Anita Pennel, Fair Board Treasurer, updated the Board on the 2017 Cheyenne County Fair. Fair Board member Jason Juracek was also present. 8:45 A.M., Chairman Johnson opened the public hearing to review and con-sider approval of an appli-cation for a Conditional Use Permit from 5 X 5, LLC, to mine gravel from an open pit mine in an A Agricultural zone located in the East Half of Section 22, Township 17 North, Range 52 West of the 6th P.M., Cheyenne County, Nebraska. Cheyenne County Planning and Zoning Administrator Colleen Terman was pres-ent. The Planning and Zoning Commission met on July 31, 2017 and approved the application with the recommendation it be forwarded to the County Commissioners for final approval. After a review of the documentation and a discussion, a motion was made by Sanders, seconded by Miller to adopt Resolution 2017-12A approving the issu-ance of the Conditional Use Permit as presented. Deputy Treasurer Shelley Bowlin, in the absence of the County Treasurer, requested approval to turn over the Tax Sale Certificates to the County Attorney for foreclosure on the lien of all taxes delin-quent, whether regular or special, on all real estate within Cheyenne County, Nebraska, remaining unsold and Certificates of Tax Sale be issued thereon. A motion was made by Sanders, seconded by Miller to adopt Resolution 2017-13 authorizing the County Treasurer to turn over the Tax Sale Certificates to the Cheyenne County Attorney for foreclosure. This claim was denied because it was not a requirement in the per-formance of the job. The next claim to be denied was #1708587 to Wheat Belt Public Power District in the amount of $6,088.39. Of the $6,088.39, $4,253.27 for the payment of electricity was approved. The remaining $1,835.12 was for repair on the arena lights at the fairgrounds. The Board reviewed a Management Representation letter from Donald Wilson regard-ing the County audit for the period of July 1, 2016 through June 30, 2017. County Attorney Schaub had reviewed the letter and recommended approval. A motion was made by Miller, seconded by Sanders to approve the Management Representation letter from Donald Wilson as reviewed. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None.

Next, the Board reviewed a Management Representation letter from Troy L. Hilyard regarding the Keno audit for the peri-od of July 1, 2016 through June 30, 2017. County Attorney Schaub had reviewed the letter and recommended approval. A motion was made by Miller, seconded by Sanders to approve the Management Representation letter from Troy L. Hilyard as reviewed. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

The Board discussed the possibility of conducting an auction of surplus property. County Attorney Schaub stated that, pursuant to Nebraska Statute 23-3115, the Board may authorize the sale of surplus prop-erty, other than mobile equipment, which is obso-lete or not usable by the County with a value of less than $2,500 without com-petitive bidding. Further, the Board may authorize the sale of surplus mobile equipment which is obso-

lete or not usable by the County with a value of less than $5,000, but it must be sold through competitive bidding.

Cris Burks, Weed Superintendent, addressed the Board regarding the procedure for spraying the roadsides. It was the deci-sion of the Board to spray the roadsides when a com-plaint is received.

At 8:30 A.M., Chairman Johnson declared the pub-lic hearing open to review the 2017-2018 Cheyenne County Budget.

The Board discussed increasing the 2017-2018 restricted funds revenues by an additional 1%. A motion was made by Miller, seconded by Sanders to adopt Resolution 2017-17 increasing the 2017-2018 restricted funds revenues by an additional 1%. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk.

Secondly, the Board dis-cussed setting the 2017-2018 Cheyenne County tax levy at .419891 which is different than the 2016-2017 Cheyenne County tax levy of .429714. A motion was made by Miller, seconded by Sanders to adopt Resolution 2017-18 setting the 2017-2018 Cheyenne County tax levy at .419891 which is differ-ent than the 2016-2017 Cheyenne County tax levy of .429714. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None.

The Board next reviewed and discussed the 2017-2018 Cheyenne County Budget docu-ments. A motion was made by Miller, seconded by Sanders to adopt 2017-19 appropriating the 2017-2018 Cheyenne County Budget. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

At 8:40 A.M., Chairman Johnson declared the Budget Hearing closed.

The Board reviewed Resolution 2017-20 regarding the transfer of funds from the County General Fund to the County Road/Bridge Fund. When the County budget for 2017-2018 was adopted on September 18, 2017, it included a transfer of funds from the County General Fund to the County Road/Bridge Fund in the amount of $1,665,019.00 to provide adequate fund-ing for the Road/Bridge Department. Accordingly, a motion was made by Miller, seconded by Sanders to adopt Resolution 2017-20 authorizing the County Treasurer to transfer the sum of $1,665,019.00 from the County General Fund to the County Road/Bridge Fund to provide adequate funding for that depart-ment. Further, one-half of the designated funds in the amount of $832,509.50 is to be transferred by December 31, 2017 and the remaining $832,509.50 is to be transferred by April 30, 2018. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk.

Next, the Board reviewed Resolution 2017-21 regarding the transfer of funds from the County Visitors Improvement Fund to the County Visitors Promotion Fund. When the County budget for 2017-2018 was adopted on September 18, 2017, it included a transfer of funds from the County Visitors Improvement Fund to the County Visitors Promotion Fund in the amount of $150,000.00 to provide adequate funding for the County Visitors Promotion Department. Accordingly, a motion was made by Miller, seconded by Sanders to adopt Resolution 2017-21 authorizing the County Treasurer to transfer the sum of $150,000.00 from the County Visitors Improvement Fund to the County Visitors Promotion Fund to provide adequate funding for that depart-ment. The designated funds will be transferred as needed to provide adequate funding for that depart-ment. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None. Diane Scott, County Treasurer, presented the Distress Warrants Report. There were a total of 109 warrants in the amount of $98,230.91. The total amount collected with additional

Connie Hancock, Extension Educator, informed the Board about a new program entitled Nebraska Innovative Maker Co-Laboratory. Also present were Extension Educator Karen DeBoer and Library Director Andrew Sherman. This program creates distance-based social interactions between learners and mentors. It explores the use of vir-tual tools to make physi-cal things in collaborative environments.

Doug Hart Highway Superintendent updated the Board on road activi-ties.

The Public Hearing is being held to discuss proposed chang-es to the Zoning Guidelines (Ordinance 275) to add Cargo Containers to the allowed Conditional Uses in the Residential 1 Zoning Districts. The change would permit the place-ment of Cargo Containers in areas zoned R-1 with the approval of a Conditional Use permit. An agenda for
