    - Please read carefully the important information contained in your offer when you receive it before accepting or rejecting the offer.

    - These Terms and Conditions are correct at time of printing and may be subject to change. Terms and Conditions will be provided with your offer letter. Full Terms and Conditions are available on our website: http://sydney.edu.au/cet/terms

    1. Refund policy- To be eligible for a refund (less applicable administrative charges), you must provide notice and withdraw from the English course prior to the course commencement. Once the course has commenced you will not be eligible for a refund. (We define a course as the number of weeks you pay for).

    - Due to compliance and quality assurance, refunds or transfers cannot be granted for students studying in Direct Entry Courses (DEC) packaged with the University of Sydney.

    - Transfers and refunds can only be made in 5 week blocks (modules/terms).

    - Where fees are paid on your behalf, CET reserves the right to notify that party.

    - The refund will be made to the same person or party from whom the payment was received on your behalf.

    - Any debts to CET must be paid before any refund can be calculated with outstanding amounts being deducted from the refund.

    - The administration fee is non-refundable.

    - You must notify CET directly or through your agent if you are unable to start your course on time. Failure to do so may result in the cancellation of your enrolment and you may not be entitled to a refund of the fees paid. Missed classes will not be refunded.

    - CET will refund your tuition and other fees if your visa is rejected. You must notify CET in writing immediately and provide documentation. You must also notify CET if you are unable to obtain a visa before the commencement of the course.

    - If you cancel your enrolment more than one month before the course commencement date, you will receive a refund of 100% of fees paid excluding the administration fee.

    - If you cancel a deferred course you will receive a refund of 80% of fees paid excluding the administration fee.

    - If you cancel your enrolment less than one month before the course commencement date, you will receive a refund of 80% of fees paid excluding the administration fee

    - Refunds will be paid within six (6) weeks of receiving a written claim from you. The refund currency will be determined according to University policy.

    - All refunds are sent to the original account from which we received the funds.

    - All requests for a refund must be made on the Transfer of Fees/ Refund Form available from CET Reception or by contacting [email protected]. Requests must be accompanied by supporting documentation.

    - If you wish to contest CET’s rejection of your request for a refund please follow the Centre’s Complaint and Grievance Procedures. This agreement and the availability of complaints and appeals processes does not remove your right to take further action under Australia’s consumer protection laws.

    2. Transfer of fees- When you transfer to a formal degree course at the University of Sydney you are eligible for a transfer of the remainder of your CET fees (if any). We charge an administration fee of up to AUD$200 for this service. Note: This is not applicable to DEC students. Please note, by law, CET is not obliged to agree to a transfer of money if you transfer to another institution.

    - Transfer to another institution: If you transfer to a formal degree or diploma course at another university, TAFE or college, you MAY be eligible for a transfer (to that institution) of up to 80% of the remainder of your fees. Both CET and the other institution must approve the transfer. You should request a transfer on the CET ‘transfer form’. You may need a release letter from CET. CET will notify Immigration where necessary.

    - You must present CET with your confirmed offer from the other institution before you leave CET.

    - No refund will be made to another student, or if you transfer to another ELICOS provider.

    3. Provider defaultIn the unlikely event that CET is unable to deliver or complete the delivery of your course, and is unable to place you in a suitable alternative course in CET or with another ELICOS provider, a full refund of the remainder of your CET fees (if any) will be made within four (4) weeks of course start date.

    4. Satisfactory attendanceCET monitors daily attendance of all English students to ensure that all students meet the attendance requirements of Standard 11 of the Education Services for Overseas Students (ESOS) Act, National Code 2007. Please review the CET Student Attendance Policy, which outlines the attendance requirements: http://sydney.edu.au/cet/docs/cet-student-attendance.pdf.

    5. Courses, term dates, hours of tuition and feesAny course at the Centre for English Teaching that is appropriate for a Student Visa applicant has a maximum class size (teacher-student ratio) of 18. Centre for English Teaching courses for which a Student Visa may not be issued, such as Customised Programs, might have a larger class size. The Centre for English Teaching reserves the right to review courses, term dates, hours of tuition and fees at any time without notice. We will notify you of any changes prior to the commencement of your course. Please see our website for the latest details: http://sydney.edu.au/cet.

