Regional Policy Statement Change 3 (Rangitāiki River) Area covered: Rangitāiki River catchment only What the plan change does: Proposed Change 3 introduces new issues, objectives, policies and methods specific to the Rangitāiki River catchment in a new Treaty Co-Governance chapter 2.12 in the Regional Policy Statement (RPS). Proposed Change 3 seeks to fulfil Regional Council’s responsibilities under the Ngāti Manawa and Ngāti Whare Treaty Settlement Claims Acts 2012 which requires the RPS recognise and provide for the vision, objectives and desired outcomes of the Rangitāiki River Document. In general terms, Proposed Change 3 involves: Introducing a new Treaty Co-governance chapter into Part 2 of the RPS, as section 2.12 Locating the Rangitāiki River change and subsequent treaty co-governance changes to the RPS in this chapter Including the eight objectives from the Rangitāiki River Document, with policies and methods derived from the actions and desired outcomes of the River Document Including a new Map 4aa showing the extent of the change to which the specific Rangitāiki River provisions apply Including the complete Rangitaiki River Document in a separate treaty co-governance compendium document. Regional Policy Statement

Regional Water and Land Plan Note:

• The Regional Water and Land Plan is being extended will become the Regional Resource Management Plan. The Regional Coastal Environment Plan will remain a separate document.

Plan Change 9 (Region-wide Water Quantity) Title: Region-wide water quantity – Plan Change 9 Area covered: Whole of region What the plan change does: Revises the existing framework for water allocation (taking or using water from streams and underground aquifers) to fix some existing problems and improve the efficiency of water allocation. It is a step towards implementing the National Policy Statement for Freshwater Management. Matters of particular interest to iwi/hapū:

• Existing limits for water allocation strengthened. • Enhanced requirements for water users to meter and report water use (the volumes used on

Marae, urupa and individual households are not required to be metered). • Objectives and policies for integrated management of freshwater resources that reflect

tangata whenua values and aspirations and incorporate matauranga Māori. • Requirement to consider relevant iwi and hapū resource management plans and to take

account tangata whenua values when processing resource consents • Specific policies and rules that enable transfer of resource consents to take water. The

potential effects of any transfer on tangata whenua values, including those of the owners of Māori land must be considered.

• A report “Assessment of water availability and estimates of current allocation levels” is now available, so people can see how much water is allocated in the region.

Plan Change 10 (Lake Rotorua Nutrient Management) Title: Plan Change 10: Lake Rotorua Nutrient Management Area covered: Rural production activities within the Lake Rotorua groundwater catchment. What the plan change does: Introduces new rules that require a staged reduction of nitrogen from farming activities located within the Lake Rotorua groundwater catchment. Farming activities with an effective area over 10ha are the key focus of Plan Change 10. Farms between 5ha and 10ha in effective area are permitted subject to complying with a stocking rate table and activities not being commercial in nature. The outcome will be a 320tN reduction by 2032 to achieve the sustainable nitrogen load of 435tN. Matters of particular interest to iwi/hapū: Lake water quality – The plan change intends to contribute to enhancing and maintaining the water quality of Lake Rotorua. Plan Change 11 (Geothermal Provisions) Title: Geothermal • Plan Change 11 to the Regional Water and Land Plan – Geothermal Provisions • Plan Review of the Rotorua Geothermal System Regional Plan Area covered: Whole region. What the plan change does: Plan Change 11 and the Rotorua Geothermal Regional Plan Review will involve a review of provisions for the allocation of geothermal energy and fluid. The change will focus on:

• Sustainability -checking current use of the resource and scientific modelling to ensure that the resource is available long term and to protect special features and values)

• Efficiency – how we allocate to make sure the resource is not wasted (eg. not allocating more than people need)

• Values - identifying significant geothermal features and policies to protect these Matters of particular interest to iwi/hapū: • Identification and protection of significant geothermal surface features (including how Māori

value those places) • Geothermal potential/allocation for Māori land (eg. conditional development fields – Tikitere,

Rotomā, Taheke) • Limits to use to protect surface features (eg. in Rotorua city), while ensuring traditional uses

