Executive Summary

This is a request to rezone to 3-3(c), General Business District with conditions, to permit the site to beredeveloped for use as a tour bus office and accessory garage. A portion of the site is zoned B-3 but theproposed building and bus parking area cannot be accommodated within the existing B-3 area; theproposed rezoning would be for the entire parcel.

Staff Recommendation

APPROVAL subject to the submitted proffers, dated October 8, 2012.

Planning Analysis

The applicant is proposing to remove the existing buildings on the property and construct a tour busoffice and accessory bus garage and parking area. The application indicates that the office will havetwo employees, who book tours over the phone. Customers do not travel to the office. The conceptualplan shows an asphalt parking area that includes eight parking spaces in the front and side of thebuilding. The 5,456 square foot building consists of an office, a two-bay bus garage, and an enclosedwash bay. To the rear of the building, a gravel parking lot is shown, including six bus parking spacesand six regular parking spaces for the drivers’ personal vehicles. The parking is screened with a 6’board-on-board fence. Additional screening using 6’ tall evergreen trees is shown along the sideproperty lines.

The property is designated for Agricultural use on the General Land Use Plan Map of theComprehensive Plan. Approximately one acre of the subject property has been zoned B-3 since 1974,when the Comprehensive Rezoning of the County took place, likely to accommodate the existingcommercial use of the property. The existing zoning line is located approximately 150’ from MountainRoad, which can accommodate approximately half of the proposed site. To soften the view of the busparking lot, supplementary evergreen tree screening has been provided in addition to a screening fence.The proffered conceptual plan shows the back half the property to remain vacant. For these reasons,staff finds this request appropriate and compatible with the surrounding area.

Agency Analysis

VDOT initially expressed concerns about the sight distance at the proposed entrance along MountainRoad and requested that the applicant verify that the entrance meets intersection sight distance of 610’.The applicant field verified the sight distance and provided a surveyed plan and profile as requested.

There were no other substantive comments from any of the reviewing agencies.

Proffers

Staff recommends approval of the following proffers, dated October 8, 2018:

1. Conceptual Plan. Accept. The applicant has proffered to develop the property in substantialconformity with the conceptual plan.

2. Elevations. Accept. The proposed building will be constructed in substantial conformity withthe elevations.

3. Dedication of Right-of-way. Accept. Right-of-way dedication has been proffered alongMountain Road in accordance with the Major Thoroughfare Plan.

4. Lighting. Accept. The applicant has proffered to limit the height of any lighting to 25’.5. Use Restrictions. Accept. Use of the site will be limited office with accessory bus garage and

parking as well as all B-i uses. The bus parking area must be screened.6. HVAC Units. Accept. The applicant has proffered the screening of HVAC units.

PROFFERS: C-3-18(c), Heirfield Properties, LLC

The undersigned, Heirfield Properties, LLC, owner of parcel designated GPIN 7803-10-3412 (“the

Property”), voluntarily agrees for themselves, their agent, personal representatives, successors

and assigns (collectively “the Property Owner”) that, in the event the Property is rezoned from

B-3 and A-i to B-3, the development and use of the Property shall be subject to the following

conditions:

1. Conceptual Plan. The Property shall be developed in substantial conformity with the

conceptual plan, titled “Concept Plan” dated May 16, 2018, revised October 3, 2018,

prepared by Youngblood, Tyler & Associates, P.C. of Mechanicsville, Virginia.

2. Elevations. The building shall be constructed in substantial conformity with the

elevations, titled “AlOl Preliminary Plans” dated October 3, 2012, with no revision dates,

prepared by Lakeland Services, Inc. of Ruther Glen, Virginia.

3. Dedication of Right-of-way. The Owner agrees to dedicate sixty feet (60’) of right-of-way

measured from the centerline of Mountain Road (U.S. Route 33) to the Property for future

road widening, free of cost to the County, upon request of the County or VDOT.

4. Lighting. Any lighting on the Property shall be no greater than twenty-five (25) feet in

height.

5. Use Restrictions. Use of the Property shall be limited to office with accessory bus garage

and parking. All other uses shall be limited to uses permitted within the B-i,

Neighborhood Business District. All outside storage of materials and equipment shall be

screened in accordance with the requirements of Section 26-263.

6. HVAC Units. Any mechanical units on the Property shall be screened, and if on the roof,

screened by architectural features which are compatible with the building façade

architecture. Screening shall be designed to block such units from view by persons from

the ground immediately adjoining the Property, or from adjacent residential uses. The

method of screening shall be submitted at the time of site plan review.
