    SUMMARYThis enactment provides for the control by First Nations of their elementary

    and secondary education systems. It establishes a framework to enable FirstNations to exercise that control by administering schools situated on theirreserves, by delegating the power to administer schools to a First NationEducation Authority or by entering into a tuition or administration agreement.It also creates a right of access to elementary and secondary education topersons of school age who are ordinarily resident on a reserve, establishesthe Joint Council of Education Professionals, sets out the roles andresponsibilities of the main participants in First Nations education systems andprovides for the necessary funding. Finally, the enactment makes related andconsequential amendments to the Indian Act , the Mikmaq Education Act andthe First Nations Jurisdiction over Education in British Columbia Act .

    SOMMAIRELe texte porte sur le contrle par les premires nations de leurs systmes

    dducation primaire et secondaire. Il met en place un cadre leur permettantdexercer ce contrle par ladministration des coles qui se trouvent dansleurs rserves, par la dlgation de ce pouvoir une autorit scolaire ou parla conclusion dun accord relatif aux droits de scolarit ou dun accord relatif ladministration dcoles.     An Act to establish a framework to enableFirst Nations control of elementary andsecondary education and to provide forrelated funding and to make relatedamendments to the Indian Act andconsequential amendments to other ActsWhereas the Government of Canada, in

    its Statement of Apology on June 11, 2008to former students of Indian residentialschools, acknowledged past failures in thefield of First Nations education andcommitted to moving forward inpartnership with First Nations in a spirit of reconciliation;

    Whereas the Government of Canada rec-ognizes the importance of quality, child-

    centred education for the success of FirstNations children;Whereas First Nations education

    systems should be designed andimplemented in accordance with theprinciple that First Nations have control of their childrens education;

    Whereas First Nations must receivesupport that enables them to exercisetheir rights and fulfil their responsibilitiesrelating to the elementary and secondaryeducation provided to their children;

    Whereas First Nations children attendingschools on reserves must have access to

    Establishment 10. There is established a council, to beknown as the Joint Council of EducationProfessionals, consisting of a minimum of five and a maximum of nine members,including a Chairperson and Vice-chairperson.

    (a ) the Minister is not provided with aninspection report in respect of the schoolunder subsection 38(3);(b) after receiving an inspection report inrespect of a school that identifiessignificant problems of non-compliancewith the requirements under this Act, theMinister is of the opinion that adequatemeasures to remedy the problems have

    not been put in place;(c ) the Minister is of the opinion thatimmediate action is required to deal witha significant risk to student well-being andsuccess at the school; or(d ) the Minister is of the opinion thatimmediate action is required to deal witha significant risk that the responsibleauthority will not be able to comply withthe requirements under the Act due to itsbeing in serious financial difficulties.

    and the qualifications required of thosepersons;(f ) providing for the matters that must beaddressed in the school policies referredto in paragraphs 21(1)( d ) and 35(2)( b) and(f ), the school success plan referred to inparagraph 36(1)( a ) and the school safetyplan referred to in paragraph 36(1)( i );(g) respecting the management of aschools property for the purposes of paragraph 21(1)( g), including its operationand maintenance;(h) setting out the conditions that anagreement referred to in subsection 27(1)must meet and respecting designationsmade or revoked under subsections 27(3)and (5), respectively;(i ) respecting tuition agreements andadministration agreements for thepurposes of sections 23 and 24,respectively, including providing for theMinisters approval of the agreements andthe conditions of approval;

    ( j ) respecting schooling provided at homeor elsewhere for the purposes of section31, including the supervision of thatschooling and the circumstances in whichthe schooling may be discontinued;(k ) providing for minimum requirements forthe number of instructional hours andinstructional days in a school year;

    (l ) respecting insurance for the purposesof section 34;(m ) respecting the establishment andmaintenance of records for the purposes of paragraph 35(2)( e ), including providing for

    their content, and the provision of copiesto the Minister;(n) respecting school inspections,including when, and the manner in which,they are to be conducted and thepreparation and submission of inspectionreports for the purposes of sections 37and 38, and specifying the qualificationsof a person who is otherwise qualified forthe purposes of subsection 37(2);(o) establishing the methods of calculationreferred to in subsection 43(1);( p ) respecting the collection, use,disclosure, retention and disposal of information for the purposes of this Act;and(q) prescribing anything that by this Act isto be prescribed.

For the period beginning on the dayon which this section comes into force andending on June 30, 2017, this Act does notapply in any given school year in respectof the council of a First Nation or anyperson who is ordinarily resident on areserve of that First Nation if, in the 12months preceding June 30 of that givenyear,

    ( a ) a school situated on a reserve of that First Nation received assistance orservices under clause 4.1 or 4.2,respectively, of the Tripartite EducationFramework Agreement between HerMajesty the Queen in right of Canada,

    Her Majesty the Queen in right of BritishColumbia and the First NationsEducation Steering Committee thatcame into force on January 27, 2012;and

    ( b ) the council of that First Nation or anentity acting on its behalf was a party toa funding arrangement that compliedwith clause 5.1 of that Agreement.

Despite section 54, sections 114 to122 of the Indian Act , as those sectionsread immediately before the day on whichthat section 54 comes into force, continueto apply to a First Nation, and to theSechelt Indian Band established bysubsection 5(1) of the Sechelt IndianBand Self-Government Act , in respect of which, immediately before that day, thosesections 114 to 122 applied under an Actof Parliament or an agreement relating toself-government that is given effect by anAct of Parliament, as the case may be, tothe extent provided for in that Act oragreement.
