PUBLIC PARTICIPATION. Members of the public raised the following issues: That the 30 mph speed restriction on the A51 be relocated near Iddenshall Nursing Home. A sunken grid on the A51. That the three warning signs on the approach to the 30 mph limit had been removed and should be replaced. That there should be a 30 mph speed limit on Willington Lane. It was reported that the whole of Clotton would be covered by high speed broadband this summer and the problem of the waterlogged cabinet had been corrected. Surface water from Cinder Lane was running on to an adjacent property and causing flooding. Over grown hedge at the junction of Willington Road and Cinder Lane. Cllr Deynem reported Cheshire West Council were reassessing the speed limits on the A51

41. ACCEPTANCE OF MINUTES Resolved unanimously that the meetings on 9 January and 27 February 2017 be accepted as circulated and signed by the Chairman as a true record.

PLANNING The planning register was accepted by council as circulated. Council considered an email from a resident regarding the unlawful habitation in a static caravan in the field between Brookfield House and Brook Cottage, Cork Screw Lane, and agreed to report the resident’s concerns to the Cheshire West and Chester Councils Planning Enforcement Officer.

NEIGHBOURHOOD DEVELOPMENT PLAN Resolved unanimously Thomson Partnership be appointed adviser to the Neighbourhood Plan Group subject to references. Council agreed that the clerk in conjunction with Thomson Partnership, prepare a detailed agenda for general circulation before the scheduled NDP meeting on Tuesday 28th. March 2017.

HIGHWAY ISSUES Resolved unanimously that the Clerk, following discussions with the Chairman and Cllr Platt, sends a letter to a senior officer in Cheshire West Highways department raising the following : 1) Can the 30 mile speed limit on the A51 from Tarporley commence on the Tarporley side of Iddenshall Hall, the care home for elderly and those with dementia? 2) Can the warning signs of the approaching 30 mph area be reinstated at both entries to the 30 mph area (as there was until recently)? 3) When will the surface to the A 51 through Clotton be either repaired or ideally renewed? Other issues that have been raised by the residents as the frustration levels increase. 1) Can the speed limit on Willington lane be reduced? 2) Can restrictions on Corkscrew Lane be introduced? 3) There is flooding off the fields at the Willington Lane end of Cinder Lane. The letter to be copied to the Ward Councillors, MP and published on the website. Community Speed Watch Ian Rutherford, Road Safety Officer Cheshire West has approved 3 sites for the ‘Speed Indicator Device’ (SID)

VILLAGE WELL Council agreed that the clerk establish if detailed plans of the well site are available and then proceed to instruct a solicitor to give council a definitive answer on the possibilities of registering the Well and the cost and process to do so.

Introduction - Andrew Thompson gave a brief résumé on Neighbourhood Development Planning, the background, actions and timetable* The circulated Constitution* as accepted by the Parish Council was discussed. Andrew also touched on the Evidence required, the Consultation we need and funding. It was agreed that Duddon Parish Council would be approached before the next meeting to establish if they were interested in joining us, so that the area covered by the Plan could be established. Election of Chairman Proposed by Chris Prescott, Seconded by Jacqui Baker, Peter Manby was elected Chairman. Request for neighbourhood area by the Parish Council needed. JB to send toolkit link to Chris (chairman of PC) to request approval for the agreed neighbourhood area. Chris to request permission of the PC to make application to CWaC for neighbourhood area.

Clotton Hoofield sits under STRAT 9 (details to be circulated by JB). Duddon falls under STRAT 8 and is classified as a local service centre, therefore is faced with different issues and pressures.

Funding Apply for funding when neighbourhood area has been approved. £9,000 max, to be applied for in smaller chunks. Initial funding application to be completed by JB and AT when budgets have been prepared.

