Mayor Lannom called the Special Meeting to order at 6:31 p.m. after declaring a quorum present.

FIRST ORDER OF BUSINESS:

1. DiscusslAct upon tbe Enterprise Funds for Fiscal Year ending September 30,2014.

City Manager Rodriguez opened by giving an update on the items that were passed on to Pecos County. City Manager Rodriguez will attend their regular meeting they have set up for August 12, 2013.The County will discuss on what they will propose and lor ,accept. This includes the baseball fields, trash route, and the landfill. The discussion on the Municipal court will be delayed due to the Justice of the Peace being out on medical leave. City Manager Rodriguez would discuss their decisions with City Council on that evening. At that time if the City has to assist with one employee it will be from October 2013 thru January 2014, and will use one of the City employees.

Mayor Lannom asked if they were going to provide us witl;l trash truck?

City Manager Rodriguez "I hope so."

Mayor Lannom asked if the trash truck would be the one that picks up the big bins and the 96 gallon containers?

City Manager Rodriguez "yes" the county route is the three yarders and 96 gallon containers.

Council Member Jackson asked if they had mentioned anything about going up on rates?

City Manager Rodriguez stated that the county would be discussing that, the City would go up on their rates or they would give us a truck so we can charge the customer and the City would make their money that way. They would decide on the lesser of the two.

City Manager Rodriguez -started the budget w\th the tax numbers. The Finance Department presented preliminary numbers from the tax assessor's office that were doser to the City"s actual numbers. The current tax rate is 46.97 cents the effective tax rate is 45.16 cents and tlte rollback rate is 47.32

cents. If the City would go with the effective rate the city would see a loss of $15,000 from the budget. If the City would go with the rollback there would be a gain of $37,000 that's the difference that it will make on the budget. On the revenue side it's staying close to what the city shows.

Mayor Lannom asked if these numbers were including the increase on the rates and/or utilities?

City Manager Rodriguez responded ''yes sir" the other side of the page shows a calculated difference on what the tax payer would pay based on their property value.

Finance Director Smith shows a difference at .47 cents if the City left it at the effective tax rate, with the rollback tax rate the difference would be a little less for the homeowners.

Mayor Lannom replied "so the difference between the current tax rate and the rollback rate arejust pennies?"

Finance Director Smith replied ''yes sir" we would need to know what tax rate you would like to decide on so we could incorporate that into the budget. The City's current top revenue amount was $600,000 that is the fIrst estimated fIgure that the tax assessor had giving us.

Mayor Lannom asked if the tax assessor was sure on the numbers that she had provided the fInance department?

Finance Director Smith replied ''yes this is now."

Mayor Lannom asked "so this is what she is going to publish in the paper then?"

Mayor Pro-Tem Bodges stated that the City's values were the only ones that had gone up 1.9% and everything else had gone down.

Finance Director Smith responded that she had the increase at $12,266 and we showed it at $15,000 so the City is a little different. The City goes off the collection rate only the back tax shows later.

Mayor Pro-Tem Hodges asked if the rollback rate was just below what the City would be accountable for on the rollback collection?

Finance Director Smith stated that's exactly what it is, she has our rollback at .473295 and her other estimate is .451698 and if we went with the .4516 it would be down from last year, at .0537 if the City goes up to .4732 your only changing from last year's percent by .0035 rates.

Council Member Childs stated that the City needed to go with the rollback rates because we went with collections only.

Finance Director Smith said ''yes we are recommending the rollback rate."

City Manager Rodriguez stated that this would be on the agenda for the next meeting.

City Manager Rodriguez continued with an update on the medical insurance. He did notify the council that the rates for insurance had not changed but they did recommend that the percentage we put in to cover claims go up. We only added 3% but the city could set that amount.

Mayor Lannom asked if we collected the amount at the first of the year and put it in the bank?

City Manager Rodriguez replied "no sir" we get the budgeted amount and as we collect the premiums from the employees that part goes to the premium of the insurance and the other part goes to the bank.

Mayor Pro-Tem Hodges asked if the City had done well on their claims this fiscal year?

City Manager Rodriguez said ''yes.''

SECOND ORDER OF BUSINESS:

2. Discuss/Act upon the General Funds for September 30,2014.

Finance Director Smith discussed about the current dental cap of$1500 on certain items. The City was proposing to add 3% into that medical fund to give the e~ployees the option to increase their dental cap of $1500 more per

person for a total benefit of $3000. It would be an additional $10.00 per month for employee only, $15.00 for employee and spouse, $20.00 for employee and children, and $25.00 for employee and family, this would go into the health claim fund that the city had set aside for those claims.

