PLANNING COMMISSION APPROVAL AUTHORITY: Conditional Use Permit Pursuant to Section 90-42.4 of the Hemet Municipal Code a restaurant with a drive-thru may be considered by the Planning Commission with the processing of a Conditional Use Permit pursuant to the findings outlined in Section 90-42.5 of the Hemet Municipal Code. PROJECT SETTING: The subject property is located on the frontage north side of W Florida Avenue, between N Sanderson to the west and Kirby Street to the east. Access to the site is provided from Florida Avenue from a 35 foot wide drive-aisle, which provides access to a commercial center. The .63 acre pad site comprises of an existing 2,331 square-foot office building and parking. Surrounding Land Uses The property maintains a General Plan Land Use designation of CC (Community Commercial) and is zoned (C-2) General Commercial. The existing commercial site is developed with existing curb, gutter, and sidewalk. Surrounding land uses include AMF Hemet Lanes (bowling alley) to the north, Mickey's Yogurt to the south, California Budget motel to the east, and El Pollo Loco to the west. •General Plan Land Use Map (Exhibit 2) •Zoning Map (Exhibit 3) •Aerial Map (Exhibit 4) PROJECT DESCRIPTION & ANALYSIS: The project involves conversion of an existing office building (formerly Long John Silver's Restaurant and Title Max) into a 2,581 square-foot drive-thru restaurant on 0.63 acres. Proposed operating hours for walk‐in and drive‐through service will be from 6:00am to 10:00pm, seven (7) days a week. The anticipated number of employees is 2 to 6 per shift. Site Plan Site improvements include a 12-foot wide drive-thru with menu order board, 250 square-foot addition to the existing building for new pickup window, reconfigured parking area with landscaping, new outdoor seating with covered patio shade trellis for patrons. There will also be new site lighting, new trash enclosure, and ADA accessible pathway provide to the sidewalk along the frontage of W Florida Avenue. Floor Plan The applicant is actively working towards selection of a restaurant tenant and is in negotiations with potential tenant. The proposed interior layout consists of a 1,207 square-foot dining room area, customer service counter and point of sale area, two (2) accessible bathrooms, designated kitchen area, 250 square-foot kitchen addition and pickup window. Parking Per Section 90-1423(B)(22), the parking criteria for a drive-thru restaurant is 1 space for each 200 square feet up to 2,000 square feet of gross floor area plus 1 space for each 60 square feet of gross floor area beyond 2,000 square feet. Based on a gross floor area of 2,581 square feet, a total of 20

parking spaces would be required. A total of 24 parking spaces, including 1 ADA spaces have been provided. Therefore, sufficient parking will be provided. Circulation The new drive-thru queueing lane entrance is located at the northwest corner of the project site via a one-way 12-foot drive aisle. The drive-thru lane would wrap around the building in a clockwise direction, and provides stacking of six (6) cars before the menu ordering board. Section 90-1423(B)(22) requires a minimum queuing for no less than six (6) vehicles to the menu board. As illustrated on the site plan, the minimum queuing of six (6) vehicles has been provided. Furthermore, an additional stacking of six (6) cars up to the pickup window has also been provided, which provides additional queue capacity and improves the service rate during peak drive-through conditions. Architecture There are no changes to the existing architectural style of the building. The new 250 square-foot addition will match the existing structure. Any exterior enhancements or modifications to the building would require review and approval by the Planning Division during the building plan check process, and subject to the City's Commercial Design Criteria. Landscaping Landscaping is proposed throughout the site, around the building, in the parking areas and along the street frontage of Florida Avenue. Proposed landscaping includes Chinese Elm and Liquid Amber trees, (ground cover) Dwarf Coyote Bush and Dwarf Rosemary, (shrubs) Orchid Rockrose, India Hawthorn, Fountain Grass, Dwarf Heavenly Bamboo, Day Lily, Japanese Iris, Shiny Xylosma, Fraser's Photinia, Ganzia Species, Orchid Rockrose, India Hawthorn, Day Lily, and Fountain Grass. Per Section 90-1425(b)(1) five (5) percent of the parking area shall be landscaped with live plant materials, including but not limited to trees, shrubs and ground cover. The required landscaping may be in the form of islands, strips or tree wells. A total of 19.07% landscape area is proposed. Lighting Site lighting is proposed within the parking lot area and around the building. A condition of approval will require a site lighting plan to be submitted during the building plan check. Lighting as required by code shall be installed and shielded to confine direct rays of artificial light within the boundaries of the parking lot. Light standards shall not exceed 25 feet in height and shall be located so as not to interfere with parking lot landscaping and in accordance. All lighting shall be adjusted so that all lighting is contained within the boundaries of the site. Grading and Drainage The applicant shall submit a final grading and drainage plan for approval by the City Engineer. It has been determined that a Water Quality Management Plan is not required because the site was previously developed with a building and parking lot, and additional impervious surface area is less than 5,000 square feet. PROPOSED FINDINGS: CONDITIONAL USE PERMIT FINDINGS Pursuant to Section 90-42.4 of the Hemet Municipal Code a restaurant with a drive-thru may be considered by the Planning Commission with the processing of a Conditional Use Permit pursuant to the findings outlined in Section 90-42.5 of the Hemet Municipal Code as follows:

