1.1 SUMMARY OF WORK

C. The Work consists of an addition of two garage doors to the Attached Utility Garage, as described in the Contract Documents.

D. Deep River Partners, Ltd. provides no warranty of any kind for any product or material selections specified in the Contract documents.

E. Deep River Partners, Ltd. is not a general contractor and the Owner must separately contract with a general contractor or contractors for the construction of the project. Deep River Partners, Ltd. has no responsibility for contractors, subcontractors, laborers, materialmen or suppliers working on the project.

F. Deep River Partners, Ltd. provides no warranty or guaranty for any aspect of an contractor’s work, including any work by any contractor’s subcontractors, laborers, materialmen or suppliers.

G. Deep River Partners, Ltd. is not responsible for (a) inspecting contractor's, subcontractor’s or laborer’s work, (b) verification of the accuracy of any contractor's, subcontractor’s or laborer’s

work, or (c) observation of any contractor's, subcontractor’s or laborer’s work for compliance with the Contract Documents prepared by Deep River Partners, Ltd.

H. Although every effort will be made by Deep River Partners, Ltd. to check the Contract Documents for accuracy, ultimately, contractors, subcontractors and laborers must check all details and dimensions on-site during construction. As such, contractors, subcontractors and laborers assume final and full responsibility for all details and dimensions contained in the plans and specifications.

I. Contractors shall be responsible for making sure that all work is done in accordance with all state and local codes, as well as all product and material data sheets and specifications. Deep River Partners, Ltd. shall not be responsible for the failure of any as-built condition to comply with state or local codes, or for the failure of any product to comply with manufacturer data sheets and specifications.

J. Deep River Partners, Ltd.’s plans utilize a process called free design for details not shown including but not limited to roof, window, flashing, plumbing, electrical, and HVAC details. This means that Deep River Partners, Ltd.’s plans may not include all required details. Contractors shall, using their own staff and/or qualified subcontractors, design and build all free design portions of the work. Contractors, subcontractors and laborers are assuming both the design and build responsibility for all free design portions of the project.

K. Work Not Included: The following will be provided by others: 1. Permit application process. 2. Landscape Drive Pavers and softscape, shown on construction documents as “by

landscape”, Finish Drive and Landscape Lighting. 3. Security / Fire Detection system. 4. Low Voltage Light Control including low voltage keypads and low voltage light control

panels. 5. Home Automation. 6. Underground storm water management system. 7. Property Maintenance including but not limited to snowplowing, lawn, and tree pruning

to allow for site access and as required by local authorities having jursidiction.

1.2 WORK RESTRICTIONS

A. Contractor's Use of Premises: During construction, Contractor shall have full use of building area within 50’ of Attached Utility Garage and access drive. Contractor’s use of premises is limited only by Owner’s right to perform work or employ other contractors on portion of Project.

B. Contractor shall abide by all environmental regulations, local ordinances governing work in or adjacent to occupied spaces and ordinances governing tree removal/protection & debris removal.

1.3 PERMITS

A. Contractor/Subcontractor’s to procure and include costs for all necessary permits and inspections for their respective work, as required by state and local regulations.

PRICE AND PAYMENT PROCEDURES 01200 - 1

SECTION 01200 - PRICE AND PAYMENT PROCEDURES

PART 1 - GENERAL

1.1 CONTRACT MODIFICATION PROCEDURES

A. All changes to the contract documents must be made via a written Bulletin or Change Order.

B. If a Bulletin results in an additional cost or credit to owner, and or a change in contract time / completion date of the project, a written Change Order must be produced and approved by the Owner & Architect.

C. Changes in the work may be accomplished after execution of the Contract, and without invalidating the Contract by executing a Bulletin and if required, a Change Order. A Change Order shall be based upon agreement among the Owner, Contractor and Architect. Changes in the work shall be performed under the applicable provisions of the Contract Documents and the Contractor shall proceed promptly unless otherwise provided for in the Change Order.