Plan Change 12 (Freshwater Futures) Title: Freshwater Futures Programme - Kaituna-Pongakawa-Waitahanui and Rangitāiki Water Management Area - Plan Change 12 Area covered: Rangitāiki catchment (excluding Lake Rerewhakaitu catchment); Kaituna catchments draining to Maketū estuary (excluding lake Rotoiti and Rotorua catchments); Pongakawa and catchments draining to [Little] Waihī estuary; Waitahanui catchment What the plan change does: Through the National Policy Statement for Freshwater Management 2014 (NPSFM), central government has directed regional council’s to improve the way that fresh water is managed so that:

• Our lakes, rivers, streams, wetlands and the estuaries they flow into are kept healthy. • Freshwater quality and quantity allocation decisions are well informed, sustainable, efficient

and based on agreed limits. • Te Mana o te Wai (the relationship between; the health and mauri of water; the

environment and of the people) is recognised. • Native plants and animals can thrive in healthy freshwater habitats.

Proposed Plan Change 12 will set out the intended freshwater environmental outcomes, stated as ‘objectives’ for the Rangitāiki and Kaituna-Pongakawa-Waitahanui WMAs. Freshwater quality and quantity limits required to meet those objectives will be established, along with rules and other methods to manage land and water use to enable freshwater environmental outcomes to be achieved. Any new water quantity limits and methods will supersede region-wide default water quantity allocation limits established by Plan Change 9 to the Regional Water and Land Plan. Matters of particular interest to iwi/hapū: The Council will take reasonable steps to involve iwi and hapū in identifying tangata whenua values and interests in fresh water while developing the plan change, and those values and interests are to be reflected in decision making regarding the plan change. Involvement is being/will be sought primarily by invitation to hui-a-iwi, meetings with iwi and associated hapū, and for iwi to place a person on community groups. The plan change will give effect to freshwater quality and quantity aspects of Proposed Regional Policy Statement change 3: Rangitāiki. It will also have particular regard to Te Maru o Kaituna’s river document Kaituna, he taonga tuku iho – a treasure gifted to us (yet to be published for consultation) and Te Ara Whanui O Rangitāiki: Pathways of the Rangitāiki. Plan Change 13 (Air Quality) Title: Plan Change 13 (Air Quality) to the Regional Water and Land Plan. This will replace the Operative Regional Air Plan. Area covered: Whole region. What the plan change does: The plan change will replace the current policies and rules to manage discharges of contaminants to air in the region. Matters of particular interest to iwi/hapū: Iwi and hapū located near industrial areas particularly Mount Maunganui, Ngāpuna, Kawerau (exposure to contaminants) Protecting the mauri of air Iwi and hapū with horticultural business activities and/or within horticultural areas (exposure to agrichemicals) Timeframes: Drafting plan change Completed Release of draft plan change for consultation Completed Notification of proposed plan change April – June 2017 Submissions period June – July 2017 Hearing August – September 2017 Decisions released November 2017 Who to contact: Karen Parcell, Senior Policy Analyst: [email protected]

Plan Change 14 (OSET) Title: Plan Change 14 (OSET) to the Regional Water and Land Plan. This Plan Change will replace the current On-site Effluent Treatment Regional Plan. Area covered: Whole region. What the plan change does: Updates policies and rules for on-site effluent treatment systems (OSET systems). Includes septic tanks, AWTS, pit latrines/long drops, greywater discharges, Papakāinga developments. Adds new rules for composting toilets. Updates rules for areas that will be reticulated. Clarifies rules for each of the Rotorua Lakes catchments, and co-ordinates regulations for OSET systems in Lake Rotorua with Plan Change 10 (Lake Rotorua Nutrient Management). Matters of particular interest for iwi/hapū: Policies and rules to control discharges of wastewater from OSET systems. Rules applicable to OSET systems for Papakāinga developments. Provisions relating to specific areas (Rotorua Lakes, and Maintenance Zones). Regional Pest Management Plan Title: Regional Pest Management Plan review. The next Regional Pest Management Plan will replace the existing one. Area covered: Whole region What the plan change does: The Regional Pest Management Plan is the key policy document that directs how pests (both plants and animals) are managed in the region. It is developed under the Biosecurity Act. The Plan will list pests that need to be managed, Council’s approach to managing them and who will be responsible for their management. Matters of particular interest to iwi/hapū: Ongoing protection of Māori values, opportunities for different pest management approaches and pest management implications for multiple-owned Māori land.
