Editor’s NoteDear Patron,

The age of digital rumour mongering has well and truly arrived. In the aftermath of rumours which led to the exodus of north-east people fleeing cities across India, the marked increase in global violence and hatred over a trivial private video has laid waste to lives and livelihood of thousands of people across the globe. The widespread anger over the so-called denigrating video on Prophet Mohammed was unwarranted, given the fact that the video itself was done in poor taste by someone who had no idea on what Islam stands for and just needs to be scoffed off. Instead there was a mass frenzy more kindled by an overzealous media which sought to portray this issue totally out of proportion. For me personally, what was more surprising was the fact that none of the top echelons in the US came out openly criticising the video and showing their solidarity with the Islamic world. Just goes to show that no matter which country, politicians are of the same breed who uses such issues to provoke a situation that affects only the common man and plays into the hands of politicians for their personal gain.

On the economy part, true to his words, the Prime Minister has shown his resolve to push ahead with economic reforms which will propel the economy forward. The opening of retail for FDI will surely go a long way in bringing the next ‘Green Revolution’ in terms of making farming a lucrative business opportunity for the next generation of youngsters. Today, farming has all but lost its attractiveness as a profession. No youngster wants to become a ‘farmer’. The only way to make farming an attractive proposition would be to open up the sector for foreign investment with adequate safeguards and technology which will ensure we can be self-sufficient in food production in the years to come. It’s not too far when we will start to see the ‘Farm to Fork’ concept take shape in India.

Coming to this edition, our cover story focuses on the increasing menace of building violations which sadly affects the end-customer. Even banks turn a blind eye to blatant violations by builders keeping in mind only their commercial interest as against the interest of the buyer. In such circumstances, it becomes important for a buyer to be well informed to be able to identify such deficiencies and ensure his money is invested wisely. Starting this edition, we have introduced two new segments – Star Struck and DIY which should make interesting reading. Do let us know your feedback.

Move against land registration fraud

In the wake of increasing fraudulent registrations, state registration department has implemented a new

scheme to combat these cases. The inspector general of registration has recently issued a circular to all sub-registrar offices making compulsory, the submission of original patta or title deed of the land at the time of registration. Earlier, submitting the photocopy of the title deed was adequate for registering a document. Though the government has not issued an order in this regard, sub-registrar’s have been told to implement the directive from the department to curtail unlawful activities as public is affected by these fraudsters and are forced to run from pillar to post after buying land.

Residents of Chennai can soon look to relax in a more beautiful locality. Chennai is to be dotted

with more than 100 parks to be set up by the Corporation of Chennai in the city’s expanded areas. Under fire for allowing many parks to be razed for development projects, Mayor Saidai S Duraisamy in the budget announced the plan to create more ‘green lungs’ in the newly-included areas. There are 260 parks in the old corporation limits. While residents and environmentalists

welcomed the move, corporation officials said acquiring these lands was tough. A senior official said: “The spaces identified for the 100 parks in eight zones include small parks, Open Space Reservation (OSR) land and vacant places.”

According to the findings of CBRE's latest report titled India Logistics Market View, India witnessed

an increased market activity in 2012. Demand for logistic and warehousing spaces was not only limited to leading cities such as NCR (National Capital Region), Mumbai, Chennai and Bangalore, but was also spread across the leading tier II cities. Availability of large land parcels at relatively low cost, connectivity to multiple markets across states and industrial clusters, has led to the emergence of some tier-II and tier-III cities as favoured destinations for the development of logistics parks and warehouses. Rental values witnessed growth across most micro-markets due to higher demand for warehousing and logistics facilities. The coming months are likely to witness additional supplies across cities, which will positively impact transaction activity in these locations.Commenting on the findings of the report, Anshuman Magazine, Chairman and Managing Director of CBRE, South Asia Pvt. Ltd said, "The rising level of activity in logistics and warehousing space across metros as well as tier II cities is testimony to the growing confidence of domestic

and international retailers in India. Factors such as enhanced connectivity, implementation of various reforms and completion of major infrastructure projects are expected to further augment the logistics sector across India. Going forward, there will be significant reorganisation in warehousing industry & network planning by organisations in the country."FMCG majors, white goods and consumer electronics firms are also on an expansion spree and are steadily increasing their footprint across the country. Built-to-suit options have been the preferred mode of expansion for most occupiers, with large sized transactions of around 10,000 -15,000 sq ft of warehousing space being reported in the first half of 2012.

Increased demand for warehouses

According to OSR rules, buildings with more than 10,000 sqm of space are required to earmark 10 percent of the area as OSR land. The second master plan of the Chennai Metropolitan Development Authority shows that each Chennaiite has only 0.46 sqm of ‘green space’ against the 17 sq m of green space per resident in Bangalore. In Chennai, infrastructure projects, including metro rail, have claimed many parks. The corporation park in Ashok Nagar, Thiru-Vi-Ka Park in Shenoy Nagar; Nehru Park on Poonamallee High Road and May Day Park in Chintadripet are now closed for metro rail works. Corporation sources said tenders for the new parks, 19 in Valsaravakkam, nine in Madhavaram, 10 in Perungudi, 14 in Sholinganallur, 13 in Alandur, seven in Tiruvottiyur and six in Manali, would be floated soon. LIC Housing Finance, a subsidiary of Life Insurance Corporation of India (LIC) plans to

disburse around 8-10 percent of its total loan portfolio to developers by the end of this fiscal, a top company official said. "Presently, around 6 percent of our total loan portfolio constitutes of developer loan. We plan to increase it to 8-10 percent in the current financial year," told Director and Chief Executive Officer of LIC HF, V K Sharma. He, however, said the housing finance firm would not aggressively push this portfolio in this fiscal though there is an uptick in the loan disbursements to developers.

