AGC AND ARTBA FILE SUIT TO BLOCK OSHA’S REVISED CRYSTALLINE SILICA RULE Two major industry associations, the Louisiana chapter of the Associated General Contractors of America (AGC) and the American Road & Transportation Builders Association (ARTBA), filed a challenge to the Occupational Safety and Health Administration’s (OSHA) final respirable crystalline silica rule in the U.S. Court of Appeals for the Fifth Circuit. Crystalline silica is a basic component of dust from soil, sand, granite and other minerals associated with construction. The rule, released March 24 by the Department of Labor, sets the limit of 50 micrograms per cubic meter of air, averaged over an eight-hour shift, compared to the previous level of 250 micrograms for the construction industry. While the administration did make a number of changes to the final rule, including dropping requirements for contractors to establish regulated areas that would block access to parts of construction sites where dust is being generated, both associations continue to feel that this final rule is not acceptable. Throughout the rulemaking process, ARTBA has pointed out a number of problems with the new OSHA standard, noting: It is based on outdated health data. In setting the new standard, OSHA has relied on studies from as early as the 1930s. More recent data clearly shows silica exposure has been dramatically reduced under the existing standard. According to the Center for Disease Control (CDC), deaths due to silicosis have declined 93% over the past 39 years. It is built on faulty economic data. OSHA estimates the rule will cost the construction industry $658,971,248 per year. An ARTBA co-sponsored, independent economic analysis of the proposed standard, conducted by Environomics, Inc., shows the new standard will cost the construction industry nearly $2.2 billion per year. It may be doing more harm than good by requiring workers to wear respirators in hot environments, potentially exposing them to otherwise avoidable heat stroke and stress. It creates air sampling requirements that are unworkable, requiring time consuming sampling and testing procedures that will yield virtually meaningless results, since, by

the time the results are known, the “workplace” location and conditions tested will have moved and/or changed.

The associations have urged federal officials to craft measures that would allow the roughly 25 percent of firms not meeting the prior standard to comply. Given the tremendous reductions in silicosis within the construction industry that has taken place since that standard was put in place, even more lives could be saved by getting greater compliance with that standard. Both AGC and ARTBA will continue to work with Congress and the next presidential administration to seek measures to improve this flawed rule in a way that truly benefits the health and safety of our workforce. SAFE HARBOR CALCULATION FOR SEVERANCE TAX IN PLACE At the request of the West Virginia Crushed Aggregates Council, the state Tax Department has created a 17.5% safe harbor valuation formula for calendar year 2016 for limestone producers for calculation of West Virginia severance tax on the production of limestone and sandstone. The safe harbor of 17.5% represents the percentage of costs that relate to the production of limestone or sandstone to the point of the quarry floor. (A copy of the letter from Mark Matkovich, State Tax Commissioner, has been sent to WVCAC members and is included in this Newsletter). For further details, see this week’s Highway Bulletin. BUDGET SHORTFALL GAP CLOSES; STILL NO AGREEMENT ON NEXT YEAR’S BUDGET A budget deficit that was projected in January to exceed $350 million when the 2015-16 budget year ends June 30 is now projected at a $146.3 million shortfall, mainly due to mid-year

