Prevention means temporary prohibition of person from exiting from the Territory of Indonesia based on particular Immigration reasons or others prescribed by the Law. (pg. 7)

49. Setiap orang yang masuk atau keluar Wilayah Indonesia wajib melalui pemeriksaan yang dilakukan oleh Pejabat Imigrasi di Tempat Pemeriksaan Imigrasi. (art. 9;par.(1))

51. Pejabat Imigrasi menolak Orang Asing masuk wilayah Indonesia dalam hal orang asing tersebut:a. namanya tercantum

dalam daftar Penangkalan;

b. tidak memiliki Dokumen perjalanan yang sah dan berlaku;

c. memiliki Dokumen Keimigrasian yang palsu;

d. tidak memiliki Visa, kecuali yang dibebaskan dari kewajiban memiliki Visa;

e. telah memberi keterangan yang tidak benar dalam memperoleh Visa;

Immigration Official will deny any Foreigner from entering to the Territory of Indonesia if:a. his/her name is entered

in the banishment list;

b. has no legal dan valid Travel Document;

c. has counterfeit immigration document;

d. has no Visa, except those exempted from the obligation to have Visa;

e. provides untrue information in obtaining Visa;

An Immigration Officer refuse entry into Indonesia to a foreigner, in case said subject is:a. watchlisted ;

b. Not in possession of a legitimate and valid travel document;

c. in possession of a false immigration document;

d. Not in possession of a visa except those falling under the category of visa exemption;

e. Supplying misinformation in order to obtain a visa;

f. menderita penyakit menular yang membahayakan kesehatan umum;

g. terlibat kejahatan internasional dan tindak pidana transnasional yang terorganisir;

h. termasuk dalam daftar pencarian orang untuk ditangkap dari suatu negara asing;

i. terlibat dalam kegiatan makar terhadap Pemerintah Republik Indonesia;atau

j. termasuk dalam jaringan praktik atau kegiatan prostitusi, perdagangan orang dan penyelundupan manusia.(art.13;par (1))

f. suffers from communicable diseases endangering the public health;

g. is involved in the international crime and organized transnational crime;

h. is listed as Wanted Person for arrest from a foreign country;

i. is involved in subversive activities against the Government of the Republic of Indonesia; or

j. is involved in the prostitution, trafficking and people smuggling network or practice. (pg. 13-14)

f. carrying contagious disease harmful to public health;

g. involved in International and Transnational Organized Crime Activity (ies);

h. listed as wanted person by a foreign country to be arrested;

i. involved in insurgery action against the Indonesian Government; or

j. on prostitution activity or practice networking human trafficking and people smuggling. (pg. 16-17)

52. Orang Asing yang ditolak masuk sebagamana dimaksud dalam ayat (1) ditempatkan dalam pengawasan sementara menunggu proses pemulangan yang bersangkutan. (art. 13; par (2))

c. memberikan tanda atau mengibarkan bendera isyarat bagi kapal laut yang datang dari luar Wilayah Indonesia dengan membawa penumpang;

d. melarang setiap orang naik atau turun dari alat angkut tanpa izin

Transportation Authority coming from outside Territory of Indonesia or going to leave Indonesia shall be obliged to:

a. prior to arrival or embarkation, notify the arrival or departure plan in writing or electronically to Immigration Official;

b. submit the list of passengers and list of crew of Means of Transportation signed by him to Immigration Official;c. make sign or hoist signal flag for vessel coming from outside Territory of Indonesia carrying passengers;

d. prohibit any person from getting on or off from the Means of Transportation without the permit of the Immigration Official before and during the Immigration check;