By the end of June quarter, LIC HF's outstanding loan portfolio was at around ` 65,650 crore, which was a 24 percent growth over the same period last year. While individual loans constituted 94-95 percent of the portfolio, developer loans comprised 5-6 percent of the total amount. Earlier, the housing finance

company had said that low developer loan portfolio had put margins under pressure and higher disbursals would increase the margin level. Sharma also said respite in interest rate is necessary to boost the overall housing finance industry and to reduce the cost of borrowing for the housing finance companies.

Despite the violence in the Suzuki plant at Manesar in July, the Japanese have no second

thoughts about investing in a multi-billion Chennai-Bangalore Industrial Corridor (CBIC), according to government sources, privy to several rounds of talks between Japanese diplomats and Indian officials on the issue. “They are going ahead with preparations for a comprehensive integrated master plan for the development of the CBIC, with the progress being regularly reviewed by TKA Nair, Adviser to Prime Minister Manmohan Singh,” the sources said. The idea has generated considerable enthusiasm in the South India. Andhra Pradesh has sought to be included in the project and sought the CBIC’s extension to the Krishnapatnam port. Karnataka wants the corridor to be

extended to Chitradurga and the State government has already commissioned a pre-feasibility study to set up a manufacturing city between Chitradurga and Tumkur. Although South India has become the hub of Information Technology and automotive sectors besides other industries, the sources said the Prime Minister was keen to put an ambitious project in the pipeline so that it could be operational after a decade. The plan currently includes a dedicated rail freight corridor besides solutions to address the private sector’s complaint of bad roads, poor access to ports and frequent blackouts. The key projects will include Phase II of the Chennai Outer Ring Road and the Chennai-Bangalore Expressway, the upgrade of airports in Chennai,

While NRI remittance grew 24 percent during the last quarter of 2011-12, as compared with 8.1 percent

during the same period in the 2010-11 fiscal, the demand for investment in real estate is inching high. Leading Chennai

developers have reported a quantum jump in the number of enquiries over a period of three to four months. There are others who feel that the preferred investment locations are OMR, ECR and parts of Velachery, as considerable development is visible in these areas. With the Gulf employment situation slowly stabilising, there has been renewed interest, which has resulted in the quantum of NRI enquiries (for investment in immovable property) in the city going up by 50 percent over the last year, according to Chennai developers. Interestingly, the demand from NRIs in USA has also increased considerably. Local funding at competitive lending rates, and loans for expatriates maintaining good credit history at zero percent interest rates, have nudged NRIs to take advantage of the current situation and plough back money into real estate back home.

Surge in NRI realty demand

The Indian unit of the world's largest chemicals company BASF, BASF India Ltd, is looking to set up a greenfield

facility in Chennai by 2015 to address the growing demand for emission control catalysts for the automotive sector. The decision comes against the backdrop of more cities coming under the Bharat Stage IV (BS IV) emission control norms by 2015, according to a company executive. Anticipating a growth in the number of vehicles needing to adhere to the new norms, the company plans to ramp up capacity with the capabilities to address the trucks market, which so far has not been under the norm. The company is on the lookout for land in the state for setting up the facility.The proposed facility would also have a testing facility which is part of a master plan in the long-term to test products developed in original vehicles and analyse their performance. Automotives like trucks do not require catalysts under the BS III norms prevailing across a large part of the country, at present. The greenfield facility is envisaged to be ready before April, 2015, when the BS IV norms become mandatory. However, the officials said details including investment had not been finalised. BASF Catalysts India Pvt Ltd, a part of BASF Ltd, has a facility at Maraimalai Nagar, in Chennai to cater to the emission control catalyst requirements of cars and two wheelers. It had almost doubled capacity in 2009. The existing facility had also gone through an expansion to cater to the needs of two-wheeler markets.

Even as nominal savings of households fell an estimated 2 percent year-on-year in the first half of 2012,

households have, in a departure from the ‘pervasive preference’ for gold seen in recent years, chosen to park their savings in bank deposits and property. A Morgan Stanley study shows that interestingly, the savings in equities have nearly doubled during this period, albeit on a low base. So far this year, returns from equities and gold have been more or less equal at about 13 percent with the returns from the Sensex slightly ahead. Earlier this week domestic gold prices hit a new high of `30,920 per 10 gm. Small savers have always been risk-averse in that they leave much of their surpluses with banks.

However, the rate of growth of bank deposits has slowed down sharply over the past six months — to around 15 percent — as real interest rates remain negative. The Reserve Bank of India noted in its annual report that household financial savings moderated to 7.8 percent of GDP in 2011-12 from 9.3 percent in the previous year and 12.2 percent before that. Morgan Stanley’s analysis shows that, in value terms, gold is down 11percent, bank deposits are up 7percent and property is up 37percent. Fixed income mutual fund flows remain positive, but are down 58percent y-o-y. Small savings have fallen 15percent, but new insurance premiums are up 8percent. “It appears that the physical asset of choice is property, not gold, unlike in the past two years, and the preference for yield and safety is declining at the margin, a shift from 2011,” it notes. The relative preference between financial and physical assets has also narrowed — financial savings are down 2.9percent, whereas physical savings are up 0.5percent in the first half of 2012 – the changes were 10percent and 48percent, respectively, in the first half of 2011. The RBI had pointed to high inflation as a cause for lower savings; it also felt slower urban job creation and income growth would have impacted the propensity to save.