spending cuts and an infusion of funds from legislation passed during the regular session, Department of Revenue officials said Tuesday. The gap was closed with mid-year spending cuts ordered by Gov. Earl Ray Tomblin to save more than $60 million, as well as legislation that will move about $90 million into the General Fund to help close the 2015-16 shortfall. Revenue Secretary Bob Kiss said discussions are continuing with legislators over the ongoing impasse on how to resolve a $239 million shortfall in the 2016-17 budget. Legislators left town March 15 with the 2016-17 budget in limbo. During the 2016 regular session, the state Senate passed a number of tax increase measures, including an increase in tobacco taxes proposed by the governor. The Senate also passed $300 million in new revenue for the State Road Fund. All those measures died in the House of Delegates, where a number of members are ardently opposed to any tax increases. Gov. Tomblin will have to call the Legislature into special session to complete work on the 2016-17 budget bill sometime before the new budget year begins on July 1. Secretary Kiss said he didn’t know if legislators are ready to proceed, but “we’ve made some progress,” he said. CAWV SCHOLARSHIP GOLF OUTING, JUNE 3, BERRY HILLS COUNTRY CLUB The annual CAWV Scholarship Golf Outing will be held on Friday, June 3, at Berry Hills Country Club. Over 300 CAWV members and guests played in last year’s event, which sold out very early. Due to the tremendous number of golfers in recent years, we are limited to 20 "Sixsomes" for both the 7:30 a.m. and 1:30 p.m. starting times. For morning golfers, an awards luncheon will be held immediately after play. For the afternoon golfers, an awards dinner will be held immediately after play. All proceeds from the Golf Outing benefit the CAWV Scholarship Foundation. Anyone interested in participating is encouraged to fill out the attached reservation form and return it to the CAWV office. WE EXTEND OUR SYMPATHIES The CAWV is sorry to report the passing of Kenneth M. Dunn, 93, on April 2. He formed the Kenneth M. Dunn Construction Company in 1959 and built it into one of the leading utility contracting firms in West Virginia. He was president of the West Virginia Contractors Association (prior to the WVCA and AGC of West Virginia merging to become the Contractors Association of West Virginia) and was a long-time member of the CAWV Board of Directors and ARTBA. He was inducted as a charter member of the Civil Engineering Academy of Distinguished Alumni of WVU in 2005. He was appointed the first Secretary of Transportation by Gov. Gaston Caperton. Donations may be made in Ken's memory to the Statler College of Engineering and Mineral Resources at WVU or Highlawn Presbyterian Church in St. Albans. CONTROL OF WORK

105.6-COOPERATION WITH UTILITIES:

ADD THE FOLLOWING SUBSECTION TO THE PROPOSAL:

105.6.1-Division Owned Utilities: It will be the Contractor’s responsibility to locate

and identify WVDOH owned utilities within the project limits where those utilities would be

interrupted or damaged by performing work. WVDOH owned utilities are typically limited

to electrical wiring used to power various devices and systems such as, but not limited to,

roadway lighting, sign lighting, traffic signals (including lead-in cables to advance high

speed induction loops), dynamic message signs (DMS), closed circuit television (CCTV),

roadway weather information system (RWIS), weigh in motion (WIM) and advance warning

flashers. This work shall be incidental to the project.

Department owned utilities or components that are cut, damaged, or destroyed by any

work performed as part of the project shall be replaced by the Contractor at no additional cost

to the Department.

Lighting, traffic signal, overhead sign plans, etc. if available, may be obtained by

APRIL IS NATIONAL SAFE DIGGING MONTH- SPREAD THE WORD This April marks the eighth annual National Safe Digging Month. WVUCA is reminding contractors to always contact Miss Utility of West Virginia before beginning any digging project. National Safe Digging Month is formally recognized by the U.S. House of Representatives and Senate and has traditionally earned the support from more than 40 state governors across the country. When calling 811 (or 1-800-245-4848), contractors are connected to Miss Utility of West Virginia, the local one-call center, which notifies the appropriate utility companies of their intent to dig. Locate tickets can also be submitted electronically through www.muwv.org. Professional locators are then sent to the requested digging site to mark the approximate locations of underground lines with flags, paint or both. A utility line is damaged by digging once every three minutes nationwide, and one-third of these incidents are caused by failure of the professional excavator or homeowner to call 811 before beginning their digging project. The Common Ground Alliance’s (CGA) 1,400 members have proclaimed April as National Safe Digging Month as a way to bring extra attention to the issue and reduce the risk of unnecessary infrastructure damage. As part of National Safe Digging Month, CGA and WVUCA encourages homeowners and contractors to take the following steps when planning a digging project this spring: 1. Always call 811 a few days before digging, regardless of the depth or familiarity with the

property. 2. Plan ahead. Call on Monday or Tuesday for work planned for an upcoming weekend,

