We are pleased to place this Work-Order/Contract/Agreement for providing services for Civil & Structural work with material and labour on Sq.ft basis to complete the entire Civil-work for the said project.

With issuing of this Contract/Work-Order/Tender/Agreement all previous written and verbal communications stands cancelled in the subject matter. Terms and Conditions mentioned in this Contract/Work-Order/Tender/Agreement are final and binding to all concerned parties. In this Contract/Work-Order/Tender/Agreement:

“Client, Employer or We” means M/s RVG Foundation, hereafter shall be referred as “RVGF”.

“Contractor, Vendor or You” means M/s XXXXXXXXXXXXXXXX, hereafter shall be referred as “XXXXX”.

“PMC, Nexus, Nexus PSPL or NPSPL” means M/s Nexus Project Solution Pvt. Ltd. Row House NO.4, Dheeraj Savera, Opposite Siddharth Nagar Borivali (East), Mumbai 400 066, hereafter shall be referred as “NPSPL”.

“Contract / Work-Order / Tender / Agreement” means “Civil Contract (M&L Basis)” contract documents issued to him/signed with him.

A) SCOPE OF WORK FOR CONTRACTOR:

The contractor’s scope of work includes all below mentioned works (with labour & materials both in scope of contractor):

1) Breaking of existing structures like Staircase-headrooms, Gym, Terrace-Parapet, LMR/Lift-shaft-top-slab, Terrace-

waterproofing, Foundations-of-Solar-System etc. all structures above the existing terrace-slab and Part-compound-wall (Front side compound-wall of the existing-building) will be in scope of contractor at his own cost. Reconstruction of the broken Front-side Compound-wall, at new suggested place as per architects’ design, is also in scope of contractor at his own cost.

2) Excavation for the reconstruction of front-side compound-wall, new UG-Tank, new RWH-tank and new Watchman-cabins to be done by contractor at his own cost.

3) Correction in the Basement (as per attached drawing), from what is existing at site, is in the scope of contractor without any extra cost to the client.

4) Correction in the Ground-floor (as per the attached plan), from what is existing at site, is in the scope of contractor without

any extra cost to the client.

5) Correction in Staircase, Lift-Lobbies, Lift-Shafts & Electrical-shafts (as per the attached plan), from what is existing at site, is in the scope of contractor without any extra cost to the client.

6) Leveling course as needed on excavated base:

a) Contractor to closely supervise excavation agency and get the desired levels done as required. Contractor to do the setting-out of building with total station-survey at his own cost, before excavation. He is required to closely supervise excavation agency and get the desired foundation levels excavated as required.

b) If any soil-collapse happens due to loose soil strata and soil gets spread on excavated area, collapsed soil to be removed by contractor at his own cost.

7) Soling & P.C.C. below the Compound-wall, UG-tank, RWH-tank and Watchman-cabins is in scope of contractor at his own

cost.

8) Dewatering during construction works at any level, for any duration (till completion of all his work scopes) & for all leads in excavated pits and irregular pockets. Before dewatering of sub-soil-water in municipal-SWD a filtration-chamber making is also in scope of contractor (as per municipal specifications & details).

9) Anti-termite treatment is also in scope of contractor.

10) Backfilling works i.e. returning filling in Compound-wall, UG-tank and RWH-tank, is in scope of contractor. He must do the

filling, levelling, watering and compaction works all at his own cost. Supplying & Fixing of Paver-blocks/Trimix-flooring is in scope of client at his own cost.

11) All R.C.C. works for 6th Floor beam/columns to Terrace-Floor slabs/beams + Lifts + Staircases + Terraces + RCC Parapets (for Staircases, Refuse-areas & Terrace) + Flower beds + chajjas + All Elevation Projections + Refuse area + Lift-Machine-Room + Overhead water tanks (including Fire-Fighting tank as per fire NOC) + extension of existing-Under-Ground water tanks (including Fire-Fighting tank as per fire NOC) + Meter-room + Rain-water-harvesting Tanks + Pump-room + Watchman-cabins + Cornices and the like. RCC-Parapets at various locations in the project, as per the general dwg attached with contract documents.

All the RCC Work on 12th floor required to erect M.S. Roof on top of 12th floor, are also in the scope of civil contractor. Fabrication of 12th Floor Roof is also in scope of contractor, as per the item-rates BOQ attached along with this tender/WO. Contractor must note that only the Fabrication & Roofing-sheet items will be paid as separate-items, over and above the “Sqft Rate” mentioned in the contract/WO. Civil (RCC/Masonry/Plaster/Waterproofing) items will not be paid as extra-item/separate-item.

Bonding chemicals and retarding super-plasticizers (of approved make as mentioned in attached work-specifications) must be used for concrete making at contractor’s own cost. Structural engineer’s approved polymers (at the cost of contractor) must be used for surfaces where honey-comb arises OR for all structural repairs. Note: Staircase is to be made “enclosed-type” & Electrical-duct is to be created from existing basement to 6th Floor as per attached drawing, without any extra cost to client.

12) Internal and External Light-wt. Block work (AAC block masonry) as per drawings.

100mm thick RCC patli with 2-8mm bars to be provided at bottom of walls and at every 1.2m height as mentioned in annexures. All external walls will be 150mm thick. Toilet walls must be 150mm thick. Wall where electrical DB to be fixed, must be 150mm thick. All other internal walls will be 100mm thick. Partition-wall between adjacent offices/flats must be 150mm thick. Sand being used for Block-work must be properly screened river-sand. Ready-made mortar (of Ultratech,

Magicrete or as approved by PMC) can be used for block-work, in place of site-mixed cement-sand mortar without any extra cost to client.

13) Silpose sand ONLY must be used for internal & external plaster work both.

External plaster will be double coat plaster with water-proofing compound (of approved make as mentioned in attached work-specifications) must be used in 2nd coat. Make must be approved in writing by PMC E-in-C before use. Hack-aid chemical must be used at cost of contractor for surfaces where hacking get skipped with-in 4 days of de-shuttering. Internal & External both plaster-works must be done as per specifications mentioned in attached annexures. If client is required to do Gypsum-work in ceiling due to hacking not done timely by the civil-contractor, cost of Gypsum-work to be borne by contractor. AND if client had actually planned only putty-work on the ceiling surface (in such case hacking is not asked by contractor as hacking is not reqd. for putty application), but if undulations are very high in ceiling surface constructed by the civil-contractor then Gypsum-work may be required to be done in ceiling to bring it in good line-level. In such case hack-aid application & Gypsum-work to be done in ceiling by civil-contractor at his own cost. Internal wall surfaces shall be plastered with scratch coat of cement plaster 15mm thick in C.M. (1:4), to receive POP/Gypsum over plaster. Plaster mortar shall be hand mixed mortar. POP/Gypsum work is not in scope of contractor.

14) Water-proofing works for UG Tank, OH Tank, Refuse-areas, Flower-beds/Balconies, Toilets/WCs and LMR-top, as

mentioned below: a) Waterproofing of UG-Tank:

UG-Tank bottom as well as side-walls and UG-Tank top to receive Shabad_ladi+Cement_grouting+Plain_IPS waterproofing. Grouting+Chemical_waterproof_application+Rough_waterproof_plaster from inside UG tank (bottom as well as side-walls), as instructed by PMC.

b) Waterproofing for Refuse-areas: Chemical_waterproof_application+Rough_IPS waterproofing for Refuse-areas as per slope. Waterproof watta must be done on all around the floor (on floor-to-wall junction).

c) Waterproofing of OH-Tank: OH Tank to receive Grouting+Chemical_waterproof_application+Rough_waterproof_plaster waterproofing from inside tank (bottom as well as side-walls) and Grouting+Chemical_waterproof_application+Rough_IPS on top of OH Tank.

d) Waterproofing of Toilet/WC & LMR-top: Sunk areas and Floors of Toilet/WCs & Lift-Machine-Room top to receive grouting+chemical_waterproof_application+brick-bat+rough_IPS waterproofing. All Toilet walls to receive waterproof plaster upto 1.0m height but the toilet-wall which is having shower-head on it, must be plastered upto full 2.2m height in full length.

e) China-chips (single/multi coloured, as selected by architect) must be fixed by contractor on OH-Tank-top & LMR-top at his own cost. China-chips must also be done on waterproof-watta done.

f) Waterproofing of Flower-beds: Flower-beds to receive grouting+chemical_waterproof_application+brick-bat+rough_IPS waterproofing. Filling of holes/core-cuts made in UG-Tank & OH-Tank for plumbing/fire-fighting/vent pipes is in scope of civil-contractor at his own cost, using appropriate grouts/waterproofing-compounds. Filling of holes/core-cuts made in Chajjas/Flower-beds/Balconies for drainage-pipes is also in scope of civil-contractor at his own cost, using appropriate grouts/waterproofing-compounds. Filling of holes/core-cuts made in beams for plumbing/fire-fighting/vent pipes is not in scope of civil-contractor, anywhere in project. Those holes/core-cuts to be filled by respective contractors. Civil contractor must get waterproofing works executed through a professional/specialized waterproofing contractor ONLY. All water-proofing works must be done with guarantee of 10 years on letter-head of contractor (format for guarantee will be provided by PMC). BASF/Fosroc make waterproofing compounds only must be used for all chemical based waterproofing works. Use of AAC block-pieces in waterproofing works (in-place of bricks) is permitted but corners of blocks must not be flakey/sharp. Corners of such pieces must be regular, and size of pieces must not be more than 150mm in any-dimension. 200mm size blocks must not be used. Bricks are not required to be used for waterproofing works.

15) Re-doing of Soling & P.C.C. “from plinth-line/building-plinth to the compound-wall” (damaged during the new construction) for paving around building, is in scope of contractor at his own cost. Approx. 250mm Soling & PCC in Meter-room & Panel-room, to raise the floor-level after cables are laid by electrical-contractor (AAC-blocks can be used for filling purpose), at his own cost.

16) Making & fixing of concrete-cover-blocks for columns/beams/slabs etc., as per specifications provided by structural consultant, is in scope of contractor.

17) Part-Compound-walls + Compound-Gates + Watchman-cabin are in scope of contractor. Gates to be supplied by client

free of cost to contractor. Breaking of existing part-compound-wall as Site E-I-C instruction & throwing away its debris is also in scope of contractor at his own cost. New Compound-wall to be average 1.8m height with 3m c/c intermediate columns/footings and tie-beams at top & bottom. New Compound-wall to be double-coat plastered from both sides as per plaster details issued by architect.

18) Construction & dismantling of temporary structures like Cement storage Godown, Stores for storing tools and tackles, Site

office for Contractor+Client+PMC with their Toilet facility AND separate bath/toilet facilities for workers/staff will be done by contractor at his own cost. Client to provide sewage/drainage connection from “municipal sewage-line (outside plot premise) to the 1st chamber outside the toilet facility made for labour-toilets” (i.e. all ground-level piping & chamber works to be done by client at his own cost). Client to provide electric connection at one point i.e. only upto meter placing. Balance electrical & plumbing works do be done by contractor at his own cost. Contractor is expected to make septic-tank & soak-pit for above infrastructure, at his own cost, in-case sewage line is not available at site. All material reqd will be brought by contractor at his own cost, for making godowns, stores, client/PMC/Contractor’s site offices, all toilets, septic-tank, soak-pit etc. If mention in Annexure B: clause 10.8, contractor to make labour toilets on refuse areas. Contractor to maintain regular cleaning of septic-tank & soak-pit, as and when required, at his own cost. Contractor to visit site and ascertain these items carefully, before quoting his price.

Contractor is expected to allow use of these toilet facilities to other agencies appointed by client, without any extra cost to client/agencies. Contractor to dismantle all temporary infra facilities, created by him for completing his scope of works, at his own cost. Removal of debris generated due to dismantling of such temporary structure is also in scope of contractor, at his own cost.

19) In-case temporary structures constructed as mentioned in Sub Para 18) above are required to be relocated or removed

completely as per client requirements, Contractor shall dismantle completely any or all temporary structures and reconstruct at different locations as directed by E-in-C of PMC. Contractor is expected to construct such structure twice for free of cost but will be paid extra (as per mutually agreed rates) for relocating 3rd or more time only. In-case material re-shifting is required, due to some requirements from client, contractor is expected to lift & shift materials twice for free of cost but will be paid extra (as per mutually agreed rates) for re-shifting 3rd or more time only.

20) If the space constraints are due to the site-conditions and then if such shifting & re-shifting of contractor’s

office/godown/stores/toilets/electric-meters etc. is required to be done by contractor, it will be done by contractor at his own cost. Such shifting & re-shifting is not limited to any no.

21) Due to space constraints if material shifting & re-shifting is required to be done by contractor, it will be done by contractor

at his own cost. Such shifting & re-shifting is not limited to any no.

22) Any pre-cast work for toilet-ducts, if required, does not come into scope of contractor. All cast-in-situ, curved or round-projections (whether slabs / beams / columns) and Circular/Inclined columns, must be casted using M.S. farmas ONLY. Any farmas required for such cast-in-situ works also comes in scope of contractor. Contractor’s rate must be inclusive of these farma making and using, as asked by PMC.

23) Ground-level area-lighting will be done by client once only. During the course of work, area lighting will be maintained and

repaired by contractor only at his own cost. After contractor’s work completion, ground-level area-lighting is to be maintained by client at his cost.

24) Water charges will be applicable as per Annexure B: clause 17. Electricity charges will be applicable as per Annexure B:

clause 18.

B) PRICE:

This agreed and accepted rate works out to Rs ……..……….. /- (Rupees …………………………………………………………………………. Only) per Square Foot (Sq.ft) on the contractor’s payable area, for RCC/Masonry/Plaster/Water-proofing works according to Terms and Conditions enclosed to this Work-Order. The total value of contract shall be approximately Rs. ……………………..…………. /- (Rupees …………………………………………………………………………………………………….…… Only), as mutually agreed and accepted by Client & Contractor for Contractor’s Payable Area of 37,425 Sqft, for RCC/Masonry/Plaster/Water-proofing works according to Terms and Conditions enclosed to this Work-Order. Contractor’s final payable area will be worked out as per “Annexure A” attached here-with. In case of variation (whether increase or decrease) in Contractor’s Payable Area, the payable amount to contractor shall be worked out considering above mentioned “per sqft” rate. Utility area works may-be or may-not-be executed. If such area (UG-Tank/STP/Sub-station/Pump-room/Temple etc.) does not get executed, area for these elements will not be paid to contractor.