D. A Change Order is a written instrument prepared by the Contractor and signed by the Owner and the Contractor stating their agreement upon all of the following: 1. A Change in work 2. The amount of the adjustment in the Contract Sum, including any admininstration fees 3. The extent of any adjustment in the Contract time

E. No work provided for via Change shall be performed until the Change Order is signed by both the Contractor and the Owner.

F. The Change Order process will be managed by the Contractor. Copies of all Change Orders will be provided to the Architect, who will review and forward to the owner.

1.2 PAYMENT PROCEDURES

A. Submit copy of each application for payment for work completed on a monthly basis, according to the schedule established in Owner/Contractor Agreement and Schedule of Values. 1. Submit partial releases of liens from each subcontractor or supplier for whom amounts

were requisitioned in the Application for Payment with in (10) ten days of receipt of payment. Specify dollar amounts for which rights are to be waived, NO liens reading “in full to date” will be accepted.

2. Submit final Application for Payment after completion of Project closeout procedures with release of liens in full for all work as described in the Contract Documents from all subcontractors, material suppliers, and General Contractor.

3. Contractor agrees to pay a fee of $100.00 per day for each day the project remains incomplete past the Substantial Completion Date as defined in the General Contractor / Owner Aggreement. This fee will be deducted from the Final Payment.

4. A value equal to 200% of the value of incomplete items listed on the Punchlist will be retained from the final Application for Payment until such items are completed according to the contract documents

5. Contractor agrees to pay a fee of $100.00 per day for each day the Punchlist remains incomplete following the 30th day after the Punchlist is issued. This fee will be deducted from the Final Payment.

ADMINISTRATIVE REQUIREMENTS/CONSTRUCTION MANAGEMENT 01300 - 1

SECTION 01300 - ADMINISTRATIVE REQUIREMENTS / CONSTRUCTION MANAGEMENT

PART 1 - GENERAL

1.1 PROJECT MANAGEMENT AND COORDINATION

A. Maintain an onsite set of up to date Contract Documents including Bulletins for the duration of the project.

B. Verify layout information shown on Drawings in relation to existing benchmarks before completing the Work. Retain the services of a surveyor as needed for new driveway layout, and as required by governmental agencies for certification.

C. Coordinate construction to ensure efficient and orderly execution of each part of the Work.

D. Pick up, post, and maintain building permit on owners behalf. Call for all required inspections as work progresses and manage completion of inspection deficiences in a timely manor allowing construction to stay on schedule.

E. Coordinate contractors as listed on the Schedule of Values, integrating installation properly in the construction sequence. Coordinate the interface of carpentry and mechanical components as shown. If redesign is required as a result of not integrating the structural and mechanical systems the Construction Manager / General Contractor shall bear the cost of consultants to redesign affected systems.

F. Coordinate contractors completing Work by others as listed in Specification 01100 as required to integrate their installation properly in the construction sequence.

G. Administer products per Specification Section 01600.

H. Prevent the absorption of moisture by products. 1. Until a covered storage area is available, store products that are subject to mold or damage

by the elements under cover in a weather-tight enclosure with ventilation adequate to prevent condensation.

2. Set bundles on 3 supports, raised off ground. 3. Cut banding on panel materials when high moisture levels exist to prevent edge damage. 4. Store products inside unfinished covered area as soon as possible. 5. Coordinate delivery of moisture-sensitive products so materials are not present before

“wet” work is completed and dry. 6. Store products in moisture-impermeable packaging for as long as possible (i.e. until

acclimation must begin) when moisture / humidity levels are high. 7. Inspect lumber and building materials used, and reject any items that are exhibiting mold

growth. 8. Dehumidification shall begin once the building is enclosed and weather-tight to remove

moisture from the structural wood materials and minimize the potential for mold growth. Each trade is responsible for monitoring humidity levels of both the site and the product (if applicable) and notify Architect if humidity levels exceed the levels required for optimum product performance.

