Report: 102/2017 RMS Road Type Two (2) Road Train Trial

Introduction: On Wednesday, 1st February 2017 the RMS carried out a field trial from North Bourke to south of Bourke to ascertain the suitability for a type two (2) road train and a PBS Level four (4) (BAB configuration) to access the network. The trial focussed specifically on the vehicle and its interaction with road users and road infrastructure at the intersections while travelling through Bourke. Background: The RMS has received a number of transport industry enquiries regarding the access for type two (2) road train access from North Bourke to Nyngan and Trangie. The route will be assessed in stages; the first stage will be to ensure the combinations can manoeuvre through the intersections of Bourke. There are four (4) intersections that were assessed from North Bourke to South of Bourke. These being:-

Intersection of the Mitchell Highway and Hungerford Road North Bourke

Intersection of the Mitchell Highway and Kamilaroi Highway at Bourke

Intersection of the Mitchell Highway and Richard Street at Bourke

Intersection of the Mitchell Highway and Gorrell Avenue( Kidman Way) at Bourke

Swept path assessments on the intersections through Bourke indicated the combination would encroach into the opposing travel lanes or impact on the local infrastructure while manoeuvring through the intersections. Pre-trial - the assessment team convened on site at the North Bourke parking bay. WHS requirements and the assessment criteria reviewed. Trial: The trial confirmed that the combinations encroached into the opposing travel lanes while manoeuvring through the intersections and therefore are unsuitable routes through the township of Bourke. Council Staff suggested that the bypass route from the Mitchell Highway through Tarcoon Street would be suitable. A trial was carried out on three (3) intersections of this route:-

Post-trial: On completion of the trial, the assessment team convened at the Bourke Shire Council meeting room to discuss the outcome of the trial. All parties agreed that the initial four intersections of the trial were unsuitable for the type two (2) road train and PBS Level four (4) (BAB configuration) combinations. All parties agreed that the Tarcoon Bypass route would be suitable for the combinations. The Co-ordinator for the Regional NSW High Productivity Road Transport Alliance stated that the Transport industry would be happy to access this route with curfew hours in place and under permanent speed restriction conditions if required. Report: 201/2017 Planning Proposal to Amend LEP

Introduction Council staff have been made aware of a anomaly that exists in the current Bourke Local Environmental Plan 2012 (LEP) that permits a standard dwelling to be erected, but prohibits the development of manufactured dwellings in the RU1 – Primary Production Zone. The anomaly has arisen due to the definitions of dwelling and dwelling houses as per the LEP. Discussions with other Western Region Councils suggest that this will be an issue for many Councils. The Western Region Department of Planning & Environment has been approached to determine whether there is a Department led solution to the problem, however, the timeliest solution is to prepare and lodge this draft planning proposal to amend the LEP. Timing is important as Council currently has a development application for the installation of a manufactured dwelling in the RU1 – Primary Production zone lodged and in the process of being assessed. Without an amendment to the LEP, this DA must be refused. Bourke LEP Proposed Amendments It is recommended to prepare a simple planning proposal to amend the LEP to include dwellings (as well as retain dwelling houses) in Part 3 of the RU1 – Primary Production Land Use Table. An amendment to the wording of LEP clause 4.2A is also required to ensure that dwelling density in the RU1 zone does not unintentionally increase. Council currently engages Geolyse to undertake the more detailed planning functions on our behalf and have had them prepare a draft planning proposal in regard to these changes. The process for amending the LEP is to submit the Planning Proposal to the Department of Planning for consideration. Once this has occurred and if it is supported, it will be placed on public exhibition. Council will be informed once the Department has responded to the Planning Proposal. Council is requested to accept the delegation of plan making functions in this regard pursuant to Section 59 of the Environmental Planning and Assessment Act 1979, which enables the draft LEP to be made once the required steps have been completed.

98/2017 That Council: 1. “Endorse the attached draft Planning Proposal to enable the amendment of the Bourke Local

Environmental Plan 2012 to include dwellings (as well as retain dwelling houses) in Part 3 of the RU1 – Primary Production Land Use Table and to amend the wording of clause 4.2A to include dwellings; and

2. Forward the endorsed draft Planning Proposal to the DP&E with a request for a Gateway determination and proceed to public exhibition subject to advice received; and

3. Request that the Gateway delegate to Council plan making functions under Sections 59(2) and (3) of the Environmental Planning and Assessment Act 1979, in this instance.”

GENERAL MANAGER

Background: The legislative requirements in relation to the policy for the payment of expenses and the provision of facilities for Councillors is now required to be reviewed within the first twelve (12) months of the beginning of each quadrennial term. In addition to the legislative provisions The Division of Local Government has also developed guidelines to assist Councils in the development of their individual policies. These guidelines have been produced under Section 23A of the Local Government Act 1993. The current policy which was subject to a comprehensive revision in 2013 took into consideration the provisions of these guidelines and there have only been minimal changes since that time. Council can change the policy however, any significant changes will again trigger the advertising requirements. Financial Implications: The cost of the payment of expenses and the provision of expenses to the Mayor and Councillors is included in the Annual Operational Plan of Council Some advertising costs were incurred in the compliance with the legislative provisions but once again they are covered by existing votes. Current Situation: The Payment of Expenses and the Provision of Facilities Policy was presented to the previous Council on Monday, 27th June 2016, the advertisement of this policy was placed on the 14th July 2016 but not formally adopted. As a result of the changes that have been made to Section 252 of the Local Government Act, which relates to the Payment of Expenses and Provision of Facilities to the Mayor and Councillors, the policy must be reviewed within the first twelve (12) months of the beginning of each quadrennial term. An advertisement was placed in the Western Herald on Thursday, 9th February 2017 and the statutory advertising period allowed for the submissions to be received up until 13th March 2017. Council to date has not received any submissions regarding the policy in relation to the Payment of Expenses and Provision of Facilities to Councillors. Resolution

Background: Council awarded the tender to Saunders Electrics from Longreach for the Installation of the new lighting at the Bourke Airport. Current Situation: In accepting the tender the resolution did not contain the approval to Affix the Seal of Council which is normally undertaken on a contract of this size. Background: The concept of the Far West Initiative (FWI) has been with us for some time now and was aimed at both improving the sustainability of Councils involvement and improving the service delivery by all agencies to make them more efficient and effective and reduce the instance of duplication. The establishment of the FWI was effectively borne out of the Final Report of the Independent Local Government Review Panel Current Situation: There is an indication by politicians that the concept of the FWI will not progress, however, at the same time both the Office of Local Government (OLG) and the Department of Premier and Cabinet (DPC) are continuing within their schedule of consultation with government agencies. The eight (8) Councils to form the FWI were initially not required to participate in the Fit for the Future process, however, some work has been undertaken by consultancy firm Morrison Low on the asset evaluation of each of the Councils and T-Corp have been engaged to undertake some further assessment work on each Councils level of sustainability. T-Corp will be visiting Bourke on the 4th April 2017. When the consultation period for the FWI concluded in December the indication was that a summary of the submissions was to be collated and a report to the then Minister was to be prepared so that the next steps, if any, could be determined. To date I don’t think that report has been finalised.