Housing & Urban Development Corporation Ltd (HUDCO) has introduced home loans up to ` 25 lakh

for salaried individuals at a floating rate of interest of 10.20 percent. HUDCO home loan not only offers the low rate but also additional features such as free personal accident insurance, no charges before sanction, loan for the longest duration – 25 years and no pre-payment charges, said a press release from the corporation. This makes it a competitive product available in the major capital cities of India. The offer is also available for non- salaried individuals as a group. HUDCO is a Government of India-owned financial institution with the mandate to promote affordable housing. Since 1970 HUDCO has financed over 15 million dwelling units. HUDCO is the premier organisation in the country committed to the development of “affordable housing” and “housing for

economically weaker sections.” The one percent interest subsidy is also available for housing loans upto` 15 lakh with the cost of house not exceeding ` 25 lakh under the Interest Subvention Scheme of Government of India. HUDCO has a pan-India presence through its regional offices in State capitals. The HUDCO Niwas scheme will be operational in 20 Regional Offices of HUDCO, covering urban agglomeration of the concerned State Capitals. Hudco to offer housing loans for salaried

The Reserve Bank of India (RBI) on Tuesday asked banks to provide 1 percent interest subsidy for home loans up to `15 lakh. The

interest subvention scheme has been liberalised with effect from 2011-12 by extending it to housing loans up to `15 lakh where the cost of the house does not exceed `25 lakh, RBI said in a notification. The scheme has since been extended by government and will remain in force up to March 31, 2013, it said. A budgetary provision of R400 crore has been made under the scheme for the year 2012-13 by the government, it said. The limit of subsidy for an individual borrower would be ` 14,912 for a loan of `15 lakh, and ` 9,925 for a loan of `10 lakh. The extended scheme will benefit all housing loans availed in the current financial year. The National Housing Bank is the sole nodal agency for implementation of the scheme for banks, regional rural banks and housing finance companies.

Consultancy firms Jones Lang Lasalle and Cushman and Wakefield have expressed that the Government

move to allow 51 percent FDI in multi-brand retail will attract investments and change retail landscape. PankajRenjhen, Managing Director-Retail Services, Jones Lang LaSalle India, said, “The decision is a big step towards strengthening organised retail. The new regulations are going to change the retail landscape.” The Government has opened a gateway for foreign funding into the sector. There are still some apprehensions on its implementation due to caveats. However, it does signify a strong positive outlook for this sector, he said. The FDI will be a powerful catalyst for the growth of retail. In

the long term, this will prove beneficial to all the major stakeholders, he felt. Sanjay Dutt, Executive Managing Director, South Asia, Cushman& Wakefield, said: “The Government’s decision is a much-awaited and much-needed initiative. In a period when we are learning only about poor economic performance on various fronts, this decision will boost overall sentiment and the economy.” In a statement, he said, “Within the next 12-24 months, international retailers will accelerate their entry strategy. The developers involved in shopping centre development, who were badly hit since 2008, will also get a tremendous boost,” he said. Dutt further said, “We will witness serious players expanding in this space. Over the medium to long term, the

retail sector, real estate industry and the end-consumers will benefit from the move and the economy on the whole will gain momentum, depth and size.”

The definition for development ‘varies with the type of development envisaged- spatial, economic, social, etc. In urban

planning, spatial development is often given more emphasis and it is closely linked to social and economic development. Regulations are enforced as part of the planning strategy ‘to conserve and promote public health, safety convenience and general welfare of the people and to provide for the future growth and improvement of the area.’It is important for us to understand the types of development regulations adopted in India, the relevance of such regulations in the present context, the need for effective tie up between the different regulations, the extent to which the regulations can support and promote urban development, the role of existing planning organisations in enforcing the regulations, prevailing planning regulations applicable to Tamil Nadu in general and Chennai in particular and try to spell out the need for regulations in capturing private investments for public good. Development regulations include master plans, zonal plans, detailed development plans, regulations regarding land use, usage of buildings, coverage, Floor Area Ratio, set-backs, open spaces, height, number of storey, parking requirements, etc; for various developments on land, and for various categories of buildings.Town Planning Legislation and the municipal Building Bylaws are the main instruments based on which Development Control Regulations are being enforced. During the last 40-50 years general town planning, master plans, and detailed development plans have been prepared and implemented in many of the cities and towns in India. But the extent to which these plans and the regulations forming part of these have influenced in shaping our towns is a matter of debate. Several reasons can be attributed for the success / failure of urban planning. All urban plans in India are evolved from the basic British System of planning. The time taken for the preparation, publication, and implementation of the above plans within the framework of the existing Acts is so much that by the time the plan is sanctioned, it becomes redundant.

Relevance of zoning regulations In spite of the fact that master plans and detailed development plans have been notified for many of our cities, city centres are characterised by chaos , congestion, narrow roads, and dilapidated buildings without any parking spaces. In the case of

