ofFinance's issue of promissorynotes to refinance earlier bondsissued (in accordance with theEmergency Decree enabling theMinistry of Finance to issuebonds to restructure the liabi-lities of the Financial Institutions

Development Fund B.E. 2541),the BOT issued two announ-cements to financial institutionsthat were members of therepurchase market, namely:

1 The BOT's regulation con-cerning the sale and purchaseof government bonds with arepurchase clause Volume12 B.E. 2544, where theBOT would purchase debtrestructuring promissorynotes at 95 per cent of facevalue; and

2. The BOT's regulationconcerning the sale andpurchase of bonds with arepurchase clause withprimary dealers Volume 2B.E. 2544

The definition of "bond" in theformer regulations was modifiedto include debt restructuringpromissory notes, where theBOT is the registrar and payingagent. Furthermore, "debtrestructuring promissorynotes" were defined as pro-missory notes issued by theMinistry of Finance in accor-dance with the royal ordinancepertaining financial assistancefrom the Ministry of Finance tothe FIDF.

This was effective from 17September 2001.

(25 September) Regulations forAsset Management Companies(AMCs)

The BOT allowed AMCs topurchase immovable propertiesof debtors that have not beenmortgaged with other AMCs.This can be done through anauction as ordered by a court oflaw or official receiver orcollective creditors in the caseof debt restructuring. The AMCsmust dispose of these immovableproperties within 10 years andthe same regulations apply to

the holding of immovableproperties awaiting sale.

This was effective from 25September 2001.

G. Measures on supervision anddevelopment of financialinstitutions

(11 January) Prescription onmaintenance of assets byforeign commercial bankbranches

The BOT circulated the revisedNotification of the Ministry ofFinance concerning the pre-scription on maintenance ofassets by foreign commercialbank branches. The notificationrepealed the permission to countthe following investments usingthe capital funds of branches offoreign banks, as assets ofSection 6 of the CommercialBanking Act B.E. 2505 asamended by the CommercialBanking Act (No.2) B.E. 2522.These investments include :

1. Investments in shares inlimited companies, whichfinally will be invested inordinary or preferred sharesof commercial banks andfinance companies registeredin Thailand, in accordancewith a scheme approved bythe BOT, and

2. Investments in ordinary orpreferred shares of com-mercial banks and financecompanies registered inThailand.

This was effective from 19December 2000.

(22 January) The use of theinternet for the services offinance companies and creditfoncier companies

The BOT circulated theNotification of the Ministry ofFinance concerning the use ofthe internet for the services of

finance companies and creditfoncier companies. The mainpoints of this notificationinclude :

1. Expanding the scope offinancial services thatfinance companies and creditfoncier companies areallowed to undertake usingthe internet to include allservices approved by theBOT, as specified by the Acton the Undertaking ofFinance Business, SecuritiesBusiness and Credit FoncierBusiness, B.E. 2522 and itsrevision. However, thesecompanies are required toobtain approval from BOTprior to undertaking anyoperations.

Finance companies andcredit foncier companies thathave been given permissionunder the Notification of theMinistry of Finance dated27 January B.E. 2543 underthe same title can beginundertaking such servicesimmediately.

2. In linking finance com-panies' and credit fonciercompanies' Websites withother businesses, they mustnot show trademarks ormessages of other businesseson their homepages. Theymust also refrain fromadvertising services offeredon other businesses' Web-sites, or allow transactionsbetween customers and otherbusinesses from their Web-sites. Finance companies andcredit foncier companies areallowed to charge fees forthe internet services fromtheir customers and otherbusinesses according tomarket mechanism, whileensuring fairness forcustomers.

This was effective from 8February 2001.

(26 February) Regulations forfinance companies and creditfoncier companies on lending,deposit taking, and fundingfrom the public

The BOT issued regulations forfinance companies and creditfoncier companies on lendingand deposit taking from thepublic. Their customers arerequired to provide personaldetails and verifying signaturesfor all supporting documents.Documents must be stored for atleast 5 years from the time thecompany begins repayment tothat customer, for auditingpurpose. Customers are requiredto use their real names and notaliases or false names. Forcustomers whose loans ordeposits with these companiesprior to the date that theseregulations become effective,finance companies must act inaccordance with these regu-lations within 6 months fromthe day these regulationsbecome effective, with theexception of customers whocannot be contacted and thecompany has sent an officialletter to these customersexplaining the matter.

This was effective from 26February 2001.

(7 August) BIBF operationscope

The BOT permitted BIBFtransactions to be hedged againstinterest rate risk with financialinstitutions. The transactionsinclude loans and internallending, and lending to foreigncustomers, other BIBF busi-nesses, the Ministry of Finance,the BOT, or domestic customersthat borrowed in foreigncurrency.

This was effective from 17August 2001.