The concept of the FWI has involved considerable work for all Councils and I think that each of the Councils involved would like some clarity as to work that the OLG and DPC are continuing to be developing. The four (4) OROC members who were also earmarked for the FWI met quickly after the last OROC meeting and decided that they would seek such clarity and I was tasked with making the appropriate contacts. This revenue is split proportionally across General, Water and Sewer Funds and changes on a monthly basis in accordance with cash flow requirements

The market value of Council’s Investments held as at 28th February 2017 is $12,905,845.28.

Investment income earned as at 28th February 2017 was $194,819.88.

Term Deposits Percentage of Total Portfolio 100% Average Investment Yield 2.59% Discussions/Comments The Investment portfolio increased by $50,041.24 during the period. The investment portfolio is invested in term deposits with the National Australia Bank. The investment portfolio is regularly reviewed in order to maximise investment performance and minimise risk. The Government Guarantee on Investments up to $1 million dollars has now expired and the new cap of $250,000 has replaced the scheme. Report: 411/2017 Outstanding Debts due to Council

Background: At the February Ordinary meeting of Council, Council resolved the following:- “That staff develop a strategy to reduce the outstanding debts due to Council and that a report be submitted to the March Meeting of Council” Current Situation The Manager of Corporate Services (MCS) and Revenue Officer (RO) have been working together to put in place strategies to reduce the outstanding debts and generate a better cash flow for Council. Key Strategies Include;

Payment Arrangements. MCS and RO have been making personal contact with rate payers in an attempt to enter into payment arrangements with rate payers in order for them to repay the debt owed to Council over a specified time frame.

Additional Cycles of OVERDUE NOTICES. MCS and RO have decided to send OVERDUE NOTICE’S as each Instalment becomes overdue. Overdue Notices were previously issued

twice a year in December and June. The additional notices will be sent in March and September.

Council Issued Letter. To be included with the Overdue Notice’s. This letter will outline the Ratepayers obligations to pay the debt owing to Council or legal action will commence.

Letter of Demand. Rate payers who are unresponsive to Overdue Notices will be issued a “Letter of Demand” from our Debt Collection Agency. This Letter gives the Rate Payer a final Seven Days to make payment.

Legal Action. MCS and RO will be taking Legal Action against all rate payers who fail to respond to the strategy listed above. We will be using all resources made available to us from our Debt Collection Agency in an attempt to try and recover outstanding debts from rate payers.

713 Sale. The General Manager has asked that we hold a Sale of Land for Unpaid Rates. MCS and RO will be working together to include all properties in the public auction that meet the criteria to be sold for unpaid rates in an effort to further reduce the Outstanding Debt for Bourke Shire Council.

Financial Implications The table below shows the total combined Rates and Charges collection to 28th February 2017 compared to 31st December 2016. Conclusion Council staff will continue take action against all outstanding Debtors. DELEGATES REPORT

Background: The Western Division Shire Conference was held in Wentworth on Sunday, 26th February to Tuesday, 28th February 2017. The Mayor, Councillor Barry Hollman, Deputy Mayor, Councillor Lachlan Ford and I attended the conference as representatives of Council driving down on the Sunday. Current Situation: NSW Deputy Premier, the Hon. John Barilaro, MP, Minister for Regional Development, Minister for Skills and Minister for Small Business was the key note speaker at the Conference. Also attending the Conference were the Member for Murray, Adrian Piccoli and the Parliamentary Secretary for Western Division, Rick Colless MLC. The Deputy Premier gave a very good address and is a very accomplished speaker, covering a number of topics including the Far west Initiative and the potential availability of funding from the Restart NSW programme where it was expected that $6 Billion dollars would be allocated to regional and rural NSW. There has been a subsequent announcement regarding finding for tourism and environmental projects and it is anticipated that funding will become available for infrastructure projects and suggested that Council have a number of projects “shovel ready”. Bourke Shire Council had a total of sixteen motions before the conference and all were adopted. There was a good range of speakers and the opportunity was taken to network with a number of representatives from the Departments we deal with on a regular basis and I think that the Mayor and Deputy Mayor would agree that the long drive was justified. Councillor Leigh Byron from Balranald Shire was re-elected Chair with Councillor Dave Gallagher from Broken Hill elected as Deputy with Councillor Hollman joining Councillor Peter Nunan from Wentworth as Executive Members. The Mayor and Deputy Mayor may like to add their own comments at the meeting. 1. PURPOSE

This Policy has been developed to provide guidance in complying with the Local Government

Act, section 413(3), which requires Council to prepare its General Purpose Financial Statements

in compliance with Australian Accounting Standards. The relevant standard for the purpose of

this Policy is AASB 124 Related Party Disclosures, July 2015 (AASB 124).

The objective of the Policy is to ensure that the existence of certain related party relationships,

related party transactions and information about the transactions, necessary for users to

understand the potential effects on the Financial Statements are properly identified, recorded

in Council’s systems, and disclosed in Council’s General Purpose Financial Statements in

compliance with AASB 124, the Privacy and Personal Information Protection Act 1998 [PPIPA]

and the Government Information (Public Access) Act 2009 [GIPAA].

2. POLICY STATEMENT

Council in complying with disclosure requirements in AASB 124, will;

1. identify related party relationships, related party transactions and ordinary citizen

transactions;

2. identify information about the related party transactions for disclosure;

3. Establish systems to capture and record the related party transactions and information

about those transactions;

4. identify the circumstances in which disclosure of the items in subparagraphs (1) and (2) are

required; and

determine the disclosures to be made about those items in the General Purpose Financial

Statements for the purpose of complying with AASB 124.

STATEMENT OF PROCEDURES

1 AASB 124 DISCLOSURE REQUIREMENTS

1.1 Disclosures To comply with AASB 124, for annual periods beginning on or after 1 July 2016, Council will make the following disclosures in its General Purpose Financial Statements: (a) Relationships between Council and its subsidiaries, irrespective of whether there have

been transactions between them.

(b) Key management personnel (KMP) compensation in total and for each of the following categories: - (i) short-term employee benefits; (ii) post-employment benefits; (iii) other long term benefits; and (iv) termination benefits.

(c) Amounts incurred by Council for the provision of KMP services that are provided by a

separate management entity. (d) The information specified in Section 1.2 for related party transactions with the following

persons during the periods covered by the Financial Statement:- (v) Council subsidiaries; (vi) entities who are associates of Council or of a Council subsidiary; (vii) joint ventures in which Council or a Council subsidiary is a joint venture party; (viii) Council’s KMP; (ix) other related parties, comprising:-

(a) a close family member of a KMP of Council; (b) entities controlled or jointly controlled by a KMP of Council; (c) entities controlled or jointly controlled by a close family member of a KMP of

Council; (d) other entities as specified in AASB 124, paragraph 9(b)(iii), (iv), (v) and (viii)

1.2 Disclosed Information For each category of related party transactions specified in Section 1.1(d), Council will disclose the following information in Council’s General Purpose Financial Statements:- (a) the nature of the related party relationship; (b) the amount of the transactions; (c) the amount of outstanding balances, including commitments, and:-

(i) their terms and conditions, including whether they are secured, and the nature of the consideration to be provided in settlement; and

(ii) details of any guarantees given or received; (d) provisions for doubtful debts related to the amount of outstanding balances; and (e) the expense recognised during the period in respect of bad or doubtful debts due from

related parties.