Since steel and concrete consumptions accounted for working out the contractor’s rate (“per sqft” consumption provided in work-order) are approximate and may vary, actual steel and concrete consumption will be revised (“per sqft” consumption) and letter for the same will be issued to contractor after 2nd typical floor is completed. Contractor’s further billing will be done considering those revisions in contractor’s quoted rate. However, contractor’s Final-Bill must be prepared considering actual final steel and concrete consumptions (certified by PMC) for entire scope of works of contractor and Final-Bill must be prepared by contractor considering those final corrections. Similarly, contractor’s payable area accounted for working out the contractor’s rate is also approximate and may vary. Actual payable area to contractor will also be revised and letter for the same will be issued to contractor after 2nd typical floor is completed. Contractor’s further billing will be done considering those revisions in contractor’s quoted rate. Actual final payable area to contractor will be certified by PMC after completion of entire scope of works of contractor and Final-Bill must be prepared by contractor considering those final corrections.

The above rate is inclusive of deploying adequate shuttering/supporting materials, tools-tackles & manpower as mentioned below, to complete the above-mentioned scope of works:

i) All materials required (other than the below mentioned client’s scope of materials) to complete work specified in “scope of work for contractor”, which includes wastages etc. specified in this document.

ii) Workers / Manpower required to complete his scope of works. iii) Tools and Plants, Equipments required to complete his all scope of works. iv) All Shuttering, Shuttering oil/grease, Scaffolding, Supportings required to complete his all scope of works. v) Site Establishment expenses for execution of his scope of works. vi) Overheads and Profits to complete his all scope of works. vii) ONLY specifically mentioned Equipments / Shuttering / Scaffolding / Supportings / Tools / Tackles / Plants (in below

mentioned points) will be supplied by client. Else all such items to be arranged by contractor at his own cost, to complete his scope of works.

viii) Misc. expenses required to complete the work in stipulated time limit.

The above rate is agreed in consideration of “Scope of Supply of the Materials” as specifically mentioned in below points (with non-exhaustive quantities for all his scope of works, except for the specifically mentioned items where limited quantity consumption is in scope of contract):

1) Rubble for Soling (for new Compound-wall, UG-tank & RWH-Tank) will be brought by contractor at his own cost.

2) If Plum-concrete is required to be done anywhere in the project, it will be paid to contractor as an extra item as per

Appendix C. But if contractor consumes more concrete in plum-concrete then what is mentioned in structural drawings, extra concrete consumed will not be accounted for extra-claim of plum-concrete and material consumed in plum-concrete to be debited to contractor as penalty for negligence.

3) Murrum required for back-filling in new Compound-wall, UG-tank & RWH-tank, to be brought by contractor at his own cost.

Murrum for filling to be of good quality and must be approved by PMC. Rock-pieces/boulders/brick-bats/building-debris/muck/black-cotton-soil/polythen-bag-pieces must not be there in murrum being brought.

If back-filling is in scope of contractor, contractor must do the required plot levelling at his own cost, before MEP works are started by client.

4) A 4.0m projected cantilever MS-Platform at 6th floor with G.I. Sheet-base is to be erected by civil contractor, at his own

cost. (as a safety-platform).

5) Complete Ground floor should be covered with 6m projected safety-net using bigger-net (4”x4” squares) & smaller-net (1”x1” squares) by civil contractor, at his own cost, for safety purpose.

6) Road (in front of the building) also to be covered with safety net by using both bigger-net (4”x4”) & smaller-net (1”x1”), by civil contractor at his own cost.

7) While working out the contract pricing, contractor to consider the rate of Reinforcement Steel as Rs. 38,000/- (Rupees

Thirty-Eight thousand only) per Metric Tonne (excluding GST BUT including Profit, Overhead, transport, loading & unloading etc.). If steel is brought at lesser rates than above mentioned rate, contractor will give credit to client and if steel is brought at higher rates than above mentioned rate, contractor can claim for rate difference. Such claims must get settled bill to bill. 18-gauge G.I. Binding wires to be arranged by contractor at his own cost. No basic rate is applicable for G.I. Binding wire. If prior written-approval is not taken from PMC for any purchase above the mentioned rate, contractor will not be eligible for any refund/claim for rate difference.

8) While working out the contract pricing, the reinforcement steel consumption is considered (without considering wastage) for all structural-elements (in whole project) as 5.0 kg per Square foot of contractor’s payable area. Any consumption in excess of 5.0 kg per sqft of contractor’s payable area will also be charged @ Rs. 38,000/- (Rupees Thirty-Eight thousand only) per MT. Any steel consumption lesser than or in excess of 5.0 kg per Sqft (on contractor’s payable area) shall also be debited or credited @ Rs. 38,000/- (Rupees Thirty-Eight thousand only) per MT to contractor, from any amount due to him. For verification of quantity of steel consumed in project, theoretical calculation of steel (BBS) as per as-built drawings for all structural-elements, shall ONLY be considered. No deduction or addition in price shall be permitted on account of labour / OH / Profit etc., for less or more steel-quantity consumed in complete scope of this tender/WO. Steel wasted by contractor or steel-scrap generated out of contractor’s scope of works shall NOT BE accounted in steel consumed for the project. Only theoretical calculation of steel (BBS) as per as-built drawings for all structural-elements, shall be considered for steel consumed for the project. Hence, this steel-scrap or steel-wastage generated at site (from contractor’s scope of works) shall be property of contractor. Only supply rate variation will be debited / credited to contractor for less / more steel used. No deduction or addition in price will be permitted on account of labour / OH / Profit etc., for less or more steel quantity consumed. Steel being used in PCC, parapets of stair-case/terrace/refuse-area, lintels, DPC, masonry-works, and other non-structural elements shall not be considered/accounted as steel consumed for the project. Contractor is permitted to use his steel-scarp, generated out of project structural-works, for Terrace-parapet / Refuse-area-parapet / Staircase-pardi / PCC / lintels / DPC / masonry-works / other non-structural elements as instructed by PMC. If steel is being supplied by client (in account of contractor), contractor will send his person on weigh-bridge to ensure quantity of steel being supplied by client. Once the delivery is accepted by contractor, material security shall be in scope of contractor. Client shall debit contractor the whole supplied quantity of steel, in account of the project. In such case, any extra brought/used steel then the approved BBS, will be deducted from any amount due to contractor. Contractor must remember that in no-case he can claim steel-quantity consumed in project more than the theoretical calculation of steel (BBS) as per as-built drawings. Extra claim of “rate-difference” from the basic rates provided in work-order, on any unaccounted use/wastage done by contractor (beyond the permissible uses limit), will not be paid or entertained on that quantity of steel.

9) Contractor is strictly instructed that cutting/bending of reinforcement for every level must only start after submission of Bar-Bending-Schedule to PMC for that level, failing to which Rs. 25,000/- will be debited to contractor for every such incident. Steel quantity which will not be found registered in BBS, will not be accounted as consumed-steel-quantity for the project.

10) Reconciliation of Steel received must be submitted by contractor 1st week of every month to PMC, failing to which Rs.

25,000/- will be debited to him for every such incident. Challans of steel received must be given to PMC rep. the same day of steel receipt. Client does not require any approval from contractor to debit amount on such accounts. But client will take PMC’s consent before debiting any such amount.

11) While working out the contract pricing, contractor to consider the rate of Cement as Rs. 235/- (Rupees Two Hundred Thirty-Five only) per Bag of 50 Kg (excluding GST BUT including transport, loading & unloading etc.). Cement used for Minor-Concrete-works (lintel, stair-case pardis, DPC, masonry-bends, and other non-structural concrete works except PCC & Plum-concrete), Masonry-works, Plaster-works & Water-proofing-works shall be of Gujarat Ambuja/ACC/Ultratech 53 grade or PPC grade. If cement is brought at lesser rates than above mentioned rate, contractor will give credit to client and if cement is brought at higher rates than above mentioned rate, contractor can claim for rate difference. Such claims must get settled bill to bill. For (± 10%) from above mentioned cement rates, credit & debit will not be accounted to contractor & client both. Below 10% from this rate, contractor will transfer credit to client, and above 10% from this rate, client will give credit to contractor. In case difference in supplied cement rate is more or less than 10%, credit / debit will be done for that particular supply considering the actual basic rates (Rs. 235/-) provided in contract. If prior written-approval is not taken from PMC for any purchase above the mentioned rate, contractor will not be eligible for any refund/claim for rate difference.

Cement wasted by contractor in all his scope of works shall NOT BE accounted in cement consumed in project. Only theoretical calculation of cement as per as-built drawings, shall be considered for cement consumed in project. Only supply rate variation will be debited / credited to contractor for less / more cement used in project. No deduction or addition in price shall be permitted on account of labour / OH / Profit etc., for less or more cement quantity consumed in complete scope of this tender/WO. Extra claim of rates (over the basic rates provided in contract) on any unaccounted use/wastage done by contractor, while using cement, will not be entertained on that quantity of cement.

12) Contractor is expected to use Ready-Mix-Concrete (RMC), supplied and managed by contractor at his own cost, for all Concrete-works (Columns, Slabs, Beams etc.) of appropriate grade. Contractor’s rates must be inclusive of using bonding chemical / Super-Plasticizers required for construction joints / retarder, wherever required.

13) While working out the contract pricing, contractor to consider the rate of Structural-Concrete as Rs. 5500/- (Rupees Five Thousand Five Hundred only) per Meter Cube (excluding GST BUT including transport, loading & unloading etc. and including of pumping charges). If concrete is brought at lesser rates than above mentioned rate, contractor will give credit to client and if concrete is brought at higher rates than above mentioned rate, contractor can claim for rate difference. Such claims must get settled bill to bill.

If prior written-approval is not taken from PMC for any purchase above the mentioned rate, contractor will not be eligible for any refund/claim for rate difference. No basic rate is applicable to concrete required for PCC, Plum-concrete, parapets of stair-case/terrace, lintel, DPC, masonry-bends and other non-structural concrete works. Concrete for those elements must be brought/made-at-site by contractor at his own cost (with all required materials in his scope).

14) While working out the contract pricing, the concrete consumption is considered (without considering wastage) for all

structural-elements (in whole project) as 1.20 CFT per Sqft on contractor’s payable area for complete scope of works of contractor (structural concrete shall only be accounted in consumption. PCC+any other non-structural concrete work will not be accounted in consumption). Any concrete consumption lesser than or in excess of 1.20 CFT per Sqft (on contractor’s payable), shall also be debited or credited @ Rs. 5500/- (Rupees Five Thousand Five Hundred only) per Meter Cube to contractor, from any amount due to him.

For verification of quantity of concrete consumed in project, theoretical calculation of concrete as per as built drawings, shall ONLY be considered. No deduction or addition in price shall be permitted on account of labour / OH / Profit etc., for less or more concrete-quantity consumed in complete scope of this tender/WO. If concrete/RMC is being supplied by client (in account of contractor), contractor must verify quantity of RMC being supplied by RMC vendors (by his own ways at his own cost) before accepting supply. Once the delivery is accepted by contractor, material security shall be in scope of contractor. Client shall debit contractor the whole supplied quantity of concrete, in account of the project. In such case, any extra brought/used concrete then the approved theoretical concrete quantity, will be deducted from any amount due to contractor. Contractor must remember that in no-case he can claim concrete-quantity consumed in project more than the theoretical calculation of concrete as per as-built drawings. Extra claim of “rate-difference” from the basic rates provided in work-order, on any unaccounted use/wastage done by contractor (beyond the permissible uses limit), will not be paid or entertained on that quantity of concrete.

15) Contractor is strictly instructed that concrete reconciliation register must be signed before start of any structural-concrete. Failing to which Rs. 25,000/- will be debited to contractor for every such incident. Structural-Concrete quantity which will not be found registered in concrete reconciliation register, will not be accounted as consumed-concrete-quantity for the project.

16) All the junctions of masonry walls and concrete shall be covered with PVC mesh to avoid cracks in the plaster. This PVC mesh also to be provided by contractor while plastering on the chasings made for electrical conduits, electrical boxes, and plumbing lines and above PCC block to avoid the de-bonding of plaster. PVC mesh for all such works to be provided by contractor at his own cost. AAC blocks must be hacked @ 2” c/c by contractor at his own cost, for better bonding with plaster being done on it. All materials required for masonry-works to be brought by contractor at his own cost.

17) Internal plaster to ceiling not considered anywhere. The ceiling surface of Floor-lobbies shall be hacked as per instructions

of PMC. Ceiling of Chajjas, Flower-beds, balconies must also be hacked. Ceiling surface of Stair-case areas not to be hacked and must be properly grinded with grinder. Surface cracks on all the slabs to be properly filled with cement mortar, bringing the ceiling surface in true line and level to the satisfaction of PMC, as per specification provided in annexures. Flower-bed / Chajjas / Elevation projects / Pocket Terrace ceiling will be plastered as per instructions of PMC. Contractor’s rate must be including of this plaster. Internal Plaster mortar will be hand mixed mortar. All materials required for internal-plaster works to be brought by contractor at his own cost. All Internal wall surfaces shall be plastered with scratch coat of cement plaster 15mm thick in C.M. (1:4), to receive POP/Gypsum over plaster. POP/Gypsum work will be in scope of client. Masonry wall mortar shall be hand mixed mortar. Surface cracks on all the slabs to be properly filled with cement mortar, bringing the ceiling surface in true line and level to the satisfaction of PMC, as per specification provided in annexures, by contractor at his own cost (material for such items to be provided by client free of cost to contractor).

18) All materials required for Waterproofing-works as well as grouting/filling works of holes/core-cuts (only which are in scope of contractor) shall be brought by contractor at his own cost. China-chips work also is in scope of contractor at his own cost.

19) Walls of all staircases, common-passage & floor-lobbies shall be treated with single coat sand-faced-plaster/Hand-

Sponge-finish/scratch-coat as instructed by PMC in writing. All toilet-ducts shall be treated with Double coat sand faced plaster from inside.