9. Maintain humidity levels below 55% during the pre millwork phase and do not install finish wood components prior to humidity levels reaching less than 45%. Alert

owner/architect prior to drywall phase of wet or potential mold conditions at which time owner may have the structure tested for mold content and complete remediation.

I. Manage ordering and receipt of all products including but not limited to Lumber and Millwork to ensure compliance with Construction Documents noting and gaining owner approval prior to any deviation in quanity per section 01200.

J. Progress meetings will be held at project site and via tele-conference as required. Notify Owner and Architect of meeting dates. Each Contractor or other entity concerned with current progress or involved with planning or coordination of future activities shall attend. 1. Prepare minutes of each meeting and distribute to parties present, owners and Architect.

K. On a monthly basis produce, review for compliance with contract, approve, and submit applications for payment to Architect according to Construction Agreement between Owner and Contractor. Maintain Master Schedule of Values and payment record for the duration of the project.

L. Manage all correspondence between Owner, Architect, and Contractors.

M. Procure pricing for Change Orders as directed by Owner or Architect and submit to Architect and Owner for approval.

N. Distribute and manage all communication with Contractors

O. Review all bids for document compliance, complete contract negotiation and execute sub-contractor agreements according to the Schedule of Values. Manage vendor compliance with executed contracts. Maintain and manage all contracts with sub-contractors as listed on the Schedule of Values.

P. Actuate and monitor all site activities on a full time basis as required. Submit to Deep River pictures of the entire job, including a picture of each exterior side of the work and one from each corner of each room being constructed, on a weekly basis, to accurately show the project progress.

Q. Notify Architect two weeks prior to the following work completions to allow for site observation prior to the next phase of work. 1. Demolition completion 2. Rough carpentry completion 3. Mechanical completion 4. Finish carpentry completion 5. Painting completion 6. Substantial completion 7. Punch list completion

R. Assure the completion of work specified in Architect’s observation reports.

S. Perform routine inspections and enforce compliance with the Contract Documents.

T. Manage and maintain a clean working environment.

U. Interface and integrate all disciplines into a cohesive team.

V. Troubleshoot conflicts and create resolution in compliance with the Contract Documents.

W. Manage and complete closeout submittals and procedures and manage Section 01400 Quality Requirements.

X. Manage warranty and call back agreements for a period of 1 year from substantial completion.

Y. Manage site safety adhereing to all local, state and federal regulations, and enforce contractor compliance with same.

1.2 CONSTRUCTION SCHEDULE

A. Prepare a horizontal bar-chart construction schedule. Provide a separate time bar for each activity and a vertical line to identify the first workday of each week. Use same breakdown of Work indicated in the Schedule of Values. As Work progresses, mark each bar to indicate actual completion. 1. Submit with Schedule of Values at submission of bid. 2. Coordinate each element with other activities. Show each activity in proper sequence.

Indicate sequences necessary for completion of related Work. 3. Indicate Substantial Completion and allow time for Deep River Partners procedures

necessary for certifying Substantial Completion. 4. Schedule Distribution: Distribute copies to Owner, Deep River Partners, contractors, and

parties required to comply with dates. 5. Updating: Revise the schedule after each meeting or activity where revisions have been

made. Distribute revised copies to Owner, Architect, contractors, and parties required to comply with dates. All changes to schedule to be executed via Change Order.

1.3 SUBMITTAL PROCEDURES

A. Deliver all submittals to Architect and coordinate submittal preparation with construction schedule, fabrication lead-times, other submittals, and activities that require sequential operations. 1. No extension of Contract Time will be authorized due to failure to transmit submittals in

time to permit processing sufficiently in advance of when materials are required in the Work.