1.That the proposed location of the conditional use is in accord with the objectives of this chapter and the purposes of the zone in which the site is located; and Finding: The subject property is located within the C-2 (General Commercial) zone. The zoning allows for a drive-thru restaurant, subject to a Conditional Use Permit. Surrounding land uses include AMF Hemet Lanes (bowling alley) to the north, Mickey's Yogurt to the south, California Budget motel to the east and El Pollo Loco to the west. The surrounding land uses are primarily commercial uses to serve the needs of the area. In addition, the project meets the development standards of the C-2 zone and complies with the Hemet Zoning Code requirements for commercial development for setbacks, design.andlandscaping, lighting, architectural parking, height,building circulation, Therefore, the proposed location of the conditional use is in accord with the objectives of this chapter and zone in which the site is located. 2.That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity: Finding: The project involves the conversion of an existing office building (formerly Title Max and Long John Silver’s Restaurant) into a 2,581 square-foot drive-thru restaurant on 0.63 acres. Site improvements also a new drive-thru queuing lane, menu-board for ordering, outdoor seating area and covered trellis feature, new landscaping, new site lighting, new trash enclosure (relocated), and modified parking. Surrounding land uses include AMF Hemet Lanes (bowling alley) to the north, Mickey's Yogurt to the south, California Budget motel to the east, and El Pollo Loco to the west. The surrounding land uses are primarily commercial uses to serve the needs of the area. Conditions of approval pertaining to building code requirements, circulation, parking, lighting, landscaping, hours of operation, will ensure that the drive-thru restaurant would be operated and maintained in a manner that will not be detrimental to the public, health, safety or welfare, or materially injurious to properties or improvements within the vicinity. 3.That the use and operation is consistent with the general plan, goals, and policies: Finding: The subject property is designated as CC (Community Commercial) in the Hemet General Plan designation. The Community Commercial designation provides for general retail, markets, commercial services, restaurants, lodging, commercial recreation, professional offices and financial institutions. Community Commercial areas are typically located near residential, office or industry activity centers or major arterial corridors, and are designed to serve the needs of the community at-large. A drive-thru restaurant is a permitted use in the C-2 Zone, subject to a Conditional Use Permit. The conditions of approval shall ensure that the use and operation is consistent with the general plan, goals, and policies. Furthermore, the use and operation is consistent with the following general plan, goals, and policies: LU-4.3: ReandDevelopment Infill - adaptive retheActively Use: promote - ofinfill anduseeconomically underutilized obsolete, and dilapidated commercial and industrial sites, and foster rehabilitation consistent with surrounding uses and the needs of the community. LU-11.1: Attract New Businesses: Support existing businesses and seek to attract new business and industries which strengthen and diversify Hemet’s tax revenue base, improve wage and salary levels, increase the variety of job opportunities, and employ the resident labor force.

