1 Preliminary Provisions

1.1 Title and Commencement

1.1.1 ThisBylawistheBayofPlentyRegionalNavigationSafetyBylaw2010.1.1.2 ThisBylawcomesintoforceon15July2010.1.1.3 ItisanoffencenottocomplywiththeprovisionsofthisBylaw.1.1.4 CompliancewiththisBylawdoesnotreplacetheneedtocomplywith

otherlegislationsuchastheMaritimeTransportAct1994orResourceManagementAct1991.

1.2 Areas within which this Bylaw Applies

ThisBylawappliestoallthewaterswithintheBayofPlentyRegionasdefinedundertheLocalGovernment(BayofPlentyRegion)ReorganisationOrder1989.

1.3 DefinitionofTerms

InthisBylaw,unlessthecontextotherwiserequires:

Access lane meansanareadesignatedasanaccesslaneunderclause3.6ofthisBylaw.

Accident hasthesamemeaningasinsection2oftheMaritimeTransportAct1994.

Act meanstheLocalGovernmentAct1974.

Aid to Navigation includes:(a)anylightshipandanyfloatingorotherlightexhibited

fortheguidanceofships;(b)anyfogsignalnotcarriedonavessel;(c)allmarksandsignsinaidofmarinenavigation;(d)anyelectronic,radioorotheraidtomarinenavigation

notcarriedonboard.

Aircraft hasthesamemeaningasintheCivilAviationAct1990.

Anchorage meansaplace(enclosedorotherwise)usedfortheanchoringofvesselstothebedofwaters,whethertheplaceisreservedforsuchpurposesbytheCouncilornot.

Anchoring meansthesecuringofavesseltothebedofwatersbywayofananchor,cableorotherdevice,thatisnormallyremovedwiththevesselwhenitleavestheanchorage.

Beacon meansalightormarksetupasanavigationmarkorawarningtovessels.

Buoy meansananchoredfloatservingasanavigationorlocationalmark,ortoindicateamooring,reef,orotherhazard.

Buoyancy Aid meansthesameaspersonalflotationdevice.

Class 3 packing group l oil products

meansoilhavinganinitialboilingpointlessthanorequalto35degreescentigrade.

Class 3 packing group ll oil products

meansoilhavingaflashpointoflessthan23degreescentigradeandaninitialboilingpointgreaterthan35degreescentigrade.

Class 3 packing group lll oil products

meansoilhavingaflashpointequaltoorgreaterthan23degreescentigradeuptoandincluding61degreescentigradeandaninitialboilingpointgreaterthan35degreescentigrade.

Coastal Marine Area hasthesamemeaningasinsection2oftheResourceManagementAct1991.

Commercial Vessel meansavesselthatisnot:(a)apleasurecraft;or(b)solelypoweredmanually;or(c) solelypoweredbysail.

Council meanstheBayofPlentyRegionalCouncilasconstitutedundertheLocalGovernment(BayofPlentyRegion)ReorganisationOrder1989.

Craft hasthesamemeaningasshiporvessel.

Crew meansthepersonsemployedorengagedinanycapacityonboardavessel,butdoesnotincludetheMaster,aPilot,orapersontemporarilyemployedonthevesselwhileinport.

Director of Maritime New Zealand

meansthepersonwhoholdsthepositionofDirectorofMaritimeNewZealandundersection439oftheMaritimeTransportAct1994.

Emergency Response Craft

meansanyvesselapprovedbytheHarbourMasterforuseinemergencyresponseandmayincludePolice,Customs,HarbourMaster,NavalandportcompanyvesselsapprovedbytheHarbourMasterforsuchuse.

Enforcement Officer meansapersonappointedasanenforcementofficerunderSection650BoftheAct.

Explosive meansanysubstanceormixtureorcombinationofsubstanceswhichinitsnormalstateiscapableofsuddenexpansionowingtoareleaseofinternalenergy,andincludesthecapabilitytoburnsuddenlyorexplode.

Flag A meansFlagAoftheInternationalCodeofSignals(theDivers’Flag),beingaburgee(swallow-tailed)flagcolouredinwhiteandbluewithwhitetothemast,ofnotlessthan600mmby600mmorarigidequivalent.

Flag B meansFlagBoftheInternationalCodeofSignals,beingaburgee(swallow-tailed)flagcolouredinred,ofnotlessthan600mmby600mmorarigidequivalent.

Flagged Area meansthatareaofbeachwhichmaybemarkedfromtimetotimewithredandyellowflagsandwhichextendsto200metersfromtheactualwater’sedgetocreateasafeswimmingarea.

Foreshore meansanylandcoveredanduncoveredbytheflowandebbofthetideatmeanhighwaterspringsand,inrelationtoanysuchlandthatformspartofthebedofariver,doesnotincludeanyareathatisnotpartofthecoastalmarinearea.

Gross Tonnage meansthevolumeofallavessel’senclosedspaces(fromkeeltofunnel)measuredtotheoutsideofthehullframingwithsomeexemptionsfornon-productivespacessuchascrewquarters;asmeasuredundertheTonnageMeasurementConventionof1969.

Harbour Master meansapersonappointedbytheBayofPlentyRegionalCouncilasHarbourMasterundersection650BoftheActandincludesanyDeputyHarbourMaster.

Honorary Enforcement Officer

meansapersonappointedasanHonoraryEnforcementOfficerundersection650BoftheAct.

Impede the Passage meanstocauseavessel,whetherbyactionorinactiononthepartofanothervessel,toaltercourse,alterspeedorstop,ortopreparetodosomethingthatwouldnototherwisebedone.

Incident meansanyoccurrence,otherthananaccidentthatisassociatedwiththeoperationofavesselandaffects,orcouldaffect,thesafetyoftheoperation.

Kiteboarding meansusingacontrollablekitetopullariderthroughthewateronasmallsurfboard,wakeboardorkiteboard,andincludeskitesurfing.

Length inrelationtoavessel,meansoveralllength.

Maritime Rules meansmaritimerulesmadeundertheMaritimeTransportAct1994.

Master meansanypersonwho,forthetimebeing,isresponsibleforthecommandorchargeofavessel,butdoesnotincludeaPilotwhoispilotingthevessel.

Mean High Water Springs (MHWS)

meanstheaverageofthelevelsofeachpairofsuccessivehighwatersduringthatperiodofabout24hoursineachsemi-lunation(approximately14days),whentherangeoftidesisthegreatest.

Moor means:(a)thesecuringofanyvesselalongsideawharforjetty

bymeansofsuitablemooringropes;or(b)thesecuringofanyvesseltoamooringoranchor;butexcludesthetemporaryanchoringofavessel.

Mooring meansanyweightorarticleplacedinorontheforeshoreorthebedofawaterwayforthepurposeofsecuringavessel,raft,aircraftorfloatingstructure;andincludesanywire,rope,buoyorotherdeviceattachedorconnectedtotheweight,butdoesnotincludeananchorthatisnormallyremovedwiththevessel,raft,aircraftorfloatingstructurewhenitleavesthesiteoranchorage

Mooring Area means:(a)anyareashownasamooringareaintheBayof

PlentyRegionalCoastalEnvironmentPlanmapsor(b)anyareafromtimetotimedesignatedbytheCouncil

asamooringareaundertheResourceManagementAct1991,wherevesselmooringsmaybeplaced;

butdoesnotincludeananchorage.

Nautical Chart meansamapofaseaareashowingonitanycoastlines,rocksanddangerstovessels,andalsoshowingthepositionsofaidstonavigationandotherprominentfeatures.

Navigable Waters meansanywaterswhethercoastalorinlandwhichareabletobenavigated,andincludingharbours.

Navigate meanstheactorprocessofmanagingordirectingthecourseofavesselon,through,over,orunderthewater.

Obstruction meansanobject,equipment,structure,vesselorpersonpositioned,whetherinthewaterornot,soastorestrict,preventorimpedenavigationofavesselorcauseahazardtopeopleonavesselorinthewater.

Oil meanspetroleuminanyformincludingcrudeoil,fueloil,sludge,oilrefuseandrefinedproductsandincludesanysubstancedeclaredtobeoilinMarineProtectionRules.

