No form or applicaon process is needed - - our team will take care of the paperwork. Connuing educaon is important in all professions, and I will ensure that it gets done, but I believe that granng this extension is in the best interest of our state. "Hurricane Irma was a storm unlike anything we've seen before, and it impacted much of our great state.Recovery efforts are already under way, and every available local, state and federal resource is workingcollabora�vely to help Floridians get back on their feet quickly.

This month, I traveled the state in tandem with Florida's fireservice personnel, and I could not be prouder of the lifesavingwork I've seen firsthand. These men and women are workingaround the clock to bring families to safety, far a�er the stormhas passed.

Our State Fire Marshal unit serves as the lead agency for Florida'sfirefigh�ng and urban search and rescue emergency supportfunc�ons, and they have done a phenomenal job of coordina�ngassets from across Florida and the en�re United States. From New York to California, Louisiana and Tennessee,law enforcement teams have sent their search and rescue teams to join Florida's efforts, and we appreciatetheir robust support.

With two category 4 hurricanes hi�ng the American mainland in such quick succession, we are in anunprecedented recovery situa�on. It will take �me, but Florida will recover and be stronger than ever.

CONSUMER ALERT: Managing the Post-Storm Insurance Claims Filing ProcessAs Hurricane Irma continues to impact Florida, residentsaffected by the storm will soon begin the process of surveyingdamages to their property and belongings. Chief FinancialOfficer Jimmy Patronis and Insurance Commissioner DavidAltmaier have the following tips to help consumers as theybegin the process of filing insurance claims on damagedproperty and belongings:

Tip 1: Locate all applicable insurance policies. This mayinclude a homeowners’ policy, flood policy (flood coverage is

CFO Patronis said, “Florida’s decade-longhurricane-free streak offered the insuranceindustry years to prepare, to build reserves, andto update technology. Florida’s policyholders fullyexpect that the insurance companies they entrustto protect their homes will be there during theirtime of need, and we’ll do everything possible toprotect Florida’s policyholders throughout theentire post-storm process.”

Insurance Commissioner Altmaier said,“Consumer protection is our number one priorityas Hurricane Irma bears down on Florida. TheOffice is dedicated to constantly monitoring thefinancial health of insurers, and in the comingdays, we will be available around the clock toaddress any insurer issues.”

Nearly 50 insurance company representativeswere invited to participate in the call. Topicsincluded: post-storm claims reporting, theavailability of insurance adjusters, andhomeowners’ abilities to file claims whentraditional communication lines are down.

CFO Patronis confirmed that there are nearly200,000 individuals currently licensed to adjusthurricane damage claims in Florida. Insurancecompanies can appoint (contract with) theseadjusters to ensure adequate post-stormavailability. CFO Patronis stressed that insurancecompanies must be prepared and have anappropriate number of adjusters on staff to meetconsumers’ post-storm needs.

Following the full impact of Hurricane Irma,insurance companies will be required to report

not covered under a typical homeowners’ policy and isseparate coverage) and an automobile policy (may coverdamage to your car from flooding).

Tip 2: Document all damaged property and belongings. Takephotos or shoot video footage before attempting anytemporary repairs. When you file an insurance claim, you maybe asked for visual documentation of damages. Aphotographic home inventory is a handy resource for thissituation. A free smartphone app developed by the NationalAssociation of Insurance Commissioners called “MyHomeScr.APP.book” can help you take and store a room-by-roomlog of photos.

Tip 3: Contact your insurance company or insurance agent assoon as possible to report damages. Insurance policiesrequire prompt reporting of claims, so it is important to act assoon as possible. If you need help finding your propertyinsurance company’s website and contact information, clickhere. For a list of licensed insurance agents in Florida, clickhere.

Tip 4: Cover damaged areas that may be exposed to theelements in order to prevent further damage. Your insurancecompany may reimburse the expense of these temporaryrepairs, so keep all receipts. Remove water-logged andotherwise damaged items from your house to prevent thespread of mold, but document them and do not dispose of anydamaged property until your insurance company adjuster hashad an opportunity to survey it.