newly developed planned neighbourhoods we find that land use control has not been very effective, with the result that most of the residential buildings crop up haphazardly and even have become residential cum commercial. It is a common phenomenon that CBD gets extended into residential zones as the demand for higher order uses increases and as the market forces play a vital role in deciding the locations. Comparatively wider roads and availability of other infrastructural facilities attract commercial and other uses to these residential zones which in turn bring in more traffic and parking on roads. Laxity in enforcement of regulations can be cited as one of the major reasons. But can we ignore the economic benefit derived by the owner of the residence while letting out part of his house for a shop / office? Should we not consider the objections that will be raised by his law abiding neighbour? The responsibility of the institutions that control and regulate development should be to examine the use change to assess the infrastructural up gradation that such change would bring about and follow the process of public hearing before deciding on rezoning. Levying development charges for changes, which necessitate upgradation of services is one way of tapping private investment for public good. The whole process should be transparent and based on sound principles of planning.Rezoning is a rigorous and public process and hence not attempted at in many of our cities and towns. In the absence of this process, which allows permissible changes in zoning regulations, gross violations take place resulting in the degeneration of our planned areas. It is for the planning and enforcing authorities to decide on the maximum permissible variations in the existing zoning regulations and makes developers and owners pay for the upgradation of the infrastructure necessitated additionally. This is possible only where zoning regulations exist. There are situations, especially in old town areas where no regulations ever existed. The process of introducing regulations / development controls in such areas amounts to bringing such areas within urban renewal programs. Imposing regulations for promoting developments, where chaos and congestion prevail, will go a long way in bringing about orderliness. This would require detailed analysis of the existing situations, giving due consideration for the heritage precincts, and reconstitution of the plot boundaries using techniques like land assembly. Allowing vertical growth will provide much needed ground open space and parking spaces. Underground / multi

level parking lots are essential in most of our city centres as long as we rely on personalised vehicles. Pedestrianisation of certain areas within the urban core especially in places of heritage value can increase the flow of tourists.

Role of the Planning and development agencies in enforcing development controlThe 73rd and 74th Constitution Amendment Act has empowered the local bodies with sufficient powers to undertake planning and participatory development. The local bodies, viz. corporations, municipalities, and first grade panchayats, scrutinised the adherence to Building Bylaws, a task which they are ill equipped to handle. The Corporations and the Municipalities are geared to short-term goals. Planning and regulatory process if subjected to short run considerations, there is a danger of the whole process losing the focus. The technical capability of the local bodies has to be strengthened with planning professionals if the duties vested with them are to be carried out efficiently. The development regulations also used as a tool to encourage amalgamation of smaller sites into larger ones for achieving higher FSI with provision of adequate space around the buildings and space for recreational purposes within the site, and also to discourage over-utilisation of road and other infrastructure, resulting in congestion, traffic delay, and choking and also breaking down of water supply or sewerage or electricity infrastructures. Development standards prescribed for building constructions vary from country to country, region to region and city to city mainly for the reasons of local climatic conditions, public infrastructure availability/ planned, terrain, culture and way of life of the people, affordability of the people, and also the land availability for development.

Development RegulationsIn order to regulate developments, the areas have been designated as one of the 10 use zones listed in the Development Regulations. The developments in these use zones will be regulated in accordance with Development Regulations. Further in Chennai Metropolitan areas for buildings of special character such as multi storeyed building areas, continuous building areas, and economically weaker section areas are also designated in the plan. Ecologically sensitive areas zoned include CRZ (Coastal Regulatory Zone) areas, Aquifer recharge areas,

and catchment areas. MRTS influence areas; IT Corridor and areas around Airports are shown as areas of special character. Development prohibited area namely Pallikkaranai swamp area, area around Indian Air Force station are also clearly demarcated. The Chennai Metropolis is expected to become one of the Mega Cities in the world with more than 10 million population, in the next 10 years. The Chennai City Corporation with 176 sqkm area will accommodate about 59 lakh population while the rest of the Metropolitan Area with an extent of 1,013 sqkm will accommodate about 66 lakh population by 2026. For a balanced, planned development, a multipronged approach is recommended for adoption which includes regulation of developments through land use and development regulations, decongestion measures like shifting of certain traffic intensive wholesale activities from congested localities to planned areas, development of new town / satellite towns and formulation and implementation of integrated urban infrastructure development projects by the agencies concerned.Layout means division of land into plots exceeding eight in number. Regulations for layout include availability of road access with a minimum width of 23 feet and should be at least 30 metres (about 100 feet) from any nearby burial ground or crematorium. No subdivision or layout can be laid out or building for Residential, Commercial, Industrial or Institutional or any structure for occupation will be constructed within 500m from an existing live quarry or a crusher. If a quarry is claimed as abandoned, then a certificate from the local body or the licensing authority concerned to that effect shall be produced. Where use of a site or premises is specifically designated in the detailed development plan, it can be used only for the specificpurpose so designated, unless the land use of the site is varied. (c) Catchment area:Redhills and Puzhal lakes are the main sources of water supply to the Chennai city.In order to protect this water source from the negative impacts of the urbandevelopments contiguous areas in the catchments of these lakes have been declaredas 'Redhills catchments area'.

Classifaction of coastal Regulation Zone For regulating development activities, the coastal stretches within 500 metres of HighTide Line on the landward side is classified into four categories and the development or construction activities in different categories of CRZ area shallbe regulated in accordancewith the following norms:Category I (CRZ-I):No new construction shall be permitted in CRZ- I except(a) Projects relating to energy, ports, pipelines, wharves, radar installations etc.(b) Exploration and extraction of Oil and Natural Gas,(c) Salt harvesting or desalination plants etc.Category-II (CRZ-II):(i) Buildings are permitted only on the landward side of the existing road (or roads approved in the Coastal Zone Management Plan of the area) or on thelandward side of existing authorised structures. Buildings permitted on thelandward side of the existing and proposed roads/existing authorised structuresare subject to the existing local Town and Country Planning Regulationsincluding the existing norms of Floor Space Index/Floor Area Ratio. (ii) Reconstruction of the authorised buildings to be permitted subject to theexisting FSI/FAR norms and without change in the existing use.Category-III (CRZ-III):(i) The area upto 200 metres from the High Tide Line is to be earmarked as ‘NoDevelopment Zone’ provided that such area does not fall within any notifiedport limits or any notified Special Economic Zone. Building permission for such construction/reconstruction will be subject tothe conditions that the total number of dwelling units shall not be more thantwice the number of existing units; total covered area on all floors shall notexceed 33 percent of the plot size; the overall height of construction shall notexceed 9 metres and construction shall not be more than 2 floors ground floorplus one floor. Category-IV (CRZ-IV):Applicable to specific areas in and around Andaman and Nicobar islands and Lakshadweep.

