North Liberty City Council June 26, 2012

Regular Session

Call to order. At 6:30 p.m., Mayor Salm called the June 26, 2012 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl, Wayson. Others present: Ryan Heiar, Tracey Mulcahey, Scott Peterson, Kevin Trom, Dean Wheatley, Erika Harper and other interested parties. Approval of the Agenda. Chipman moved, Hoffman seconded to approve the agenda. The vote was: ayes – Wayson, Hoffman, Kuhl, Donahue, Chipman; nays – none. Motion carried. Consent Agenda. Donahue moved, Wayson seconded to approve the Consent Agenda including City Council Minutes from the Regular Session on June 12, 2012; the attached list of Claims, May Revenues, the Liquor License Application for Barrios Palms LLC, Class BB Beer License with Sunday Sales endorsement, the Liquor License Renewal for Casey’s General Store Class E & C Liquor License with Sunday Sales endorsement, Pay Application Number 4 for the City Streets and Maintenance Facility to Garling Construction, Inc. in the amount of $306,668.55, Change Order Number 2 for the City Streets and Maintenance Facility for Garling Construction, Inc. in the amount of $7,892.00, Change Order Number 1 for the Library Expansion Project to Todd Hackett Construction Co. in a reduction of $6,000.00. The vote was: ayes- Hoffman, Donahue, Chipman, Kuhl, Wayson; nays – none. Motion carried.

Public Comment. No public comment was offered. City Engineer Report City Engineer Trom reported that the steel for the Streets and Maintenance Facility Project arrived last week. The construction is expected to begin on Thursday. The Dubuque Street Overlay Project will be starting July 3. The street will be closed July 5 & 6 to replace the culvert. The project is expected to be complete by July 12. The North Front Street project survey work is complete with the design being started soon. Council discussed the North Front Street Project.

City Attorney Report. City Attorney Peterson presented information regarding Board and Commission appointments and the gender balance law. If the positions are unable to be filled within three months to balance the gender with good effort to recruit volunteers, the appointment can be filled by a qualified applicant.

City Administrator Report. City Administrator Heiar reported that staff will continue advertising for the Board and Commission vacancies that have not achieved gender balance through the most recent round of advertisements. The Library Project has begun. The earth movers have started excavating. On Wednesday, July 4, City offices will be closed. The Recreation Center and Pools will be open. Johnson County Refuse will collect garbage as normal. Heiar reminded Council to return evaluations to Mulcahey by July 6 for discussion at the July 10 City Council meeting. The engineer review process will be handled differently than in the past.

Mayor Report. Mayor Salm reported that the Iowa League of Cities is filming and doing interviews relating to the City’s IPad transition.

Board and Commission Appointments Donahue moved, Hoffman seconded to approve the Mayor’s recommended appointments; Planning Commission, Carol Haack; Board of Adjustment, Alison Werner-Smith; Parks & Recreation - Shelby Behrens, Kerry Fitzpatrick, and Bonnie Pitz; Library Board - Nick Gefaller and John Henk; Telecommunications Commission Katie Colony and Matt Zacek. After discussion, the vote was: ayes – Donahue, Chipman, Kuhl, Wayson, Hoffman; nays – none. Motion carried. Food Pantry. Kuhl moved, Wayson seconded to approve Resolution Number 12-64, A Resolution to commit local monetary support to the North Liberty Community Food Pantry for purchase of capital equipment in support of community social service efforts. The motion was discussion. Kuhl moved to amend the motion to up to $15,000 for the freezer, in case of cost overruns, if the freezer is less than $15,000, the Pantry can come back to council to discuss the spending of the remaining funds, and that the equipment is to remain with the Food Pantry or be returned to the City. After discussion, the vote on the amendment was: ayes – Chipman, Kuhl, Wayson, Hoffman, Donahue; nays – none. Motion carried. The vote on the original motion relating to the resolution was: ayes – Chipman, Kuhl, Wayson, Hoffman, Donahue; nays – none. Motion carried. Youth Triathlon. Hoffman moved, Chipman seconded to approve Resolution Number 12-65, A Resolution authorizing the use of city streets and temporary street closings for the Community Center’s Youth Triathlon. Katie Gerot, Aquatics Direction, presented additional information about the proposed event. After discussion, the vote was: ayes – Kuhl, Wayson, Hoffman, Donahue, Chipman; nays – none. Motion carried.