While there’s nothing that can undothis disgraceful disaster, steps can and should be taken toensure that it never happens again. 'Our office is working quickly to develop a thorough statewideinspection plan, as the emergency rules require. remain in contact with your insurance

company regarding any outside vendors that

are brought in to make repairs. If you need

help locating contact information for your

While making temporary repairs, obtain the

licensing or training credentials of all third-

party vendors before signing any work

agreements. Beware of fly-by-night repair

companies and hire only licensed and

reputable vendors. Use the Department of

Contractor License lookup to make sure all

contractors are properly licensed and

Fully review all documentation you are

asked to sign and ask questions to make

sure you understand the agreements you

#AfterIrmaChief Financial Officer Jimmy Patronis warned Floridians ofscammers looking to take advantage of those impacted byHurricane Irma. Floridians should be vigilant in verifying theidentity of those claiming to represent government and reliefagencies, and should ask questions to fully understand allcontracts with insurance and repair companies.

CFO Patronis said, "As Florida continues the recoveryprocess following Hurricane Irma, I urge all consumers to bescam smart and on the lookout for opportunistic scammerswho try to prey on vulnerable people during this time.Regrettably, there are individuals who will attempt to takeadvantage of our fellow Floridians.”

Below are tips to help protect Floridians from scams:

• Ensure you understand all documents a contractorrequests you to sign, including assignment of benefitsagreements. Ask questions until you fully understand who isresponsible for payment.

• Verify the identity of individuals claiming to representgovernment and relief agencies or insurance companies.Official personnel should display their ID badges, shouldprovide identification without hesitation upon request, andsay why they are in the area (i.e. surveying damage,assisting residents, etc.). If you suspect that someone isimpersonating official personnel, contact the local policedepartment or sheriff’s office immediately.

o Beware of imposters going door-to-door claiming to beFEMA representatives, asking for money to assist with thefiling of federal flood claims. FEMA does not charge for thisservice and does not go door-to-door in this capacity.

o Beware of robocalls from imposters claiming to representFEMA, asking consumers to hang up and dial a 1-800number to make an insurance payment ASAP to preventpolicy cancellations.

Among otherprovisions, the Order provides an additional 90 days topolicyholders to supply information to their insurancecompany; prohibits insurance companies from canceling ornon-renewing policies covering residential propertiesdamaged by the hurricane for at least 90 days; and freezesany and all efforts to increase rates on policyholders for 90days. Office Statement on Annual Workers’ Compensation Rate FilingThe Office of Insurance Regulation has received the 2018 Florida workers’ compensation rate filing by theNational Council on Compensation Insurance (NCCI), which proposes a statewide average premium decrease of9.6%. This includes a statewide average rate decrease of 9.3% and a reduction of the fixed expense costapplicable to every workers’ compensation policy in Florida from $200 to $160. The new rates would becomeeffective January 1, 2018.

On September 4, 2017, GovernorRick Sco� signed Execu�ve Order17-235, declaring a state ofemergency for the declaring astate of emergency for the en�reState of Florida. Asof today, the Governor has notli�ed the state of emergency.

The five daycancella�on periodapplies to only thosecontracts related todamages from thisrecent heavy weatherevent.

Subparagraph (11)(b)1states that a publicadjuster may notcharge, agree to, oraccept anycompensa�on,payment, commission,fee, or other thing ofvalue in excess of tenpercent of the amountof insurance claimpayments made bythe insurer for claimsbased on events thatare the subject of adeclara�on of a stateof emergency by theGovernor. Thisprovision applies toclaims made duringthe year a�er thedeclara�on ofemergency.

FinCEN Issues Advisory on the FATF-Iden�fied Jurisdic�ons with AML/CFTDeficiencies (UPDATE: September 15, 2017)

The Financial Crimes Enforcement Network (FinCEN) today issued an advisory to financial ins�tu�onsregarding the Financial Ac�on Task Force’s (FATF) updated list of jurisdic�ons with strategic an�-moneylaundering/counter-terrorist financing (AML/CFT) deficiencies. These changes may affect U.S. financialins�tu�ons’ obliga�ons and risk-based approaches regarding relevant jurisdic�ons. Big data is big business. But it canalso lead to bigger headaches whenlarge-scale breaches expose personalinforma�on. What's in your wallet?

