Preamble

A presentation on development of a Mini Grid system co-generation was made to Councillors on 2 December 2003.

Council has now received a formal request from GridX to place infrastructure within public land for the provision of a Mini Grid power system in Stage 7 of the Mirvac Estate in Glenfield.

Report of Manager Property and Support Services

Proposal

GridX is involved in a pilot project with Mirvac to install and operate a mini Grid system in a housing estate in Sydney’s western suburbs.

Glenfield has been selected as an appropriate development area for the installation of the micro co-generation system (MCS) delivering energy on a cellular mini grid. The function of a mini grid is based on a collective operation of a network of decentralised micro generators, with associated heat recovery, energy storage and distribution systems in modular cells.

Under the proposal GridX will provide electricity, gas hot water and climate control water to the dwellings in a Greenfield site owned at this stage by Mrivac. The co-generation systems are to be located in the footpath areas as shown on the attached plan.

Key points regarding the system are:

• Mini grids to connect to 16 homes and also street lights serving the immediate area

• Mini grid also connects to existing electricity distribution system in the event of outage

• GridX sells electricity to homes and exports excess power to the National Electricity Market

• GridX arranges for gas distribution to supply gas to homes and co-generation plant and will be effective retailer of gas

• Street lights will incorporate a vent for exhaust fumes

• Hot water will be provided to homes via a heat exchange

• A thermal network will deliver hot water during winter and cold water during summer to the houses and a swimming pool in common property

• Mrivac during the building of houses will install an air conditioning system operated by climate control water rather than electrically operated heat pumps

• GridX/Mrivac are investigating supplying to each household a hydronic dryer and the climate control water will also provide heat for hot water tanks

• Primary source of water will be rainwater and stormwater run off

The trial is intended to be for an 18 months period and will be the first in New South Wales. If successful arrangements may need to be made for indefinite operation.

Land Issues

The installation of normal utility infrastructure items such as sewer, electricity and gas within road areas are covered by various legislative provisions applicable to each authority. As a result there is no independent need to formalise property rights for these well established infrastructures within road areas.

GridX however as a small company dealing in a new and innovative technology does not have the advantage of the same legislative provisions.

Council would require a formal arrangement with GridX in order to ensure its rights were protected as well as GridX during the trial period. In preparing this report Council staff have had close liaison with Council’s Solicitor to review the proposal.

This legal review has included agreements that need to be made between GridX and Mirvac, Integral Energy and Australian Gas Light (AGL). It is understood that the environmental aspects of the trial have been considered by the EPA, SEDA and licensing for the trial is not required under the Protection of the Environment Operations Act 1997.

Risk Issues

As with any new technology there are some risks attached. A risk workshop was conducted by Sinclair Knight Mertz (SKM) to identify risks associated with the GridX system.

In summary “all identified environmental and safety hazards or loss scenarios that were risk assessed returned mainly low risk profiles. This implies that the controls in place or planned considered effective, and negative impacts to the community are expected to be low”.

Contingencies identified by SKM that minimised exposure to both Council and residents are summarised below:

• GridX are contracted to remove all equipment and infrastructure, and reinstate all standard services at no cost to stakeholders.

• GridX have the “in principal” support of Integral Energy, the Australian Gas Light Company and the developer, Mirvac.

• GridX will maintain an on-site presence and have committed to providing plain English description of the system to the community, and consult with the community over any concerns that they may have.

• The company is financially viable and has performed well in technical and financial assessments carried out by third parties.

• Modified appliances will be “gifted” to residents by Whirlpool and should the pilot program fail to deliver the expected hot water and chilled water for the air conditioning services, the modified appliances could be easily removed and standard appliances retrofitted at no additional cost of connection.

• The co-generation system is based on low voltages and equipment is de-energised, meaning that the components are not under high loads. This promotes a longer usable life of plant and equipment, greater reliability and lower maintenance and repair costs.

Comments

The proposal by GridX for a trial of the MiniGrid technology appears to be an innovative “green” sustainable energy project. From the risk assessment carried out, if all other legal and technical aspect are satisfactory to suppliers such as AGL and Integral, it is considered that adequate protection can be put in place for Council.

It is proposed in the absence of any regulatory framework that a Deed of Licence could be entered into with GridX to allow the trial of this new technology at Glenfield.

The Deed of Licence will allow:

• Installation, within the Council footpath area of the roadway, of natural gas fire mini co-generation system (MCS)

• The location of associated pipelines leading to the privately owned residences proposed in the Mirvac subdivision.

• The location on Council land of exhaust emission apparatus within street light poles.

