The Goose Creek Village Proffer Amendment would remove a requirement that the applicant construct 20,000 square feet of office space before completing the residential component of the project. Under current proffers they can build 300 of the approved 564 townhouses and apartments. The applicant has built over 100,000 square feet of retail floor area but no office space. The Gateway Zoning Conversion is a request to convert from the PD-IP zoning district under the 1993 Zoning Ordinance to PD-IP under the Revised 1993 Ordinance. Until recently this presented no issues; however, the PD-IP district does not fully implement the new Route 28 policies and the policies now recommend conversions only where they support the planned land use. Staff and the Planning Commission have recommended approval of the conversion on the basis that it is consistent with Board practice and the conversion to the latest Ordinance is beneficial. of the upcoming cases prior to each public hearing. Supervisors will have already received the staff reports

for the upcoming February Public Hearing. The purpose of this item is to solicit any additional comments

or questions so staff may prepare a response for the hearing if time allows.

There are four land use applications on the agenda in February. To date there has been no public comment

on any of the applications and both the Commission and staff have recommended approval of the

applications. The Goose Creek Village Proffer Amendment would remove a requirement that the applicant

1. Northern Virginia Regional Water Supply Plan

Election District: Countywide

Pursuant to Virginia Code and a Memorandum of Agreement with the Northern Virginia Regional Commission (NVRC) and twenty-one (21) other Northern Virginia local governments the Board of Supervisors shall consider the adoption of the Northern Virginia Regional Water Supply Plan (Plan). The Plan includes information in regard to the following: 1) existing water sources; 2) existing water use; 3) existing water resource conditions; 4) assessment of projected water demand; 5) description of water management actions; 6) a statement of need if water demands exceed current and projected source availability; 7) analysis of alternatives to address projected water source/supply deficits; and 8) map(s) detailing program elements such as, without limitation, existing environmental resources, water sources, and water uses, and proposed new sources. The purpose of the Plan is to ensure adequate and safe drinking water; encourage, promote, and protect all other beneficial uses of water resources; and encourage, promote, and develop incentives for alternative water sources, for the Northern Virginia Region.

2. ZCPA-2011-0007, Goose Creek Village Proffer Amendment

Centex Homes of Fairfax, Virginia, has submitted an application to amend the proffers approved with ZMAP 2003-0008, Goose Creek Village North, to delete a requirement that office uses compose a minimum of 20,000 square feet of the 70,000 square feet of commercial development required before the Applicant can exceed 300 residential dwelling units (564 units were approved). There is no proposed change in density. The project is zoned PD-OP, PC-CC-CC, R-16, and R-24 zoning districts that make up the Goose Creek project. This application is subject to the Revised 1993 Loudoun County Zoning Ordinance. The subject property is approximately 20 acres in size, is

composed of 142 parcels, and is located on the west side of Route 659, and on the north side of the Dulles Greenway (Route 267). The policies of the Revised General Plan (Suburban Policy Area (Ashburn Community)) and the Toll Road Plan designate this area for Business uses and recommend a Floor Area Ratio (FAR) up to 0.4. On December 21, 2011, the Planning Commission forwarded the Zoning Concept Plan Amendment application to the Board of Supervisors with a recommendation of approval (7-2, Syska and Maio opposed). Staff recommends approval.

3. SPEX-2011-0020, Stone Ridge Land Bay 8 – Mini-Warehouse

SPEX-2011-0021, Stone Ridge Land Bay 8 – Child Care Center

Election District: Dulles

Stone Ridge Community Development IV, L.L.C., of Burke, Virginia, has submitted special exceptions to permit a mini-warehouse use in the GB (General Business) zoning district, and a child care center in the PD-IP (Planned Development-Industrial Park) zoning district. These applications are subject to the Revised 1993 Loudoun County Zoning Ordinance. The area of the proposed special exceptions is a 9.9 acre portion of a 27.39 acre parcel that is located south of John Mosby Highway (Route 50), west of Stone Springs Boulevard and on the north side of Tall Cedars Parkway. The policies of the Revised General Plan (Suburban Policy Area (Dulles Community)) and the Arcola Area/Route 50 Corridor Plan Amendment (CPAM 2005-0007) designate this area for Business Community uses and recommend a Floor Area Ratio (FAR) up to 1.0. The Planning Commission heard the applications at its December 21, 2011 public hearing. There was no public comment and the Commission voted 9-0 to recommend approval. Staff also recommends approval.

