Ordinance for Hearing and Adoption Consideration. 11
First Ordinance is Amending Chapter 334 of 12
the Code of the City of Union City Entitled Rent 13
Stabilization. 14
MS. NOVA: This Ordinance has to do with 15
owner-occupied four, five, and six-family units. 16
The owners of four, five, and six-family 17
buildings, as part of their registration, must 18
file an affidavit stating that they reside in 19
building and comply with the regulations 20
established by the Rent Stabilization Board. 21
These regulations shall set forth criteria 22
to establish proof of residency. 23
MAYOR STACK: This is basically being done 24
so we make sure those owner-occupied houses are 25

really owner-occupied. 1
That somebody’s not just saying that 2
they’re living there and they’re really not 3
living there and taking advantage in trying to 4
decontrol the units and they don’t live there. 5
So they would have to provide certain types 6
of proof that they actually live at the property; 7
their children are registered in Union City 8
schools, cable TV bills. Also there’s other 9
examples; PSE&G for an apartment bill, a house 10
meter bill -- besides the hallway lights. They 11
would have to show that they have proof that they 12
live in this six-family house, so they would not 13
be able to enjoy the benefits of being able to 14
decontrol. 15
We’re just looking to preserve affordable 16
housing and rent control in the City of Union 17
City, making sure people are honest about if 18
they’re living there; that they show documented 19
proof of doing so. 20

Chapter 296 of the Code of the City of Union City 1
Entitled Peace and Good Order, Short Term Rental. 2
MS. NOVA: This Ordinance was put in for -- 3
to revise and clarify the definitions of vacation 4
rental as they are in the current ordinance. 5
This has to do with exclusive transient use 6
for 30 days or less. That is what a vacation 7
rental would be considered, pursuant to the 8
Ordinance for Short Term Rentals. 9
MAYOR STACK: This -- we’re still -- we’ve 10
been meeting with some of the -- some of the 11
individuals in the City who I had a meeting on 12
Friday with; about 15 that are doing Airbnb. I 13
committed to them that on the penalty stage we 14
would hold off on the Ordinance. 15
We’re just going forward with -- we 16
originally introduced and the penalty phases of 17
the fine phase will be held off until after I 18
meet with them again or possibly several meetings 19
again. 20

MAYOR STACK: Sure. 14
Just before we do on the -- the Application 15
to the County Trust Fund; this is for matching 16
funds with the County on the playground that 17
we’re currently building on 11th and -- and West 18
Street -- 11th Street and West. 19
This should be open -- 20
This will be dedicated to police officers 21
that have fallen in the line of duty. 22
This should be opened up sometime -- we’re 23
looking to open it around May 5th, which should be 24
right before Police Week; a dedication to the 25
24
police officers, not only in Union City but 1
across the country, that put their lives on the 2
line every day to keep us safe. 3
I’d like to praise the Board of 4
Commissioners and Commissioner Valdivia for the 5
great job they’ve done in making sure that this 6
park is being renovated. 7
It’s going to have an eternal flame powered 8
by electric -- obviously, not by gas but by 9
electric that will burn at the park in honor of 10
those police officers. 11
There will be a small water park there and 12
a monument. 13
We’re also paving those streets, from 11th 14
Street from Bergenline to West and from West to 15
Central. Those will be totally repaved. 16
New tree planting will be going up. 17
Additional lighting will be going up also. 18
Having said that, on a lot of this stuff 19
for Body -- for Cliffside Body for Repair of Snow 20
Plows, equipment, the Dodge Jeep RAM, and several 21
other items on here, the tent structure. 22
I’d like to praise the Department of Public 23
Works, Commissioner Rivas and all the 24
Commissioners but specifically Commissioner Rivas 25
25
for the great job they’ve done during the 1
blizzard that we had and the other snowfall that 2
we had. 3
Hopefully we don’t get anymore snow this 4
year but they’ve done a great job in really 5
keeping our streets clear. 6
The men and women of the DPW, specifically 7
Kathy Garretson, has done an -- an outstanding 8
job in running that Department. 9
The DPW is truly I would have to say the 10
second 24/7 agency in the City -- with the Police 11
Department being first -- about truly how much -- 12
how hard they work. 13
Literally, many of those employees are in 14
very early; leave very late. The dedication and 15
the evening hours, weekends. Seven days a week 16
we have people out there sweeping the streets and 17
they do a terrific job in really keeping our 18
streets clear and -- and really making us proud. 19
And, Commissioner, you deserve that credit. 20
Oh, on 5th and -- on 5th Street also we just 21
put up a salt bay on 5th and Summit. It was just 22
constructed. That will give us more access to 23
salt in the City. We’ll be able to purchase more 24
salt as part of the -- the bid that we go out for 25
26
in conjunction with other cities in the County 1
where we can store salt safely; it doesn’t get 2
wet; it doesn’t face the elements of the weather. 3
So, having said that, I’m proud to support 4
those items on the agenda and I thank each and 5
every Commissioner for their dedication on these 6

calendar; Manhattan Bar and Grill. And I might 3
say that this is the last disciplinary hearing 4
that we have pending. 5
That can change by next week, believe me. 6
But this is a situation where there was a 7
special condition on the license about music. 8
And apparently there was a birthday party going 9
on and they had some music going on after the 10
hours. The Police were there; they saw it and 11
went in and gave a violation. 12
Even though we’ve had a condition on this 13
license for -- since January or even longer, this 14
is really the first time there’s ever been an 15
incident and this was rather minor. 16
I’ve spoken to Mr. Diaz and also Detective 17
Dunlay, who’s been very active with respect to 18
the plea negotiations, and I would recommend a 19
three day suspension. 20
And the licensee is in agreement. Mr. Diaz 21
is in agreement. And Detective Dunlay’s in 22
agreement. 23
So I would rec -- 24

going forward though, that there’s better 14
management of the establishment; that people 15
aren’t outside -- that people aren’t outside 16
hanging out in front of the place under the 17
disguise of smoking, that there’s cars not parked 18
literally on the corner. 19
I passed by there the other night, cars are 20
on the corner. 21
I’ve seen them myself, ma’am, I disagree 22
with you. I seen it myself. 23
I drive the area constantly. Constantly I 24
drive the City. I drove the City Saturday night 25

till 2:30 in the morning. 1
We spent a lot of money in that area; 2
renovating the area, fixing the sidewalks. You 3
have a grammar school a couple -- not even -- not 4
even 300 -- 200 feet away; a brand new grammar 5
school. 6
It’s a very, very residential area. It’s a 7
very densely populated area like the rest of our 8
City and we have to be respectful of our 9
neighbors. 10