Transportation mode responsible on arrival from outside Indonesian Territory or on departure thereat should:

a. Prior arrival or departure inform arrival and departure plan in writing or electronic to the Immigration Officer on duty;

b. surrender passenger and crew manifest duly signed to the Immigration Officer on duty;

c. provide sign or flying the code flag for vessel carrying passenger from outside Indonesia;

d. Prohibit anyone to board or leaving the vessel without Immigration permission during examination;

h. menanggung segala biaya yang timbul sebagai akibat pemulangan setiap penumpang dan/atau awak alat angkutnya. (art. 18; par (1))

e. prohibit any person from getting on or off from the Means of Transportation after the Immigration check, while waiting for departure;f. immediately take out from the Territory of Indonesia on first occasion, any Foreigner not meeting the requirements with his or her Means of Transportation;

g. assure that the Foreigner presume of or suspected to enter the Territory of Indonesia illegally not to get off from his Means of Transportation; andh. bear all costs arising as the consequence of returning of each passenger and/or crew of his Means of Transportation. (pg. 16-17)

e. prohibit anyone to board or leaving the vessel after having been issued Immigration clearance and pending departure;

f. transport back out of Indonesia at the first availability any foreigner not complying with the requirements on arrival with the related vessel;

g. to assure a suspected foreigner on illegal entry to Indonesia, not to leave the vessel;

responsible for all costs incurred as a result of passenger repatriation and/or its crew; (pg.19-20)

Immigration Area means certain area that can only be passed by the passengers or crew of Means of Transportation who will exit from or enter the Territory of Indonesia or by authorized official and personnel. (pg. 19)

Immigration Area is a restricted area only to serve passenger or crew for entry into and leaving Indonesia or for competent authority and officer as well. (pg. 21)

61. Kepala Kantor Imigrasi bersama-sama dengan penyelenggara bandar udara, pelabuhan laut, dan pos lintas batas menetapkan area imigrasi sebagaimana dimaksud pada ayat (1) (art. 22; par.(2))

Temporary stay visa shall be issued to Foreigners:

a. as clergyman, experts, workers, researchers, students, investors, elderly and families and Foreigners legally married to an Indonesian national, who will travel to the territory of Indonesia to stay for the limited period, or

b. to join to work on vessel floating devices or installation operating in Indonesian waters, territorial sea, continental shelf, and/or the Exclusive Economic Zone of Indonesia (pg. 26)

Limited Stay Visa provided to a foreigner as:

a. clergyman/religious profession, expatriate, worker, research, student, investor, oldaged people and family and legal married foreigner with Indonesian national to conduct travel to Indonesia and to remain in Indonesia for a limited periode; or

b. Joinship to work aboard a vessel, floating mode, or Archipelagic Waters, installation operational in Continental Shelf, and/or Indonesia Exclusive Economic Zone. (pg. 28)

The application for Visa shall be denied in case the applicant:a. has name listed in the banishment list;b. has no legal and valid travel document;

c. has no sufficient living cost for himself and/or his family during staying in Indonesia;d. has no return ticket or continuation ticket to go to another country. (pg. 27)

Visa application is rejected on grounds of:

a. applicant is watchlisted;

b. not in possession of valid and Legitimate Travel Document;c. Not enough having living substance for his/her own and/or family during stay in Indonesia;d. No retour or through ticket to proceed to another country. (pg. 29)

79. Orang asing yang dibebaskan dari kewajiban memiliki Visa sebagaimana dimaksud pada ayat (1) adalah:a. warga negara dari negara tertentu yang ditetapkan berdasarkan Peraturan Presiden dengan memperhatikan asas timbal balik dan asas manfaat;b. warga negara asing pemegang Izin Tinggal yang memiliki Izin Masuk Kembali yang masih berlaku;c.Nakhoda, kapten pilot, atau awak yang sedang bertugas di alat angkut; (art. 43; par. (2))

Any Foreigner exempted from the obligation to have visa referred to in paragraph (1) shall be:

a. citizen of particular country stipulated based on the Regulation of President by taking into account the reciprocity principle and benefit principle;b. foreigner as the bearer of Stay Permit having valid Re-entry Permit;

c. master, captain pilot or crew on duty in Means of Transportation; (pg. 28)

Any Foreigner detained in the interest of investigation, prosecution, and examination process in the court hearing or experiencing detention or imprisonment sentence in the penitentiary, while the stay permit expires shall not be subjected to the obligation referred to in paragraph (1). (pg. 31)

f. imposed Immigration Administrative Compliance;

92. Orang Asing tertentu yang berada di Wilayah Indonesia wajib memiliki Penjamin yang menjamin keberadaannya. (art. 63; par. (1))

b. collection of data on traffic, both for Indonesian national and foreigner entering to or exiting from the Territory of Indonesia.