providing ample time for the approximate location of lines to be marked. 3. Confirm with your local one call center that all lines have been marked. 4. Learn what the various colors of paint and flags represent at www.call811.com/faqs. 5. Consider moving the location of your project if it is near utility line markings. 6. Don’t allow work to begin if the lines aren’t marked. BE AWARE—NEW WVDOH SPECIAL PROVISION REQUIRES CONTRACTOR TO LOCATE UTILITIES/BE RESPONSIBLE FOR DAMAGE The WVDOH has begun use of Special Provision 105.6—Cooperation With Utilities, which makes it the Contractor’s responsibility to locate and identify WVDOH owned utilities within the project limits where those utilities would be interrupted or damaged by performing work. Location is incidental to the project and the contractor IS responsible for replacement at NO additional cost to the department. The DOH Traffic Engineering Division has historically located and identified DOH utilities on their ROW but last year announced they no longer had the manpower to provide this service. The CAWV, WVUCA, WVACEC and WV811 have met with the DOH to discuss this issue. The DOH has stated that use of this new provision is an interim step as they investigate alternatives for having this service provided by an outside vendor(s). A copy of the Special Provision dated February 25, 2016 is included with this newsletter. We encourage members to share this information with subcontractors and others that could be impacted by the change. The provision is reportedly being added by addendum to jobs that are already advertised and will be placed in all future proposals until further notice.

AGC ADVOCATES FOR WATER/WASTEWATER INFRASTRUCTURE

The Senate Committee on Environment & Public Works will hold a hearing concerning "the Federal Role in Keeping Water/Wastewater Infrastructure Affordable." AGC submitted testimony for the record emphasizing support for several financing tools that would help contractors and their local government partners build the nation's water/wastewater infrastructure. AGC called for increased appropriations to the Clean Water and Drinking Water State Revolving Loan Funds, enacting a long-term dedicated revenue stream for water/wastewater infrastructure (like a water trust fund), resurrecting the Build America bonds program, funding the new WIFIA program of direct federal loans and loan guarantees, and unlocking private capital by making private activity bonds for water and sewer exempt from the PAB volume cap. AGC and its coalition partners in the Water Infrastructure Network will continue to advocate for every method of increasing funding and financing for water/wastewater infrastructure. MOTOR FUEL TAX REVENUES CONTINUE TO DECLINE The reduction in the state’s wholesale gas tax is continuing to eat into Motor Fuel revenue collections for the State Road Fund. The wholesale gas tax is based on the average wholesale price of gasoline. Due to lower prices, the wholesale gas tax was reduced 1.1 cents per gallon January 1, 2015 and another 1.4 cents per gallon January 1, 2016. Each penny of the wholesale gas tax yields approximately $15 million. Through March 30, 2015, or nine months of the Fiscal Year 2016 budget, Motor Fuel tax collections totaled $306.5 million. In March 2015, collections had dropped to $327 million. In March 2014 – before the wholesale gas tax was first cut – Motor Fuel tax collections totaled $339 million. From March 2014 to March 2016, Motor Fuel tax revenues have dropped from $339 million to $306.5, a 10% drop. Barring any unforeseen changes in the price of gasoline, the state’s wholesale gas tax is set to drop another 1 cents per gallon, effective January 1, 2017. Through the first nine months of FY 2016, Registration Fees were down 8.5 percent from last year ($56.1 million versus $64.5 million) and the Privilege Tax was up 10% ($153.2 million versus $149.9 million). Total revenues to the State Road Fund this year are $517.2 million versus $542.3 million last year, a 4.6% drop. S.B. 555, passed by the West Virginia Senate this past legislative session would have changed the floor for the average wholesale price of gasoline at $2.56, up from $2.34 to keep the wholesale tax from declining further. The bill also increased the state retail gas tax 3 cents per gallon to make up for the 2.5 cents per gallon drop in the wholesale gas tax. S.B. 555 would have generated over $300 million annually for highway and bridge construction and maintenance through a variety of sources, including dedicating a portion of the state consumer sales tax to highways, increasing DMV fees and making the privilege tax on vehicles equal to the 6 percent state sales tax. The bill passed the Senate 25-9 on a bipartisan vote. The bill died in the House Finance Committee in the final days of the session. TAX DEPARTMENT CREATES SAFE HARBOR VALUATION FOR SEVERANCE TAX The state Tax Department on March 30, 2016 sent a letter to the CAWV creating a 17.5% safe harbor valuation formula for calendar year 2016 for limestone producers for calculation of West Virginia severance tax on the production of limestone and sandstone. The safe harbor of 17.5% represents the percentage of costs that relate to the production of limestone or sandstone to the point of the quarry floor. The West Virginia Crushed Aggregates Council met with tax officials in January to discuss the possibility of creating a “Safe Harbor” valuation formula for calculation of the West Virginia Severance Tax upon limestone and sandstone. WVCAC asked for a 10% safe harbor based on the following reasons:

10 percent of the selling price of crushed stone is a reasonable approximation of a

quarry’s average mining costs. Mining costs include costs associated with uncovering

the stone (stripping) and severing the stone from the earth (drilling and blasting). Mining

costs do not include the cost of transporting the severed stone to the crushers for further

processing nor do they include the cost of stockpiling finished products or loading

finished products into trucks for customer delivery. Mining costs will vary from year to

year depending on the amount of stripping that is done so in some years a producer’s

mining costs could be more than 10 percent of the selling price while in other years

those same costs could be less than 10 percent.