If your purse or wallet is stolen, yourdriver's license could easily be sold tosomeone who resembles you. Once aperson has your driver's license it iseasy to obtain other forms ofiden�fica�on in your name. Yoursocial security number is the mostimportant piece of informa�on abank needs when extending credit oropening an account. Social securitynumbers are also used to obtainmedical care, file a fraudulent taxreturn, commit crimes or steal yoursocial security benefits.

What to do if you think yourinforma�on has been compromised

Stay calm, but monitor your personalfinancial informa�on closely. You shouldlook out for suspicious account ac�vityor anyone asking to collect sensi�veinforma�on. This includes usernames,passwords and credit card informa�on(referred to as phishing). It is importantto take ac�on immediately to protectyourself.

To be safe, freeze your credit with thethree major credit repor�ng agencies(Equifax, Experian and TransUnion) ifyou suspect your iden�ty has beencompromised. This allows you to restrictaccess to your credit report, making itmore difficult for iden�ty thieves toopen new accounts in your name. Besure to protect the informa�on of yourfamily as well – including children andelderly parents. For more informa�onabout a credit freeze, visit the FederalTrade Commission's ConsumerInforma�on Credit Freeze FAQs. Contactyour bank or credit card company if youno�ce suspicious ac�vity on youraccount. You may ask them to put asecurity block on your account orpreemp�vely request a new credit ordebit card. To help accelerate Hurricane Irmarecovery efforts across Florida, CFOPatronis announced an extension ofcon�nuing educa�on deadlines forlicensed insurance professionals inFlorida.

Con�nuing educa�on deadlines are setby the licensee’s birthday month, andany licensee with a deadline inSeptember, October or November willnow have an extended deadline ofDecember 31, 2017, to complete theircon�nuing educa�on requirements.

The extension applies to all insuranceprofessional licensees that require con�nuingeduca�on, including insurance adjusters,agents and customer representa�ves. Noform or applica�on process is required to beapproved for this extension. The Departmentof Financial Services’ Division of InsuranceAgent & Agency Services is upda�ng its onlinedatabase to automa�cally reflect the updateddeadline.

Are You Compliant with Your CE or Not?

To be CE compliant requires more than just taking CE courses. Below are a fewsugges�ons for remaining CE compliant:

CE requirements change. You should regularly review your CE status throughyour MyProfile account. Your total hours have specific alloca�on requirementsthat must be met. Be sure to take all the right categories of CE courses.Check for late hours. Hours taken a�er your due date will s�ll post on yourcompliance evalua�on screen, but they will be noted as "Late". Though yourhours requirement may have been met, late comple�on of your con�nuingeduca�on requirement will result in penal�es.Check prior evalua�on periods. Always check previous compliance periods tomake sure you are not delinquent for a prior period. Be sure to click on VIEWENFORCEMENT NOTICE just below the Not Compliant text to check for anyoutstanding fines.Check your transcript. The same course cannot be taken with the sameprovider within a two-year period and receive credit. This is noted on yourtranscript as a duplicate course. You will need to take a different course tomeet your CE requirement.

Do not allow yourself to be recruited by amarketer tou�ng cheaper health insurance ora guaranteed "can't lose" investment for yourclients.

Many �mes the sales materials will beimpressive, and fabricated le�ers fromregulators or others will give the appearanceof legi�macy. Some of the warning signs ofan unauthorized or bogus health plan will bethe use of trade associa�ons, unions oraffinity groups that a consumer must join tobe eligible for coverage.

Another warning sign is the use of the phrase"Mul�ple Employer Welfare Arrangement"(MEWA). While MEWAs can be legi�mate,they must be licensed by the state, and notmany are.

The marketers may claim their plan is afederal plan or an Employee Re�rementIncome Security Act (ERISA) plan and isexempt from state regula�on, which is adefinite red flag.

