CALL TO BARTZ called the meeting of the Health and Safety Committee to order at 6:00PM. 6

ROLL CALL Members present were Jim Graeber, Pat Haskin, Steve Bartz and Dale Ernst. Also 9
present were Mayor Clarann Stocker, Director of Public Works Mike Tolvstad, 10
Superintendent of Public Works Dustin Bonack, Chief of Police Al Elvins, Clerk-Treasurer 11
Amanda L. Bartz and Office Assistant Brenda Crass. 12

MINUTES HASKIN MOVED to approve the minutes from January 5, 2016 and ERNST seconded. The 17

2.) Tomahawk Farm and Flea Market – Saturdays from June to October 2016 29

GRAEBER MOVED to approve the Tomahawk Farm and Flea Market application as 31
presented and HASKIN seconded. The VOTE was unanimous. 32

OTHER 1.) Request from Police Department to Purchase AED’S with Grant Funds Received 34
BUSINESS 35
ELVINS explained the Police Department is projecting at $20,000 donation to purchase 36
AED’s for the Police Department. He stated they received a check from Harley Davidson 37
for $3,200 and would like permission to purchase the AED’s with the grant money. 38

HASKIN MOVED to approve the purchase of the AED’s not to exceed $3200 and 40
GRAEBER seconded. 41

Steve Taskay stated the ambulance service purchases Physio Control AED’s and 1
suggested making the Departments compatible so that equipment can be swapped out. 2

2.) “Open for Business” Requirements for Liquor Licenses 6

BARTZ stated that in Section 6-49 of the City ordinance it states “the phrase ‘open for 8
business’, means 150 days of full use and operation.” He stated they were trying to 9
figure out the intent of “full use and operation”. 10

Clerk BARTZ stated she looked thru statutes and other communities and could not 12
define what “open for business” was. 13

BARTZ questioned if a business was to turn the lights on for a few minutes and wasn’t 15
open for a whole day, would that then be considered a day. He questioned changing the 16
ordinance to add that a business needs to be open a minimum amount of hours per day. 17
He stated there are other businesses looking for a liquor licenses. 18

Karen Kosidowski-Bergen, from Krabby Karen’s stated that she is meeting the minimum 20
requirements. BARTZ stated that the driveway has not been plowed. 21

Kosidowski-Bergen stated she is not open for business right now and is closed from the 23
end of the year to May as she clarified when she applied for the license. 24

BARTZ stated he cannot see the business being open for 150 days a year. 26

ERNST questioned what she defines as a business day. Kosidowski-Bergen stated she is 28
there anywhere from 4-12 hours a day. 29

BARTZ stated everyone has a different definition of what a day is. 31

HASKIN stated if she is closed January thru May, almost half a year. 33

Mickey Loka stated, as a former business owner, he cannot see making the minimum 35
requirement more than 4 hours to be open. 36

Christine Vorpagel, Tomahawk Main Street, stated that 150 days a year is generous. 38

BARTZ clarified that by the City ordinance, Krabby Karen’s is compliant. 40

Mickey Loka questioned if 150 days a year is standard. Clerk BARTZ clarified it is 42
standard procedure. 43

Steve Taskay questioned if there are people knocking on the door for a liquor license. 1
Clerk BARTZ confirmed that there are other businesses looking for liquor licenses. 2

Mayor STOCKER stated at the state level townships are looking to the City’s for licenses 4
and are able to apply to the City for a liquor license. Clerk BARTZ stated the City does 5
not have any available. 6

BARTZ stated he believes that Krabby Karen’s is in a location that is within 300 feet of a 8
church. He stated that this rule does not apply to a restaurant, but the sale of alcoholic 9
beverages must be 49% and the sale of food must be 51%. BARTZ stated this is 10
something to be aware of. 11

3.) “Wine Walk” Information – Tomahawk Main Street, Inc. 13

Christine Vorpagel, Tomahawk Main Street, stated the Spring Fling art walk puts artists 15
in businesses. She stated that an addition to the Spring Fling Art Walk would be a Wine 16
Walk. She stated there would be up to 20 locations where there would be wine or craft 17
beer available. Vorpagel stated they would be able to serve the wine or craft beer as 18
under the picnic license and would have to have a licensed operator at each 19
establishment. 20