20) External plaster (20mm thick) to be provided in two coats with sand faced finish. First coat in C.M. 1:4 and second coat in

C.M. 1:3. PMC approved PP-Fibers must be added in 1st coat and Water-proof compound must be added in 2nd coat of plaster. Contractor’s price must include using PP-Fibers and Water-proof compounds. External Plaster mortar will be machine (Mixer) mixed mortar only for both the coats. Toilet-Ducts to receive double-coat plaster from inside. All materials required for external-plaster works to be brought by contractor at his own cost. Watta & IPS finish in scope of contractor at his own cost, for all chajja projections as per PMC instructions. IPS finish on all service slabs (toilet ducts, electrical ducts & Fire-Fighting ducts etc.), also in scope of contractor at his own cost, as per PMC instructions.

21) Ledge-wall for toilets (wherever required), in block masonry, is considered in contractor’s scope of work at his own cost. Making staircase winders in block masonry, are also in scope of contractor at his own cost, if any.

22) All materials required for making of concrete-cover-blocks to be arrange by contractor at his own cost.

23) Use of crushed-sand for cast-in-situ concrete is permitted.

24) Over and above theoretical quantity of sand, no wastage is allowed for complete work of sand uses. Any wasted/used sand than theoretical quantity will not be accounted while accounting refund/claim for rate difference to the contractor.

Only supply rate variation will be debited / credited to contractor for less/more sand used. No deduction or addition will be permitted on account of labour / OH / Profit etc., for less or more sand quantity consumed.

25) Compound development upto compound-wall, etc. is considered in contractor’s scope of work.

26) In case due to exigencies of services, Client may procure some materials for incorporating in the work and issue to the

Contractor. The Contractor shall sign delivery challans for receipt of such materials. The Client is not bound to take any consent or approval from Contractor for procurement of such materials. The expenses incurred due to such procurement of materials shall be recovered from the Contractor as per actual payments made by the Client to the vendors.

27) The Client reserves all rights to increase/decrease, split and alter scope of work in consultation with PMC adjudging the performance of Contractor. In the event of increase or decrease in the scope of work, the Contractor shall be paid with the agreed and accepted rate.

28) In the event when Contractor has failed to complete the targeted progress, the Client shall have full rights, without taking any consent/approval from Contractor to appoint other agency/agencies in consultation with PMC, to complete the work at the risk and cost of the Contractor. The payments made to such agency/agencies shall be recovered from contractor’s dues immediately.

29) C-line of columns will get checked by total-station surveyor only. This work will be done by contractor at his own cost.

30) Contractor is to arrange for shift/lead-lift of steel/cement/all other materials at site at his own cost once. Client may be required to unload his materials on outside road (due to space constraint in site) and contractor is expected to lift & shift the materials (of his scope of work only) as soon intimated by Nexus to contractor. In such circumstances, if materials are not removed from road as soon it is intimated by Nexus to contractor and if any penalty is levied by any govt. authority on account of road-cleaning or materials laying on road, same is to be handled, settled and paid by contractor at his own cost.

31) Contractor to maintain his own security at site. He has to secure his materials and materials supplied by client on his account. No case/matter will be entertained and replied by client on account of theft of his materials/materials supplied by client on his account.

32) Contractor to maintain complete safety of site workers and persons working on site against any fall at his own cost. Contractor to arrange to guard all openings/cutouts/external face of slab areas against any fall. Contractor is expected to cover all openings at external face of the building by fencing of 1.1m height green-cloth (well supported by 20/25mm reinforcement-bars @ 2.0m c/c vertically and 12/16mm 3 Nos. bars horizontally) at his own cost. He must use steel-scrap for this purpose and must not claim extra to client for use of these reinforcement bars as safety-bars. Contractor will remove all such bars from all floors after his work completion or as instructed by PMC, at his own cost, and place them at

PMC designated space at ground-floor. Contractor will provide all necessary safety-nets for protecting neighbouring properties from falling items from his scope of works and ensure all possible safety required in this regard, at his own cost. PMC’s decision will be final and binding to contractor with regards to providing safety-nets for neighbouring properties. No extra claim of contractor, in regard to providing safety-nets, will be paid and entertain. In all case, contractor is solely responsible in case of any loss to neighbouring properties due to his falling objects.

33) Contractor to throw away his-excavated-material/electrical-conduit-debris/his-debris-generated due to his civil works, from site at his own cost and no debris permissions will be arranged by client for such purpose. Contractor to arrange required permissions at his own cost. Client will cooperate for any papers required for any official permission by contractor. Any penalty levied by govt. authority on this account shall also to be paid by contractor at his own cost. Client will arrange to remove debris generated by other agencies, at his own cost.

Contractor to provide persons to clean the vehicles carting away excavated soil at his own cost, before they go out of site). If any penalty is levied by govt. authority on account of road cleaning/vehicle standing around site area, same is to be managed and handled by contractor and paid by contractor only.

34) Drawings attached with Work-Order are only for the purpose of understanding the whole scope of work of contractor. Architectural and structural planning changes may happen during the course of execution. These changes will not be treated as change of work scope of contractor. No extra claim will be entertained and paid on this account unless reworking has happened. Payment of contractor will be calculated as per the contractor’s payable area worked out from Annexure A.

35) Contractor must get all mix designs of concrete also approved by PMC well in advance to avoid any delay in works. Non-approved mix design will not be permitted to use in any element. Cost of getting mix-designed, as and when asked by PMC, from PMC approved laboratory to be borne by contractor.

36) If any purchase is done by contractor without prior approvals of rates from PMC, for the items having basic rates in Work-Order, reimbursement for the cost paid by contractor above the basic rates mentioned will not be done by client for that particular purchase. Hence contractor must take rate approval from PMC prior to bringing any material at site, which is having basic rates in contract. Copy of this written approval must be attached along with extra rate claims of each item. In all circumstances, if contractor is failed to take prior approval, any quantity brought at site will be certified on rates of previous or later lot brought at site (whichever rate is lower).

Procedure of rate approval of each-supply for materials which are provided with basic rates in Work-Order: Contractor will obtain list of approved vendors from PMC for each material and will also send his list of vendors to PMC for approval, before asking rates from any vendor. The contractor will then send negotiated rates of minimum 3 approved vendors (one from contractor side, one from PMC side and one from client side) for each material to PMC’s Purchase-Manager. PMC may further negotiate the quoted rates. PMC will take approval from client and confirm the same to contractor in writing (about approved vendor name, his approved terms & conditions and his approved rates). Contractor will then do the necessary follow-ups with vendor for his material requirements as per site work schedule. For RMC only, contractor must ask rates from vendors only after vendor’s Mix-Design approval from PMC.

Quantity of materials supplied by vendors, which are provided with basic quantities/rates in Work-Order OR Quantity of materials free supplied by client: It is duty of contractor ONLY to verify the quantity being supplied by all such vendors. Client/PMC will not be responsible/answerable for any less/more quantity being supplied by any such vendor for any material, then what is mentioned in challon of any particular supply. Client is responsible to pay ONLY for theoretical consumption of materials (for materials which are provided with basic quantity-consumption in Work-Order). Situation when rate approval is not obtained by contractor for materials which are provided with basic rates in Work-Order: If any material whose make is not approved by PMC in writing, get used anywhere, contractor to remove the same and replace it with approved make at his own cost. If it cannot be replaced due to certain constraints, contractor will not be permitted to claim any payment for work done by using non-approved material.

37) Annexure B & C which includes general and special terms and conditions of contractor, are part of this contract. Other annexures and appendix are also part of Work-Order documents and contractor rates must be quoted considering and annexures and appendix attached herewith.

38) Contractor is expected to sign all checklists and quality control documents required by PMC, unconditionally. Contractor’s quotes rates are inclusive of all necessary staff to maintain all such documentations. No extra claim will be paid and entertained on such account.

39) All works mentioned in scope of contractor must be done as per Architect & consultants drawing supplied be PMC.

40) RCC, Masonry & Plaster works to be done as per Material-Specifications, Work-Procedures & Quality-Standards

mentioned Annexure-D. All materials being brought at site by contractor must meet Quality-Standards mentioned in Annexure-D. All material-tests must be done as mentioned in Work-Order & attached Annexure-D. Tests must be carried out in manner as mentioned in attached Annexure-D. In-case of any ambiguity in specifications mentioned in general-Work-Order-documents & Annexure-D, specifications mentioned in Annexure-D for respective work will precede over general-Work-Order-documents.

41) All “Terms & Conditions” and “Special Conditions” mentioned in attached annexures of this contract are meant to

explain/elaborate the scope of work mentioned above. In no case any clause mentioned in “Terms & Conditions” and “Special Conditions” can reduce or remove the scope of contract mentioned above.

42) No basic rate is applicable for the items not being provided with any basic rate in this work-order.

C) TAXES & DUTIES:

1) All government/municipal charges, deposits etc. will be borne by the client, for the requirement of obtaining approvals for commencement/completion of construction works.

2) The rate is Exclusive of GST applicable (prevailing rates is 18% of gross amount charged for the bill claimed). 3) Contractor shall submit his firm’s GST Registration number, with a photocopy of the same. 4) Contractor shall submit to PMC/Client all documentary evidence regarding payment of GST paid challons to confirm

whether GST amount paid by the Client through R.A. Bills / Final bill is deposited to concerned Govt. authorities. Within 15 days of payment receiving from client for any bill, copy of challons of the GST paid by contractor (to Govt.) must be sent to client, else further bill-payment will not be processed.

5) Any revision in GST levied by State Government and Central Government shall only be borne by Client. 6) Contractor rate is inclusive of all other taxes levied by State Government and Central Government on materials being used

at site for contractor’s scope of supplies/work and client supplied materials in scope of contractor. Copy of challans & Test reports of all materials, being used at site for contractor’s scope of work, must be submitted by contractor to PMC’s E-in-C within 1 day of material reaching at site. Only steel testing report must be submitted as per tender conditions. Contractor will submit challans of all the materials brought by him for uses in project to nexus site team in-charge.

7) PF & ESIC will be paid by contractor at his own cost.

D) FIRM PRICE CONTRACT:

The unit rate mentioned above shall remain firm till xxxxxxxxx or four months from actual-scheduled-date-of-completion (as per Handing-Over Letter), whichever is later. During this period, no escalation on price will be allowed for any reason whatsoever it may be.

E) WORK COMPLETION SCHEDULE:

Hence, actual date of completion of project to be worked out 9 months from handing-over of

Terms and Conditions:

HEADING CLAUSE DESCRIPTION

Definition

1.1 “Client, Employer or We” means M/s RVG Foundation., hereafter shall be referred as “RVG F”.

1.2 “Contractor, Vendor or You” means M/s ……………………………………………………….., hereafter shall be referred as”…………………….”.

1.3 “PMC, Nexus, Nexus PSPL or NPSPL” means M/s Nexus Project Solutions Pvt. Ltd., having office at Row House No.4,Dheeraj Savera, Opposite Siddharth Nagar, Borivli (East),Mumbai 400 066, hereafter shall be referred as “NPSPL”.

1.4 “E-in-C” means Engineer In Charge deputed by M/s Nexus Project Solutions Pvt. Ltd.,

Time for Completion 2.1 “Time is an essence of contract”.

Calendar months 2.2 The time for completion of entire work in “Contractor’s scope is 9 calendar months (Nine calendar months) including monsoon.

Checking by Municipal authorities AND Work-Slow in exam period of Hostel Students

2.3 The above period includes approx. 30 days required by client for required checking by Municipal authorities, after casting of various other-level slabs. In this period, the contractor may not be able to proceed for works above-plinth/last-casted-floor but he may carry out balance work below-plinth/below-last-casted-floor, if any. Beside this, due to exams of hostel students in Oct/Nov months, contractor’s activities may be asked to slow-down for a period of approx. 15/20 days. Activities which does not create any type of noise may be taken up by contractor in the subjected period.

Delay in checking by Municipal authorities

2.4 In case plinth-checking or any other level slab-checking is delayed beyond the above mentioned period, the Contractor shall be given extension for the extra period only, as per “Firm Price Contract” clause. Claim for Escalation in price will not be considered, entertained and paid due to delay unless the “Firm Price Contract” clause allows so.

Delay in Release of drawing by Architect / Structural Consultant

2.5 In case due to certain unavoidable circumstances, release of drawings by Architect/Structural Consultant is delayed, then such delayed period will be assessed by PMC and the Contractor shall get the extension for the extra period only. Claim for Escalation in cost by Contractor for this period will not be considered, entertained and paid.

Delay due to Other working agencies

2.6 No compensation shall be allowed in the case of clearance of works from other working agencies simultaneously at site.

Delay due to water standing in borrow pits

2.7 No compensation shall be allowed for any delay in the execution of work on account of water standing in borrow-pits or compartments.

Extension of time for completion of work

2.8 E-in-C in consultation with client shall decide the time lapsed due to reasons mentioned in clauses 2.4 to 2.7 and the period will be granted for extension of time to completion of work without any price adjustment.

Site Representatives 3.1 The Contractor shall depute full time well qualified and experienced Project Manager, who will be authorized representative of Contractor and to be acceptable by Client and PMC. No concreting will be allowed in absence of Contractor’s Engineer. In addition to that contractor will appoint separate supervisors to handle work at site.

Implementation of instructions

3.2 Project Manager appointed by Contractor should be available during the working hours to receive and carry out instructions from Engineer In Charge of PMC.

Active participation in meetings

3.3 Project Manager appointed by Contractor shall be having active participation in all progress review meetings/ Coordination Meetings as and when called by E-in-C.

Alternative arrangement 3.4 In case the Project Manager appointed by Contractor is not available due to any reasons, the Contractor shall instruct Sr. Engineers to coordinate all activities for the project.

Absenteeism of Project Engineer

3.5 The absenteeism of Project-Manager/Sr. Engineer from site will attract penalty of Rs. 50,000/- (Rupees Fifty Thousand only) per month, absenteeism of Jr. Engineer/Supervisor from site will attract penalty of Rs. 25,000/- (Rupees Twenty Five Thousand only) per month. The penalty charges will be recovered from contractor’s payments due.

Adequacy of Contractor’s Staff

3.6 The Contractor shall depute requisite numbers of Site Engineers, Jr. Engineers, Supervisors, etc. as directed by E-in-C. Contractor’s quoted rates are inclusive of engaging all necessary engineering and supervisory staff to monitor the works properly.

Additional staff deployment

3.7 The E-in-C reserves the right to inform the Contractor to depute additional staff in case required as per site exigencies without any extra cost to client. The Contractor shall deploy such staff immediately.