2. Architect will not accept submittals from sources other than the General Contractor / Construction Manager.

B. Coordinate each submittal with other submittals and with work that does not require submittals.

C. Product Data: Mark each copy to show applicable choices and options. Include the following: 1. Job Name. 2. Data indicating compliance with specified standards and requirements. 3. Notation of coordination requirements. 4. For equipment data, include rated capacities, dimensions, weights, required clearances,

and furnished specialties and accessories.

D. Shop Drawings: Submit newly prepared information drawn to scale. Do not reproduce Contract Documents or copy standard information. Submit 1 black-line print on sheets at least 8-1/2 by 11 inches but no larger than 30 by 42 inches. Include the following: 1. Job Name and Drawing Index 2. Dimensions, profiles, methods of attachment, coordination with adjoining work, large

scale details, and other information, as appropriate for the Work 3. Identification of products and materials. 4. Notation of coordination requirements. 5. Notation of dimensions established by field measurement. 6. Identification of deviations from Contract Documents or prevoius submittal.

E. Samples: Submit (2) two Samples finished as specified and identical with the material proposed. Where variations are inherent in the material, submit sufficient units to show limits of the variations. Include Job Name, Product Name and Manufacturer, Color, and Finish on back of sample.

F. Architect will review each submittal, mark as appropriate to indicate action taken, and return copies / samples, less those retained via written Bulletin. Compliance with specified requirements in the Contract Documents, verification of field dimensions, coordination with adjoining work, and accuracy of submittal remains Contractor's responsibility.

1.4 CLOSEOUT SUBMITTALS

A. Submit a set of “as built” Contract Documents marked to show installation that varies from the Work originally shown in cases where Architect has not issued Bulletins to cover such work including but not limited to septic systems.

B. Operation and Maintenance Data: Create file for product data organized alphabetically. 1. Service Contractor Contact List 2. Copies of warranties. 3. Owners Manuals. 4. Product Data. 5. Care and maintenance instructions.

1.5 CLOSEOUT PROCEDURES

A. Request Substantial Completion observation once the following are complete: 1. Advise Owner of pending insurance changeover requirements. 2. Submit maintenance manuals, warranties, and similar record information. 3. Deliver spare parts, extra materials, and similar items. 4. Changeover locks and transmit keys to Owner. 5. Complete startup testing of systems and instruction of operation and maintenance

personnel. 6. Remove temporary facilities and controls. 7. Complete final cleanup. 8. Touch up, repair, and restore marred, exposed finishes. 9. Obtain final inspections from authorities having jurisdiction. 10. Obtain certificate of occupancy and final inspection reports as required including but not

limited to septic and well final inspection reports.

B. On receipt of a request for observation, Architect will proceed with observation and advise Contractor of unfilled requirements via written Punchlist. Architect will prepare the Certificate of Substantial Completion after observation and advise Contractor of Punchlist items that must be completed or corrected before the certificate will be issued. The Certificate of Substantial Completion shall be issued when the project is able to be occupied and used for the purpose intended.

C. Arrange for each installer of equipment that requires operation and maintenance to provide instruction to Owner / Owner's personnel. Include a detailed review of the following: 1. HVAC controls. 2. Emergency operations and safety procedures. 3. Security, Phone and Audio/Visual operation. 4. Product data files. 5. Spare parts, tools, and materials. 6. Lubricants and fuels. 7. Identification systems.

D. Request observation for Final Punchlist completion, once the following are complete: 1. Submit a copy of the Substantial Completion Punchlist stating that each item has been

completed or otherwise resolved for acceptance.

E. Architect will re-observe the Work on receipt of notice that the Work has been completed. If the Work is incomplete, Architect will advise Contractor of the Work that is incomplete or obligations that have not yet been fulfilled. If the work is completed Architect will review Final Request for Payment and the approved Final Request for Payment date will serve as the final completion date for all warranties outstanding at the time of substantial completion.

B. Painted Surfaces: Apply coats as required for adequate coverage – minimum 1 coat over manufacturer recommended primer for specified surfaces.

