Watch, Like, Share, Connect with us @ BCAS Global My Dear Members, The Modi Government last week promulgated an Ordinance to amend the Banking Regulation Act, empowering the Reserve Bank of India (RBI) to unilaterally direct banks to resolve bad loan problems. Besides RBI can also initiate bankruptcy proceedings against chronic defaulters by effective use of the Insolvency & Bankruptcy Code. Earlier the Union Cabinet had approved the said Ordinance allowing the RBI to deal with these loans on a case-to-case basis as opposed to following a set of broad guidelines and rules for all non-performing assets (NPAs). The RBI may specify one or more authorities or committees to advise banking companies on a resolution of stressed assets. This Ordinance is an important first step as these mechanisms are functional and can produce results if flaws are ironed out. India’s banks have been beset with huge amount of NPAs and at the end of December 31, 2016, it is estimated to have crossed `7 lakh crore. The Government has also collated details on bad loans worth nearly `50,000 crore that need immediate action against wilful defaulters. These wilful defaulters have not repaid bank loans despite having the capacity to do so and have diverted funds for other purposes. Wilful defaults are the worst kind of bad loans that empowers banks to get after the promoters and directors by even naming and shaming them through public notices and advertisements for not paying up. FM Jaitley also mentioned that if some of the largest stressed assets are resolved, it will create space for banks to step up lending. The new Ordinance may also thus empower banks to force lingering corporate loan defaulters to forego ownership and voting rights in their companies, allowing lenders to induct new management leadership mandated to turnaround these entities within a specified time frame. Hopefully the RBI will now ensure that the wilful defaulters are taken to task and do not go scot free. The BCAS Referencer 2017-18 with the theme “INDIAN RAAGAS” was released on 28 th April 2017 at the hands of Padma Shri Pandit Satish Vyas, a world known Santoor Maestro. Before the release function BCAS was also fortunate enough, though for a small while, to hear Panditji play the instrument which mesmerised the audience. This year’s Referencer has been compiled by the youth members of BCAS duly guided by the senior compilers. The Study Circle Meeting on “Management Lessons from Ramayana” by CA. C. N. Vaze was well attended. Even today Ramayana is playing a significant role in shaping the mindset and the culture of not only Indians, but also of many scholars world over. Ramayana deals with management of personal life, spiritual life; and also the management of any activity of an organisation. The Society has organised twin seminars on Practical Issues in Income Computation and Disclosure Standards (ICDS) and Tax Deduction at Source on 19 th and 20 th May respectively. The Indirect Tax Residential Study Course this year focussed on the new GST Law and being held in June received excellent response and we had to close the enrolments fast. However the Society has ensured to confirm maximum participants. The preparations of the Jal Erach Dastur CA Students Annual Day event “Tarang 2K17” which is in its 10 th Edition is in full swing. "Tarang -Tarasho Apne Talent Ke Rang" will be held on 3 rd June 2017, an event where about 500 CA students showcase their talents in various extracurricular activities. This

    year the theme for “Tarang” is “Digital India” and opportunities of transformation of lives which it offers. I request members to enrol their students for this much-awaited event.

    In keeping with public sentiment, the Supreme Court upheld the death sentence against the four men who were involved in the Nirbhaya case in December 2012. A ‘barbaric crime’ that has ‘shaken the conscience of the nation’ said one of three judges hearing the condemned men’s appeal. The crime thus met the ‘rarest of rare’ standard that merits capital punishment. Indeed, no other reported incident has evoked the kind of public reaction than the one we know as the Nirbhaya case.

    Four and a half years later, the “Nirbhaya case” remains a touchstone of almost mythical proportion. No single crime has resulted in as much law making and law amending as this one. The citizen-led nationwide protest following the rape, resulted in the setting up of a judicial commission headed by a retired Supreme Court judge and, eventually, an amended law that is much tougher. While capital punishment to the four men condemned to the gallows might bring some measure of closure to the family of the victim, it is unlikely that it will make a dent to India’s shameful statistics on such violence. “Certain attitudinal change and change in the mindset is needed to respect women and to ensure gender justice,” observed the Supreme Court judgment. Bringing that about will take more than the length of a hangman’s rope.