Owner includes:(a)inrelationtoavessel,theagentoftheownerandalso

achartererofthevessel;and(b)inrelationtoanydock,wharf,quay,orslipway,

includesalesseeofthedock,wharf,quay,orslipway;or

(c) inrelationtoavesseltowhichparagraph(a)orparagraph(b)ofthisdefinitionapplies,where,byvirtueofanycharterordemiseorforanyotherreason,theregisteredownerisnotresponsibleforthemanagementofthevessel,includesthechartererorotherpersonwhoisforthetimebeingsoresponsible;or

(d)inrelationtoanunregisteredvesseloraregisteredvesselthatdoesnothavearegisteredowner,meansthepersonwhoisforthetimebeingresponsibleforthemanagementofthevessel.

Personal Flotation Device (PFD)

meansanyserviceablebuoyancyaidthatisdesignedtobewornonthebodyandthatmeetsthedefinitionofPFDinMaritimeRulePart91,andincludesalifejacket.

Personal Water Craft (PWC)

meansapersonalwatercraftisapowerdrivenvesselthathasafullyenclosedhullanddoesnottakeonwaterifcapsizedandisdesignedtobeoperatedbyapersonstanding,sittingastrideorkneelingonit,butnotseatedwithinit,andincludesajetski.

Person in charge of a vessel meanstheMaster.

Pilot inrelationtoanyvessel,meansanypersonnotbeingtheMasterormemberofthecrewofthevesselwhohastheconductofthevesselandwhoisdulylicensedbyMaritimeNewZealand.

Pilotage Area meanstheTaurangapilotageareaasdescribedinMaritimeRulePart90.

Pleasure Craft meansashipthatisusedexclusivelyfortheowner’spleasureorastheownersresidenceandisnotofferedorusedforhireorreward,butdoesnotinclude:(a)ashipthatisprovidedfortransportorsportor

recreationbyoronbehalfofanyinstitution,hotel,motel,placeofentertainmentforotherestablishmentorbusiness;or

(b)ashipthatisusedonanyvoyageforpleasureifitisnormallyusedorintendedtobenormallyusedasfishingshipforthecarriageofpassengersorcargoforhireorreward;or

(c)ashipthatisoperatedbyanyclub,incorporatedsociety,trustorbusiness.

Power Driven Vessel meansanyvesselpropelledbymachinery.

Proper Speed meansspeedthroughthewater.

Public Notice meansanoticeinanewspapercirculatinggenerallyinthedistrictorregiontowhichthesubjectmatterofthenoticerelates.

Recreational Craft meansavesselthatis:(a)apleasurecraft;or(b)solelypoweredmanually;or(c) solelypoweredbysail.

Region meanstheBayofPlentyRegionasdefinedundertheLocalGovernment(BayofPlentyRegion)ReorganisationOrder1989.

Region’s Waters meansallwaterswithintheBayofPlentyRegion,theseawardboundaryofwhichistheouterlimitoftheterritorialsea.

Reserved Area meansanareadesignatedasareservedareaunderclause3.6ofthisBylawthatisreservedforaspecificpurpose.

Reward meansthepaymentto,orforthebenefitof,theownerorMasterofavessel,ofacontributiontowardstheexpensesofavoyageby,oronbehalfof,persons;butdoesnotincludepaymentofanycontributionsbypart-ownersofthevesselorbypersonsengagedasbonafidecrewmembers.

Sailboarding meansusinganytypeofboardthatispropelledbydetachablesailapparatusandoperatedbyapersonorpersonsstandingontheboard,andincludeswindsurfing.

Seaplane meansaflyingboatoranyotheraircraftdesignedtomanoeuvreonthewaterandunderMaritimeRule22isdeemedtobeavesselwhenoperatingonthewater.

Seaworthy inrelationtoanyvesselmeansbeinginafitcondition,intheopinionoftheHarbourMaster,tosafelyundertakeaseavoyagewithinitsdesigncapabilities.

Ship hasthesamemeaningasvessel.

Shore whenreferringtodistancefromshore,meansdistancefromthewater’sedge.

Speed uplifting meansanyspeedupliftingthatappliestoanareadesignatedunderclause3.6anddefinedunder schedule3.

Structure meansanybuilding,equipment,device,orotherfacilitymadebypeopleandwhichisfixedtolandorthebedofawaterway;and(a)includesslipways,jetties,pilemoorings,swing

moorings,rafts,wharves,marinefarms,andotherobjectswhetherornottheseareaboveorbelowthewaterlineorlineofmeanhighwaterspringsbut

(b)doesnotincludebuoys,beacons,anchoredfloatsornoticesand

(c)doesnotincludeaidstonavigation.

Support Vessel meansanyvesselusedforcoaching,marshallingandrescueattendancefortraining,regattasandcompetitions.

Surfing meansusinganyobjectthatisdesignedtobeusedforwavesurfingorsurfriding.

Tanker meansanyvesselcarryingoilinbulkascargo,orcapableofcarryingoilinbulkascargo,whosetanksandcompartmentshavenotbeenrenderedandcertifiedgas-free.

Underway meansthatavesselisnotatanchor,ormadefasttotheshore,oraground.

Vessel meanseverydescriptionofboatorcraftusedinnavigation,whetherornotithasanymeansofpropulsion;andincludes:(a)abarge,lighter,orotherlikevessel;(b)ahovercraftorotherthingderivingfullorpartial

supportintheatmospherefromthereactionofairagainstthesurfaceofthewateroverwhichitoperates;

(c)asubmarineorothersubmersible;(d)apersonalwatercraft;(e)aseaplanewhenoperatingonthewater(f) asailboard,kiteboard,orpaddleboard.

Water Skiing meansbeingtowedbarefootoronanobjectofanykindotherthanavessel.

2 General Matters

2.1 Personal Flotation Devices

2.1.1 Nopersoninchargeofarecreationalcraftshalluseitorallowittobeusedunlessitcarries,atthetimeofuse,andinareadilyaccessiblelocation,sufficientpersonalflotationdevicesofanappropriatesizeforeachpersononboard,includinganypersonsbeingtowed.

2.1.2 Clauses2.1.1and2.1.7shallnotapplyto:(a) anysurferoruserofsimilarunpoweredcraft;and(b) anysailboarderorkiteboarderifawetsuitiswornatalltimes;and(c) adiveronaboatofsixmetresorlessinlengthoverallthatisusedfor

recreationaldivingwithinfivenauticalmilesofshore,ifafullbodydivesuitiswornatalltimes;and

(d) apersontrainingfororparticipatinginasportingevent,ifthetrainingortheeventissupervisedinaccordancewiththesafetysystemofasportingorganisationapprovedbytheHarbourMasterunderthisBylaw,ortheDirectorofMaritimeNewZealandunderMaritimeRule91.4(3);and

(e) amemberofavisitingforeignwatersportsteam,ifthepersoncarriesorwearsapersonalflotationdevicethatisapprovedbythecompetentauthorityforuseinthatperson’scountryofresidence.

2.1.3 Inrespectofanycultural,ceremonial,sportingevent,trainingactivity,orotherorganisedrecreationalactivity,clause2.1.1shallnotapplyifpermissionisgiveninwritingbytheHarbourMasterthatasupportvesselremainsintheimmediatevicinityofthepleasurecraftandthesupportvesselcarrieslifejacketsofanappropriatesizeforeachpersononboardthesupportvesselandthepleasurecraft.

2.1.4 Inrespectofanycultural,ceremonial,sportingevent,trainingactivity,orotherorganisedrecreationalactivity,theorganisingbodymay,whereitisnotpracticaltomeettherequirementsofclause2.1.3,applytotheHarbourMasterforawrittenexemptiontoclause2.1.1.TheHarbourMastermaygrantanexemptionforaspecifiedtimeperiod,providedthattheHarbourMasterissatisfiedthatadequatesafetyprecautionsaremadeforrescuinganypersonsparticipatingintheeventoractivity.

2.1.5 Nopersoninchargeofapleasurecraftshalluseittotowanypersonandnopersonmaycausehimselforherselftobetowedbyanyvessel,unlessthepersonbeingtowedwearsaproperlysecuredpersonalflotationdeviceofanappropriatesizeforthatperson.

2.1.6 Clause2.1.5doesnotapplytoaperson:(a) trainingforanytrickwaterskiingelementofasportingevent

administeredbyanationalsportingorganisationapprovedunderMaritimeRule91.4(3);or

(b) participatinginasportingeventthatisadministeredbyanationalsportingorganisationapprovedunderMaritimeRule91.4(3).