Regulation for Development in the Aquifer Recharge Area Aquifer recharge area that serve as oneof the major sources for city water supply has been declared as aquifer recharge arearestricted for development. Details of villages covered in the aquifer recharge area are given below: (i) Kottivakkam(ii) Palavakkam(iii) Neelankarai(iv) Okkiamthuraipakkam(v) Injambakkam(vi) Karapakkam(vii) Sholinganallur(viii) UthandiIn the Restricted Development Zone, Ordinary residential and commercial buildings,institutional and other non-Multi Storeyed Buildings shall be permitted only for the following purposes and accessory uses.(i) Any ordinary residential building including dwelling, detached, semi-detached, tenements or flats and service apartments.(ii) Professional consulting offices and incidental uses thereto occupying a floor area not exceeding 40 sq.m. and G+1 floors in height(iii) Schools or Institutions not exceeding 100 sq.m.in floor area and G+1 floors in height(iv) Petty shops occupying a floor area notexceeding 40 sq.m. and G+1 floors in height(v) Nursery schools, Primary Schools, High Schools, Higher Secondary Schools,Libraries and reading rooms.

(vi) Parks, play grounds, farms, gardens, nurseries, including incidental buildings thereon

Unapproved Layouts“Half of the nearly 14 lakh sale deeds registered annually in the State involve residential plots in unauthorised and unapproved layouts,” observe senior officials of the Registration Department. This is an indication of the rapid proliferation of unapproved residential layouts and active sale of plots within them. In order to discourage this , government of Tamil Nadu had amended the Registration Act in 2009 to refuse registration of such plots, but it has not yet been implemented. These layouts do not provide mandated space for formation of wide roads, parks, playgrounds and other crucial social infrastructure in newly developing areas. This has also led to the loss of income to the government, more profit for unauthorised layout promoters and higher expenses for residents in future. As per Government records more than 50 percent of all buildings in Chennai have violated building rules. Over the years, instead of coming up with a corrective action, the government has been legitimising unauthorised constructions which has encouraged more blatant violations. Only recently did the CMDA have reconstituted the enforcement cell. It has created two divisions exclusively for issue of completion certificate and two divisions for pursuing enforcement action. The enforcement action wing will handle locking and sealing,

forfeiture of security deposit and demolitions as well. The government amended the Town and Country Planning Act in 1998 and regularised illegal constructions completed before 1998. The statement of objects and reasons, which accompanied the amendment, admitted that about three lakh buildings in Chennai have violated rules. The government said that it would be administratively difficult to penalise them, and wanted the violations to be condoned. The fines proposed would deter future violations, the government explained.When this amendment was legally challenged, the Supreme Court permitted it, but only as a ‘one-time measure.’ This meant: no more casual attitude to enforcing building rules and no more regularisation schemes. The Court emphasised that the government should check violations at the beginning stage itself. The State assured the Court that it would. However, not only did it fail to check the

proliferation of unauthorised constructions, it repeatedly extended regularisation schemes in 2000, 2001, 2002 and 2007. An ordinance aimed at controlling and regulating unauthorised developments throughout the State has been promulgated to amend the Town and Country Planning Act. This was a logical conclusion of the process initiated with the formation of a committee, headed by former Supreme Court Judge S. Mohan. Constituted in June 2007 to review the Act, the Mohan Committee submitted its report in July 2010 to the government. It had suggested amendments for effective enforcement action and providing “limited solution” to the unauthorised developments made prior to July 1, 2007. Through the ordinance, several sections of the Act have been amended, apart from the insertion of a section – 113 C. The amendment of the sections was essentially meant for revising the amounts of fine.The new section seeks to give exemption to buildings developed on or before July 1, 2007 by collecting an amount not exceeding three times the guideline value of the land. It provides for prescribing different rates for different parts of the planning area. Through a revised Schedule to the Act, the government also revised the amounts of penalty for various offences. An amount of ` 5,000 had been fixed for failure to apply for permission and get permission; it also confers power to require the removal of unauthorised development and stop unauthorised development. A sum of ` 10,000 was fixed for three types of offences – erection of building or change in use of land without permission; failure to comply to pay development charges and obstruction to the exercise of the power of entry by the government servants while ` 7,500 was determined for failure to use and develop the land in conformity with the development plan. A new subsection (Sec 113-C) has been proposed. It will allow the government to “exempt any building developed on or before July 1, 2007, from any provisions of this Act or any rule or regulation made there under.” Detailed guidelines for implementing the exemptions and the penalty charges to be collected have also been suggested.As against the fixed regularisation fee currently in force, the Justice Mohan Committee has proposed a penalty in proportion to the guideline value of the land, “as prevalent on the date of application.”For example, an application made in 2002 to regularise 100 square metre unauthorised area in a multi-storey commercial building on 10thMain Road Anna Nagar, the penalty would