All these works will be at the cost of GridX. At the expiration of the proposed 18 month trial, if unsuccessful removal of the equipment will be at the cost of GridX. It is proposed that a bank guarantee of $150,000 be held to ensure removal.

Should the technology be successful within the first 12 months of operation, it is proposed that a further long term agreement will need to be evaluated with suppliers and Council. It may be possible if successful the statutory powers of the main utilities involved may be able to cover such a long term arrangement.

Conditions to be attached to the Deed.

- GridX to have Public Liability cover for $10 million naming Council on the Policy.

- Council to be indemnified for any damage arising out of the trial technology

- Normal Development Consent clauses to cover

• Fencing around all work areas • Unreasonable noise and vibration

Preamble

Council at its meeting of 16 March 2004 requested that a report be prepared on the Heritage of Helen Stewardson Hall, Leumeah in relation to the acquisition, building and naming.

Council has also received a letter from Ms Stella Vernon, daughter of Helen Stewardson, in relation to the hall and naming of a reserve to retain the memory of Helen Stewardson.

Report of Manager Property and Support Services

The history of Council’s involvement with the Helen Stewardson Hall has been reviewed through the file and through research carried out by Ms Stella Vernon.

The land was originally owned by the Leumeah Progress Association having been purchased from P G King. The Association had arranged for the erection on the land of a former weatherboard army barracks that had been transported to the site and was subsequently used as a community hall.

On 4 November 1975 as a result of an offer made by Leumeah Progress Association Council accepted the transfer of the land inclusive of the hall. The transfer was basically made as a trust to Council with the hall being made available to the Association free of cost for its meetings. The Leumeah Guides Association were to be appointed as a Management Committee responsible for management of the hall in lieu of payment for the use of the hall.

Council at its meeting of 16 December 1975 resolved to appoint Mrs E A Bradford as Chairperson, Mrs M Standing as Secretary, Mrs C Bale as Treasurer and Mrs E Dean as Hall Booking Officer to the Management Committee. At that meeting Council also agreed to a request from the Progress Association that the hall be known as the “Helen Stewardson Community Hall” after a Leumeah community stalwart.

Council agreed to carry out only major maintenance of the facility and the Management Committee be responsible for booking the facility and all operational expenses.

Due to several members of the Management Committee either retiring or moving away from Campbelltown area the Section 530A Committee for Helen Stewardson Hall ceased operation on 31 March 1995 and handed over the management of the facility to Council.

The Helen Stewardson Hall is in a poor condition and Council at its meeting of 3 February 2004 resolved:

1. “That following the successful relocation of Calvary Life Assemblies and the Manchester United groups to other premises Council proceed with the demolition of the two existing buildings.

2. That advice be sought from local real estate agents regarding the alternatives available for the disposal of the site.

3. That Council contact the Stewardson family to ascertain if there is anything of value outstanding in the community centre that the family may like to salvage prior to demolition.”

On site discussions were held with Council staff and Ms Vernon, a member of the Stewardson family. Ms Vernon indicated that the three signs attached to the hall are of significance and that prior to demolition she would like possession of these. Council staff have arranged for the signs to be removed.

Ms Vernon also indicated that she would like to sight the deeds of the land transfer and this has been arranged.

Ms Vernon initially suggested that Council name the reserve located on the eastern side of Pembroke Road where it crosses Smith Creek to “Helen Stewardson Reserve.” This particular location forms part of the Smiths Creek Reserve. Ms Vernon has written to Council advising that she is aware that whilst the Smiths Creek Reserve runs from Pembroke Road through to the eastern end of Broughton Street/Georges River Road she is only interested in the small area back from Pembroke Road.

Council staff held further discussions with Ms Vernon where it had been suggested that Angle Reserve, located off Angle Road Leumeah, be renamed to “Helen Stewardson Park”. Angle Reserve has playground equipment. This Reserve will be reviewed as to future functionality in accordance with the recently adopted resolution of Council to appoint a consultant to review Open space. This option would therefore appear unsuitable at this time.

As any review of Open Space will not impact on Smiths Creek it would appear to be a practical area to rename at this time in accordance with Ms Vernon’s wishes.

The historic review of the subject land has indicated a further issue for Council to consider. Under Council’s land classification the land is “Operational Land” and therefore can be sold however the means by which Council received the land places constraints on future disposal action. As the land was given in trust, recent Court decisions would indicate that the land has to be considered as an implied trust and therefore notwithstanding the original resolution of Council that classified the land “Operational” it should be considered as “Community Land”.

