The Coinmissioii on Elections, pursuant to ihe powei's vested in it l)y the

Constitulion, the Omnibus Election Code, Executive Order No. 157, Republic Act No.

7166, Republic Act No. J0380, and othei- pertinent election laws, RESOLVED, as it

hereby RESOLVES, to promulgate the following rules and regulations on local

ahseiitee voting:

SECTIOtT 1. Delinition of terms, - the following terms are liereljy definet!as follows:

a) Local absentee voting - refers to a system of voting whereby govemnieiitofficials and employees, including members of the Armed Forces of thePliilippines (AER), and liie Philippine National Police (PMP) as well asmembers of the media, media practitioners including their leclinical andsupport staff (media voters) wlio are duly registered voters, are allo\ved tovote for nallonal positions; i.e.. President, Vice-President', Senatoi's and I'arly-List Representatives, in places where Ihey are not registered voters l)iiL "wiierethe}' are temporarily assigned to perform election duties on election da}', oi* incase of media voters, they will not be able to vote due to the performance oftheir fiuiclions in covering and re])orting on tlie elections;

b) Media —lefers to those who are engaged in news importing on a nationwideor local scale, including correspondents of national, regional, provincial, city,or municipal publications or broadcast entities, or those engaged in otherforms ofjournalism and their technical and support staff.

a) government officials and employees;

b) mejnbers of tiie PNP;

c) members of Lbe AFl^; and •

d) members of Lbe media, media practilioners inchiding their leclinieal andsupport staff who are actively engaged in the pursuit of informaliongathering and reporting or distribution, in any manner or form, including,but not limited to the following:

w 1. Pi'intJournalists;2. Television JoiirnEilists;3. Pliolo Journalists;4. Online Journalists;5. Radio Journalists;6. Documentary makers;7. Television/Radio Production;

provided that a) they are duly registered voters and whose registration records are notdeactivated, and hj 011 election day, in case of government officials, iiienihers ofthe ENP ami AIT^, they are assigned temporarily to perform election duties in placeswhere they are not registered voters; or in case of media voters, they will no! he ableto vote due to the performance of their functions in covering and re]X)iling on theconducl of elections.

VAn Government officials and emplo3'ees who will be posted abroad to performelection duties on election day may also avail of local absentee voting, provided, lliatthey are registered voters under Republic Act No. 8189, otberwise known as "TbeVoter's Registration Act of 1996" and that the};' are not I'egistered overseas absenteevoteis under Republic Act No. 9189, otherwise known as "The Overseas Absentee VolirigAct of 2003".

SEC. 3. Where and when to file the application forms to avail of thelocal absentee voting. ~ Ap[dicants who will avail of the local absentee voting shallfile their duly accomplished Application Forms (lAV Form No. Oi) at and on thefollowing:

In cities outside NCR where tliere are more than one (i) OBices ol City ElectionObicevs (OCEO), the Regional Election Director (RED) shall immediately designate notlater than January 18, 2016 the OCEO which shall receive the applications to avail oftile local absentee voting. For this purpose, the RED concerned shall submit to theCommittee on Local Absentee Voting (CLAVh through the Acting Director IV, ElectoralContests Adjudication Department (ECAD), ihe list of designated OCEO/s.

Sec. 4. Date and Place of "Voting. - Local absentee voters shall vole on anyday fiom April 27, 28 and 29, 20)6 from 8:00 o'clock in the morning until5:00 o'clock in llie afternoon.

^ The EID shall cause the Avidest disseniinalion of education and informalionmaterials relative to the conduct of the local absentee voting S3'steni to all governmentofficials, the A.FP and PNP as well as to the media.

The ITD shall provide the CLAV with the updated Nalional hist of RegisteredVoters (NLRV) and other technical assistance in the verification of registered voters.