Right to remove Contractor’s staff

3.8 The E-in-C reserves the right to inform the Contractor to remove any of the staff from site. The reasons of removal to be considered as in-competence / rude or mis-behavior with PMC’s staff or Client’s Engineer / Under the influence of alcohol or drugs / misusing Client’s supplied materials / negligence towards work entrusted and likewise.

Bar Charts and Schedules 4.1 The Contractor shall immediately after receipt of Work-Order, submit to PMC a Bar-Chart in details showing all activities to complete the work in stipulated time period. PMC will ensure that contractor is supplied advance copies of relevant drawing at-least 21 days in advance (for procurement & planning) and GFC’s at-least 10 days in advance of any particular stage.

Modification of Bar Charts and schedules

4.2 With Prior approval of E-in-C in advance, contractor shall modify the Bar Chart as per progress achieved at site. The contractor shall keep in mind that, even after modifying the Bar Chart the original completion date will remain unaltered.

Methodology 4.3 The methodology adopted for completing any activity shall be got approved from E-in-C or directed by him, prior to commence such activity at site.

Simultaneous methodology

4.4 The methodology to be adopted shall be simultaneous and not sequential operations.

Workmanship and Quality Control

5.1 The Contractor shall ensure that entire work shall be executed as per “Good Engineering Practice” and in the best workmanlike manner.

Quality Control Laboratory at site

5.2 NA

Lab Technicians 5.3 NA

Workmanship 5.4 The Contractor shall note that Best quality of materials shall be procured by Client and supplied to him; hence he shall give best quality of workmanship to get the best final product.

Reinforcement steel testing criteria

5.5

Reinforcement steel of requisite grade and quality, as instructed by Structural Consultants specifications, shall be arranged and supplied by the client. For testing of reinforcement steel, contractor shall borne expenses for following:

a) Contractor to cut the steel in required length for testing samples. b) Contractor to send his person for collection of report and submission to E-in-C.

The contractor shall pay all charges for: a) Transportation of samples to designated laboratory approved by E-in-C / Structural

Consultants. b) Testing charges charged by designated laboratory approved by PMC.

In case the results are not found satisfactory, client shall immediately remove the reinforcement steel brought in the lot and replace with good quality reinforcement steel having satisfactory test reports from laboratory, at his own cost. No extra claim by contractor for idle sitting of labours will be entertained or paid by Client/PMC in such situation.

A) Reinforcement steel of 8 mm dia, 10 mm dia, 12 mm dia shall be tested only for Physical/Mechanical properties tests for each 60 MT lot, if supplied by same vendor of same Brand. Else testing will be done for each Lot.

B) Reinforcement steel of 16 mm dia, 20 mm dia, 25 mm dia and 32 mm dia shall be tested for Physical/Mechanical and Chemical properties tests for each 40 MT lot, if supplied by same vendor of same Brand. Else testing will be done for each Lot.

Site mix concrete by Volumetric basis

5.6 The Contractor may be permitted by E-in-C to do the Site Mix Concreting using Volumetric basis. Contractor at his own cost will arrange for mix-design testing, at lab designated by PMC, based on the materials to be incorporated in the mix. No extra rates shall be paid for using site mix in place of RMC.

Concrete cubes & Cover-blocks

5.7 The Contractor shall cast time to time Concrete Cubes 150 mm x 150 mm x 150 mm size, minimum 9 numbers or more as directed by E-in-C for Site Mix Concrete and also for Ready Mixed concrete. Contractor to make concrete-cover-blocks (for all RCC elements) & concrete-wedge-pins (“Faachar”) for RCC-masonry junctions at his own cost, as per specifications & sizes provided in structural consultant drawing.

Sufficiency of cube moulds 5.8 The Contractor shall arrange minimum 9 number of cube moulds 150 mm x 150 mm x 150 mm size and keep them in good condition at site.

Concrete cubes testing charges

5.9 The cost of making the cubes, curing for adequate days, assisting for loading the cubes to be sent for testing shall be borne by the Contractor. The Contractor shall dispatch the cubes to the lab designated by PMC. Transport charges, testing Charges etc. shall be borne by the Contractor. The Contractor shall arrange to collect the test reports and submit to E-in-C for ensuring the quality of concrete maintained at site by him. Contractor must get minimum of 10% of cubes tested in designated laboratory approved by PMC/Client, at his own cost, i.e. every 10th testing must be done in such designated lab.

Sand Silt Contents 5.10 The Contractor shall arrange best quality locally available sand for concrete, mortars. Maximum permissible silt contents to be 8% in sand. Only approved and process-graded sand to be used by Contractor. In case the silt contents are more than 8%, the contractor shall arrange to wash the sand before use to bring the silt content below 8%, at his own cost.

Screening of sand 5.11 Contractors quoted rate includes screening of sand by sand screening machine or screening plates, for Brickwork and Plaster, as directed by E-in-C.

Use of screenings 5.12 Use of screenings shall be utilized as directed by E-in-C.

Stacking of materials on slabs

5.13 Sand/Bricks/Blocks to be stacked properly on each slab taking care that no slab is unduly loaded.

External type Material-Hoist

5.14 Contractor, at his own cost, is expected to set-up 1 no. material hoist dedicated for site uses and remove/dismantle it at his own cost.

All running, Maintenance and AMC costs of all these machineries must also to be borne by contractor without any extra cost to client. Contractor to arrange all necessary permissions for running all his machineries/equipments at his own cost. Contractor to submit third-party inspection and certification for all his machineries/equipments working at site before start functioning of his machineries. Submission of certification does not relieve him from his responsibility of keeping PMC, client’s persons and Client indemnified from any mishap which may happen due to his installations.

Any changes in equipment requirements for project does not relieve contractor from his duty to deliver project as per project schedule period given in above clause 2.2.

Slump cone 5.15 Contractor shall keep slump cone always available at site to check the slump of the concrete of site mix or Ready Mixed Concrete supply.

Measures to be taken, due to failure of compressive strength of Concrete Cubes

5.16 In case the test results are failed to achieve satisfactory results, then further non-destructive tests and/or Core tests shall be carried out by the Client at Contractor’s cost, as directed by E-in-C / Structural Consultants. Contractor is expected to cooperate in such situation. No extra claim for idle sitting of labours will be entertain in such situation.

Acceptance criteria: Decisions

5.17 The quality and workmanship of concrete and other works would be subject to approval of E-in-C and or Structural Consultant. The decision of above persons shall be firm and binding on the Contactor.

Schedule for Basic Rate Provided materials in Work-Order Or Client’s supply materials : Procurement of Ready-Mix-Concrete (RMC)

6.1 PMC/Client will approve rates of RMC, if basic rates are provided in Work-Order, as per procedure mentioned in “Civil Contract (M&L Basis)” main documents. And contractor will then do the necessary follow-up with vendor for his requirements. But if client decides to supply RMC in account of contractor as basic rates/quantity-consumptions are provided in Work-Order OR if supply of RMC is in scope of client, the procedure for procuring the RMC shall be as under:

Approval of Mix-design of RMC vendor

6.1 (a) Client/PMC will give list of approved RMC vendors to contractor. Contractor will obtain Mix-Design from those RMC vendors and send it to PMC for his written approval.

Weekly schedule 6.1 (b) Contractor will do the necessary follow-ups with approved RMC vendor for his requirements of concrete. The Contractor shall prepare the weekly schedule on every Saturday and send to RMC plant and PMC, for requirement of RMC in the next week, with probable time for RMC required at site.

Indenting procedure

6.1 (c) Next day’s requirement of RMC with time to reach the RMC at site shall be confirmed by the Contractor to RMC plant and PMC by 5.00 pm. However in case RMC requirement is cancelled or postponed, the Contractor must inform well in advance to RMC plant and PMC for such cancellation or postponement on the previous day for demand of RMC. This will help RMC supplier to take adequate measures to divert and arrange his RMC supply suitably. If any misunderstanding in such follow-up between contractor and RMC plant leads to any financial implication to client, such amount will be recovered by client from contractor from any sum due to contractor.

Time for unloading the transit mixer

6.1 (d) Contractor must ensure that the RMC Transit Mixer is unloaded/used as per guidelines mentioned in respective element’s checklist. In case Contractor fails to do this, the transit mixer with RMC will be returned to RMC plant and the cost of wasted RMC shall be borne by Contractor.

Pour Card 6.1 (e) It is the responsibility of the Contractor to satisfy himself first for the checking of formwork, reinforcement and get it approved from E-in-C before jointly signing pour card maintained by E-in-C at site.

Procurement of Reinforcement Steel

6.2 PMC/Client will approve rates of Steel, if basic rates are provided in Work-Order, as per procedure mentioned in “Civil Contract (M&L Basis)” main documents. And contractor will then the do the necessary follow-up with vendor for his requirements. But if client decides to supply Steel in account of contractor as basic rates/quantity-consumptions are provided in Work-Order OR if supply of Steel is in scope of client, procedure for procurement of Reinforcement Steel will be as below:

Time for indent and procurement reinforcement steel

6.2 (a) On receipt of the reinforcement drawing from PMC, Contractor shall work out quantities required for reinforcement steel and the demand note for steel shall be given to PMC by Contractor, 10 days in advance diameter wise so that the procurement action can be taken properly to avoid any delay on progress of work.

Stacking, shifting and consumption of Reinforcement steel

6.2 (b) The Contractor shall arrange that Reinforcement steel is being unloaded near to his steel yard. In case there is a space constraint at site, reinforcement steel will be unloaded nearest possible to Contractor’s steel yard. Re-shifting of this steel to his required place shall be arranged by the Contractor at his own cost, for use in the works. Irrespective of supply scope of client / contractor, on receipt of the Reinforcement steel, contractor shall at his own cost arrange to stack the reinforcement steel on MS logs or on hard platform or on MS vertical platforms, diameter wise, to protect the Reinforcement steel from direct contact of dirt, dust and water. The Contractor shall consume Reinforcement on First come first consumed basis. If steel is being supplied by client and if site condition does not permit for straight bars supply, client will be supplying bent bars (in 9-10MT supply lot, in small size trucks). Contractor is expected to accept the material as may be the case and do the necessary action for cutting/bending at his own cost.

Demand of other materials 6.3 PMC/Client will approve rates of Other Materials such as Cement / Sand etc., if basic rates are provided in Work-Order, as per procedure mentioned in “Civil Contract (M&L Basis)” main documents. But if client decides to supply these materials in account of contractor as basic rates/quantity-consumptions are provided in Work-Order OR if supply of any of such material is in scope of client, the contractor shall submit his indent to PMC at least 7 days in advance so to procure the materials well in time to avoid any delay in progress of work. Contractor will then the do the necessary follow-up with vendor for his requirements.

Timely supply of materials 6.4 The Client if supplying any material, shall arrange to supply the materials on date requested by Contractor as far as possible. However in case of delay in arranging supply of materials only extension of time will be granted to the Contractor.

Claim of IDLE charges 6.5 Contractor’s claim for IDLE Charges of manpower, establishments, tools and tackles, plant and equipment or any other means due to delay in supply of materials by Client shall not be entertained, considered and paid.

Contractor’s obligations 6.6 Any delay in working out and demand of steel and or other materials under purview of Client’s supply will not relive him from his obligation of completing the work in stipulated time agreed and accepted by him.

Liquidated Damages

7.1 In case the Contractor failed to complete the all activities of work on stipulated Completion time agreed and accepted by him, liquidated damages will be levied against him.

7.2 The recovery of liquidated damages will be recovered at the rate of Rs. 30,000/- per day, subject to maximum of 5% (Five percent) of the contract amount.

7.3 The amount will be deducted from any amount due to Contractor and shall be without prejudice to the rights of the Client.

7.4 However the Contractor shall note that the payment or Deduction made for such liquidated damages does not relieve him from his obligations to complete the work or other obligations and liabilities under this agreement.

Measures to be taken for Non-Compliance of notice for the Defective-works

8.1 In the event it is noticed by the E-in-C or Client that Contractor’s quality of work is substandard, contractor must be informed in writing to repair/rectify/dismantle/demolish the defective work within the time frame assessed by E-in-C. The Contractor will be given maximum one week notice to repair / rectify / dismantle / demolish the defective work and redo properly. On completion of the notice-period, if the Contractor fails to repair / rectify / dismantle / demolish the defective-works done by him, the E-in-C in consultation with the Client will carry out the said works through other agencies Contractor’s risk & cost, without issuing any further notice to contractor. PMC does not need any approval from the civil-contractor to start such works with any other agency. However, as a punitive measure the expenses will be recovered “at twice of the cost accounted by client for carrying out the said works by other agencies” (which includes the supervision/over-head cost incurred by client/NPSPL).

Measures to be taken for “Unattended scope of works/items” by the civil-contractor

8.2 The Contractor will be given maximum 30 days’ notice to start any of the unattended item, which is in scope of contractor. On completion of this notice period, if the Contractor fails to start the unattended item with full strength (which is in his scope of works), PMC in consultation with the Client will carry out the said works through other agencies at Contractor’s risk & cost, without issuing any further notice to contractor. PMC does not need any approval from the civil-contractor to start such works with any other agency. However, as a punitive measure the expenses will be recovered “at twice of the cost accounted by client for carrying out the said works by other agencies” (which includes the supervision/over-head cost incurred by client/NPSPL).

Insurance, ESIC and EPF policy

9.1 Contractor shall, at his own cost, obtain and maintain Insurance to fully cover their personnel deployed at site, as required under Workmen’s Compensation Act & ESIC Act. EPF policy for all his workers will also be paid by contractor at his own cost. Please note that “Insurance of Labours” must be done site specific i.e. Insurance must be done specifically for “Rajasthan Vidyarthi Griha” site labours, not covering contractor’s other running site. Contractor’s quoted rate must be inclusive of all such expenses needed to be done by him. Copy of all such documentations must be submitted by contractor along with his RA bills. Workers will not be permitted to work at site by E-in-C, without having insured by contractor. These insurances must remain valid till completion of all his scope of works. Client to obtain 3rd Party insurance of insurance to cover all visiting people at site, at his own cost. This insurance must remain valid till completion of project.

Payment of Insurance premium

9.2 Contractor shall at their cost arrange requisite Insurance policies for their materials, tools, tackles, equipments etc. till successful completion of all his scope of works.

Indemnify 9.3 Contractor shall indemnify and shall keep Client and PMC indemnified against any and all actions, claims, damages and costs under the Workmen’s Compensation Act or Analogous law.