Council Member Childs asked ''what does it cost the city."

Finance Director Smith replied by stating that if they used the max amount of $1500 and the additional amount of $1500 for a total of $3000, the employee would be contributing $120.

Council Member Childs asked if it was going to cost the city $1500 per employee?

City Manager Rodriguez clarified, no it is not per employee. It will only be ~e .c?~,e~ that use it. K :would~ speciijs:s for example; bridge work, root canal~, etq.

Finance Director Smith commented that the appn>ved dental work woQld be a class B or a class C.

Mayor Pro-Tem Hodges asked what the City Manager's recommendation was?

City Manager Rodriguez recommended that they approve the additional coverage.

Finance Director Smith mentioned that the only ones that would benefit from the additional coverage would be the ones that signed up.

City -Secretary Gonzalez asked what the maximum was? "What does it increase to?"

Finance Director Smith responded that if they sign up for the additional benefit their total benefit would be $3000.

Council Member Childs asked how much the City was paying on benefits for the employees? "A lump sum?~'

City Manager Rodriguez replied it's an estimated $873,500 on medical benefits.

Finance Director Smith did clarify that all the premiums were coming out of this amount that is what they put aside for the whole program.

City Secretary Gonzalez commented "even if they choose the additional option it's not going to cost the City any money unless there's a claim, but the cost of the premium will not go up."

Finance Director Smith let city council know that there was no longer a medical laser of $75,000.

Mayor Lannom asked if that's all they had on insurance?

Mayor Pro-Tem Hodges motioned for the additional option, Council Member Ramirez seconded the motion. Motioned died due to lack of votes

City Manager Rodriguez discussed the reclassification of the Police Department. The Finance Department put in the actual numbers so you can see the impact that it would have per position based on where they pay scale and with the proposed reclassification. They have included the merit pay in that department for the individuals that are not getting reclassified.

Mayor Lannom asked "are they not getting merit pay if they are getting reclassified?"

City Manager Rodriguez responded ''that is correct."

Mayor Pro-Tem Hodges asked if the Lieutenants position that went down was Wolverton's position?

City Manager Rodriguez ''yes we brought that down to the base."

Mayor-Lannom asked. if the position was included in the budget?

City Manager Rodriguez replied ''yes.''

Council Member Childs asked if the City had recommended a 2% increase?

City Manager Rodriguez stated "no, that is an average." It will be based on evaluation and performance. The supervisor will decide what step they will receive.

Mayor Lannom proposed that they hire a Public Works Director as soon as possible, for two reasons. First the City Manager cannot manage the city and work on the water project at the same time, it's too much and there's too much at stake. The Public Works Director can take over a lot of the management duties. Second this person has to have the experience necessary to begin to look at the capital improvement program for the City. Helor she needs to be able to discuss fIrst hand with people who know the most about the system. That person would be someone like Mr. Gonzales who knows everything about the water and sewer. Someday he will not be with the City anymore and we need that knowledge. We need a Public Works Director to let us know what the most important issues are that we should worry about.

Council Member Childs stated we have a manager that needs to be managing the City employees and staff. As this water project proceeds it's going to get busy. I think that we need our manager managing the City and we hire a person to manage the water project.

Mayor Lannom stated that he had suggested that to City Manager Rodriguez but he has not made a decision yet.

Council Member Jackson asked City Manager Rodriguez to consider the suggestion, and also asked for his input.

City Manager Rodriguez commented that he had included a position for a Public Works Director but no money was put on that line. He suggested that they go thm the budget and come back to that after everything had been looked at then decide.

City Manager Rodriguez discussed the proposed rates and what they vyould look like.

Mayor Pro-Tem Hodges stated that the City always adds and never subtracts, I think that we should cut the Lieutenants position because we don't need it this year. We bring in a Public Wor1cs Director that will be a right hand man to the City Manager and he assigns his duties as he sees fit.

Mayor Lannom asked "if we cut the Lieutenants position that means we cannot promote anyone."

City Manager Rodriguez responded, we could but at that point we would bring it back to city council for approval.

City Council was in agreement with the Lieutenants position staying vacant until it is needed.

Mayor Lannom asked if the Parks Department had to be adjusted?

Finance Director Smith replied we will leave that department and recreation as is to make up for there over time.

Mayor Lannom wanted to clarify that CVB is going to fund the Annie Riggs, The Fort, and The Sibley School House. The Mayor then asked if the cemeteries were being irrigated?