SliC. 7. Powers and Functions of the CI^V. - 'I'he CLAV, through the hAVGroups, shall supervise the liiiplementation of the local ahsentee voting, and shall havethe following powers and functions;

a. Distribute copies of Application Forms (LAV Fonn No. 01) to allgovernment agencies, AFP, PNP, media entities^ corporations orinemhei's of ihe media concerned;

I). Receive accomplished Application Imrins (L/iV Form No. 01)together with Certified Lists of Applicants (LAV Form No. 02) forlocal ahsentee voting not later than March 10, 2016;

c. Verify whether the applicants are eligible for local absentee voting notlater than April 15, 20i6;

d. Prepare the last of Approved Applicants for Local Ahsentee Volingwith Minutes of Voling (TAV Fo7*i/i No. 04) [leroffice/unit/baLLalion/OCFOs/OPES/ORFD-NCR;

0. Send Notices (l^iVFoj-iji No. 08) to all Municipal/City/District EOsconcerned before elections not later than April 20, 2016, {;opyfurnished the FES, of the names of voters who are registered in theii-respective Municipality/Cily/District and who will avail of localabsentee voting, as soon as llie aforementioned list is prepared for saidEOs to annotate in the Election Day Computerized Votei-s List(EDCVL) that said voters are voting through the Local Ahsentee VotingSystem ;

For this purpose, the concerned Municipal/Ciiy/District EOs shallsubmit within five (5) days from receipt of the above iiotice a report tothe CLAV of Iheir compliance Iberelo.

f. Transmit the following to all conceined heads ofoffices/supervisovs/commanders or officers next-in-rank/CEOs/PES/RED-NCR, not iatei- than Ax^ril ai, 2016;

(i) last of Approved Applicants for Local Ahsentee Voting withMinutes (TAVForm No. 04)] and

(ii) The exact nnmher of local absentee hallols, innei- and oiitei'envelopes and paper seals corresponding to the nuinl)er ofapproved applications.

g. Receive under proper receipt and take custody through the Recejilionand Custody Unit Q^CU), the envelopes containing tlie accomplishedlocal absentee ballots and other related docunienis from the heads ofoftices/siipervisors/commanders or officers next-iiwi-ank, the CEOs,PES, or the RED-NCR, as the case may he, on or before 7:00 o'clockin tlie evening of 9, 2016;

ii. Verily wlietlier llie number of envelopes containing the accoinplisiiedballots is equal to the number of signatures affixed in the list subinilteclby the heads of offices/super\nsors/conimanders or officers next-iii-rank /the CEO/PES concerned or the RED-NCR, as the case may be.

If there are more envelopes containing the accomplished ballot thanthe signatures affixed on the list, set aside the eiwelope of tlie votei'

VN whose signature does not appear in the list and place the same in aseparate ballot box intended for the purpose. Such fact shall beindicated in a report to be prepared by the LAV Group concernedwiiich sliall be submitted to the CLA\C Said ballots sliall not becounted;

If there are more signatures affixed in the list than the number ofenvelopes received, such fact shall likewise be indicated in the report tobe prepared by the I.AV Group wliich shall be submitted to the CLAV.The report shall indicate the names of tlie voters whose signaturesappear in the list", but without corresponding envelopes, lii this case,the CIAV, through the Head of the LAV Group concerned, shall directthe heads of offices/supervisors/commanders or officers uext-in-rank,the CEO/PES concerned or the RED-NCR, as the case may he, totransmit the envelopes of said voters;

After receipt and verification thereof, turn-over tlie same includingother elecLion documents to the RCU;

i. Supervise the counting of ballots and canvassing of votes;

j. Receive for safekeeping all ballot boxes containing the coniited ballotsand I'elated election documents from the SBEIs and Special Board otCanvassers (SBOC) for local absentee voting;

Ic. Send Notices (lAV Form No. oS-A) to all lVlunicipal/Cit3'/DistrictEOs concerned after elections but not later than June 30, 20j6 of thenames of voters who actually voted under tlie local absentee voting forupdating of their voting records;

For tills purpose, the concerned Municipai/City/Dislnct EOs sliallsubmit within five (5) days from receipt of the above notice a repoi t tothe CLAV of their compliance thereto; and

Perform and exercise such other functions and powers as may benecessaiy for the proper implementation of the local absentee votinglaw.