Dealing with concerned authorities in case of accidents / mishaps

9.4 The Contractor shall deal with the concerned authorities in case of accident / mishap happens at site and see that in PMC or Client are indemnified from such dealings. All expenses for settling such matter also to be borne by contractor.

Liability to pay damages 9.5 The Contractor shall pay at his own cost any compensation to affected person or his legal heir, in case of any accident or mishap happens at site premises, irrespective of settlement of claim from Insurance agency.

Labour/Labour Laws 10.1 The Contractor is solely responsible to follow all applicable labour laws in force and which may come during the course of contract period, at his own cost.

In-case of failure of contractor in compliances of labour laws & insurance

10.2 In the event of expenses incurred by client, due to failure or inability of contractor to discharge the duties arising out of compliances required under above mentioned labour laws and insurance requirement, then the same will be made good (recovered) from the payable amount to contractor.

Control on labour 10.3 The Contractor is responsible to ensure that workers deployed at site shall not occupy any space other than the labour camp space provided/approved by PMC.

Materials for labour hutments and toilets

10.4 All materials required for building labour camp / labour toilets shall be provided by the Contractor at his own cost. In case the materials provided by the Client, the cost of materials will be recovered from any amount due to Contractor. All municipal approvals required to erect labour-camps, toilets and site-offices to be brought by client at his own cost.

Shifting of hutments 10.5 In case due to space constraint it is found necessary in the opinion of E-in-C that Contractors temporary structures are to be removed /shifted to other locations, Contractor has to remove and re-erect, at his own cost, his establishment in to the space allocated by E-in-C. Shifting & re-shifting is not limited to any no.

Damages to client’s or adjacent properties

10.6 The Contractor will be responsible for any kind of destruction/damage made by his labour to the client’s or adjoining properties during the tenure of construction in the premises. The Client will ascertain the quantum of such damages with the help of PMC and decide the compensation. The Client’s decision regarding compensation to be paid to the claimant will be binding on the Contractor. In case the Contractor is failed to pay compensation to the claimant, Client will pay the same and recover it from any payment due to Contractor.

Optimal usages of electrical energy

10.7 The Contractor must ensure that electrical energy/water, and other materials supplied by Client or materials of other agencies to incorporate in the work shall be used in most optimistic way. In case any misuse found, Contractor shall be held responsible and amount recovered from Contractor’s dues as per PMC’s certification. PMC’s decision regarding penalty will be binding on the Contractor.

Maintaining good hygienic conditions

10.8 It will be the responsibility of the Contractor to ensure and maintain good hygienic conditions in the labour camp and toilets till satisfactory completion of all his works, at his own cost. Contractor must follow rules and regulations laid by BMC/Govt. regulatory from time to time for maintaining healthy and hygienic conditions at site, at his own cost. Contractor to ensure that nowhere water must remain accumulated at site and malaria must not spread. Labours must get checked regularly for malaria treatment & other diseases and record for these tests must be submitted to PMC as and when asked by PMC or local govt. authorities. Contractor must engage ONLY the private doctors for treatment to his labours (Govt. Doctors/Hospitals NOT to be consulted for any matter/case). Cost of all such treatments and tests must be borne by contractor. If any penalty is levied by any govt. authority due to contractor’s negligence on this account, it is to be handled and paid by contractor at his own cost. Copy of all such documentations must be submitted by contractor along with his RA bills. If it is observed that contractor is failing in maintaining govt. authority required hygienic conditions at site, Rs. 1,00,000/- penalty will be levied by client for every such incident, in addition to the penalties levied by govt. authority.

Dry/Wet garbage bins 10.9 Contractor must strictly follow Solid Waste Management practice in professional manner & as per govt. regulations, at his labour camps, at his own cost. For collecting the dry and wet garbage from labour camp, the Contractor shall arrange dust-bins / garbage-collection-bins (separate for Dry and wet garbage) and also arrange the removal of the same according to Municipal regulations at his own cost. The manure generated by waste management must be disposed by proper professional practice, by contractor at his own cost. 1 Nos. of MS/PVC debris-chute must be installed and maintained by contractor at his own cost for each wing (if wings are not interconnected thru common passage), from terrace to Gr. Floor, to bring down debris from upper levels.

Vacation of premises 10.10 The Contractor will be responsible to vacate the premises occupied by labour camp, toilets, stores, offices, temporary structures erected during the tenure of work. The Contractor shall immediately dismantle, remove all above mentioned structures including his plants and equipments, tools and tackles, at his own cost. The site occupied shall be leveled properly at no extra cost to client.

Safety 11.1 Safety of all workers, staff, supervisors, subcontractor’s with their workers, PMC’s Staff, Consultant’s and their staff, Client and Client’s staff at the work site and premises is the first priority of the Contractor. A complete kit (equipped with all necessary medicines) must be maintained by contractor at site for his complete work schedule.

Scope 11.2 The Contractor’s scope shall include formwork, scaffolding, provide personal protection safety equipment / gears, helmets, boots, safety belts, goggles and everything else necessary for the proper execution and successful completion of the work. Shuttering, centring and scaffolding design for entire project (for all levels) is also in scope of contractor, at his own cost. But contractor is expected to take approval from PMC before implementing such designs. Contractor at his own cost display safety and related instructions at site clearly and at various locations to educate the working people at site. All staircases midlandings, landings, floor entry-exit, peripheral lighting along with building and stores/areas lightings must be installed and maintained by contractor at his own cost till satisfactory completion of his scope of works. A penalty of Rs. 1,000/- will be levied on contractor for any incident of safety lapse in missing of equipment/gear/helmet/boot/safety-belt/safety-goggles/lights at site.

Safety net 11.3 i) Safety net must also be provided covering compound of building & over-the-road in-front of plot-premise, as directed by E-in-C.

ii) Safety platform shall be provided 4m projected on 5th floor level, by Contractor all around periphery, from building-face, at his own cost as directed by E-in-C.

iii) One safety net around the periphery of building (approx. 4m cantilevered) must be installed 2 floors below RCC working floor, as directed by E-in-C.

iv) One more safety net around the periphery of building (approx. 3.0m cantilevered) must be installed 2 floors below Masonry working floor, as directed by E-in-C.

Both these safety (sr. no. iii & iv) nets must be moved upwards along with work progress. No wooden element will be permitted as bracing/supporting member in any safety-platform. A penalty equivalent to the actual expense incurred by client in managing the accident Or Rs. 1,50,000/-, whichever is higher, will be levied on contractor for any incident of safety lapse in missing of these safety platforms at site OR not maintaining it as and when asked by PMC. Contractor to do all necessary safety arrangements to keep neighbouring properties safe from any danger getting arises from his scope of works (to the satisfaction of neighbouring society), at his own cost. In such cases, client/PMC may ask contractor to enhance safety measures done by contractor, without any extra cost to client. Contractor is bind to follow their instructions in such case.

Liability of Contractor 11.4 The Contractor shall be fully responsible and liable for everything and all matters in connection with or arising out of or being a result or consequence of contractor carrying out or omitting to carry out any work. Where Sub-Contractor’s may execute any part of the works, such responsibility and liability of contractor’s work shall cover and extend to the work of all such Sub-Contractor’s also.

Responsibility of Contractor

11.5 It may be noted that the Contractor has to take full responsibility for the safety, stability and adequacy of all site operations and methods for contractor’s work including all temporary works. In any-case Client/PMC will not be responsible for any accident happens at site to contractor’s employed persons.

Safety measures 11.6 The Contractor shall guard personnel at his own cost around all excavations, construction/civil work in progress, and openings and at all edges, temporary stairs and other temporary measures required during construction. The supports used for the scaffolding, staging guardrails, barricades and safety barriers and temporary stairs shall be strong, adequate for the particular situations, tied together with horizontal pieces and braced properly. The entire scaffolding arrangement together with the staging, guard rails, barricades and safety barriers, and temporary stairs provided needs the approval of the E-in-C, however such approval shall not relieve the Contractor of any of his responsibilities, obligations and liabilities for safety and for timely completion of the works. The use of wooden scaffolding on the Site is strictly forbidden. All small, large ducts and cut-outs must be covered with steel mesh or barricading by contractor at his own cost. All areas from where person can fall, shall be barricaded by green-net with required angle-framing and railings (strong enough to protect person from falling), by contractor at his own cost. A penalty of Rs. 10,000/- will be levied on contractor for any incident of safety lapse at site.

Deployment of Electrician 11.7 The Contractor will deploy a full-time electrician at site at contractor’s cost for contractor’s assistance and Client will not be responsible for any accident / safety negligence from Contractor employs, in handling of any electrical equipment. It may be noted that it will the sole responsibility of the Contractor to provide proper protective measures for electrical wires/cables insulation provided for operations of Concrete mixers (of 1 cement bag mixing capacity), vibrators, hoists, spot lights, drill machines, welding machines and other electrical equipments during the tenure of work.

Safety Officer 11.8 NA

Cleaning of site 12 The Contractor shall depute in consultation with E-in-C adequate workers to clear the site from debris, wastages of ply or timber pieces, concrete, bricks, blocks, mortar splashes and the like on daily basis.

Discipline 13 The Contractor must be aware that the work is in residential area. Any nuisance, misconduct caused by his workers, staff, subcontractor’s or subcontractor’s workers shall be dealt by the Contractor and he shall indemnify Client and PMC’s staff from such acts.

Arbitration 14.1 All disputes, meanings, doubts, differences of any kind, interpretations, assumptions, clarifications, claims and the like arising out of or relating to contract specifications, designs, drawings, quality of materials incorporated in the work, instructions or orders or those conditions related to execution of work, or failure to execute the work at any stage shall be referred to Arbitration under the provisions of the Arbitration & Conciliation Act, 1996 or any statutory modification or re-enactment thereof and the rules made there under and for the time being in force to the sole arbitration of the Director of the PMC during the currency of work or after completion of the work within 10days. The award given by the Director of PMC shall be binding on Contractor and Client, both the parties, unless it is set aside by the Court.

Disputes 14.2 The Contractor invoking arbitration shall specify disputes to the arbitrator with the amount of claim.

Prayer 14.3 The prayer of the Contractor for arbitration shall not be time barred in accordance with the provisions of Limitations Act 1908 or 1963 as the case may be.

Reconciliation of Reinforcement Steel

15.1 Steel reinforcement reconciliation : following procedure will be adopted a) Contractor’s Project engineer shall submit reconciliation of the steel statement for

scrutiny to E-in-C’s certification that adequate quantity is consumed in the work as mentioned by Structural Consultants.

b) In-case of less consumption of steel in the work, contract amount will be proportionately devalued and the cost will be deducted from Contractor’s dues in consultations with structural Consultant and E-in-C.

Cut pieces of Reinforcement steel /scrap shall be stacked at site separately and to be removed form site at regular interval and as and when instructed by E-in-C.

Reconciliation of cement/RMC used

15.2 1. Cement used in the various mortar mixes, concrete mixes shall be ascertained by Contractor’s Project Engineer.

2. The Contractor shall ensure that adequate quantity of cement is consumed in the work. 3. Contractor’s Project engineer shall submit reconciliation of the RMC statement for scrutiny

to E-in-C’s certification that adequate quantity is consumed in the work as mentioned by Structural Consultants.

4. In-case of less consumption of cement/RMC in the work, contract amount will be proportionately devalued and the cost will be deducted from Contractor’s dues in consultations with structural Consultant and E-in-C.

In case of excess consumption the cost of extra cement/RMC consumed shall be borne by Contractor.

Mode of Payment 16.1 The Contractor shall claim his Running Advance Bill (R.A. Bill) on completion of actual work done not less than Rs. 30.0 Lakhs (Rupees Thirty Lacs only) or at 30 days interval, whichever is earlier. Copy of Challans for Provident Fund, ESIC and Insurance paid by Contractor for his labours, must be submitted along with his RA bills. Without having attachment of these challan copies bills will not be recommended or entertained by PMC for payments. The contractor will be required to furnish bill for the work done (as mentioned above) and also an undertaking that he is complying with all the statutory requirements and is paying all the statutory levies for all the labours employed by him. The bill will not be recommended for payment without the undertaking. 8 to 10 Photographs must be attached with the bill for explaining the completion of the items being claimed in the attached bill (along with building photo from around 100m, self-explanatory about “status of completed floors”). Photographs must also must be self-explanatory in regards, of the overall cleaning being maintained at site and photographs of completed grinding works (explaining quality of work being done).

Duration for scrutiny and certification of R.A. Bill

16.2 The bill will be scrutinized by E-in-C within 4 days and will be forwarded to PMC’s office for certification and onward transmission to Client for releasing the payments within 7 days of receipt of the R.A. Bill from E-in-C.

Release of payment by Client

16.3 The Client may release the payment within 7 days from receipt of the certified bill from PMC. In all, contractor can expect payment within 21 days of his bill submission.

Retention money 16.4 The retention money will be 5% of work done amount. This will be deducted from each R.A. Bill. The retention amount will be released in two parts. 2.5% after the “Virtual Completion Certificate” received from Nexus PSPL for contractor’s scope of works and balance 2.5% after defect liability period of one year, from the date of “Virtual Completion Certificate” issued by PMC for contractor’s scope of work. The first 2.5% retention amount (out of the total 5% retention amount) will be released only after receiving proof of all PF amounts paid by contractor for his labours deployed at “Rajasthan Vidyarthi Griha” site during his work duration.

Recoveries 16.5 Recoveries towards defective, incomplete works or any work not performed as specified and or any other recoveries as in the opinion of E-in-C, will be deducted from the payment due to the Contractor.

Debit notes 16.6 In case any debit notes raised by the E-in-C, such amount shall be kept on HOLD till the settlement of such debit notes and will be released or deducted after final settlement.

Incidental expenses 16.7 All on-site and off-site incidental expenses in connection with the contracted work shall be borne by the Contractor. But any nuisance raised at site by any out-sider will be handled by contractor and paid by client separately.

Final Bill 16.8 The Contractor shall submit final bill with after completion of all works assigned to him under this contract with all supporting documents to E-in-C. Contractor shall also submit his “No Claim Certificate” along with his final bill in format provided by PMC. After scrutiny of final bill, PMC shall certify the final bill within 45 days considering all extra claims, debits, retention money and forward the final bill to Client for release of payment.