be about ` 8.95 lakh (the guideline value for land in 2002 was ` 13,760 per square metre) as against the existing regularisation fee of ` 10 lakh (` 10,000 per square metre).For residential buildings not exceeding 300 square metres, the committee has recommended that the penalty charges should not exceed 50 percent of what is levied for other categories of building.Suggestions have also been made that the extent of violation that can be regularised with respect to Floor Space Index should not exceed 50 percent of the permissible limit and fire safety. Structural conditions should be considered before buildings are regularised.The proposed amendments, when implemented, will be applicable to all buildings in the State, unlike the ordinance that is limited to the Chennai Metropolitan Area.Starting this year, Chennai Corporation will follow new steps to ensure building plans are not violated. Every approved plan copy should have a record of the name of the divisional Assistant Engineer/Junior Engineer. According to Chennai Corporation, the owner would have to inform the divisional AE/JE at the ward office as soon as the foundation is completed. The failure to do so on the part of the building owner or builder will lead to temporary suspension of building plan permit, which would also be recorded on the approved plan. An acknowledgement letter would be issued to the applicant by the AE/JE after the intimation from the building owner or builder is received. The AE/JE would inspect the site within 10 working days to ensure that the foundation is laid as per the dimensions of the approved

plan. If the AE/JE fails to inspect the site within 10 working days, the house owner shall continue the work of construction. If the dimension of the foundation is in violation to the building plan, stop work notice would immediately be issued and rectification would have to be carried out by the building owner or the builder. If the construction is in accordance with the approved plan, the AE/JE would fill up a form at the site itself and hand it over to the building owner/site in-charge, to indicate that the foundation is in line with the approved plan.This procedure would in no way supersede the general instructions and rules for constructions and if there is any gross violation after the foundation stage, suitable action would be taken within the existing legal provisions. The civic body has the responsibility of processing planning permission application for ordinary buildings, which have stilt plus two floors or ground floor plus first floor not exceeding six dwelling units in case of residential buildings and not more than 300 sq. m. in case of commercial buildings. The sanction is given by the zonal executive engineer in accordance with the delegation of powers issued by the member secretary of CMDA.The new procedure is aimed at speeding the enforcement action against violations. It is high time the potentials of theDevelopment Authorities should be utilised andMetropolitan Planning Committees are to beconstituted as envisaged. The ULBsand the Development Authority have to work hand in hand to enforce the regulations in orderto achieve the results of planning. Development Control Regulations are enforcedwith a view to improve the welfare of the people.It is necessary to make the whole system of planformulation and implementation more dynamicand responsive to changes. For this, the planninglegislation will have to be modified updated andmade more citizens friendly. Taking into accountthe rapid urbanisation, globalisation, increase inland values, and change in life styles, the land useproposals may have to be more flexible. Amechanism has to be evolved for tapping theprivate benefits for public good, making use ofplanning regulations. There is need for evolvingspecial regulations for urban core arearejuvenation, for Heritage zones and for coastaland island zones in Chennai. Development authorities, who were created toundertake model schemes and long termplanning, can still play a vital role in planning andregulating urban development if they work handin hand with the local bodies. Regulations are only means to an end,the ultimate aim being the enhancement in the Quality of Life.

Another door, and this one leads us into this one-of-a-kind boutique. The warmly

lit corridor leads to smaller rooms, each containing a treasure trove of its own – jewellery (ethnic, junk and contemporary), collectibles, beautifully embroidered tunics and kalamkari kurtas in muted tones. However, it is their home furniture

segment which impresses, merely because of the emphasis on detailing, attention to art and a customised service to match.

Rushmi, the designer, initiates us into the creative process. “Our

interiors segment enjoys a strong client base. We have furniture and

furnishings customised to requirements. Depending on the client’s preference

of colours and design, we offer them a few options. Most clients usually know what they want

and tell us their preferences and tastes. We usually try and work around that,” reveals Rushmi, taking us through different home accessories. White square cushions with a colourful parrot

in blazing red alternated those of quiet green with patches of brown floral embroidery.

Asharaa makes the most of its space with an eclectic infused blend of ethnic elements and contemporary influences for an expression like no other. Tuba Raqshan discovers more, browsing through hardbound notebooks

A Contemporary Statement

Conversation startersThe eye goes to the statement mirror on the wall, resembling a flower, each wooden panel making up a petal with the mirror as its core. On its edges runs a golden line, adding a touch of opulence in the midst of a Zen like minimalism. “We have our own embroidery unit and do a lot of customisation for clients, based on their colour and design choices. We also do a lot of screen printing and wall stencilling, even on ceilings. There are a wide range of patterns and designs available,” she avers, showing us through a series of curtains, some in sheer fabric and others in plush velvets or gorgeous brocades, elegantly draped over the doorway.

Cut on metalBut, Asharaa’s trump card is their emphasis on the metal cutwork inspired elements – right from coasters to conversation pieces. Rushmi explains, “There is a lot of scope for metal cutwork in home décor. It is usually used in vases but we interpret them in different ways. We have metal cutwork in coasters, wall patterns and furniture which is usually a conversation piece.” There are also bouts of experimentation and the result of which is a table with a movable rectangular panel encased with metal overlay. Asharaa’s design philosophy occupies that space between eclectic and practical. “We work around our clients because they have to live in that space. Usually, clients have two extremely different views. It is up to us to redefine it and bring it into a workable format. We do suggest masterpieces, only if our clients request us to. Currently, the trend is to go minimalistic with a touch of modernism. Beyond that, it differs from client to client,” concludes Rushmi.

Director Balsingh George in an interview with Shilpa CB

What unique aspects would you like buyers to be familiar with?We are indentified for best-in-class products and services. We have given a swimming pool, gymnasium and teak wood joineree (doors and windows) in a project where the price per apartment was less than ` 10 lakh. Even there we did not move from what we stand for. 26 years of litigation-free business is a rarity in real estate business. We’ve never had any litigation in all these years. That distinction very few people can lay claim to. We can confidently walk into any project delivered 15—20 years ago and we are sure to be greeted well.We are also known for ever-improving quality. We are definitely not a company that believes that we’ve learnt it all. Our philosophy is that we can learn from anybody and any day. We just strive to get better with each project. I am convinced that a builder is only as good as his last project.