1.3 Disclosed in Aggregate or Separate For each related party category specified in Section 1.1(d), Council will disclose information specified in Section 1.2 for related party transactions of a similar nature in aggregate except when separate disclosure is necessary for an understanding of the effects of related party transactions on the Financial Statements of Council, having regard to the following criteria: (a) the nature of the related party relationship; (b) the significance of the transaction (individually or collectively) in terms of size or value

(including where the materiality arises due to the fact that no consideration for the transaction is given or received by Council);

(c) whether the transaction is carried out on non-arm’s length terms; (d) whether the nature of the transaction is outside normal day-to-day business operations,

based on the factors and thresholds under the direction of the Responsible Accounting Officer in consultation with Council’s external auditor.

1.4 IDENTIFYING COUNCIL RELATED PARTY RELATIONSHIPS AND TRANSACTIONS

1.4.1 Identification

The Responsible Accounting Officer is responsible for identifying Council subsidiaries, associates and joint ventures (incorporated and unincorporated) from the Related Entities Register, a document which is prepared to substantiate Note 19 of the Financial Statements “Interests in Other Entities”.

1.4.2 Control or Joint Control

To determine whether Council has control or joint control of an entity, the Responsible Accounting Officer is responsible for applying Australian Accounting Standards AASB 10 Consolidated Financial Statements and AASB 11 Joint Arrangements.

1.4.3 Associate or Joint Venture

To determine whether an entity is an associate of, or in a joint venture with, Council or a Council subsidiary the Responsible Accounting Officer is responsible for applying AASB 128 investments in associates and joint ventures.

1.4.4 Electronic Investigation

The Responsible Accounting Officer is responsible for investigating through Council’s business system whether any identified Council subsidiaries, associates or joint ventures have an existing related party transaction with Council.

1.4.5 Information Extraction The Responsible Accounting Officer is responsible for identifying and extracting information specified in Section 1.2 against each existing related party transaction in Council’s business systems for the purpose of recording the related party transactions and associated information in a register of related party transactions.

1.4.6 Manual Investigation and Recording of Information

For related party transactions that are not captured by Council’s business systems, the Responsible Accounting Officer is responsible for manually reviewing the transactional documentation and record the information specified in Section 1.2 for the subject transaction in the register of related party transactions.

1.5 IDENTIFYING RELATED PARTY TRANSACTIONS WITH KMP AND THEIR CLOSE FAMILY MEMBERS

1.5.1 Related Party Disclosures KMP must provide a related party disclosure in the form set out in Attachment A, notifying any existing or potential related party transactions between Council and either themselves, their close family members or entities controlled or jointly controlled by them or any of their close family members, subject to Section 3.5, to the Manager Corporate Services by no later than the following periods during a financial year (specified notification period):- (a) 30 days after the commencement of the application of this Policy; (b) 30 days after a KMP commences their term or employment with Council; (c) 30 November each year; (d) 30 June each year.

1.5.2 Related Party Disclosure Form At least 30 days before a specified notification period, the Executive Assistant will provide KMP with a Related Party Disclosure Form (Attachment A) and a Privacy Collection Notice (Attachment B).

1.5.3 Suspected Related Party Transaction

If a KMP suspects that a transaction may constitute a related party transaction, the KMP should provide a related party disclosure to the Executive Assistant and Information for consideration and determination.

1.5.4 Other Notifications

The notification requirements in Section 3 are in addition to the notifications a KMP must make to comply with:- (a) Council’s adopted Code of Conduct; and (b) the disclosure of interests in a written return pursuant to section 450A of the Local

Government Act 1993 and Local Government (General) Regulation 2005.

1.5.5 Exclusions The notification requirements in Section 3 do not apply to:- (a) related party transactions that are ordinary citizen transactions not assessed as being

material as determined under Section 4; and (b) the Mayor and Councillors’ expenses incurred and facilities provided during the financial

year under Council’s Payment of Expenses and Provision of Facilities to Mayor and Councillors’ Policy, the particulars of which are contained in Council’s Annual Report pursuant to the Local Government (General) Regulation 2005, clause 217.

1.5.6 Information Extraction

The Responsible Accounting Officer is responsible for identifying information specified in Section 1.2 against each notified related party transaction in Council’s business systems for the purpose of recording the related party transactions and associated information in the register of related party transactions.

1.5.7 Other Sources of Information To ensure all related party transactions are captured and recorded, the Responsible Accounting Officer is responsible for reviewing, if required, other sources of information held by Council including, without limitation:- (a) a register of interests of a KMP and of persons related to the KMP (b) minutes of Council and committee meetings; (c) Council’s Contracts Register.

3.8 Manual Investigation and Recording of Information

For notified related party transactions that are not captured by Council’s business systems, the Responsible Accounting Officer is responsible for manually reviewing the transactional documentation and record the information specified in Section 1.2 for the subject transaction in the register of related party transactions.

1.6 ORDINARY CITIZEN TRANSACTIONS

1.6.1 Non-material in Nature

A KMP is not required to notify in a related party disclosure and Council will not disclose in its Financial Statements, related party transactions that are ordinary citizen transactions assessed to be not material in nature.

1.6.2 Material in Nature

A KMP is required to notify in a related party disclosure and Council will disclose in its Financial Statements in accordance with Section 1, related party transactions that are ordinary citizen transactions assessed to be material in nature.

1.6.3 Materiality Assessment

The Responsible Accounting Officer is responsible for reviewing and assessing the materiality of related party transactions that are ordinary citizen transactions to determine whether the disclosure of such transactions are necessary for an understanding of the effects of the related party transactions on the Financial Statements having regard to the criteria specified in Section 1.3. As a general rule, Council will utilise $10,000 as the threshold for materiality.

1.6.4 Information Extraction

The Responsible Accounting Officer is responsible for identifying information specified in Section 1.2 against each notified related party transaction that is an ordinary citizen transaction assessed as being material in nature in Council’s business systems for the purpose of recording the related party transactions and associated information in a register of related party transactions.

1.7 REGISTER OF RELATED PARTY TRANSACTIONS

1.7.1 Maintain a Register

The Responsible Accounting Officer is responsible for maintaining and keeping up to date a register of related party transactions that captures and records the information specified in Section 1.2 for each existing or potential related party transaction (including ordinary citizen transactions assessed as being material in nature) during a financial year.