SEC. 8. Procedures for filing of applications to avail of local absenteevoting. —

a. All persons ^vlio may avail of the local absentee voting as providedtmdei" Sec. 2 hereof shall file their duly accoinplisiied ApplicationForms (LAVForm No. oO as provided for under Sec. 3 hereof.

All application forms shall be under oath. For this purpose, the headsV of offices/supervisors/commaiulers or officers next-in-raiik may

iv) the Provincial Election Supervisoi' for areas other than thosementioned above.

The application forms may be reproduced or downloaded from theofficial COMEl.EC \vebsile at \m\v.comelec.gQv.ph.

b. The heads of offices/supervisors/commanders oi' officers next-in-rank, shall receive all accomplished and subscribed application foi nisfrom their respective personnel.

In case of media voters, the CEO or PES concerned, or the RED-NCR,shall receive all accomplished and subscribed ai)plication formstogether with Certified List of Applicants (lAV Form No. 02)accomplished by the heads of the media entities to whom theapi)licants belong;

• c. The heads of offices/supervisors/commanders or officers next-in-rankshall prepare a Certified iJst of Applicants (LAV Form No. os) undertheir supervision or command who submitted their accomplishedapplication forms for local absentee voting indicating therein IheMunicipality/City/Disti'ict, barangay and precinct number where theyare registered and the place of their assignment on election day, with acertification that the applicants will be re-assigned on election day toperfoim election-related duties; or in case of media voters, that theymay not be able to vote due to the performance of their functions ofcovering and reporting the conduct of elections;

d. Not later than March JO, 2016, the heads of offices/siipervisois/commanders/officers iiexL-in~rank, the CEO or PES concerned orRED-NCR, as the case may be, siiall submit directly to the CLAV eithei*by peisonal service or private courier, the following:

(i) A Certified List of Applicants (1\AV Form No. 02) imdei- theirsupervision or command who siibmitled their accomplishedapplication forms for local absentee voting indicating therein theMunicipalily/Cily/District, barangay and precinct number vvhei'eIhey are registered and llie place of their assignment on eleclionda}', with a certification that the applicant/s will he re-assigned onelection day to perform election-related duties; or in case of mediavoters, that they may not be able io vote due to Ibe performance oftheii' fnnctions of covering and reporting (be conduct of elections.

SbC. 9. Veriiicaliou of registrations of applicants bir local absenteevoting. - Upon receipt of the Certified List ofApplicants (LAV Form ATo, 02) and Lheaccomplished Application Forms (t^V Form No. 01), the CLAV shall verify from theNational List of Registered Voters (NLRV) provided by the Tnformation and TechnologyDepartmeiil (ITD), COMELEC \vheLher the applicants are regisleied voters, andgenerate a Report thereon (LAVForm No, 03).

Only the applications of individuals \vhosc names aie in the NLf^V shall beaptn'oved by the CLAV.

The CLAV shall prepare a f.ist of Approved Applicants for l.ocal Absentee Votingwith Minutes of Voting (LAV Form No. 04).

Once approved, applicants should ensure that they \vill vote on any day li'omApril 27, 28 and 29, 2016 as lliey are already included in the certified list of localabsentee voters and tbat in the Election Day Computerized Voters iJst (EDCVIO, tbeyare indicated as voting llirough local absentee voting system.

In case of double or multiple voting, the applicant shall be charged wllh anelection offense as defined under paragraph z, subparagrapli 2 of Sec. 261 of theOmnibus Election Code and shall be recommended to be adminisLrati\'ely charged, ifapplicalile.

SEC. 10. Disapproval of the appliealion lo avail of local absenteevoting. - The application Lo avail of local absentee voting shall be disapproved on thegrounds lliat;

a. the names of llie apfdicants are not found in the NLRV;

1). the application was filed out of lime;

0. the application is not under oath;

d. the application is only a p!iot:ocop3Vlacsiniile copy; or

e. the Certification portion of the certified list is not duly accomplished.