    Starting this month, in a symbolically powerful assertion of the principle and ideal of democratic equality, the Government of India has banned the use of red beacon lights (Lal Batti ) on cars used by VIPs. PM Modi himself declared that every Indian is a VIP. Now, no one other than the enforcement agencies and ambulances, which do need to travel faster than citizens, can use flashing lights to clear the way.

    The move is belated but wholly welcome in a country where the VIP beacon had become a status symbol, a decoration for politicians and administrators. By marking them apart from common people, it conferred power out of proportion with their standing. The sight of motorcades bright with red beacons, shouldering aside the common herd on the roads, put the message across with profound force. Indeed, the red beacon perpetuated, in democratic India, the segregation of the ruler and the ruled, which was a hallmark of

    colonial power. The red beacon is a distant descendant of the same colonial policy, and has no place in a democracy.

    If an equal society is India’s declared objective, politicians and administrators should travel like ordinary people. Several small privileges will have to be stripped to bring equity to a deeply classist society. Terrorism had provided the excuse for gifting VIPs with massive security details, whose size and armaments had become expressions of personal status and power, rather like expensive jewellery. It took a public outcry for that aberration to be rationalised. Now, the abolition of car beacons takes us another step closer to egalitarianism. And yet, a long road lies ahead.

    It is said that motivational speakers fail to create a long-lasting impact because research has shown that a month later people can only retain about 2% of the message they hear. Having an audience high on energy for a few days may not be a good return on investment in terms of the time that you pull them out of work for, and the money you spend in motivating them.

    Words don’t last but memories of your experiences, especially the ones about victory, fun and pleasure last forever. Imagine having your audience engaged into such moments of inspiration and achievement, creating greater confidence towards delivering results out of their inner drive and passion that they can use and direct in their daily work-a-day life.

    When you allow your team a real time challenge that creates a lasting impression of success and understand experientially the process of creating it - you have a team of transformed and ignited participants. They will hold these life changing experiences and what it means to them close to their hearts, guiding them through the challenges time after time, long after the motivational words are forgotten.

    INTENSIVE GST TRAINING PROGRAM UNDER THE TRADE OUTREACH INITIATIVE OF THE GOVERNMENT OF INDIA

    The nation is at the brink of a landmark indirect tax reform. The path is now clear towards the implementation of GST from 1st July 2017. To create awareness amongst people and to prepare trade and industry and business community to embrace GST, the Government has formulated a trade outreach initiative whereby certain institutions and their faculties are specifically trained by the Government officers and certified as Approved Training Partners (ATPs).

    BCAS is proud to be one of the leading Approved Training Partners (ATPs) certified by NACEN (National Academy of Customs, Excise and Narcotics).     The nation is at the brink of a landmark indirect tax reform. The path is now clear for the introduction of GST with effect from 1st July, 2017. In more ways than one, the dual GST Regime being implemented in India is unique. State level registrations and taxability of interstate branch transfers are unique concepts for service providers. The extent of automation expected over the GST Network has no precedent in the world. Indeed, we are moving towards exciting times.

    The new regime provides a wide array of opportunities to chartered accountants. It is time to sharpen the axe. As we start the process of migration and implementation of GST, professionals would face many questions in their minds. In order to provide guidance to such professionals, BCAS has started the GST Clinic whereby a panel of two experts solve the queries faced by members. The Clinic functions every Saturday at the BCAS Library from 11 a.m. to 1 p.m.

    Participation in the Clinic is free. However, it is important that the member sends the query in advance latest by Thursday evening to [email protected] and call to obtain prior appointment, at least a day before the clinic date. It may be noted that only members who have queries will be permitted to attend the GST Clinic.

    Panel member/s address those issues and provide the querists verbal opinion, which assists them in understanding the new law. No email / written opinion will be given. Personal presence is compulsory.