1.7.2 Contents of Register The contents of the register of related party transactions must detail for each related party transaction: (a) the description of the related party transaction; (b) the name of the related party; (c) the nature of the related party’s relationship with Council; (d) whether the notified related party transaction is existing or potential; (e) a description of the transactional documents the subject of the related party transaction; (f) the information specified in Section 1.2.

The Responsible Accounting Officer is responsible for ensuring that the information specified in Section 1.2 is disclosed in Council’s Financial Statements to the extent, and in the manner stipulated by AASB 124, subject to Section 1.3.

1.8 INFORMATION PRIVACY

1.8.1 Confidential The following information is classified as confidential and is not available for inspection by or disclosure to the public, including through a GIPAA application:- (a) information (including personal information) provided by a KMP in a related party

disclosure; and (b) personal information contained in a register of related party transactions.

1.8.2 When Consent is Required

Except as specified in this Policy, Council and other permitted recipients will not use or disclose personal information provided in a related party disclosure by a KMP or contained in a register of related party transactions for any other purpose or to any other person except with the prior written consent of the subject KMP.

1.8.3 Permitted Recipients

The following persons are permitted to access, use and disclose the information (including personal information) provided in a related party disclosure or contained in a register of related party transactions for the purposes specified in Section 6.4: (a) the General Manager; (b) the Responsible Accounting Officer, Manager Corporate Services, Governance Officer,

Finance Officer, Executive Assistant (c) an Auditor of Council (including an Auditor from the NSW Auditor General’s Office); (d) Other Officers as delegated by the General Manager.

1.8.4 Permitted Purposes

A person specified in Section 6.3 may access, use and disclose information (including personal information) in a related party disclosure or contained in a register of related party transactions for the following purposes:- (a) to assess and verify a notified related party transaction; (b) to reconcile identified related party transactions against those notified in a related party

disclosure or contained in a register of related party transactions; (c) to comply with the disclosure requirements of AASB 124; (d) to verify compliance with the disclosure requirements of AASB 124.

1.8.5 An individual may access their personal information provided by a KMP in a related party disclosure or contained in a register of related party transactions in accordance with Council’s Privacy Management Plan.

1.9 GOVERNMENT INFORMATION (PUBLIC ACCESS) [GIPAA] STATUS

1.9.1 No Public Inspection

The following documents are not open to or available for inspection by the public: (a) related party disclosures provided by a KMP; and (b) a register of related party transactions.

1.9.2 Not GIPAA - accessible

A GIPAA application seeking access to:- (a) a document or information (including personal information) provided by a KMP in a

related party disclosure; or (b) personal information contained in a register of related party transactions;

will be refused on the grounds the document or information comprises information for which there is an overriding public interest against disclosure pursuant to Section 14 of GIPAA.

1.9.3 Transactional Documentation

A GIPAA application seeking access to and release of transactional information and documentation the subject of a related party transaction with Council will be considered, assessed and decided in accordance with Council’s usual procedures regarding applications made under GIPAA.

1.10 DEFINITIONS

Each of the following expressions in bold bears the meaning shown below:- Arm’s length terms Terms between parties that are reasonable in the circumstances of the transaction that would result from:- (a) neither party bearing the other any special duty or obligation; and (b) the parties being unrelated and uninfluenced by the other; and each party having acted in

its own interest. Associate In relation to an entity (the first entity), an entity over which the first entity has significant influence.

Close family members or close members of the family In relation to a KMP, family members who may be expected to influence, or be influenced by that KMP in their dealings with Council will include:- (a) that person’s children and spouse or domestic partner; (b) children of that person’s spouse or domestic partner; and (c) dependents of that person or that person’s spouse or domestic partner.

For the purpose of AASB 124, close family members could include extended members of a family (such as, without limitation, parents, siblings, grandparents, uncles/aunts or cousins) if

they could be expected to influence, or be influenced by, the KMP in their dealings with Council.

Control Control of an entity is present when there is:- (a) power over the entity; and (b) exposure or rights to variable returns from involvement with the entity; and (c) the ability to use power over the entity to affect the amount of returns received

as determined in accordance with AASB 10 Consolidated Financial Statements, Paragraphs 5 to 18, Appendices A (Defined Terms) and B (Application Guidance).

Joint control The contractually agreed sharing of control of an arrangement, which exists only when decisions about the relevant activities require the unanimous consent of the parties sharing control.

Joint venture An arrangement of which two or more parties have joint control and have right to the net assets of the arrangement.

Joint venture party A party to a joint venture that has joint control of that joint venture. KMP Person(s) having authority and responsibility for planning, directing and controlling the activities of Council. Specifically, KMP of Council are the:- (a) Mayor; (b) Councillors; (c) General Manager; (d) Managers; (e) Public Officer.

KMP Compensation All forms of consideration paid, payable or provided in exchange for services provided and may include:-

Short-term employee benefits, such as wages, salaries and social security contributions, paid annual leave and paid sick leave, profit sharing and bonuses (if payable within 12 months of the end of the period) and non-monetary benefits (such as medical care, housing, cars and free and subsidised goods or services) for current employees;

Post-employment benefits such as pensions, other retirement benefits, post-employment life insurance and post-employment medical care;

Other long-term employee benefits, including long service leave or sabbatical leave, jubilee or other long service benefits, long-term disability benefits and, if they are not payable wholly within 12 months after the end of the period, profit sharing, bonuses and deferred compensation;

Termination benefits; and

Share-based payment.

Materiality The assessment of whether the transaction, either individually or in aggregate with other transactions, by omitting it or misstating it could influence decisions that users make on the basis an entity’s financial statements.

Ordinary citizen transactions Transactions that an ordinary citizen would undertake with Council, which are undertaken on arm’s length terms and in the ordinary course of carrying out Council’s functions and activities. Examples of ordinary citizen transactions assessed to be not material in nature are: (a) paying rates and utility charges; (b) using Council’s public facilities after paying the corresponding fees. Related party A person or entity that is related to Council pursuant to the definition contained in AASB 124, Paragraph 9. Examples of related parties of Council are:- (a) Council subsidiaries; (b) KMP; (c) close family members of KMP; (d) entities that are controlled or jointly controlled by KMP or their close family members.

Related party transaction A transfer of resources, services or obligations between the Council and a related party regardless of whether a price is charged. Examples of related party transactions are:- (a) purchases or sales of goods; (b) purchases or sales of property and other assets; (c) rendering or receiving of services; (d) rendering or receiving of goods; (e) leases; (f) transfers under licence agreements; (g) transfers under finance arrangements (example: loans); (h) provision of guarantees (given or received); (i) commitments to do something if a particular event occurs or does not occur in the future; (j) settlement of liabilities on behalf of Council or by Council on behalf of that related party.

Related party disclosure A document entitled Related Party Disclosure by Key Management Personnel in the form set out in Attachment A.

Significant influence The power to participate in the financial and operating policy decisions of another entity but is not control or joint control of those policies, as determined in accordance with Australian Accounting Standard AASB 128 Investments in Associates and Joint Ventures, Paragraphs 3, 5 and 6.