2.1.7 Nopersoninchargeofarecreationalcraftshallusethatcraftorallowittobeusedincircumstanceswhere:(a) tides,riverflows,roughseas,barcrossings;or(b) adverseweather,adversevisibility,emergenciesorothersituations;presentanincreasedrisktothesafetyofpersonsonboard,unlesseverypersononboardiswearingaproperlysecuredpersonalflotationdeviceofanappropriatesizeforthatperson.

2.2 Swimming or Diving around Wharves and Jetties

Nopersonshalljump,diveoff,swimorundertakeotherrelatedactivities:(a) fromorwithin50metresofanystructureintheportzoneasdefinedin

theOperativeBayofPlentyRegionalCoastalEnvironmentPlan;or(b) fromanyotherwharforjettywhenavesselismanoeuvringwithin50

metresofthewharf;or(c) anyothersuchareasinthewatersasdeterminedbytheHarbour

MasterunlesspermissionisgivenbytheHarbourMasterinwriting.

2.3 Use of Vessel Engine around Wharves, Jetties and Ramps

2.3.1 Nopersonshalloperatethepropulsionsystemofavessel:(a) whileitislyingatanywharforjetty,orwhileitisloadingtoorfrom

aboattraileratanyramp,insuchawaythatitmaydamageanyproperty,scourthebedofnavigablewaters,orinjureanyperson.However,thisclausedoesnotprecludetheuseofthepropulsionsystemforthesafeberthingorun-berthingofanyvesselatawharforjetty;or

(b) toloadorunloadavesseltoorfromatraileratanyramporlocationwherethisisprohibitedbyadirectionoftheHarbourMaster.

2.3.2 TheMasterofanycommercialvesselmust:(a) ensurethatcrewmembersarestationedbothforwardandaftonany

vesselwhilethatvesselislyingatanywharfandabouttotestoristestingapropulsionsystem;and

(b) warnallpersonsorvesselsintheimmediatevicinityofthatvesselthattheenginesarebeingtested;and

(c) notifytheHarbourMasterbeforetestingapropulsionsystemwhilethatvesselislyingatanywharf.

2.4 Vessels which are not Seaworthy

2.4.1 TheMasterandtheownerofanyvesselanchoredormooredinanywatersmustkeepthevesselinaseaworthyconditionatalltimes,unlesstheHarbourMasterhasgivenpriorwrittenapprovalforittobeanchoredormooredinanunseaworthyconditionandsubjecttosuchconditionsthattheHarbourMastermaydetermineappropriatetoensurenavigationsafety.

2.4.2 Ifanyvesselinnavigablewatersisnotseaworthy:(a) theHarbourMasteroranEnforcementOfficermaygiveadirectionto

theownerand/ortheMasterofthevesseltomovethevesseltoanalternativelocationortoremoveitfromthewaterswithinareasonabletimespecifiedinthedirection.Suchdirectionmaybegivenbyanymeansofcommunication;and

(b) theownerandMasterarejointlyandseverallyresponsibleforensuringthedirectioniscompliedwith.

(c) Iftheownerand/orMasterofthevesselfailstomovethevesselinaccordancewithadirectiongivenunderclause2.4.2(a),theHarbourMasteroranEnforcementOfficermaymovethatvesseltoapositionwhereitisnolongerahazardtonavigation,orremoveitfromthewater.ThecostsincurredbytheHarbourMasteroranyEnforcementOfficertakingactionunderthisclause,arepayablebytheowner,Master,oragentofthevesselandarerecoverableasadebtduetotheCouncil.

(d) TheHarbourMasterorEnforcementOfficershallexercisereasonablecareintakingactionunderthisclause,butneithertheynortheCouncilwillbeliableforanydamageresultingdirectlyorindirectlyfromsuchaction.

2.4.3 Nopersonshalloperateanyvesselthatisnotseaworthyexcepttocomplywiththedirections,underthisBylaw,oftheHarbourMasteroranEnforcementOfficertomovethevesseltoanalternativelocation.However,intheeventofanemergencyoranaccidentatsea,thepersoninchargeofanyunseaworthyvesselshallproceedtoasafeareaimmediately.

2.5 Seaplanes

Nopersonnavigatingavesselshallimpedeaseaplaneintheprocessoflandingortakingoff.

2.6 Vessels to be Adequately Anchored, Moored or Secured

2.6.1 Nopersonshallanchorormooravesselsoasto:(a) impedethepassageofothervesselsorobstructtheapproachtoany

commercialwharf,pierorjetty;or(b) createahazardtoothervesselsatanchororonamooring;or(c) createahazardforotherrecreationalcraft,swimmersorwaterusers.

2.6.2 Exceptinanemergencyinvolvingdangertolifeorproperty,nopersonmaycut,break,destroy,orunlawfullydetach:(a) themooringoranchoringofanyvessel;or(b) thefasteningsecuringanyvessellyingin,atoralongsideornearany

wharf,dockorlandingplace.2.6.3 Whenavesselismooredin,atoralongsideawharf,adockoralongside

awharforotherlandingplace,theownerorMastermustensurethat

adequateandsafemeansofaccesstothevesselisprovided,properlyinstalled,securedandadjustedtosuitalltidalconditions.

2.6.4 TheownerorMasterofavesselatanchor,moored,orberthedatawharf,mustensurethatitissecurelyfastenedatalltimesand,ifrequiredbytheHarbourMaster,maintainapersononboardtokeepwatch.

2.7 Prohibited Anchorages

Exceptinanemergencynopersonmayanchorormooranyvesselwithin:(a) 200metresofanysubmarinepowerortelephonecable

(b) 50metresofanycommercialberthoperatedbythePortofTaurangaLimited.

(c) NopersonshallanchoravesselwithinthenavigationalchannelbetweentheŌhauChannelDiversionWall,LakeRotoitiandshore(includingtheWildlifeProtectionAreamarkedbyredbuoys).

2.8 Restricted Anchorages

ExceptinanemergencynopersonshallanchoranyvesselwithinanyrestrictedanchorageidentifiedinSchedule1unlessthevesseliskeptreadytomakeimmediatedepartureandananchorwatchonboardthevesselismaintainedatalltimes.

2.9 Restricted Launching

NopersonshalllaunchavesselfromanyareaoftheshorewherethisisprohibitedbyadirectionoftheHarbourMaster.

2.10 Obstructions

2.10.1 Nopersonshallobstructtheaccessbywaterstoanywharf,landingplace,boatramp,slipway,navigationalchannelormooring,withoutpriorpermissionoftheHarbourMaster.

2.10.2 Nopersonshallplaceanyobstruction,includinganyvessel,fishingapparatusorstructure,inanywatersthatisliableto:(a) restrictnavigation;or(b) causeorhavepotentialtocause,lossoflifeorinjurytoanyperson;or(c) causedamagetoanyvesseloranyproperty.

2.10.3 Nopersonshallleavestabilisers,booms,cranes,davitsorotherequipmentextendingoverthesideofavesselsoastocauseahazardtoanyothervessel.

2.11 Collisions and Accidents

2.11.1 TheMasterofanyvesselthat:(a) hasbeeninvolvedinanyaccident;or

(b) hasbeeninvolvedinacollisionwithanyvesselorproperty,orhasbeensunkorgroundedorbecomestranded;or

(c) byreasonofaccident,fire,defectorotherwiseisinsuchaconditionastoaffectitssafenavigationortogiverisetodangertoanyperson,othervesselsorproperty;or

(d) inanymannergivesrisetoanobstruction;or(e) causesanydamagetoanynavigationaidorstructure,ortoanything

onthestructure;must,aswellascomplyingwithanyaccidentreportingrequirementsoftheMaritimeTransportAct1994,assoonasispracticablereporttheoccurrencetotheHarbourMasterandwithin48hoursprovidetheHarbourMasterwithfullwrittendetailsoftheoccurrence.

2.11.2 Areportunderclause2.11.1mustinclude:(a) afulldescriptionofanyinjurytopersonsandtheirnamesandtheir

addresses;and(b) afulldescriptionofanydamagetovessels,navigationaidsor

structures;and(c) thename(s)andaddress(es)ofperson(s)inchargeofthevessel;and(d) thetimeanddateoftheoccurrence;and(e) anoutlineofeventsrelatingtotheoccurrence.