It is proposed therefore to proceed with the demolition of the improvements in accordance with Council’s resolution due to safety reasons. Further options in relation to sale should be deferred pending the Open Space review, which will by necessity also include community facilities. This may possibly result in a Council reconsidering some existing land classifications and would allow all such matters including the subject and classification to be considered across the whole Local Government Area.

Preamble

Council has received correspondence from Sydney Gas requesting Council consent, as holder of a caveat, to the granting of a lease over part of the property known as Lot 35 DP 230946 which is owned by R E Bloom & Sons Pty Ltd to Sydney Gas (Camden) Operations Pty Ltd.

Report of Manager Property and Support Services

R E Bloom and Sons Pty Ltd are currently undertaking negotiations for a commercial lease with Sydney Gas Ltd over the privately owned land described as Folio Identifier 35/230946 in part being land described as Lot 351 in DP 1066780. The lease is for a term of five years and is to allow use of the land for the construction of a gas treatment plant and associated pipelines. Council has a caveat over the property and the Land and Property Information NSW (LPI) requires the consent of Council as Caveator to allow registration of the lease.

History of Caveat (Subsidiary)

An application was lodged by R E Bloom and Sons Pty Ltd over Part Portion 34 Parish of Menangle, Menangle Road, Menangle Park for a Development Consent for the mining of sandstone. The Development Consent was approved in 1974 subject to the applicant granting Council an option to purchase the land after a period of 15 years.

In 1984 Council agreed to an extension of the original mining agreement with the option to purchase exercisable at the conclusion of the excavation or on 18 January 2004 or a period of time agreed upon by the two parties for a consideration to be determined by two individual valuers appointed by the parties. The option to purchase from Council included a right of way for access to the subject land from the nearest public road. Excavation at the site is continuing and as such Council’s option to purchase remains valid.

In order to protect Council’s interest a caveat was taken over Lot 35 DP 230946 to protect access to the quarry.

Current Position

The Gas Treatment Plant has been previously approved by the State Government as a State Significant Development in association with Sydney Gas’ extraction of coalbed methane. The lease is entirely a matter between Sydney Gas and the private landowner and Council staff have not had discussions regarding the lease. It is noted however that there are no conditions of the lease impacting on Council’s interest in the land.

Legal advice has been sought indicating that Council’s position is not prejudiced by the granting of consent to lodge the Commercial Lease. This lease does not affect the land that Council has the option to purchase and the right of way access will still remain available to Council.

Preamble Council, at its meeting of 28 September 2004, allocated an additional $100,000 to the 2004/2005 Footpath Program.

A draft program has been developed in accordance with the adopted Footpath Strategy, to add to the previously adopted program for 2004/2005.

Report of Manager Technical Services Requests have been received, collated and evaluated from various sources for footpaving construction, in conjunction with the identification of appropriate links in the footpath networks in order to develop a priority list of works.

Schedule 1 lists all the sites in order of priority in accordance with the weightings in the Footpath Strategy. Schedule 2 lists all sites requested for new footpaths, grouped by suburb. It gives lengths and estimated costs for each site and totals for each suburb.

Preamble

Applications for funding were made under the Roads and Traffic Authority’s Local Government Road Safety Auditing / Accident Investigation and Prevention (AIP) Program. Advice has been received of the success under the Program for two projects, and Council’s formal acceptance of the grant offers is sought.

Report of Manager Technical Services

Applications were made under the above Program for the following projects:

1 Conduct an independent road safety audit of Queen Street

Funding of up to $15,000 has been offered to undertake a formal road safety audit of Queen Street, from Moore Oxley Bypass to Camden Road, to review the significant accident history at various locations along the road.

2 Implement remedial works on Mt Sugarloaf Drive, Glen Alpine

As previously agreed by Traffic Committee, and subsequently adopted by Council on 31 August 2004, a scheme has been developed to provide marked parking lanes and traffic islands on Mt Sugarloaf Drive to assist in speed reduction and subsequent crashes. The offered funds of $7,750 will assist in implementing the works.

The funds have been offered on the basis of 50:50 sharing of the costs. Funds are available under the Minor Works Program (Traffic Facilities) to meet Council’s share of the costs.

Preamble

Council, at its meeting of 6 July 2004, resolved as follows:

Council received a presentation on the Project from its Consultants on 5 October 2004.

Report of Manager Technical Services

The previous report identified 11 gateway sites that would be considered for an innovative mix of public art and environmentally responsive landscape designs which represent key themes of Campbelltown, celebrate the “green” city aspect and link together visually.