PRIVACY COLLECTION NOTICE RELATED PARTY DISCLOSURES BY KEY MANAGEMENT PERSONNEL Attachment B Purpose of Collection, Use and Disclosure Effective for annual periods beginning on or after 1 July 2016, Council must disclose certain related party relationships and related party transactions together with information associated with those transactions in its general purpose financial statements, in order to comply with Australian Accounting Standard AASB 124 Related Party Disclosures July 2015 (AASB 124). Related parties include Council’s key management personnel (KMP), their close family members, and any entities that they or any of their close family members control or jointly control. A related party transaction is any transaction (whether a transfer of resources, services or obligations) between the reporting local government and any of the related parties, whether monetary or not. If there is a related party transaction with Council applicable to a reporting financial year, AASB 124 requires Council to disclose in the financial statements the nature of the related party relationship and information about the transaction, including outstanding balances and commitments associated with the transaction. Disclosure in the financial statements may be in the aggregate and/or made separately, depending on the materiality of the transaction. For more information about Council’s disclosure requirements under AASB 124, please refer to Council’s Related Party Disclosure Policy. Notifications by Key Management Personnel In order to comply with AASB 124, Council has adopted a policy that requires all members of its KMP to periodically provide notifications to the Executive Assistant of any existing or potential related party transactions between Council and any of their related parties during a financial year, and any changes to previously notified related party relationships and transactions relevant to the subject financial year. To this end, each KMP must provide a Related Party Disclosure, in the approved form, notifying any existing or potential related party transactions between Council and any related parties of the KMP, to the Executive Assistant by no later than the following periods during a financial year:- 30 days after the commencement of the application of this policy; 30 days after a KMP commences their term or employment with Council: 30 November (each year); and 30 June (each year).

Note, these related party disclosure requirements are in addition to the notifications KMPs are required to make to comply with Council’s adopted Code of Conduct. This includes disclosures relating to Conflicts of Interest (Pecuniary and Non Pecuniary) and Gifts and Benefits. Council’s Auditors may audit related party information as part of the annual external audit.

What is an entity that I, or my close family member, control or jointly control? Entities include companies, trusts, incorporated and unincorporated associations such as clubs and charities, joint ventures and partnerships. Control You control an entity if you have:-

(a) power over the entity; (b) exposure, or rights, to variable returns from your involvement with the entity; and (c) the ability to use your power over the entity to affect the amount of your returns

Example of control Fred is the Mayor of Sunny Shire Council and owns 100% of the ordinary shares in Sunny Development Company Pty Ltd (the company). The ordinary shares are the only shares in the company that have voting rights. Fred controls the company because he has the power to affect the company’s decisions and the return that he will get from the company. Fred will need to include the company on his related party disclosure.

Joint control To jointly control an entity there must be contractually agreed sharing of control of the entity, which exists only when decisions about the relevant activities require the unanimous consent of the parties sharing control.

Example of joint control Fred is the Mayor of Sunny Shire Council and owns 50% of the ordinary shares in Sunny Development Company Pty Ltd (the company). Fred’s brother Stan owns the other 50% of the ordinary shares. Fred and Stan are the only Directors of the company and have equal voting rights on the board. Fred and Stan have joint control of the company because any decisions require the unanimous consent of them both. Fred will need to include the company on his related party disclosure and the entity’s related party relationship with Fred and Stan.

In some cases, it will be obvious that you or a family member control or have joint control over an entity. In other cases it will be less clear. If you are unsure whether you, or a close family member, has control or joint control of an entity then you should contact the Responsible Accounting Officer for a confidential discussion.

GENERAL MANAGER’S ACTIVITY REPORT

Report: 3/2017 “From the GM’s Desk”

23rd February 2017 The NSW Deputy Premier, the Hon. John Barilaro, MP, Minister for Regional Development, Minister for Skills and Minister for Small Business will be the key note speaker at the Western Division Shire Conference to be held in Wentworth commencing on Sunday, 26th February and finishing on Tuesday, 28th February 2017. Also attending the Conference will be the Member for Murray, Adrian Piccoli and the Parliamentary Secretary for Western Division, Rick Colless MLC. The Deputy Premier will attend the conference all day on the Monday and join delegates for the Conference Dinner that night. We are fortunate that the Deputy Premier has been able to make his time available to attend particularly given his busy schedule. One of the questions that will no doubt be asked of the Deputy Premier will be the future of the Far West Initiative (FWI) and if it is to continue, what form it will take and how it will be funded. The Mayor, Councillor, Barry Hollman, Deputy Mayor, Councillor Lachlan Ford and I will travel to Wentworth for the conference and will be interested to hear the address and comments from the Deputy Premier. Bourke Shire Council has lodged a number of motions to the conference, some of which are designed to reinforce the existing policy of the Local Government Association of New South Wales whilst others deal with contemporary issues within Local Government.

The Welcome to Bourke Night held on Tuesday at the Bourke Swimming Pool was very well attend with around 80 people in attendance and it was also good to see a number of representatives from the various organisations in town. The function was hosted by Bourke Shire Council in conjunction with Bourke Rotary Club and representatives of both organisations were on hand to welcome the newcomers to town with each of the new residents receiving an information pack.

At the Western Division Conference in Wentworth I intend catching up with the Cross Border Commissioner, James McTavish to progress the concept of the cross border promotion of Southwest Queensland and Northwest New South Wales from a tourism perspective. The area has a lot to offer and if we can encourage visiting the area each of the towns can promote the attractions of the neighbouring towns no matter which side of the border they are located. I have raised the cross border tourism promotion with Local Member, Kevin Humphries, MP and he provided the suggestion that we look to James as the first contact point.

Dan Simmons resigned from his role at Brewarrina in November 2016 and his last day as General Manager of Brewarrina will be tomorrow 24th February 2017. Dan and I have enjoyed a good working relationship, sharing information and opinions and we have worked together on a number of matters as well as travelling to meetings together. I would like to wish him all the best for the future as he moves back to the central west.

The “red alert” for blue green alae at Louth remains in place and the issue of amber alerts for a number of other locations, including Bourke, a reminder to all residents to exercise caution in those parts of the river. If we continue to get hot weather and low river flows there will be an increased probability of getting further outbreaks along the river system. Full details in relation to what the alerts mean for domestic, recreational and stock use is contained on the New South Wales Department of Water website www.dpi.nsw.gov.au

The height in the Darling River has been around 4.06 metres over the past few days. Council staff members regularly monitor the flows and try and estimate the impact of these flows locally and it is anticipated that the flow will continue to go over the weir for a little while yet. Again, I remind residents to be “water wise” and don’t waste water.

The introduction of the New South Wales Emergency Services Property Levy (ESPL) will see a charge appear on 2017/2018 rate notices to cover the cost of providing emergency services within our community. The charge was previously attached to insurance policies, however, with a number of people electing not to insure, this method was deemed to place an unfair burden on those who did insure and the attaching of a charge to a rate is seen as a more equitable way of providing the funding. I SHOULD STRESS THAT WHILST THE CHARGE LEVIED WILL BE COLLECTED IN CONJUNCTION WITH THE RATES. THE MONEY COLLECTED FOR THE ESPL WILL BE FORWARDED TO THE STATE GOVERNMENT AND WILL NOT REMAIN WITH COUNCILS. Councils will levy the charge and collect it and will receive a fee for doing so but it will effectively be on a cost recovery basis.