    ACCOUNTING AND AUDITING CLINIC Companies Act, 2013 has cast onerous responsibilities on the Management to comply with all the applicable accounting standards as well as various disclosures. The Statutory Auditors of companies also must state in their report compliance to Accounting as well as Auditing Standards. There are many more reporting requirements under CARO, 2016 which should also be complied.

    Considering the wide gamut of reporting requirements, many a times small and medium sized companies as well as small and medium sized auditing firms find it difficult to address the issues which may arise while finalising audited financial statements.

    BCAS whose majority members represent small and medium sized firms catering to mid-size corporates, has been operating Accounting and Auditing Clinic, wherein issues relating to accounting standards, auditing standards, reporting requirements as well as Companies Act compliance are put forth by the members before eminent and experienced panel.

    Panel member/s address those issues and provide the querists verbal opinion, which assists them in improving quality of reporting and avoid any non-compliance.

    BCAS has decided to revitalise this Clinic and make it more vibrant by creating awareness and gradually take this Clinic to different parts of Mumbai/Thane to serve professionals/corporates in much timely manner.

    Terms and Conditions

    1. BCAS Hall can be used for educational purpose in the field of Chartered Accountancy by a Member only and in accordance with the policy of the Society and for no other purposes either directly or indirectly or for commercial purpose.

    2. The hall usage is made available by the BCAS to facilitate education of its members in the field of chartered accountancy at nominal cost/charge. The current charges are as under, till any revision:

    a. Above rates are subject to service tax / GST as applicable.

    b. Hall can be booked only 45 days prior to the date of educational event subject to availability except Sundays and BCAS Holidays.

    c. Combined capacity of the hall is about 90 people in theatre style seating and 50 people in classroom style.

    d. Refund of security deposit will be after 10 working days from the date of the event.

    3. Any member wishing to make reservation for use of the BCAS Hall for the purpose stated in point 1 above should pay such charges and deposit 100% in advance.

    4. Extension of time will strictly be subject to availability and there being no booking for next session and solely at the discretion of BCAS. Extension beyond 8.00 pm will not be permitted. ` 1,500 will be levied for every additional hour or a part thereof.

    5. The Society reserves the right to accept or reject any application.

    6. In case of cancellation of booking by members, a letter in writing duly signed by the member has to be received, 25% of the Hall charges will be deducted, in such case and balance will be refunded in 15 working days. In case of cancellation of booking by BCAS office, the entire amount will be refunded.

    7. It is not permitted to stick any papers, balloons, pictures etc. on the wall, ceiling or curtains. In case of any damage caused to the property of the Society, the BCAS will have the right to recover compensation for such damages or disfiguration out of the refundable deposit.

    8. The vehicle/s of the visitor/s to the BCAS Hall will not be permitted to be parked in the Jolly Bhavan Society premises. The use of the Hall is solely at the risk of the member and BCAS does not undertake any obligation for any loss or damage to the member or other persons attending such event. Members are advised to take care of their valuable and belongings at all times, and BCAS shall not be responsible for any loss thereof

    BCAS library in its new avatar is fully operational with best of the ambience, technology and facilities. The state of the art library has an air-conditioned lobby, study room and dedicated work stations for use by its members with print facility at a nominal cost. The library is equipped with a repository of more than 2000 books written by eminent authors. These books include the widely sought after BCAS publications and other publications published by publishers like Taxmann, Snowwhite, Wolters Kluwer (CCH), Bharat Law House etc. The collection is a wide spectrum, ranging from topics of professional interest like Direct Taxes, Indirect Taxation, Transfer Pricing, International Taxation, Service Tax, Company Laws, Labour Laws, Accounting & Auditing, Management Books, Tribunals and Supreme Court Judgements and BCA Journals etc. In addition to the books, online facilities for direct tax and indirect tax judgements are also available.

