HEY ARTISTS!Thank you for your interest in being a part of LVL UP EXPO’s 2021 Artist Alley! We are excited to offer the best of esports, anime, comics, and technology for our 9th year.

Our main focus has revolved around bringing our diverse community together with one common interest in mind: celebrating what you love!

The upcoming LVL UP EXPO will be held at the Las Vegas Convention Center on April 23 - 25, 2021, with just over 200,000 sq ft. of exhibit floor space.

This guide is designed to help prepare you for our event, so please read through it thoroughly. Should you have any questions, do not hesitate to reach out to the Booth Sales Team at [email protected] .

TERMS & CONDITIONS (1/2)By contracting to lease a booth space at LVL UP EXPO 2021, you agree to abide by our Terms and Conditions. All accepted artists will be prompted to sign that the Artist understands and agrees to our Terms and Conditions in the Artist Alley Agreemen

Booth Lease SecurementIn order for an Artist to secure booth space, Artist must: 1.) Be approved by LVL Up Expo’s Booth Sales Team. An approval email will be sent out informing Artist. 2.) Complete Registration. Registration inlcudes one hundred percent (100%) of the amount due, along with execution of Artist Alley Agreement. Any exception to this policy shall be at the sole discretion of LVL Up Expo. Artist must complete steps 1 and 2 before Artist can move into the Event.

Jury SystemArtist agrees and understands that LVL Up Expo’s Booth Sales Team elects Artists by a jury system and not on a first come, first serve basis.

Check-In During Set UpArtists must be checked in between 8AM - 10PM on Thursday, April 22. No check-ins will be available on Friday, April 23. Check-Ins are located in the main entrance lobby, where attendee registration is located. Please look for “Artist Check-in/Check-Out” Signage. If the Artist is not checked in between the above timeframe, s/he may risk forfeiture of their booth.

Set Up of Booths and Late Set Up ForfeitureSet Up Hours are Thursday, April 22, 2021 between the hours of 8:00 AM – 12:00 AM. Artists who do not install during these times, may at the discretion of Management, have their licensed space terminated, and changed or transferred to another Artist. The removed Artist shall not be entitled to a refund or any resulting damages. normal expenses of the event are paid.

Strike and Clean Up of BoothsStrike (”Dismantle”) Hours are Sunday, April 25, 2021 between the hours of 6:00 PM – 11:00 PM and Monday, April 26, 2021 between the ours of 8:00 AM – 12:00 PM. Any booths not completely dismantled and removed by these times, may result in removal by Management and associated fees will incur at prevailing rates. If an Artist dismantles and/or removes booth before these times, Artist will be flagged by Management and may not be allowed to exhibit at future events.

Character of Licensed SpaceBooths must be designed, constructed and operated in good taste and in a safe manner. All products, business and display materials must take place and be kept within the licensed space. No explosives, fuels or other combustible matter may be brought into the licensed space. Licensed space is to remain clean and free of restrictions and/or hazardous materials or odors. Sound of any kind must not be projected outside of the licensed space and noise levels are to be kept at a reasonable level. Notwithstanding the above provisions, may result in termination of licensed space and shall not be entitled to a refund or any resulting damages. Management shall reserve the right to require the removal, relocation or the modification of any licensed space, display, exhibit, or part thereof.

Inappropriate Product and Counterfeit/Bootleg MaterialArtists shall not be allowed to sell or distribute material deemed to be offensive or inappropriate. Artist will not be allowed to sell counterfeit material. Management has the sole discretion to determine what is offensive or inappropriate material. An Artist who continues to sell such materials may result in termination of their licensed space and shall not be entitled to a refund or any resulting damages.

Booth AssignmentWhile initial booth reservation may be mutually agreed to by the Artist and Management, finalassignment is the proprietary right of Management. Furthermore, the Artist shall not assign, sublet orapportion the whole or any part of the space assigned or have representatives, equipment ormaterials other than their own in the licensed space without written consent from Management.

TERMS & CONDITIONS (2/2)Event CancellationIn the event that LVL Up Expo 2021 is unable to operate, in the sole determination of ourManagement, whether due to Acts of God, force majeure, terrorism, war, illness, public safety, strike, civil commotion, picketing, fire or state of emergency, or by reason of any other occurrence not under the control of Lvl Up Expo, or otherwise, Lvl Up Expo may cancel, postpone or terminate the 2021 event, the Artist waives any and all claims the Artist may have against Lvl Up Expo for damages or expenses and agrees to accept in complete settlement and discharge of all claims, a refund of the Artist’s booth registration fee.