Release of payment of final bill by Client

16.9 The Client shall release the final bill amount due to Contractor within 25 days after receipt of the certified final bill from PMC

Water : For Construction purpose

17.1 Water for Construction purposes will be arranged & supplied by Client free of cost to the contractor (for contractors’ team, PMC office and all other agencies).

Infrastructure for distribution of construction-water

17.2 All necessary infrastructures for distribution of water for construction purpose on each floor (using GI pipe, not PVC/cPVC) shall be done by the contractor at his own cost. Further distribution on each floor will also be done by contractor at his own cost. The Contractor shall ensure that the curing work shall be carried out properly at any/all levels. Water pumps of adequate capacities required for supplying the water at locations shall be arranged by Contractor at his own cost. All repairs and maintenance, to the pumps and pipe lines shall be carried out by Contractor at his own cost. Contractor to allow other agencies working for the project, use of such pumps & water without any extra cost to client. Contractor to handover such water-lines laid by him to client without any extra cost to client.

Water : For Drinking purpose during construction

17.3 The Contractor shall arrange & supply drinking water at his own cost (for his team, PMC office, door-frame-fixing-agency & electrical slab-conduiting-agency). If municipal drinking lines can be arranged by client at site, monthly bills for uses of water to be borne by contractor. Client will do sub-metering once other agencies will start working at site so that other agencies water uses are being paid by them-self. Meters shall be installed by client at his own cost.

Infrastructure for distribution of drinking-water

17.4 All necessary infrastructures for distribution of water to labour hutment (including drinking purpose) shall be done & borne by contractor from water-meter/storage-tank to his working areas. Water pumps of adequate capacities required for supplying the water at locations shall be arranged by Contractor at his own cost. All repairs and maintenance, to the pumps and pipe lines shall be carried out by Contractor at his own cost. Contractor to handover such water-lines laid by him to client without any extra cost to client.

Storage tank 17.5 The Contractor shall make adequate capacity storage tanks at his own cost, to store the water required for construction as well as drinking purpose.

Delay in Supply / non supply of water

17.6 If water-supply is in scope of client, in-case of delay in supplying of construction-water from client, contractor MUST bring water from his known resources but MUST take rate approval from nexus billing-head before ordering for supply. In no case delay in arranging supply or non-supply of water will relieve the Contractor to complete the work within the stipulated time period.

Electricity : For Construction purpose

18.1 The Electric supply (3 Phase) will be provided by the Client at one point, at ground floor. Further distribution shall be done by Contractor at his own cost, for his scope of works.

Use of electricity 18.2 The electric energy bills consumed during construction period will be paid by the client at his own cost. The Contractor shall use electric energy in most optimistic manner and for bonafide purpose.

Infrastructure for distribution of electricity during construction

18.3 All necessary infrastructures for distribution of electricity, for construction purpose, on all floors (using cable, not wire) shall be done by the Contractor at his own cost. Contractor to maintain staircase area lighting (on all floors) at his own cost, till completion of his scope. Any further distribution of electricity, for his scope of works, will also be done by contractor, at his own cost. The Contractor to arrange infrastructure and distribution of this supply at various locations (including labour camps & working areas) as per the site requirement at his own cost (this includes halogens required for working of labours), from electric-meter to his working areas. Compound lighting (for property only) will be done by client at his own cost. These lighting will also maintained later by contractor at his own cost till completion of his scope of works. Contractor to handover such lights and its distribution network to client, after completion of his scope, without any extra cost to client.

Adequacy of electricians 18.4 It will be the whole responsibility of the Contractor to keep licensed electrician/electricians along with a trained helper/assistant at site.

Precautions to be taken while using electricity

18.5 All the electrical points, installations made at various locations shall be thoroughly checked before using the equipments. In any circumstances wires shall not be kept loose or hanging. Joints if any shall be secured properly so that no leakage of electric current occurs.

HEADING CLAUSE DESCRIPTION

Storage of Materials 19.1 The Contractor shall prepare location plan to store his material, in an optimistic way. This plan shall be got approved from E-in-C before implementing at site. A) Cement godown B) Stores for tools and tackles C) Platforms for perishable materials like sand, stone metals. D) Stores for other materials supplied by Client.

Consumption of materials 19.2 Storage of consumable materials shall be arranged in such a way that the materials used follows “first come-First used” basis.

Storage of perishable materials

19.3 Perishable materials like sand, Coarse aggregates shall be stacked on proper hard base and adequate partitions to avoid wastages.

Material Procurement & Transfer

20.1 The Contractor shall procure material at the wholesale prices. The material if in emergency procured by retail price will be certified by the E-in-C.

20.2 The transfer slip for transfer of shuttering material, cement, steel or any other material at the site will be duly signed by the E-in-C

20.3 The material for shuttering and labours for civil work will be brought as per requirement at the site and demand certified by E-in-C.

Drawings 21.1 Drawings will be issued to Contractor by E-in-C. Drawings issued marked with “For Site Execution” or “Good for Construction” or “Execution” or “For Construction” only shall be used for execution of work.

Revised drawings 21.2 In case any revised drawing is issued by E-in-C for execution purposes the drawings issued earlier shall be discarded immediately duly marked with “SUPERCEDED - NOT TO REFER”.

Ownership of drawings issued to Contractor

21.3 All drawings issued to the Contractor are property of the Client and shall be returned to the Client on successful completion of the work.

Use of drawings 21.4 The working drawings / Elevations / Sections / Structural drawings and details, issued relating to this work shall not be used for any other purposes or for other works as this is intellectual property of the Architect/Consultant related to this work only. The Contractor will be held responsible for such misuse. If it is found that contractor has shared project drawings to any outsider, without consenting client, hefty penalty will be levied to contractor due to such misuse.

In-case of discrepancy in Arch & RCC drawings

21.5 “Advance Copy” of any architectural & structural drawing for any particular stage will be issued to contractor, as per his submitted schedule, before issuing “Good For Construction” drawing for same. Contractor MUST read architectural & structural drawings well before execution. He must inform Nexus-TD / PM / Sr. Engr. within 7 days of issuing “Advance Copy” for any discrepancy found between architectural & structural drawings. GFC of any drawing will be issued ONLY AFTER obtaining comments from contractor so that necessary corrections can be incorporated in GFC. Contractor must re-check for any discrepancy before execution even in GFC issued and brought to the notice of Nexus-TD / PM / Sr. Engr. Else re-doing or rectifying cost (as instructed by PMC) to be borne by contractor. The Contractor must study all architectural & structural GFC drawings in detail. Any discrepancies or deviation from the drawings and/ or in his scope of works, shall be reported to the E-in-C at the earliest by the Contractor, before starting the work. In any circumstances, Contractor shall not take any decisions directly regarding the drawings or the design considerations. Else re-doing or rectifying cost (as instructed by PMC) to be borne by contractor. In general, there may be some small changes at 1st Basement-floor, 1st podium-floor, 1st ramp & 1st typical-floor slab/beam shuttering/reinforcement. Contractor is expected to make necessary corrections in laid shuttering for only these initial stages as instructed by PMC/Client, without any extra cost to client. If any beam is protruding down in bed-room / kitchen / living-room of lower-floor, it MUST BE brought to notice of PMC director, before execution. Else re-doing or rectifying cost (as instructed by PMC) to be borne by contractor at his own cost. If any beam/slab/drop is protruding down in parking areas and reducing the clear-height for parking from less than 2.4m for single-parking or 3.85m for stack-parking or 6.6m for puzzle-parking, it MUST BE brought to notice of PMC director, before execution. Else re-doing or rectifying cost (as instructed by PMC) to be borne by contractor at his own cost.

Onus 21.6 The onus shall be on the Contractor to obtain all the necessary approvals in writing for every stages of work, such approvals, however, shall not relieve the contractor of any of his responsibilities under this Work-Order. In case, discrepancies are found at a later-date or during-execution and even the E-in–C has missed any point while checking and allowed the contractor to progress the activity in spite the drawings contains correct details, it shall be the responsibility of the Contractor to rectify, modify and redo the work at his own expenses. Discrepancy, if any found, shall be brought to notice to E-in-C in writing before execution of work. In case the work is executed at site without proper checking/coordinating by Contractor and the mistake is pointed out by E-In-C or Architect or Consultants, the Contractor shall rectify, modify and redo the work at his own cost. In case materials supplied by Client, then the expenses shall be recovered from Contractor’s due payments.

Reporting 22 The Contractor shall submit report to E-in-C mentioning manpower & machineries deployed at site and activities in progress, every-day in the morning latest by 10.00a.m.

Termination 23.0 The work will be terminated due to following reasons :-

Quality 23.1 Substandard quality of workmanship.

Inadequacy 23.2 Failing to employ adequate manpower, materials, machinery, plant and equipment to achieve the accepted planned progress of work.

Time schedule 23.3 Failing to adhere mutually agreed time schedule due to slow progress / improper scheduling / mismanagement of work.

Rectifications 23.4 Failing to carry out rectifications / repairs ordered by E-in-C with in specified time frame.

Special Conditions: HEADING CLAUSE DESCRIPTION

Excavation

1.1 Excavation for new Compound-wall, UG-Tank/ RWH-Tank shall be carried out by contractor through his agency in soil/rock to required depth and removing excavated materials to Municipal approved dumping yard including royalty and other charges, at his own cost. Excavation for compound-wall, compound-gates, SWD and watchman-cabins also to be done by contractor at his own cost to required depth Removing such excavated materials to Municipal approved dumping yard including royalty and other charges also in contractor’s scope.

1.2 Contractor to closely supervise excavation agency and get the desired levels done as required.

1.3 In case further fine tuning in leveling is required to be done to make the excavated surface in desired level, Contractor to get it done by providing Plum concrete or P.C.C. as directed by E-in-C of Nexus.

1.4 Contractor shall dress the bottom surface dressing manually to ensure correct desired level is achieved before carrying out P.C.C. for foundation/Pile-caps.

Dewatering

2.1 Contractor shall arrange at his own cost minimum Two dewatering pumps of 5.0 HP capacities in working conditions at site to bail out water coming from all sources in to the excavated area. These pumps must be maintained by contractor at site from start of foundation work to completion on back-filling of below ground pits. Smaller/as-reqd capacity pumps to be maintained by contractor later-on till the completion of all his work scopes, for any sort of pit-dewatering.

Dewatering must be done by contractor keeping in mind all municipal regulation about water-drainage. Water must be discharged into municipal drain only after required level of filtration. If any objection or penalty is levied by govt. authority, it must be managed, settled and paid by contractor at his own cost.

Maintenance of dewatering pumps

2.2 The maintenance, upkeep and repairs to pumps and repairs/replacement of accessories for dewatering pumps shall be borne by Contractor.

Dewatering pump operators

2.3 It will be the responsibility of the Contractor to deploy totally dedicated and adequate numbers of pump operators at site to bail out the water from excavated area and dispose it in the authorized municipal drains thus keep the site clear of water stagnation always. No extra charges shall be paid to the Contractor in this regard.

Dewatering of Sumps/lift pits

2.4 The Contractor shall continue dewatering in the sump/Sumps and lift pit, till the sumps and lift pits are totally waterproofed.

Site logistic Plan 3 The Contractor has to accommodate his establishment within the available space in the site. Due to exigencies at site in the opinion of the E-in-C, Contractor has to shift his establishment to the other location with the consent of E-in-C, as mentioned in “Scope of Work for Contractor, clause no. xiii”.

Safety Precautions 4 The Contractor must keep safe entry and exit passages for workers to use in all situations to archive total Safety measures at site. The passageways and working paths shall be always kept free of any obstacles all the time.

House keeping 5.1 The Contractor shall ensure that, he shall clear surfaces for himself to work at his cost and also provide clean surfaces wherever required for other agencies to work, once his scope of work is complete for any element.

Penalty due to bad housekeeping

5.2 In case Contractor failed to keep site clean and clear, E-in-C shall give notice to the Contractor in writing to act up on. Even after the notice, if the Contractor is failed to keep site clean and clear, then E-in-C in consultation with Client will employ adequate workers to clear/clean the site and expenses incurred + 100% additional charges for supervision as penalty will be recovered from “Contractor’s dues.

Coordination and cooperation with other agencies working for same project

6 The Contractor shall cooperate and closely coordinate with the Lift, Fire, Electrical, Sanitary, Plumbing, Air-conditioning and any other Contractors, adequately making necessary provisions as required from time-to-time. Co-ordination with these agencies to be maintained by PMC. Any logistic-support and services to these agencies are not in scope of civil-contractor, unless specifically mentioned anywhere in these contract documents.

Working hours 7.1 The work is in residential & Commercial area, The Contractor shall plan his working schedule accordingly in normal working hours. He must himself enquire about working hours available for construction in the area.

Overtime cost 7.2 If it is necessary for the Contractor or any Sub-contractor to work on other than working days or outside the normal working hours in order to keep up to the time schedule and meet the Construction Programme, the Contractor shall obtain the prior approval of the E-in-C in writing, which approval shall not be unreasonably withheld. The additional cost of wages and any other costs incurred as a result of overtime or any shift work (except supervision expenses incurred by the PMC/Client) shall be borne by the Contractor. The Contractor shall take necessary precautions to avoid any inconvenience, nuisance to the person/persons residing in adjoining properties of work site where work is being carried out.

Night work/Late hours work

7.3 The Contractor is normally expected to work during daytime and is required to complete the work in all respects as stipulated elsewhere. However, night work may be stipulated and shall be permitted in exigencies with the prior approval of the E-in-C at Contractor’s own cost. Further, contractor must start & finish concreting activities as timely as possible so that night concreting in not required to be done at site. In-case, due to delay in RMC supply or delay-in-start-of-concreting-work, if any neighbour or police matter arises, it must be handled, managed & settled by contractor at his own cost.

Targeted completion date

8 The Contractor must ensure that he may not get the opportunity to do either overtime work or night work mentioned in Para 5.1, 5.2 and 5.3 above. However, this does not permit the Contractor for asking for any extension of time in completion-period mentioned in “Civil-Contract (M&L Basis), Clause E” and “Annexure B, Clause 2.2”.

Optimum usages 9.1 RMC: The Contractor must use RMC in most efficient and optimistic way.

9.2 Steel: The Contractor shall prepare his bar bending schedule in such a manner that the wastages shall be bare minimum.

Steel-Scrap 9.3 The steel scrap will be defined as below: a) Lengths less than 1.5 running meters in case of bars up to and including 12 mm dia b) Lengths less than 3.0 running meters in case of bars more than 12 mm dia.