Liberty Centre, Part 1C, Lot 2 Site Plan. Wheatley presented the site plan application for Liberty Centre, Part 1C, Lot 2. Both staff and the Planning Commission recommended approval with the condition that the building modifications be made to extend the building offsets to at least eight inches. Since the Planning Commission meeting, the developer has made those amendments. Jason Santee from McClure Engineering was present to answer any questions relating to the application. Council discussed the application. Donahue moved, Wayson seconded to approve Resolution Number 12-66 A Resolution approving a Commercial Development Site Plan for 650 Community Drive, North Liberty, Iowa. The vote was: ayes – Wayson, Hoffman, Donahue, Chipman, Kuhl; nays – none. Motion carried.

Street Trees Ordinance Updates. Chipman moved, Hoffman seconded to approve the third Consideration and adoption of Ordinance Number 12-08, An Ordinance amending the City of North Liberty Code of Ordinances by amending Chapter 150 to implement changes to trees in the right-of-way. The vote was: ayes – Hoffman, Donahue, Chipman, Kuhl, Wayson; nays – none. Motion carried.

Golf Cart Ordinance Update. Donahue moved, Kuhl seconded to approve the third Consideration and adoption of Ordinance Number 12-09, An Ordinance amending the Code of Ordinances of the City of North Liberty, Iowa, by adding new sections pertaining to the operation of golf carts and usage during special events. The vote was: ayes – Donahue, Chipman, Kuhl, Wayson, Hoffman; nays – none. Motion carried. FY 2013 Salary Resolution. Kuhl moved, Chipman seconded to approve Resolution Number 12-67, A Resolution authorizing salaries and hourly wages for City employees for the fiscal year of July 1, 2012 through June 30, 2013. The vote was: ayes – Chipman, Kuhl, Wayson, Hoffman, Donahue; nays – none. Motion carried.

Harvest Estates II. Hoffman moved, Wayson seconded to approve Resolution Number 12-68, A Resolution approving the Developer’s Agreement between the City of North Liberty and Glynmor LLC that establishes the terms and conditions under which Harvest Estates II will be developed in the City of North Liberty, Iowa. After discussion, the vote was: ayes – Kuhl, Wayson, Hoffman, Donahue, Chipman; nays – none. Motion carried.

Forevergreen Road Agreement. Chipman moved, Kuhl seconded to approve Resolution Number 12-69, A Resolution authorizing the Service Agreement between the City of North Liberty and the City of Coralville for services relating to the Forevergreen Road Study Project. After discussion, Donahue moved to table, Kuhl seconded. After discussion, the vote on the motion to table

was: ayes – Donahue, Kuhl; nays – Wayson, Hoffman, Chipman. Motion failed. After discussion, the vote on the original motion was: ayes – Chipman, Kuhl, Hoffman, Wayson; nays – Donahue. Motion carried.

Assessment Resolution. Wayson moved, Donahue seconded to approve Resolution Number 12-70, A Resolution authorizing the assessment of delinquent amounts owed to the City of North Liberty, Iowa to individual property taxes. The vote was: ayes- Hoffman, Donahue, Chipman, Kuhl, Wayson; nays – none. Motion carried.

Johnson Controls. Donahue moved, Hoffman seconded to approve Resolution Number 12-71, A Resolution authorizing the Planned Service Agreement between the City of North Liberty and Johnson Controls for Community Center Maintenance. After discussion, the vote was: ayes – Donahue, Chipman, Kuhl, Wayson, Hoffman; nays – none. New Business. Councilor Kuhl reported that the MPOJC will be meeting at 4:30 p.m. tomorrow in North Liberty Council chambers. Adjournment. At 7:10 p.m., Wayson moved, Hoffman seconded to adjourn. All ayes. A RESOLUTION APPROVING THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF NORTH LIBERTY AND PUBLIC PROFESSIONAL AND MAINTENANCE EMPLOYEES LOCAL 2003 FOR THE PERIOD OF JULY 1, 2012 THROUGH JUNE 30, 2013

WHEREAS, the City of North Liberty, Iowa participated in collective bargaining with the Public Professional and Maintenance Employees Local 2003; and

WHEREAS, the arbitrator determined the outcome of the contract

negotiations; and WHEREAS, the arbitrator’s determinations are included in the attached

Collective Bargaining Agreement; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

OF NORTH LIBERTY, IOWA:

1. That the terms of the agreement, attached hereto as Exhibit A, between the City of North Liberty, Iowa, and Public Professional and Maintenance Employees Local 2003, are hereby approved.

2. That the Mayor and City Administrator are hereby authorized to execute the agreement attached hereto as Exhibit A.

Re: Monthly Report

We performed building maintenance as needed this month. We repaired and

welded the shade umbrellas at the pool’s grass beach area. We repaired the

driveway at the city maintenance facility with new concrete.