C. Stained Surfaces: Apply coats as required for adequate coverage – minimum 1 coat.

D. Fill nail holes in all doors, jamb, and trim where nail heads are not flush with surface.

E. Seal tops and bottoms of all exterior doors.

F. Paint weatherproof outlet covers in color most similar to surounding materials.

G. Comply with all manufacturer’s finishing requirements for exterior door and trim products, including but not limited to finishing all exterior products on all (six) sides as required.

3.2 INTERIOR APPLICATION

A. Comply with paint manufacturers written instructions for surface preparation, environmental and substrate conditions, product mixing and application per Interior Paint Schedule.

B. Contractor to fill holes, sand and de-dust surfaces between coats to ensure a smooth finished product free from surface blemishes and drips.

C. Stained woodwork IS NOT to be prestained before it is applied.

D. Painter to protect all surfaces, INCLUDING, BUT NOT LIMITED TO THE FOLLOWING: tile floors, windows, hardware, melamine, countertops, bath tubs, shower stalls, and Garage slabs from paint overspray and splatter.

3.2 SURFACE PREPARATION

A. Prepare concrete surfaces in accordance with manufacturer's instructions and ASTM D 4258.

B. Remove dirt, oil, grease, wax, laitance, curing compounds, water-soluble concrete hardeners, and other surface contaminants.

C. Remove sealers, finishes, and paints.

D. Remove unsound concrete by scarifying, sand blasting, shot blasting, or high pressure water blasting.

E. Chemical surface preparation (acid etching) is unacceptable and will void Manufacturer’s warranty.

F. Mechanical Surface Preparation: 1. Mechanically abrade concrete surface in accordance with manufacturer's instructions. 2. Leave concrete surface with an aggressive texture. 3. Remove concrete dust. 4. Conform to ASTM D-4259. 5. Surface profile shall conform to IRCI Guideline 03732 CSP 4, minimum.

3.3 CONTROL JOINTS, CRACKS

A. Provide repair and treatment of control joints and surface cracks utilizing manufacturer’s standard materials and installation details.

3.4 APPLICATION

A. Repair concrete substrate as required using cementious repair/resurfacer in accordance with Manufacturer's instructions.

B. Do not add thinners to materials. No thinners shall be approved or allowed.

C. For coverage rates, consult data sheet for finish system.

D. Finish surface to be smooth, with uniform texture, free of surface defects, and without porous areas.

E. Follow Manufacturer’s recommendations on terminations and connections to walls, drains, doorways, columns and floor-to-floor transitions

F. Mix broadcast quartz and resin and trowel to joint between slab and base and up concrete base to underside of drywall termination and trowel smooth using cove base tool at corner to create resin and quartz base integral with floor slab.

3.5 CLEAN UP

A. Remove masking, draping, and other protection from adjacent surfaces.

I. Install exposed raceways parallel to or at right angles to nearby surfaces or structural members, and follow the surface contours as much as practical.

J. Join raceways with fittings designed and approved for the purpose and make joints tight. Use bonding bushings or wedges at connections subject to vibration. Use bonding jumpers where joints cannot be made tight. Use insulating bushings to protect conductors.

K. Install pull wires in empty raceways. Use No. 14 AWG zinc-coated steel or monofilament plastic line having not less than 200-lb tensile strength. Leave not less than 12 inches of slack at each end of the pull wire.

L. Install raceway sealing fittings where required by the NEC and at wiring entrances to refrigerated spaces. Locate at suitable, approved, accessible locations and fill them with UL-listed sealing compound. For concealed raceways, install each fitting in a flush steel box with a blank cover plate having a finish similar to that of adjacent plates or surfaces.

M. Provide two (2) low voltage sensor wires from garage door opener button to opener and from opener to each side of overhead door at base of jamb.

N. Clearly label all enclosures, transformers and other electrical components.