2.11.3 Ifanincidentdescribedinclause2.11.1involvesdamagetoavesselthataffects,orislikelytoaffect,itsseaworthiness,theMastermaynotmovetheeffectedvesselexcept:(a) toclearthemainnavigationalchannelortomoororanchorinsafetyor(b) inaccordancewiththedirectionsoftheHarbourMaster.

2.11.4 Clause2.11.1(b)doesnotapplytoanypleasurecraftinvolvedinorganisedracingwhereaminorcollisionoccurs.

2.12 Aids to Navigation

2.12.1 Nopersonmaytieavesseltoanybuoy,beacon,orotherdeviceorstructureerectedasanavigationaidorwarning,withoutthepriorwrittenpermissionofthe:(a) HarbourMasteriftheaidtonavigationisoperatedbyalocalauthority

orportcompany;or(b) DirectorofMaritimeNewZealandiftheaidtonavigationisoperatedby

MaritimeNewZealand.2.12.2 Nopersonmaydamage,remove,defaceorotherwiseinterferewithany

buoy,beaconorotherdeviceorstructureerectedasanavigationaidorwarning.

2.12.3 Nopersonmayerect,maintainordisplayanybeacon,buoyorotherdevicewhichmaybeusedas,ormistakenfor,arecognisednavigationaid,withoutthewrittenpermissionoftheHarbourMasterandtheDirectorofMaritimeNewZealand.

2.13 Sound and Light Signals

2.13.1 Nopersonshallbloworsound,orcausetobeblownorsounded,thewhistle,sirenorhornofavessel,withinanyharbour,exceptasanavigationsafetysignal.However,nothinginthisBylawprecludes:(a) Thetestingofsuchawhistle,sirenorhornformaintenancepurposes

orbeforethevesselleavesanywharf;(b) Thestartingguns,hornsorwhistlesinanyorganisedyachtraceor

sportingactivityprovidedtheyareusedinlocationswheretherewillbenoadverseeffectonnavigationsafety.

2.13.2 Nopersonshallfitoruseanyflashinglights,sirensorothersoundorlightsignalsnotprescribedinamaritimeruleforthatvessel,withoutthewrittenpermissionoftheHarbourMaster.

2.13.3 Theuseofblueflashinglightsand/orsirensonavesselisrestrictedtoPolice,Customs,HarbourMasterorotherenforcementvesselsauthorisedbytheHarbourMaster.

2.13.4 Theuseofpurpleflashinglightsonavesselisonlypermittedsothatinanemergencyorduringanincidentaresponsecraft,authorisedbytheHarbourMaster,canidentifyitselftoavessel,aircraftorpersoninvolvedintheresponse.

2.13.5 Purpleflashinglightsmaynotbeusedwhentravellingtoorfromanincident,andimplynostatusorprivilegetothatvessel.

2.13.6 Anyvesselauthorisedtousepurpleflashinglightsbythisclausemustobserveclause3.2atalltimes.

2.14 Use of Distress Signals

2.14.1 Apersonmustnotmakeoruseadistresssignal,orcauseorpermitadistresssignaltobemadeorused,unlessthatpersonissatisfiedthat:(a) thevesselthatisonthewater(oranypersonfromthatvesseltowhich

thepersonbelongs)isinseriousorimminentdangerandrequiresimmediateassistance;or

(b) anothervessel(oranypersonfromthatvessel)isinseriousandimminentdangerandcannotitselfmakethesignalandrequiresimmediateassistance.

2.14.2 Apersonmustnotusesignalswhichmaybeconfusedwithdistresssignalsunlessthatpersonisindistress.

2.14.3 TheDirectorofMaritimeNewZealandmay,forthepurposeofallowinginstructionintheuseofdistresssignals,authoriseinwritingthemakingofdistresssignalsatsuchtimesandplaces,andsubjecttosuchotherconditions,astheDirectorthinksfit.

TheHarbourMasteristobenotifiedinwritingofthedate,timeandlocationofanintendedinstructionintheuseofdistresssignals.

2.15 Discharge into Water

Nopersonshalldischarge,drop,alloworcausetobedischargedordroppedintonavigablewaters,anycargooranythingfromanyvessel,wharforfromthelandanywherethatwouldormayconstituteadangertonavigationorsafety.

2.16 Flagged Areas on Beaches

2.16.1 TheHarbourMaster,aSurfLifeSavingNewZealandPatrolCaptain,anEnforcementOfficeroranHonoraryEnforcementOfficermay,fromtimetotime,setasideareasofbeachesasflaggedareasforthepurposesofswimmingandbodyboardingonly.

2.16.2 Nopersonmaycarryoutanyactivityotherthantheactivitiesforwhichtheareahasbeenflagged.

2.17 DirectionsbyHarbourMasterorEnforcementOfficer

2.17.1 TheHarbourMasteroranEnforcementOfficermaygivedirectionstoanyperson(includinganypersonappearingtobeinchargeofanyshiporseaplane)forthepurposeofimplementingthisBylaw.

2.17.2 Anypersontowhomadirectionisgivenunderclause2.17.1isrequiredtocomplywiththeHarbourMaster’sorEnforcementOfficer’sdirectionsassoonasisreasonablypossible.

3 Operating Requirements

3.1 Minimum Age for Operating Powered Vessels

3.1.1 Nopersonundertheageof15yearsshallbeinchargeof,propelornavigateapoweredvesselthatiscapableofaproperspeedexceeding10knotsunlessheorsheisunderdirectsupervisionofapersonovertheageof15yearswhoisinimmediatereachofthecontrols,andwhoisnotthelookoutpersonasprovidedforinclause3.4.

3.1.2 Theownerofapower-drivenvesselthatiscapableofaproperspeedexceeding10knotsmustnotallowanypersonwhoisundertheageof15yearstopropelornavigatethatvesselincontraventionofclause3.1.1.

3.1.3 Clauses3.1.1and3.1.2donotapplytoanypersonwhohasawrittenexemptionfromtheHarbourMaster.Writtenexemptionsmaybegivenfortraining,competitionsorothersportingevents,andtheHarbourMaster,whenconsideringwhetherornottograntsuchanexemption,shallhaveregardtothecompetenceoftheperson,thelevelofsupervision,andawarenessofthisBylawandsafetymatters.

3.2 Speed of Vessels

3.2.1 Nopersonshallpropelornavigateavessel(includingavesseltowingapersonoranobject)ataproperspeedexceeding5knots:(a) within50metresofanyothervessel,raft,floatingstructureorpersonin

thewater;or(b) withineither200metresoftheshoreorofanystructure,oronthe

inshoresideofanyrowofbuoysmarkinga5knotrestriction;or(c) within200metresofanyvesselorfloatingstructurethatisflyingFlagA

oftheInternationalCodeofSignals(diver’sflag).3.2.2 Nopersonshallpropelornavigateapoweredvesselataproperspeed

exceeding5knotswithanypersonatorontheforepartorbowofthatvesselorwithanyportionoftheirbodyextendingovertheforepart,bow,orsideofthatvessel.

3.2.3 Nopersonshallcauseorallowhimselforherselftobetowedbyavessel(whetherornotonawaterski,aquaplaneorothertowedobject)ataproperspeedexceeding5knotsinanycircumstancesasspecifiedinclause3.2.1.

3.2.4 Nopersoninchargeofavesselshallpermitthevesseltocontinueonwards,afteranypersonbeingtowedbythatvesselhasdropped(whetheraccidentallyorotherwise)anywaterskioranyfloatingobjectwhichmaycausedangertoanyotherpersonorvessel,withoutfirsttakingappropriateactiontoimmediatelyrecoverthatwaterskiorfloatingobject,unlessthatpersonhastakenmeasuresadequatetoensurethatthewaterskiorfloatingobjectisclearlyvisibletootherwaterusers.

3.2.5 Clause3.2.1(a)and(b)donotapplyto:(a) avesselover500grossregisteredtonnage,ifthevesselcannotbe

safelynavigatedincompliancewithclause3.2.1(a)and(b);or(b) avesseloperatinginanaccesslaneorareservedareaforthe

purposeforwhichtheaccesslaneorreservedareawasdesignated;or(c) atug,pilotvessel,HarbourMastervessel,emergencyresponse

craftorpolicevessel,ifthevessel’sdutiescannotbeperformedincompliancewithclause3.2.1(a)and(b);or

(d) acrafttrainingfororparticipatingincompetitiverowingorpaddling;or(e) anyrowingskiff,outriggercanoeorsimilarcraft.