As part of the charge for the ESPL new Land Values for all Councils have been issued and will be utilised for the levy of the 2017/2018 rates. The new valuations will ensure that there is a consistency of charges for all Councils in relation to the ESPL. Bourke Shire only had new land values put in place two years ago and the introduction of this latest valuation will see some changes to the rates levied on individual properties. The total valuation of the Shire has increased dramatically over the past two (2) years and has jumped by around 38% with the total valuation for the Shire going from $150,000,000 to $213,000,000. The biggest increase will be in the farmland category where the average increase is around 45%.

Council’s TOTAL rate income for general rate is pegged at 1.5% so the TOTAL rate income can only increase by the 1.5%; however, the rates for individuals will depend on whether or not their valuation increase was above or below their category average. There are some significant increases to some properties well in excess of their category average and the Valuer General will be sending out valuation notices to all owners which will detail the new valuations applicable to all properties. Any queries in relation to valuation should be directed to the office of the Valuer General whose contact details will appear on the valuation notice.

Council accounting staff, as well as undertaking their normal duties are also preparing for the change to a new computer software package which will hopefully take place early in the 2017/2018 financial year. Whilst the software will be primarily focussed on accounting applications a number of the modules with be installed that will be beneficial to other departments across Council. The new system will provide the opportunity to more readily access data in a format required by some of the agencies to whom we regularly report.

Local racehorse trainer, James Hatch, will be taking his horse Stoneyrise to Sydney for the final of the Country Championship following its victory in the Western Racing Country Championship Qualifier held at Dubbo on the weekend. The final of the Country Championship has prizemoney of $400,000.00 and will be run at Royal Randwick on the 1st April and Stoneyrise will no doubt have the support of lots of local horsing racing enthusiasts on this big occasion. James is based at Hungerford and despite only having a very small team in training has been very successful, and this win and the impending trip to Randwick is certainly a significant milestone in his career. Stoneyrise had its first race as a maiden at the Bourke Races in 2014.

Mr Barilaro also reconfirmed that mergers were never considered for the eight (8) Far West Councils of NSW. Ms Upton has added that the NSW Government was committed to building on the goodwill established with Councils, state agencies and communities through the Far West Initiative.

The NSW Deputy Premier, the Hon. John Barilaro, MP, Minister for Regional Development, Minister for Skills and Minister for Small Business was the key note speaker at the Western Division Shires Conference, hosted by Wentworth Shire, on Sunday, Monday and Tuesday. At the conference Leigh Bryon, Mayor of Balranald Shire was re-elected President, Deputy Mayor of Broken Hill Dave Gallagher elected Vice President, Cr Peter Nunan from Balranald and Mayor of Bourke Barry Hollman were elected to the Executive.

Bourke Shire Council lodged a total of 16 motions at the conference including those on the need for the strengthening of rural communities and the provision of incentives for firms to relocate, the consideration to remote communities when designing the Container Deposit Scheme and the ability to provide any mandatory Councillor training by flexible learning. Others included the costs incurred by Council in disposing of indiscriminately disposed needles and the need for further education in the area, the lack of mobile phone services and the need to ensure that the recently announced cutback in staff by Essential Energy does not lead to delays in effecting repairs and outages.

The Mayor, Councillor Barry Hollman will be away on the 6th March so the next opportunity to discuss issues with him will be the 13th March 2017. Mayor Hollman is generally available from 2.00pm to 4.00pm of a Monday at Council’s offices.

The next meeting of the Orana Regional Organisation of Councils (OROC) will be held on Friday, 10th March at Dubbo. The Mayor and I will be travelling down to attend.

The “Welcome to Bourke” night held last week was fortunate to be able to showcase some of the local talent with the Dirt River Band, Frank Povah, the Bourke Community Choir and the Black Stump Boot Scooters all on hand to provide entertainment to what was a very good crowd with a good mix of newcomers and locals.

A warm welcome back to the Far West of NSW to the newly appointed General Manager of Brewarrina Shire, Jeff Sowiak, who started work on Monday. Jeff is no stranger to the isolated areas of Australia having lived in Boulia in North West Queensland prior to coming to Brewarrina.

The height in the Darling River has dropped to 4.00 metres over the past few days with less than 100 mega litres flowing over the weir. While there is only a limited flow it is anticipated that the flow will continue to go over the weir for a little while yet with the cessation of flow over the weir being the trigger point for water restrictions to be introduced. Again, I remind residents to be “water wise” and don’t waste water.

Council has resolved to seek public comment regarding the need to continue to maintain airstrips at Enngonia, Ford’s Bridge and Byrock. Each of the strips have very limited usage and still need to be maintained and checked periodically to ensure that there is no major problems and things like the windsocks are in good condition. An increased difficulty in maintaining the strips has prompted a review of the need to keep them operational.

I had a visit from Stuart Telfer the Motoring Events Manager and Brian Hoare a Board Member of Variety – The Children’s Charity, who is responsible for the conduct of the Variety Bash last week to let me know that they will be in town the night of the 3rd August 2017. They expect to have around 120 cars in town for the night so accommodation will be at a premium. Bourke has been a very popular stopover for a number of these “bash” type events and the organisers are very happy with the assistance and cooperation they have received from the people and organisations within Bourke.

Senior Citizens Week starts this Sunday with a barbeque being hosted by Bourke Shire Council and the Bourke CWA at the Back O’ Bourke Exhibition Centre Café. RSVPs for the event were to be lodged with Bourke Shire by the Wednesday, 1st March 2017. There are activities on each day over the week with the exception of the Saturday.

Council at the last meeting considered a report in Closed Council regarding the level of outstanding debt that Council currently has and has asked the staff to develop a strategy aimed at significantly reducing this high level of debt. As part of that strategy Council staff will be working closely with the debt collection agency to remind people of their level of debt and the need to meet their obligations. A number of residents have already received letters indicating that they will be subject to legal proceedings if they don’t pay their outstanding debts. The cost of the legal proceedings is added to the debt, so it is in their interest to make the payments or come into Council to make suitable arrangement.

Council will be reverting back to Mondays for the conduct of its normal monthly meetings with the meetings to be held on the 4th Monday at 9.00am unless otherwise determined by Council. Council had previously resolved that the April meeting will be held on Wednesday, 26th April this will remain. Council had in September 2016 following the elections resolved to hold the meetings on a Tuesday; however, with this proving unsuitable to a number of Councillors the Monday was again selected.