Finance Director Smith stated that the parks department takes care of that also, and would be able to work on them now that they had more time.

City Manager Rodriguez commented that due to the cut backs the County was doing, they requested that EDC's contract go down from $125,000 to $100,000.

Finance Director Smith let the council know that those amounts already reflected the budget.

City Manager Rodriguez"went on to the Fire Department's budget and the City's 25% is $75,000 for the -next fiscal year.

Finance Director Smith added that 25% would be $74,200 and they had originally-put in $80,.000. and the fire department is proposing $90,000.

City Manager Rodriguez reminded the council that last year they had capped it at $75,000 and not to exceed that amount.

Mayor Lannom asked City manager Rodriguez if it was still capped?

City Manager Rodriguez replied "yes."

Council Member Jackson asked if that was in writing?

City Manager Rodriguez replied ''yes.''

Mayor Pro-Tern Hodges stated that they could go up on the amount, but it needed to stay capped.

Finance Director Smith stated that they had projected it at $80,000 in there figures for Fort Stockton only.

Mayor Pro-Tern Hodges agreed to cap it at $80,000.

City Manager Rodriguez notified city council know that the last payment to incode in the amount of $98,625 will be made on October 1,2013.

City Manager Rodriguez had discussed the incentive pay, and had considered eliminating it and just doing a merit pay. The merit pay is based on a step system and job performance. There are certificates and licenses that are listed as incentive pay but do not qualify because they are actual job requirements. If they have additional certifications that are not a job requirement then that will be considered as an incentive.

Mayor Lannom asked if these two would get converted?

City Manager Rodriguez replied ''yes.''

Mayor Pro-Tern Hodges like that better.

Mayor Lannom asked if longevity was staying?

City Manager Rodriguez replied ''yes'' the longevity stays and will not affect the budget this year unless we gave everyone a pay cut. We would incorporate

that into the current pay. We should have a new policy manual by October 1st. we can go over that again.

Council Member Childs asked where we were in the budget? Are we balanced?

City Manager Rodriguez let him know that the City was in the positive $264,000.

:Mayor Pro-Tern Hodges asked "what we were projected to be last year?"

Finance Assistant Rodriguez replied "$391,000 is what got budgeted as contingency. "

Mayor Pro-Tern Hodges stated so were probably going to end up $600,000 to $700,000 in the positive?

Finance Director Smith said $500,000 to $700,000 just to be conservative right now.

Council Member Alexander asked if these amounts included any of the items they had discussed previously, for example the baylor?

City Manager Rodriguez let them know that this did not include anything for the landfill. The only thing that was included was extra for the driver if they got the truck from the county.

City Manager Rodriguez moved on to City Council. There was no change.

City Manager Rodriguez went on to City Hall. We did add maintenance for the van we didn't have anything for the van so we included a line. Information technology network is $40,000 that's for the transition to the schools network. They estimated $30,000 for the yearly assistance and $60,000 for the equipment and software that is needed.

Mayor Lannom asked if the City's web page was up and running again?

City Manager Rodriguez let the Mayor know that it was getting rebuilt and would be up and running any day now.

City Manager Rodriguez let them know that our equipment was outdated and there was no additional capacity on the server.

Council Member Alexander commented that the City hardly used the $40,000 this fiscal year so the school was going to update the software, hardware and purchase new servers with that money. Everything will be housed in the technology center so they could have access to the equipment and there is also more space.

Council Member Childs stated so it's $60,000 plus the $40,000 to do everything?

Council Member Alexander replied ''yes'' and we also need a minimum of 100 kilowatt backup generator.

City Manager Rodriguez stated that they had added money for a used vehicle for him.

Council Member Childs stated that the City Manager should be driving a new vehicle.

City Council was in agreement. They agreed with $35,000 for a vehicle for the city manager.

City Manger Rodriguez notified city council that they had set money aside for disaster p1an that needed to be put together.

Human Resources Director Corkrum stated that the last plan was revised in 2009. There is a federal standard training available.

City Manager Rodriguez moved on to City Secretary, no changes have been made.

City Manager Rodriguez did have some changes to the Finance Department that had been moved to city council.

Council Member Jackson suggested that they wait on the Municipal Court.

City Manager Rodriguez stated that they had also made changes to Human Resources, and moved the employee appreciation banquet from city manager to human resources.

Mayor Lannom asked if the police department wanted two more vehicles?