Formwork 10.1.1 Formwork to be used in the work shall be of Good quality plywood of Pragati/Orient/Silence/Nocteply Brand or other brand approved by E-in-C. Only new plywood will be allowed for works. M.S. Plates will not be permitted for formwork.

Wt. of 12 mm thk plywood to be used in formwork

10.1.2 The Contractor must ensure that the weight of 12 mm thick plywood to be used in formwork shall not be less than 34 Kg for 32 sqft. Plywood being used must be film/plastic coated and conforming to IS: 4990 with not more than 12% moisture content.

Vertical props 10.2 All vertical support props shall be of M.S. Only. Such MS props can be permitted height only upto 4.2m. For height more than 4.2m “H” frames or Cup-Lock system only will be permitted for use.

M.S. Spans 10.3 The Contractor may use M.S. Spans of appropriate design duly approved by E-in-C.

Use of plywood shuttering

10.4 The Contractor is expected to use Plywood shuttering for columns and sides of beams, slabs, chajjas, canopies, flower beds, lift walls, shear walls and the like. Shear-walls/Lift walls/Retaining-walls must be casted strictly using tie-rods. Contractor is expected to have one complete set of shuttering and scaffolding for one floors and 2nd floor beam bottoms. Any ply-set must be replaced after max. 8/10 repetitions or as instructed by PMC. Form-work system being used at site MUST BE groove-type, not pin-type. Only Ply-to-Ply joints will be permitted, not Wooden Plank-to-Ply joints.

Use of Tie-Pattis, Pin-Pattis, Tie-rods, PVC sleeve and cups

10.5 Tie-Patti, Pin-Patti, Tie-rods etc. must be used at adequate interval for RCC-walls, Columns, Retaining walls & lift walls. Contractor shall provide PVC sleeves with PVC cups so that the Tie-Patti, Pin-Patti, Tie bars etc. can be removed easily while de-shuttering. However, contractor must ensure that such Tie-Patti, Pin-Patti, Tie-rods are removed properly during de-shuttering process and their holes must be drilled with 4mm extra dia drilling-machine and plugged with cement mortar not less than (1:1) proportion mixed with BASF/Fosroc make non-shrinkage grout, at his own cost. In case of Aluform use, such holes must be filled from internal as well as external both sides before removing brackets of the casted floor. In case of conventional ply-shuttering use, such holes must be filled from internal side immediately after de-shutting of the floor-slab AND such holes must be filled externally along with external-plaster works. External-plaster of any area CAN NOT be done without showing all filled-up external-holes to site-in-charge.

Sleeves for MEP works (Mechanical/Plumbing/Electrical/Fire-Fighting)

10.6 Contractor shall fix PVC or G.I. sleeves at his own cost, free of cost provided by client, at desired locations and diameter shown by E-in-C, in concrete elements or in Brick work/block work. Contractor is permitted for 5%-6% dislocation of PVC sleeves while concreting but if more numbers of sleeves get dislocated then core-cutting charges to be debited to contractor for rectifying his poor workmanship.

Gaps in plywood joints 10.7 The plywood shuttering shall be fixed in such a manner to avoid gaps between ply. However, in unavoidable situations gaps shall not exceed 3 mm. Such gaps shall be filled with tapes of suitable quality duly approved by E-in-C.

Shuttering oil 10.8 Shuttering shall be properly treated with shuttering oil of good quality duly approved by E-in-C. It must be ensured that reinforcement shall not be coated with shuttering oil.

Cleaning, Stacking, Lifting-shifting and Maintaining the Aluminium Form-work

10.9 NA

Scaffolding 11 The Contractor shall use “H” frame scaffolding or good quality M.S. props with adequate bracings, clamps at intervals specified by the manufacturers with prior approval of E-in-C. “H” frames or Cup-Lock system only must be used for double/triple height work.

Workmanship 12.1 RCC work: All edges of RCC elements, levels, lines shall be maintained in true line and levels.

Hacking 12.2 RCC surfaces shall be hacked properly to receive plaster as directed by E-in-C.

Treating protruded portions

12.3 All protruded portions after removal of shuttering shall be grinded with grinder to make the concrete surfaces even. All expenses for such works shall be borne by Contractor.

Racking out joints 12.4 For Masonry-work joints shall be raked out to receive plaster as directed by E-in-C.

Screening of sand 13 Sand used for plaster/brick work/block work shall be screened, at contractor’s own cost.

Mixing of mortar 14 Cement mortar shall be mixed on MS trays only. Mixing on slab is strictly prohibited.

RCC-Lintels & Lift-gems

15.1 RCC-Lintels (cast-in-situ / precast) above windows & doors to be done by contractor at his own cost, wherever required. RCC/masonry/plaster works for Lift-gem to be done by contractor at his own cost, as per details provided by architect/lift-vendor. As lifts are generally finalized by client little late in project-schedule, there may be case when lift-details are provided to contractor later then his floor masonry/plaster works are completed. In such case, contractor is expected to make lift-gem in RCC/Masonry, as per details provided to him, without any extra cost to client.

Lift-Shaft Grinding & Chipping

15.2 If passenger/car lift-shafts are not in true line & plumb and if lift vendor requires any chipping/grinding/correction to bring the shaft in true line & plumb, civil contractor must do such corrections at his own cost.

Internal plaster 16.1 Internal plaster shall be in one coat and up to 15 mm thick. Internal plaster shall be provided in line, level and plumb. The plastered surfaces of walls shall be in right angle to each other so that thickness of neeru-finish / POP comes to maximum 8 mm thick. If POP thickness comes more than 8mm (due to walls not being in level/plum/right-angle), Contractor has to do second coat of internal plaster to level the surface at his own cost. In case the plaster has to be done more than 15 mm thick (due to walls not being in level/plum/right-angle), the Contractor has to do the internal plaster in two coats to bring the surfaces in right angle and in plumb at his own cost. Jhari/Grooving work done on walls, by electrical contractor (for laying his wall conduits), shall be plastered by civil contractor fixing PVC mess above jhari/groove work, at his own cost. But if Jhari/Grooving work is being done after the internal plaster-work is completed by civil-contractor, covering of concealed-conduit to be done be civil-contractor as an extra item. Internal plaster to be done leaving at least 230mm space from unfinished-RCC-floor (for fixing-up skirting by flooring-contractor). This balance internal-plaster above skirting shall also to be done by civil-contractor at his own cost, once skirting is fixed by flooring-contractor. Masonry/RCC surfaces where marble/granite door/window frames are expected to be fixed, must be single coat plastered by contractor at his own cost, as instructed by site-in-charge. Jhari/Grooving work done on Toilet/WC walls, by plumbing-contractor (for laying his plumbing pipes), shall be plastered by water-proofing contractor at his own cost. Waterproof plaster behind concealed-pipes shall also to be done by waterproofing-contractor at his own cost. If waterproofing is in scope of civil-contractor, such plaster shall also to be done by civil-contractor at his own cost. Gabda/Pocket created by plumbing-contractor, while laying his sewage/waste pipes in Toilets/WCs, shall be plastered by water-proofing contractor from internal side of Toilet/WC at his own cost. But Gabda/Pockets created in external face of building to be done by civil-contractor, at his own cost. If cracks appears on walls (due to whatever reasons), before the painting works are started, contractor is expected to repair such cracks without any extra cost to client. If such cracks appears on walls (due to whatever reasons), after the painting works are done, contractor is expected to repair such cracks without any extra cost to client but still contractor will be debited/charged by client 50% of the amount charged by the painting-contractor for re-painting the surface. This debit will be applied by client without going much into details of reason-of-cracks (just to simplify the situation & execution). Debris generated due to work executed by MEP contractor’s to be removed by civil-contractor, at his own cost, as instructed by PMC/client. Debris generated due to work executed by POP/Gypsum contractor is not to be removed by civil-contractor. However, if civil contractor is not cleaning the debris immediately after completing his internal-plaster, no reminder (for asking him to clean his debris) will be severed to him and POP/Gypsum contractor can be asked to start his works. In such case debris generated due to POP/Gypsum works will also be removed by civil-contractor at his own cost.

External plaster 16.2 External plaster shall be in two coats and max. 25mm thick sand-faced/hand-sponge-finish as directed by E-in-C, using waterproofing compound as per dosage directed by manufacturer.

If building is having more than 10 floors, contractor will have to do external-plaster in parts, i.e. minimum of 7 floors and maximum of 10 floor height must be plastered in one-go. This is MUST REQUIRED as this facilitates client to start internal finishing activities on floors where internal & external both plasters are completed. MS platform & all other supports required, to erect the scaffolding for above floor external-plaster, are in scope of contractor at his own cost. Shifting of such MS platform for upper level floor works is also in scope of contractor at his own cost.

If building height is more than 30m, entire external face of scaffolding erected for plastering must be covered with safety-net + green-hessian-cloth so that plaster drops does not spread in neighbouring building-compounds/roads.

Scaffolding system for external-plaster must be ‘H’ frames or cup-lock system only. Wooden scaffolding is strictly prohibited from use.

Top surface of external-plaster must be as directed by E-in-C. Contractor to do the levelling of ground surfaces (to erect scaffolding for external plaster), at his own cost. But if back-filling of excavated areas is in scope of client then levelling of plot (to erect scaffolding for external plaster) will be done by contractor as an extra item/cost to client.

Later date filling/casting of MEP cut-outs OR partly-casted-slab portions AND Covering of MEP ducts at parapet-level

17 PMC/Client may temporarily hold the construction of the MEP-Cut-outs-in-floor-slabs OR MEP-cut-outs-in-service-slabs etc. at various floors and may ask the contractor to complete such areas as per clearance provided by PMC/Him. Contractor will not be paid any extra amount or rate, over and above the contract price, for such delayed clearance provided by PMC/client for such areas. Some slab portions may also to be required to be left un-casted by civil contractor, as per MEP drawings & requirements at various floors. Such areas at Basements, Podiums, Service-floors and Typical-Floors (left un-casted for ease in Fire-fighting, Electrical, Plumbing and Mechanical-ventilation installations) must be casted by civil contractor once all MEP installations are completed. Nexus E-in-C written instructions only must be followed for this procedure. No extra payment will be paid to contractor in account of such slab portions being casted later OR any difficulty faced by contractor in casting of such slab portions due to the installed MEP services. All MEP ducts to be covered above terrace (at parapet-level) as per the structural details and instruction issued by nexus E-in-C, without any extra cost to client.

Casting of extended Foundations / Basements / Podiums / Outside Ramps etc.

18 PMC/Client may temporarily hold the construction of the portions of Foundations / Basements / Podiums / external-ramps etc., which is extended beyond main building line, and may ask the contractor to complete such areas as per clearance provided by PMC/Him. Contractor will not be paid any extra amount or rate, over and above the contract price, for such delayed clearance provided by PMC/client for such areas. However, PMC/client MUST NOT hold such portion unreasonably and MUST provide clearance to complete such areas, in-case no further structural work’s work-front is available to contractor inside the main building area. But if client asks the contractor to complete such areas alongside the main building works, contractor is bound to complete such areas as per client’s required schedule, without any extra cost to client.

RCC and Waterproofing works at Refuse-Area & Terrace

19 If specifically asked by client/PMC, Refuse-area & Terrace slabs to be casted by contractor as per typical-floor sunk areas without any extra cost to client (i.e. in refuse-area & terrace, all sunk areas to be provided as per typical-floor). In above case, if waterproofing is also in scope of civil contractor, IPS+Brick_bat waterproofing must be done by contractor in refuse-area & terrace sunk-portions without any extra cost to client.

Site mix concrete 20 In case the quantity to be used in the R.C.C. elements is less than the quantity of one transit mixer i.e. about 5 to 6 Cum, in such cases the Contractor after obtaining prior approval from E-in-C, may produce concrete in small quantities of grade directed by E-in-C using Concrete mixer and with proportions approved by the E-in-C.

Fencing / Barricading to site premises

21 The Contractor shall maintain at all times fencing / barricading provided by the Client around the periphery of site at his own cost till handing over the project to the Client. Any additional materials required to maintain this Fencing/barricading such as C.G.I. Sheets / Vertical-Supports (M.S.) shall be provided by Contractor at his own cost.

Completion Certificate 22 Contractor on completion of work shall inform E-in-C in writing that he has completed all works in his scope. E-in-C after going in every respect in conformity with the Work-Order, defects, checklists and compliance shall recommend to Director PMC to issue completion Certificate for the work.

Defect Liability Period 23 The defect liability Period shall start Five year (Sixty months) from the date of Completion-Certificate issued to him by PMC, after satisfactory completion of work in his scope. All defective items of work and defects noticed and brought to the attention of the Contractor during the Defects Liability Period shall be promptly and expeditiously attended to and replaced and/or rectified and made good by the Contractor at his own cost, to the complete satisfaction of the E-in-C. In case contractor fails to attend the defects during specified time, the work will be carried out at Contractor’s risk and cost through other agencies.

Scaffolding for passenger lift well for lift agencies

24.1 The Contractor shall provide & erect scaffolding for erection for the passenger lifts (as per specifications provided by lift vendor) and remove the same after electrical-work/painting-works/ lift-work is completed in lift-shafts and work is certified by E-in-C. The cost of providing, erecting and removing the scaffolding shall be borne by the Civil Contractor.

Scaffolding for Toilet-duct Fins

24.2 As the civil contractor is anyway expected to erect scaffolding for typical-floor-external-plaster, civil-contractor must remove such scaffolding only after PVC/Aluminium fins fixing by client. No claim for extra payment, for keeping scaffolding available for client for fixing fins, will be entertained or paid to contractor. The cost of erecting and removing the scaffolding shall be borne by the Civil Contractor. Client must start fixing of fins immediately after external-plaster completion by civil-contractor. PMC will ensure that such agencies must complete their work alongside the contractor, to minimize the use of contractor’s scaffoldings and supporting. But typical-floor external-paint to be done by painting-contractor using his own scaffolding.

Cement paint inside Lift shafts/wells

25 Painting inside Passenger lift shafts/wells is in scope of client, at his own cost. Contractor to allow use of his erected scaffolding to the client appointed painting contractor, without any extra cost to client.