    6. Minimum entry ageStudents should be at least 18 years old. Applications from students aged less than 18 years old will be considered if guardianship arrangements are in place. Australian Government conditions apply. CET adheres to the University of Sydney’s Under 18 International Students Policy 2016: http://sydney.edu.au/policies/showdoc.aspx?recnum=PDOC2016/420&RendNum=0.

    7. Formalisation of your enrolmentThe National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2007, referred to as “The National Code”, is a set of nationally consistent standards that governs the protection of overseas students and delivery of courses to those students by providers registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). CET is a CRICOS registered provider of education and training to overseas students.

The National Code Part D, Standard 3 requires that there is a written agreement between CET as a registered provider and you as an overseas student setting out the services to be provided, fees payable and information in relation to refunds of course money. This standard ensures that the obligations and rights of both CET as provider and you as the student are clearly set out, including the course money payable and services that we as the provider are obliged to supply.

Your online or other form of acceptance of our offer, and the subsequent receipt by us of payment, constitutes ‘the written agreement’ between you and CET. In our offer we:

    - Identify the course or courses in which you are to be enrolled and any conditions on your enrolment. - Provide an itemised list of course and other money payable by you. - Provide information in relation to refunds of course money.

    We now also:

    - Advise that personal information about you is collected on this form and during your enrolment in order to meet our obligations under the ESOS Act and the National Code 2007; to ensure student compliance with the conditions of their visas and their obligations under Australian immigration laws generally. The authority to collect this information is contained in the Education Services for Overseas Students Act 2000, the Education Services for Overseas Students Regulations 2001 and the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2007. Information collected about you on this form and during your enrolment can be provided, in certain circumstances, to the Australian Government and designated authorities and, if relevant, the Tuition Protection Service. In other instances information collected on this form or during your enrolment can be disclosed without your consent where authorised or required by law.

    - Advise you of your obligation to notify CET as the registered provider of a change of address while enrolled at CET.

    8. Student release information and application formTo be considered for a release, please read the information and complete the application form: http://sydney.edu.au/cet/docs/CET_Release_Letter_Request_Form.pdf.

    9. Participation in activities and excursionsBy agreeing to these Terms and Conditions, you understand and agree that: - The University of Sydney and the Centre for English Teaching (CET) do not accept any responsibility or liability whatsoever if you become ill or injured or if any of your belongings become lost, damaged or destroyed while you are on an excursion or travelling to or from an excursion. - If you participate in any activities while on excursion (for example, swimming), then you do so at your own risk. You acknowledge that you are responsible for assessing your own level of skill for undertaking any particular activity. - Neither the University of Sydney nor CET is under any obligation to insure you or your property against any risks while you are on an excursion. Excursion insurance is your responsibility if you require it. - If you become ill or injured while on an excursion and are unable to give your specific consent, then first aid or other emergency or temporary care may be administered to you.

    - You waive any right to claim against the University of Sydney or CET for anything specified in section 9 of these Terms and Conditions. - If any of your family members accompany you on an excursion, then the same conditions as set out above also apply to them as a condition of their participation. - Since excursions are an integral part of face-to-face teaching and learning, missing an excursion will affect your attendance percentage for the course.

    10. Permission for photography and video-recordingBy agreeing to these Terms and Conditions, you understand and agree that:

    - The University of Sydney and CET may use photos/videos of you in promotional materials in a variety of media including the internet and these may be given to or used by a 3rd party.

    - In the event you do not want your photos/videos to be used by the University of Sydney, CET or a 3rd party it is your responsibility to inform CET personnel at the time photos/videos are being taken.

    11. Course progressPlease review the CET Progress Policy for information on the steps taken if you do not meet the progression requirements of your CET English course: http://sydney.edu.au/cet/docs/progress-policy.pdf.

    12. Student misconductIf you engage in conduct during your CET course or enrolment that constitutes a breach of the Code of Conduct for Students, or otherwise constitutes misconduct, CET may impose a penalty on you in accordance with Centre for English Teaching – Student Discipline Provisions 2017, including cancellation of your enrolment.

Code of Conduct for Students: http://sydney.edu.au/policies/showdoc.aspx?recnum=PDOC2011/215&RendNum=0

Student conduct expectations and the process for alleged breach of conduct, and penalties are outlined in the CET Student Discipline Provisions: http://sydney.edu.au/cet/docs/CET-Student-Discipline-Provisions-August-2017.pdf.