3.2.6 Clause3.2.1(a)shallnotapplyto:(a) avesselpoweredbysailinrelationtoanyothervesselpoweredby

sail,whilethevesselsareparticipatinginayachtraceortrainingadministeredby:(i) aclubaffiliatedtoYachtingNewZealand;or(ii) anon-profitorganisationinvolvedinsailtrainingorracing;or(b) anyboardsportcarriedout,withdueregardforthesafetyofother

waterusers,andinaccordancewiththeacceptedsafepracticesoftheindividualsport.

3.2.7 Clause3.2.1(b)shallnotapplyto:(a) avesselpoweredbysailwhilethevesselisparticipatinginayacht

raceortrainingadministeredby:(i) aclubaffiliatedtoYachtingNewZealand;or(ii) anonprofitorganisationinvolvedinsailtrainingorracing;or

(b) avesseloperatinginaccordancewithaspeeduplifting;or(c) asailboarderorkiteboarder.

3.2.8 Clauses3.2.1(a)and(b)and3.2.2shallnotapplytosmallcraftoperatedbyorganisationsunderanapprovedMaritimeNZSafetyPlanandincludescraftoperatedbyaSurfLifesavingClubaffiliatedtoSurfLifesavingNewZealandthatareinvolvedinsurflifesavingoperations.

3.2.9 Everypersonwhopropelsornavigatesapleasurecraftmustensurethatitswakedoesnotcauseunnecessarydangerorriskofdamagetoothervesselsorstructures,orharmtootherpersons.

3.3 Speed Limits on Region’s WatersTheHarbourMastermayatanytimeinstructanypersonoperatingavesselnottoexceedaspecifiedspeedinanynavigablewatersforthepurposesofensuringnavigationalsafety.

3.4 Lookouts on Vessel used for Water Skiing or Towing any Person

3.4.1 Nopersoninchargeofavesselmayuseittotowanypersonunlessatleastoneadditionalpersonisonboardwhoisresponsibleforimmediatelynotifyingthepersoninchargeofeverymishapthatoccurstothepersonwhoisbeingtowed.

3.4.2 Nopersonmaycauseorallowhimselforherselftobetowedbyorfromanyvesselunlessatleastoneadditionalpersonisonboardwhoisresponsibleforimmediatelynotifyingthepersoninchargeofeverymishapthatoccurstothepersonwhoisbeingtowed.

3.4.3 Nopersonwhoisundertheageof10yearsispermittedtoactastheadditionalpersonrequiredbyclauses3.4.1and3.4.2.

3.5 Water Skiing or Towing a Person between Sunset and Sunrise or in Restricted Visibility

3.5.1 Nopersonmayoperate,betweensunsetandsunrise,orinrestrictedvisibilityavesselthatistowinganyperson,whetherornotthepersonbeingtowedisonawaterski,aquaplane,barefoot,paraglider,orothersimilarobject.

3.5.2 Nopersonmaycausehimselforherselftobetowedbyavesselbetweensunsetandsunrise.

3.5.3 Forthepurposesofthisclause,thetimesofsunsetandsunriseforanyparticulardayaretobedeterminedwithreferencetothecurrenteditionoftheNewZealandNauticalAlmanac.

3.6 Designating Temporary or Permanent Access Lanes, Reserved Areas and Speed Upliftings

3.6.1 TheCouncilmaydesignateanareaofanynavigablewaterasanaccesslaneorreservedareaforanyspecifiedpurposeonapermanentortemporarybasis.

3.6.2 TheCouncilmaydesignateanareaasbeingsubjecttoaspeedupliftingonapermanentortemporarybasis.

3.6.3 Councilhasdesignatedthepermanentaccesslanes,reservedareasandareasdesignatedasbeingsubjecttoaspeedupliftingdescribedinSchedule3.

3.7 Conduct in Access Lanes and Reserved Areas

3.7.1 Nopersonshall,inanyaccesslane,propel,navigate,ormanoeuvreavesselexceptbythemostdirectroutealongtheaccesslaneandonthatsideoftheaccesslanethatliestothestarboard(right-hand)sideofthevessel.

3.7.2 Nopersonshall:(a) whilebeingtowedbyavesselinanyaccesslane,causehimselfor

herselforanywaterski,aquaplaneorothertowedobject,onorbywhichheorsheisbeingtowed;or

(b) causeanyobjectthatisbeingtowedbyavesselinanyaccesslane;totravelotherthanbythemostdirectroutealongtheaccesslaneandonthatsideoftheaccesslanethatliestothestarboard(right-hand)sideofthevessel.

3.7.3 Nopersonwithinanaccesslaneorreservedareashallproceedinanymannerthatisdangerousinrelationtoanyvesselorotherpersonintheaccesslane.

3.7.4 Nopersonshallobstructanyotherpersonwhilethatotherpersonisusinganaccesslaneorreservedareaforthepurposeforwhichithasbeendesignated.

3.8 Marking of Access Lanes and Reserved Areas

3.8.1 Everyaccesslanemustbemarkedonshorewithorangepostswithhorizontalblackbands.

3.8.2 Anaccesslanemayalsobemarkedonthewaterwithorangebuoyswithoneormoreverticalblackstripes

3.8.3 Everyreservedareamustbemarkedonshorewithblackpostswithwhitehorizontalbandsunlessthisiscannotbepracticallyachieved.

3.8.4 Areservedareamayalsobemarkedonthewaterwithblackbuoyswithoneormoreverticalwhitestripes.

3.8.5 Adequatesignagewillidentifythelocationandpurposeforwhichaccesslanesandreservedareashavebeendesignated.

3.9 Special Events

3.9.1 Anypersonintendingtoconductarace,speedtrial,competitionorotherorganisedwateractivity,ortorecogniseculturaleventsorpractices,inanyareatowhichthisBylawappliesmustapplyinwritingtotheHarbourMasterto:(a) temporarilysuspendtheapplicationofpartorallofclause3.2of

thisBylawinthatareaduringtheconductoftherace,speedtrial,competitionorotherorganisedwateractivity;and/or

(b) temporarilyreservetheareaforthepurposeofthatactivity.3.9.2 WheretheHarbourMasterissatisfied,onconsideringanapplicationunder

thisBylaw,thattheapplicationmaybegrantedwithoutendangeringthepublic,heorshemaygranttheapplicationaccordingly,foraperiodnotexceeding10days,andonsuchconditions(ifany)astheHarbourMasterconsidersappropriate.Note: In determining applications the Harbour Master will refer to the Rotorua Lakes Closure Policy.

3.9.3 NograntofanapplicationunderthisBylawshallhaveeffectunless,notlessthan7daysnormorethan14daysbeforethestartoftheactivity,publicnoticeapprovedbytheHarbourMasterisgivenspecifyingtheperiodoftheactivityanddetailsofthesuspensionorreservedarea.

3.9.4 TheHarbourMastermayrecoverfromtheapplicantallactualandreasonablecostsincurredforthepublicationofapublicnoticeunderthisclause.

3.10 Special Designated Areas See Schedule 4 for maps.

3.10.1 WildlifeProtectionArea–ŌhauChannelDiversionWall,LakeRotoitiNopersonshalloperateanymotorisedvesselwithintheŌhauChannelDiversionWallWildlifeProtectionArea,markedbyredbuoys,anddesignatedinSchedule4.

3.10.2 ŌhiwaHarbourPWCexclusionareaNopersonshalloperateapersonalwatercraftwithinthedefinedlimitsofŌhiwaHarbourasfollows:(a) TothewestofalinefromthebeachattheeasternendofŌhope

Wharfinposition38°59.04’South177°06.50’EasttoMatureiPointinposition38°00’South177°06.20’East.

(b) TothesouthofalinefromMotureiPointthatintersectsthenorthernpointsofUretaraIslandtothewesternedgeofWhanangāpikopikoIsland(TernIsland).

(c) TotheeastofalinefromthewesternedgeofWhanangāpikopikoIsland(TernIsland)tothewesternsideofŌhiwaSpit.