Artist CancellationAn Artist who elects to cancel their licensed space for any reason, on or before 90 days of the firstday of the Event will receive a full (100%) refund of the amount charged; within 90 days of the firstday of the Event will receive half (50%) refund; within 45 days of the first day of the Event, the Artistwill not be applicable to receive any refund..

Inappropriate Product and Counterfeit/Bootleg MaterialArtists shall not be allowed to sell/distribute material deemed to be offensive orinappropriate. Artist will not be allowed to sell counterfeit material. LVL Up Expo hasthe sole right to determine what is considered to be offensive or inappropriatematerial. An Artist who continues to sell such materials may be removed from theconvention hall without warning and refund.

LiabilityManagement, its directors, contractors, volunteers, and employees, shall not be responsible for anyloss, theft or property damage suffered by Artist their employees, or representatives. Furthermore,Management, it’s directors, contractors, volunteers and employees, shall not be responsible for anydamage, illness, or injury to Artist personnel, agents or attendees. Artist does hereby indemnify, save,and hold harmless Management, its directors, contractors, volunteers, and employees from any andall claims and liabilities that may ensure from any cause whatsoever, including attorney fees.

Governing LawThis Agreement will be governed by the laws of the State of Nevada without regard toconflicts of laws principles.

WaiverThe rights and remedies of the parties to this Agreement are cumulative and not alternative. Neither the failure nor any delay by any party in exercising any right, power, or privilege under this Agreement will operate as a waiver of such right, power, or privilege, and no single or partial exercise of any such right, power, or privilege will preclude any other or further exercise of such right, power, or privilege. To the maximum extent permitted by applicable law, (a) no claim or right arising out of this Agreement can be discharged by one party, in whole or in part, by a waiver or renunciation of the claim or right unless in writing signed by the other party; (b) no waiver that may be given by a party will be applicable except in the specific instance for which it is given; and (c) no notice to or demand on one party will be deemed to be a waiver of any obligation of such party or of the right of the party giving such notice or demand to take further action without notice or demand as provided in this Agreement.

Jurisdiction; Service of Process Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, thisAgreement may be brought against any of the parties in the courts of the State of Nevada, County ofClark, or, if it has or can acquire jurisdiction, in the United States District Court for the District ofNevada and each of the parties consents to the jurisdiction of such courts (and of the appropriateappellate courts) in any such action or proceeding and waives any objection to venue laid therein.Process in any action or proceeding referred to in the preceding sentence may be served on any partyanywhere in the world.

Clean Up FineAll clean up after the event must be completed no later than 12:00 pm on April 26, 2021. Clean up is not allowed the next day or at a later time. If large trash, debris, boxes, shipments, etc. is left behind by the Artist, the Artist may incur cleaning fines up to $500. Dumpsters will be easily accessible during break down times. Please properly break down all boxes before disposing.

NEVADA SALES TAXArtists will be required to complete a One Time Use Sales Tax Form, which will be provided to all artists upon checking in. After the event,Artists will need to return the form and remit the sales tax collected from sales during break down. Location to turn this in will be thesame spot as check-in. See Page 08 of this guide for location and times of check-ins and break down.

We will forward the completed return and your payment to the Department on your behalf.

All checks should be made payable to the Nevada Department of Taxation.

Cash is also accepted.

Alternatively, you can submit it to Nevada Department of Taxation. Address and due date will be available on the provided form.

BOOTH AWARDS &RECOGNITION PROGRAMAll Artists exhibiting at LVL UP EXPO 2021 will automatically be entered into our Booth Awards and Recognition Program. This will be separate from the Exhibitors’ Awards and Recognition Program. LVL UP EXPO will be awarding Artists who have the best booth display at the show based off the below listed criteria.

This program is established to recognize your efforts, as well as improve our attendees’ showroom experience. We will be giving out a total of six (6) recognition awards (three to artists and three to exhibitors), which each include $100 credit towards LVL UP EXPO 2022’s booth purchase and a guarantee of an Artist Booth for 2022.

Furthermore, LVL UP EXPO will give a shout out to your booth on our social media platforms and website!