Chief ELVINS stated each establishment must have its own independent licensed 22
operator. Clerk BARTZ clarified that any individual can obtain a temporary operator 23
license that is valid for 2 weeks but must be approved by the Health and Safety 24
Committee and the Common Council. 25

Chief ELVINS questioned if consumption would be allowed outside the premises or 27
limited to the inside of the businesses. Vorpagel stated that consumption would not be 28
allowed outside, she stated they would want people inside the establishments 29
purchasing or looking at things and it would be easier to control within the 30
establishments. 31

Chief ELVINS clarified Tomahawk Main Street would have to go thru a distributor to 33
obtain the wine and craft beer. 34

HASKIN asked if the establishments would also need to obtain a liquor license. Clerk 36
BARTZ clarified that it would be covered under the picnic license held by Tomahawk 37
Main Street. 38

HASKIN voiced concern with the event serving alcoholic beverages. She referred to an 40
article in The Municipality magazine and stated that Wisconsin is the number one binge 41
drinking state in the nation. HASKIN reiterated that she is not here to discourage 42
alcoholic consumption, but was voicing concerns with encouraging people to drink 43
alcohol. 44

Chief ELVINS questioned if there would be a limit as to how much would be provided to 2
each individual. Vorpagel clarified only samples would be provided. 3

BARTZ stated he had no issue with it, and thanked Vorpagel for checking with the 5
committee and to look into it more. 6

HASKIN reiterated that she would like to see more non-alcoholic family friendly events 8
in the City. 9

REPORTS 1.) Police Department Report – January 2016 11

Chief ELVINS stated the Police Department had one drug seizure occur and it has gone 13
to another state. He stated they seized ½ pound of marijuana and it all occurred after a 14
simple traffic stop. 15

VAN DE WEERD stated he found the report very informative and thanked Chief ELVINS 17
for the report. 18

2.) Fire Department Report – January 2016 20

Clerk BARTZ stated the Fire Department will have a report for the next meeting. 22

Music on the River Wednesday June 22nd through July 27th,
2016 EVENT INFORMATION
This event is sponsored by Music on the River. The event will be a concert series on Wednesday s from
June 22nd through July 27th. The event will set up at 4:00pm and end at 8:00pm. The estimated
attendance will be 1,000. There will be no food or alcohol sales. The estimated number of attendees is
1,000.
Missing from the application is a Certificate of Insurance listing the City of Tomahawk as an additional
insured for $1,000,000. The application fee of $25.00 has been paid but no fees have been assessed for
the barricades and the extra garbage/recycling containers.
1. CITY RESOURCES
Fire Department – No additional services are required.
Public Works – $65.25 per event, $391.50 total.
Police Department –
2. SITE LAYOUT
Event is located at Veterans Memorial Park.
6 Barricades are delivered to the site. This is at the request of the Public Works/Parks
Department to keep vehicles of grass.
3. RESERVATIONS
Reservations have been made for the pavilions at the park, this is at no cost to the
organizer.
4. GARAGE COLLECTIONS
City supplies 12 garbage cans and 6 recycling cans.
5. RESTROOMS
Public Works would recommend the placement of two port-a-potties at this site. The Park
facilities cannot handle the number of attendees.
6. PARKING
There are no parking concerns.
Parking is provided off-street and there is little to no impact on neighbors.
7. EMERGENCY PLAN
Weather is monitored by WJJQ and online apps. If bad weather is predicted a decision is
made by 4:00pm to move the event to SARA Park.

This event is sponsored by Tomahawk Main Street, Inc. The event will be a motor cycle show from Noon
to ??? on May 28th and a car show from 5:00am to 5:00pm on May 29thThe estimated attendance will be
400 on May 28th and 8,000 on May 29th. There will be food concession but there will be no alcohol sales.
All paperwork has been included with the application including a Certificate of Insurance listing the City
of Tomahawk as an additional insured for $1,000,000. The application fee of $25.00 has been paid along
with $22.00 for barricades, $10.00 for street sweeping, $40.00 for garbage cans and $25.00 for electrical
service. ($122.00 total)