4. ZRTD-2011-0008, Gateway North Lots 1A & 1B

Sojourn Gateway Hotel Ltd. of Virginia Beach, Virginia, has submitted an application to rezone 11.88 acres from the PD-IP (Planned Development-Industrial Park) zoning district under the 1993 Loudoun County Zoning Ordinance to the PD-IP (Planned Development-Industrial Park) zoning district under the Revised 1993 Loudoun County Zoning Ordinance to permit the development of all principal and accessory uses permitted in the PD-IP zoning district. The property is located within the Route 28 Taxing District. The subject property is located on the north side of Route 606, between Pacific Boulevard and Route 28. The Revised General Plan (Suburban Policy Area (Ashburn Community)) and Route 28 Corridor Policy Area)

designates this area for Route 28 Core/Office Cluster uses, which encourages predominantly office

development at floor area ratios of 0.6 to 1.0. The Planning Commission will hear the application at their January 25 public hearing and the Board will receive an update on the Commission action prior to the February 7 public hearing. To date there has been no public comment. Staff is recommending approval of the application. The case has been “double advertised”; that is, scheduled for the Board hearing prior to Commission action, consistent with the Board policy of expediting ZRTD cases.

5. SPMI-2010-0003, Kingdom Hall

Election District: Catoctin

Leesburg Congregation of Jehovah’s Witnesses of Paeonian Springs, Virginia has submitted an application for Minor Special Exception to modify the additional regulations of Section 5-639 of the Revised 1993 Loudoun County Zoning Ordinance to continue the church use and allow for an expansion of the existing church building on a property not meeting the minimum 10 acre lot size and to reduce the 75-foot building setback on the north and south sides of the existing building to 33-feet and 42-feet respectively, to accommodate a 1,678 square foot expansion of the existing church building. No increase in church capacity is proposed. The subject property is 2.27 acres in size and is located northeast of Bridge

View Court (Route 1018) and east of Charles Town Pike (Route 9) and north of the Route 7 Bypass. The policies of the Revised General Plan (Rural Policy Area) designate this area for rural economy uses and limited residential development. The Planning Commission does not hear a minor special exception. Staff is recommending approval noting the church is a civic use supported in the Rural area and the changes will improve handicap accessibility.

6. ZOAM-2011-0004, Amendment to Section 6-500 of the Loudoun County Zoning Ordinance

(Enforcement and Penalties)

Pursuant to Sections 15.2-2204 and 15.2-2285 of the Code of Virginia the Board of Supervisors gives notice of an amendment to Section 6-500 of the Revised 1993 Loudoun County Zoning Ordinance to revise and add provisions related to enforcement of the zoning regulations and penalties for zoning violations. The Board of Supervisors initiated the amendment by resolution adopted on May 19, 2009. Section 6-502 is proposed to be amended to add a provision for the issuance of inspection warrants by a magistrate based on probable cause that a zoning violation has occurred with respect to the use or occupancy of a dwelling. Sections 6-503 and 6-504 are to be amended to provide that a violation arising from the same operative set of facts may be prosecuted as a criminal misdemeanor after civil fines total $5000 or more. The authority for this provision is Section 15.2-2209 of the Code of Virginia. The public purposes of these amendments are to achieve the purposes of zoning as set forth in Sections 15.2-2200 and 15.2-2283 of the Code of Virginia, including, without limitation, furtherance of the public necessity, convenience, general welfare and good zoning practice and facilitating the creation of a convenient, attractive and harmonious community.