3.10.3 PassiveRecreationAreas(LakesTikitapuandTarawera)WithinaPassiveRecreationAreanopersonshalloperate:

(a) Anymotorisedvessel(exceptduringthemonthsofApriltoJuneforthepurposesoffishing);or

(b) Anyothervesselataproperspeedgreaterthan5knots.WithinaPassiveRecreationAreaallvesselsmustgivewaytoswimmers.

3.10.4 PassiveAreas(LakesRotomahanaandŌkataina)OnLakesRotomahanaandŌkatainanopersonshalloperatepersonalwatercraftorhovercraft,orlandaircraftorhelicopters,ortowpeopleordevicesfromvesselsforrecreationalpurposesotherthanequipmentusedforfishing.

3.10.5 Nettingrestriction–ThorntonRivermouthNopersonmaysetanetwithina500mradiusfromtheseawardpointofthegroyneontheeasternsideoftheThorntonRivermouthexceptasprovidedforintheareasidentifiedwithinSchedule4.

3.10.7 SpeedrestrictionwithintheMatutuBasin(Nor-westernArm),LakeRotomāNopersonshalloperateavesselwithintheMatutuBasin,LakeRotomāataproperspeedgreaterthan5knots.

3.10.8 ŌkawaBaySpeedRestriction,LakeRotoitiNopersonshalloperateavesselataproperspeedgreaterthan5knotsintheŌkawaBaywaterskiingrestrictionareaunlesstowingintotheWaterSkiAreafromshore.

3.11 Closure of Areas

WheretheHarbourMasterconsiderstheretobeadangertoapersonorpersons,theHarbourMastermaycloseaccesstoanareaofwaterforanyspecifiedtime,foranyspecifieduseand/orunderspecificconditions.

3.12 Moorings

3.12.1 Nopersonshallplaceamooringinanywaters,whetherinamooringareaidentifiedinSchedule2ornot,unlessalicenceissuedbytheHarbourMasterhasbeenobtained.

3.12.2 Anymooringthatisrequestedtobeplacedoutsideamooringareashallbesubjecttoaresourceconsent.

3.12.3 TheHarbourMastermayremoveorauthorisetheremovalofanyunauthorisedmooringandtheactualandreasonablecostsofdoingsocanberecoveredbytheCouncilasadebtfromtheownerofthemooringorfromthepersonwhoinstalledit.

3.12.4 TheCouncilshallnotbeliableinanyeventfortheposition,insufficiencyorinsecurityofanyregisteredmooringsiteormooringsiteallocatedbytheHarbourMaster.

3.12.5 TheCouncilshallnotberesponsibleforanydamageorlossthatmayarisetoanyyacht,boatorlaunchpermittedtousetheregisteredmooringsiteoccasionedthroughanybreakingawayordefectintheowner’smooringsoranypartofthem,orthroughtheactofanypersonincausingdamagetotheowner’smooringsoranypartofthem,orcausedbyanyyacht,boatorlaunchwhilemooredtosuchmooringorbyanyperilsoftheseasorbynavigationofanyship,boatorlaunchwithintheregisteredmooringsiteorfromanycausewhatsoever.

3.12.6 TheHarbourMasterorthenominateddelegatehastherighttoinspectanymooringandcandirecttheownertoupgradeorrepairthemooringasconsideredappropriate.

3.12.7 Everymooredvesselshallclearlydisplayanidentificationnameornumber.3.12.8 Nopersonshallanchoranyvesselsoastoobstructanylicensedmooring.

3.12.9 TheHarbourMastermay,subjecttotheconditionsspecifiedinclauses3.12.10,3.12.11and3.12.12,grantamooringlicenceforaspecifiedmooringarea.

3.12.10 EverymooringlicenceissuedbytheHarbourMastershallapplytothevesselandowner(s)namedinthelicence,andistoberenewedannually.

3.12.11 TheconditionsofanymooringlicenceissuedbytheHarbourMastermayinclude,butarenotlimitedto:(a) thepreciselocationofthemooring;(b) thesizeandtypeofanyvesselwhichmaybeattachedtothemooring;(c) thedesignandspecificationsofthemooring;(d) arequirementformaintenanceandinspectionsofthemooringbya

mooringinspectorapprovedbytheHarbourMaster,onceeverytwoyears.Themooringinspectorwillissueacertificateofinspection/compliance;thisshallbemadeavailabletotheHarbourMaster;

(e) thetypeofbuoyorfloatwithwhichtheownerofamooringmustmarkthelocationofthemooringwhenitisnotbeingusedbyavessel;anditsidentificationnumber;

(f) arequirementthattheownerofthemooringshallbeliableinanyeventfortheposition,insufficiencyorinsecurityofanylicensedmooring.

3.12.12 TheHarbourMastershallnotgrantanylicenceforamooringunlesssatisfiedthat:(a) thereisadequatespaceinthemooringareafortheproposedmooring;

and(b) themooringisofadequatespecificationstoaccommodatethevessel

proposedtobemooredthere.3.12.13Noownerofalicensedmooringshallleaveamooringvacantor

unattendedforaperiodoflongerthansixmonthswithoutthewrittenpermissionoftheHarbourMaster.

3.12.14WheretheownerofamooringhasleftthemooringvacantorunattendedforaperiodoflongerthansixmonthswithoutthewrittenpermissionoftheHarbourMaster,theHarbourMastermaycancelthelicenceanddirectthatthemooringtackleberemoved,ormadeavailableforleaseorsale.

3.12.15Noownerofalicensedmooringmay,exceptwiththewrittenpermissionoftheHarbourMaster:(a) partwiththepossessionofthemooring;or(b) assignthemooringtoanyotherperson;or(c) sufferanyotherpersontohavetheuseofthemooring,exceptinan

emergency;or(d) usethemooringforavesselotherthanthevesselnamedinthe

licence,exceptinanemergency.3.12.16 ShouldanymooringfeesorotherchargesduetotheCouncilunderany

oftheprovisionsofthisBylawremainunpaidforaperiodof30days,then

theHarbourMastershallbeempoweredtoremovethemooringanddetainthevesseluntilsuchfeesandcharges,includingthecostofremovingthemooring,havebeenfullypaidanddischarged.Shouldsuchdebtshavenotbeenpaidanddischargedwithinafurther60days,theCouncilhastheright,afterduenotification,tosellthesaidvesseland/ormooringtorecoverthedebt.

3.12.17 Intheeventthatamooringlicenceholderdoesnotcomplywiththelicenceconditions,theHarbourMasterorthenominateddelegatehastherighttoremovethemooringand/orvessel.

3.12.18 Intheeventthatanyrequiredmooringinspectionexceedsthe2-yearlimit,theHarbourMasterhastherighttoremovethemooringand/orvessel.

3.12.19NoliabilityshallattachtotheCouncilbyreasonofanydamagewhichmayoccurtoanyvesselduringsuchremovalordetentionunlessthesameiscausedbynegligenceoftheCouncil’sservants.

3.13 Duty of Master of a Vessel under 500 Gross Tonnage

WhilstwithintheTaurangaHarbourPilotagearea,theMasterofanyvesselunder500grosstonnageshallnotallowthatvesseltoimpedethenavigationofanyvesselof500grosstonnageormore.

3.14 Dive Operations

3.14.1 TheMasterofeveryvesselfromwhichdiveoperationsareinprogressmustensurethatFlagAisdisplayedinsuchamannerthatitcanbeclearlyidentifiedbythewatchkeeperofanothervesselatadistanceinexcessof200metres.

3.14.2 EverypersondivingfromavesselmustensurethatflagAisdisplayedinsuchamannerthatitcanbeclearlyidentifiedbythewatchkeeperofanothervesselatadistanceinexcessof200metres.

3.15 Collision Prevention

NopersonshalloperateanyvesselinbreachofMaritimeRulePart22(CollisionPrevention)madeundertheMaritimeTransportAct1994.

4 Tankers, Hazardous Cargoes, Hazardous Works and Dangerous Materials

4.1 Vessels Carrying Explosives

4.1.1 TheMasterofanyvesselinanyport,harbour,roadsteadoranchoragehavingonboard,orintendingtoload,explosivesmusthoistonthevesselaredflagorFlagBoftheInternationalCodeofSignalsbydayandanall-roundredlightatthemastheadbynight.