    BCAS MEMBERS VISIT TO TATA HOSPITAL ON AUSPICES OF BCAS FOUNDATION

    BCAS Foundation was set up understanding the need for members to channelize their philanthropic efforts. It is a matter of great satisfaction that our members have contributed generously for the various projects taken up by the Foundation. Our various committees and in particular HD & TI committee & MPR committee has been a great source of support for the Foundation activities.

    In pursuance of our ongoing activity - NEEDY CHILD PROJECT (CANCER AFFLICTED), a new initiative was taken by the BCAS Foundation to explore how it can help cancer afflicted needy children. Under the leadership of Trustee Shri Pradeepbhai Shah, members from HD&TI Committee- CA. Mayur Nayak, CA. Nitin Shingala and CA. Mihir Sheth and their spouses, visited Paediatric Oncology Department (known as ImPaCCT) which stands for “Improving Paediatric Cancer Care and Treatment” at Tata Memorial Hospital on 20th December 2016. The group was briefed on the activities, patients’ profile, and type of medical treatment offered and ever increasing financial need of the department against the funds available.

    The group was briefed by Ms. Shalini Jatia who is a Secretary to the ImPaCCT Foundation and is more than a full-time volunteer in the department providing rock solid support since past many years. During her interaction with the Group, she brought out some heart-wrenching facts which are enunciated below;

    4. Average expenditure of treatment per child is `3 lakh. If treated rightly, there is 80% chance of saving a life of child at early stage of disease.

    5. Almost 80% of children come from the families whose income levels cannot support treatment and disruption that follows.

    6. This despondency results in refusal or abandonment of treatment thereby losing a chance to save life of young life.7. Sadly, the probability of abandonment is much higher in case of a girl child.She opined that there can be possibility of redeeming the situation with more awareness amongst conscientious individuals. This can be done by their active financial help and committed time involvement howsoever little it may be to start with.

    Extremely impressed by the work being done and moved by the fate of the young hopefuls, BCAS Foundation has offered financial help on regular basis from its members and promised to enrol its members’ families by arranging periodic visits so that they can be inspired to find ways on time commitment and financial help.

    Tata Memorial Hospital is situated in Parel, Mumbai, India. It was established by the Sir Dorabji Trust in 1941 and soon evolved as a centre of excellence in cancer treatment and research. In 1957, it was taken over by the Ministry of Health of Government of India. The administrative control of the hospital is with the Department of Atomic Energy.

    It is today recognized as a premier Cancer Hospital with path breaking research activities and efficiency in giving quality treatment to large number of patients at reasonable and low cost. At any given time, there are about 1000 patients in the OPD and about 60000 patients annually visit the hospital.

    The paediatric general ward situated in the Annexe building has about 44 admitted children. They are mostly from rural India and very poor.

    The hospital felt a need to have their own foundation to monitor donations to their patients as there were some rogue elements collecting money that never reached the patients or genuine payments that could not reach the patients on time. With this in mind, ImpaCCT (Improving Paediatric Cancer Care and Treatment) was established in the year 2010 by Tata hospital.

    BCAS Foundation through ImpaCCT has decided to volunteer in giving donations for treatment of paediatric patients of Tata Memorial Hospital.

    A. P. (DIR Series) Circular No. 44 dated April 13, 2017

    Exim Bank's Government of India supported Line of Credit of USD 31.29 million to the Government of the Republic of Nicaragua

    Exim Bank has made available, subject to certain terms and conditions, to the Government of the Republic of Nicaragua, a Line of Credit of US $ 31.29 million for financing transmission lines and substations project in the Republic of Nicaragua. Eligible goods and services of the value of at least 75% of the contract price must be supplied by the sellers from India, while the remaining 25% of the goods and services can be procured by the sellers from outside India.

    The terminal utilization period for the credit is 60 months after the scheduled completion date of the project.

    Exim Bank has made available, subject to certain terms and conditions, to the Government of the Republic of Mauritius, a Line of Credit of US $ 52.30 mill ion for financing Project Trident in the Republic of Mauritius.
