Background

In 2004 City Council identified the need to revitalize the Kennedy Road South area The existing Secondary Plan and zoning permissions at the time for the area permitted a wide range of highway commercial industrial and service commercial uses which resulted in an unattractive streetscape that was reflected in minimal private investment over the years The physical quality of the area combined with the range of land use permissions did little to attract better quality uses and development to the area

In 2004 the City retained a consultant to undertake a comprehensive land use and urban design study and an Interim Control by-law was passed that prohibited the establishment of any new use or the expansion of any existing use while the study was in progress

In 2006 City Council approved an official plan and zoning by-law amendment for the study area One of the study recommendations was to encourage development that allows for industrial in the rear of some properties with retail facing Kennedy Road South As a result the zoning (Section M1-3445) was amended to include certain lands within the industrial area zone while permitting Service Commercial uses fronting about 50 meters along the frontage of Kennedy Road South Section M1-3445 permits uses permitted in the M1 zone (Industrial) and also allows uses permitted in the Service Commercial zone within 50 metres of the front lot line

In the Citys Comprehensive Zoning by-law 270-2004 the front lot line is defined as the line that divides a lot from the street In the case of a corner lot the shorter lot line that abuts a street is considered the front lot line The longer lot line that abuts a street is considered the flankage lot line In the case of a corner lot this means that the front lot line may not necessarily be the lot line fronting Kennedy Road South

Further details on the technical aspects of this application can be found in the Information Summary contained in Appendix 5

Current Situation

A zoning issue was brought to the attention of City staff after the approval of the zoning by-law through a public inquiry The owners of 158 Kennedy Road South located at the southeast corner of Kennedy Road South and Glidden Road encountered an issue when inquiring about a service commercial use for their plaza As this property is a corner lot with the shorter of the two frontages facing Glidden Road the Glidden Road frontage is the front lot line

As Glidden Road is the front lot line for 158 Kennedy Road South Service Commercial uses are only allowed in the two units adjacent to Glidden Road and not in all the units facing Kennedy Road South which was the intent of the M1- Section 3445 zoning designation

Therefore a housekeeping amendment to Zoning By-law 270-2004 is required in order to clarify that for the purposes of all lands zoned M1-Section 3445 the lot line abutting Kennedy Road is the front lot line Staff has prepared such an amendment which is attached hereto as Appendix 6

Details of the Proposal

The attached Zoning Amendment serves to implement the original intention of the Citys zoning by-law for the Kennedy Road South Revitalization Study for certain lands with frontage on the east side of Kennedy Road South

The proposed zoning change aims to consolidate the industrial nature of this district but also allows flexibility for commercial uses in the front of the properties along Kennedy Road South Figure 1 illustrates all the properties zoned M1-Section 3445 along Kennedy Road South

As the intent of the 2006 by-law for the lands zoned M1-Section 3445 remains the same and the amendment is meant to clarify this intent notice of public meeting was given through publication in the Brampton Guardian in accordance with the City of Brampton Official Plan and the Planning Act

The attached Zoning By-Law proposes to

The attached Zoning Amendment serves to implement the original intention of the Citys zoning by-law for the Kennedy Road South Revitalization Study for certain lands with frontage on the east side of Kennedy Road South

The proposed zoning change aims to consolidate the industrial nature of this district but also allows flexibility for commercial uses in the front of the properties along Kennedy Road South Figure 1 illustrates all the properties zoned M1-Section 3445 along Kennedy Road South

As the intent of the 2006 by-law for the lands zoned M1-Section 3445 remains the same and the amendment is meant to clarify this intent notice of public meeting was given through publication in the Brampton Guardian in accordance with the City of Brampton Official Plan and the Planning Act

The attached Zoning By-Law proposes to

bull amend the existing M1-Section 3445 Zone by adding a new clause that clarifies for the purposes of all lands zoned M1-Section 3445 the lot line abutting Kennedy Road is deemed to be the front lot line