We picked up trash and pet waste stations as needed this month.

A great deal of time was spent mowing and trimming weeds around fence lines, the

bike trail and city parks and ponds this month. We also sprayed weeds in areas that

are more difficult to weed trim.

We performed ground and landscape maintenance. The 92 planter boxes at Liberty

Centre pond have been hand watered daily. Highway 965, Golfview Drive and St

Andrews Drive intersection landscaping have been maintained and watered

frequently. Landscape maintenance has taken a great deal of time due to the

abundance of weeds. We continue to mulch landscapes and trees this month to help

conserve moisture. We have been trimming and cutting dead trees and limbs along

the bike trail as time permits.

We have maintained ball diamonds and facilities this month. We continue to host

baseball and softball tournaments. We hosted the state 9U baseball tournament

again this year on June 22-24. Parks Department staff provided field/facility

maintenance.

Repairs are now complete at the tennis courts. The fence along the east side was

removed and reinstalled due to frost heave. In addition to the repairs we

incorporated an area for audience seating and viewing. This will be very

beneficial for tennis matches we host.

We have begun work at Quail Ridge Park preparing for the installation of sewer

and water to the shelter. Hopefully in the next month if weather permits we will

have the restrooms complete and usable for park users.

Work has begun at the Ranshaw house. Thanks to the Water Department for the

timely installation of the new water service to the house. We have received

quotes to take the old overhead electric service off the front of the house and bury

in a new underground service. This will dress up the front of the house and help

make it easier for Roger Qwinnup to repair and repaint the siding.

drainage easement. In the fall we will finish up this area with seeding. • We have been watering our trees outside of our fence here at the shop. • Due to the construction on I-80 and 380 intersections, Dan Lange is still

spending a lot of time working with coordinating our traffic signals. • Staff has been patching streets and working gravel roads and shoulders. • Our Street Department shop is ahead of schedule now. Most of the main

frame work has been erected in the past week. • Mowed ditches and R.O.W’S. • Hauled rock on gravel roads and shoulders. • Hauled sand in for the winter, it is dry sand so now is the time too haul. • Attended all safety meetings. • I have been working on our capital equipment for this upcoming year. • Assisted other departments as needed.

Read 6,860 radio reads last month that’s an increase of 59 accounts. We had to re read

approximately 33 accounts.

We delivered 110 shut off notices and shut off approximately 26 overdue accounts for non-

payment this month.

In the month of June we averaged about 1,386,000 gallons a day and our total pumpage for the

month was 42,958,000 gallons that is an increase of about 31.8% from last June. With the dry

weather we have been experiencing we seem to be doing ok with only running the water plant.

The highest pumpage to date has been 1,712,000 gallons.

We received a revised permit from the IDNR this month and spent a few days making some

changes to our monthly operating report. Pinnacle Engineering was here to calibrate some of the

flow meters in the plant.

We have had to deal with several service line leaks in the last month. We found a leak close to

the intersection of North Front and Dubuque Street that had been leaking under the road. This

was a very small leak that appeared in a crack in the paving, because we weren’t 100% sure it

was a leak or who’s service it was the Water department went ahead and made the repairs and

contacted the owner with what we found. The owner will be paying for the expenses associated

with the repair.

We spent several days last month collecting hydrant data for the ISO insurance report. They are

asking for information on locations of hydrants, if they have steamer caps, what size of hydrants,

flow data, and static pressures. I hope to have that report finished in the next couple of weeks.

We continue collecting curb box location information, exercising main line valves, installing

new meters and RF’s, and replaced several high use water meters last month.

Water Pollution Control Facility

Iowa TO: Mayor, City Council and City Administrator FROM: Dave Ramsey DATE: July 2, 2012 SUBJECT: June 2012 Water Pollution Control Plant Report The following items were worked on at the Water Pollution Control Plant during the month of June:

1. All preventative maintenance at the plant and lift stations was completed. During

the month several major equipment rebuild projects were completed.

2. Staff stayed very busy with numerous operational issues throughout the month.

3. Staff attended several safety meetings.

4. Yearly inspection of all cranes at the facility was completed. All cranes were brought up to date per the inspection report.

5. Yearly inspection and cleaning of the EQ basin was completed. A new liner was installed in the basin last year and is in excellent condition.

6. Bi-yearly load testing on all generators was completed this month.

board liked the data and ability to compare numbers and Shelly will look into continuing some version of this presentation. 4. Prime Time and Game Time: Jones Gym work has been completed and the floor is curing. It should be ready for the games.