You also talk about redefining luxury. What exactly do you mean by that?In my grandfather’s house – he was a very resourceful man – there was only one air-conditioner. The house was very large for the single air-conditioner. As opposed to that, my daughter will call 20 minutes before she reaches home and ask for the air-conditioner to be switched on. Luxury is something which keeps moving, it’s a moving target. If you read our brochures, we have said ‘Yesterday’s luxury is today’s necessity’. What we know as a moving target, we keep improving on that and that is why we say ‘Redefining Luxury’. What we thought luxury standard two years ago, that is today a necessity. So we keep raising the bar.

What would you call are the luxuries of today?The house itself is limited to one’s purchase power. What comes inside a project even for a very small flat is where

the luxury quotient comes in. As you saw, our swimming pool is 36 metres long. That could have been 10 metres long. We have chosen to build a pool as large as large as possible. I would have loved to make it a 50 metre pool but because of space constraints we had to limit it to 36 metres. You take our gymnasiums, it will have better equipment than most gyms in the city. You can buy a treadmill for ` 30,000. We will be buying ours for at least ` 5 lakh. That’s the kind of difference there is. The amenities at Golden Opulence is available at other projects, too but the facilities we have are far superior compared to those projects. If you take Golden Opulence, the huge pool is flanked by large banquet halls. If you rent out the pool and the halls, you can have a wedding ceremony and celebration there.

How integral to luxury is location? I like Poonamallee High Road because I’ve lived on that side. Someone who

lives in Adyar might not find Poonamallee appealing. Location cannot be identified with luxury. Location is not an indicator to luxury. It never was. I went into somebody’s building on Khader Nawaz Khan Road. Most expensive piece of real estate today is on that road. They have acute water shortage. What kind of luxury is that if there is no adequate water? I am saying that the location does not spell luxury. What comes with the building, irrespective of whether it is on Boatclub, OMR or GST road makes it luxurious.

Could you tell us a bit of the best practices that you’ve followed that have helped you complete 125 projects in the last 26 years? Any lessons for aspiring builders you would like to share?Don’t talk too much. Stick by what you say. I am a man who thinks I’ve done a lot of mistakes. I am not going to encourage anyone to model himself after me. I am still learning.

What challenges have you overcome in the long journey?There have been a lot. On the business front, everybody goes through problems, I have also gone through my share

of problems. If a business house is complaining about government policy… well everybody is suffering because of the same policy. If it bothers you too much then you will have to choose between being in business and opting out.

What advantages have you seen doing business in Chennai?I was born and raised here. This is my home. There is a comfort factor. I have ‘home advantage’. But that’s not how business can be planned or perceived. There are people who live outside India who do business here. However, this point in time, I am not looking at business outside Chennai. The market is more stable compared to the neighbouring big cities. A very high percentage of buyers are end users.

Which locations are you planning your future projects in? You have also mentioned that you have bought land for them?We have assets predominantly on Poonamallee High Road and off Poonamallee High Road. It’s not like I don’t want to buy elsewhere. I am still trying to buy in South Madras.

With land becoming scarcer, have builders become more competitive?Land is available in plenty but the terms that are attached by the owners are unrealistic. If the pricing is right, then there is something wrong with the property. Land purchase is the biggest winner.

Are there any well-thought out strategies in terms of resource allocation, planning etc?At this point in time, we are doing alright with our funds. We have a few ongoing projects. Our Chembrambakkam project will also be launched soon. The land is owned by us. We are not paying interest on borrowings.

The 2BHK at Golden Opulence is about 690 sqft. What trends are you seeing in the kinds of apartments people are buying? The Chennai buyers want two-bedroom, even if the rooms are very small, they want two bedrooms. A single-bedroom flat, according to me, is a bit of a challenge to sell, as opposed to buyers in Bengaluru and Mumbai. Yes, I know there are a lot of builders coming up with one-bedroom flats. But this is my view. I could be wrong.

Your new project Golden Opulence has 29 sizes. Why this variety?You take a two-bedroom, two toilet apartment there are four sizes in that. We wanted two and three bedroom combination in each block. We did not want to isolate the different sizes in separate towers.

What kind of developments do you see happening in the old parts of the city?It could go from bad to worse. The population multiplication is the first problem. They will become redundant. For instance, do you know what’s behind central station? That is the older part of Madras which is forgotten. Most people are not familiar with it. They will draw a blank if asked about a few streets in George Town. A 40-year-

old person will not know the names of the famous streets. I don’t see a huge change in the façade of these old, congested places. I don’t see that skyline changing at all. There is no scope for development there, unless you buy a whole street and develop. Eventually, you will detach from these parts. I don’t go to Mount Road which I used to frequent when I was a student at school and college. People will move to places that are convenient to their livelihoods.

I am not saying Poonamallee is the beginning and end of Chennai. If you live in OMR and work in OMR or if you live in Poonamallee and work in that direction why would you come into Nungambakkam. What for?The rules don’t permit huge development, first of all. Affordability is another factor. Large housing development inside the city cannot be marketed. We are in the process of redeveloping housing board flats which are under 25 years. Each compound has about 48 flats, 60 flats. They approach a builder and the whole building is cleared. We have one such project running in Anna Nagar.

What locations would you suggest to an investor?

Some place where growth is happening. The IT corridor is good. But it is purely dependent on one industry. If you are located in a place where multiple industries are accessible that will offer high returns.