Publicity Flyer to be prepared and circulated to the community (including summary of results from recent A51 speed/traffic research). HIGHWAYS Clotton Community Speed Watch April 2017 Motorists travelling at excessive speed through neighbourhoods is one of the most common issues raised with Local Authorities and Parish Councils, and has an impact not only on road safety but on the quality of life for those residents who endure it. Community Speed Watch through the villages of Clotton and Duddon on the busy A51, was undertaken by a group of volunteers through the month of April in order to both raise awareness of the levels of speeding and help reduce traffic speeding through the villages. Working within the community to help control the problem locally, factual data was collected for further investigation with the purpose of finding an acceptable solution to reduce the number of speeding vehicles along the stretch of road between the roundabouts at Tarvin and Tarporley. The Community Speed Watch scheme is currently operated throughout Cheshire, and is supported by Clotton Hoofield Parish Council, Cheshire West and Chester Council, and Cheshire Police. The Community Speed Watch program aims to check the speeds of vehicles within a 20/30/40 miles per hour speed limit and seeks to promote safer driving in the local community by educating rather than by prosecuting individuals. It was therefore decided not to record vehicle registration numbers but simply to collect data to inform the group and other interested parties (such as Clotton Parish Council) in making future decisions and also to The Community Speed Watchers were trained by an appropriately qualified person in the use of the speed indication equipment, and was given advice regarding conflict resolution. High Viz jackets were worn by all personnel undertaking Speedwatch duties. Identified and assessed areas were targeted only during the hours of daylight. Area 1 was centrally placed just outside the Bulls Head Pub, Area 2 at Duddon in close proximity to the primary school and Area 3 outside Tarporley Gates on the South Eastern side of the village. Sessions were organised and data gathered noting the date, time of the day and weather conditions, then types of vehicles using the road and the individual speed of each vehicle was recorded. Alternate hours and days of the week were used for the recording. This was completed over a 4 week period during the month of April.

Analysis of Data Week 1 / Area 1 outside the Bulls Head Pub At this location it was observed that vehicles were often slowed down by other vehicles turning into and out of Corkscrew Lane. Although this was also seen to cause numerous near misses as vehicles braked quickly form their excessive speed, It was suggested a mirror positioned across the road from Corkscrew lane would help those trying to turn right from that road. A very nasty accident occurred outside the pub on Day 2 of the Speedwatch when a vehicle waiting to turn into the pub carpark was hit by the vehicle waiting behind when if had been hit by a speeding vehicle coming from Tarvin towards Tarporley. The Speedwatch had to be abandoned as a result of this accident. A near miss was recorded when a Boughey lorry (travelling too fast), very nearly hit the back of a vehicle turning left onto Corkscrew Lane.

We recorded on average 488 vehicles an hour using the road with the breakdown as follows 84% cars; 4% HGV; 9% Delivery 29% 0f the vehicles were speeding over 30mph 4% of these were travelling at speeds at or over 36mph = 325 vehicles Week 2 / Area 2 At the Duddon End of the A51 close to the Primary School The area allocated was on a long stretch of road and it was noted that cars reduced their speed as soon as they could see the SID and observers. The average number of vehicles per hour was 486, 5% were HGV’s 10% delivery vehicles Vehicles travelling over 30mph accounted for 22% of the total volume of traffic. 3% of these were travelling at speeds 36 mph or over. 183 vehicles Making a comparison between the manually collected data from Speedwatch and the Council’s electronic data at the same time of the day, we can see a marked difference in those exceeding the 30mph (40-55% as opposed to 22%) This can only be down to the fact the when drivers have visible signs that their speed is being checked they slow down. The average number of vehicles per hour was 566 78% were cars; 7% were HGV’s; 14% were delivery vehicles 47% of the vehicles were travelling over 30mph 16% of these were travelling at speeds greater than 36mph a total of 1682 vehicles recorded. The evidence from our recording of data just inside the 30mph limit shows that people were travelling at high speeds well into the 30mph limit and also picking up speed very rapidly before leaving the village (towards Tarporley) This may well be that they can see a 50mph sign and are accelerating towards it when still in the 30mph limit. One of the issues we felt was that the 30mph sign was positioned just after a bend and drivers could not easily see the 30mph sign until they were upon it. We were all in agreement that a much better positioning of the 30mph sign would be at the junction with Iddenshall Old Peoples Home and the Potato factory behind it. There is a good stretch of road before this entrance and drivers would be able to reduce their speed in sufficient time. This is being fair to both the drivers who use the road and the residents who live there. NOTE: Had we decided to take the registrations of all the cars speeding over 36mph this would have required 2190 notification letters to be sent out. 77% of these came from the South Eastern section of the road Main Points to be resolved

1. The high speed of vehicles in the South Eastern end of the village up to the 30mph limit has

major safety issues for all the residents living in that stretch and beyond, and well into the

30mph limit. Although we were unable to verify the speeds of vehicles over this stretch, and

particularly after checking vehicles in other areas, it is believed that vehicles were travelling in

excess of 50/60pmh and we have observed a number of cases where there was overtaking on

the double white lines. We have had a number of accidents in the last 12 months and very

many near misses . We have an 87 bed Old Peoples Home on a very fast stretch and a large

number of vehicles turning into and out of this. On Monday 24th April we counted 31

stationary vehicles in the car park. In addition to this directly behind the Old Peoples Home

there is a very busy potato factory. At noon on that day there were 20 vehicles in the yard and

in discussion with the owner he confirmed that in the busy season (July – October) there would

be between 200-300 slow vehicles turning into and out of the lane end.