The Jandra will be subject to inspection next week by the Roads & Maritime Services staff and following this inspection all should be in readiness for the upcoming tourist season. The Jandra is one of the major drawcards in attracting tourists to our town and encouraging them to stay an extra night or two. While on tourism I would urge each and every resident of Bourke to be an ambassador for the town and if you get the opportunity to speak to our tourists make them feel welcome, suggest things they can do and the attractions that are available. A welcoming town will provide an incentive to stay but importantly recommend the town to friends or others they meet during their travels.

9th March 2017 The NSW Deputy Premier, the Hon. John Barilaro, MP, Minister for Regional Development, Minister for Skills and Minister for Small Business at the Western Division Conference spoke about the Far West Initiative in detail and with his address leading to media reports that the Far West Initiative may not proceed. However, announcements made subsequent to Wentworth Conference all indicating that the reform process for the Far West will continue. The initial concept of the Reform of the Far West was to see a “whole of government” (Federal, State and Local) approach taken to the improvement of service delivery in the Far West and to look at ways to increase the sustainability of the eight Councils in the Far West. However, this seems to have drifted into looking solely at the operation of Local Government which was not going to address some of the systemic issues in each of the communities. The Deputy Premier indicated that he would like to see Councils in the Far West be more involved in developing a model that they would be comfortable with and looked forward to working with Councils in this regard.

The Deputy Premier in his address also indicated that it is anticipated that there will be significant funds available for the improvement to infrastructure in regional and rural New South Wales and encouraged Councils to have “shovel ready” projects in preparedness to take advantage of the

availability of the funding. In response to a concern that many Councils, including those in the far west who don’t have the available funds to develop the detailed submissions required to enhance their chances of securing the available funding, the Deputy Premier indicated that this problem was one that would be addressed.

With the expectation that Councils need to adopt a greater lead in any reform process and to be the drivers of the process and not the followers, the Chairman of the Western Division of Councils, Councillor Leigh Byron, has convened a meeting of all Western Division Councils at Broken Hill on the 24th March 2017 as the first step in ensuring that Local Government has an increased involvement in the reform process. While we now have the technology available to negate the long trip to Broken Hill it is felt the first meeting should be a face to face meeting. The Mayor and General Manager of each of the Councils have been invited to attend.

The Mayor Councillor Barry Hollman will be available to discuss issues relating to Council or for issues for which Council may be able to provide some assistance on Monday, 13th March 2017. Mayor Hollman is generally available from 2.00pm to 4.00pm on a Monday, with the exception of the 4th Monday of each Month which of course is Council Meeting Day.

The Mayor and I will be travelling to the quarterly meeting of the Orana Regional Organisation of Councils (OROC) which will be held on Friday, 10th March at Dubbo. Following the OROC Meeting all members Councils have been invited to attend the launch of Regional Platters. Regional Platters is aimed at connecting the regional agricultural producers and experience with people. Regional Platters is supported by Dubbo, Gilgandra, Mid- Western, Narromine, Nyngan, Warren Warrumbungle Councils In Dubbo it is hoped to be able to set aside an hour or so to meet with representatives of the other OROC members who are also involved with the Far West Initiative (FWI) to discuss options leading up to the meeting of Western Division in Broken Hill on the 24th March 2017.

A reminder, that Council will be reverting to Mondays for the conduct of its normal monthly meetings. The flow in the Darling River continues to drop with only 72 mega litres per day flowing over the weir as of late Monday. While there is a limited flow it is anticipated that the flow will continue to go over the weir for a little while yet with the cessation of flow over the weir being the trigger point for water restrictions to be introduced. The rain on Saturday night provided a much needed lift for gardens and pastures and also put a little extra in the weir pool.

The approaches to the Whiskey Creek Bridge on the West Culgoa Road have been recently sealed with around a kilometre of bitumen being laid and the guardrail to be installed shortly.

Work will commence shortly on the sealing of Dunsandle Road which is adjacent to Clara Hart Village in Enngonia. The work will involve around one kilometre of road finishing near the Enngonia Waste Depot turn off. The funding for the project was made available under an Aboriginal Communities Road Safety Programme and will result in a significantly improved road surface and a reduced nuisance and hazards caused by dust.

It was a great start to Senior Citizens Week last Sunday with a barbeque lunch being hosted by Bourke Shire Council and the Bourke CWA at the Back O’ Bourke Exhibition Centre Café. Around sixty people enjoy a barbeque lunch followed by some delicious deserts provided by the Bourke CWA and some lucky attendees were the recipients of lucky door prizes. Councillor Sarah Barton represented Council at the function with the Mayor Barry Hollman and Deputy Mayor Lachlan Ford both being away. Councillor Barton and Councillor Bartley were the cooks for the day and did a great job. There have been activities all week and Bourke Shire is proud to be actively involved in the provision of Senior’s Week Activities for its residents.

The Jandra was successful in meeting all requirements during an inspection earlier this week by the Roads & Maritime Services staff and all should be in readiness for the upcoming tourist season.- There are already several charters booked for the coming week prior to starting the daily cruising season.

While in Wentworth I had some discussions with the Regional Manager of Public Works, Gavin Priestley regarding the possibility of some of the maintenance contracts for the State Government being split so that local contractors can have the opportunity to submit tenders. While I accept that economies of scale would tend to indicate that the current model may give a more economic outcome it does little to help the economies of small town and equally does not provide the opportunities for the local contractors to be able to employ apprentices and retain the young people in the rural areas. We can give all the political rhetoric we like about the small contractors

not having the correct systems in place in relation to WHS and Environmental Management the simple fact is they can do the work as cheaply and effectively but are put off by the size of the contracts and the cash flow and other resources needed to be able to gear up to undertake the contracts of such a huge scale. Gavin was certainly sympathetic to the issue and we will continue our discussions over the next few weeks. During the course of the conference the Deputy Premier made the comment that in some instances some things don’t stack up when subject to a business case but would stack up on a whole of community benefit. Certainly the awarding of these contracts on a more localised basis would be one of these times when the community benefits should be put before a business case.

16th March 2017 Last week the Treasurer of NSW, the Hon Dominic Perrottet, MP tabled legislation in the NSW Parliament to establish the Fire and Emergency Levy (FESL) the proposed levy was previously known as the Emergency Services Property Levy (ESPL) and the levy will be collected by Councils alongside Council rates from 1st July 2017. The FESL will replace the levy that was previously attached to insurance policies. There has been a lot of work that that has been required to be undertaken by Councils in preparation for the introduction of the levy and Bourke Shire Council has been working with Local Government New South Wales to ensure that Councils in this part of the state are adequately compensated for both the preliminary work and the ongoing work. The introduction of the levy requires all properties to be given a FESL Classification and Councils are required to notify landowners of the classification by 30th April 2017.

The Institute of Public Works Engineering Australia NSW Division (IPWEA) have been holding a series of Regional Forums with the ORANA Regional Forum being held in Bourke yesterday and brought together industry representatives from across the region and also representatives of the sponsoring organisations involved in the Forum. The representative of the Roads and Maritime Services was Jason Gordon, Manager Technical Operations and Support for the RMS. Jason is of course a local from Bourke having commenced his career at Bourke Shire Council. Councillor Hollman as Mayor of Bourke Shire was asked to provide a welcome address and provide an outline of some of the work occurring within the Shire. The group took advantage of the opportunity to take a cruise on the Jandra on Tuesday evening and they were joined by both Councillors and staff of Bourke Shire.