Are you a first-generation entrepreneur? Tell us about

what drew you into this line of work?I am not a first generation entrepreneur. My grandfather ran a business of tile and brick manufacturing. But I started this company. It was just blind faith that housing had to do well that encouraged me to get into this line of work. I won’t say that I had a major strategy planned before I came in. I had an uncle who was doing well in this business. That inspired me to take it up.

In the primary marketThe primary residential market comprises of projects under construction where you deal directly with the developer. If you are buying a flat under construction, there are a number of

charges apart from its basic cost. Loan processing fees: While taking your house on a loan, the processing fee and documentation charges are the first costs that you will encounter. “These charges can be a flat fee of ` 7,000-10,000 or upto 1 percent of the loan value depending upon the financial institution,” says Paramasivam, a Chennai-based Real Estate consultant. Service tax: According to the government order, buying an immovable property under construction attracts a service tax of 12.36 percent on 25 or 33 percent of the gross value of the property. Your developer will add this service

tax to your bill. However, some developers include this in the total cost of the loan value. Infrastructure charges: These are mandatory charges meant for the development and maintenance of the infrastructure around a project. Though this costs only ` 37.50 per sqft, some developers charge anywhere between ` 50 to ` 100 per sqft depending on the city.Preferential location charges (PLC): Based on the location of your apartment, you will have to pay PLC depending on the size, alignment, floor height and the rate of the flat. The amount of PLC varies between different developers and projects, and may range between ` 25-100 per sqft. There is no regulatory framework or standard rules that govern the laws relating to PLC. Utility charges: The developer will also add costs associated with the building. These include firefighting charges, electrification charges, club-membership fee, parking fee, development charges and an annual maintenance deposit. In addition, studies have shown that natural sunlight can be mood-enhancing and good for your health. The concept was rediscovered and patented in 1986 by Solatube International of Australia. This system has been marketed for widespread residential and commercial use. Other day lighting products are on the market under various generic names, such as 'SunScope', 'solar pipe', 'light pipe', 'light tube' and 'tubular skylight'. West- and east-facing glass can have nearly five times the solar heat gain of north-facing glass and more than triple that of south-facing glass. Although the amount of radiant heat at west and east exposures is the same, west is most important to protect because it occurs during the hottest time of the day.Strategies for increasing the amount of natural light in any building include adding windows, traditional skylights, or tubular skylights. Although including windows and traditional skylights at the design stage can be cost-effective, incorporating them during remodeling can get expensive. Installing additional windows or traditional skylights typically involves siding, framing, insulation, and drywall repairs. Even in new construction, installing a traditional skylight will cost two to three times as much as installing a tubular skylight when you figure in all the different trades affected. Get Help

The first thing that you have to do is to check the title of the property. You need to ask for copies of all the seller's title deeds and

other relevant documents going back to 33 years. Although it will suffice if you check the title deeds going back to 12 years, it is always better to go back to at least 33 years. There is some significance in these time periods. These periods of time pertain to the duration after which the title comes to a valid rest in a person. The next question is: What are 'title deeds' and 'other relevant documents'? Title deeds are all documents which pertain to the property in question, and which embody the flow of the title from one owner to the next. Examples of title deeds are: Sale Deeds, Settlement Deeds, Gift Deeds, Wills, Decrees of Court, Government Grants, Release Deeds, Partition Deeds and the like. Other relevant documents pertain to a particular property which have some bearing upon the title in question. Examples of these include: Mortgage Deeds, Lease Deeds, Encumbrance Certificates and the like. To this list, a document known as a Patta should also be added. This is an important document issued by the revenue authorities although it is not a document of title (except in certain cases, where the patta is

issued under certain statutes in recognition of a pre-existing right). Once you have all the title deeds and other relevant documents together, you need to arrange them chronologically keeping the encumbrance certificates separately. After arranging the documents, check the schedule of the property. This is normally found at the end of the document. Sometimes, there is more than one schedule to a document (for example, in a Partition Deed, where each of the persons partitioning the erstwhile joint property amongst themselves will have a separate schedule describing the property allotted to that respective person). In such a case, you will need to read through the body of the document to check which schedule is the one that describes the property with which you are concerned. The schedule of a property will help you to identify it by giving you the name of the sub-registrar's office under whose jurisdiction the property is located, the name of the village/locality, the survey number within which the property is located, the extent of area of the property in question, and the boundaries of the property. Some schedules of property may give you more details and some less. There is no hard and fast rule in such matters. What is important

is that the schedule should be of sufficient specificity to enable you to identify the property in question with pinpoint accuracy. However, there are some minor difficulties in this. Sometimes, when you are dealing with old documents, you will find that with time, the boundaries would have changed, survey numbers would have been either sub-divided or re-numbered and so on. In such a case, you will have to ask for the necessary documents or other linking ones to establish the unbroken connection between the earlier document in the chronological order and the immediate succeeding one. Sometimes, a person would have acquired the property under one document, held it during his lifetime and died without leaving a will, wile his heirs would have executed the next succeeding document of title. In such a case, you will have to ask for and check the legal heirship certificate or other such proof that is available to show that all the legal heirs of the previous holder have joined in the execution of the next document. If all the links exist in a clean manner, and the property you are interested in is transferred from holder to holder in an unbroken chain upto your present seller, then you can move on to the next step. If not, then you will have to ask your seller to provide the bridging documents or other proof. Otherwise, you will find yourself in a dilemma with your seller on one hand trying to desperately downplay the extent of discrepancy, and your mind on the other, terrified of making a costly mistake. In such cases or when you are in doubt, it is advisable to contact your lawyer who will be able to guide you.