This year both the men and women have 4 teams, so only 1 gym will be used. Game Time is Wed/Mon 6pm and 7:30 pm June 19, 24, July 2, 11, 16, 18 and Prime Time is Tues 6pm and 7:30 pm and Sunday 3pm and 4:30pm June 20, 27, July 2, 11, 16, 18.

1. Status Updates: Meetings continue regarding Penn Meadows Park. Currently looking at concerns regarding parking, concessions, and restrooms needed and the cost (according to usage numbers). West Side Park has no new concepts, continuing with original plan. Dog Park talks continue, but land within North Liberty is quite expensive. If the Army Corps land outside of town is used, the city may take part in some way.

2. Recreation Monthly Report: Summary of the past month was reviewed. 3. Monthly Budget Reports: Budget reports were reviewed. 4. Other Issues/Concerns: Construction will begin soon on the library expansion. Parking lots will remain open, the park will

North Liberty Planning Commission Minutes

June 20, 2012 The meeting of the Planning Commission was called to order at 6:45 pm. Members Present: Anderson, Covert, Detlefsen, Haack; absent: Mausser, Moore, Frost. Also Present: Scott Peterson, Kevin Trom, Dean Wheatley, Erika Harper, Mary Byers, Mayor Salm, Brian Wayson, Nate Byers, and other interested parties. Agenda Approval: Anderson moved, seconded by Haack, to approve the agenda as submitted. The vote was: ayes—Anderson, Covert, Detlefsen, Haack, nays: none; absent: Mausser, Moore, Frost. Motion carried. Public Comment: No public comment was offered. Hunter Companies, Commercial Site Plan Application. Wheatley presented the request of Hunter Companies to approve a commercial site plan located at the southwest corner of Penn Street and Highway 965. Staff recommended approval subject to building modifications to extend the building offsets to at least eight inches. There were no public comments. Nate Byers, McClure Engineering, addressed the commission on any questions they had on the site plan. Haack moved, seconded by Anderson, to recommend approval to the City Council subject to the building modifications to extend the building offsets to at least eight inches. After discussion, the vote was: ayes—Anderson, Covert, Detlefsen, Haack; nays—none; absent—Mausser, Moore, Frost. Motion carried. Stiltner Electric, Conditional Use Permit. Wheatley presented the request to allow outside storage of business material at the existing building under construction located at the southern end of Herky Street west of Interstate 380. The conditional use for outside storage is recommended by city staff for approval subject to improvements shown on the proposed site plan. The applicant was not present and there were no comments from the public. Anderson moved, seconded by Detlefsen, to recommend approval of the Conditional Use Permit to the Board of Adjustment. After discussion, the vote was: ayes—Anderson, Covert, Detlefsen, Haack; nays—none; absent—Mausser, Moore, Frost. Motion carried.

Wheatley presented the request of the revised existing conditional use for outside storage of business material at the existing building location at the northeast corner of 240th Street and Progress Street. City Staff recommends approval to the Board of Adjustment subject to improvements shown on the proposed site plan. The applicant was not present and there were no comments from the public. Anderson moved, seconded by Detlefsen, to recommend approval of the Conditional Use Permit to the Board of Adjustment. Wheatley reported that Casey’s would not be building a store there and that the lot had been sold to someone else. NEW BUSINESS. It was the consensus of the commission to move the July Planning Commission to July 5, 2012. ADJOURNMENT. Roll Call. At 6:30 p.m., Commissioner Dave Moore called the July 5, 2012 meeting of the North Liberty Planning Commission to order. Commission members present: Anderson, Detlefsen, Frost, Moore; absent - Covert, Haack. Others present: Dean Wheatley, Tracey Mulcahey, Scott Peterson, Carter Kurdlre, Tom, Salm, Brian Wayson, Nate Byers, Glen Siders, Erika Harper and other interested parties. Agenda Approval. Detlefsen moved, Frost seconded to approve the agenda. All ayes. Motion carried. Public Comment. No public comment was offered. Liberty Centre Part 1, Lot 11 Commercial Site Plan. Staff Presentation. Wheatley presented the request of Hunter Companies to approve a commercial site plan for property generally located on the south side of Penn Street and west of Highway 965. The developer has set aside additional parking for the potential of a restaurant use. Staff recommends approval with easements in place and additional pedestrian connectivity. Applicant’s Presentation. Nate Byers, the applicant’s representative from McClure Engineering spoke regarding the application relating to pedestrian connectivity. He stated that the proposed development is no different than the surrounding ones. The Commission discussed the proposed application. Recommendation to City Council. Frost moved, Detlefsen seconded to recommend approval of the Commercial Development Site Plan for Lot 11, Liberty Centre Part 1 with easements being included.