The Member for Barwon, Kevin Humphries, MP was in town yesterday and was one of the speakers at the IPEWA Regional Forum. Whilst he was in town Kevin met with Council and a number of issues were raised with him, including the Far West Initiative, the proposed funding for infrastructure projects which is expected to be announced shortly, Health Services and the Murray Darling Basin Plan.

Councillor Leigh Byron from the Western Division of Councils, has convened a meeting of the Executive at Broken Hill on the 24th March 2017 to look at options for the Far West Initiative and all Council Mayors and General Managers are invited to attend. Mayor Councillor Hollman is a member of the executive and will be attending.

Mayor Hollman is generally available between 2.00pm to 4.00pm of a Monday to discuss any issues with residents, except the 4th Monday of each Month which of course is Council Meeting Day.

The Mayor and I attended the quarterly meeting of the Orana Regional Organisation of Councils (OROC) held last Friday in Dubbo. The meeting touched on a number of issues including a report from Steve Loane the General Manager of Warrumbungle Shire on the recent fires that impacted on his Council, Upper Hunter and Mid-Western Councils and the magnitude of the losses incurred. Peter Halyburton, Principal of Energy Management Services who has provided a consultancy role on electricity matters for OROC Members for a number of years, was on hand to give delegates an insight into the way electricity prices are calculated and the impact on the availability of generating capacity including coal, gas, solar and wind on the pricing both now and into the future.

Whilst in Dubbo the opportunity was taken to meet with the other three (3) Councils proposed for the Far West Initiative (FWI) being Cobar, Walgett and Brewarrina Shires, to discuss options leading up to the meeting of Western Division in Broken Hill on the 24th March 2017 and it was decided to seek a meeting with the Premier, Deputy Premier and Minister for Local Government to ascertain a clear direction for the four (4) Councils. The fact that each of the Councils had already spent considerable resources on reviewing a number of proposals and models over the past three (3) years with little in the way of tangible results has proven frustrating for all Councils. Each of the four (4) Councils had expressed a desire to retain their affiliation with OROC and the Orana Region.

Mayor Barry Hollman and I also met with Shane Hatton, the State Manager of Rural and Remote Medical Services (RaRMS) over breakfast to get an update in relation to the operation of RaRMS in Bourke. Shane happened to be in Dubbo last Friday and when learning of the fact that OROC was meeting in Dubbo we took the opportunity to facilitate the meeting which was very productive and provided the opportunity for both parties to raise issues of concern and get an insight into the provision of medical services in the town.

The flow in the Darling River although only relatively small, continues to go over the weir which is good news for all gardeners with the possibility of water restrictions averted for a little while yet. It is particularly good news for our Parks and Gardens Staff who are ensuring they have the town looking good for the Easter Weekend and in particular the Renshaw Oval (Racecourse) Complex.

Senior Citizens Week for 2017 wrapped up last Sunday with a barbeque lunch being hosted by Bourke Rotary with members of the Royal Far West and Bourke CWA combining to provide the deserts. Each of the guests received a souvenir tea-towel to mark Seniors Day in Bourke 2017. Local Barrister, John Thompson was guest speaker for the day speaking on the importance of preparing and keeping a Will updated and the various avenues available for the making of a Will. On behalf of Council I would like to thank all those people within the community who assisted in the coordination and hosting of the events during Senior’s Week 2017 and a special thankyou to Community & Governance Officer, Letiticia Tiffen for the overall coordination of the week long activities and Kellie Honeyman who provided assistance to Letiticia particularly during the two weekend functions.

The New South Wales State Government last week announced funding of $300 million through Restart NSW Regional Growth- Environmental and Tourism Fund. The program aims to increase tourism visitation to regional NSW by investing in regional environmental and tourism infrastructure. A briefing session in relation to the allocation of the first round of the funding which amounts to $100 million will be held in Sydney today with the opportunity to participate in person or by Webcast. The briefing will provide prospective applicants the objectives of the initial round and the requirements for the expression of interest process.

The work at Enngonia that I mentioned in my column last week will also see the road into the Enngonia Cemetery sealed and a carpark established at the cemetery which will significantly improve the area.

The provision of facilities in the village areas is an ongoing project with public toilets to be built at both Wanaaring and Enngonia.

Council will seek to obtain funding for the construction of toilets on the highways and main roads leading into Bourke. During our recent trip to Wentworth we noticed that the RMS has funded a number of toilets facilities on the Wilcannia to Cobar Road and there is also a toilet block east of Nyngan. If Councils are to try and attract tourism to the regions it would be advantageous if similar facilities could be funded in this part of the state.

Craft & Storytime theme this month was Superheroes, in line with the theme for the Summer Reading Club. This month the session was combined with a party to conclude the Summer Reading Club. The kids dressed up as the favourite superhero. We had 13 children attend.

A display was put up in the library for Valentine’s Day this month.

We have been busy this month updating the Premiers Reading Challenge books, removing old books and adding new ones, ready for the challenge to begin in May.

Report: BOBEC and VIC February 2017 Activity update

Throughout February the hot weather has continued to keep numbers relatively low with some pick up noticeable through to the end of January. In February work also continued on the Jandra making it ready for it’s out of water survey in early March. Work to the Jandra included repainting the hull and ensuring the gates that screen the paddles were free from rust before repainting. Overall the Jandra remains in excellent condition with no issues found during its survey.

At the beginning of March the Centre resumed seven day per week operations in readiness for the visitor season.

Phil Johnston Manager of Tourism & Development Land Valuation Manager of Corporate Services, Leonie Brown tabled a copy of a summary of the changes to the valuations within the Shire. A copy was distributed to all Councillors. General Manager, Ross Earl advised that the changes to the valuations had been advertised and queries were to be referred to the Valuer General. Cr Cole returned to the meeting at 11.10am

CLOSED SESSION OF COUNCIL

Matters deemed to be of an urgent nature The Mayor, Councillor Barry Hollman indicated that he would like to discuss as a urgent matter, the issue of the recent spike in anti-social behaviour in Bourke, however, some of the information had been relayed to him in confidence by individuals who thought that the matter should be referred to Closed Council. Pursuant to section 10A (2) (a), the public were invited to make representations to the Council Meeting before the meeting was closed, as to whether the meeting should be closed to consider the identified CONFIDENTIAL report. No members of the public made representation. Resolution at 11.19am

120/2017 1. That Council move into Closed Council to consider business identified, together with any late

reports tabled at the meeting. 2. That pursuant to section 10A (1)-(3) of the Local Government Act 1993, the media and public be

excluded from the meeting on the basis that the business to be considered is classified confidential under the provisions of section 10A(2) as outlined above

3. That the correspondence and reports relevant to the subject business be withheld from access to the media and public as required by section 11(2) of the Local Government Act 1993.