4.That the type, intensity, sensitivity, and operating characteristics of the proposed use, and the manner in which they will be located on the site, are compatible with existing land uses, the character of established neighborhoods, or planned development in the vicinity: Finding: The project involves conversion of an existing office building (formerly Long John Silver's Restaurant and Title Max) into a 2,581 square-foot drive-thru restaurant on 0.63 acres. Proposed operating hours for walk‐in and drive‐through service will be from 6:00am to 10:00pm, seven (7) days a week. The anticipated number of employees is 2 to 6 per shift. The hours of operation are well within the operating hours of surrounding commercial development within the area. Surrounding land uses include AMF Hemet Lanes (bowling alley) to the north, Mickey's Yogurt to the south, California Budget motel to the east, and El Pollo Loco to the west. The surrounding land uses are primarily commercial uses to serve the needs of the area. Therefore, staff finds the proposed drive-thru restaurant is compatible with the type, intensity, sensitivity, and operating characteristics in a manner that is consistent with the character of the surrounding development. GENERAL PLAN AND ZONING CONSISTENCY: The subject property is designated as CC (Community Commercial) in the Hemet General Plan designation. The Community Commercial designation provides for general retail, markets,commercial services, restaurants, lodging, commercial recreation, professional offices and financial institutions. CC areas are typically located near residential, office or industry activity centers or major arterial corridors, and are designed to serve the needs of the community at-large. The proposed drive-thru restaurant is an approved use, subject to a Conditional Use Permit. The conditions of approval shall ensure that the use and operation is consistent with zoning, general plan, goals, and policies. CEQA REVIEW: The project is exempt from provisions of the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15332 (In-Fill Development Projects) Class 32 consists of projects characterized as in-fill development meeting the conditions described in this section. CEQAGuidelines Association of Environmental Professionals 2020 279 (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality. (e) The site can be adequately served by all required utilities and public services. The project is also exempt from provisions of the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301 (I)(3). EXISTING FACILITIES Class 1 (e) (ADDITIONS) to an existing structure provided that the addition will not result in an increase of more than 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is less. PUBLIC COMMUNICATIONS RECEIVED: On March 25, 2021 the City gave public notice by advertising in the Press Enterprise and by mailing to property owners and tenants within 500 feet, of the holding of a public hearing at which the project

Florida Avenue Note: Any conditions revised at a hearing will be noted by strikeout (for deletions) and/or underline (for additions), and any newly added conditions will be added at the end of all conditions regardless of the Department originating the condition. STANDARD CONDITIONS The following conditions of approval were approved by the City Council as standard conditions of approval for all projects. Questions regarding compliance with these conditions should be directed to the Planning Division at (951) 765-2375. General Requirements: 1. CONDITIONAL USE PERMIT (CUP 20-003) shall become null and void on April 6,

2023 (two calendar years from the date of approval), unless use in reliance on the approved Conditional Use Permit is established prior to the expiration date. A time extension may be granted by the Planning Commission in accordance with Hemet Municipal Code, provided a written request for a time extension is submitted the Planning Division prior to the expiration date. No formal notice of expiration will be given by the City.

2. Approval of CONDITIONAL USE PERMIT (CUP 20-003) shall become effective on April

20, 2021 unless appealed to the Planning Commission by April 19, 2021 (10 calendar days after action by the Planning Commission). The appeal shall be in writing and shall be accompanied by the required fee.

3. The conditions of approval of this project shall supersede all conflicting notations,

specifications, dimensions, typical sections, and the like, which may be shown on the project development plans.

4. This project site shall be developed in accordance with the approved plan(s) and the

conditions contained herein.