The following four sites have been agreed by Council for the development of concept designs and costings:

• Cambridge Avenue, Glenfield

• F5 entry into Campbelltown Road, Campbelltown

• Narellan Road, Campbelltown

• Raby Road, Raby

A working party of Council staff, Council’s Public Art Consultant and a Landscape Consultant has been formed, and has jointly developed concept schemes for each of the locations. Indicative budgets have also been developed covering each of the locations, and are provided in the Attachments.

Funds of $255,000 are currently available to implement the initial stages of the proposed works, based on funds of $155,000 identified in the original 2004/2005 Budget, as well as an additional allocation of $100,000 arising from Council’s decision of 28 September 2004.

It is noted that some elements of the works will require the concurrence of other authorities, such as the Roads and Traffic Authority and Integral Energy, or adjacent property owners, while the public arts components are yet to be formalised through the adoption of the Public Arts Masterplan. This Plan will develop themes and priority locations for Campbelltown sculptures and costings to be considered in the 2005/2006 and ongoing budgets. Priority has therefore been given in the development of a works program to those elements that can be implemented in the shortest timeframe.

It is intended to commence discussions with other Authorities and adjacent property owners regarding implementation of the remaining components of the proposed works.

The Landscape Consultants have provided an indicative total cost of approximately $2.6m to complete all four sites, including provision for public art works. A detailed breakdown of the components is included in the Attachment. The program of works therefore indicates a 10 year program to implement all of the recommended works, based on an annual allocation of approximately $250,000. (Alternatively, funds of $960,000 are required to complete only the landscape elements, taking some 4 years to complete)

Subject to Council’s approval of the concept plans, it is proposed that the following components of the works be adopted, based on the available funds of $255,000 in 2004/2005.

The recommended schedule of works is based on completing all of the landscape works along Raby Road, undertaking several natural extensions of the existing landscaping theme along Campbelltown Road, and commencing the landscaping works along Cambridge Avenue.

Communication

Lighting

Lighting has not been specifically addressed in the development of the concept plans, other than to making suitable budget provisions, as it was considered that lighting opportunities would be more appropriately identified during the detailed design phase. In particular, it is considered that site-specific lighting schemes would be more appropriate to highlight particular elements of the overall schemes, such as up lighting on the bridge elements, lighting of the sandstone city statements, and lighting to the iconic art elements.

These lighting costs are included in the budget estimates provided.

Railway Corridor Landscaping

At the presentation, the issue of landscaping along the rail corridor, particularly at Glenfield, was raised. In this regard, it is considered that the entire railway corridor could be treated as the “twelfth” city entrance (as 11 road based city entrances have previously been identified). There are a number of sites along the corridor that could be significantly improved, and it may be preferable to develop a unified theme along the corridor, in conjunction with RailCorp, as there is already an existing partnership to undertake some screen planting as part of an anti graffiti program.

1. That Council adopt the proposed overall City Entrances works program for the four sites, subject to the final adoption of the Public Arts Masterplan.

2.5 Landscaping in Roundabouts

Preamble

Council, through the Access for the Disabled Sub Committee, as well as from the general community, received a number of complaints about sight distance at several roundabouts. These roundabouts have generally been ones that have substantial formal landscaping treatments in the central island, such as at the intersection of Airds Road and Rose Payten Drive, Leumeah.

Report of Manager Technical Services

The type of landscaping used in a number of roundabouts has impacted on sight lines across the central island, reducing the available reaction time before a driver becomes aware of an opposing vehicle appearing from behind the island. In particular, this is a problem for disabled drivers who are less able to react quickly to such situations.

Discussions with Council’s horticultural staff indicate that it is not possible to simply lower the height of the vegetation at several of the roundabouts of concern, due to its impact on the health and appearance of the subject species. Further, the natural habit of many of the species selected for these sites is such that they are naturally large shrubs, and require constant attention to keep them in the design shape.

The issues of sight distance does not appear to be able to resolved with the current landscape treatments that have been implemented in the past. Further, as Council’s Occupational Health and Safety requirements have changed, the need to continually have staff within the intersection to undertake trimming works is becoming a significant risk factor.

It is recognised that the landscape treatments have contributed significantly to the image and appearance of the City.

However, in order to resolve the sight distance issues and to limit the amount of maintenance work that has to be undertaken within the intersections, it is proposed that a program of landscape changes be implemented to address these issues. In particular, it is noted that the central island landscaping at the intersection of Blaxland Road and Rose Street has been recently changed, in response to similar concerns.

It is intended that the works will be undertaken over three financial years to reduce the impact on the visual appearance of the City, utilising existing landscape maintenance funds.