On 2 November 2001, the BOTclarified its BIBF operationalguidelines to be in line with thatof the Ministry of Finance. TheBOT also made an announ-cement regarding regulations,methods, and conditions in thebusinesses of BIBF commer-cial banks, including regulationsseparating the businesses ofBIBF and commercial banksinto different business entities,as well as the opening of a nostroaccount and the separation ofdocuments that are evidence oflending, foreign exchangetransactions, or other businessby BIBF.

(4 September) Lending orinvestment in related businessesand lending to shareholders

The BOT issued an announ-cement to financial institutions(excluding BIBF) concerninglending or investment in relatedbusinesses and lending toshareholders. The main pointsfrom this announcement are asfollows :

1. Financial institutions mustsuspend credit extension orinvestment in businesses thatfinancial institutions ordirectors or executives ofthese financial institutionshave a vested interest, orlending to shareholders orexecutives of these financialinstitutions in an excessiveamount.

2. Financial institutions mustsuspend credit extension orinvestment in businesses thatfinancial institutions ordirectors or executives ofthese financial institutionshave a vested interest, orlending to shareholders orexecutive of these financialinstitutions subject to specialconditions or rules.

3. Financial institutions mustformulate a credit-extension

policy or investment policyin businesses which thesefinancial institutions or theirdirectors or executives havea vested interest, as well asto shareholders of theseinstitutions.

This was effective from 12September 2001.

(4 September) Assumption ofdirectorship in limited com-panies of directors or executivesof commercial banks

The BOT issued an announce-ment concerning amendmentsto the regulations governing theacceptance of directorships inlimited companies by executivesof commercial banks. Therevised regulations specified thatdirectors and senior executivesof commercial banks can takeup positions as chairperson,executive director, or directorwith signing authority in no morethan three other limitedcompanies. Any commercialbanks with directors or seniorexecutives not complying withthe above regulations mustamend their positions to complywith the above and report to theBOT within 90 days from theday these regulations becomeeffective. If this is not done in agiven time, the BOT reservesthe right to issue orders orimposes conditions as allowedby the law.

This was effective from 12September 2001.

(24 September) Expansion offinance companies' and financeand securities companies' scopeof business.

The BOT issued an announce-ment concerning the expansionof finance companies' andfinance and securities com-panies' scope of business in thecustodian and maintenance of

assets. The expansion includedthe custodian services for assets,as well as the maintenance andstorage of documents of title inassets and other documentsrelated to the sale, transfer, orappraisal of asset values.

(27 September) Valuation ofsecurities used in providingeligible liquid assets

The BOT permitted financialinstitutions to value theirsecurities as part of eligibleliquid assets using book valuefrom the last day of the previousmonth for the upcoming month'svalue. This is with the exceptionof promissory notes byKrungthai Thanakit Finance andSecurities Public CompanyLimited, and certificates ofdeposit by Krung Thai BankPublic Company Limited, issuedunder the Notes ExchangeProgramme for the 56 suspendedfinance companies, using theface value of the note. This waseffective from 23 November2001.

(6 October) Expansion of thedefinition of eligible liquidassets

1. The BOT added types of newsecurities and bonds that canbe classified as eligible liquidassets of commercial banks,finance companies, andfinance and securitiescompanies, as follows :

1.1 Promissory notes for debtrestructuring issued bythe Ministry of Finance,which are considered asassets of the ThaiGovernment.

1.2 Government bonds is-sued under the Tier-1 andTier-2 Capital Sup-portScheme, which are con-sidered as assets of theThai Government.

1.3 Promissory notes issuedby the Thai Asset Man-agement Corporation(TAMC) which repre-sents the right in debts ofthe Financial InstitutionsDevelopment Fund(FIDF).

2. Credit foncier companies arerequired to increase unen-cumbered assets as follows:

2.1 Promissory notes for debtrestructuring issued bythe Ministry of Finance.

2.2 Bonds or debt instru-ments issued by theFIDF.

2.3 Debentures, bond, ordebt instruments whoseprincipal and interest areguaranteed or availed bythe FIDF.

2.4 New securities issued bythe Secondary MortgageCorporation as set forthby the "SpecializedCorporation Decree toConvert Assets intoSecurities B.E. 2540".

2.5 Promissory notes issuedby Krungthai ThanakitFinance and SecuritiesPublic Company Limitedand certificates of depositissued by Krung ThaiBank Public Company,Limited under the NotesExchange Programmefor the 56 suspendedfinance companies.

2.6 Call loans issued fordomestic banks andFIDF.

The BOT granted permission forfinancial institutions to includepromissory notes issued by theTAMC as eligible liquid assetsas of the date of receipt of thesenotes. Any changes in the valueof the promissory notes must be

matched by a consistent adjust-ment in the value of eligible li-quid assets of the financialinstitution.

Circulars were dated 8 October2001 and 9 November 2001,and effective from 6 October2001 and 23 November 2001,respectively.