5. This project shall comply with all sections of the Zoning Ordinance, Subdivision Ordinance and all other applicable Local, State and Federal laws and regulations in effect at the time of the building permit application and/or time of recordation, including the California Building Code, California Fire Code, and City and State Handicapped Accessibility Requirements (California Code of Regulations, Title 24).

6. Prior to the issuance of building permits, the applicant shall be subject to all applicable

development fees at the rate in effect at the time of building permit application for the tenant improvement.

7. The applicant shall indemnify, protect, defend, and hold harmless, the City, and/or any of

its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, from any and all claims, demands, law suits, writs of mandamus, and other actions and proceedings (whether legal, equitable, declaratory, administrative or adjudicatory in nature), and alternative dispute resolutions procedures (including, but not limited to arbitrations, mediations, and other such procedures), (collectively “Actions”), brought against the City, and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, that challenge, attack, or seek to modify, set aside, void, or annul, the any action of, or any permit or approval issued by, the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof (including actions approved by voters of the City), for or concerning the project, whether such Actions are brought under the California Environmental Quality Act, the Planning and Zoning Law, the Subdivisions Map Act, Code of Civil Procedure Section 1085 or 1094.5, or any other state, federal, or local statute, law, ordinance, rule, regulation, or any decision of a court of competent jurisdiction. It is expressly agreed that the City shall have the right to approve, which approval will not be unreasonably withheld, the legal counsel providing the City’s defense, and that applicant shall reimburse City for any costs and expenses directly and necessarily incurred by the City in the course of the defense. City shall promptly notify the applicant of any Action brought and City shall cooperate with applicant in defense of the Action. (City Council Resolution No. 3693, 12-17-02)

8. Construction activity shall meet the requirements of the Hemet Municipal Code Chapter 30, Article II.

PLANNING DIVISION CONDITIONS The following conditions of approval are project specific and were recommended by the Planning Division. Questions regarding compliance with these conditions should be directed to the City of Hemet Planning Division at (951) 765-2375. 9. The hours of operation shall be from 6:00am to 10:00pm, Seven Days a Week.

10. Site lighting shall be installed and shielded to confine direct rays of artificial light within the boundaries of the parking lot. Light standards as required by code shall not exceed 25 feet in height and shall be located so as not to interfere with parking lot landscaping. Parking lot lighting may be required to be shut off after certain hours, depending upon the use and proximity to residential developments. Parking lot lighting and public common area lighting shall be shielded or designed to direct the lighting downward. All lighting shall be adjusted so that all lighting is contained within the boundaries of the site.

11. An anti-graffiti coating and/or shall be provided on all block walls and stucco covered walls and written verification of its application from the developer shall be provided to the City of Hemet, Planning Division.

12. All electrical and mechanical equipment, including but not limited to, air-conditioning units, electrical boxes, transformers, backflow preventers, and roof-mounted equipment shall be visually screened from public view. All roof-mounted air conditioning units proposed for the shall provide screening from public view via a screen enclosure that is architecturally compatible with the building. Screening material can include but is not limited to louvered roof equipment screens or panels. Screening shall be in accordance with city standards, to the satisfaction of the Planning Division and in compliance with the Building Code.

13. Signage is not approved as part of this Project. The applicant shall submit plans for a Permanent Sign Permit from the Planning Department and building permit from the Building Department, which are consistent with the Hemet Municipal Code.

Landscaping

14. A landscape and irrigation plan shall be submitted to the Building Division for review and

approval.

15. Section 90-895(h) -Landscape Requirements and Article XLVIII 16. Per Section 90-1425(b)(1) five (5) percent of the parking area shall be landscaped with

live plant materials, including but not limited to trees, shrubs and ground cover. The required landscaping may be in the form of islands, strips or tree wells as shown in Figure 1. The required landscaping shall be evenly distributed throughout the parking area to accomplish the stated purpose. Required side, rear or front yard landscaping up to a maximum of five feet in width when adjacent to the parking area may be used to satisfy up to one-half of the required parking lot landscaping. All landscaping shall be kept in a health and thriving condition, free and clear of weeds and debris.

17. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, disease, vermin, and debris, during the term of this Project.

18. Prior to the issuance of a Certificate of Occupancy or finalization of the Building Permit, all landscaping shall be installed.

19. Prior to the issuance of a Certificate of Occupancy or finalization of the Building Permit, landscaped areas shall have an automatic irrigation system, with automatic timers, installed and operational, unless cash or a bond is posted to guarantee completion.

BUILDING SAFETY DIVISION CONDITIONS The following conditions of approval are project specific and were recommended by the Building Department. Questions regarding compliance with these conditions should be directed to the City of Hemet Building Department at (951) 765-2475. 20. Address shall be posted in a manner approved by the City of Hemet Building

Department.

21. Construction activity shall only occur between the hours of 6:00 a.m. and 6:00 p.m. during the months of June through September and between the hours of 7:00 a.m. and 6:00 p.m. during the months of October through May. prohibited. Exceptions to these standards may be granted only by the Hemet Building Official and/or the Hemet City Council.

22. Access, sanitary facilities, and parking shall comply with Title 24 Accessibility Requirements per the currently adopted California Building Code.

23. At least 1 accessible route shall be provided within the site from accessible parking spaces and accessible parking loading zones; public streets and sidewalks; and public transportation stops to the accessible building or facility entrance they serve. If more than 1 route is provided, all routes must be accessible.

24. If applicable, Landscape and Irrigation plans: Submit four (4) complete sets detached from building plans.

25. Submit two (2) sets of structural calculations, energy conservation calculations and soils reports. Architects/Engineers stamp and wet signature is required prior to submittal of plan check.

26. If applicable, trash enclosure provided shall be constructed per the city standards, a copy of which can be obtained at the Engineering Division. A Building Permit is required and shall be submitted as a separate permit application.

27. Upon tenant improvement plan check submittal there may be additional Building Division requirements.

28. Upon plan check submittal and after review of the submitted plans, specifications and documents, additional requirements may be required.

29. Submit five (5) complete sets of architectural plans and/or 5 sets of booklets if the following documents are applicable to your project:

• Plot Plan

• Foundation Plan

• Floor Plan

• Structural Framing Plan

• Accessibility Plan

• Exit Study Plan

• Green Building Compliance Plan and Documentation

• Energy Compliance Plan including compliance and mandatory measures forms.

• Electrical Plans (electrical service shall be underground per Hemet Municipal Code, including size of main switch, number and size of service entrance conductors, circuit schedule and demand load.

• Plumbing and sewer plan, isometric, including underground diagram, water piping diagram, sewer or septic tank location, fixture units, gas piping and vents, heating and air conditioning diagram.

• Mechanical Plan including duct layout and sizing.

30. The proposed project will be subject to approval by the Eastern Municipal Water District

and all applicable fees and charges shall be paid to the District prior to permit issuance. Contact the water district at 951.928.3777 for specific details.

• Approval (First Release) from Eastern Municipal Water District (EMWD) will be required prior to permit issuance.

• Approval (Final Release) from Eastern Municipal Water District (EMWD) will be required prior to permit final.

31. Permit fees shall be paid in accordance to the City’s adopted fee schedule at the time of

building permit is issued.

32. Separate permits are required for all fences, walls, paving, signage, trash enclosure and any other work not included in your original submittal.

33. All contractors must show proof of State and City licenses, and workmen’s compensation insurance to the City prior to the issuance of permits.

34. Businesses shall not open for operation prior to posting of Certificate of Occupancy issued by the Building Division.