4.1.2 TheMasterorPilotofanyvesselinanyport,harbour,roadsteadoranchorage,mustnotallowthatvesseltoapproachwithin200metresofanyothervesselthatiscarryingorloadingexplosives,except:(a) withthepriorwrittenpermissionoftheHarbourMaster;or(b) forthepurposeofloadingorunloadingthatothervessel;or(c) forthepurposeofrenderingassistancetothatothervesselinan

emergency;or(d) forthepurposeofnavigatingthevesselinthenormalprocessof

berthingorun-berthing.4.1.3 TheMasterorPilotofanyvesselcarryingexplosivesinanyport,harbour,

roadsteadoranchorage,mustnotallowthatvesseltoapproachwithin200metresofanyothervessel,except:(a) withthepriorwrittenpermissionoftheHarbourMaster;or(b) forthepurposeofloadingorunloadingthatothervessel;or(c) forthepurposeofrenderingassistancetothatothervesselinan

emergency;or(d) forthepurposeofnavigatingtheshippingchannelinthenormal

processofberthingorun-berthing.4.1.4 Nothinginclauses4.1.1,4.1.2and4.1.3appliestoanyvesselwhich:

(a) iscarryinglessthan27kilogramsofexplosives;or(b) iscarryingonlyexplosivesofDivision1ofClass6(Ammunition)or

Division3ofClass7(Fireworks)assetoutintheScheduleoftheExplosivesAct1957.

4.2 Signals to be Displayed by Oil Tankers

4.2.1 Onorimmediatelybeforethearrivalinportofanyvesselcarryingbulkoilcargo,andsolongasthevesselremainsinport,theMastermustdisplaybydayFlagBoftheInternationalCodeofSignals,andbynightanallroundredlightatthemastheadorwhereitcanbestbeseenfromalldirections.

4.2.2 However,ifthevesselcannotnormallycomplywithclause4.2.1,theMastermustinsteaddisplaybyday,inaconspicuouspositionabovethedeck,aredflagmadeofmetalnotlessthan0.6metressquareandbynightaredlightcapableofbeingseenfromalldirections.

4.3 Duties of Master while Tanker is in Harbour

4.3.1 Whileinport,theMasterofanoiltankermustoperateinaccordancewiththecurrenteditionoftheInternationalSafetyGuideforOilTankersandTerminals(ISGOTT).

4.3.2 TheMasterofatankermust:(a) berthormoorthetankeronlyatsuchwharforplaceasspecifiedforbulk

oildischargesinSchedule1,orasotherwisepermittedinwritingbytheHarbourMaster;and

(b) keepthetankscontainingClass3packinggroupsIorIIoilcargosecurelyclosed,exceptwhenopenedforloadingordischarging;and

(c) unlessexemptedbytheHarbourMaster,ensurethatsufficientmotivepowerisavailableatalltimestoenablethevesseltobemovedfromtheberthincaseoffireorotheremergency;and

(d) rigtowwiresfromthevesselbothforwardandaft.

4.4 Oil Tankers and Oil Loading and Unloading

4.4.1 TheMasterofatankermustensurethat,exceptforthepurposeoftranshipment,thetankerdoesnotliewithin30metresofanothervessel,unlessthepermissionoftheHarbourMasterhasfirstbeenobtainedinwriting.

4.4.2 Hazardousandbulkoilloadinganddischarging,betweenshipandshoreusingapipelineispermittedonlyatthelocationsspecifiedinSchedule1.

4.4.3 Non-hazardousbulkoildischargesinto,orloadingfrom,roadtankersmaybepermittedatotherberths.

4.5 Hot Work Operations

4.5.1 WithinthecommercialareasofTaurangaandWhakatāneHarbours,theMasterofeveryvesselonboardwhich,oronthehullofwhich,itisproposedtocarryoutweldingorflame-cuttingoperationsinorfromanyposition,whetheronboardthevesselornot,mustobtainfromtheHarbourMasteraHotWorkPermitinaccordancewithrequirementssetoutinSchedule5,nolessthantwohoursbeforestartingtheweldingorflame-cuttingoperations.

4.5.2 TheMasterofthevesselmustensurethatbeforeanyweldingoperationsarestarted,precautionsaretakenforthedetection,prevention,andextinguishingoffireonboardthevesselorelsewhereduringtheweldingoperations,andthattherequirementsoftheHotWorkPermitaremet.Provisionmustbemadeforthecontinuanceoftheprecautionsuntiltheoperationsarecompleted.

4.5.3 TheHarbourMastermaygrantawrittenexemptionfromcompliancewithclauses4.5.1and4.5.2totheMasterorownerofavessellyingatanyship-repairingestablishment.

4.5.4 IfinanycasetheHarbourMasterisnotsatisfiedthatadequateprecautionshavebeentaken,theHarbourMastermayforbidtheoperationstostartorcontinueuntilheorsheissosatisfiedorhascausedsuchprecautionstobetakenasheorshethinksnecessary.

5 Administrative Matters

5.1 Suspensions and Exemptions from this Bylaw

TheCouncilmay,ofitsownaccordoronapplicationbyanyperson,suspendanyprovisionofthisBylaworexemptanyactivityfromanyprovisionofthisBylaw.ThesuspensionorexemptionmaybesubjecttoconditionsandhaveeffectfortheperiodoftimethattheCouncilconsidersappropriate.Anysuspensionorexemptionmadeunderthisclausemustbenotifiedtoallinterestedpersons.

5.2 Application to Master/Owners

5.2.1 WhereanyclauseinthisBylawimposesanobligationordutyontheMasterofanyvessel,thatobligationordutymust,inthecaseofavesselthathasnoMaster,beperformedorcarriedoutbytheowner.

5.2.2 WhereanyclauseofthisBylawimposesanobligationordutyonboththeMasterandtheownerofavessel,then,ifthatclauseisnotcompliedwith,theMasterandtheowneraredeemedseverallytohavecommittedanoffenceagainstthisBylaw.IfanysuchclauseiscompliedwithbyeithertheMasterortheowner,then,forthepurposesofthisBylaw,compliancebyoneisdeemedtobecompliancebytheother.

5.2.3 AHarbourMaster,EnforcementOfficerorHonoraryEnforcementOfficermayrequiretheMasterofanyvesseloranyotherpersonswhoisfoundcommittinganoffenceagainstthisBylaworwhotheHarbourMasterhasreasonablegroundstosuspecthascommittedanoffence,tosupplytheirnameandaddresswhenrequested.

5.3 Vessels to be Licensed

5.3.1 NopersonshalloperateacommercialvesselforhireorrewardthatisnotsubjecttoMaritimeRules,unlessalicence,knownasaNavigationSafetyLicence,hasbeenauthorisedinwritingbytheHarbourMaster.

5.3.2 TheHarbourMastermayissuealicenceinrespectofclause5.3.1if,intheopinionoftheHarbourMaster,theoperationwillnotdiminishthelevelofsafetyforotheractivitiesinthevicinity,orcausecongestionorjostlingforpositionorotherunsafepractices,atpointsofembarkation/disembarkationoratanyplaceenroute.WheretheHarbourMasterconsiderstheretobenavigationalsafetymattersthatarenotaddressedbytheSafeShipManagementsystem,theHarbourMastercanrequireaNavigationSafetyLicencetobeheldbytheoperator.

5.3.3 NopersonshalloperateavesselgrantedaNavigationSafetyLicencewhilethatlicenceistemporarilysuspendedbytheHarbourMasterintermsofclause5.3.6.

5.3.4 TheHarbourMastermay,subjecttotheconditionsspecifiedinclause5.3.8,grantaNavigationSafetyLicencetoavesseltowhichclause5.3.1and5.3.2applies,whichshallberenewedannually.

5.3.5 EveryNavigationSafetyLicenceissuedbytheHarbourMastershallapplyonlytothatvesselandoperator(s)namedinthelicence,andshallbeavailableforinspectionatanytimebytheHarbourMaster,orEnforcementOfficersorHonoraryEnforcementOfficers,oranyprospectiveclientoftheoperation.

5.3.6 TheHarbourMastermaytemporarilysuspendorcancelaNavigationSafetyLicenceforsuchtimeasheorsheconsidersnecessarywhere,intheopinionoftheHarbourMaster,theconditionsofthelicencehavebeenbreached.