City Manager Rodriguez replied ''yes'', they also requested money for office supplies that would consist of awards for the officers. But we are also eliminating the Lieutenants position.

Council Member Alexander asked what the bottom line for the Police Department was?

Finance Assistant Rodriguez made adjustments, subtracting the insurance and the position they eliminated and the total for the poJice department was $76,000.

City Manager Rodriguez went on to the Street Department, there overall budget went down $90,000 and the two positions they were asking for were included.

City Manager Rodriguez moved on to Code Enforcement. There first change was special services, this was to see if city council was interested in providing funds for lot clean ups. We would contract someone to come in and clean up a lot when we cannot locate the owner or the lot owner is indigent

Council Member Childs asked what the city ordinance was?

Code Enforcement Director Oakley replied that the city could fine them if the owner did not get clean up the lot after they gave them a written notice, but some of the owners to these lots are either deceased or they don't live in town. If someone comes in and cleans up the lot at our expense, we can access a lean on the property that will have to be paid before the owner sales that property.

City Manager Rodriguez notified the council that he had giving the parks department copies of all city properties that needed to be worked on. Another change for ~ode enforcement is money for a vehicle.

City Council was in agreement to approve $15,000 for a vehicle.

City Manager Rodriguez went on to the Parks Department. That department went down $15,000 from last year, all equipment has been bought.

Council Member Jackson asked if they could start working on the City parks?

City Manager Rodriguez stated to city council that Doug had been helping with the irrigation of the parks. Sullivan Park's water lines are clogged up and cou1d not be watered at this time.

Council Member Jackson suggested that they flood it.

City Manager Rodriguez moved onto the Cemetery Department. That department dropped an estimated $25,000. There is a broken main that they are trying to fix.

City Manager Rodriguez stated that the Maintenance Department added a line for oil, lube, and coolant supplies.

Mayor Lannom asked if they did routine maintenance on the vehicles?

City Manager Rodriguez replied ''yes'' there are two vehicles.

Council Member Childs asked what the training line was for? What kind of training?

City Manager Rodriguez stated that it was for ASC certifications that are specific to a diesel engine and transmission.

Council Member Alexander asked about the equipment line?

City Manager Rodriguez stated that it included a balancing machine. We do not have one so they are getting sent to the local tire shops to get balanced. He had requested funding for a lift but he had funding left this fiscal year so he is in the process of purchasing it.

City Manager Rodriguez moved on to the Water Department that department also went down an estimated $60,000 from last year's budget.

City Manager Rodriguez moved on to the RO plant. There budget went down $6,000 but they are requesting some lab equipment and a small tractor.

City Manager Rodriguez went on to Utility Administration we covered a little bit on the vehic1e for the meter readers.

City Manager Rodriguez moved on to the Sewer Department. That department went up a bit but it also incorporates another position. That will cover preventative maintenance on the sewer lines. One crew would only handle the plans and the second crew would make daily rounds on all the problem areas. Hiring that extra person would give us the two crews again and they would be able to start up on preventative maintenance again.

City Manager Rodriguez went on to the Gas Department. That went down mainly because of the lower gas rates that also lowered gas purchases.

Mayor Pro-Tern Hodges wants to go with the automated deal now rather than later.

City Manager Rodriguez moved to Sanitation. In that department we are adding office supplies. Once the City moves the network to the school system they will be able to bring in there Route Software online. This is to provide them with a computer and printer that they will need. The budget also showed the lease for the recycle truck, that's where the extra driver comes in. If the county gives a truck we have a driver but if they -do not give us a truck then we will not need that position.

City Manager Rodriguez moved on to lIB 445 fund on road repair Finance Director Smith touched a little bit on the law changes for side walk repair. We did include a little bit of money for sidewalk maintenance and repairs mainly to the school sidewalks. They have to be existing sidewalks. The street

equipment lease is for the dump truck and we left that as a lease. lIB funds can be used on salaries, materials and/or equipment for road repair.

City Manager Rodriguez asked Finance Assistant to eliminate the $15,000 and to put it on the amended budget for the next meeting. He also covered the proposed Administrative Assistant that will assist the Supervisors with all their paper work. The Administrator would be at City Hall assisting with customer service and complaints.

Mayor Lannom asked "what is automation?"

City Manager Rodriguez replied "automation is for the scale and program for the trash truck drivers to weight themselves."

Council Member Ramirez asked how often the scale got calibrated?

City Manager Rodriguez replied that he would get those reports for them for the next meeting.

Council Member Jackson asked the City Manager to get a presentation on the baler together for our next council meeting.