FIRE DEPARMENT CONDITIONS Unless specifically stated herein, these conditions shall not be construed to permit or allow deviation from any Federal or State laws nor any of the local codes and ordinances adopted by this jurisdiction. The City of Hemet enforces the California Code of Regulations (CCR), Title 24, Part 9, 2019 California Fire Code without local amendments. In addition, CCR Title 19 requirements may be applicable. The design professional should refer to these provisions for guidance when developing project drawings and specifications. 35. Addressing: Height of any numeral or letter must be 1/10 taller than the setback distance

measured in feet, expressed in inches, but in no case smaller than 6 inches in height. Width or stroke of any portion of a number or letter must be 1/10 of its height but no less that .5-inch stroke. The width of any figure must be ½ its height. Suite numbers shall be a minimum 6-inch suite numbers, with a minimum .5 inch stroke, shall be located on the front and back doors. When address is located on monument sign in compliance with this section a maximum 12-inch height and maximum 2-inch stroke width maximum is allowed.

36. All utility rooms including shall be clearly labeled with 6-inch lettering and red in color for fire protection equipment.

37. Fire extinguishers:

• A 2A10BC fire extinguisher shall be installed with no more than 75ft travel distance within the buildings.

• A class ‘K’ extinguisher is required in the cooking area within 10’ of the fryer(s).

• A 2A20BC fire extinguisher shall be installed on each fuel island in an enclosed emergency access case.

38. A fixed fire extinguishing system is required for cooking operations.

39. Emergency parking zones shall be designated and painted red with signage reading “No

Parking, Fire Lane.”

40. The following submittals will be required to be reviewed by the Fire Dept. in this sequence:

• (3) Complete sets of architectural plans for each occupancy.

• (3) Sets of automatic fire extinguishing plans. PUBLIC WORKS DEPARTMENT CONDITIONS 41. Trash enclosures must be City Standard R-500B (Double).

42. Trash enclosures must be installed in accordance with City of Hemet Standards

Specifications for Public Works Construction, Standards R-500 through R-503J.

43. The City of Hemet has an exclusive Franchise Agreement with CR&R Inc. to collect and dispose of all waste including commercial, residential and construction debris within the City of Hemet. Contact CR&R at 1-800-755-8112 to set up solid waste collection services and to help you meet your waste reduction goals.

44. Builders must recycle and or salvage for reuse a minimum of 65 percent of the nonhazardous construction and demolition waste in accordance with the 2019 California Green Building Standards Code.

45. AB 341 - All businesses that generate 4 or more cubic yards of waste per week must make arrangements for recycling collection services with CR&R or donate, sell and/or self-haul their recyclables to a recycling facility.

46. AB 1826 - All businesses that generate 2 or more cubic yards of waste per week must make arrangements for organics collection services with CR&R or donate, sell and/or self-haul their recyclables and organics to a recycling facility.

47. AB 827, MCCarty – AB 341 and AB 1826 covered businesses must provide organics and recycling containers for customers to collect waste generated from products purchased and consumed on the premises. These containers must be placed adjacent to trash containers and be visible, easily accessible and clearly marked.

WATER & WASTE WATER DEPARTMENT CONDITIONS

48. Installation of Approved Reduced Pressure Principle Backflow Preventer Assembly on

all water services per City of Hemet ordinance Title 13, chapter 4 and current policies of

the public utility department to include certification that assembly meets current

standards by a city approved certified tester.

49. Domestic and landscape water services must have separate hot taps with Reduce

Pressure (RP) devices installed within 1 foot of meter box on each service, unless

otherwise approved by the Water Division. If building fire service/sprinklers are to be

installed, must have separate fire service hot taps with Reduced Pressure Detector

Assembly (RPDA) installed.

50. Landscape Lighting and Maintenance District (LLMD) landscape if installed would need

separate hot tap, meter and RP devices installed within 1 foot.

51. Contact EMWD Development services to obtain a clearance letter to discharge into

sewer, letter must be attached to plans.

ENGINEERING DEPARTMENT CONDITIONS The following conditions of approval are project specific and were recommended by the Engineering Department. Questions regarding compliance with these conditions should be directed to the City of Hemet Public Works - Engineering Department at (951) 765-2360.