2 The pervasive speeding in Clotton and Duddon. All of our evidence from the Speedwatch

campaign and that of the Council’s own data, shows that the speed limits are not being adhered

to. This causes many problems for the residents in the village including

A) Dangerous, close calls when leaving and entering their premises,

B) Aggressive and intimidating driving, particularly by HGV’s especially when residents are

adhering to the speed limit,

C) Difficulty in crossing the road especially for the elderly and less able bodied.

D) The fact there isn’t a footpath on one side and it is very uncomfortable using the footpath

on the other side because vehicles come so close, so fast and in wet weather soaking the

pedestrians. This leads to village severance and people not visiting neighbours, family or

friends,

E) It’s unsafe for children and animals

F) Always living with the fear that another accident will occur.

3 HGV’s There are a large number of HGV’s using the road as a shortcut between the M6 at

junction 16 and the A55 to North Wales and Holyhead and now exacerbated by the upgrading

of the M6 to a ‘smart’ motorway. Many of these HGV’s are exceeding the speed limit at all

times (as recorded), and particularly during the hours of darkness when as the (Council) data

shows there are a large number going well in excess of the speed limits, and rattling through

the village all through the night. The council data showed that the highest percentage of the

volume of vehicles speeding was 86% between 3:00 – 4:00 in the morning and 68% of the

volume of vehicles going through were HGV’s. This causes severe damage to the road and

damage to people’s houses; in fact there have been many reports of houses shaking when

vehicles go past and major noise pollution which is causing sleep deprivation for the residents

of the two villages. Although it hasn’t been measured yet it is likely that there is emission

pollution as well. Everybody spoken to on the road has been affected by these issues with

some saying that this is making their life intolerable. In a rural community this is

unacceptable.

4 Accidents and Damage to Property

There have been a large number of accidents along the road from Tarporley to Tarvin roundabouts over a very long period of time (police records). In the first week of Speedwatch there were 4 accidents (two where the police were involved) and one near miss. Week 2 started with an overturned HGV and car accident at the Tarporley roundabout. Weeks 3 and 4 were thankfully without incident. Residents daily observe drivers becoming aggressive, HGV’s intimidating drivers and vehicles speeding up behind others who are adhering to the speed limits for the road. Crossing the road is very difficult. There are no designated crossing areas along the road at all. You have to run to the other side before another vehicle comes around

the corner. Elderly people and those with any disability have serious problems crossing to the other side. It is strongly felt that if no action is taken to either reduce the number of speeding vehicles, there will be more accidents, potential fatalities, damage to vehicles from the road surface and damage to the houses from vibration.

The Speedwatch group is committed to ensuring the voice of the residents of Clotton and Duddon are heard and will be exploring all avenues to get a reduction in speed along the A51. They will be working closely with the Parish Council and information will be shared to inform the Neighbourhood Plan. This could well take the form of calming measures being introduced, but at present we are waiting for a re-assessment of the area outside Iddenshall Old Peoples Home before taking any further action. This is to take place in May/June 2017. In the meantime we will be taking opinion from more people in the community and looking into how other communities have successfully tackled similar problems of their own.

Letter sent to Highways 29th March Copy not available Reply from Cheshire West Highways Dear Richard Thank you for the letters of 2 February and 29 March regarding issues within the Parish, my sincere apologies for the delay in you receiving a response. The A51 has regular safety inspections carried out through the year to ensure that any defects which require immediate attention are dealt with. I have also arranged for the network steward who covers the area to carry out a more specific inspection to also look at all the more wider issues which you raised such as blocked drains, vegetation on footways, signage and markings. Any issues which he finds which require immediate action will be dealt with and we will also consider whether any section of the road are appropriate to be put forward for assessment in the summer for next year’s structural maintenance programme. I understand that Dave Reeves met with you recently and discussed many of the issues you raised on the most recent letter to me particularly regarding the speed limits.

1. A speed limit assessment is being undertaken by Dave. 2. I understand that further discussions are being carried out with local Members but should you

wish to request a speed limit assessment be carried out, if the PC and/or Members are happy to part fund the implementation if the criteria is met and assessment can be carried out please confirm in writing to me.

3. I understand Dave explained that these are not authorised signs and cannot be replaced but he also discussed the possibility of 40mph buffer zones being considered

4. Covered above inspections are underway. 5. Again an assessment can be carried out if the PC are happy to part fund any reductions which

are considered to meet the criteria. 6. I understand Dave covered this issue if you need anything further please let me know. 7. I will arrange for this to be investigated.