Preamble

The following report is seeking Council’s consideration on a request by the resident to have an 18 metre high Lemon Scented Gum removed. The tree is located within the nature strip in Eaglemont Place at the corner of Warby Street, Campbelltown.

Report of Manager Operational Services

The tree in question is located adjacent to 59 Warby Street, Campbelltown on the nature strip within Eaglemont Place a few metres back from the Warby Street property boundary. The resident has requested the tree be removed citing that the tree is too large for the location and is dropping branches.

Council’s records indicate that the resident had been in ongoing contact over the last 10 months regarding issues relating to the subject tree, noting that a branch did fall onto the property power lines approximately 2 months ago. The lemon scented gums are known for their random way of self-preservation when the tree is stressed. The resident also has concerns about the number of bats that live in the tree which are making a continual mess on the property and vehicle.

The tree has a large full canopy with a small branch (approximately 75 mm diameter) overhanging the resident’s fibro garage. This branch could be removed and the tree dead wooded. Council’s Arborist has undertaken an inspection of the tree and the tree appears to be very healthy. The tree shows no signs of any defects or previous infestations and has an estimated life of at least 5 years. The overall condition of the tree is rated as good.

This variety of tree though very spectacular is not ideal in a residential area due to the unpredictable limb and branch loss. As previously stated there is no indication that the tree is suffering uncharacteristically in the current drought conditions. The tree can be placed on a six monthly tree inspection program and if the drought conditions lessen the tree could be fertilised which may help the condition of the tree. This fertilisation will not eliminate branch and limb fall within the tree.

The resident is concerned that the tree will impact on their property and family and requested that a report be presented so that Council could consider the matter.

Officer’s Recommendation:

1. That the 18 metre high Lemon Scented Gum located in Eaglemont Place adjacent to 59 Warby Street, Campbelltown be retained.

2. That the limb overhanging the garage be removed and the tree be cleared of dead wood.

3.2 Ingleburn Bulldogs Junior Rugby League Football Club (Item of General Business)

Councillor Hawker tabled a copy of a letter together with an attached account for $630 that he received from Ingleburn Bulldogs Junior Rugby League Club. The Club advise that they had contacted Council on several occasions asking that their playing fields be watered and received no reply from Council. Accordingly they organised their own water trucks to water the field and they would like to be reimbursed for this cost.

Committee’s Recommendation: (Hawker/Thomas)

1. That the Director City Works provide a report regarding this matter to Council at its meeting on 19 October 2004.

2. That the report include information in relation to water system that was previously installed at this oval and then removed.

3. That Council respond to the Ingleburn Bulldogs JRLC acknowledging receipt of this letter.

4. Asset Management and Supply Services

4.1 Progress Report – Art Gallery and Amphitheatre Masterplan Project

Preamble

In 2003, Council engaged architects, Tanners and Associates, to oversee the construction of the extension of the Bicentennial Art Gallery and the Amphitheatre Masterplan project.

Denham Constructions is the successful building contractor and construction is underway. The Amphitheatre Masterplan project is been constructed by Council’s Operations section.

An inspection of the site for Council was held on 5 October 2004.

Report of Manager Assets and Supply Services

Art Gallery

The Art Gallery is progressing well with most items as per the project plan. There was a minor delay in the installation of the structural steel however other areas of the building have been undertaken. It is expected that the delay will be caught up in late October early November 2004.

The new art store is nearing completion, and the roof structural steel has been installed and the cladding is underway. The older section of the Art Gallery building has been rendered and cladding has been installed that links to the facade of the new building. The form of the new building is starting to take shape and defined areas like the theatre, café, and entrance can now be visualised.

As the tiling will be completed by end of October, the Café landscape works will commence shortly to be completed by the Fisher Ghost Festival. To date, the road works is partially completed, and the asphalt seal will be completed when major construction finishes.

Amphitheatre Masterplan

As the Art Gallery extension progresses, Denham Construction will relocate their construction buildings to allow the Operations team to commence works in the Amphitheatre area. Other landscaping works have been completed adjacent to the new parking areas and to the southern amphitheatre area. It is expected that the complete project will be completed by March 2005.

• Attended 4 calls for assistance regarding tree and storm damage

• Assisted Police with missing child search

• Assisted with crowd control at President’s Cup Boat Race – Hawkesbury River

• Assisted Waverley/Woollahra Unit with road blocks, traffic and crowd control at City to Surf Race

• Set up of public display and assisted with catering at Rose Hill Race Day

• Staffed static display at Bradbury School Fete

• Set up and removal of marquee for the Kidney Foundation Car Rally

• Attended Deputy Controllers meeting at Wollondilly SES