52. INFORMATION ONLY: Applicant provided title report Order No. 2676018523-52 issued by Old Republic Title Company dated September 20, 2020. Report shows J. Shamloo LLC, a single member California limited liability company as fee owner of Parcel 2 of Parcel Map No. 23252, recorded in 1988, APN 448-310-021. The property is shown to benefit from non-exclusive “Common Access and Cross-Parking Easement”. Various other easements are identified in the report. The Building Area is restricted and abutters right of access to Florida Ave are restricted as shown on referenced Parcel Map.

The restricted building area extends to 35’ east and west of the parcel boundary and it appears the existing building encroaches into the restricted area. Site is subject to an “Avigation Easement”.

PRIOR TO ISSUANCE OF BUILDING PERMIT: Owner/Applicant shall show on the Site Plan the distance between the existing building on-site and the existing building on the westerly site and Fire Marshal and Building Official shall determine that that the separation between the existing buildings complies with applicable codes for fire considerations, health and safety.

53. Any portion of the site affected by easements of record, which cannot be relinquished or relocated, may require that the site plan be further redesigned and resubmitted for City re-review.

PRIOR TO ISSUANCE OF BUILDING PERMIT: Owner/Applicant shall provide written clearance from easement holders that the use and modification of the site as proposed does not interfere with the rights of use of the easement holder.

54. INFORMATION ONLY: The Owner/Applicant shall coordinate with affected utility companies and obtain any permits as necessary for the development of this project.

55. INFORMATION ONLY: Note that all required engineering plans and studies shall be prepared by a Registered Professional Engineer in the State of California and be submitted to the City Engineer for review and approval.

56. INFORMATION ONLY: The Owner/Applicant is required to submit digitized drawing files of all Engineering documents/plans/reports, in PDF and the file format MS Word, Excel, and the City compatible CAD (AutoCad) system, along with original Mylar plans. After all approvals, provide a PDF of all approved improvement plans showing City Engineer’s approval signature, Private Engineer’s approval and any other required agency approvals.

57. INFORMATION ONLY: Florida Avenue is a state highway, and all authority is vested in Caltrans. Hemet General Plan (GP) classifies Florida Avenue as a Divided Secondary-A 4D roadway (4 travel lanes with median). GP Bikeway Circulation Plan requires a Class

2 bikeway (On Road, Two Way Striped Lanes) on Florida. It appears that all right-of-way is existing per City requirements, however Caltrans should be consulted to verify.

PRIOR TO ISSUANCE OF OCCUPANY PERMIT: Street improvements are existing, except landscaping and driveway approach, to acceptable City standards. Florida Avenue is within Hemet Scenic Highway setback and applicant is required to provide landscape and irrigation improvement plans prepared by a Landscape Architect and construct improvements per City’s Scenic Highway Setback Manual Design Criteria and the requirements of the Public Works Department for approval of Caltrans, City Engineer, Public Works and Planning Department.

PRIOR TO ISSUANCE OF OCCUPANY PERMIT: Any site improvements encroaching into Florida Ave right-of-way, including grading, must be shown on plans approved by Caltrans and the City Engineer and construction will require an encroachment permit from Caltrans and City Engineering.

58. This project is located within the City of Hemet sewer and water service area. Owner shall comply with all relevant standards, policies, and procedures of the City in acquiring service for the project.

59. PRIOR TO ISSUANCE OF BUILDING PERMIT and ISSUANCE OF GRADING PERMIT whichever first occurs: All utility services locations and proposed service lines shall be undergrounded from the mainline and be shown on the Grading, Paving and Drainage Plan or Site Plan from the point of mainline connection to the building line.

60. PRIOR TO ISSUANCE OF OCCUPANY PERMIT: All underground utility improvements shall be completed, and written clearance provided from the utility agency.