There is always someone who has aguaranteed, get-rich-quick investment seekingout insurance professionals with an establishedmarket of clients to whom they can sell theseproducts.

These bogus investments can range fromcommunica�ons equipment companies to realestate and land development opportuni�es,which almost always turn out to beunregistered securi�es. These investmentshave been so well packaged and pitched thatsome agents also purchased them, as did theirfamily members.

Title Agency Data Call 2017

2017 marked the third year �tle insurance agencies were required under s.626.8437(11),F.S. to submit informa�on to the Florida Office of Insurance Regula�on (OIR) under the datacall required by s.627.782(8), Florida Statutes. Title agencies had un�l June 1, 2017, to maketheir submission to the OIR.

According to OIR, more than 300 agencies failed to comply with the requirements of thedata call. Agencies that did not comply by the June 1, 2017 deadline are being reviewed forpossible disciplinary ac�on against their license.

Case: A complaint from an insurance company alleged a public adjuster’s contractwas not in compliance with Florida law. Inves�gators reviewed the contract inques�on and found it did not include the proper language regarding the consumer’sright to cancel. The contract also failed to indicate if the claim was emergency ornon-emergency and whether it was a supplemental or new claim. When contactedby an inves�gator, the public adjuster advised the right to cancel language waslocated on the back of the contract. The inves�gator was able to obtain a copy of theback of the contract; however, the public adjuster refused the inves�gator’s requestto provide a copy of the back page to the insurance company to complete thecontract. Failure to provide a full, unaltered copy of the contract to the insurancecompany is a viola�on of Florida Statutes. The inves�gator’s examina�on of the backpage of the contract revealed the consumers signed the right to cancel sec�on on thesame date the contract was executed. The public adjuster maintained that while theconsumers did sign the sec�on regarding cancella�on, they did so by mistake and didnot actually intend to cancel the contract. During the course of the inves�ga�on, anaddi�onal contract was found executed by the public adjuster which contained thesame viola�ons. Disposi�on: Fined $1,500.

Case: The Bureau of Inves�ga�on received a complaint a contractor was ac�ng as apublic adjuster without being licensed. During the course of the inves�ga�on,Inves�gators found several adver�sements placed on various social media pla�ormsin which the contractor claimed to be an “insurance specialist.” Addi�onaladver�sements were found in which the contractor stated, “we very much enjoyrepresen�ng the home owner in the insurance claim process.” Inves�gators alsofound one instance in which the contractor iden�fied himself as an insuranceadjuster when solici�ng a consumer for repair work. Disposi�on: An Order to Cease and Desist was issued by the Department, demandingthe contractor cease and desist from ac�ng or opera�ng as a public adjuster inFlorida; adver�sing or holding himself out as a public adjuster in Florida; solici�ngconsumers to hire him as their public adjuster; engaging in or a�emp�ng orprofessing to engage in any transac�on or business for which a license orappointment is required under the Florida Insurance Code; and viola�ng anyprovisions of the Florida Insurance Code. required license is a third-degree felony. Failure to comply with the Order could alsoresult in a fine of up to $50,000.

Case: A central Florida bail bond agent will no longer be authorized to conduct bailbond business in Florida following an inves�ga�on which found numerous viola�ons.A consumer filed a complaint alleging the bail bond agent revoked her bond, wouldnot let her pay the remainder of the premium and surrendered her to jail. While theinves�gator was looking into the consumer’s complaint, a surety companyrepresenta�ve contacted the Department to complain the bail bond agent owedpremium for executed powers. Upon further inves�ga�on, it was found the agentfailed to submit premium owed to the surety company for 51 executed powers in theamount of $5,160 and executed 29 bonds failing to submit premium in the amountof $4,410. The inves�gator found the agent failed to return collateral upon finaltermina�on of liability on a bond, failed to properly refund premium to a defendant,failed to return collateral to an indemnitor within twenty-one days of discharge of abond, misappropriated money received in the conduct of bail bond business,misappropriated money belonging to a surety and failed to properly maintainrecords. Disposi�on: License revoked and permanently barred from licensure as a bail bondagent.