5.3.7 Alicencemaybecancellediftheconditionsofthatlicencearebreached.Therewillbenorefundoffeesifalicenceiscancelled.

5.3.8 ThetermsandconditionsofanyNavigationSafetyLicenceissuedbytheHarbourMastermayinclude,butarenotlimitedto:(a) definingpointsofembarkation/disembarkation;(b) definingtheareaorrouteofoperations;(c) limitingthenumberofpassengersorquantityoffreight;(d) anylimitationsinrespectofweatheroroperatinghours;(e) anyrequirementsforrescuecraft;(f) anyrequirementsforsafetyequipment;(g) thelevelofinstructiontobegiventopersonshiringavessel;(h) thequalificationsrequiredbythepersoninchargeofthevessel;(i) definingtheflowofwaterasrequiredwhereapplicable.

5.3.9 AlljetboatingandraftingoperatorsmustcomplywithMaritimeRulePart80:MarineCraftinvolvedinAdventureTourismorsubsequentlegislation.AbreachoftheseMaritimerulesshallconstituteabreachofthisBylaw.

5.4 Fees and Charges

5.4.1 ThefeesandchargesspecifiedinSchedule7foranyfunctionundertakenbytheCouncilunderthisBylaw,orinrespectofnavigationgenerally,mustbepaidondemandbythespecifiedpersontotheCouncil.

5.4.2 TheCouncilmay,fromtimetotime,byresolution,amendthefeesinSchedule7ofthisBylawthroughareviewofthisBylaworbyusingsection83oftheLocalGovernmentAct2002.

5.5 Port Charges (Harbour Dues)

TheMaster,owneroragentofanyvesselover1000grosstonnageusingtheportofTaurangaandwhichisnotexemptedshallpaytotheCouncilinrespectofsuchvesselportcharges(harbourdues)forthemanagementofnavigationalsafetyattherateasspecifiedinSchedule7ofthisBylaw.

6 Tauranga Pilotage Area

6.1 Directions for Entering and Navigating in Tauranga Pilotage Area (Vessels over 250 Gross Tonnage and Pilot Exempt Vessels)

6.1.1 CompulsoryPilotageisrequiredintheportofTaurangaasperSchedule8.6.1.2 ThatpartofTaurangaHarbourknownasNumber1Reach,Number2

Reach,theCutterChannel,MaunganuiRoadsandtheStellaPassageshallbedeemedtobeanarrowchannelinaccordancewithPart22.9oftheCollisionPreventionRules,NarrowChannels.

6.1.3 PriortoenteringTaurangaHarbour,theMasterofavesselshallcall“TaurangaPortRadio”onmarineVHFchannel12andreporttheintentionofthevesseltoentertheharbour.SuchvesselsshallmaintainalisteningwatchonmarineVHFchannel12whilstwithinharbourlimits.

6.1.4 TheMasterofavesselnotcarryingaworkingmarineVHFradioandunabletocommunicatewith“TaurangaPortRadio”shallnottransittheTaurangaHarbourentranceduringthehoursofdarknessorduringrestrictedvisibility,exceptinanemergency.

6.1.5 Allothervessels,commercialandrecreational,(whereaVHFisfitted),shallmaintainalisteningwatchonmarineVHFchannel12whenapproachingandtransitingtheTaurangaHarbourentranceandwhilstwithintheTaurangapilotagearea.

6.1.6 TheMastershallensurethatwhilewithinTaurangaHarbour:(a) automatic-steering“pilot”devicesarenottobeused,unlessa

helmsmanisstandingbyintheimmediatevicinityofthehelmorwheel,otherwisethevesselistobeinthehand-steeringmode;and

(b) mainenginesaretobeimmediatelyavailableforreducingspeed,stoppingorgoingasternatalltimeswithoutdelay;and

(c) anchorsaretobeimmediatelyavailableforuseinanemergency,andcapableofbeingusedwithoutpower;and

(d) allinformationfromaidstonavigationandchartsisfullymonitored;and

(e) allvessels,whetherunderpilotageorpilotexemptshallhaveanagreedpassageplanfortransitwithinpilotagelimits;and

(f) thenumberofcrewmembersonthebridgeshallbesufficienttosafelycarryouttheagreedpassageplan;and

(g) indeterminingthecompositionofthebridgeteam,dueregardshallbetakentothefollowing:theoperationofallcontrols,monitoringtheprogressofthevesselvisually,theuseofallavailableaidstonavigationandthattheappropriateuptodatenavigationalchartsareinuse.

6.2 Tauranga Pilotage Area – Radio Reporting Procedures for vessels departing from wharves or anchorages

6.2.1 AtleasttenminutespriortoplanneddeparturetheMasterofanyvesselover100grosstonnageshallcall“TaurangaPortRadio”onmarineVHFchannel12toreporttheirintentions,toobtaininformationaboutknownshippingtrafficmovements,andtoobtaincurrentweatherconditionsattheharbourentrance.

6.2.2 Afterleavingaberthoranchorage,theMasterofanyvesselover100grosstonnageshall,assoonaspracticable,call“TaurangaPortRadio”onmarineVHFchannel12andreportthatthevesselhasclearedtheberthoranchorage.

6.3 Navigational Documents required for Tauranga Harbour

Whennavigatinginanypartoftheharbourallvesselsof6metresinlengthandaboveshallcarryandconsultacurrentcopyofChartsNZ5412andNZ5411(orapprovedelectronicequivalent).

7 Whakatane Harbour

7.1 General Directions for Entering and Navigating in Whakatane Harbour

7.1.1 NomasterofanyvesselshallattempttocrosstheBar,ornegotiatetheentranceatatimewhenanothervesseloravesselhavinganotherintowispassingovertheBarorthroughtheentrance.

7.1.2 BarSignalARedBallbydayorafixedRedLightatnight,hoistedontheflagstaffattheSignalStationontheEastsideoftheentranceindicatesthatthebarisunworkable.

7.1.3 ThatpartofWhakatāneHarbourknownas“thenarrows”,fromtheentrancetoaperpendicularlineacrosstheriveratToka-tapu/Plaquerock,shallbedeemedtobeanarrowchannelinaccordancewithpart22.9oftheCollisionPreventionRules,NarrowChannels.

7.1.4 ThechanneladjacenttoMataatuaReservebetweenthegamefishingwharfandthemaincommercialwharfhasbeendesignatedanenginewarmupareaforsmallcraft.Smallcraftmaytravelatspeedsgreaterthan5knotscompatiblewithcircumstancesinanupstreamdirectiononlyandwhennoothervesselsarepassing.

Carriage of a Pilot

Everyvesselofmorethan250grosstonnesshallberequiredtocarryapilotunlessthemasterholdsacurrentpilotexemptioncertificate.TheMasterofanyvesselshallonlycarryaPilotdulylicensedbyMaritimeNewZealandforthePortofTauranga.TheMasterofeveryvesseltakingaPilotshall,ondemand,showthevessel’sCustomsClearancetothePilot.

Duties of a Pilot

EveryPilotshallbyeverymeansintheirpoweraidandassistanyvesselindistress.EveryPilotshallcarrytheirpilotlicencewiththem,andshallwhenrequestedproduceittotheMasterofanyvesselboardedbythem.EveryPilotshallwhenondutyobeyanyordersoftheHarbourMasterrelatingtomattersofnavigationsafety.ShouldanyaccidentoccurtoanyvesselwhereadulylicensedPilotiscarried,suchPilotshallimmediatelyreportthesameinwritingtotheHarbourMasterandMaritimeNewZealandstatingthenatureandthecauseofsuchcasualty,andtheextentofdamage(ifany)apparentlysustainedbythevessel.Ifanysuchaccidentshallhappentoanoutwardboundvessel,thePilotshallbeforeleavingsuchvessel,obtainfromitsMasterawrittenstatementconcerningtheincidentandtheconductandproceedingsofthePilot,andsuchstatementshallbegiventotheHarbourMasterandMaritimeNewZealand.AsfaraspracticabletheMasterofanyvesselhavinganycomplaintagainstanyPilotregardingnavigationsafetymustreportthesameinwritingtotheHarbourMaster,otherwisesuchcomplaintshallnotberecognised,andallcomplaintsbyanyPilotagainstaMastershallbemadeinwritingtotheHarbourMaster,whoshallforthwithforwardthesametoMaritimeNewZealand.