For this purpose, the CLAV shall notify llie heads ofoffices/snpervisors/conimanders or officers next-in-rank, the CEO or I'ES or the RED-NCR who shall in turn iiotJfy the concerned applicants on the disappi'oval of theirapplication to avail of the local absentee voting (LAV Form AUy. oq) providedhinvever, that for items c, d and e above, tlie application forms of those found to beregistered voleis may be comideted/complied wit;h and submitted back to ClAV on orbefore l.he deadline of preparation of the list of qualified local absentee voters on April15, 20J6.

SEC. 12. Securily envelopes for local absentee ballots. -- Ihere shall bel;vvo (2) securily envelopes for each local absentee ballot, namely; an outer envelope andan inner envelope.

The inner envelope shall contain the accomplislied official ballot and shall notbear an}' other mark except an indication that it is a special envelope for a local absenteeballot.

The outer envelope shall bear a serial number and a space for the name t)f thevoter. The detached coupon and llie inner envelope shall be placed inside the outerenvelope.

SEC. i.q. Distribution of local absentee ballots, envelopes and paperseals. - On any day from Ain-il 27, 28, and 29, 2016 from 8:00 o'clock in themorning until 5:00 o'clock in the afternoon, the heads ofoffices/supervisors/commanders concemed, under the direct supervision and presencevofxbhe Municipal/Cily/Oistrict EOs or tlieir repiesentatives, or in case of media voters,the CEOs/PES or RED-NCR or their representatives, siiall distiibute llie local absenteeballots, inner and outer envelopes, and paper seals to the qualified local abseiilee voters.During the distribution, they sball:

a. l^eqnire the voters to affix their signatures opposite their names in theList of Approved Applicants for Local Absentee Voting with Minutes ofVoting (IjAVForm No. 04) piepared by the CloAV under Section 9hereof;

b. Detacb one (.1) ballot from the pad of ballots and retain the stubs wherethe serial number of each ballot api")ears;

c. Write the serial numbers of the [)a]]ot, outei* envelope, and of the two(2) paper seals opposite the names of the votcj s in llie spaces providedin the list;

d. Give to the voters the ballot, inner and outer envelopes and the two (2)paper seals; and

a. liislruct the voters to immediately accomplish the ballot in accoidancewith Seclioii jq hereof.

SEC. 14. Manner of Voting. —The local absentee voters shall:

a. Fill up the ballot secretly;

b. Imprint Llieir thumb marks on the proper space in the detachablecoupon of tlie ballot;

c. Detacli Ihe coupon from ihe ballot and place the same inside the outerenvelope;

d. Place the accomplished ballot inside the inner enveloi)e and close andseal llie envelope with a paper seal;

e. Place the sealed inner envelope inside the outei* envelope, which shalllikewise be sealed with a paper seal;

f. Write their names on the space provided for in the outer envelope; and

g. Submit the sealed envelope to the heads ofoffices/supervisors/coinnianders oi* officejs next-in-rank,Miuiicipal/Cit3'/0istricl' EOs, the PES concerned or RED-NCil, as thecase may be.

I'be heads of offices/supervisors/commanders or officers next-in-rank,Municipal/Cit3'/District EOs, the PES concerned or RED-NCR, shall ensure that the'Sahhtity of the voting process is preserved.

SEC. J5. Transniillal of local absentee ballots and other electiondociiinents lo the CLAV. After the voting, the heads ofoffices/supervisors/commanders or ofh'cers next-in-i'ank, the CEO or PES concerned orthe RED-NCR, as the case may be, shall:

1. Gather all the sealed envelopes containing the ballots submitted tothem by the local absentee voters;

2. Prepare, in two (2) copies, a Transinittal Cellcr (J^AV Fotiu No.of) with a cei Lification on the number of accomplished ballotscollected by them. They shall submit one (1) copy l;hereof lo llie CEAVand i-etain the other copy for their file;

\N3. Transmit the sealed envelopes, together with a) List of Ajiproved

Applicants for Local Absentee Voting with Minules of Voting (lAVForm No. 04) with signatures referred to in Section 13 (a); and b)'unused official ballots torn in half, to the CLAV by tlie fastest meansavailable c/o the Electoral Contests Adjudication Dei")artment (ECAD),COMELEC, 8'̂ ' Floor, Palacio del Gobernador Building, Inlramuros,Manila, ensuring that the ballots are received by the CIAV not laterthan 7:00 o'clock in the evening of Maj'^ 9, 2016.