Interference at site 26 The Contractor shall resolve all issues, in consultation with Client, related to Police Authorities/Political Persons/Parties and Local Religious groups etc. throughout the contract period. Expenses related to handling & managing Police-Authorities / Municipal-Health-Authorities (malaria etc.) shall be borne by the contractor. However expenses related to handling & managing Political-Persons/Parties and Local-Religious-groups etc. shall be borne by the client, unless the situation arises as a direct consequence of contractor’s action. Contractor must inform client before committing any settlement expense to such persons.

ASSIGNMENT AND SUB-CONTRACTING

27.1 It is mandatory that neither the Contract nor any part thereof shall be assigned or subcontracted / or sublet without the written approval of the Client and PMC. In case written approval is given, it shall be subject to such conditions as are indicated therein.

Action for assign or subcontract or sublet the work

27.2 In the event, during progress of work, if it is noticed that the Contractor has assigned or subcontracted / or sublet without the written approval of the Client and PMC, then following procedure shall be adopted.

Termination notice 28.1 The Contractor will be issued a notice of termination by PMC in consultation with Client for breach of terms and conditions.

Right or claim of Contractor

28.2 The Contractor shall not have any right, claim of any nature due to this termination served on him.

Quantum of payment 28.3 The work completed by Contractor till that date will be ascertained and billed by E-in-C considering all debit notes and reconciliation of materials used or Client’s materials supplied if

Release of payment 28.4 The E-in-C shall forward the bill for certification by PMC office and further transmission to Client for releasing the payment if any.

Inserting Sleeves for services, wooden door frame fixing etc.

29 Contractor’s quoted rate includes leaving openings, inserts sleeves etc. in concrete for plumbing/electrical and other services. Contractor’s quoted rate also includes fixing wooden-door-frames (anywhere in project). Fixing of wooden-door-frames for MEP-shafts & utility areas (including watchman-cabin, society-office etc.) is also in scope of civil-contractor. Wooden Door-frame fixing only is in scope of contractor, free of cost to client, with all materials (holdfast/anchors/fixtures etc.) supplied free of cost by client to contractor. Marble/Granite door/window frame fixing is not in scope of civil-contractor.

Hacking of concrete 30.1 Contractor’s quoted rate includes hacking of all RCC members in above ground level @ 1” c/c or as directed by E-in-C. Contractor must start hacking only after obtaining written approval from E-in-C. Hacking must be done in accordance to RCC & Plaster-work specifications attached here-with.

Hacking for ceiling 30.2 Contractor’s quoted rate includes hacking of ceiling surfaces (Tacha) @ 1” c/c or as directed by E-in-C, for receiving Putty/POP finish. Ceiling plaster shall not be provided. Contractor must start hacking only after obtaining written approval from E-in-C. Hacking to be done only if asked by E-in-C. Hacking of habitable-floors must be done in accordance to RCC & Plaster-work specifications attached here-with.

Making Grooves, recesses etc. in plaster works

31 Contractors quoted rate includes external plaster with machine mix mortar with water proofing compound. No holes will be allowed in walls of building for erecting scaffolding. Contractor to provide double or “H” type scaffolding only. Grooves, recesses, drip mould, plaster bands & pattas etc. shall be provided by Contractor (without any extra cost) as per drawings or as directed by E-in-C.

Cleaning of building areas

32 Contractor’s quoted rate includes cleaning of all building areas including compound area and stacking the debris at a place directed by E-in-C, at following stages:

a) Below casted slab to be cleaned after casting of any above level slab (for each-slab). b) Before commencing masonry-work & after completion of masonry-work (for each-floor). c) Before commencing internal plaster & after completion of internal plaster (for each-floor). d) Before commencing external plaster & after completion of external plaster (for each-floor). e) Before terrace/toilets water proofing (for each-floor). f) Before compound paving. g) If any concrete has spilled over by concrete-pump/concrete-mixer during pumping of the

RMC, cleaning of road/building-premise also in scope of contractor, at his own cost. Waste/Debris generated by such cleaning must be stacked at a location on ground floor as instructed by PMC. Such areas to be washed by contractor, at his own cost, after removing concrete waste/debris.

Temporary works 33.1 Contractor’s quoted rate includes following temporary works. These shall be constructed by Contractor & removed on competition of overall work or as directed by E-in-C :-

a) Cement Godown – for capacity of 1000 bags. b) Construction Water Tank of 10,000 Lit capacity. c) Material testing Laboratory to be constructed with necessary testing equipments. d) 100 sqft PMC office, 100 sqft Client office, 150 sqft Conference room and 32 sqft toilets for

Client/PMC staffs. These must be made with aluminium-windows, painted-flush-doors, ventilators & OBD-paint. Tiles, closet, wash-basin & flush-tank to be provided in toilet. Necessary electrical-works also to be done by contractor at his own cost. Only Furniture and equipments/appliances to be provided by client at his own cost.

e) Separation wall & hard-platform (in PCC) for making bins for metal no. 1, 2 and sand.

No Detriment 33.2 The Temporary Works shall be designed and constructed in such a manner as to enable the Permanent Structures to be built around them without detriment to their effectiveness and due allowance shall be deemed to have been made for all necessary adjustments thereto to enable the Works and the work of other contractors employed upon the Project to proceed.

Vibrators & Mixer 35.2 Contractor’s quoted rate includes providing 2 nos. of Diesel/Petrol operated vibrators with 4 nos. of 60mm dia and 4 nos. of 40mm dia needles. Contractor shall also provide 2 nos. of electrically operated vibrators. Contractor is permitted to use electrical mixer of minimum 1 cement bag capacity.

Maintenance of Vibrators & Mixer

35.3 As the contractor (at his own cost) is expected to maintain minimum 1 bag capacity Mixers constantly at site (for making small quantity of structural-concrete and concrete for non-structural members), he must ensure that mixers are always in working condition properly maintained /overhauled periodically. Also, contractor must ensure that the vibrators and needles are always in working condition properly maintained /overhauled periodically, so as to consolidate the concrete all the time.

Material Hoist 36 Contractor’s quoted rate includes electric operated material-hoist with approx. 1.0 MT capacity with trolley and rails. Hoist must be covered with safety-net + green-hessian-cloth (full height of hoist) so that material does not fall-out from the hoist-area, in-case of any accident.

Curing of works 37 Contractor must have two electrically operated pumps (including one standby pump) for curing at site. Capacity of pump will be ascertained by PMC.

a) All concrete, masonry and plaster works shall be cured for minimum 9 days.

b) All R.C.C. vertical elements such as columns, pardis, and drops, walls are to be cured by covering the exposed surfaces by Hessian cloth (Kantan). It must be ensured that the covered surfaces by Hessian cloth (Kantan) shall be kept wet till the curing period is over.

c) On completion of slab concrete, sprinkling of water shall be started after 4 to 5 hours of finishing the slab.

d) Lean mortar bunds shall be made on finished slab surfaces within 10 to 12 hrs of finished slab surface. It must be ensured that the water is ponded in the mortar bunds till its curing period is over.

Bills and Challons to be submitted along with R.A. Bills

38 Contractor to submit challans and bills of all materials, having basic rates in Work-Order, to PMC within 10 days of material brought at site. Challans should have signature of representative of Client and PMC. Without submission of bills and challans of materials brought at site, bills for rate escalation or extra claims will not be entertained.

Lights at Ground Floor 39.1 Client to ensure that ground floor and all accesses to building properly illuminated to avoid any accident. PMC decision in this regard will be binding to client. All lights to be brought and maintained by client at his own cost.

Lights at working Slab area

39.2 Contractor to ensure that working slab area must be properly illuminated for proper working. Minimum 6 nos. of halogens of adequate capacity must be available at slab working area at cost of contractor.

Payment to sub-contractor and supplier

40 Client reserve the rights to pay directly to any sub-contractor or supplier engaged by Contractor on this site, to complete his scope of work mention in this Work-Order, on behalf of Contractor and debit to be levied to Contractor. Client does not require approval from Contractor, in regards to any payment being made to supplier or sub-contractor, for material supplied or work done for the Contractor.

Access to plot and building approaches to be clear from obstruction

41.1 It is assumed that the contractor has visited the site, studied all architectural & structural drawings and is aware of all site constraints/hardships & preliminary-works (needed to execute the mentioned scope of works), before executing this contract document. Contractor to make good access to plot, temporary access roads and building approaches to be cleared from any sort of obstructions, at his own cost. PMC/Client’s decision in this regard will be binding to Contractor. Contractor’s rates are deemed to be inclusive of expenses required while facing all site constraints/hardships & executing the preliminary-works (needed to execute the mentioned scope of works). No extra payment will be paid or entertained on any such account.

Lead and Lifting/Shifting of all materials supplied by Client

41.2 Contractor is expected to visit the site and get acquainted with actual site conditions thoroughly and discuss the site logistics with PMC before accepting and signing the contract. Client will make all possible efforts to supply all materials supplied by him, nearest to the working areas. Contractor is expected to lift & shift those materials and his own materials to his required/desired locations, at his own cost. No extra claim will be entertained and paid for lifting/shifting of these materials to be incorporated in the work. Unloading of client supplied materials to be arranged by client. But any further lifting & shifting of all such materials supplied by client is in scope of contractor. This is to be noted that contractor will have to arrange space for getting unloaded all the materials supplied by client, as per PMC instructions and as per space availability. No extra claim will be entertained and paid in regard to handling, lifting, shifting etc., of all the materials being supplied by client and unloaded as per space availability, for incorporation in contractor’s scope of works.

Delivery of client supplied materials

41.3 Client will deliver all his scope of materials at ground-floor. Contractor is expected to unload, lift/shift, stack and re-shift all such materials, for using in his scope of works, at his own cost. However, unloading of Steel, Cement, Bricks and AAC Blocks is in scope of client at his own cost, only if these are being supplied by client free of cost to contractor.

Transfer of material (out of the site premise)

42 Material Transfer Slip (MTS) to be signed by contractor and Nexus site-in-charge both, for every material being taken out by site whether such material supply is in scope of client/contractor.

Filling of core-cutting done for providing pipes in UG-tanks & OH-tanks

43 Filling of gaps/gabdaas between Pipes (being embedded in walls of UG-Tank, OH-Tank & Break-tank for plumbing/fire-fighting works) and RCC-walls to be done by waterproofing contractor. Plumbing gabdaas in Toilets/WCs will be primarily filled by plumbing contractor but those will be made water-tight/leakage-free/seepage-free by waterproofing contractor. Provisional Rates applicable to the assigned work for supply of materials, tools and skilled/unskilled workers:

Item rates mentioned in this Appendix are applicable only for extra-items being informed to contractor. These rates are not applicable to any item mentioned in “Scope of Work for Contractor” in main contract document. Scope of works mentioned in the main contract documents are inclusive of required all tools, tackles, labours, scaffolding etc. complete.

Contractor must obtained written instruction from PMC/Client before executing any extra item.

The Contractor shall arrange to supply materials, tools and skilled or unskilled workers as and when demanded by E-in-C for working at site.

These workers shall be utilised for the works as directed by E-in-C.

The requirement of workers will be given one day in advance, so that contractor gets time to arrange such manpower required.

Extra Items Claims: Contractor MUST obtain a written permission from E-in-C for the claimed extra items else the extra item claim will not be

entertained or paid. Further, extra item executed will not be considered for payment, in any case, if 5-8 photographs of executed extra item are not submitted with claims. Photographs must be self-explaining in showcasing the extra item being claimed.

In all cases wherever extra items are to be executed as per exigencies of work and ordered by E-in-C, the Contractor shall furnish detailed Rate Analysis along with necessary details, if required by the E-in-C.

The E-IN-C on establishing the validity of such claims shall certify the amount payable for such work and rates so determined shall be final and binding on the Contractor.

All extra or additional work done by contractor on instruction of the nexus E-IN-C, which were not covered by the scope of work outlined in this contract/agreement, shall be valued between the E-IN-C and the Contractor based on the following mechanism:

Rate Analysis Method/Mechanism:

a) Materials component involved in Extra-Item: i) The material cost to be accounted inclusive of all applicable duties, levies, fees, transportation, loading,

unloading etc. as delivered to the site, but excluding of applicable GST. ii) Material rates (of the materials being involved in extra-item) must be certified by PMC Purchase-Head before the

purchase of materials. Else material rates certified by PMC Purchase-Head will be binding to contractor for his claims.

iii) Proof of consumed material quantity & cost in form of an invoice/paid-bills, other relevant documents, delivery challons duly attested by E-in-C to be submitted along with the extra item claim.

b) Labour component: The direct cost of labour, direct cost of shuttering-centering & supporting-scaffolding materials, direct

cost of any other tool & equipment to execute the specified extra item and including indirect charges thereon shall be considered as “35% of the cost of material” at prevailing rate. Taxes must not be included in “cost of material” while working-out 35% labour component.

c) Overheads and Profits: In addition the Contractor shall be entitled to payment towards Establishment, operational costs

of plant and equipment, Salaries, taxes, cess, overheads and profit. This shall be deemed to be “15% (Fifteen Percent) of (a)+(b)” as above.

d) Hence, Total Payable Rate to Contractor, for any Extra-Item in Rs. = (a) + (b) + 15% of (a+b)

But, if material is supplied free of cost to contractor, for any extra item, “Total Payable Rate to Contractor” for any Extra-Item in Rs. = (b) + 15% of (b).

e) Taxes: The contractor is entitled to charge GST on contractual works over and above such cost, at prevailing rate.

f) Extra Item Billing: Contractor should claim his extra item bill within 30days of completion of work at site or before covering of that work, whichever is earlier. No claim will be entertained after 30 days of completion of the extra item or after covering of that extra item work. Claim should be raised within 7 days of starting of any extra item being executed, if rates are not pre-certified and if contractor rates are expected to be different from the above mentioned mechanism/method else contractor’s claim for the extra item will be paid & settled as per the above mentioned mechanism/method.

g) In-case of any dispute between contractor & client on payable-rate for any extra-item, decision by director of PMC shall be

final and binding to client & contractor both. Note: 1) Labour-component (d) to be considered as “25% of the cost of material” only for Plum-concrete. 2) Rest all extra-item labour-component (d) to remain as “35% of the cost of material”. 3) If client decide to get any extra item on LABOUR BASIS ONLY (in such case material to be supplied by client

free of cost), contractor will not be allowed to have any objection in such method of working. Contractor to

be paid labour and profit as per above mentioned rate-analysis only. Profit on material will not be paid to the contractor in such case.