Immigration Official shall have the authority to perform Immigration Administrative Measures agains Foreigner residing in the Territory of Indonesia to carry out the dangerous activity and reasonably presumed of endangering the public security and order or disrespecting or disregarding the legislation. Immigration Officer is competent to implement Immigration Administrative Compliance against a foreigner in Indonesia doing harmful activity and suspected dangerous to security and public order or disrespect or disobey the prevailing legislation. (pg. 45)

108. Tindakan Administratif Keimigrasian berupa Deportasi juga dapat dilakukan terhadap Orang Asing yang berada di Wilayah Indonesia karena berusaha menghindarkan diri dari ancaman dan pelaksanaan hukuman di negara asalnya. (art. 75; par. (3))

113. Orang Asing pemegang Izin Tinggal yang telah berakhir masa berlakunya dan masih berada dalam Wilayah Indonesia kurang dari 60 (enam puluh) hari dari batas waktu Izin Tinggal dikenai biaya beban sesuai dengan ketentuan peraturan perundang-undangan. (art. 78)

Any Foreigner being the bearer of Stay Permit expiring and still residing in the Territory of Indonesia for less than 60 (sixty) days as of the expiration of Stay Permit shall be subjected to the charges subject to the provisions of legislation. (pg. 45)

Expired Stay Permit holder foreigner and still present in Indonesia less than 60 (sixty) days of its stay permit timelimit will be imposed surcharge fee conform with the prevailing legislation. (pg. 46)

c. exercise first compliance at place of incident (locus delicti);

d. prohibit any person to leave or enter at place of incident for indictment process;

e. call, examine, search, apprehend, or detain an individual suspected to commit Immigration crime;

m. Meminta keterangan dari masyarakat atau sumber yang berkompeten;

n. Melakukan penghentian penyidikan; dan/atau

o. Mengadakan tindakan lain menurut hukum. (art. 106)

h. examine or confiscate letters, document or other material connected with the Immigration crime;

i. call someone to be examined and taken testimony as suspect or witness;

l. take suspect picture and fingerprint;

m. collect public information or other competent source;

b. Dengan sengaja membocorkan data Keimigrasian yang bersifat rahasia kepada pihak yang tidak berhak sebagaimana dimaksud dalam Pasal 67 ayat (2) dan Pasal 68 ayat (2) dipidana dengan pidana penjara paling lama 5 (lima) tahun; (art. 133; letter a-b)

Article 120, Article 121, Article 122, Article 123, Article 126, Article 127, Article 128, Article 129, Article 131, Article 132, Article 133 item b, Article 134 item b and Article 135 reasonably known by him shall be punishable with imprisonment sentence up to maximum of 5 (five) years;

b. Intentionally divulging the confidential data on Immigration to the unauthorized parties referred to in Article 67 (2) and 68 (2) shall be punishable with imprisonment sentence up to maximum of 5 (five) years; (pg. 72)

150. Setiap orang yang melakukan perkawinan semu dengan tujuan memperoleh Dokumen Keimigrasian dan/atau untuk memperoleh status kewarganegaraan Republik Indonesia dipidana dengan pidana penjara paling lama 5 (lima) tahun dan pidana denda paling banyak Rp. 500.000.000,00 (lima ratus juta rupiah). Any person solemnizing dummy marriage with intention to obtain Immigration Document and/or to obtain nationality status of the Republic of Indonesia shall be punishable with imprisonment sentence up to maximum of 5 (five) years and/or penalty up to maximum of Rp. 500,000,000.00 (five hundred million IDR). 151. Permohonan Dokumen Perjalanan, Visa, Izin Tinggal, Izin Masuk Kembali dan biaya beban berdasarkan Undang-Undang ini dikenai biaya imigrasi. (art. 138; par. (1))