After the local absentee voting period, the CLAV, through the LAV Groups, shallsend to all Mimicipal/City/District; EOs concerned a walLten Notice as lo who were thevoters who actually voted (lAVForm No. oS-A) under the si'stem of local absenteevoting with a direclive to indicate in the list of voters with voting records on the spaceopposite the names of the absentee voters, the following annotation: "voted llironghlocal absentee voting," to prevent the deactivalion of their legistraLion recoi'ds.

V SEC. ]6. ILeception and Custody Unit (RCU), duties and Ainctioiis. -Uie C\AV shall constitute an RCU, which shall:

a. Receive the security envelopes containing the accoiriplished ballots and theList of Approved Applicants for Local Absentee Voting with Minutes of Voting(TAVForm No. 04) with their signatures;

b. Forward the same lo the LAV group concerned for verification;

c. Place the verified envelopes containing the accoinplished ballots inside Iheballotboxes at the rate of four hundred ( |̂00) envelopes pej- ballot liox;

The ballot boxes, prior to the distribution to the SBPIs, shall be sto?ed In asafe and secured place; and

d. Deliver the ballot box iinmediatel}' at 7:00 o'clock in ihe evening of Ma}' 9,2016 to ihe Special Boards of Election Inspectors (SBEts) for counting;

Should there be a ballot box containing less than loin- Inindied b|0o)envelopes, the RCU shall equitably distribute said envelopes to the SBEFs.

SEC. 17. Special Boards of Eleclion Inspectors (SBEIs). - 'j1ie CbAVmay constitute as many SBEIs for local absentee voting as may be deemed necessaiy, tocount the local absentee ballots. The meinbei-s thereof shall be cliosen from among Ihepersonnel of the Electoral Contests Adjudication Department (ECAJO). In case of Inclc ofECAD personnel, the CLAV shall consliliite additional SBEIs from among the personnelof other departments/offices in the Main Office, Manila, not later than April 21, 20(6(lAVFormNo. 09).

To determine the number of SBEIs to be constituted, the CIAV shall use as basisthe total number of approved applications at a ratio of four Inmdred (qoo) ballots perSBEI. The order of nnmhering of SBEl shall be determined tbrongli a raffle. In case theCbAV constituted more SBEIs tlian what is retpiired, tlie SBEIs last in the oixler ofbiimbering maybe deactivated.

For every ten (jo) SBEIs, the chaii person of the CbAV shall designate one (j)supervisor wlio shall snt^ervise the coiinting, tabulation, i)reparation of Election lletnrns(ER) and other documents.

SEC. 18. Oalh of Members of SBEl. - Before assuming their office, thecliairperson and members of the SBEl shall take and sign an Oath (LA VVonu No. 10)before an}' officer aniliorized to administer oaths. Copies of the oath shall immediatelybe snlimitted to tlie CI-AV.

SEC. 19. Notice of Counting. - For the May 9, 2016 National and bocalElections, the CbAV shall give notice to all presidential, vice-presidential, senatorialcandidates, duly registered political parties or coalition of political pai ties which hasnominated national candidates, sectors and organizations participating under the partyjisl\system, and acci edited citizen's arm of the date, lime and ])lace of counting, at leastfive (5) days before the day of Ihe election.

SEC. 20. Proceedings of llie SBEI. - The SBEl shall meet at the placedesignated by the CbAV at 7:00 o'clock in Ihe evening of Maj'- 9, 20l6 to count tlievotes cast by the local absentee voters and shall not adjourn until the connling iscompleted. All proceedings of the SBEI shall be done in public. U shall act through itschairperson and all questions presented before it shall be decided Avithonl delay by amajorily vole of the members. During its meetings, not more tlian one (j) member shallbe absent at the same time, and in no case shall such absence be foi* more than twenty(20) minutes.