61. PRIOR TO ISSUANCE OF BUILDING PERMIT: Owner/Applicant is required to pay the fee and form or annex into a Lighting and Landscape Maintenance District (LLMD) if the property is not already within an LLMD for maintenance of street lighting, parkway landscaping and irrigation improvements in the adjacent public rights-of-way.

62. PRIOR TO ISSUANCE OF BUILDING PERMIT: Owner/Applicant is required to provide Parkway Landscaping and Irrigation plans prepared by a licensed Landscape Architect per requirements of Public Works Department for approval of City Engineer Public Works Department. Irrigation power and water services shall be metered separately from on-site services.

63. PRIOR TO ISSUANCE OF BUILDING PERMIT and/or ISSUANCE OF GRADING PERMIT whichever first occurs: A Grading, Paving and Drainage Plan, including Erosion Control Plan, prepared by a Civil Engineer, is required for approval of the City Engineer.

64. PRIOR TO ISSUANCE OF GRADING PERMIT Owner/Applicant is required to provide a fully dimensioned Grading, Paving and Drainage Plan prepared by a Civil Engineer for approval of the City Engineer, including but not limited to:

a. Showing complete legal description on plan cover sheet and the APN.

b. Showing all property line bearings and distances along the property lines from record information.

c. Showing all proposed and existing easements accurately plotted as shown on a current title report.

d. Showing names of all utility, communication, sewer and water service providers.

e. Showing complete dimensioning of right-of-way and existing improvements (at or below grade) from centerline, including curb faces, back of sidewalk where it exists adjacent to the project and all underground utilities.

f. Showing drainage and paving, including demolition, and all site improvements, including building footprint, located relative to property lines.

g. ADA path of travel from public right-of-way to entrance in compliance with all ADA requirements.

h. Showing Trash Enclosures in compliance with current City standards or appropriately modified as approved by City Engineer and ADA path of travel requirements from the building entrance. City standard trash enclosure is commercial, double type per Standards R-500 through R-503J as approved by the Public Works Director and City Engineer.

i. Showing all existing overhead utilities onsite and along project frontage relocated underground and new utilities placed underground from point of connection to building line in compliance with Hemet Municipal Code Section 82-172 regarding undergrounding of existing overhead utility lines.

j. Showing type, size, location, and extent of fire service detector check(s), if any.

k. Showing, East-West and North-South sections through site particularly to include buildings and extending 10-15 feet beyond the property lines and the curb line of street.

l. Showing the parking lot and related appurtenances designed in accordance with the City Parking Lot Design Criteria contained in the City Standard Specifications for Public Works Construction, Standard Drawings P-400 and P-401, Uniform Building Code Title 24, and with Chapter 90, Article XL of the Municipal Code. The location of parking lot lighting shall be shown on the plan. Lighting construction details and specifications shall be shown on a Lighting Plan sheet(s) for which may be included with the Grading, Paving and Drainage plan set or as a separate plan set for approval of the City Engineer. Lighting Plan shall be prepared by a licensed Electrical Engineer.

m. Showing location of parkway landscaping areas and trees, however plans for parkway landscaping and irrigation shall be prepared separately by a licensed Landscape Architect per requirements of Public Works Department and submitted for Public Works Department and City Engineer approval.

n. Showing location of on-site landscaping and planting areas, and trees. Improvement plans for onsite landscaping and irrigation shall be prepared as a separate plan set and submitted for Planning Department approval.

o. Showing reconstruction of existing full driveway approach, maintain existing width, per Standard 210A with radius curb returns and reconstruction of existing driveway centerline PCC gutter and AC pavement from onsite grated inlet (repair inlet apron as necessary) to the back of the approach.

p. Showing necessary dedication of public pedestrian easement to provide ADA access along back of driveway approach. PRIOR TO ISSUANCE OF OCCUPANY PERMIT: Dedication shall be made by separate instrument approved by City Surveyor per legal description prepared by Owner/Applicant’s Land Surveyor or Civil Engineer authorized to practice land surveying.