Fiscal Measures

During 2001, the governmentimplemented several measures,aiming to strengthen the overalleconomy and to achieve sustainablelong-run growth. These fiscalmeasures can be summarized asfollows :

A. Measures to stimulate theeconomy

(4 September) Measures andguidelines to expedite thedisbursement of the Budget forthe fiscal year 2002-2003.Relevant agencies must submitoperational plan for uses of thebudget, purchasing and hiring,and disbursement plans for thefiscal year 2002 to the BudgetBureau by 15 October 2001 andmust submit the same plans forthe fiscal year 2003 to theBudget Bureau by 15 September2002. The Budget Bureau mustprovide quarterly updates andfollow-up reports for thisoperation plan as well asdisbursement of state enterprisesto the Cabinet.

(25 September) Targeting actualdisbursement of the governmentbudget for the fiscal year 2002at 91 per cent of the total budgetof Baht 965 billion. This amountdid not include a reserve fund ofBaht 58 billion earmarked forspecial economic stimulusprojects. The disbursement ratewould vary depending on theactual amount of reserve fundutilized. For example, the

disbursement rate would be 88.7per cent 90.1 per cent and 91.5per cent if the reserve amountswere utilized at 50 per cent, 75per cent and 100 per cent, res-pectively.

(25 September) Annual budgetof 50 state enterprises for thefiscal year 2002. Projected ope-rating budget included totalrevenue of Baht 1,289.53 billion,total expenses of Baht 1,225.79billion, and net profits of Baht63.74 billion. Approved capitalexpenditure of Baht 204.9 billionof which Baht 160.5 billion wasqualified for budget disbur-sement. However, retainedincome of Baht 144.68 billionwas available for investment,resulting in the total deficit ofBaht 15.8 billion or 0.3 per centof GDP.

(22 October) Measures tofollow-up the actual disbur-sement of the fiscal year 2002budget. The government aimedto have at least 70 per cent oftotal government investmentexpenditure actually disbursed.Actual disbursement rate wouldbe used as a key performanceindicator. Government agencieswere required to submit a copyof purchasing, hiring anddisbursement plan to the Comp-troller-General's Department.This plan would be used asinformation for monitoring andfollow-up purpose.

(12 November) Debt suspensionfor small-scale farmers throughfinancing vehicles for farmers.An annual budget of Baht 1,196million was allocated for thispurpose bringing the total of thethree year period to Baht 3,588million for this scheme. Thetarget group included 1.152 mil-lion farmers in 5,161 agriculturalinstitutions, 1.085 million far-mers in 1,762 agricultural co-

operatives and 0.067 millionfarmers in 339 agriculturalgroups. This measure waseffective from October 2001.

(25 December) Establishmentof the Village and UrbanRevolving Fund (VURF) byallocating Baht 1 million to eachof the 74,881 villages nation-wide to be used as a revolvingfund or micro credit facility. Theobjective of the scheme is toprovide funds for carrer deve-lopment, job creation, incomeenhancement, and other publicuses in a community. Accor-ding to the plan, the VURF willsecure loans, guaranteed by theMinistry of Finance, from theGovernment Savings Bank(GSB) as sources of funds forthis plan. The government willthen repay VURF's borrowingsthrough its yearly budget.

B. Measures to support privateinvestment

(18 September) Support forSmall and Medium-sizedEnterprises (SMEs) by reducingcorporate income tax rate for acompany with issued and fullypaid-up share capital lower thanBaht 5 million to the following :

1. 20 per cent of net profitbelow Baht 1 million.,

2. 25 per cent of net profitbetween Baht 1 millionand Baht 3 million., and

3. 30 per cent of any netprofit above Baht 3million.

The scheme would be applied tonet profits of the companies orjuristic partnerships generatedafter 1 January 2002.

Tax break would also be givento support venture capitalbusinesses by exempting these-companies and their investors

the fiscal year 2002. The size ofsuch issuance should not exceedBaht 200,000 million with lessthan 20 year maturity and shouldcarry an appropriate marketinterest rate at the time ofissuance.

(25 December) The governmentapproved external debt incur-ring plan for the fiscal year 2002as follows :

1. Established the limit ofUS$ 1,000 million forthe fiscal year 2002.

2. Approved the externaldebt incurring plan forthe fiscal year 2002including 8 projects ofdirect government bor-rowing, totalling US$490.22 million and 8government-guaranteedprojects amounting toUS$ 703.24 million.

3. Approved additionaldomestic credit limit forstate enterprises tosubstitute foreign-cur-rency loans amoun-tingto Baht 15,000 millionfor the fiscal year 2002.

4. Approved in principle toempower the NationalDebt Policy Committeeto amend external debtincurring plan as appro-priate within the limitestablished above.

(11 December) Tax break formultinational corporationsseeking to set up Regional Ope-rating Headquarters (ROHs) inThailand as follows :

1. Reduced corporate incometax from 30 per cent to 10 percent for the ROH.