A safe harbor calculation method would provide certainty within the quarry industry as to

what their tax liability will be.

It would provide an easier methodology and more exact measurement for Tax

Department auditors, allowing far less time to be spent auditing severance tax, thus

giving auditors more time to focus on other taxes and to conduct additional audits

throughout the year.

Due to geological differences among quarries around West Virginia, some quarries will

have a much higher cost for removing overburden (stripping) compared to quarries

where the stone is located closer to the surface. In some cases, mining costs can also

vary significantly within an individual quarry operation depending on the locations from

which different types of stone are being mined. Also it is a common industry practice for

many operators to do advance stripping campaigns during which a significant amount of

overburden is removed in one year. When this occurs, the operator may not have any

costs associated with overburden removal for the next few years. Under the present

system, if the Tax Department audits a quarry operator in the year in which an advance

stripping campaign is conducted, the operator could be hit with a tax liability based on

the abnormally high mining costs in that one year which operators typically don’t expect

or plan for. Providing a safe harbor methodology based on selling price would provide a

level of certainty for producers that currently is not available as well as a more equitable

taxation.

Quarry operations that have higher costs associated with overburden removal look to

recover those costs through higher selling prices so under the proposed safe harbor

methodology, the higher the selling price, the more severance tax revenue the state

would collect.

As the price of crushed stone increases over time for all producers, revenues to the state

would also increase under the proposed safe harbor methodology.

WVCAC members and tax officials agreed to a one year safe harbor of 17.5%. The two groups are putting together a task force to look at a permanent structure, including the possibility of creating a tax calculation base on cents per ton of production. The Tax Department’s initial thought is that a cents per ton tax would be easier to comply with by the industry and easier to administer by the department. “The Crushed Aggregates Council appreciates Commissioner Matkovich and his staff for working with our members to develop the safe harbor calculation for this year,” said WVCAC Chairman Doug Canterbury. “We look forward to working with them to create certainty within our membership and our industry on our tax liabilities.” UPDATE ON WVDOH ASPHALT PURCHASE ORDER (PO) CONTRACTS The WVDOH and WV Purchasing Division took bids on February 24 for their annual asphalt contracts. Expiration of the current asphalt material “pick up” contract on March 31, 2016, however, prior to the award of the new contract has created challenges for the DOH and producers. Award of the new contract, CRFQ#DOT1600000066 for Bituminous Asphalt – Material and Pickup by WVDOH Forces, is reportedly being expedited by the Purchasing Division. In the interim, the DOH is unable to pick up asphalt material for use by state forces. Vendors should hear from the DOH in the very near future regarding award of the new contract. The current laydown contract does not expire until April 30, 2016. The new contract, ARFQ#DOT1600000013 for Bituminous Asphalt – Material, Delivery and Labor by the Vendor, will need to be certified to be available for use by May 1. The DOH Traffic Engineering Division has historically located and identified DOH utilities on their ROW but last year announced they no longer had the manpower to provide this service. The CAWV, WVUCA, WVACEC and WV811 have met with the DOH to discuss this issue. The DOH has stated that use of this new provision is an interim step as they investigate alternatives for having this service provided by an outside vendor(s). A copy of the Special Provision dated February 25, 2016 is included with this newsletter. We encourage members to share this information with subcontractors and others that could be impacted by the change. The provision is reportedly being added by addendum to jobs that are already advertised and will be placed in all future proposals until further notice. SASHTO SEEKING TECHNICAL SESSIONS PROPOSALS The Southern Association of State Highway and Transportation Officials (SASHTO) 2016 Technical Committee is accepting abstracts for the Annual Meeting to be held August 27-30, 2016 at The Greenbrier. The Annual Meeting will provide public- and private-sector transportation professionals an opportunity to discuss various issues and obtain information regarding innovations, processes, and procedures that may be of benefit.