SEC. 2i. Manner of connling local absentee ballots. - Upon receipt of theballot box containing the security envelopes for local absentee ballots, Ihe SBEI shallproceed with tlie counting as follows:

During the coiinLing:

i. The Chairperson, the Poll Clerk and the Third Member shallposition themselves in such a wa3' as to give the Avatchers and diepublic an unimpeded view of the ballot l^eing read by theChairperson, as well as of the election returns and tally board beingsimultaneously accomplished by the Poll Clerk and die ThirdMember, respecLivel)'^;

j. The watchers and the public shall not loiicli any of the said electiondocuments. The table shall be cleared of ail unnecessary writingparaphernalia. Any violation hereof shall consLilule an electionoffense;

k. The Pull Clerk and the Third Member shall record simultaneouslyin the election returns and in the tally Ijoard, respectively, each voteas it is read. Each vote shall be recorded by a vertical line, exceptevery fifth vote Avhich shall be recorded by a diagonal line crossingthe previous four vertical lines;

1. The same procedure shall be folloAved Avitli the succeeding plies ofballots; and

m. The sub-total of votes in figures obtained by each candidate andV.w pai"t3^ list candidate shall be recorded in the election returns and

\ The proceedings of the SBET shall be recorded in the Minutes of Coiinling ofVotes (LAVForm No. ii) to be accomplished in two (2) copies which siiall bo placedin separate sealed envelopes to be distributed as follows:

a. The first copy, to the Election Records and Statistics Depai tmeiit(ERSD), this Commission; and

b. The second copy, to ])edeposited inside the ballol box compartmentfor valid ballots.

SEC. 22. ElecMoii Rcliirns. ~ The election returns shall be prepared in eight(8) copies to be distributed as follows:

a. The first copy, to be delivered to the Special Board of Canvassers forlocal absenfee voting;

1). The second copy, to the Congress directed to the President of theSenate;

c. The third cop}', to ihe Commission tlnongh the Electioji Recordsand Statistics Department (ERSD);

d. The fointh copy, to the dominant majority parly as determined bythe Commission;

e. The lifth copy, to the dominant minority i)arty as determined by theCommission;

f. The sixth copy, to the accredited citizen's arm;

SEC. 23. Post counting procedures. Upon terininalioii of the couiiling ofvotes, the members of the SBlil shall:

b. Seal the envelope witli paper seal and affix their signatures on thesaid paper seal;

c. Deposit the envelope properly sealed inside the ballot boxcompartment for valid ballols;

d. Place lhe eighth copy of the election returns inside the ballot boxcompartment for valid ballots;

e. Close the inner compaitments of the ballot box, lock wilh one (i)Comelec padlock and seal the same with one (i) fixed lengthsecurity seal;

g. Deliver the locked ballot box to the RCU of Lhe CLAV for custodyand safekeeping; and

li. Distribute the election returns in accordance with Section 22hereof.

SEC. 24. Special Board of Canvassers. —A Special Board of Canvassers(SBOC) for local absentee voting shall be constituted to be composed of ranking Iaw3'ersof ECAD and whose appointment shall be Issued by the Chairperson of Lhe CLAV notlater than April 30, 2016.

SEC. 25. Notice of Canvass. For Lhe May 9, 2016 Nalional and LocalElections, the Chairperson of the SBOC shall give noLice to its members, all presidenlial,vice-presidential, senatorial candidates, duly registered polilical party or coaliliou oftiolitical parties which has nominated national candidates, sectors and organizationsl^articipaling under the party list S3'stem, and accredlled citizen's arm of the date, limeand place ofcanvass, at least five (5) da3's before the day of lhe election.

SEC. 26.TabuJalion Group. - The SBOC shall coustituLe aTabiiialion Group,comtJosed of two (2) members, wliicb shall be under itsdirect supei visibn and control.

The Tabulation Group shall comtxite the sub-total of the Statement of Votesprepared by the SBOC. The name of each tabulator and the serial number of theStatement of Votes assigned to them for tabulation shall be properly recorded in theminutes of the proceedings.
